Byron York: Justice Department demolishes case against Trump order | Washington Examiner - 1 views

    "James Robart, the U.S. district judge in Washington State, offered little explanation for his decision to stop President Trump's executive order temporarily suspending non-American entry from seven terror-plagued countries. Robart simply declared his belief that Washington State, which in its lawsuit against Trump argued that the order is both illegal and unconstitutional, would likely win the case when it is tried. Now the government has answered Robart, and unlike the judge, Justice Department lawyers have produced a point-by-point demolition of Washington State's claims. Indeed, for all except the most partisan, it is likely impossible to read the Washington State lawsuit, plus Robart's brief comments and writing on the matter, plus the Justice Department's response, and not come away with the conclusion that the Trump order is on sound legal and constitutional ground. Beginning with the big picture, the Justice Department argued that Robart's restraining order violates the separation of powers, encroaches on the president's constitutional and legal authority in the areas of foreign affairs, national security, and immigration, and "second-guesses the president's national security judgment" about risks faced by the United States. Indeed, in court last week, Robart suggested that he, Robart, knows as much, or perhaps more, than the president about the current state of the terrorist threat in Yemen, Somalia, Libya, and other violence-plagued countries. In an exchange with Justice Department lawyer Michelle Bennett, Robart asked, "How many arrests have there been of foreign nationals for those seven countries since 9/11?" "Your Honor, I don't have that information," said Bennett. "Let me tell you," said Robart. "The answer to that is none, as best I can tell. So, I mean, you're here arguing on behalf of someone [President Trump] that says: We have to protect the United States from these individuals coming from these countries, and there's no support for that."

Donald Trump Withdraws Proposal To Create Safe Zones In Syria | The Huffington Post - 0 views

  • President Donald Trump’s executive order freezing the United States’ refugee resettlement program, barring Syrian refugees indefinitely and temporarily restricting immigration from unnamed countries is already resulting in families being stopped at airports. But the order is also notable for its exclusion of a provision, which appeared in an earlier draft of the order, that would have created a process for establishing so-called safe zones in Syria. That clause would have instructed the secretary of defense to draft a plan within 90 days to create “safe zones to protect vulnerable Syrian populations,” according to a copy of the draft published by The Huffington Post on Wednesday. The decision to omit the safe zones proposal allows the Trump administration to avoid, at least temporarily, the complex questions that such a policy would raise. Creating and protecting safe zones could increase American military intervention in Syria, and pose a number of political and logistical problems regarding its implementation.
  • Both Republican and Democratic officials have at times advocated for implementing safe zones in Syria. Former Secretary of State Hillary Clinton made safe zones part of her foreign policy platform during her 2016 presidential campaign, and prominent GOP figures like Sens. Marco Rubio (Fla.), Lindsey Graham (S.C.) and John McCain (Ariz.) have all advocated for the policy. German Chancellor Angela Merkel also supported potential safe zones along the Turkey-Syria border, and has discussed the idea of havens for displaced Yazidis in northern Iraq. Turkey has previously backed the policy as well, and already controls a strip of land in Syria along its border that has become something of a de facto safe zone for internally displaced people.

