Bigger than the Pentagon, full of futuristic gear and thousands of workers, the plant, dedicated last month, modernizes the aging weapons that the United States can fire from missiles, bombers and submarines.It is part of a nationwide wave of atomic revitalization that includes plans for a new generation of weapon carriers. A recent federal study put the collective price tag, over the next three decades, at up to a trillion dollars.This expansion comes under a president who campaigned for “a nuclear-free world” and made disarmament a main goal of American defense policy. The original idea was that modest rebuilding of the nation’s crumbling nuclear complex would speed arms refurbishment, raising confidence in the arsenal’s reliability and paving the way for new treaties that would significantly cut the number of warheads.

UN's Ban: Being born in Gaza is not a crime - 0 views

  • N Secretary-General Ban Ki-moon lashed out at Israel for striking his organization’s facilities in Gaza during the conflict this summer as he visited the Strip on Tuesday, and said he was considering launching his own investigation into the matter.He also called on Israel to end its “occupation” of land over the pre-1967 lines and to lift all its restrictions on the Gaza borders.“This is one of the fundamental underlying issues, ending the occupation and lifting the blockade, that I have been urging the parties, the Palestinians and Israelis, to address,” Ban said.Several times during his visit, Ban remarked that he was surprised and unprepared for the level of devastation wrought by the conflict between Israel and Hamas, which controls Gaza.
  • But when he spoke about specific investigations, he mentioned Israel’s internal one into IDF activity in Gaza as well as the UN Human Rights Council’s probe into Israeli activity.In addition to those, he said, “I, as secretary-general of the United Nations, am considering establishing my own Board of Inquiry to investigate the shelling of the UN facilities and killing of UN staff.” He did not mention an investigation into Hamas activity.Its estimated that some 100 UN buildings were damaged in the war.The UN has also charged the IDF with attacking three of its UNRWA schools where civilians sought shelter, including the one that Ban visited in Jabalya.

2015 Will Be All About Iran, China and Russia / Sputnik International - 0 views

  • Fasten your seatbelts; 2015 will be a whirlwind pitting China, Russia and Iran against what I have described as the Empire of Chaos.
  • Considering that this swift move was conceived as a checkmate, Moscow’s defensive strategy was not that bad. On the key energy front, the problem remains the West’s – not Russia’s. If the EU does not buy what Gazprom has to offer, it will collapse. Moscow’s key mistake was to allow Russia's domestic industry to be financed by external, dollar-denominated debt. Talk about a monster debt trap  which can be easily manipulated by the West. The first step for Moscow should be to closely supervise its banks. Russian companies should borrow domestically and move to sell their assets abroad. Moscow should also consider implementing a system of currency controls so the basic interest rate can be brought down quickly. And don’t forget that Russia can always deploy a moratorium on debt and interest, affecting over $600 billion. That would shake the entire world's banking system to the core. Talk about an undisguised “message” forcing the US/EU economic warfare to dissolve.
  • Global oil prices are bound to remain low. All bets are off on whether a nuclear deal will be reached by this summer between Iran and the P5+1. If sanctions (actually economic war) against Iran remain and continue to seriously hurt its economy, Tehran’s reaction will be firm, and will include even more integration with Asia, not the West.

  • Now let’s take a look at Russian fundamentals. Russia’s government debt totals only 13.4% of its GDP. Its budget deficit in relation to GDP is only 0.5%.  If we assume a US GDP of $16.8 trillion (the figure for 2013), the US budget deficit totals 4% of GDP, versus 0.5% for Russia. The Fed is essentially a private corporation owned by regional US private banks, although it passes itself off as a state institution. US publicly held debt is equal to a whopping 74% of GDP in fiscal year 2014. Russia’s is only 13.4%. The declaration of economic war by the US and EU on Russia – via the run on the ruble and the oil derivative attack – was essentially a derivatives racket. Derivatives – in theory – may be multiplied to infinity. Derivative operators attacked both the ruble and oil prices in order to destroy the Russian economy. The problem is, the Russian economy is more soundly financed than America's.
  • So yes – it will be all about further moves towards the integration of Eurasia as the US is progressively squeezed out of Eurasia. We will see a complex geostrategic interplay progressively undermining the hegemony of the US dollar as a reserve currency and, most of all, the petrodollar. For all the immense challenges the Chinese face, all over Beijing it's easy to detect unmistakable signs of a self-assured, self-confident, fully emerged commercial superpower. President Xi Jinping and the current leadership will keep investing heavily in the urbanization drive and the fight against corruption, including at the highest levels of the Chinese Communist Party (CCP). Internationally, the Chinese will accelerate their overwhelming push for new 'Silk Roads' – both overland and maritime – which will underpin the long-term Chinese master strategy of unifying Eurasia with trade and commerce.
  • Russia does not need to import any raw materials. Russia can easily reverse-engineer virtually any imported technology if it needs to. Most of all, Russia can generate — from the sale of raw materials – enough credit in US dollars or euros. Russia's sale of its energy wealth — or sophisticated military gear — may decline. However, they will bring in the same amount of rubles — as the ruble has also declined.  Replacing imports with domestic Russian manufacturing makes total sense. There will be an inevitable “adjustment” phase – but that won’t take long. German car manufacturers, for instance, can no longer sell their cars in Russia due to the ruble's decline. This means they will have to relocate their factories to Russia. If they don’t, Asia – from South Korea to China — will blow them out of the market.
  • The EU's declaration of economic war against Russia makes no sense whatsoever. Russia controls, directly or indirectly, most of the oil and natural gas between Russia and China: roughly 25% of the world's supply. The Middle East is bound to remain a mess. Africa is unstable. The EU is doing everything it can to cut itself off from its most stable supply of hydrocarbons, prompting Moscow to redirect energy to China and the rest of Asia. What a gift for Beijing – as it minimizes the alarm about the US Navy playing with "containment" across the high seas.  Still, an unspoken axiom in Beijing is that the Chinese remain extremely worried about an Empire of Chaos losing more and more control, and dictating the stormy terms of the relationship between the EU and Russia. The bottom line is that Beijing would never allow itself to be in a position where the US could interfere with China's energy imports – as was the case with Japan in July 1941 when the US declared war by imposing an oil embargo, cutting off 92% of Japanese oil imports. Everyone knows a key plank of China’s spectacular surge in industrial power was the requirement for manufacturers to produce in China. If Russia did the same, its economy would be growing at a rate of over 5% per year in no time. It could grow even more if bank credit was tied only to productive investment.
  • Now imagine Russia and China jointly investing in a new gold, oil and natural resource-backed monetary union as a crucial alternative to the failed debt "democracy" model pushed by the Masters of the Universe on Wall Street, the Western central bank cartel, and neoliberal politicians. They would be showing the Global South that financing prosperity and improved standards of living by saddling future generations with debt was never meant to work in the first place. Until then, a storm will be threatening our very lives – today and tomorrow. The Masters of the Universe/Washington combo won’t give up their strategy to make Russia a pariah state cut off from trade, the transfer of funds, banking and Western credit markets and thus prone to regime change. Further on down the road, if all goes according to plan, their target will be (who else) China. And Beijing knows it. Meanwhile, expect a few bombshells to shake the EU to its foundations. Time may be running out – but for the EU, not Russia. Still, the overall trend won’t be altered; the Empire of Chaos is slowly but surely being squeezed out of Eurasia.

