[Passed by the House 9/13/11 365-54] This legislation would amend the section of the Elementary and Secondary Education Act of 1965 that governs federal financial support for charter schools, creating a program that would award grants to charter school developers via state educational agencies, state charter school boards, or governors to open new charter schools and expand and replicate existing charter schools. Priority funding would go to states that take specific steps in support of charter schools, including removing limitations on the number or percentage of charter schools that may exist or the number or percentage of students that may attend charter schools, and ensuring equitable financing for charter schools when compared to funding for public schools. The bill creates a "credit enhancement grant program" that would provide funds to public and private nonprofit entities to help charter schools secure private sector capital to buy, construct, renovate, or lease appropriate school facilities. The legislation also allows charter schools to serve prekindergarten or postsecondary school students.

One of the most important trends afoot right now is the move to privatize as many government services as possible. Billionaires like Bill Gates, along with hedge funds, are pushing an agenda of privatizing public schools, and funding a PR push in support of that cause with films like "Waiting for Superman" and the NBC "Education Nation" that included a panel with the title "Does Education Need a Katrina?".

A school district that is a finalist for the soon-to-be announced $1 million 2011 Broad Prize for Urban Education is embarking on a public relations effort - funded with U.S. government and Gates Foundation money - to end public opposition to its school reform program, which includes a slew of new standardized tests. The Charlotte-Mecklenburg School District in North Carolina is using Race to the Top money - which wasn't intended to fund public relations efforts - and $200,000 in Gates Foundation money for the campaign.

For a generation, there has been loose bipartisan agreement in Washington that the federal government has a necessary role to play in the nation's 13,600 school districts, primarily by using money to compel states to raise standards. But the field of Republican presidential candidates has promised to unwind this legacy, arguing that education responsibilities should devolve to states and local districts, which will do a better job than Washington.

Late last month, Miami-Dade school district officials scolded the Academy of Arts & Minds charter school for charging fees to students to attend basic classes - in violation of state law. But when the school's governing board met the next day, the fee issue was not mentioned. And when a parent began reading from the district's warning letter to the school, two board members walked out.

How ALEC, the Koch brothers and their corporate allies plan to privatize government.

In the 2010 midterm election, Republicans won complete legislative control of twenty-one states and the American Legislative Exchange Council was right there with model legislation to help them push through a radical right-wing agenda. Funded by billionaires like the Koch brothers, ALEC has provided the template for more than 800 bills aimed at undermining environmental protection, privatizing education, busting unions and curbing government regulation.

For five years running, the District of Columbia has failed to uphold parts of the federal law that governs the education of students with disabilities, according to the federal Department of Education's ratings of the district and other states and territories.

Private school tuition programs take one of two forms: direct government payments to parents to subsidize tuition costs or programs that give individuals and businesses tax credits for education expenses or for donations to organizations that provide tuition assistance for students entering private schools. 

"Over the objections of some public school advocates, the Louisiana Senate voted 22-16 Monday to allow corporations to sponsor charter schools in exchange for controlling up to half of the enrollment slots and half of the governing board seats. "

"As high school seniors all across the country graduated this week, history was quietly being made in Washington, D.C. at the Department of Education for 23 D.C. public school students with developmental and intellectual disabilities. They, like their peers across the country, were graduating too. They all participated in a program called Project SEARCH. The 15-year-old program now operates in 39 states and four foreign countries, but this is the first year that the federal government has hosted the project in three agencies including the Departments of Education, Labor and Health and Human Services."

Latino students in California - nearly 1.3 million of them English learners - are struggling to achieve academic success at the same level as their white peers. In "State has one of nation's highest gaps in Hispanic-white reading proficiency," Sarah Garland reports that only 12 percent of Hispanic fourth-graders in California tested proficient in reading in 2009. Nonprofits, government agencies and parents have all launched campaigns over the years to close the learning gap, but little progress has been made.