  • The facts speak clear and loud and are beyond the realm of speculation: The cockpit shows traces of shelling! You can see the entry and exit holes. The edge of a portion of the holes is bent inwards. These are the smaller holes, round and clean, showing the entry points most likely that of a 30 millimeter caliber projectile. The destruction is limited to the cockpit area. Now you have to factor in that this part is constructed of specially reinforced material The OSCE Mission It is worth noting that the initial statements by OSCE observers (July 31) broadly confirm the findings of Peter Haisenko: Monitors from the Organization for Security and Cooperation in Europe reported that shrapnel-like holes were found in two separate pieces of the fuselage of the ill-fated Malaysia Airlines aircraft that was believed to have been downed by a missile in eastern Ukraine. Michael Bociurkiw of the OSCE group of monitors at his daily briefing described part of the plane’s fuselage dotted with “shrapnel-like, almost machine gun-like holes.” He said the damage was inspected by Malaysian aviation-security officials .(Wall Street Journal, July 31, 2014)
  • The monitoring OSCE team has not found evidence of a missile fired from the ground as conveyed by official White House statements. As we recall, the US ambassador to the UN Samantha Power stated –pointing a finger at Russia– that the Malaysian MH17 plane was “likely downed by a surface-to-air missile operated from a separatist-held location”: The team of international investigators with the Organisation for Security and Cooperation in Europe (OSCE) are uncertain if the missile used was fired from the ground as US military experts have previously suggested, the Wall Street Journal (WSJ) reported. (Malay Mail online, emphasis added) The initial OSCE findings tend to dispel the claim that a BUK missile system brought down the plane. Evidently, inasmuch as the perforations are attributable to shelling, a shelling operation conducted from the ground could not have brought down an aircraft traveling above 30,000 feet.

  • Peter Haisenko’s study is corroborated by the Russian Ministry of Defense which pointed to a Ukrainian Su-25 jet in the flight corridor of the MH17, within proximity of the plane. Ironically, the presence of a military aircraft is also confirmed by a BBC  report conducted at the crash site on July 23. All the eyewitnesses  interviewed by the BBC confirmed the presence of a Ukrainian military aircraft flying within proximity of Malaysian Airlines MH17 at the time that it was shot down:

  • The original BBC Video Report published by BBC Russian Service on July 23, 2014 has since been removed from the BBC archive.  In a bitter irony, The BBC is censoring its own news productions. Media Spin The media is now saying that a missile was indeed fired but it was not the missile that brought down the plane, it was the shrapnel from the missile which punctured the plane and then led to a loss of pressure.  According to Ukraine’s National security spokesman Andriy Lysenko in a contradictory statement, the MH17 aircraft “suffered massive explosive decompression after being hit by a shrapnel missile.”  (See IBT, Australia) In an utterly absurd report, the BBC quoting the official Ukraine statement  says that:
  • The downed Malaysia Airlines jet in eastern Ukraine suffered an explosive loss of pressure after it was punctured by shrapnel from a missile. They say the information came from the plane’s flight data recorders, which are being analysed by British experts. However, it remains unclear who fired a missile, with pro-Russia rebels and Ukraine blaming each other. Many of the 298 people killed on board flight MH17 were from the Netherlands. Dutch investigators leading the inquiry into the crash have refused to comment on the Ukrainian claims.
  • The shrapnel marks should be distinguished from the small entry and exit holes “most likely that of a 30 millimeter caliber projectile” fired from a military aircraft. These holes could not have been caused by a missile attack as hinted by the MSM. While the MSN is saying that the “shrapnel like holes” can be caused by a missile (see BBC report above), the OSCE has confirmed the existence of what it describes as “machine gun like holes”, without however acknowledging that these cannot be caused by a missile. In this regard, the GSh-302 firing gun operated by an Su-25 is able to fire 3000 rpm which explains the numerous entry and exit holes. According to the findings of Peter Haisenko: If we now consider the armament of a typical SU 25 we learn this: It is equipped with a double-barreled 30-mm gun, type GSh-302 / AO-17A, equipped with: a 250 round magazine of anti-tank incendiary shells and splinter-explosive shells (dum-dum), arranged in alternating order. The cockpit of the MH 017 has evidently been fired at from both sides: the entry and exit holes are found on the same fragment of it’s cockpit segment (op cit)
  • The accusations directed against Russia including the sanctions regime imposed by Washington are based on a lie. The evidence does not support the official US narrative to the effect that the MH17 was shot down by a BUK missile system operated by the DPR militia.