No ceasefire without justice for Gaza | The Electronic Intifada - 0 views

  • As academics, public figures and activists witnessing the intended genocide of 1.8 million Palestinians living in the Gaza Strip, we call for a ceasefire with Israel only if conditioned on an end to the blockade and the restoration of basic freedoms that have been denied to the people for more than seven years. Our foremost concerns are not only the health and safety of the people in our communities, but also the quality of their lives – their ability to live free of fear of imprisonment without due process, to support their families through gainful employment, and to travel to visit their relatives and further their education. These are fundamental human aspirations that have been severely limited for the Palestinian people for more than 47 years, but that have been particularly deprived from residents of Gaza since 2007. We have been pushed beyond the limits of what a normal person can be expected to endure.
  • Charges in the media and by politicians of various stripes that accuse Hamas of ordering Gaza residents to resist evacuation orders, and thus use them as human shields, are untrue. With temporary shelters full and the indiscriminate Israeli shelling, there is literally no place that is safe in Gaza. Likewise, Hamas represented the sentiment of the vast majority of residents when it rejected the unilateral ceasefire proposed by Egypt and Israel without consulting anyone in Gaza. We share the broadly held public sentiment that it is unacceptable to merely return to the status quo – in which Israel strictly limits travel in and out of the Gaza Strip, controls the supplies that come in (including a ban on most construction materials), and prohibits virtually all exports, thus crippling the economy and triggering one of the highest poverty and unemployment rates in the Arab world. To do so would mean a return to a living death.

Europe's answer to France terror 'attack on free speech' is greater Internet censorship... - 0 views

  • About half of Europe's member states are pushing for greater online censorship powers in the wake of the terror attacks in France earlier this month. In a joint statement, interior ministers from 11 European member states -- including Germany, Poland, Spain, and the U.K. -- expressed condemnation of the attacks, while stressing further cooperation between their law enforcement and intelligence agencies. Members of the European Union, along with a delegation from the U.S. government -- including outgoing Attorney General Eric Holder -- adopted, among other sentiments, a resolution to create a partnership of major Internet providers to report and remove material associated with extremism.
  • "We are concerned at the increasingly frequent use of the Internet to fuel hatred and violence and signal our determination to ensure that the Internet is not abused to this end, while safeguarding that it remains, in scrupulous observance of fundamental freedoms, a forum for free expression, in full respect of the law," the statement said. The statement also said the Internet was a focal point in the "fight against radicalization," and there was a need to strengthen resources across the region, including greater border surveillance.

Secret Israeli Report Sees Rift With Europe Growing - J.J. Goldberg - Forward.com - 0 views

  • A classified Israeli foreign ministry document, leaked to the daily Yediot Ahronot, warns that 2015 will see Israel’s standing on the world stage steadily deteriorating. It predicts “worsening drift in Europe toward Palestinian positions, more parliaments recognizing the State of Palestine, fear of sanctions and labeling merchandise [to separate settlement products from tariff-free Israel-proper products] and no certainty that the United States will continue after Israel’s March elections to protect Israel with its veto.” The document is said to be a summary of an interministerial assessment roundtable convened by foreign minister Avigdor Lieberman, and is signed by foreign ministry deputy director-general Gilead Cohen. It was circulated to Israel’s ambassadors around the world, Yediot reported. In addition to labeling settlement products and parliamentary votes to recognize Palestine, the foreign ministry document warns of European nations halting the supply of replacement parts for Israeli equipment and demanding compensation for damage caused by Israel to European projects in the territories.

  • The tensions surrounding Prime Minister Netanyahu’s visit to Paris this week are an outgrowth of that growing gulf of suspicion. As Haaretz diplomatic correspondents Barak Ravid and Asher Schechter both reported, French president Francois Hollande initially asked Netanyahu not to come to Paris for the Sunday solidarity rally, because he wanted to avoid injecting the divisive Israeli-Palestinian issue into the rally’s theme of national and Europe-wide unity and solidarity. Once Netanyahu announced that he was coming, Hollande made clear to him that Palestinian leader Mahmoud Abbas would be invited as well. Netanyahu has said repeatedly since last week’s Paris attacks, in his initial sympathy statement and again in his remarks Monday at the site of the kosher supermarket attack, that the terror plaguing Europe is the same as the terror Israel faces. He said he hoped Europe would “wake up in time” to the terrorist threat. He continued: “Israel supports Europe in its fight against terrorism and it’s time Europe supported Israel in the same fight.” His comments have caused resentment in France. Like most of Europe, French leaders regard Israel’s conflict with Arab terrorists as fundamentally different from the jihadist terrorism spreading from Syria to the European continent. The Israeli-Palestinian conflict is seen as a territorial dispute, albeit with religious overtones where Hamas is concerned, while Al Qaeda and ISIS are seen as essentially nihilistic movements that seek to undermine Western civilization.

  • As for “waking up” to the terrorist threat, French observers note that they are carrying the fight against Al Qaeda in Mali on their own, had one of the largest NATO troop contingents fighting the Taliban in Afghanistan and maintain what’s considered one of the best counter-terrorism intelligence operations in the West. In effect, Netanyahu’s call for Europe to “wake up” and “support Israel” in its struggle against terrorism is seen as a demand that Europe acquiesce in his effort to entrench Israeli presence in the territories, rather than withdrawing and permitting a Palestinian state based on the pre-1967 lines.

    " ... no certainty that the United States will continue after Israel's March elections to protect Israel with its veto." That would seem to indicate that the Obama Administration is doing some very tough talking to Israeli government officials behind the scenes. But I doubt that Obama would have the U.S. abstain or vote in favor of a Security Council Resolution condemning Israel unless it was on a matter that would inflicit little actual pain on the Israeli government. In that scenario, Kerry could claim plausibly that the U.S. abstention or vote in favor was a "message" to Israeli gobvernment to get serious about making the two-state solution happen. But I have to admit it would warm my heart to see a Security Council Resolution adopted authorizing the use of force to break the Gaza siege and to push Israeli troops and its settlers back to the 1967 borders.

