Reform does not take place in a vacuum and the successful reform of the Bosnian polity is dependent on public support. Public demands for reform are likely to be influenced by how the current institutions are believed to be functioning and by the public support for the current institutional set-up as such. Still, the demands for alterations by the political elites of the different national communities highlight a continuing lack of consensus. Although the Constitution allows for a revision, the political room for such changes is limited, and the challenge remains to provide adequate degree of autonomy of national groups without diminishing the quality of democracy. The need to differentiate between the protection of legitimate national and minority rights and unacceptable nationalist demands emerges as a challenge with no easy solution. Best et al., eds. (2008): The Institutions of the Enlarged European Union - 0 views

  • How have the main institutions and decision-making processes of the EU responded to the arrival of new member states? This book assesses the actual state of the EU institutions in the years after the 2004 enlargement, examining each of the main institutional actors as well as trends in legislative output, implementing measures and non-legislative approaches. The contributors outline the key changes as well as patterns of continuity in the institutional politics of the EU. The analysis finds that breakdown has been avoided by a combination of assimilation of the new member states and adaptation of the system, without any fundamental transformation of the institutions. Nonetheless, they conclude that it is not just 'business as usual'.The streamlining and formalization of procedures, together with increased informal practices, has implications for transparency and accountability. Widening has not prevented deepening of European integration, but it has deepened normative concerns about the democratic legitimacy of that process which will remain very much on the agenda of the enlarged EU. This nuanced approach to the complexities of studying institutional politics and change contains important new and original data. As such it will be invaluable for postgraduate and advanced undergraduate students of EU politics and administrative science, as well as researchers, practitioners and journalists working in the fields of European studies more widely.

  • Since its inception, the European Union has stimulated many vigorous debates. This Living Review provides a state of the field perspective on the academic work that has been done to address the question of the perceptions of the European Union as a system of governance. It takes a broad scope in assessing the efforts of scholars and highlights significant theoretical and empirical contributions as well as identifying potential avenues for research. In order to understand perceptions of the EU, scholars have employed national-level frameworks of popular support, particularly partisanship and instrumental self-interest. As the number of members has increased, further research has taken a broader scope to include national identity, institutions, and attitudes regarding the normative and empirical function of both national and EU institutions. Additional works address political intermediaries such as parties, media, and elites. Finally, all of the works are fundamentally concerned with the supportive popular sentiment that underpins the EU’s legitimacy as a political institution. While there are far more works that can be practically included in this Living Review, we have attempted to construct an overview based on the dimensions that define this research as set out by significant contributions at the core of this literature.

Best et al. (2008) The Institutions of the Enlarged European Union - 0 views

  • This timely, comprehensive and authoritative study provides much food for thought for European policy makers, particularly in the current situation of uncertainty about the Lisbon Treaty. The authors' basically upbeat findings - that, despite the arrival of twelve new member states in one big bang and one after shock, it has been pretty much business as usual for the EU's institutions - will comfort both those who worried about the EU's capacity to act in the absence of institutional reform and those who argued that such reform was unnecessary. But the editors identify a number of emerging dynamics that will be of concern to all who care about the Union's democratic future: increasing formalisation of meetings and procedures on the one hand, coupled with an increase in informal, pre-cooked deals on the other; increasing primacy of the administrative over the political; and a growing trend towards "presidentialisation" within the institutions, with continued efficiency requiring more emphasis on the "primus" than on the "pares". The editors conclude that, while the European Union's institutional system continues to function and might even become more efficient, the price to be paid could further distance the Union from the citizens it seeks to serve.'

  • It is universally accepted that there has been a huge growth in EU lobbying over the past few decades. There is now a dense EU interest group system. This entirely new volume, inspired by Mazey & Richardson's 1993 book Lobbying in the European Community, seeks to understand the role of interest groups in the policy process from agenda-setting to implementation. Specifically, the book is interested in observing how interest groups organise to influence the EU institutions and how they select different coalitions along the policy process and in different policy domains. In looking at 20 years of change, the book captures processes of institutional and actor learning, professionalisation of lobbying, and the possible emergence of a distinct EU public policy style. More specifically, from the actors' perspective, the editors are interested in assessing how the rise of direct lobbying and the emergence of fluid issue-based coalitions has changed the logic of collective action, and what is the potential impact of 'venue-shopping' on reputation and influence. From an institutional perspective, the contributors explore resource and legitimacy demands, and the practical impact of consultation processes on the emergence of a distinct EU lobbying relationship. It will be essential reading for academics and practitioners alike.

