Public Citizen Defends Merchant From Unconstitutional Interference by NSA, Department of Homeland Security In Lawsuit Filed Against Agencies, Public Citizen Argues That Attempts to Stop Production of Parody Merchandise Are Inconsistent With First Amendment BALTIMORE, Md. – A Minnesota activist who uses images and names of government agencies on satirical merchandise is entitled to do so under the First Amendment, Public Citizen argued in a lawsuit filed today against the National Security Agency (NSA) and the Department of Homeland Security (DHS) on behalf of the merchant. The suit, filed in the U.S. District Court for the District of Maryland, targets cease-and-desist letters sent to the merchant’s producer by the NSA and DHS. On his website LibertyManiacs.com, Sauk Rapids, Minn., resident Dan McCall sells T-shirts, hats, bumper stickers and other items with his designs, printed by Zazzle.com – for example, a mug with the NSA seal above the words “Spying On You Since 1952” and a parodied NSA seal that says “Peeping While You’re Sleeping” above the words “The NSA: The only part of government that actually listens.”

On March 15, 2011, Zazzle received a warning letter from the NSA, and on Aug 11, 2011, it received one from DHS. The NSA said that Zazzle, by selling the merchandise, was in violation of a provision of the National Security Agency Act of 1959 that prohibits the “use [of] the words ‘National Security Agency,’ the initials, ‘NSA,’ the seal of the National Security Agency, or any colorable imitation of such words … in connection with any merchandise, impersonation, solicitation, or commercial activity in a manner reasonably calculated to convey the impression that such use is approved, endorsed, or authorized by the National Security Agency” without the permission of the NSA. DHS said that Zazzle, by selling McCall’s DHS parody items, was in violation of a law making it a crime to “mutilate or alter the seal of any department or agency of the United States,” among other provisions. In the lawsuit filed in defense of McCall, Public Citizen points out that the graphics did not create any likelihood of confusion about source or sponsorship, and no reasonable person would believe that the agencies themselves produced merchandise with those messages. The complaint also asserts that the First Amendment protects McCall and Zazzle’s right to use the seals to accurately identify the agencies he is criticizing. “The agencies’ attempts to forbid McCall from displaying and selling his merchandise are inconsistent with the First Amendment,” said Paul Alan Levy, the Public Citizen attorney handling the case. “It’s bad enough that these agencies have us under constant surveillance; forbidding citizens from criticizing them is beyond the pale.”

Public Citizen is asking the court to declare that several provisions of the National Security Agency Act cannot be enforced to forbid McCall from displaying his merchandise, and that two other laws are unconstitutionally overbroad because they violate the First Amendment by saying no one can “mutilate or alter the seal of any department or agency of the United States.” McCall is now selling his merchandise at CafePress.com. Theoretically - and even that is still extremely debatable - the Obama administration's core interest in Southwest Asia is to negotiate a very complex deal with Iran, which will take most of 2014. On Monday, the U.S. Department of Justice sued S&P for $5 billion for misleading the Western Federal Corporate Credit Union, the first federally chartered credit union, which collapsed in 2008.  Sixteen states have joined the lawsuit while the U.S. Securities & Exchange Commission has also launched an investigation. S&P has offered to settle for $100 million instead without admitting any guilt.The lawsuits are based on a special government investigation named “Alchemy” into top ratings provided by S&P for “collateralized debt obligations” (CDOs) composed of sub-prime mortgages. The federal officials allege that analysts knew that the loans were likely to go sour.

Two dozen government lawyers spent several years, conducting over 150 interviews, to find out how much the ratings agency knew about the quality of the CDOs. “Claims that we deliberately kept ratings high when we knew they should be lower are simply not true. S.&P. has always been committed to serving the interests of investors and all market participants by providing independent opinions on creditworthiness based on available information,” the Wall Street firm said in a statement released to the press.S&P has also tried to claim in court that its ratings are protected under the first amendment to the U.S. constitution, which guarantees the right to free speech. Federal judges have been skeptical like Shira A. Scheindlin, who recently ruled against the argument.