  • NUMBER ONE: "Section One:   The Constitution of the United States shall be read and interpreted literally.   No words or phrases shall be changed or substituted and no part of the Constitution shall be used to expand or increase Federal Power or Authority beyond that EXPRESSLY granted and enumerated in the Constitution.   The language of the Constitution shall be interpreted according to the definition of words at the time of their inclusion in the Constitution. Section Two:    Congress shall have, by two thirds vote of both the House of Representatives and the Senate, the power to override individual rulings of the Supreme Court of the United States and/or subordinate Federal Courts.   The President shall not have veto authority over Congressional overrides of Federal Court decisions."

Section Seven: Members of Congress shall be subject to popular recall by their respective constituencies, unless the Seventeenth Amendment to the Constitution of the United States is repealed, in which case only members of the House of Representatives shall be subject to popular recall.   Within 90 days of the ratification of this amendment each State shall pass legislation governing the recall of its Congressional Delegation.   In the event a State fails to pass the required legislation within the required 90 days, that State's Congressional Delegation shall be considered to have been recalled and new elections held within 60 days."

Oil surges 8 percent as U.S. rig count plunges, shorts scramble - Yahoo Finance - 0 views

  • EW YORK (Reuters) - Oil prices roared back from six-year lows on Friday, rocketing more than 8 percent as a record weekly decline in U.S. oil drilling fueled a frenzy of short-covering. In a rally that may spur speculation that a seven-month price collapse has ended, global benchmark Brent crude shot up to more than $53 per barrel, its highest in more than three weeks in its biggest one-day gain since 2009. The late-session surge was primed by Baker Hughes data showing the number of rigs drilling for oil in the United States fell by 94 - or 7 percent - this week. Earlier gains were fueled by reports of Islamic State militants striking at Kurdish forces southwest of the oil-rich city of Kirkuk.
  • Poised for a bounce many thought was overdue, short traders raced to cover their positions on fears that the rout, sparked by massive U.S. shale crude supplies, was nearing its end. "The rig count drop was a lot more than people expected and it really got the market going," said Phil Flynn, analyst at Price Futures Group in Chicago. According to Baker Hughes, the decline in oil drilling rigs was the most since it began keeping records in 1987. New Saudi King Tied to Al Qaeda, Bin Laden and Islamic Terrorism Washington's Blog - 0 views

  • We’ve long noted that Saudi Arabia is a huge supporter of terrorism. But the new Saudi king is particularly bad. Investors Business Daily notes: King Salman has a history of funding al-Qaida, and his son has been accused of knowing in advance about the 9/11 attacks. *** Salman once ran a Saudi charity tied to al-Qaida and has been named a defendant in two lawsuits accusing the Saudi royal family of helping the 9/11 terrorists, one of which the U.S. Supreme Court recently let move forward after years of being blocked by the State Department and the well-funded Saudi lobby. Plaintiffs have provided an enormous amount of material to source their accusations against Salman. Here’s why his ascension to the throne is not good news, especially as the terrorism threat grows: • Salman once headed the Saudi High Commission for Relief to Bosnia and Herzegovina, which served as a key charitable front for al-Qaida in the Balkans. • According to a United Nations-sponsored investigation, Salman in the 1990s transferred more than $120 million from commission accounts under his control — as well as his own personal accounts — to the Third World Relief Agency, another al-Qaida front and the main pipeline for illegal weapons shipments to al-Qaida fighters in the Balkans.
  • • A U.N. audit found that the money was transferred following meetings with Salman, transfers that had no legitimate “humanitarian” purpose. • Former CIA officer Robert Baer has reported that an international raid of Saudi High Commission offices found evidence of terrorist plots against America. • Baer also revealed that Salman “personally approved” distribution of funds from the International Islamic Relief Organization, which also has provided material support to al-Qaida. • A recent Gulf Institute report says Salman and former Saudi intelligence chief Prince Turki al-Faisal knowingly aided and abetted al-Qaida in the run-up to 9/11. • Salman works closely with Saudi clerics Saleh al-Moghamsy, a radical anti-Semite, and Safar Hawali, a one-time mentor of Osama bin Laden, according to the Washington Free Beacon. • In “Why America Slept,” author Gerald Posner claimed that Salman’s son Ahmed bin Salman also had ties to al-Qaida and even advance knowledge of the Sept. 11, 2001 attacks.
  • David Andrew Weinberg provides a superb round-up of Salman’s ties to terrorism and extremism: As former CIA official Bruce Riedel astutely pointed out, Salman was the regime’s lead fundraiser for mujahideen, or Islamic holy warriors, in Afghanistan in the 1980s, as well as for Bosnian Muslims during the Balkan struggles of the 1990s. In essence, he served as Saudi Arabia’s financial point man for bolstering fundamentalist proxies in war zones abroad. As longtime governor of Riyadh, Salman was often charged with maintaining order and consensus among members of his family. Salman’s half brother King Khalid (who ruled from 1975 to 1982) therefore looked to him early on in the Afghan conflict to use these family contacts for international objectives, appointing Salman to run the fundraising committee that gathered support from the royal family and other Saudis to support the mujahideen against the Soviets. Riedel writes that in this capacity, Salman “work[ed] very closely with the kingdom’s Wahhabi clerical establishment.” Another CIA officer who was stationed in Pakistan in the late 1980s estimates that private Saudi donations during that period reached between $20 million and $25 million every month. And as Rachel Bronson details in her book, Thicker Than Oil: America’s Uneasy Partnership With Saudi Arabia, Salman also helped recruit fighters for Abdul Rasul Sayyaf, an Afghan Salafist fighter who served as a mentor to both Osama bin Laden and 9/11 mastermind Khalid Sheikh Mohammed.