  • Why is the U.S. targeting Iran’s central bank? Well, multi-billionaire Hugo Salinas Price told King World News: What happened to Mr. Gaddafi, many speculate the real reason he was ousted was that he was planning an all-African currency for conducting trade. The same thing happened to him that happened to Saddam because the US doesn’t want any solid competing currency out there vs the dollar. You know Gaddafi was talking about a gold dinar. And as I noted in August: Ellen Brown argues in the Asia Times that there were even deeper reasons for the war than gold, oil or middle eastern regime change. Brown argues that Libya – like Iraq under Hussein – challenged the supremacy of the dollar and the Western banks: Later, the same general said they planned to take out seven countries in five years: Iraq, Syria, Lebanon, Libya, Somalia, Sudan, and Iran. What do these seven countries have in common? In the context of banking, one that sticks out is that none of them is listed among the 56 member banks of the Bank for International Settlements (BIS). That evidently puts them outside the long regulatory arm of the central bankers’ central bank in Switzerland.

Gaddafi suggested establishing a united African continent, with its 200 million people using this single currency. *** And that brings us back to the puzzle of the Libyan central bank. In an article posted on the Market Oracle, Eric Encina observed:

  • Adding credence to the theory about why Gadhafi had to be overthrown, as The New American reported in March, was the rebels’ odd decision to create a central bank to replace Gadhafi’s state-owned monetary authority. The decision was broadcast to the world in the early weeks of the conflict. In a statement describing a March 19 meeting, the rebel council announced, among other things, the creation of a new oil company. And more importantly: “Designation of the Central Bank of Benghazi as a monetary authority competent in monetary policies in Libya and appointment of a Governor to the Central Bank of Libya, with a temporary headquarters in Benghazi.” The creation of a new central bank, even more so than the new national oil regime, left analysts scratching their heads. “I have never before heard of a central bank being created in just a matter of weeks out of a popular uprising,” noted Robert Wenzel in an analysis for the Economic Policy Journal. “This suggests we have a bit more than a rag tag bunch of rebels running around and that there are some pretty sophisticated influences,” he added. Wenzel also noted that the uprising looked like a “major oil and money play, with the true disaffected rebels being used as puppets and cover” while the transfer of control over money and oil supplies takes place.

  • A review of top-secret NSA documents suggests that the surveillance agency still collects and sifts through large quantities of Americans' online data – despite the Obama administration's insistence that the program that began under Bush ended in 2011.Shawn Turner, the Obama administration's director of communications for National Intelligence, told the Guardian that "the internet metadata collection program authorized by the Fisa court was discontinued in 2011 for operational and resource reasons and has not been restarted."But the documents indicate that the amount of internet metadata harvested, viewed, processed and overseen by the Special Source Operations (SSO) directorate inside the NSA is extensive.While there is no reference to any specific program currently collecting purely domestic internet metadata in bulk, it is clear that the agency collects and analyzes significant amounts of data from US communications systems in the course of monitoring foreign targets.
  • On December 26 2012, SSO announced what it described as a new capability to allow it to collect far more internet traffic and data than ever before. With this new system, the NSA is able to direct more than half of the internet traffic it intercepts from its collection points into its own repositories. One end of the communications collected are inside the United States.The NSA called it the "One-End Foreign (1EF) solution". It intended the program, codenamed EvilOlive, for "broadening the scope" of what it is able to collect. It relied, legally, on "FAA Authority", a reference to the 2008 Fisa Amendments Act that relaxed surveillance restrictions.This new system, SSO stated in December, enables vastly increased collection by the NSA of internet traffic. "The 1EF solution is allowing more than 75% of the traffic to pass through the filter," the SSO December document reads. "This milestone not only opened the aperture of the access but allowed the possibility for more traffic to be identified, selected and forwarded to NSA repositories."

Ukraine's Gold Reserves Secretely Flown Out and Confiscated by the New York Federal Res... - 0 views

  • A Russian Internet news site Iskra (“Spark”) based in Zaporozhye, eastern Ukraine,  reported on March 7, that  “Ukraine’s gold reserves had been hastily airlifted to the United States from Borispol Airport east of Kiev”. This alleged airlift and confiscation of Ukraine’s gold reserves by the New York Federal Reserve has not been confirmed by the Western media.

