Doctor, Two Hospital Employees Plead Guilty to Violating Pressly's Privacy - ArkansasBu... - 0 views

    Dr. Jay Holland of Little Rock and two former employees of St. Vincent Infirmary Medical Center pleaded guilty Monday to misdemeanor violations of the federal medical records privacy law, the U.S. Attorney's Office and the FBI in Little Rock announced. Holland, Sarah Elizabeth Miller of England and Candida Griffin of Little Rock admitted accessing "without any legitimate purpose" the medical records of Anne Pressly, the KATV-TV, Channel 7, reporter who was fatally attacked in her home in October. For the violations of the Health Insurance Portability and Accountability Act, each faces up to one year in prison, a fine of up to $50,000, or both. Sentencing has not been scheduled.

Web Mail Company to Pay Prize After CEO Hacked - PC World - 0 views

    A secure Web mail company that challenged hackers to break into the company's Web mail system is paying out a US$10,000 prize, just days after launching the contest. A team of hackers managed to hack into StrongWebmail CEO Darren Berkovitz's Web mail account, using what's known as a cross-site scripting (XSS) attack, the company confirmed Monday. "They did it using an XSS script that took advantage of a vulnerability in the backend webmail program," StrongWebmail said in a statement. StrongWebmail launched the contest at the end of May as a way of promoting the voice-based identification technology sold by its parent company, Telesign. Hackers were given Berkovitz's e-mail address and password and challenged to break into the account. The company thought this would prove difficult because StrongWebmail requires a special password that is telephoned to the user before e-mail can be accessed.

    As if banks didn't have enough on their plates with compliance and regulation on the federal front, come May 1, they will have to be mindful of strict new rules coming from the Commonwealth of Massachusetts around data security. The Massachusetts Data Security Regulations are perhaps like no other in terms of their depth and scope. During a teleconference, attorneys from the privacy and data security practice of the law firm Goodwin Procter (Boston) described this very detailed, all-encompassing set of rules designed to keep consumers' personal data safe. They go beyond the rules of other states and the federal government that simply require companies to notify their customers of theft of their personal information. "Personal information," for the purposes of the regulation, is described as someone's first and last name or first initial and last name, in combination with Social Security Number, driver's license number or financial account number. At its core, the regulation states that companies, including banks, that handle the personal data of a Massachusetts resident must show they have in place a comprehensive, written information security program with heightened security procedures around how this information is handled. The rules also extend to entities' service providers and the degree to which they too much show they comply with the Massachusetts rules of handling data on residents. Companies have until May 1 to amend their vendor contracts to reflect this and until Jan. 1, 2010 to certify their vendors comply. Furthermore, companies must comply with these rules even if they do not have a single office in the Bay State or if they are in an already heavily regulated industry, like financial services. As long as customers in businesses' databases reside in Massachusetts, those companies are affected by the rules. In the letter, the bipartisan coalition, representing over 30 organizations, individual experts and the Microsoft Corporation, welcomes the renewed commitment in Congress to protecting consumers over special interests, but makes clear that trust is essential to health IT adoption and participation, and only attainable with privacy protections. The coalition is calling on Congress to "A.C.T.", by providing: accountability for access to health records, control of personal information, and transparency to protect medical consumers from abuse.     The suggestion comes after a 12 month period in which the Government has admitted losing millions of personal records, including the entire child benefit database. Richard Thomas, the information commissioner, will tell MPs that its annual tracking survey has found a big jump in the way that people view loss of personal data, excessive surveillance, privacy intrusions and identity theft. Its survey of 1,000 people found 94 per cent of people ranked "protecting personal information" as their top concern, ranked equal with concerns about crime. Public awareness of access to their personal information held by public bodies has also jumped, from 74 per cent to 86 per cent between 2007 and 2008. Mr Thomas will say that part of the reason has been the 277 data breaches by public bodies, since HM Revenue and Customs said it had lost the personal details of 25 million families on the child benefit database in October 2007.

