National interests creating tension in EU commission - 0 views

  • A group of EU commissioners from smaller member states is growing increasingly angry with a number of their larger-state colleagues, perceiving their actions as being driven by national interests rather than the greater European good. "We have sworn in front of the European Court not to work for our national governments back home and I am taking it seriously," a frustrated commissioner from a smaller EU country said in an off-the-record conversation with EUobserver last week.
  • "The bigger the EU becomes the more it becomes intergovernmental and the more the commission is regarded as an executive secretariat for the council," says Belgian MEP Derk Jan Eppink, a member of the European Conservatives and Reformists group in parliament. Author of Life of a European Mandarin – Inside the Commission, Mr Eppink previously worked in the cabinets of former commissioner Frits Bolkestein and subsequently that of Siim Kallas. "Commissioners from larger member states frequently feel they have to produce the goods for their governments back home, while those from smaller countries realise they don't have the capacity to do this," he said, pointing to former commissioner Gunter Verheugen's willingness to stand up for German industry.

  • This book poses two pertinent questions: First, if a European executive order is emerging, how can we empirically see it? Second, if a European executive order is emerging, how can we explain everyday decision-making processes within it? The goal of this book is two-fold: First, it identifies key institutional components of an emergent European executive order. The nucleus of this order is the European Commission. The Commission, however, is increasingly supplemented by a mushrooming parallel administration of EU-level agencies and EU committees. This book provides fresh empirical survey and interview data on the everyday decision-making behaviour, role perceptions, and identities among European civil servants who participate within these institutions. Secondly, this book claims and empirically substantiates that an emergent European executive order is a compound executive order balancing a limited set of key decision-making dynamics. One message of this book is that an emergent European executive order consists of a compound set of supranational, departmental, epistemic, and intergovernmental decision-making dynamics. Arguably, a compound European executive order transforms the inherent Westphalian order to the extent that intergovernmentalism is transcended and supplemented by a multidimensional mix of supranational, departmental and/or epistemic dynamics. This book also theoretically explores conditions under which these decision-making dynamics gain prevalence. It is argued that the decision-making dynamics emerging within an emergent European executive order are conditioned by the formal organisation of its composite parts and by the patterns of social interaction that emerge among its civil servants. Political processes and political systems can neither be adequately understood nor explained without including the organisational dimension of executive orders.

02.10.09: Croatia resumes EU membership talks - 0 views

  • Croatia, hoping to be the European Union's next country to join the bloc, resumes membership negotiations on Friday (2 October). The talks are being restarted now that a border dispute between the former Yugoslav nation and its neighbour and EU member state Slovenia is to be put to arbitration overseen by Brussels.
  • The 27-country bloc and Croatia are expected to open six new chapters of the 35 policy areas that are up for negotiation at an intergovernmental accession conference in the European capital. It is also believed that an additional five may be closed on Friday as well. If the results live up to diplomat expectations, Zagreb will have opened 28 chapters and closed 12 as of the end of the day.

The EU is seeking to establish appropriate functional superstructures extending beyond the narrow confines of trade, the economy and free market rules to accommodate its integral progress as a new force for prosperity, democracy and peace in the world. On the map of the Balkans, the local political actors continue to define their choices in line with their historic experience and stereotypes, especially as regards their neighbours and the Great Powers of the moment. The Balkan countries, which in any case are still seeking to consolidate their conventional state structures, need much more time to find their place within this unfinished supranational European structure. In both cases the actors involved, whether in the EU or in the Balkans, are grappling with the challenges of global politics from their different starting-points, but it is not easy to overcome the boundaries of their national sovereignty.