  • While the unconfirmed report regarding Ukraine’s gold reserves has not been the object of coverage by the mainstream financial news, the story was nonetheless picked up by the Shanghai Metals Market at  Metal.com. which states, quoting a report from the Ukrainian government, that Ukraine’s gold reserves had been “moved on an aircraft from … Kiev to the United States… in 40 sealed boxes” loaded on an unidentified aircraft. The unconfirmed source quoted by Metal.com, says that the operation to airlift Ukraine’s gold had been ordered by the acting Prime Minister Arseny Yatsenyuk with a view to safe-keeping Ukraine’s gold reserves at the NY Fed, against a possible Russian invasion which could lead to the confiscation of Ukraine’s gold reserves. On March 10, kingworldnews, a prominent online financial blog site published an incisive interview with William Kaye, a Hong Kong based hedge fund manager at Pacific Group Ltd. who had previously worked for Goldman Sachs in mergers and acquisitions.  ‎

  • Of significance in this interview with William Kaye is the analogy between Ukraine, Iraq and Libya. Lest we forget, both Iraq and Libya had their gold reserves confiscated by the US:
  • Kaye:  “There are now reports coming from Ukraine that all of the Ukrainian gold has been airlifted, at 2 AM Ukrainian time, out of the main airport, Boryspil Airport, in Kiev, and is being flown to New York — the presumable destination being the New York Fed…. Now that’s 33 tons of gold which is worth somewhere between $1.5 billion – $2 billion.  That would amount to a very nice down payment to the $5 billion that Assistant Secretary of State Victoria Nuland boasted that the United States has already spent in their efforts to destabilize Ukraine, and put in place their own unelected  government. Eric King:  “Whether the United States is taking down Saddam Hussein in Iraq, or Muammar Gaddafi in Libya, there always seems to be gold at the end of the rainbow, which the U.S. then appropriates.” Kaye:  “That’s a good point, Eric.  The United States installed a former banker in Ukraine who is very friendly to the West.  He is also a guy with central bank experience.  This would have been his first major decision to transport that gold out of Ukraine to the United States.
  • You may recall that allegedly the logistical requirements prevented the New York Fed from returning the 300 tons of gold the United States stores for Germany back to Germany.  After a year of waiting, the New York Fed only sent Germany 5 tons of gold.  So only 5 tons of gold was sent from the Fed to Germany, and it wasn’t even the 5 tons that had been originally stored with the Fed. Even the Bundesbank has admitted that the gold sent to them by the New York Fed had to be melted down and tested for purity because it wasn’t Germany’s original bars.  So how is it, since logistical requirements are supposedly such a major issue, that in one airlift, assuming this report is accurate, all the gold Ukraine possessed in their vault was taken out of Ukraine and delivered to the New York Fed? I think anybody with any active brain cells knows that just like Germany, Ukraine will have to wait a very long time, and very likely will never see that gold again.  Meaning, that gold is gone.” (KingsWorldNews, March 10, 2014, emphasis added)

