    The Federal Trade Commission (FTC) is getting tough on online viral marketing using blogs and other social networking sites. The proposed rules would make bloggers legally liable if they make untrue statements about products or services. Companies would face sanctions, too, if they use blogs and social networking sites to make untrue claims. "This impacts every industry and almost every single brand in our economy, and that trickles down into social media," Anthony DiResta, an attorney representing several advertising associations, told vnunet.com. The rules have been a long time coming. It's the first revision of the FTC's advertising rules since 1980. New kinds of marketing have sprouted in the last 30 years, but this is the first time the FTC is paying attention to these kinds of advertising practices. Not everyone agrees that this is a good idea. Richard O'Brien, vice-president of the American Association of Advertising Agencies, told the website, "Regulating these developing media too soon may have a chilling effect on blogs and other forms of viral marketing, as bloggers and other viral marketers will be discouraged from publishing content for fear of being held liable for any potentially misleading claim."

Diebold Admits Systemic Audit Log Failure; State Vows Inquiry | Privacy Digest - 0 views

    Premier Election Solutions (formerly Diebold Election Systems) admitted in a state hearing Tuesday that the audit logs produced by its tabulation software miss significant events, including the act of someone deleting votes on election day. The company acknowledged that the problem exists with every version of its tabulation software. The revelation confirmed that a problem uncovered by Threat Level in January, and reiterated in a report released two weeks ago by the California secretary of state's office, has widespread implications for election jurisdictions around the country that use any version of the company's Global Election Management System (GEMS) software to tabulate votes. "Today's hearing confirmed one of my worst fears," said Kim Alexander, founder and president of the non-profit California Voter Foundation. "The audit logs have been the top selling point for vendors hawking paperless voting systems. They and the jurisdictions that have used paperless voting machines have repeatedly pointed to the audit logs as the primary security mechanism and 'fail-safe' for any glitch that might occur on machines. To discover that the fail-safe itself is unreliable eliminates one of the key selling points for electronic voting security."

    Big Brother may be at it again. Behavioral advertising -- the tracking of consumer's Internet surfing activity to create tailored ads -- has triggered an intense legal controversy that has law firms scrambling to stay on top of a burgeoning practice. Attorneys say that behavioral advertising is raising privacy, litigation and regulation fears among consumer advocates, the electronic commerce and advertising industries and legislators. Law firms are busy helping companies come up with a transparent way of letting consumers know that their online activities are being tracked and possibly shared. "Lawmakers and companies are having a tough time keeping up with this new frontier of Internet privacy issues, and there is growing consumer unrest about behavioral advertising, leading in some cases to consumer rebellion," said Lisa Sotto, a partner and head of the privacy and security data group in the New York office of Richmond, Va.-based Hunton & Williams. "Consumers find this type of tracking intrusive, and businesses are starting to take the consumer reaction seriously," she said. The buzz over behavioral advertising has been building since congressional hearings that were held last year, during which Congress called on Internet service providers (ISPs) to testify about a highly controversial advertising practice known as "deep-packet inspection." The practice gives companies the ability to track every Web site consumers visit and provides a detailed look at everything they're doing, such as where they're going on vacation, who is going, how much they spent on the trip and what credit card was used. But then came the first class action targeting behavioral advertising, filed against Foster City, Calif.-based NebuAd Inc., an online advertising company accused of spying on consumers from several states and allegedly violating their privacy and computer security rights.     Even IT professionals are confused about what constitutes Web 2.0, according to a survey released Wednesday by web security vendor Websense and research firm Dynamic Markets. According to the survey, of 1,300 information technology managers across 10 countries, 17 percent of respondents correctly identified all the items on the survey that can be considered Web 2.0. IT administrators commonly identified the "obvious" Web 2.0 sites -- such as the social networking sites Facebook and LinkedIn, Dave Meizlik, director of product marketing at Websense, told SCMagazineUS.com on Tuesday. They also commonly identified blogs and micro blogs, such as Twitter, as Web 2.0. But, respondents less frequently identified other sites as Web 2.0, including iGoogle and Wikipedia, Meizlik said. Only half of respondents identified video uploading sites, such as YouTube, as part of Web 2.0, the survey found. David Lavenda, vice president of marketing and product strategy at security vendor Worklight, told SCMagazineUS.com on Wednesday that IT administrators know they need to secure the enterprise from Web 2.0 threats, but are not always sure what those threats are. "When you go to organizations where security is really important -- financial and government organizations -- and ask, 'What's your fear of Web 2.0?,' they say, 'I really don't know, but we hear enough stories of people being compromised that we don't want to take a chance.' That's the most common answer." Lavenda said.

