"Milwaukee's voucher system, which allows low-income students to attend private schools using tax dollars, discriminates based on disability, according to a complaint filed Tuesday by the American Civil Liberties Union, the ACLU of Wisconsin Foundation and Disability Rights Wisconsin."

"The shame that many teachers and principals feel at being made responsible for a school's low academic performance is a recent phenomenon. School leaders would say that they could hardly be blamed for reversing conditions over which they had little control. Until the past quarter-century, demography as destiny was the dominant explanation for unequal school outcomes. Things began to change by the mid-1970s."

New York State's heralded anti-bullying law is about to go into effect July 1. But the state Board of Regents recently took some teeth out of the law, known as the Dignity Act, when it said that charter schools don't have to provide in-class instruction to schoolchildren about the dangers of discrimination and harassment, leaving their students without a key protection from bullying.

They say, "It takes a village to raise a child." Family and community engagement is integral to a quality education. Ensuring participation is especially important in communities where poverty, language barriers or discrimination have resulted in disenfranchisement. Apparently, this lesson is lost on our governor, whose SB 24 will strip the neediest communities of any meaningful participation in their public schools with the creation of a "Commissioner's Network" of schools.

Blatant forms of discrimination against women in academia have diminished since the Equal Pay Act and Title IX became law in 1964 and 1972, respectively. Yet gender differences in salary, tenure status, and leadership roles still persist among men and women in higher education. In particular, wage differences among male and female professors have not been fully explained, even when productivity, teaching experience, institutional size and prestige, disciplinary fields, type of appointment, and family-related responsibilities are controlled for statistically (see here).

The rules under which charter schools operate - Federal, state and local - are supposed to ensure equal access to charters and to prevent discrimination.  In theory preference should be given to those in the local area, which then in theory should provide a student body with demographics very much like those of surrounding neighborhood schools from which their students are drawn.

Careful examination discloses that disadvantaged students have made spectacular progress in the last generation, in regular public schools, with ordinary teachers. Not only have regular public schools not been "the great discriminator" - they continue to make remarkable gains for minority children at a time when our increasingly unequal social and economic systems seem determined to abandon them.

"In a Louisiana public school, female students who are suspected of being pregnant are told that they must take a pregnancy test. Under school policy, those who are pregnant or refuse to take the test are kicked out and forced to undergo home schooling. Welcome to Delhi Charter School, in Delhi, Louisiana, a school of 600 students that does not believe its female students have a right to education free from discrimination. According to its Student Pregnancy Policy, the school has a right to not only force testing upon girls, but to send them to a physician of the school administration's choice. A positive test result, or failure to take the test at all, means administrators can forbid a girl from taking classes and force her to pursue a course of home study if she wishes to continue her education with the school."

Yesterday's Milwaukee Journal Sentinel carries a feature on the Lynde and Harry Bradley Foundation.The Bradleys were the main source of support for Gov. Walker's assault on Wisconsin's teachers and public employee unions. Indiana's T-Party Gov. Mitch Daniels sat on Bradley's board of directors. His teacher-bashing, anti-union school "reform" initiative was recently embraced by Ed Sec. Arne Duncan.  They also provided support for the Milwaukee school voucher program and its main proponent in the African-American community, Howard Fuller and his Black Alliance for Educational Options (BAEO) . They funded Charles Murray, author of racist book, "The Bell Curve," which argues that intelligence is predicated on race, and Dinesh D'Souza, author of "The End of Racism," which attempts to absolve Whites from discrimination against Blacks during slavery, claiming that Blacks were too uncivilized to be a part of society anyway.

In short, there are different ways to measure the gender gap, and their "accuracy" is not about the statistics as much as how they're interpreted. The gap is 75-80 cents on the male dollar if you're making no claims that the difference is attributable solely to discrimination. When you account for the underlying factors - and you must do so to interpret the data in this manner - you get a somewhat different picture of the extent of the problem (problem though it still is). Now, think about how easily this all applies to test data in education. We are inundated every day with average scores and rates - for schools, districts, states, subgroups of students, etc. These data are frequently compared between groups and institutions in much the same way as wages are compared between men and women.

In the most competitive market for job-hunting teachers in New Orleans in recent memory -- perhaps ever -- some worry that veteran educators have received short shrift. Several teachers who attended a recent meeting at the United Teachers of New Orleans, for instance, alleged the district has discriminated based on age in order to save money.

Kelly Fischer, one of the plaintiffs in a special-education discrimination lawsuit against the state of Louisiana, says last year she was discouraged by a number of charter schools from enrolling her now 10-year-old son Noah, who is blind, autistic and eats from a tube. While charters are free from many of the bureaucratic constraints of traditional districts, such as union contracts and limits on the length of school days, they must follow U.S. antidiscrimination laws, just like other public schools.

As Nicholas Kristof noted a few months ago in the NY Times, the quality of the teaching profession was long subsidized by discrimination and other barriers preventing talented people from entering other fields

A state Senate committee approved legislation Thursday that would allow charter schools to refuse to admit students on the basis of their ability to speak English, their sexual orientation or other factors.