  • Reprising this role in Bosnia, Salman was appointed by his full brother and close political ally King Fahd to direct the Saudi High Commission for Relief of Bosnia and Herzegovina (SHC) upon its founding in 1992. Through the SHC, Salman gathered donations from the royal family for Balkan relief, supervising the commission until its until its recent closure in 2011. By 2001, the organization had collected around $600 million — nominally for relief and religious purposes, but money that allegedly also went to facilitating arms shipments, despite a U.N. arms embargo on Bosnia and other Yugoslav successor states from 1991 to 1996. And what kind of supervision did Salman exercise over this international commission? In 2001, NATO forces raided the SHC’s Sarajevo offices, discovering a treasure trove of terrorist materials: before-and-after photographs of al Qaeda attacks, instructions on how to fake U.S. State Department badges, and maps marked to highlight government buildings across Washington. The Sarajevo raid was not the first piece of evidence that the SHC’s work went far beyond humanitarian aid. Between 1992 and 1995, European officials tracked roughly $120 million in donations from Salman’s personal bank accounts and from the SHC to a Vienna-based Bosnian aid organization named the Third World Relief Agency (TWRA). Although the organization claimed to be focused on providing humanitarian relief, Western intelligence agencies estimated that the TWRA actually spent a majority of its funds arming fighters aligned with the Bosnian government.
  • A defector from al Qaeda called to testify before the United Nations, and who gave a deposition for lawyers representing the families of 9/11 victims, alleged that both Salman’s SHC and the TWRA provided essential support to al Qaeda in Bosnia, including to his 107-man combat unit. In a deposition related to the 9/11 case, he stated that the SHC “participated extensively in supporting al Qaida operations in Bosnia” and that the TWRA “financed, and otherwise supported” the terrorist group’s fighters. The SHC’s connection to terrorist groups has long been scrutinized by U.S. intelligence officials as well. The U.S. government’s Joint Task Force Guantanamo once included the Saudi High Commission on its list of suspected “terrorist and terrorist support entities.” The Defense Intelligence Agency also once accused the Saudi High Commission of shipping both aid and weapons to Mohamed Farrah Aidid, the al Qaeda-linked Somali warlord depicted as a villain in the movie Black Hawk Down. Somalia was subject to a United Nations arms embargo starting in January 1992. *** The board of trustees for the Prince Salman Youth Center, which Salman himself chairs, today includes Saleh Abdullah Kamel, a Saudi billionaire whose name showed up on a purported list of al Qaeda’s earliest supporters known as the “golden chain.” (The Wall Street Journal reported that Kamel “denies supporting terror.”) But as the United States sought to shut down Saudi charities with ties to terrorism in the aftermath of the 9/11 attacks, Kamel and Salman both condemned the effort as an anti-Islamic witch hunt.
  • In 1995, US aid worker William Jefferson is killed in Bosnia. One of the likely suspects, Ahmed Zuhair Handala, is linked to the SHC. He also is let go, despite evidence linking him to massacres of civilians in Bosnia. [Schindler, 2007, pp. 263-264] In 1997, a Croatian apartment building is bombed, and Handala and two other SHC employees are suspected of the bombing. They escape, but Handala will be captured after 9/11 and sent to Guantanamo prison. He is convicted, but pardoned and released by the Bosnian government two years later. He will be arrested again in 2002 for involvement in an al-Qaeda plot in Bosnia and sent to Guantanamo prison (see January 18, 2002). By 1996, NSA wiretaps reveal that Prince Salman is funding Islamic militants using charity fronts (Between 1994 and July 1996).
  • History Commons adds important details: By 1994, if not earlier, the NSA is collecting electronic intercepts of conversations between Saudi Arabian royal family members. Journalist Seymour Hersh will later write, “according to an official with knowledge of their contents, the intercepts show that the Saudi government, working through Prince Salman [bin Abdul Aziz], contributed millions to charities that, in turn, relayed the money to fundamentalists. ‘We knew that Salman was supporting all of the causes,’ the official told me.” By July 1996 or soon after, US intelligence “had more than enough raw intelligence to conclude… bin Laden [was] receiving money from prominent Saudis.” [Hersh, 2004, pp. 324, 329-330] One such alleged charity front linked to Salman is the Saudi High Commission in Bosnia (see 1996 and After). His son Prince Ahmed bin Salman will later be accused of having connections with al-Qaeda leader Abu Zubaida (see Early April 2002). [PBS, 10/4/2004] It appears this surveillance of Saudi royals will come to an end in early 2001 (see (February-March 2001)).
  • Author Roland Jacquard will later claim that in 1996, al-Qaeda revives its militant network in Bosnia in the wake of the Bosnian war and uses the Saudi High Commission (SHC) as its main charity front to do so. Al-Gahtani will later be killed fighting with al-Qaeda and the Taliban in Afghanistan. [Schindler, 2007, pp. 143-144; Schindler is a professor at the U.S. Army War College] In 1995, the Bosnian Ministry of Finance raids SHC’s offices and discovers documents that show SHC is “clearly a front for radical and terrorism-related activities.” [Burr and Collins, 2006, pp. 145]
  • In November 2002, Prince Salman patronized a fundraising gala for three Saudi charities under investigation by Washington: the International Islamic Relief Organization, al-Haramain Foundation, and the World Assembly of Muslim Youth. Since 9/11, all three organizations have had branches shuttered or sanctioned over allegations of financially supporting terrorism. That same month, Salman cited his experience on the boards of charitable societies, asserting that “it is not the responsibility of the kingdom” if others exploit Saudi donations for terrorism. *** The new king has also embraced Saudi cleric Saleh al-Maghamsi, an Islamic supremacist who declared in 2012 that Osama bin Laden had more “sanctity and honor in the eyes of Allah,” simply for being a Muslim, than “Jews, Christians, Zoroastrians, apostates, and atheists,” whom he described by nature as “infidels.” That didn’t put an end to Salman’s ties to Maghamsi, however. The new Saudi king recently served as head of the supervisory board for a Medina research center directed by Maghamsi. A year after Maghamsi’s offensive comments, Salman sponsored and attended a large cultural festival organized by the preacher. Maghamsi also advises two of Salman’s sons ….
  • A 1996 CIA report mentions, “We continue to have evidence that even high ranking members of the collecting or monitoring agencies in Saudi Arabia, Kuwait, and Pakistan – such as the Saudi High Commission – are involved in illicit activities, including support for terrorists” (see January 1996). Jacquard claims that most of the leadership of the SHC supports bin Laden. The SHC, while participating in some legitimate charitable functions, uses its cover to ship illicit goods, drugs, and weapons in and out of Bosnia. In May 1997, a French military report concludes: ”(T)he Saudi High Commission, under cover of humanitarian aid, is helping to foster the lasting Islamization of Bosnia by acting on the youth of the country. The successful conclusion of this plan would provide Islamic fundamentalism with a perfectly positioned platform in Europe and would provide cover for members of the bin Laden organization.” [Jacquard, 2002, pp. 69-71] However, the US will take no action until shortly after 9/11, when it will lead a raid on the SHC’s Bosnia offices. Incriminating documents will be found, including information on how to counterfeit US State Department ID badges, and handwritten notes about meetings with bin Laden. Evidence of a planned attack using crop duster planes is found as well. [Schindler, 2007, pp. 129, 284]