  • First, I was amazed at how few photos can be found from the wreckage with Google. All are in low resolution, except one: The fragment of the cockpit below the window on the pilots side. This image, however, is shocking. In Washington, you can now hear views expressed of a “potentially tragic error / accident” regarding MH 017.   • I recommend to click on the little picture to the left. You can download this photo as a PDF in good resolution. This is necessary, because that will allow you understand what I am describing here. The facts speak clear and loud and are beyond the realm of speculation: The cockpit shows traces of shelling! You can see the entry and exit holes. The edge of a portion of the holes is bent inwards. These are the smaller holes, round and clean, showing the entry points most likely that of a 30 millimeter caliber projectile. The edge of the other, the larger and slightly frayed exit holes showing shreds of metal pointing produced by the same caliber projectiles. Moreover, it is evident that at these exit holes of the outer layer of the double aluminum reinforced structure are shredded or bent – outwardly! Furthermore, minor cuts can be seen, all bent outward, which indicate that shrapnel had forcefully exited through the outer skin from the inside of the cockpit. The open rivets are are also bent outward.
  • In sifting through the available images one thing stands out: All wreckage of the sections behind the cockpit are largely intact, except for the fact that only fragments of the aircraft remained . Only the cockpit part shows these peculiar marks of destruction. This leaves the examiner with an important clue. This aircraft was not hit by a missile in the central portion. The destruction is limited to the cockpit area. Now you have to factor in that this part is constructed of specially reinforced material. This is on account of the nose of any aircraft having to withstand the impact of a large bird at high speeds. You can see in the photo, that in this area significantly stronger aluminum alloys were being installed than in the remainder of the outer skin of the fuselage. One remembers the crash of Pan Am over Lockerbie. It was a large segment of the cockpit that due to the special architecture survived the crash in one piece. In the case of flight MH 017 it becomes abundantly clear that there also an explosion took place inside the aircraft.

  • So what could have happened? Russia recently published radar recordings, that confirm at least one Ukrainian SU 25 in close proximity to MH 017. This corresponds with the statement of the now missing Spanish controller ‘Carlos’ that has seen two Ukrainian fighter aircraft in the immediate vicinity of MH 017. If we now consider the armament of a typical SU 25 we learn this: It is equipped with a double-barreled 30-mm gun, type GSh-302 / AO-17A, equipped with: a 250 round magazine of anti-tank incendiary shells and splinter-explosive shells (dum-dum), arranged in alternating order. The cockpit of the MH 017 has evidently been fired at from both sides: the entry and exit holes are found on the same fragment of it’s cockpit segment! Now just consider what happens when a series of anti-tank incendiary shells and splinter-explosive shells hit the cockpit. These are after all designed to destroy a modern tank. The anti-tank incendiary shells partially traversed the cockpit and exited on the other side in a slightly deformed shape. (Aviation forensic experts could possibly find them on the ground presumably controlled by the Kiev Ukrainian military; the translator). After all, their impact is designed to penetrate the solid armor of a tank. Also, the splinter-explosive shells will, due to their numerous impacts too cause massive explosions inside the cockpit, since they are designed to do this. Given the rapid firing sequence of the GSh-302 cannon, it will cause a rapid succession of explosions within the cockpit area in a very short time. Remeber each of these is sufficient to destroy a tank.

The real reason for the coming showdown in Syria is the success of Russia’s military intervention in defense of the Syrian government against the Islamic State and other extremist groups.   • U.S. foreign policymakers have experimented at planting propaganda in social media and then citing it as evidence to support their goals, a process now playing out in the Syrian “regime change,” as Rick Sterling explains.
  • The major achievement of The Syria Campaign has been the branding and promotion of the “White Helmets,” also known as “Syria Civil Defense,” which began with a British military contractor, James LeMesurier, giving some rescue training to Syrians in Turkey with funding provided by the U.S. and U.K. The group stole this name from the REAL Syria Civil Defense as documented in this recent report from Aleppo. The “White Helmets” are marketed in the West as civilian volunteers doing rescue work. On Sept. 22, it was announced that the Right Livelihood Award , the so-called “Alternative Nobel Prize,” is being given to the U.S./U.K.-created White Helmets “for their outstanding bravery, compassion and humanitarian engagement in rescuing civilians from the destruction of the Syrian civil war.”  But the White Helmets are largely a propaganda tool promoting Western intervention against Syria. Unlike a legitimate rescue organization such as the Red Cross or Red Crescent, the “White Helmets” only work in areas controlled by the armed opposition. As shown in this video, the White Helmets pick up the bodies of individuals executed by the terrorists; they claim to be unarmed but are not; and they falsely claim to be neutral.
  • Many of the videos from Al Qaeda/terrorist-dominated areas of Syria have the “White Helmets” logo because the White Helmets work in alliance with these extremist groups as primarily a media marketing tool to raise public support for continuing the support to the armed opposition as well as the demonization of the Syrian government.  The Rights Livelihood press release said the White Helmets “remain outspoken in calling for an end to hostilities in the country.” But that is false, too. A Major Act of War Taking over the skies above another country is an act of war that would require a major U.S. military operation, according to senior American generals.

