Glorious Generalist: Report on "Copyright and Fair Use in the Digital Age" - 0 views

  • The first part of the program was a chance to learn the details about the Code of Best Practices for Fair Use in Academic and Research Libraries, which was published in January 2012 as a joint project of the Association of Research Libraries, Center for Social Media at American University and the Program for Information Justice and Intellectual Property at American University. The second part of the program was from Creative Commons on “Fair Use and Copyright in the Age of the Internet.” (I will probably get those notes done too at some point). I am presenting below the notes I took during the meeting, but you can follow the first presentation at the ARL site, as well as find a lot more information and the actual code at arl.org/fairuse.

It enhances the ability of librarians to rely on fair use by documenting the considered views of the library community about best practices in fair use, drawn from the actual practices and experience of the library community itself. It identifies eight situations that represent the library community's current consensus about acceptable practices for the fair use of copyrighted materials and describes a carefully derived consensus within the library community about how those rights should apply in certain recurrent situations.

    "The ultra high-resolution images of works, both famous and less well-known, can be freely downloaded, zoomed in on, shared, added to personal 'studios', or manipulated copyright-free. Users can have prints made of entire works of art or details from them. Other suggestions for the use of images include creating material to upholster furniture or wallpaper, or to decorate a car or an iPad cover for example."

Publishers Will Appeal E-Reserves Decision That Favored Georgia State U. - 0 views

    The publisher plaintiffs who accused Georgia State University of copyright infringement in a lawsuit over course e-reserves aren't happy with the outcome of that case. On Monday they said they would appeal a federal judge's decision, handed down in May, that was largely a win for the defendants.

    The Research Works Act will prohibit federal agencies from unauthorized free public dissemination of journal articles that report on research which, to some degree, has been federally-funded but is produced and published by private sector publishers receiving no such funding. It would also prevent non-government authors from being required to agree to such free distribution of these works. Additionally, it would preempt federal agencies' planned funding, development and back-office administration of their own electronic repositories for such works, which would duplicate existing copyright-protected systems and unfairly compete with established university, society and commercial publishers.

    For the fifth time since the Digital Millennium Copyright Act (DMCA) was passed in 1998, the Library of Congress is preparing to grant limited rights to crack DRM locks on digital content. Not that it matters much; despite an increased willingness at the Library to grant such permission, the actual tools most people need to bypass DRM remain forbidden.