  • The British government has admitted that its practice of spying on confidential communications between lawyers and their clients was a breach of the European Convention on Human Rights (ECHR). Details of the controversial snooping emerged in November: lawyers suing Blighty over its rendition of two Libyan families to be tortured by the late and unlamented Gaddafi regime claimed Her Majesty's own lawyers seemed to have access to the defense team's emails. The families' briefs asked for a probe by the secretive Investigatory Powers Tribunal (IPT), a move that led to Wednesday's admission. "The concession the government has made today relates to the agencies' policies and procedures governing the handling of legally privileged communications and whether they are compatible with the ECHR," a government spokesman said in a statement to the media, via the Press Association. "In view of recent IPT judgments, we acknowledge that the policies applied since 2010 have not fully met the requirements of the ECHR, specifically Article 8. This includes a requirement that safeguards are made sufficiently public."
  • The guidelines revealed by the investigation showed that MI5 – which handles the UK's domestic security – had free reign to spy on highly private and sensitive lawyer-client conversations between April 2011 and January 2014. MI6, which handles foreign intelligence, had no rules on the matter either until 2011, and even those were considered void if "extremists" were involved. Britain's answer to the NSA, GCHQ, had rules against such spying, but they too were relaxed in 2011. The British government hasn't admitted guilt, but it has at least acknowledged that it was doing something wrong – sort of. "It does not mean that there was any deliberate wrongdoing on the part of the security and intelligence agencies, which have always taken their obligation to protect legally privileged material extremely seriously," the government spokesman said. "Nor does it mean that any of the agencies' activities have prejudiced or in any way resulted in an abuse of process in any civil or criminal proceedings. The agencies will now work with the independent Interception of Communications Commissioner to ensure their policies satisfy all of the UK's human rights obligations." So that's all right, then.

    If you follow the "November" link you'[l learn that yes, indeed, the UK government lawyers were happily getting the content of their adversaries privileged attorney-client communications. Conspicuously, the promises of reform make no mention of what is surely a disbarment offense in the U.S. I doubt that it's different in the UK. Discovery rules of procedure strictly limit how parties may obtain information from the other side. Wiretapping the other side's lawyers is not a permitted from of discovery. Hopefully, at least the government lawyers in the case in which the misbehavior was discovered have been referred for disciplinary action.

What GOP Senators Don't Understand About Iran | Al Jazeera America - 0 views

  • There’s a charming naiveté to the open letter [PDF] by 47 Republican senators that condescendingly seeks to explain features of the U.S. constitutional system to Iran’s leaders that they otherwise “may not fully understand.” The missive warns that, with respect to “your nuclear negotiations with our government ... any agreement regarding your nuclear-weapons program that is not approved by the Congress” could be revoked by the next president “with the stroke of a pen and future Congresses could modify the terms of the agreement at any time.”
  • Beyond the amusing inaccuracies about U.S. parliamentary order, it seems there are some features of the nuclear negotiations that the signatory senators don’t fully understand — not only on the terms of the deal, but also on who would be party to an agreement. There are no negotiations on Iran’s “nuclear-weapons program” because the world’s intelligence agencies (including those of the U.S. and Israel) do not believe Iran is currently building nuclear weapons, nor has it made a strategic decision to use its civilian nuclear infrastructure to produce a bomb. An active Iranian nuclear-weapons program would render moot the current negotiations, because Iran would be in fundamental violation of the Nuclear Non-Proliferation Treaty (NPT). As things stand, Tehran remains within the terms of the NPT, which allows nuclear technology for peaceful purposes, but monitors member states to prevent weaponization. Tehran and the IAEA remain in dispute over full compliance with all transparency requirements of the NPT, particularly over alleged previous research into weapons design. But Iran’s nuclear facilities remain under constant monitoring by international inspectors who certify that no nuclear material is being diverted.
  • The current negotiations are focused on strengthening verifiable safeguards against weaponization over-and-above those required by the NPT, yet the Republican-led Congress, egged on by Israeli Prime Minister Benjamin Netanyahu, is warning that those goals are insufficient, and the terms and time-frame of the deal are unacceptable. The key element missing from the GOP Senators’ letter, however, is that the deal is not being negotiated between Iran and the United States; it is being negotiated between Iran and the P5+1 group, in which the U.S. is joined by Britain, France, Germany, Russia and China. Even if the U.S. is the key player in that group, the deal being pursued reflects an international consensus — the same consensus that has made sanctions against Iran so effective. This was likely in the mind of Iran’s foreign minister, Javad Zarif, who dismissed the letter as “of no legal value” and a “propaganda ploy.” Zarif noted that the deal would indeed be an international agreement adopted by the U.N. Security Council, which a new administration would be obliged to uphold — and that any attempt by the White House or Congress to abrogate, unilaterally modify or impede such an agreement would be a breach of U.S. obligations.

Israel has been briefed on the negotiations all along, so Netanyahu surely knew that the goal was a Security Council resolution that Congress could not affect. And while admittedly, the fact that it was a Security Council Resolution in the making was not widely known, are we to believe that the Speaker of the House of Representatives did not know that too? Germany Concerned about Aggressive NATO Stance on Ukraine - SPIEGEL ONLINE - 0 views