  • The New York Times reported that in 2012 General Martin E. Dempsey, chairman of the Joint Chiefs of Staff, told the White House that imposing a no-fly zone in Syria would require up to 70,000 American servicemen to destroy Syria’s antiaircraft system and then impose round-the-clock control over Syrian airspace. General Carter Ham, former commander of the U.S. Africa Command who oversaw the aerial attacks on Libya in 2011, said on CBS News that “I worry sometimes that, when people say ‘impose a no-fly zone,’ there is this almost antiseptic view that this is an easily accomplished military task. It’s extraordinarily difficult. … “It first entails — we should make no bones about it. It first entails killing a lot of people and destroying the Syrian air defenses and those people who are manning those systems. And then it entails destroying the Syrian air force, preferably on the ground, in the air if necessary. This is a violent combat action that results in lots of casualties and increased risk to our own personnel.”
  • In other words, an appeal for a “no-fly zone” is not a call for a non-violent solution. It is seeking a bloody act of war by the United States against Syria, a nation that poses no threat to America. It also would almost surely be carried out in violation of international law since a United Nations Security Council resolution would face vetoes from Russia and probably China. Also, the White Helmets have never criticized or called for the end of funding to extremist organizations including Nusra Front, Al Qaeda’s Syrian affiliate. On the contrary, White Helmets are generally embedded with this organization which is defined as “terrorist” by even the U.S., which is likely why the head of the White Helmets, Raed Saleh, was denied entry to the U.S. The foreign and marketing company origins of the White Helmets were exposed over 1½ years ago – and since then, writer Vanessa Beeley has revealed the organization in more depth in articles such as “Who Are the White Helmets?” and “War by Way of Deception.”  Despite these exposés, understanding of the White Helmets is limited, with many liberal and progressive people uncritically accepting the propaganda and misinformation about Syria. Much of the progressive media has effectively blocked or censored critical examinations amid a flood of propaganda about “barrel bombs” dropped by the “brutal dictator” and his “regime.” 
  • In the last week, Netflix started showing a 40-minute documentary movie about the “White Helmets” that amounts to a promotional video. A substantial portion of it takes place in Turkey where we see trainees in hotel rooms making impassioned phone calls to inquire about their families in Syria.  The “family values” theme is evident throughout, a good marketing angle. The political message of the video is also clear: after a bombing attack, “It’s the Russians …. they say they are fighting ISIS but they are targeting civilians.” The movie includes video previously promoted by the White Helmets such as the “Miracle Baby” rescue, an incident that may or may not have been staged. The video includes self-promoting proclamations such as “You are real heroes.” While no doubt there are some real rescues in the midst of war, many of the videos purporting to show the heroes at work have an unrealistic and contrived look to them as revealed here.
  • “Alternative media” in the West has echoed mainstream media regarding the Syria conflict. The result is that many progressive individuals and groups are confused or worse. For example, the activist group CodePink recently issued a media release promoting the Netflix White Helmets propaganda video.

The only question is who paid them to produce this video.  There is growing resistance to this manipulation and deception. In response to a petition to give the Nobel Peace Prize to the White Helmets, there is a counter petition at Change.org. Following the Right Livelihood Awards’ announcement, there will soon be a petition demanding retraction of the award to the White Helmets. The story of the White Helmets is principally a “feel good” hoax to manipulate public perception about the conflict in Syria and continue the drive for “regime change.” That’s why big money was paid to “Purpose” to “incubate” The Syria Campaign to brand and promote the White Helmets using Facebook, Twitter, etc. That’s why more big money was paid to create a self-promotional documentary. 
  • The judges at Rights Livelihood were probably influenced by the documentary since critical examination of facts around Syria is so rare. It’s a sad commentary on the media. As veteran war correspondent Stephen Kinzer recently wrote, “Coverage of the Syrian war will be remembered as one of the most shameful episodes in the history of the American press.”