  • European Union leaders have come to a consensus that the bloc's treaty must be changed, although only in a limited fashion, in order to allow for the creation of a permanent bail-out fund for member states. "Today we took important decisions to strengthen the euro," European Council President Herman Van Rompuy told reporters at a press conference in the early morning hours of Friday (29 October).
  • Initially horrified at the Franco-German demand for a wholesale re-writing of the EU rulebook only a year after the Lisbon Treaty had been approved, the other EU leaders are now warming to the idea of a "limited" tweaking of the treaty in a way that they hope will avoid major political fall-out. "Heads of state and government agree on the need for member states to establish a permanent crisis mechanism to safeguard the financial stability of the euro area as a whole and invite the president of the European Council to undertake consultations with the members of the European Council on a limited treaty change required to that effect," the draft conclusions of a two-day summit in Brussels read.
  • "No country is opposed in principle to a moderate treaty change but they want to know what the political and legal consequences of this would be," said one source close to the discussions. Two moves have been tentatively agreed. EU Council President Herman Van Rompuy is to be tasked with exploring whether such a limited change can be done via a simplified revision procedure, in which EU leaders can make the change without having to call a full Intergovernmental Conference (IGC) - involving negotiations between the governments, consultations with the European Parliament and the participation of the European Commission, which could open a Pandora's Box of other new proposals. Mr Van Rompuy would also explore whether legally this can be done without the tweak having to be presented to national parliaments for approval, which would almost certainly grind down the process, or even further, whether such a move would provoke referendums in some countries, notably Ireland, which maintains a constitutional requirement that any shift in powers from Dublin to Brussels be approved in a vote by the people. He would report back to the European Council in December.

18.12.08: Slovenia to block Croatia EU accession talks - 0 views

  • Slovenia said on Wednesday (17 December) it would block further accession talks with EU candidate Croatia due to a long-running border dispute between the two countries. Zagreb was hoping to open 10 new chapters of its accession negotiations package with the EU and close another five during an intergovernmental conference on Friday (19 December) in Brussels.
  • But speaking ahead of the meeting, Slovenian Prime Minister Borut Pahor said his country had reservations, arguing that documents – notably maps – Croatia had provided during its accession process could prejudge a solution of their long-running border dispute. "Slovenia has reservations concerning seven chapters, since the documents presented by Croatia could prejudge the common border," Mr Pahor told journalists in Ljubljana. "And concerning another four chapters, we also have substantial reservations," he said, adding that Slovenia would at this stage "only give its consent to open one chapter and close three."

  • For its part, Croatia strongly criticised the "unprecedented" decision by Slovenia. "Croatia isn't and won't be ready nor will it ever accept blackmail and exclusivism, which have no place in the EU... We won't buy our membership of the EU with territory. This is our firm position and our friends in Slovenia must know this," Croatian Prime Minister Ivo Sanader told journalists in Zagreb, Croatian news agency Hina reported.

  • A compromise package aimed at convincing the Irish to return to the urns and agree to the Lisbon Treaty seems to be taking shape as Dublin considers opt-outs on defence. Meanwhile, EU countries appear to be leaning towards retaining the current system of one commissioner per country in response to Ireland's concerns that it may lose its commissioner.
  • According to the source, keeping the present system of one commissioner per country may not only serve to give the Irish a sense of having accomplished an important goal with their negative vote. Such a measure could also be easily adopted (by means of a brief intergovernmental conference) because other countries are starting to have second thoughts about reducing the number of commissioners, the source added.

  • The big question: who to choose?  In the absence of formal criteria, much speculation has broken out over who should take up the role of EU president.     Poland has reaffirmed it will not bow to pressure from its EU partners and is set to push for a fresh debate on the voting system in upcoming talks on a new treaty for the bloc.

    "We're going to talk about this at the intergovernmental conference simply because, when something is decided, it has to be acted upon", Polish prime minister Jaroslaw Kaczynski told Polish public radio on Wednesday (4 July).

    Poland's main concern centres around a specific part of the voting system which allows countries to delay an EU decision if they fall just short of the required number of countries to block it.

    Warsaw claims it secured a gentleman's agreement at a meeting of EU leaders last month, allowing countries to delay decisions by up to two years.

    However, the written mandate for negotiating a new EU treaty only promises a reasonable delay, which some officials say should not exceed four months.

  • The incoming Portuguese presidency has set aside just three months for negotiation on a new EU treaty, believing the weekend's tempestuous summit resulted in sufficiently clear directions to wrap up a new text. According to Portuguese ambassador Alvaro Mendonca, formal negotiations will be opened on 23 July with the aim to have them signed off by EU leaders on 18-19 October.

