Unification and Coordination of Maritime Jurisdiction: Providing a Judicial Guarantee f... - 0 views

    Maritime jurisdiction plays an important role in international trade and marine transport. It involves special kinds of rules that vary among different countries and legal systems. Thus, in international maritime jurisdiction, the coordination and settlements of jurisdictional conflicts are vital for the uniformity of international maritime law. This study provides a comparative analysis of maritime jurisdiction in international trade and marine transport. First, it introduces the concept, category, and legal characteristics of maritime jurisdiction based on historical sources. Then, we conduct a comparative analysis of the civil law system, common law system, international conventions, and Chinese maritime jurisdiction provisions, focusing on their differences and the existing legal problems. Among other suggestions for the improvement of the rules of maritime jurisdiction, this study proposes the unification and coordination of maritime jurisdiction, which could impact international trade and marine transport.

    Maritime transport is a major source of pollution of marine environment, which is the essential object in a series of international maritime legislations and various countries' domestic laws. Focused on protecting the marine environment, China has spent over 40 years developing the rule of law for marine environmental governance in maritime transport, including efforts made in legislation, law enforcement, and the judiciary. In this article, we attempt to examine China's experience and practice in the marine environment, explain the logic and consideration in relevant practices, and summarize China's paradigm for the rule of law for such governance. China has sought to resolve two major issues: the relationship between domestic and international law and the balance of interests between flag, coastal, and port states, offering a vivid model of marine environmental governance on which other countries can base their own legal systems. The findings reveal that with following and enforcing the international law of the sea, now China's domestic laws have form lawful authority on binding foreign vessels. China is continually strengthening the construction of its legislative system to harmonize inconsistencies and keep pace with international marine environmental law. To eliminate administrative inefficiency resulting from cumbersome procedures, China has reformed its maritime enforcement system by consolidating multiple administrations. China's independent maritime judicial system is meeting the demand to develop environmental specialization, enabling further exploitation of its profession in solving maritime environment cases and implementing environmental legislation.

    Many marine megafauna taxa are tied to the sea surface for breathing which makes them vulnerable to vessel collisions. Sea turtles have developed efficient mechanisms to reduce surface time for breathing to a few seconds, but they can extend their surface periods to rest or to rewarm after diving into deep and colder waters. However, knowledge of collision occurrences is limited to data of turtles stranded along the coastline worldwide, whereas events occurring offshore go likely underestimated due to the sinking of carcasses. Here we performed a spatially explicit assessment to identify, for the first time, oceanic areas of higher exposure for sea turtles from maritime traffic in the Tyrrhenian Sea, Western Mediterranean. Satellite-tracking data were used to estimate utilization distributions of loggerhead turtles using Brownian bridge kernel density estimation. Maritime traffic density maps based on Automatic Identification System (AIS) data were extracted from open-access data layers, provided by the European Maritime Safety Agency, summarized, and used for the exposure analysis. Turtle occurrences were also investigated in response to vessel densities and seasonal patterns by fitting a generalized additive model to the data. Our results demonstrated that loggerhead turtles are potentially exposed to maritime traffic across the entire basin, especially in the easternmost part. The exposure varies among spring/summer and autumn/winter months. Highest turtle occurrences were found in regions primarily subjected to cargo, tanker, and passenger transportation. This study represents the first-ever effort to characterize the exposure of oceanic loggerhead turtles to maritime traffic and highlights oceanic areas of higher exposure where research and conservation efforts should be directed to understand the effective impact of this stressor on the species.

    Port and maritime studies dealing with containerization have observed traffic concentration and dispersion throughout the world. Globalization, intermodal transportation, and technological revolutions in the shipping industry have resulted in both network extension and rationalization. However, lack of precise data on inter-port relations prevent the application of wide network theories to global maritime container networks, which are often examined through case studies of specific firms or regions. This paper presents an analysis of the global liner shipping network in 1996 and 2006, a period of rapid change in port hierarchies and liner service configurations. While it refers to literature on port system development, shipping networks, and port selection, it is one of the only analyses of the properties of the global container shipping network. The paper analyzes the relative position of ports in the global network through indicators of centrality. The results reveal a certain level of robustness in the global shipping network. While transhipment hub flows and gateway flows might slightly shift among nodes in the network, the network properties remain rather stable in terms of the main nodes polarizing the network and the overall structure of the system. Additionally, mapping the changing centrality of ports confirms the impacts of global trade and logistics shifts on the port hierarchy and indicates that changes are predominantly geographic.

    The escalating greenhouse gas (GHG) emissions from maritime trade present a serious environmental and biological threat. With increasing emission reduction initiatives, such as the European Union's incorporation of the maritime sector into the emissions trading system, both challenges and opportunities emerge for maritime transport and associated industries. To address these concerns, this study presents a model specifically designed for estimating and projecting the spatiotemporal GHG emission inventory of ships, particularly when dealing with incomplete automatic identification system datasets. In the computational aspect of the model, various data processing techniques are employed to rectify inaccuracies arising from incomplete or erroneous AIS data, including big data cleaning, ship trajectory aggregation, multi-source spatiotemporal data fusion and missing data complementation. Utilizing a bottom-up ship dynamic approach, the model generates a high-resolution GHG emission inventory. This inventory contains key attributes such as the types of ships emitting GHGs, the locations of these emissions, the time periods during which emissions occur, and emissions. For predictive analytics, the model utilizes temporal fusion transformers equipped with the attention mechanism to accurately forecast the critical emission parameters, including emission locations, time frames, and quantities. Focusing on the sea area around Tianjin port-a region characterized by high shipping activity-this study achieves fine-grained emission source tracking via detailed emission inventory calculations. Moreover, the prediction model achieves a promising loss function of approximately 0.15 under the optimal parameter configuration, obtaining a better result than recurrent neural network (RNN) and long short-term memory network (LSTM) in the comparative experiments.     As an important component of new western land-sea corridor, the construction of Pinglu Canal will effectively alleviated waiting time and congestion costs and enhance the reliability and resilience of the regional maritime transport network in the post-pandemic era in particular. From the perspective of competition and cooperation game, this paper investigates typical transportation routes from the port of Jakarta in Indonesia to the port of Nanning in China from the key factors of the changes in freight volume and the evolution of profits and subsidies, considering local government subsidies, environmental costs, marine emissions and other critical factors. The results demonstrated that in the centralized strategies adopted by two transport route operators, as the volume of goods transported through Pinglu Canal increased, so the corresponding profits increased. The increase in subsidies also contributed to generating the volume of freight through Pinglu Canal, but the social welfare under the decentralized strategy adopted by both transport route operators was more effective than that of the centralized strategy.