The announcement of a reversal of long-standing regulatory policy for banking at an event organized by a lobby group is questionable as the wider developmental and regulatory concerns related to a liberalized entry of foreign banks are yet to be discussed in Parliament. In the Indian context, the key policy issue is — do the benefits of foreign bank entry greatly outweigh the potential costs? Foreign banks have been operating in India for the past many decades and yet we find no evidence of the widely held notion that foreign banks add to domestic competition, increase access to financial services and ensure greater financial stability in the host countries. As witnessed during the global financial crisis of 2008, foreign banks reduced their domestic lending in India by as much as 20 per cent whereas the state-owned banks played a counter-cyclical role during the crisis.

  • An attempted radio-electronic attack on Russian television satellites from the territory of Western Ukraine has been recorded by the Ministry of Communications. It comes days after Ukraine blocked Russian TV channels, a move criticized by the OSCE. Russian Ministry of Communications experts identified the exact location in Ukraine of the source of attempted jamming of Russian TV satellites’ broadcast, RIA Novosti news agency reports. The ministry noted that “people who make such decisions” to attack Russian satellites that retransmit TV signals, “should think about the consequences,” Ria reports. The ministry did not share any details of the attack.
  • On Thursday, a number of Russian state TV channels websites suffered a large cyber-attack partially coming from Ukraine. Russia’s Channel One website was temporarily unavailable due to a distributed denial-of-service (DDoS) attack. Meanwhile, Russia-24 TV also said it suffered from a “massive network attack.” According to Itar-Tass, the targeted Russian media have connected attacks to their editorial policy of covering the recent events in Ukraine.

Kosareva cited as an example an incident on March 5 with a pro-Russian journalist, Sergey Rulev who was beaten up and threatened by Ukrainian nationalists “just because he dared to interview riot police [Berkut].” A correspondent for Russiya-24 TV channel, Artyom Kol said he was repeatedly threatened by ultra-nationalist group Right Sector who placed him on a ‘wanted list’ on February 22.

  • The National Security Agency used the holiday lull to “minimise the impact” of a tranche of documents by releasing them on Christmas Eve, the American Civil Liberties Union (ACLU) said on Friday. The documents, which were released in response to a legal challenge by the ACLU under the Freedom of Information Act, are heavily – in some places totally –redacted versions of reports by the NSA to the President’s Intelligence Oversight Board dating back to 2007. A court ordered the documents released this past summer, and a 22 December deadline for that release was agreed upon, according to Patrick Toomey, a staff attorney at the ACLU’s national security project, because the NSA said it needed “six or seven months” to complete its review and redaction process. A spokesperson for the NSA said that the 22 December deadline, “which was agreed to by all parties,” was met.
  • But according to Toomey, the ACLU didn’t receive the documents until “late in the day on the 23rd” – the NSA sent them by FedEx late on the 22nd – and the NSA didn’t publicly release them until Christmas Eve. “I certainly think the NSA would prefer to have the documents released right ahead of the holidays in order to have less public attention on what they contain,” Toomey said. The redactions on the document are extreme, and their omissions tantalising. One entry, from the 4th quarter of 2008, reads: “On [redacted] [redacted] used the US SIGINT System (USSS) to locate [redacted] believed to be kidnapped [redacted] The selectors were tasked before authorization was obtained from NSA. After the NSA Office of General Counsel (OGC) denied the authorization request, [redacted] was found. He had not been kidnapped.” Another reads: “On [redacted] during an experimental collection and processing effort, NSA analysts collected [several lines of text redacted.] The messages were deleted [redacted] when the error was identified.”