Software created by the controversial UK-based Gamma Group International was used to spy on computers that appear to be located in the United States, the UK, Germany, Russia, Iran, and Bahrain, according to a leaked trove of documents analyzed by ProPublica. It's not clear whether the surveillance was conducted by governments or private entities. Customer e-mail addresses in the collection appeared to belong to a German surveillance company, an independent consultant in Dubai, the Bosnian and Hungarian Intelligence services, a Dutch law enforcement officer, and the Qatari government.

The leaked files—which were posted online by hackers—are the latest in a series of revelations about how state actors including repressive regimes have used Gamma's software to spy on dissidents, journalists, and activist groups. The documents, leaked last Saturday, could not be readily verified, but experts told ProPublica they believed them to be genuine. "I think it's highly unlikely that it's a fake," said Morgan Marquis-Bore, a security researcher who while at The Citizen Lab at the University of Toronto had analyzed Gamma Group's software and who authored an article about the leak on Thursday. The documents confirm many details that have already been reported about Gamma, such as that its tools were used to spy on Bahraini activists. Some documents in the trove contain metadata tied to e-mail addresses of several Gamma employees. Bill Marczak, another Gamma Group expert at the Citizen Lab, said that several dates in the documents correspond to publicly known events—such as the day that a particular Bahraini activist was hacked.

The leaked files contain more than 40 gigabytes of confidential technical material, including software code, internal memos, strategy reports, and user guides on how to use Gamma Group software suite called FinFisher. FinFisher enables customers to monitor secure Web traffic, Skype calls, webcams, and personal files. It is installed as malware on targets' computers and cell phones. A price list included in the trove lists a license of the software at almost $4 million. The documents reveal that Gamma uses technology from a French company called Vupen Security that sells so-called computer "exploits." Exploits include techniques called "zero days" for "popular software like Microsoft Office, Internet Explorer, Adobe Acrobat Reader, and many more." Zero days are exploits that have not yet been detected by the software maker and therefore are not blocked.

The BBC loves to boast about how “objective” and “neutral” it is. But a recent article, which it was forced to change, illustrates the lengths to which the British state-funded media outlet will go to protect one of the U.K. government’s closest allies, Saudi Arabia, which also happens to be one of the country’s largest arms purchasers (just this morning, the Saudi ambassador to the U.K. threatened in an op-ed that any further criticism of the Riyadh regime by Jeremy Corbyn could jeopardize the multi-layered U.K./Saudi alliance). Earlier this month, the BBC published an article describing the increase in weapons and money sent by Saudi Arabia and other Gulf regimes to anti-Assad fighters in Syria. All of that “reporting” was based on the claims of what the BBC called “a Saudi government official,” who — because he works for a government closely allied with the U.K. — was granted anonymity by the BBC and then had his claims mindlessly and uncritically presented as fact (it is the rare exception when the BBC reports adversarially on the Saudis). This anonymous “Saudi official” wasn’t whistleblowing or presenting information contrary to the interests of the regime; to the contrary, he was disseminating official information the regime wanted publicized. This was the key claim of the anonymous Saudi official (emphasis added):

The well-placed official, who asked not to be named, said supplies of modern, high-powered weaponry including guided anti-tank weapons would be increased to the Arab- and western-backed rebel groups fighting the forces of Syria’s President Bashar al-Assad and his Russian, Iranian and Lebanese allies. He said those groups being supplied did not include either Islamic State (IS) or al-Nusra Front, both of which are proscribed terrorist organizations. Instead, he said the weapons would go to three rebel alliances — Jaish al-Fatah (Army of Conquest), the Free Syrian Army (FSA) and the Southern Front.

So the Saudis, says the anonymous official, are only arming groups such as the “Army of Conquest,” but not the al Qaeda affiliate the Nusra Front. What’s the problem with this claim? It’s obvious, though the BBC would not be so impolite as to point it out: The Army of Conquest includes the Nusra Front as one of its most potent components.
