Two Women - 300 Identity Theft cases! - 0 views

    On Monday two women from Fort Pierce were arrested for committing 300 different cases of Identity theft on the Treasure Coast and South Florida. The two women go by the names of Tychell Letrein Robinson, 33 and Patrice V. Johnson, 26. According to the Federal Trade Commission, in 2007 Florida took fifth place in nation with regards to the number of ID theft victims per 100,000 residents. The FTC also estimated that about 9 million Americans have their identities stolen every year. The Fort Pierce Police Department, the Port St. Lucie Police Department, the Sheriff's Office as well as the U.S. Postal Service worked together in a two year investigation in order to track down these two criminals. Law enforcement agencies discovered that the arrested had somehow managed to steal the personal information of several victims and open new accounts in their names. Authorities believe that the women bought a lot of their identifying information from accomplices. In a news conference on Monday afternoon, Sheriff Ken Mascara mentioned that criminal circles were well aware that the arrested would pay accomplices $50 in exchange for peoples sensitive information. Authorities discovered that the two women met while they were both under the employment of Liberty Medical. Apparently Robinson headed the criminal operation and taught Johnson all she needed to know with regards to making thousands of dollars every week through identity theft. The arrested managed to target victims in Florida from Orlando to Clearwater and even Palm Beach. The majority of victims were from St. Lucie County and the Treasure Coast. Time-share cos fined $1.2M for telemarketing calls - 0 views

    One of the nation's largest time-share companies is going to be shelling out nearly a $1 million for making phone calls to people on the national "Do Not Call" list, federal regulators said Tuesday. Westgate Resorts, based in Orlando, Fla., was named in a complaint filed on behalf of the Federal Trade Commission. The agency alleged that Westgate and two other companies placed thousands of telemarketing calls to people on the list. The FTC says Westgate has agreed to pay $900,000 to settle the charges. The commission on Tuesday also announced a $275,000 settlement with another Florida-based travel company, Accumen Management Services Inc., and its subsidiary, All in One Vacation Club, LLC. The company made telemarketing calls to consumers who had filled out entry forms for a sweepstakes to win vacation packages. Many of those called, the FTC said, were on the Do Not Call registry and did not agree to receive the telemarketing pitches for timeshares and vacation getaways. In the case of Westgate, the agency received several thousand complaints from consumers. The commission said Westgate bought phone numbers from an Internet-based lead generator that collected contact information in connection with offerings on its Brandarama.com web site. The two other companies named in the Westgate complaint are: Central Florida Investments Inc., and CFI Sales and Marketing, LLC., which both did telemarketing for Westgate. The combined fines of $1.17 million will go to the U.S. Treasury. Calls to Westgate and Accumen seeking comment were not immediately returned. The latest enforcement actions bring to 40 the number of Do Not Call cases the government has filed against companies since the registry began in June 2003. The biggest case to date involved satellite television provider DirecTV Inc., which paid a $5.3 million settlement. More than 167 million phone numbers have been placed on the Do Not Call registry.

    Across the country, many major-college athletic departments keep their NCAA troubles secret behind a thick veil of black ink or Wite-Out. Alabama.Cincinnati. Florida. Florida State. Ohio State. Oklahoma. Oregon State. Utah. They all censor information in the name of student privacy, invoking a 35-year-old federal law whose author says it has been twisted and misused by the universities. Former U.S. Sen. James L. Buckley said it's time for Congress to rein in the Family Educational Rights and Privacy Act, which he crafted to keep academic records from public view. A six-month Dispatch investigation found that FERPA, as it's commonly called, is a law with many conflicting interpretations. And that makes it virtually impossible to decipher what is going on inside a $5 billion college-sports world that is funded by fans, donors, alumni, television networks and, at most schools, taxpayers.

A Call to Legislate Internet Privacy - Bits Blog - NYTimes.com - 0 views

    The debate on Internet privacy has begun in Congress. I had a chance to sit down recently with Representative Rick Boucher, the long-serving Virginia Democrat, who has just replaced Ed Markey, the Democrat from Massachusetts, as the chairman of the House Subcommittee looking after telecommunications, technology and the Internet. Mr. Boucher is widely regarded as one of the most technologically savvy members of Congress. As he ticked off his top priorities for his panel, most involved the pressing demands of telecommunications regulation. There is a law governing how local TV stations are carried on satellite broadcasters that needs to be renewed. There is the Universal Service Fund, which takes money from most telephone customers to pay for rural service to be improved. And there is the conversion to digital television and the investments in rural broadband to be supervised. But high on his list is a topic that is very much under his discretion: passing a bill to regulate the privacy of Internet users. "Internet users should be able to know what information is collected about them and have the opportunity to opt out," he said. While he hasn't written the bill yet, Mr. Boucher said that he, working with Representative Cliff Stearns, the Florida Republican who is the ranking minority member on the subcommittee, wants to require Web sites to disclose how they collect and use data, and give users the option to opt out of any data collection. That's not a big change from what happens now, at least on most big sites.