But, according to Toomey, they speak to a total picture of a “large number of different compliance violations. We don’t know how many.” He said the documents deepen the picture of the nature and extent of compliance violations by analysts working for the NSA.

  • The state agency that regulates the legal profession in Virginia has canceled a planned seminar in Jerusalem following objections over Israel’s discrimination against Americans of Palestinian, Arab and Muslim ancestry. “Certain members of the Virginia State Bar and other individuals have expressed objections to the VSB’s plan to take the Midyear Legal Seminar trip in November to Jerusalem,” Kevin E. Martingayle, the agency’s president, wrote in an email to members today. “It was stated that there are some unacceptable discriminatory policies and practices pertaining to border security that affect travelers to the nation.” “Upon review of US State Department advisories and other research, and after consultation with our leaders, it has been determined that there is enough legitimate concern to warrant cancellation of the Israel trip and exploration of alternative locations,” Martingayle said.

It will also stiffen resistance to Congressional junkets to Israel, which are funded by Israel and Zionist organizations in the U.S. The last thing Israel's governing Zionists want is the U.S. legal profession all over them like white on rice.

Even so, Comey recently lobbied for tech companies to do away with end-to-end encryption. However, his crusade has fallen on unsympathetic ears, both from the private companies he seeks to control — and from the NSA. Prior to Rogers’ statements in support of encryption Thursday, former NSA chief Michael Hayden said, “I disagree with Jim Comey. I actually think end-to-end encryption is good for America.” Still another former NSA chair has criticized calls for backdoor access to information. In October, Mike McConnell told a panel at an encryption summit that the United States is “better served by stronger encryption, rather than baking in weaker encryption.” Former Department of Homeland Security chief, Michael Chertoff, has also spoken out against government being able to bypass encryption.
  • Rogers cited the recent Office of Personnel Management hack of over 20 million users as a reason to increase encryption rather than scale it back. “What you saw at OPM, you’re going to see a whole lot more of,” he said, referring to the massive hack that compromised the personal data about 20 million people who obtained background checks. Rogers’ comments, while forward-thinking, signify an about face in his stance on encryption. In February 2015, he said he “shares [FBI] Director [James] Comey’s concern” about cell phone companies’ decision to add encryption features to their products. Comey has been one loudest critics of encryption. However, Rogers’ comments on Thursday now directly conflict with Comey’s stated position. The FBI director has publicly chastised encryption, as well as the companies that provide it. In 2014, he claimed Apple’s then-new encryption feature could lead the world to “a very dark place.” At a Department of Justice hearing in November, Comey testified that “Increasingly, the shadow that is ‘going dark’ is falling across more and more of our work.” Though he claimed, “We support encryption,” he insisted “we have a problem that encryption is crashing into public safety and we have to figure out, as people who care about both, to resolve it. So, I think the conversation’s in a healthier place.”

But The Associated Press has learned that 7 email chains are being withheld in full for containing “top secret” material. The 37 pages include messages recently described by a key intelligence official as concerning so-called “special access programs” — a highly restricted subset of classified material that could point to confidential sources or clandestine programs like drone strikes or government eavesdropping. Department officials wouldn’t describe the substance of the emails, or say if Clinton had sent any herself. Spokesman John Kirby tells the AP that no judgment on past classification was made. But the department is looking into that, too.
  • For those that Clinton only read, and didn’t write or forward, she still would have been required to report classification slippages that she recognized. Possible responses for classification infractions include counseling, warnings or other action, State Department officials said, though they declined to say if these applied to Clinton or senior aides who’ve since left the department. The revelation comes after more emails from Hilary Clinton’s personal email have come to light. “[The investigation has reached] a critical mass,” DiGenova told radio host Laura Ingraham when discussing the FBI’s still pending investigation. Though Clinton is still yet to be charged with any crime, DiGenova advised on Tuesday that changes may be on the horizon. The mishandling over the classified intelligence may lead to an imminent indictment, with DiGenova suggesting it may come to a head within 60 days.
