New Jersey franchise law stalled in state senate - 0 views

AAHOA said it was misinformation that delayed the bill's passage, while the American Hotel & Lodging Association said the bill "would have destroyed the hotel industry's franchise model." It will return Assembly Bill 1958 would make changes to the New Jersey Franchise Practices Act that could benefit the hospitality industry, AAHOA said previously. Specifically, the changes include restricting non-competes for longer than six months; prohibiting requiring a relocation or capital investment greater than $25,000 more than once every five years unless hotel franchisers can establish a return on the investment; requiring a franchiser that receives "any rebate, commission, kickback, services, other consideration or anything of value" to fully disclose them to the franchisee and turn them over to the franchisee; putting restrictions on mandatory sourcing of goods or resources; and prohibiting suspending, restricting or preventing access to franchise services.

    KEN GREENE IS leaving his position as president and CEO of AAHOA to begin a new job with Dallas-based IBF Hospitality. AAHOA already has begun searching for his replacement. Greene will leave on Feb. 11, according to a statement. He was brought on last year in June to replace Cecil Staton, AAHOA's former president and CEO when he left the association unexpectedly. "Ken has been instrumental in carrying AAHOA through the past several months, which brought on a lot of change both at AAHOA and in our industry," said AAHOA Chair Vinay Patel. "We're grateful for the time he's spent at AAHOA and wish him nothing but continued success as he transitions to another opportunity." While at AAHOA, Greene oversaw the association's return to in-person events, including the 2021 AAHOA Convention & Trade Show at the Kay Bailey Hutchison Convention Center in Dallas in August. He also helped in write AAHOA's strategic plan and helped restaff the organization after the departure of Staton, the association's executive vice president and COO Rachel Humphrey and others.

Small hotels need to avoid the erratic rate shifts of the past and capitalize on new trends as they emerge. By embracing strong revenue management systems and discipline in these properties, operators can realize greater control over a typically inconsistent space. RevPAR is still expected to recover fully on a nominal basis this year, according to the forecast released Thursday at STR's 14th Annual Hotel Data Conference in Nashville. However, RevPAR is still expected to take until 2025 to recover when adjusted for inflation, according to the forecast. For 2022, RevPAR is now expected to average $93 compared to the projection of $92 released in June, when projected nominal RevPAR recovery was set in 2023. The occupancy projection for the year was lowered to 64.6 percent for the year and the ADR projection rose to $148. The updated forecast adds a little more than $2 to the ADR projection for both 2022 and 2023, and occupancy was lowered by less than a percentage point for each year.

The Save Local Business Act provides long-overdue clarity and consistency that will protect our nation's small businesses," said one of the bill's sponsors, U.S. Sen. Roger Marshall. "The Biden Administration's Labor Department has relied on complicated court rulings to handle joint employers instead of providing clear guidance to the business community. In a time of economic hardship, we should be doing all that we can to help our nation's small businesses, not let the heavy hand of government regulations run amok."