    On January 7, backers of California's Proposition 8 filed a federal lawsuit, asking that they be exempted from complying with California election laws that require disclosure of the names of people who give as much as $100 to a campaign for or against an initiative. The case is ProtectMarriage.com v Bowen, no. 2:09-cv-00058 (Sacramento). It was assigned to U.S. District Court Judge Morrison England, who was appointed in 2002. The case depends on the 1982 U.S. Supreme Court precedent Brown v Socialist Workers '74 Campaign Committee, which said that disclosure is not compelled if there is a reasonable possibility that campaign contributors, if identified, will be subject to harassment. Besides the Socialist Workers Party, other groups that have won freedom from disclosure include the Freedom Socialist Party, Socialist Action, and the Communist Party.

But, what if you visited an investment site, only to find advertising messages suggesting therapies for your recently diagnosed heart condition? Chances are that you would experience what Fran Maier calls the "creepiness" factor, a sense that someone has been snooping into a part of your life that should remain private. Maier is the Executive Director of TrustE, a nonprofit that sets guidelines for online privacy and awards a seal of approval to companies meeting those guidelines. She was a speaker at the recent Supernova conference, an annual technology event in San Francisco organized by Wharton legal studies and business ethics professor Kevin Werbach in collaboration with Wharton. Creepiness Factor The creepiness factor is a risk inherent in so-called behavioral targeting. This practice is based on marketers anonymously observing a user's behavior on the Internet and compiling a personal profile based on interests and behavior -- sites visited, searches conducted, articles read, even emails written and received. Based on their profiles, users receive advertising targeted specifically to them, regardless of where they travel on the web. Consumer advocates worry that online data collection and tracking is going too far. Marketing executives counter that consumers benefit from seeing advertising relevant to their interests and contend that relinquishing some personal data is a reasonable trade-off for free access to Internet content, much of it supported by advertising.

In recent years, advances in computer technology have made it possible for detailed information about people to be compiled and shared more easily and cheaply than ever. That has produced many benefits for society as a whole and individual consumers. For example, it is easier for law enforcement to track down criminals, for banks to prevent fraud, and for consumers to learn about new products and services, allowing them to make better-informed purchasing decisions. At the same time, as personal information becomes more accessible, each of us - companies, associations, government agencies, and consumers - must take precautions to protect against the misuse of our information. The Federal Trade Commission is educating consumers and businesses about the importance of personal information privacy, including the security of personal information. Under the FTC Act, the Commission guards against unfairness and deception by enforcing companies' privacy promises about how they collect, use and secure consumers' personal information. Under the Gramm-Leach-Bliley Act, the Commission has implemented rules concerning financial privacy notices and the administrative, technical and physical safeguarding of personal information, and it aggressively enforces against pretexting. The Commission also protects consumer privacy under the Fair Credit Reporting Act and the Children's Online Privacy Protection Act.

Security Fix - Data Breach Highlights Role Of 'Money Mules' - 0 views

    On Friday, Brunswick, Maine-based heating and hardware firm Downeast Energy & Building Supply sent a letter notifying at least 850 customers that the company had suffered a data breach. Downeast sent the notice after discovering that hackers had broken in and stolen more than $200,000 from the company's online bank account. The attack on Downeast Energy bears all the hallmarks of online thieves who have stolen millions from dozens of other businesses, schools and counties over the past several months. In every case, the thieves appeared more interested in quick cash than in pilfering their victims' customer databases. Nevertheless, the intrusions highlight an additional cost for victims of this type of crime: complying with state data breach notification laws. "This is something new to us, fortunately, but we have responsibilities under Maine statute to report these things to our customers and employees," said the company's president, John Peters, in an interview with Security Fix. At least 44 other states and the District of Columbia have similar data breach notification laws. Sometime prior to September, attackers planted keystroke logging malware on Downeast's computer systems, and stole the credentials the company uses to manage its bank accounts online. Then, on or around Sept. 2, the hackers used that access to initiate a series of sub-$10,000 money transfers out of the company's account to at least 20 individuals around the United States who had no prior business with Downeast Energy. This type of crime is impossible without the cooperation of so-called "money mules," willing or unwitting individuals typically hired via Internet job search Web sites to act as "local agents" or "financial agents" responsible for moving money on behalf of a generic-sounding international corporation, legal experts say.The mules are then instructed to withdraw the cash and wire it via Western Union or Moneygram to fraud gangs overseas, typically in Eastern Europe.

