While checking final edits on their new book, two media-studies scholars are informed by their publisher that they must secure permission to use a magazine cover as an illustration of one of their assertions. Instead of dropping the graphic or making cold calls to the magazine, the scholars explain their fair-use rights under copyright-and the publisher's general counsel agrees.

This past April in Switzerland, Lawrence Lessig gave an impassioned lecture denouncing publishers' paywalls, which charge fees to read scholarly research, thus blocking most people from access. It was a familiar theme for Mr. Lessig, a professor at Harvard Law School who is one of the world's most outspoken critics of intellectual-property laws. But in this speech he gave special attention to JSTOR, a not-for-profit journal archive. He cited a tweet from a scholar who called JSTOR "morally offensive" for charging $20 for a six-page 1932 article from the California Historical Society Quarterly. The JSTOR archive is not usually cast as a leading villain by open-access advocates. But Mr. Lessig surely knew in April something that his Swiss audience did not: Aaron Swartz-a friend and former Harvard colleague of Mr. Lessig's-was under investigation for misappropriating more than 4.8 million scholarly papers and other files from JSTOR. On July 19, exactly three months after Mr. Lessig's speech, federal prosecutors unsealed an indictment charging that Mr. Swartz had abused computer networks at the Massachusetts Institute of Technology and disrupted JSTOR's servers. If convicted on all counts, Mr. Swartz faces up to 35 years in prison."

However, one must say the country's leading newspapers scored an own goal when they took Google to court last year for listing their content in the search engine's news section and won on copyright. I guess they didn't look at how people arrive at a typical online newspaper site, which derives up to 50 percent or more of their visitors from Google. In addition to taking the group of papers out of its news section, Google also stopped indexing them in its search engine. Now the newspapers are complaining that they are being discriminated against unfairly! (...) Google has big power and the danger is how the company wields it in pursuit of profit. It brings traffic to websites, but the company that claims to "do no evil" can also taketh away ostracising those for good and bad reasons. The company is also stepping up its aggregation news service by trying to attract more volume through the "gamification" of Google News. Google is following a trend among news sites to bring readers in. With their consent, readers will be rewarded with "news badges" based on their reading habits. Badges of varying levels will be given out depending on the amount and types of articles you read. About 500 badges are available to suit a wide range of topics. Peter Walker guardian.co.uk, Sunday 3 July 2011 "Britons could face charges for breaking US copyrights even if they have no link to America and servers are based elsewhere" "British website owners could face extradition to the US on piracy charges even if their operation has no connection to America and does something which is most probably legal in the UK, the official leading US web anti-piracy efforts has told the Guardian. The US's Immigration and Customs Enforcement agency (ICE) is targeting overseas websites it believes are breaking US copyrights whether or not their servers are based in America or there is another direct US link, said Erik Barnett, the agency's assistant deputy director. As long as a website's address ends in .com or .net, if it is implicated in the spread of pirated US-made films, TV or other media it is a legitimate target to be closed down or targeted for prosecution, Barnett said."

If you embed a YouTube video that turns out to be infringing, and more than 10 people view it because of your link... you could be facing five years in jail. This is, of course, ridiculous, and suggests (yet again) politicians who are regulating a technology they simply do not understand. Should it really be a criminal act to embed a YouTube video, even if you don't know it was infringing...? This could create a massive chilling effect to the very useful service YouTube provides in letting people embed videos."

This is why we tabled a text originally elaborated by the World Blind Union, by people who know best the reality on the ground; (2) The international copyright regime is a mature system, with more than 120 years of implementation experience in many countries. It is feasible to craft precise and effective E&L norms without depriving the rights of authors to reap the benefits of their creativity. We all recognize those rights and are fully committed to defend them. Let there be no doubt about it. Those two assumptions remain the guiding principles underlying Brazil's position. We are committed to helping bring this negotiating process to a successful outcome. For Brazil, a successful outcome is an international instrument which will be an useful and effective one. An effective instrument which makes clear the firm commitment "on the ground" of all Member States to mitigating the book famine of more than 150 million people world-wide. At the end of the process there must be a treaty. Why shouldn't we aim for a treaty? First, the proposal contains rules on how to identify orphan works. It provides that the user has to conduct a diligent search to find the copyright holder. In this search, the user should rely on sources such as databases and registries. One such tool that exists in the book publishing sector is ARROW, the Accessible Registry of Rights Information and Orphan Works. It is hoped that other sectors will also develop similar central rights information databases. Doing so would greatly simplify and streamline the conduct of a reliable diligent search. Secondly, the proposal establishes that if the diligent search does not yield the identity or location of the copyright holder, the work shall be recognised as an orphan work. This status shall then, by virtue of mutual recognition, be valid across the European Union. This implies that once a work is recognised as an orphan work, it shall be recognised as such across the European Union. The proposal also foresees that there will be a generally accessible record of all recognised orphan works. Thirdly, the proposal establishes the uses that can be made of the orphan works and the conditions for such uses depending on their nature. Thus, the current proposal should make a major contribution to the development of various European digital library initiatives and their accessibility for everyone throughout the European Union. Clear rules on what works can be posted online as orphan works will also provide the beneficiaries of the Directive - not only libraries, museums and archives but also film heritage institutions and public service broadcasters - with a sound legal framework that safeguards them against claims of copyright infringement.