    There is pervasive fear of identity theft. Victims spend an extraordinary amount of time and money recovering from it. The government is doing something about it, but businesses may not be pleased to hear that the government's latest action is another unfunded mandate. New rules concerning identity theft prevention at financial companies go into effect on Friday May 1, 2009, but for most organizations, complying with the FTC's Red Flags Rule could be as simple as writing down rules and procedures already in place and having them certified by the Board. The rules are about procedures, not about data security, said Tiffany George, attorney for the division of privacy and identity protection at the FTC. She spoke on Tuesday at the FTC's workshop for businesses held on the campus of Fordham University in New York City. "The Red Flags Rule covers what to do when, despite our best efforts, thieves steal data," she said. As new regulations go, the FTC's Red Flags Rule will be less painful than many other recently enacted rules. For example, while Sarbanes-Oxley is considered a burden to many public companies, requiring several full-time staff, the Red Flags Rule can likely be handled by legal or compliance staff already in place.

The reports came only days after another privacy debacle, this one self-inflicted. Photos and family information about Sir John Sawers, soon to be Britain's chief spy, appeared in another newspaper, The Mail on Sunday, after his wife posted them on Facebook. While attitudes toward privacy can appear paradoxical, the seeming contradiction is really about something else: control. When people bare their bodies on Facebook or their souls in the digital confessional of Google's search engine, they feel as if they are in charge. Not so, when the private embarrassments come to light unexpectedly.

But coming from the head of state, rather than a political candidate, the new effort quickly sparked concern among Republicans about the propriety of government collecting information on private citizens' political speech.

    Amazon has opted out of Phorm's controversial targeted advertising technology, delivering a serious blow to the UK-listed company which has already prompted a European commission legal action against the British government. Phorm's technology, which is yet to be launched in the UK, allows ISPs to track their customers' activity on the internet in order to target adverts on pages they subsequently visit. Amazon's absence from Phorm's Webwise system deprives the company of the second most visited destination, after eBay.co.uk, among shopping and classified websites in the UK, according to data from Hitwise. It means Phorm will not have access to crucial information about what Amazon users are interested in. Last month the Open Rights Group, privacy campaigners, sent a letter to nine of the internet's biggest names, including Amazon, Google, Bebo, Facebook and Yahoo, asking them to opt out of Phorm's technology "to protect your users' privacy". Google and Bebo are actively considering whether to opt out and a spokesman for Amazon said the company has now removed all its domain names - including Amazon.com - from Webwise. A spokesman for Phorm said the company does not comment on individual cases but the it is understood to be planning a meeting with Amazon's management to explain the benefits of the Webwise system.

U.S. consumers snub mobile banking on security fears | U.S. | Reuters - 0 views

    Banks and cellphone companies have a long way to go to persuade U.S. consumers to use their cellphones for banking, as many worry about security and extra fees and others are not even aware they can. In a survey of about 500 U.S. consumers, accounting firm KPMG found that only about 9 percent had tried mobile banking. In comparison, about 76 percent "consistently use" online banking services on computers. As many as 95 percent said they were so uncomfortable with conducting financial transactions on their phones that they've never used them to make a purchase on a retailer's Web site. About 48 percent of respondents cited security and privacy worries as their reason for not banking on their cellphones, according to KPMG. While many respondents said they believe mobile banking is important, according to the accounting firm, they do not think it is important enough to pay extra for it. Roughly 19 percent of respondents said they are "somewhat likely" to a use a mobile device for online banking in the next 12 months but only seven percent said are willing to pay a nominal fee for cellphone banking, according to the survey. And even though most of the major U.S. banks offer a mobile banking service, about 68 percent of the survey respondents said their bank does not offer the service. "The fact that the majority of U.S. consumers are not aware that their current banks offer mobile banking is clearly more perception than reality," said Carl Carande, a principal in KPMG LLP's Advisory and Banking and Finance practices. Banks offering mobile services include Citigroup Bank of America and Wells Fargo.

    Canadians who travelled to the United States in 2008 are being advised to check their credit-card statements and watch for signs of identity theft after a massive security breach at a U. S.-based company that processes millions of credit cards. Canada's Privacy Commissioner said yesterday she was shocked to learn that New Jersey-based Heartland Payment Systems, which processes credit-card transactions for more than 250,000 businesses in the United States, had found "malicious software" in its operating system. "I'm amazed to see something this significant can still happen with the importance that not only privacy commissioners, but experts everywhere, are placing on security," Jennifer Stoddard said. "I was concerned to see this going on and the size of it." Tech experts say the hack could be one of the largest ever credit-or debit-card data breaches, and that Canadians should watch closely for signs of identity theft.