  • It was quiet in eastern Ukraine last Wednesday. Indeed, it was another quiet day in an extended stretch of relative calm. The battles between the Ukrainian army and the pro-Russian separatists had largely stopped and heavy weaponry was being withdrawn. The Minsk cease-fire wasn't holding perfectly, but it was holding. On that same day, General Philip Breedlove, the top NATO commander in Europe, stepped before the press in Washington. Putin, the 59-year-old said, had once again "upped the ante" in eastern Ukraine -- with "well over a thousand combat vehicles, Russian combat forces, some of their most sophisticated air defense, battalions of artillery" having been sent to the Donbass. "What is clear," Breedlove said, "is that right now, it is not getting better. It is getting worse every day." German leaders in Berlin were stunned. They didn't understand what Breedlove was talking about. And it wasn't the first time. Once again, the German government, supported by intelligence gathered by the Bundesnachrichtendienst (BND), Germany's foreign intelligence agency, did not share the view of NATO's Supreme Allied Commander Europe (SACEUR).
  • The pattern has become a familiar one. For months, Breedlove has been commenting on Russian activities in eastern Ukraine, speaking of troop advances on the border, the amassing of munitions and alleged columns of Russian tanks. Over and over again, Breedlove's numbers have been significantly higher than those in the possession of America's NATO allies in Europe. As such, he is playing directly into the hands of the hardliners in the US Congress and in NATO. The German government is alarmed. Are the Americans trying to thwart European efforts at mediation led by Chancellor Angela Merkel? Sources in the Chancellery have referred to Breedlove's comments as "dangerous propaganda." Foreign Minister Frank-Walter Steinmeier even found it necessary recently to bring up Breedlove's comments with NATO General Secretary Jens Stoltenberg.
  • But Breedlove hasn't been the only source of friction. Europeans have also begun to see others as hindrances in their search for a diplomatic solution to the Ukraine conflict. First and foremost among them is Victoria Nuland, head of European affairs at the US State Department. She and others would like to see Washington deliver arms to Ukraine and are supported by Congressional Republicans as well as many powerful Democrats. Indeed, US President Barack Obama seems almost isolated. He has thrown his support behind Merkel's diplomatic efforts for the time being, but he has also done little to quiet those who would seek to increase tensions with Russia and deliver weapons to Ukraine.   • German foreign policy experts are united in their view of Breedlove as a hawk. "I would prefer that Breedlove's comments on political questions be intelligent and reserved," says Social Democrat parliamentarian Niels Annen, for example. "Instead, NATO in the past has always announced a new Russian offensive just as, from our point of view, the time had come for cautious optimism." Annen, who has long specialized in foreign policy, has also been frequently dissatisfied with the information provided by NATO headquarters. "We parliamentarians were often confused by information regarding alleged troop movements that were inconsistent with the information we had," he says. The pressure on Obama from the Republicans, but also from his own political camp, is intense. Should the ceasefire in eastern Ukraine not hold, it will likely be difficult to continue refusing Kiev's requests for shipments of so-called "defensive weapons." And that would represent a dramatic escalation of the crisis. Moscow has already begun issuing threats in anticipation of such deliveries. "Any weapons deliveries to Kiev will escalate the tensions and would unhinge European security," Nikolai Patrushev, secretary of Russia's national security council, told the Russian newspaper Komsomolskaya Pravda on Wednesday.
  • The German government, meanwhile, is doing what it can to influence Breedlove. Sources in Berlin say that conversations to this end have taken place in recent weeks. But there are many at NATO headquarters in Brussels who are likewise concerned about Breedlove's statements. On Tuesday of last week, Breedlove's public appearances were an official item on the agenda of the North Atlantic Council's weekly lunch meeting. Several ambassadors present criticized Breedlove and expressed their incredulity at some of the commander's statements. The government in Berlin is concerned that Breedlove's statements could harm the West's credibility. The West can't counter Russian propaganda with its own propaganda, "rather it must use arguments that are worthy of a constitutional state." Berlin sources also say that it has become conspicuous that Breedlove's controversial statements are often made just as a step forward has been made in the difficult negotiations aimed at a political resolution. Berlin sources say that Germany should be able to depend on its allies to support its efforts at peace.
  • A mixture of political argumentation and military propaganda is necessary. But for months now, many in the Chancellery simply shake their heads each time NATO, under Breedlove's leadership, goes public with striking announcements about Russian troop or tank movements. To be sure, neither Berlin's Russia experts nor BND intelligence analysts doubt that Moscow is supporting the pro-Russian separatists. The BND even has proof of such support. But it is the tone of Breedlove's announcements that makes Berlin uneasy. According to Asarov, Nuland said that, were violence used against the protesters on Maidan Square, information about the money he and his cronies had taken out of the country would be made public.

  • Using the broad powers granted under the USA PATRIOT Act, the FBI demanded that 4 librarians produce private information about library patrons’ reading habits, then used an endless gag order to force them to remain silent about the request for the rest of their lives under penalty of prison time.
  • The FBI was demanding that the library hand over private data on library patrons en masse “to protect against international terrorism.” The document that Mr. Christian was given was a so-called National Security Letter (NSL), a type of administrative subpoena for personal information — self-written by the FBI without any probable cause or judicial oversight.  The legal framework for these powerful NSLs was established by Section 505 of the USA PATRIOT Act in 2001. What’s more, Mr. Christian was placed under a perpetual gag order.  The NSL prohibited the recipient “from disclosing to any person that the F.B.I. has sought or obtained access to information or records under these provisions.”  The gag order was broad enough that it was a crime to discuss the matter to any other person — for life.  The USA PATRIOT Act allows for this suppression of speech, and issues a punishment of up to 5 years in prison for anyone caught violating the endless gag order.

The gag served to legally prevent Mr. Christian from personally testifying before Congress about the effects of the USA PATRIOT Act before the law’s reauthorization in March of 2006.   It passed through Congress easily and was signed once again by President George W. Appellate judges were clearly disturbed by the breadth of the NSL gag provisions.  One appellate judge wrote, “A ban on speech and a shroud of secrecy in perpetuity are antithetical to democratic concepts and do not fit comfortably with the fundamental rights guaranteed American citizens… Unending secrecy of actions taken by government officials may also serve as a cover for possible official misconduct and/or incompetence.” Sensing a potential legal defeat, the government took the steps necessary to preserve its powers.  Only a few weeks after the USA PATRIOT Act was renewed, the FBI abandoned the Library Connection case and voluntarily lifted the librarians’ gag order.  This eliminated the possibility that the NSL provisions could be struck down in court, protecting the USA PATRIOT Act from further judicial scrutiny.  In May 2006, the four librarians broke their silence at last.

Human Rights Council has already launched its own investigation of potential war crimes committed during Israel's latest invasion of Gaza. An article passed by me sometime during the last 48 hours that quoted the Chief Prosecutor at the ICC to the effect that she would act if Palestine filed charges but said that "the ball is in Palestine's court." The ICC has been widely criticized for its preference of convicting the leaders of African nations rather than of caucasian nations. Given that circumstance, the Court of 15 judges may welcome the Palestinian opportunity to prove that it is willing to convict leaders of a non-African nation. Certainly, Israel's occupation and colonization of Palestine since hostilities ceased in 1967 offers more than fertile ground for such a case. I have to admit that I enjoy my mental picture of Benjamin Netanyahu in chains standing in the Court's dock in The Hague.

What Really Matters About the Extended Negotiations with Iran « LobeLog - 0 views

  • The single most important fact about the extension of the nuclear negotiations with Iran is that the obligations established by the Joint Plan of Action negotiated a year ago will remain in effect as negotiations continue. This means that our side will continue to enjoy what these negotiations are supposed to be about: preclusion of any Iranian nuclear weapon, through the combination of tight restrictions on Iran’s nuclear program and intrusive monitoring to ensure the program stays peaceful. Not only that, but also continuing will be the rollback of Iran’s program that the JPOA achieved, such that Iran will remain farther away from any capability to build a bomb than it was a year ago, and even farther away from where it would have been if the negotiations had never begun or from where it would be if negotiations were to break down. Our side—the United States and its partners in the P5+1—got by far the better side of the deal in the JPOA. We got the fundamental bomb-preventing restrictions (including most significantly a complete elimination of medium-level uranium enrichment) and enhanced inspections we sought, in return for only minor sanctions relief to Iran that leaves all the major banking and oil sanctions in place. If negotiations were to go on forever under these terms, we would have no cause to complain to the Iranians.
  • But the Iranians do not have comparable reason to be happy about this week’s development. The arrangement announced in Vienna is bound to be a tough sell back in Tehran for President Rouhani and Foreign Minister Zarif. The sanctions continue, and continue to hurt, even though the Iranian negotiators have conceded most of what they could concede regarding restrictions on the nuclear program. There will be a lot of talk in Tehran about how the West is stringing them along, probably with the intent of undermining the regime and not just determining its nuclear policies.
  • That the Iranian decision-makers have put themselves in this position is an indication of the seriousness with which they are committed to these negotiations. This week’s extension is of little use to them except to keep alive the prospect that a final deal will be completed. Also indicating their seriousness is the diligence with which Iran has complied with its obligations under the JPOA. The International Atomic Energy Agency confirmed today Iran’s compliance with its final pre-November 24th obligation, which had to do with reducing its stock of low-enriched uranium in gaseous form.

