    More than 100 school districts in Texas have passed a resolution saying that high-stakes standardized tests are "strangling" public schools, the latest in a series of events that are part of a brewing revolt in the state where the test-centric No Child Left Behind was born. State-mandated standardized testing has become so dominant in Texas that, according to Denise Williams, testing director of the Wichita Falls Independent School District, high school students are spending up to 45 days of their 180-day school year taking them, according to the Times Record News. Students in grades three through eight spend 19 to 27 days a year taking state-mandated tests.

    According to Wikipedia, cost-benefit analysis "is a systematic process for calculating and comparing benefits and costs of a project, decision or government policy (hereafter, 'project'). CBA has two purposes: 1.To determine if it is a sound investment/decision (justification/feasibility), 2.To provide a basis for comparing projects. It involves comparing the total expected cost of each option against the total expected benefits, to see whether the benefits outweigh the costs, and by how much." I believe that it would be prudent to apply this process to the current accountability movement now being administered in public education, primarily in the form of testing mandates such as No Child Left Behind and Race To The Top.

    In a ruling that could have multi-billion dollar consequences for Colorado's budget, a Denver judge ruled the state's school funding system is not "thorough and uniform" as mandated by the state constitution. The state's school funding system "is not rationally related to the mandate to establish and maintain a thorough and uniform system of free public schools," District Judge Sheila Rappaport said in her 183-page ruling in which she called the system "unconscionable."

    Secretary Arne Duncan is right about the No Child Left Behind law: It is an unmitigated disaster. Signed into law a decade ago by President George W. Bush, NCLB is widely despised for turning schools into testing factories. By mandating that every student in the nation would be "proficient" by 2014, as judged by state tests, it set a goal that no nation in the world has ever met, and that no state in this nation is close to meeting. The goal is laudable but out of reach. It's comparable to Congress mandating that every city, town, and village in the nation must be crime-free by 2014 ... or their police departments would be severely punished.

    Not long ago, I finally made it to Paris, no doubt years after many of my students had lounged in its cafes. Naturally, I went to the Louvre to view the Mona Lisa. Standing in front of it, beguiled by that mysterious smile, my suspicion was confirmed: da Vinci did not paint by the numbers. Moreover, there was apparently no accountability system in place to ensure he would succeed in this artistic endeavor. He might have failed, and no doubt did many times. Those canvasses do not hang in museums. I also tried not to paint by the numbers in my history classes, a good thing since it's tough for me to stay within the lines. Besides, during most of my career, there were few state mandates to encumber my efforts. Ah, state mandates and standardized tests! Let it be generously said, they are not known for facilitating imaginative teaching.

"There's a lot of talk about data and test prep, and I didn't used to hear that." The school, which until recently was a program at PS 199, provides an almost private-school like experience for musically gifted students who must audition in kindergarten and again in 5th grade for middle school.

    The legislative mandate was simple - keep kids in school if at all possible, suspension and expulsion having been identified as a point of entry for the school-to-prison pipeline. Passed in 2003, the Juvenile Justice Reform Act endorsed a wide variety of measures to reduce rates of juvenile incarceration. One such measure was support for in-school programs that reward students for good behavior rather than simply punishing them for acting out. It identified the state's higher than average suspension and expulsion rates as a cause for concern.

    Public education is by necessity an extension of our political system, resulting in schools being reduced to vehicles for implementing political mandates. For example, during the past thirty years, education has become federalized through indirect ("A Nation at Risk" spurring state-based accountability systems) and direct (No Child Left Behind and Race to the Top) dynamics. As government policy and practice, bureaucracy is unavoidable, but the central flaw with the need for structure and hierarchy is that politics prefers leadership characteristics above expertise. No politician can possibly have the expertise and experience needed in all the many areas a leader must address (notably in roles such as governor and president). But during the accountability era in education over the past three decade, the direct role of governors and presidents related to education has increased dramatically-often with education as a central plank in the campaigns and administrations of governors and presidents. One distinct flaw in that development has been a trickle-down effect reaching from presidents and governors to state superintendents of education as well as school board chairs and members: People attaining leadership positions that form and implement education policy have no or very little experience or expertise as educators or scholars.