01.09.09: Swedes plan big bang institutional summit in October - 0 views

  • - Sweden is hoping to clear up the EU's distracting institutional issues in one grand summit next month in order to drag the union's focus back to pressing international issues.

    Speaking to MEPs on Tuesday (1 September) Cecilia Malmstrom, Sweden's Europe minister, said: "Our aim is - if everything goes smoothly and the Lisbon treaty is adopted - that at the October council ...we can decide on all the institutional issues."

    The gathering of EU leaders at the end of next month should appoint the new list of commissioners, the new EU foreign minister and the president of the European Council.

    According to Mrs Malstrom, the summit should also agree a "loose framework" for the EU's fledgling diplomatic service.

  • This book examines in depth the impact of the EU on aspects of the quality of democracy in eight selected post-communist countries. Considering both the political and legal aspects of the dynamics among institutions and focussing on inter-institutional accountability, the book analyses how constitutional designs have been effectively implemented to achieve this, and to what extent this was the result of EU action. In order to make a comparative assessment of the EU on democracies, the book features detailed case studies according to their different status vis-a-vis the EU, including older new member states: Poland and Hungary; newer new member states: Romania and Bulgaria; potential candidates: Albania and Serbia; and neighbour and remote neighbour states: Ukraine and Armenia.     This Living Reviews article evaluates the most important strains of social science research on the impact of the European Court of Justice (ECJ) on integration, EU-level policymaking, and national legal orders. Section 2 defines the concepts of judicialization and governance, and discusses how they are related. As the article demonstrates, the "constitutionalization of the EU," and its effect on EU governance, is one of the most complex and dramatic examples of judicialization in world history. Section 3 discusses the institutional determinants of judicial authority in the EU in light of delegation theory. The European Court, a Trustee of the Treaty system rather than a simple Agent of the Member States, operates in an unusually broad zone of discretion, a situation the Court has exploited in its efforts to enhance the effectiveness of EU law. Section 4 focuses on the extraordinary impact of the European Court of Justice, and of the legal system it manages, on the overall course of market and political integration. Section 5 provides an overview of the process through which the ECJ's case law - its jurisprudence - influences the decision-making of non-judicial EU organs and officials.   • A renowned research institute has suggested that Macedonia change its name to an agreed formula on the day of its EU accession as a means of resolving its ongoing dispute with Greece. As exotic as this may seem, the proposal has already triggered interest and debate in regional media.
  • The proposal, signed by ESI President Gerald Knaus, has triggered a lot of interest and debate in regional media, the institute notes in a press release circulated yesterday (12 July).
  • While most Europeans find the Greek position puzzling or irrational, the prevailing political thinking in many capitals is that the EU enlargement process should be slowed down, the ESI paper notes. In this context, the fact that Macedonia's EU bid is stuck is even welcome, the institute claims. Gerald Knaus is categorical in saying that if a compromise between Skopje and Athens is reached, then a referendum in Macedonia will be called. But the Macedonian politicians who may be ready to make concessions over the country's name would do so only on the condition that it would actually ensure the country's EU accession, the ESI director argues. To "square the circle," the ESI suggests making a constitutional amendment in Skopje that changes the country's name now, allowing Athens to support the start of EU accession talks later this year. But the amendment would only foresee the change's entry into force on the day Macedonia actually joins the EU. The proposed constitutional change could read: "All references to the Republic of Macedonia in this constitution will be replaced by a reference to XX (a compromise name) on the day this country joins the European Union." If for some reason Skopje never joins the EU, it will never have to change its name, the ESI paper reads. Knaus also argues that the proposed solution would allow both countries and their leaders to claim victory. In parallel, Greece should promise to allow Macedonia to join NATO under the name FYROM (the name under which Macedonia joined the UN) once the constitutional changes have been passed, he says.