  • Because the P5+1 got much the better side of the preliminary agreement, the P5+1 will have to make more of the remaining concessions to complete a final agreement. The main hazard to concluding a final deal is not an Iranian unwillingness to make concessions. The main hazard is a possible Iranian conclusion that it does not have an interlocutor on the U.S. side that is bargaining in good faith. We push the Iranians closer to such a conclusion the more talk there is in Washington about imposing additional pressure and additional sanctions, as people such as Marco Rubio and AIPAC have offered in response to today’s announcement about the extension of negotiations. We have sanctioned the dickens out of Iran for years and are continuing to do so, but the only time all this pressure got any results is when we started to negotiate in good faith. Surly sanctions talk on Capitol Hill only strengthens Iranian doubts about whether the U.S. administration will be able to deliver on its side of a final agreement, making it less, not more, likely the Iranians would offer still more concessions. Any actual sanctions legislation would blatantly violate the terms of the JPOA and give the Iranians good reason to walk away from the whole business, marking the end of any special restrictions on their nuclear program.
  • Indefinite continuation of the terms of the existing agreement would suit us well, but completion of a final agreement would be even better—and without one the Iranians eventually would have to walk away, because indefinite continuation certainly does not suit them. And besides, the sanctions hurt us economically too. To get a final agreement does not mean fixating on the details of plumbing in enrichment cascades, which do not affect our security anyway. It means realizing what kind of deal we got with the preliminary agreement, and negotiating in good faith to get the final agreement.

  • We do know that the nation’s domestic-intelligence network is massive, including at least 59 federal agencies, over 300 Defense Department units, and approximately 78 state-based fusion centers, as well as the multitude of law enforcement agencies they serve. We also know that local law enforcement agencies have themselves raised concerns about the system’s lack of privacy protections.
  • The SAR database is part of an ever-expanding domestic surveillance system established after 9/11 to gather intelligence on potential terrorism threats. At an abstract level, such a system may seem sensible: far better to prevent terrorism before it happens than to investigate and prosecute after a tragedy. Based on that reasoning, the government exhorts Americans to “see something, say something” -- the SAR program’s slogan. Indeed, just this week at a conference in New York City, FBI Director James Comey asked the public to report any suspicions they have to authorities. “When the hair on the back of your neck stands, listen to that instinct and just tell somebody,” said Comey. And seeking to reassure those who do not want to get their fellow Americans in trouble based on instinct alone, the FBI director added, “We investigate in secret for a very good reason, we don't want to smear innocent people.”