    A while back, I noted that states and districts should exercise caution in assigning weights (importance) to the components of their teacher evaluation systems before they know what the other components will be. For example, most states that have mandated new evaluation systems have specified that growth model estimates count for a certain proportion (usually 40-50 percent) of teachers' final scores (at least those in tested grades/subjects), but it's critical to note that the actual importance of these components will depend in no small part on what else is included in the total evaluation, and how it's incorporated into the system. In slightly technical terms, this distinction is between nominal weights (the percentage assigned) and effective weights (the percentage that actually ends up being the case). Consider an extreme hypothetical example - let's say a district implements an evaluation system in which half the final score is value-added and half is observations. But let's also say that every teacher gets the same observation score. In this case, even though the assigned (nominal) weight for value-added is 50 percent, the actual importance (effective weight) will be 100 percent, since every teacher receives the same observation score, and so all the variation between teachers' final scores will be determined by the value-added component.

    As Blue Jersey reported, Chris Christie's nominee to the state Supreme Court, Phillip Kwon, was voted down by the Senate Judiciary Committee along party lines. This is a very big deal in the NJ education debate, because Christie has made it clear he wants to overturn the court's ruling that mandated adequate funding for the poorest districts in the state. These are the famous "Abbott Districts," named for the landmark case brought by the Education Law Center. The original ruling has since been superceeded by the School Funding Reform Act (SFRA). Christie has made no secret that he wants to stack the court with nominees that will overturn SFRA; that would mean a huge cut in school funding for the poorest districts, and big tax cuts for Christie's wealthy base. This is in addition to the changes he has proposed to SFRA, which ELC estimates will be a $400 million cut to at-risk children across the state.

Federal testing and accountability mandates under No Child Left Behind and, more recently, Race to the Top, have added layers of bureaucracy while eliminating much of the creativity and authentic learning that makes teaching enjoyable. Tack on the recession's massive teacher layoffs and other school cuts, plus the challenges of trying to compensate for increasing child poverty, homelessness, and food insecurity, and you get a trifecta of disincentives to become, or remain, a teacher.

The Pattern on the Rug - Bridging Differences - Education Week - 1 views

    There comes a time when you look at the rug on the floor, the one you've seen many times, and you see a pattern that you had never noticed before. You may have seen this squiggle or that flower, but you did not see the pattern into which the squiggles and flowers and trails of ivy combined. In American education, we can now discern the pattern on the rug. Consider the budget cuts to schools in the past four years. From the budget cuts come layoffs, rising class sizes, less time for the arts and physical education, less time for history, civics, foreign languages, and other non-tested subjects. Add on the mandates of No Child Left Behind, which demands 100 percent proficiency in math and reading and stigmatizes more than half the public schools in the nation as "failing" for not reaching an unattainable goal. Along comes the Obama administration with the Race to the Top, and the pattern on the rug gets clearer.

    In a series of recent blog posts and in a forthcoming article I have discussed the potential problems with using bad, versus entirely inappropriate measures for determining teacher effectiveness.  I have pointed out, for example, that using value-added measures to estimate teacher effectiveness and then determine whether a teacher should be denied tenure, or have their tenure removed might raise due process concerns which arise from the imprecision and potential outright inaccuracy of teacher effectiveness estimates derived from such methods. I have also explained that in some states like New Jersey, which have adopted Student Growth Percentile measures as an evaluation tool, that where those measures are used as a basis for dismissing teachers, teachers (or their attorney's) might simply rely on the language of the authors of those methods to point out that they are not designed to, nor were they intended to attribute responsibility for the measured student growth to the teacher. Where attribution of responsibility is off the table the dismissing a teacher on an assumption of ineffectiveness based on these measures is entirely inappropriate, and a potential violation of the teacher's due process rights. But, the problem is that state legislatures are increasingly mandating that these measures absolutely be used when making high stakes personnel decisions.

    When Gov. Andrew Cuomo presented his budget to the state on Tuesday, he promised a windfall of school aid for poor districts. After years of cuts worth billions of dollars, education advocates hailed the $805 million school aid increase in the governor's spending plan as a restoration sorely needed in classrooms that have lost teachers and programs in recent years. But a closer look shows relief for high-needs districts is still far off, as much of that 4 percent increase will go to mandated expenses and a competition that will render some districts losers. Officials in some districts don't think the tiny increases they will see this year will even cover the jump in employee benefits.