Elementary and high schools are receiving less state funding than last year in at least 37 states, and in at least 30 states school funding now stands below 2008 levels - often far below. These cuts are attributable, in part, to the failure of the federal government to extend emergency fiscal aid to states and school districts and the failure of most states to enact needed revenue increases and instead to balance their budgets solely through spending cuts. The cuts have significant consequences, both now and in the future: They are causing immediate public- and private-sector job loss, and in the long term are likely to reduce student achievement and economic growth.

Rupert Murdoch's attempt to corner the education market is not going to go smoothly, it appears. On Thursday, Joel Klein, vice president of Murdoch's News Corp., which owns Fox News, appeared on a panel discussion about school board governance at Jeb Bush's Excellence in Education summit in San Francisco. Klein was at the conference in his role as the former long-serving chancellor of the New York City school system. But there was no getting around his current position. Klein was testy when I asked him about the protesters preparing to descend on the hotel to greet his boss on Friday morning, when Murdoch is scheduled to speak. And he didn't escape his panel discussion without having to face more questions about News Corp.'s education ventures.

'We're from the government, and we're here to help." Those words strike fear in just about any situation but they sound particularly ominous when the subject of the government's help is Florida's university system, and the ones doing the helping are Gov. Rick Scott and the state Legislature, backed by Big Business. Their assistance, to take form during the spring legislative session, will be a push to replace subjects such as music, psychology and French literature with the study of science, technology, engineering and math.

With approximately 500 tax-exempt bond transactions completed to date, the charter school sector of the municipal market continues to gain size and momentum and has emerged as much more than a fragmented niche for high yield investors. The growth rate in the number of charter schools across the country - now exceeding 5,000 - is expected to increase due to the heightened focus that policymakers at all levels of government have placed on results-driven education reform. This growth will generate greater charter school demand for affordable facility financing, a demand that is well met by the tax-exempt bond market with its tax-exempt interest rates and longer principal repayment periods. To date, however, fewer than 8% of charter schools have accessed the market for their permanent facility financing needs.

I've commented in the past about the difficulties of obtaining reconcilable data on finances of New Jersey Charter Schools. What do I mean by reconcilable? Well, when I'm looking at financial data on charter schools in particular, I like to be able to see some relationship between expenditure and revenue data reported on IRS 990 filings (Tax returns of the non-profit boards/foundations/agencies that operate the charters) and state government (department of ed) reported expenditures and/or any annual financial report documents that might be required by charter authorizers. This really is an authorizer/accountability issue. A financial reporting requirement issue.

"Value Added Models (VAMs) are irresistible. Purportedly they can ascertain a teacher's effectiveness by predicting the impact of a teacher on a student's test scores. Because test scores are the sin qua non of our education system, VAMs are alluring. They link a teacher directly to the most emphasized output in education today. What more can we want from an evaluative tool, especially in our pursuit of improving schools in the name of social justice? Taking this a step further, many see VAMs as the panacea for improving teacher quality. The theory seems straightforward. VAMs provide statistical predictions regarding a teacher's impact that can be compared to actual results. If a teacher cannot improve a student's test score in relatively positive ways, then they are ineffective. If they are ineffective, they can (and should) be dismissed (See, for instance, Hanushek, 2010). Consequently, state legislatures have rushed to codify VAMs into their statutes and regulations governing teacher evaluation. (See, for example, Florida General Laws, 2014). That has been a mistake. This paper argues for a complete reversal in policy course. To wit, state regulations that connect a teacher's continued employment to VAMs should be overhauled to eliminate the connection between evaluation and student test scores. The reasoning is largely legal, rather than educational. In sum, the legal costs of any use of VAMs in a performance-based termination far outweigh any value they may add.1 These risks are directly a function of the well-documented statistical flaws associated with VAMs (See, for example, Rothstein, 2010). The "value added" of VAMs in supporting a termination is limited, if it exists at all."