  • At a fundamental level, suspicious activity reporting, as well as the digital and physical infrastructure of networked computer servers and fusion centers built around it, depends on what the government defines as suspicious.  As it happens, this turns out to include innocuous, First Amendment-protected behavior. As a start, a little history: the Nationwide Suspicious Activity Reporting Initiative was established in 2008 as a way for federal agencies, law enforcement, and the public to report and share potential terrorism-related information. The federal government then developed a list of 16 behaviors that it considered “reasonably indicative of criminal activity associated with terrorism.” Nine of those 16 behaviors, as the government acknowledges, could have nothing to do with criminal activity and are constitutionally protected, including snapping photographs, taking notes, and “observation through binoculars.”
  • There are any number of problems with this approach, starting with its premise.  Predicting who exactly is a future threat before a person has done anything wrong is a perilous undertaking. That’s especially the case if the public is encouraged to report suspicions of neighbors, colleagues, and community members based on a “hair-on-the-back-of-your-neck” threshold. Nor is it any comfort that the FBI promises to protect the innocent by investigating “suspicious” people in secret. The civil liberties and privacy implications are, in fact, truly hair-raising, particularly when the Bureau engages in abusive and discriminatory sting operations and other rights violations.
  • A few months later, a scathing report from the Senate subcommittee on homeland security described similar intelligence problems in state-based fusion centers. It found that Department of Homeland Security (DHS) personnel assigned to the centers “forwarded ‘intelligence’ of uneven quality -- oftentimes shoddy, rarely timely, sometimes endangering citizens’ civil liberties and Privacy Act protections... and more often than not unrelated to terrorism.”
  • Law enforcement officials, including the Los Angeles Police Department’s top counterterrorism officer, have themselves exhibited skepticism about suspicious activity reporting (out of concern with the possibility of overloading the system). In 2012, George Washington University’s Homeland Security Policy Institute surveyed counterterrorism personnel working in fusion centers and in a report generally accepting of SARs noted that the program had “flooded fusion centers, law enforcement, and other security outfits with white noise,” complicating “the intelligence process” and distorting “resource allocation and deployment decisions.” In other words, it was wasting time and sending personnel off on wild goose chases.
  • Under federal regulations, the government can only collect and maintain criminal intelligence information on an individual if there is a “reasonable suspicion” that he or she is “involved in criminal conduct or activity and the information is relevant to that criminal conduct or activity.” The SAR program officially lowered that bar significantly, violating the federal government’s own guidelines for maintaining a “criminal intelligence system.” There’s good reason for, at a minimum, using a reasonable suspicion standard. Anything less and it’s garbage in, garbage out, meaning counterterrorism “intelligence” databases become anything but intelligent.
  • yet another burgeoning secret database that the federal government calls its “consolidated terrorism watchlist.” Inclusion in this database -- and on government blacklists that are generated from it -- can bring more severe repercussions than unwarranted law enforcement attention. It can devastate lives.
  • There is hope, however. In August, four years after the ACLU filed a lawsuit on behalf of 13 people on the no-fly list, a judge ruled that the government’s redress system is unconstitutional. In early October, the government notified Mashal and six others that they were no longer on the list. Six of the ACLU’s clients remain unable to fly, but at least the government now has to disclose just why they have been put in that category, so that they can contest their blacklisting. Soon, others should have the same opportunity.
  • As of August 2013, there were approximately 47,000 people, including 800 U.S. citizens and legal permanent residents like Mashal, on that secretive no-fly list, all branded as “known or suspected terrorists.” All were barred from flying to, from, or over the United States without ever being given a reason why. On 9/11, just 16 names had been on the predecessor “no transport” list. The resulting increase of 293,650% -- perhaps more since 2013 -- isn’t an accurate gauge of danger, especially given that names are added to the list based on vague, broad, and error-prone standards.
  • The No Fly List is only the best known of the government’s web of terrorism watchlists. Many more exist, derived from the same master list.  Currently, there are more than one million names in the Terrorist Identities Datamart Environment, a database maintained by the National Counterterrorism Center. This classified source feeds the Terrorist Screening Database (TSDB), operated by the FBI’s Terrorist Screening Center. The TSDB is an unclassified but still secret list known as the “master watchlist.” containing what the government describes as “known or suspected terrorists,” or KSTs.
  • Nothing encapsulates the post-9/11, Alice-in-Wonderland inversion of American notions of due process more strikingly than this “blacklist first, innocence later... maybe” mindset. The Terrorist Screening Database is then used to fill other lists. In the context of aviation, this means the no-fly list, as well as the selectee and expanded selectee lists. Transportation security agents subject travelers on the latter two lists to extra screenings, which can include prolonged and invasive interrogation and searches of laptops, phones, and other electronic devices. Around the border, there’s the State Department’s Consular Lookout and Support System, which it uses to flag people it thinks shouldn’t get a visa, and the TECS System, which Customs and Border Protection uses to determine whether someone can enter the country.
  • According to documents recently leaked to the Intercept, as of August 2013 that master watchlist contained 680,000 people, including 5,000 U.S. citizens and legal permanent residents. The government can add people’s names to it according to a shaky “reasonable suspicion” standard. There is, however, growing evidence that what’s “reasonable” to the government may only remotely resemble what that word means in everyday usage. Information from a single source, even an uncorroborated Facebook post, can allow a government agent to watchlist an individual with virtually no outside scrutiny. Perhaps that’s why 40% of those on the master watchlist have “no recognized terrorist group affiliation,” according to the government’s own records.
  • This opens up the possibility of increased surveillance and tense encounters with the police, not to speak of outright harassment, for a large but undivulged number of people. When a police officer stops a person for a driving infraction, for instance, information about his or her KST status will pop up as soon a driver’s license is checked.  According to FBI documents, police officers who get a KST hit are warned to “approach with caution” and “ask probing questions.” When officers believe they’re about to go face to face with a terrorist, bad things can happen. It’s hardly a stretch of the imagination, particularly after a summer of police shootings of unarmed men, to suspect that an officer approaching a driver whom he believes to be a terrorist will be quicker to go for his gun. Meanwhile, the watchlisted person may never even know why his encounters with police have taken such a peculiar and menacing turn. According to the FBI's instructions, under no circumstances is a cop to tell a suspect that he or she is on a watchlist.
  • Inside the United States, no watchlist may be as consequential as the one that goes by the moniker of the Known or Appropriately Suspected Terrorist File. The names on this blacklist are shared with more than 17,000 state, local, and tribal police departments nationwide through the FBI’s National Crime Information Center (NCIC). Unlike any other information disseminated through the NCIC, the KST File reflects mere suspicion of involvement with criminal activity, so law enforcement personnel across the country are given access to a database of people who have secretly been labeled terrorism suspects with little or no actual evidence, based on virtually meaningless criteria.
  • And once someone is on this watchlist, good luck getting off it. According to the government’s watchlist rulebook, even a jury can’t help you. “An individual who is acquitted or against whom charges are dismissed for a crime related to terrorism,” it reads, “may nevertheless meet the reasonable standard and appropriately remain on, or be nominated to, the Terrorist Watchlist.” No matter the verdict, suspicion lasts forever.
  • The SARs program and the consolidated terrorism watchlist are just two domestic government databases of suspicion. Many more exist. Taken together, they should be seen as a new form of national ID for a growing group of people accused of no crime, who may have done nothing wrong, but are nevertheless secretly labeled by the government as suspicious or worse. Innocent until proven guilty has been replaced with suspicious until determined otherwise. Think of it as a new shadow system of national identification for a shadow government that is increasingly averse to operating in the light. It’s an ID its “owners” don’t carry around with them, yet it’s imposed on them whenever they interact with government agents or agencies.   • Swiss prosecutors have searched offices of the Geneva subsidiary of HSBC bank in an inquiry into alleged money-laundering. They said they were investigating HSBC Private Bank (Suisse) and "persons unknown for suspected aggravated money laundering". The investigation could be extended to people suspected of committing or participating in money laundering. HSBC said it was "co-operating with the Swiss authorities." The raid comes more than a week after allegations first emerged that HSBC's Swiss private bank may have helped wealthy clients evade tax. HSBC published a full-page advert in several weekend papers containing an apology over the claims.
  • The chief executive of HSBC's Swiss private bank, Franco Morra, said last week it had shut down accounts from clients who "did not meet our high standards". Mr Morra added the revelations about "historical business practices" were a reminder that the old business model of Swiss private banking was no longer acceptable.
  • HM Revenue & Customs was given the leaked data in 2010 and has identified 1,100 people who had not paid their taxes. Last week, HSBC admitted that it was "accountable for past control failures", but said it had now "fundamentally changed". "We acknowledge that the compliance culture and standards of due diligence in HSBC's Swiss private bank, as well as the industry in general, were significantly lower than they are today," it added. The bank faces criminal investigations in the US, France, Belgium and Argentina, but not in the UK, where HSBC is based. HSBC said it was "co-operating with relevant authorities".

  • Geneva's attorney general, Olivier Jornot, told reporters the investigation could be extended to individuals suspected of money laundering or tax fraud. "The goal of this investigation is precisely to verify if the information that has been made public are well-founded and if de facto reproaches can be made, whether it be towards the bank, or towards physical persons, like collaborators or clients," he said. Offshore accounts are not illegal, but many people use them to hide cash from the tax authorities. And while tax avoidance is perfectly legal, deliberately hiding money to evade tax is not. The allegations have caused a political storm in the UK over who knew what and when.
  • The leaked data was not received by the government until 2010 by which time the coalition had taken power, but refers to tax evasion that took place under the last Labour government between 2005 and 2007. The man in charge of HSBC at the time, Stephen Green, was made a Conservative peer and appointed to the government. Lord Green was made a minister eight months after HMRC had been given the leaked documents from his bank. He served as a minister of trade and investment until 2013.