Thousands of Floridians may have been affected by hotel data breach -- South Florida Su... - 0 views

    Up to 21,000 Floridians may have been affected by a data breach at Wyndham Hotels & Resorts last year, prompting Attorney General Bill McCollum to ask consumers to keep a close eye on their credit statements. According to a statement released today, Wyndham reported to the Attorney General's Office that it contacted affected consumers in December and notified them that unauthorized access to Wyndham systems had potentially compromised their personal data on their debit and credit cards. The data breach has since been disabled. McCollum encouraged consumers to report any suspicious activity on their accounts to law enforcement. Affected consumers are encouraged to take precautionary steps, including obtaining a free fraud alert from one of the credit reporting agencies. Anyone who believes they may be a victim of identity theft should also request that the national credit bureaus place a fraud alert on their credit reports. Consumers should notify banks and creditors involved of questionable charges or accounts, keep records of all telephone calls and follow up in writing with credit bureaus, banks and creditors.

    A federal judge said he will decide in the next few days whether supermarket giant Hannaford Bros. is potentially liable for damages because of a data breach that exposed more than 4 million credit and debit card numbers to computer hackers. Judge D. Brock Hornby heard arguments on Wednesday at U.S. District Court. Attorneys for Hannaford asked the judge to dismiss the lawsuit, which was filed against the Scarborough-based company last year. Attorneys for the plaintiffs said Hornby should certify the case as a class-action suit and let it proceed toward trial. The upcoming ruling will determine whether parts or all of the suit will go forward. The case boils down to a couple of central questions: To what extent are merchants responsible for securing the electronic data that gets processed with every noncash purchase, and what should the consequences be when that data is stolen? "These are fascinating and difficult issues," Hornby said after hearing the arguments Wednesday. "I'll get a written decision out to you as soon as I can." Between Dec. 7, 2007, and March 10, 2008, hackers stole credit and debit card numbers, expiration dates and PIN numbers from people shopping at Hannaford supermarkets. The grocery chain operates more than 200 stores under various names in New England, New York and Florida. More than 4 million card numbers were exposed, and by the time Hannaford publicly announced the breach, on March 17, 2008, about 1,800 fraudulent charges had been made.

    In all of 2008, 40 banking institutions failed - 25 banks and 15 credit unions. So far in 2009, 72 institutions have either been closed or taken over by regulators, including 7 banks just this past weekend. The Federal Deposit Insurance Corporation (FDIC)'s troubled bank list, now at 305, has more than doubled from last year's total, when 117 banks were listed. Court Stiffs Veterans Caught in Privacy Breach | Threat Level | Wired.com - 0 views

    Veterans suffering anxiety and paranoia following the theft of a government hard drive containing the medical histories and Social Security numbers of 198,000 of their brethren cannot recover financial damages, a federal appeals court says. The 11th U.S. Circuit Court of Appeals, in largely dismissing a class-action, ruled Wednesday that the veterans could recoup at least $1,000 under the Privacy Act if they could show financial damages, not mental anguish. What's more, the Atlanta-based court noted that the veterans - some already suffering post-traumatic stress syndrome from their Vietnam War days - likely could recover damages for mental anguish associated with the data breach if the lawsuit was before a different court. That's because the courts of appeal across the nation have issued conflicting interpretations of the Privacy Act of 1974, which allows people to sue the government for privacy breaches and recover "actual damages." Precedent in the 11th Circuit, which includes Alabama, Florida and Georgia, interprets "actual damages" as money losses only. So 198,000 veterans - whose life history was on a hard drive that vanished from a Birmingham, Alabama Veterans Administration hospital - are out of luck, even if their war-time paranoia was exacerbated by the breach. The 11th Circuit noted (.pdf) that the 5th U.S. Circuit Court of Appeals and the 10th U.S. Circuit Court of Appeals "do not restrict 'actual damages' under the Privacy Act to pecuniary losses." And the Supreme Court has refused to resolve the circuit splits.

    The first sign that something was wrong seemed harmless: A new Dell credit card arrived in my mail one afternoon. More landed in the mailbox the next day. Macy's. Bloomingdale's. Crate and Barrel. Radio Shack. Then later: Visa Sony, Toys R Us and Lowe's cards turned up. I didn't request any of these cards. My first call to Dell revealed what I suspected. Someone had applied for a credit card using my name. I felt violated and vulnerable. Then, it hit me: I've become a statistic, a victim of identity theft. A thief had taken my name, my credit and my identity and managed to spend more than $8,000 (money that, I'm grateful, I didn't have to pay). I still don't know who the culprit was or how it happened. All I know is that if this happened to me - a Sun Sentinel consumer affairs and watchdog reporter - it can happen to anybody. Thieves move quickly Identity theft is the fastest growing crime in the United States, according to the Federal Trade Commission, which enforces identity theft laws. Experts estimate 10 million Americans become victims of identity fraud each year. Last year, businesses lost $56.6 billion to ID theft, the commission said. I've spent hours on the phone talking to fraud investigators, credit bureaus and bank staff as I've tried to sort out the mess that is now mine to clean up. I was exhausted every time a call ended. Individual investigations, conducted by fraud departments for each of the credit card companies that issued accounts in my name, took months to complete before concluding I was a victim of ID fraud. But there is a bright side to this story. I thought I knew how to protect myself. But what I've learned through this experience has taught me that you can never be too careful. I also learned some hard lessons along the way about how best to safeguard my personal information in the future - and respond, if my identity is targeted again.