    What companies do you trust to guard your privacy? According to a Wednesday study from the Ponemon Institute and TRUSTe, eBay is the most trusted company for privacy, followed by Verizon and the U.S. Postal Service. Facebook, meanwhile, cracked the study's top ten for the first time. To reach its conclusions, Ponemon and TRUSTe first polled more than 6,000 adults on their "most trusted" brands. An expert review panel then compared those results against the companies' privacy statements, notices, to what levels they accessed account information, their cookie management, in- and out-of-network data sharing practices, and the availability of customer service staff. Of the top 10 companies, seven of them were technology-related. The entire list includes eBay, Verizon, the U.S. Postal Service, WebMD, IBM, Procter & Gamble, Nationwide, Intuit, Yahoo, and Facebook. "With the banking industry at the center of a national financial crisis, it's no surprise to see a loss of trust reflected in the rankings of even those top performers on this list," Dr. Larry Ponemon, chairman and founder of the Ponemon Institute, said in a statement. "Meanwhile, the continued strong showing of e-businesses such as eBay, WebMD, Yahoo, and Facebook seems to demonstrate consumers' growing comfort with doing business online."

    Social networking users are more vulnerable than ever and taking more risks with their online privacy. According to the 'Bringing Social Security to the Online Community' poll by AVG, while the social networking community has serious concerns about the overall security of public spaces, few are taking the most basic of steps to protect themselves against online crimes. Participants indicated concern over growing phishing, spam and malware attacks, and nearly half of those surveyed are very concerned about their personal identity being stolen in an online community. Despite widespread use of social networks at home and/or at work, 64 per cent of users infrequently or never change their passwords on a regular basis, while 57 per cent infrequently or never adjust their privacy settings. Further, 21 per cent accept contact offerings from members they do not recognise, more than half let acquaintances or roommates access social networks on their machines, 64 per cent click on links offered by community members or contacts and 26 per cent share files within social networks. As a result of this widespread proliferation of links, files and unsolicited contacts, nearly 20 per cent have experienced identity theft, 47 per cent have been victims of malware infections and 55 per cent have seen phishing attacks.

In past years, courts showed sympathy for corporations that monitored personal email accounts accessed over corporate computer networks. Generally, judges treated corporate computers, and anything on them, as company property. Now, courts are increasingly taking into account whether employers have explicitly described how email is monitored to their employees."

Kaiser patient medical records compromised - 0 views

    "Medical records for about 15,500 Northern California Kaiser patients - about 9,000 of them in the Bay Area - were compromised after thieves stole an external drive from a Kaiser employee's car last month, Kaiser officials said Tuesday." Kaiser officials said the electronic device contained patients' names, medical record numbers and possibly ages, genders, telephone numbers, addresses and general information related to their care and treatment. No Social Security numbers or financial information was contained on the drive, and Kaiser officials said there's no evidence that the information has been used inappropriately. The device was not encrypted, but some of the information was password protected. Kaiser has sent letters to the 15,500 members and the employee, who Kaiser would not identify, has been fired.

    At the National Archives and Records Administration's annual conference Thursday, one keynote speaker asked the crowd of several hundred how many of the archivists in attendance were sold on the use of social media. Only a smattering raised their hands. Clearly, it's a challenge for the government to figure out how to navigate complex archival and e-discovery regulations that require it to capture and store all sorts of new content in the age of social media, cloud computing, and seemingly endless storage. "The federal government is in a constantly evolving records environment," Adrienne Thomas, acting archivist of the United States, said in a luncheon speech to the conference. "These are exciting and challenging times." Obama administration ambitions toward cloud computing and more openness only make that issue more complicated. "Many of us in the federal records administrations have struggled with the implications of this new direction," Paul Wester, director of modern records programs at the National Archives, said in an interview. "We deeply believe in transparency and openness, but we are concerned about FOIA, HIPAA, the Privacy Act, personally identifiable information, and compliance with the Disability Act and Federal Records Act."