22.04.09: Time running out for Croatia's EU reforms - 0 views

  • The structural reforms Croatia still needs to carry out are more likely to hold up its EU membership bid than the current border dispute with Slovenia, a senior EU official has warned. "I would be more concerned about structural reforms [in Croatia]" than about the border dispute, Vincent Degert, head of the European Commission's delegation in Croatia told a group of journalists in Zagreb on Monday (20 April).
  • Mr Degert spoke about justice reform, as well as the need to restructure Croatia's shipyards and the agriculture sector, as some of the key areas where progress is still needed. "These are the hardcore reforms," he said, with Croatia hoping to finish membership negotiations within the next eight months and enter the EU by 2011.
  • Meanwhile, the 18-year-old dispute on the delimitation of the sea border between Slovenia and Croatia has been escalating in the last months, after Ljubljana blocked Zagreb's EU accession talks in December. The blockage is now threatening to delay the EU entry timetable targeted by Croatia. An intergovernmental EU-Croatia conference planned for the end of March was postponed and is now scheduled to take place on Friday.

  • In a new setback to Croatia's EU bid, the Czech EU presidency on Wednesday (24 June) cancelled an EU-Croatia intergovernmental conference planned for 26 June due to a lack of progress in Croatia and Slovenia's border dispute which has been blocking Zagreb's EU accession talks for six months.
  • "Despite substantial efforts to facilitate a solution to the country's border dispute with Slovenia, Croatia's accession talks remain blocked and no new chapters can be formally opened or closed," the Czech presidency said in a statement.

  • Bulgaria is threatening to block Turkey's application to join the European Union unless it pays out billions of euros in compensation for displaced people, in a case dating back to the days of the Ottoman Empire. A Bulgarian cabinet minister without portfolio who runs the country's Agency for Bulgarians Abroad, Bojidar Dimitrov, pressed the claim in remarks to the Bulgarian newspaper, 24 Hours, on Sunday (3 January).
  • "Turkey is surely able to pay this sum, after all, it's the 16th largest economic power in the world," he said, putting a total of $20 billion (€14 billion) on the settlement. "One of the three conditions of Turkey's full membership of the EU is solving the problem of the real estate of Thracian refugees." The Ottoman Empire in 1913 expelled hundreds of thousands of ethnic Bulgarians from lands lying on the western side of the Bosphorus. It became the Republic of Turkey in 1923 and recognised the rights of the displaced people in a 1925 treaty, but the agreement was never implemented, Bulgaria says. An official in the Bulgarian government press office, Veselin Ninov, told EUobserver on Monday that Mr Dimitrov's statement reflects government policy and that the dispute is being handled by a Bulgarian-Turkish intergovernmental working group.

17.12.10: European Parliament condems the outcome of the European Council - 0 views

  • The centre and left of the European Parliament have robustly condemned the outcome of the European Council, complaining that the interest of the bloc as a whole has been sidelined in favour of national interests. It is common for the groups in the parliament to criticise the results of European summits, but the missives issued the afternoon following the meeting were abnormally trenchant.
  • The Party of European Socialists "condemned" the result, attacking the "conservative leaders" who hold a majority in the Council. "The Conservative leaders are fundamentally mistaken. Yet again they have failed to take control of the crisis," said Poul Nyrup Rasmussen, the former Danish prime minister and leader of the PES. "The reaction of the Markets illustrates this clearly." Mr Rasmussen pointed to the overnight downgrading of Irish bonds by the Moody's credit agency as signifying that the investors were unconvinced by the council's plan. He warned that the EU Council had put itself in "direct conflict" with the parliament over its refusal to countenance any move towards debt issuance at the EU level. "The German, British, Swedish and Dutch Governments formed a roadblock to progress on the eurobonds issue. So blatantly putting national interest before European recovery is short-termist and lacking in leadership," he said.
  • The European Parliament must be consulted on the treaty change, but it has no co-decision power under the 'simplified revision procedure' - the new method the EU leaders are using to deliver the limited treaty change while avoiding any national referendums. But, depending on the fine print of how the permanent bail-out fund is constructed, it may have approval powers. The EU prime ministers and presidents at the summit did not take any decisions on the details of the fund. According to a parliamentary legal expert, if the European Council itself develops the mechanism on an 'intergovernmental' basis, and the fund is similar to the existing €440 billion rescue mechanism, which involves a series of loan guarantees by member states, then the chamber will only be consulted, as with the treaty change. But if the EU is asked to develop and present a proposal, or if it involves any direct EU funds as well as national loan guarantees, then "this is part of the community method, and the parliament has co-decision powers". The Greens also said that the permanent crisis mechanism "will not be enough to get Europe out of the crisis."