  • Member states are considering taking the EU Parliament to court if it does not back down on demands for new powers on EU foreign policy and international agreements, EUobserver has learnt. Ambassadors representing member states at a meeting in Brussels on Wednesday (13 October) signaled their discontent over an inter-institutional agreement between the European Commission and the EU legislature which may give fresh powers to euro-deputies, especially when it comes to international negotiations on behalf of the EU.
  • The draft report, according to an analysis by the council of ministers' legal services, could lead to a stand-off between EU institutions if adopted as such next week in Strasbourg. "The court option is not off the table," one EU source said. Ambassadors will come back to the matter in their meeting next Wednesday, following the MEP's vote in the plenary. The crux of the matter is to what extent MEPs can be part of EU delegations to multilateral and bilateral meetings and negotiations with other countries. According to the draft, the Parliament wants to have its representatives guaranteed participation in all multilateral, but also bilateral agreements "of particular political importance" - for instance on trade or fisheries.

  • In a report on the western Balkan countries' progress towards the EU that the European Commission will present next week, Brussels will reiterate a warning it expressed earlier about Bosnia and Herzegovina's political instability and the lack of reform in the country. "Constitutional elements established by the Dayton/Paris peace agreement [which ended the 1992 – 1995 war in Bosnia] have been challenged by key political leaders in both entities" of Bosnia – the Serb-populated Republika Srpska and the federation of Bosnia and Herzegovina.
  • "The lack of consensus on the main features of state building… and [the] inflammatory rhetoric have adversely affected the functioning of institutions and have slowed down reform" in the country, reads the draft of the document seen by the EUobserver.

  • This book poses two pertinent questions: First, if a European executive order is emerging, how can we empirically see it? Second, if a European executive order is emerging, how can we explain everyday decision-making processes within it? The goal of this book is two-fold: First, it identifies key institutional components of an emergent European executive order. The nucleus of this order is the European Commission. The Commission, however, is increasingly supplemented by a mushrooming parallel administration of EU-level agencies and EU committees. This book provides fresh empirical survey and interview data on the everyday decision-making behaviour, role perceptions, and identities among European civil servants who participate within these institutions. Secondly, this book claims and empirically substantiates that an emergent European executive order is a compound executive order balancing a limited set of key decision-making dynamics. One message of this book is that an emergent European executive order consists of a compound set of supranational, departmental, epistemic, and intergovernmental decision-making dynamics. Arguably, a compound European executive order transforms the inherent Westphalian order to the extent that intergovernmentalism is transcended and supplemented by a multidimensional mix of supranational, departmental and/or epistemic dynamics. This book also theoretically explores conditions under which these decision-making dynamics gain prevalence. It is argued that the decision-making dynamics emerging within an emergent European executive order are conditioned by the formal organisation of its composite parts and by the patterns of social interaction that emerge among its civil servants. Political processes and political systems can neither be adequately understood nor explained without including the organisational dimension of executive orders.

08.10.09: Barroso fears powerful 'European president' - 0 views

  • European Commission President Jose Manuel Barroso has sided with smaller member states in trying to restrict the role of the proposed president of the European Council, a new post created by the Lisbon Treaty. Addressing the European Parliament on Wednesday (7 October), Mr Barroso chastised MEPs for referring to the post as "president of Europe."
  • "I am sorry, there will not be a president of Europe. There will be, if we have Lisbon, the president of the European Council. It is important to understand that point because sometimes I think there are some ideas about certain derives institutionelles [institutional drifts]," he said.
  • The commission president has no formal powers in appointing the European Council president but he warned: "The European Commission will not accept the idea that the president of European Council is the president of Europe." Mr Barroso's remarks came shortly after a leaked paper on the new Lisbon Treaty posts by Belgium, the Netherlands and Luxembourg underlined the importance of maintaining the "institutional balance" of the union. The paper has been interpreted in some quarters as an anti-Blair move. Poland has also prepared a document on the role of the president of the European Council. Earlier this week, Polish Europe minister Mikolaj Dowgielewicz indicated to EUobserver the limited role that Warsaw foresees for the new president.
