  • MR KIRBY: Well, again, I think – and I think Mark walked you through this – there were three principal topics that they discussed. One was Syria; one was Ukraine; and the other, of course, was DPRK and our work inside the UN to pursue additional sanctions on the regime. The discussion on Syria focused on two things principally. One was the situation in Aleppo and the Secretary’s obvious and deep concern about the continued siege there and also about the potential to continue multilateral efforts to discuss the way ahead. And that’s – and that’s basically it. We certainly, when we said we were suspending U.S.-Russia bilateral engagement on the cessation of hostilities and the work to that end in Syria, there was never any expectation that the two foreign ministers wouldn’t speak about Syria again. And certainly, if we’re going to continue multilateral efforts, which we fully intend to do, whether it’s with the ISSG or other partners or through the UN, there’s no way you can do that without including Russia in that discussion. QUESTION: So and just – so are you trying to set up a meeting, for example? I mean, you’re talking about bilateral discussions. Are you trying to set up a meeting with other countries including Russia on this? MR KIRBY: I don’t have anything on the schedule to speak to today, but I certainly wouldn’t rule out the fact that there will be attempts and efforts through multi – through a multilateral fora to meet again and to try to work through this. I certainly wouldn’t rule that out. QUESTION: And just one other one. Given the failure of the previous efforts and given the main thing that you guys argued was that the carrot or the leverage you had was Russia’s eagerness for intelligence-sharing cooperation, et cetera, the JIC, what makes you think they’re going to be any more likely to work to halt or reduce the violence in a multilateral context absent those incentives than they were when they had the incentives on the table? MR KIRBY: We don’t know. We don’t know. That’s a call for them to make if they’re interested or willing in participating in a multilateral discussion or not. But speaking for Secretary Kerry, I can tell you that he fully intends to use multilateral efforts available to him, whether it’s the ISSG or the UN or something separate and distinct. Tom Shannon was in Berlin at the invitation of the German Government just yesterday to – a smaller but still multilateral discussion about Syria. The Secretary has every intent to continue to use those vehicles as best he can. But we don’t know whether Russia will come to those sessions. We don’t know whether they will do so --
  • QUESTION: Yeah, okay. And is there anything that you are doing to try to stop Aleppo from falling to the government, the Russian-backed government offensive, or have you kind of written it off? MR KIRBY: Nobody is writing off Aleppo. I think everybody’s deeply troubled and concerned about what appears to be a very continued, concerted, and if – and increased effort by the regime to conduct a siege and to take Aleppo. But -- QUESTION: Yeah. Are you doing anything to stop it? MR KIRBY: Well, we obviously are continuing – another reason why, as I said, they – Foreign Minister Lavrov and the Secretary spoke yesterday was the Secretary was expressing our concerns about what’s going on in Aleppo. We’re not turning a blind eye to that. And we still want – the short answer to your question is we’re still interested in pursuing a cessation of hostilities that can endure nationwide, and certainly in Aleppo. It’s just that now we’re going to have to pursue that goal through a multilateral effort and not any longer solely through a bilateral effort with Russia.

  • QUESTION: Let me just follow up on the statement made by Brigadier General Konashenkov, the spokesman for the ministry of defense. He said that they have the 300 and the 400 and it’ll come out surprisingly and so on. Does that give you pause in contemplating a military option? MR KIRBY: Again, Said, I don't want to – I think it’s safe to assume that we’re looking at a full range of options here. And those comments notwithstanding, we still have a responsibility as a government to consider all those options. What we’ve also said is that none of the other options that we’ve talked about to date are any better or can lead – we don’t believe will lead to a better outcome than what we’re trying to pursue through diplomacy. And we’re still trying. Even though we’re suspending bilateral cooperation with Russia, we’re still trying to pursue diplomatic solutions here. And so I just don’t want to – I don’t think it’s useful or helpful for me to speculate one way or the other about these comments and the threats that they might embody. We have a responsibility to the Syrian people, to our allies and partners, and we take that responsibility seriously. And we’re approaching this conversation inside the government with that in mind.
  • QUESTION: In the event that a strike is decided upon and you take out certain, let’s say, runways or military facilities and so on, it would be just a punishment or would it be a la Desert Fox back in 1998 in Iraq? Or would it be something that is sustained to basically – like Libya, to overthrow the regime? MR KIRBY: Said, you’re well ahead of any decisions, at least that have been made to date here, on the U.S. side. I can’t even begin to entertain that question. We still believe a diplomatic approach is the best one. Yes, inside the government, we continue to have conversations about options. Not all of those options, as I’ve said, revolve around diplomacy. It would be irresponsible for us not to think about other tools available to us to change the situation on the ground in Syria. But we’ve also said that military options, whether they’re a no-fly zones, a safe zone, whatever you want to call them, they bear risk. They expend resources. And they’re certainly, just by dint of the fact that they’re military, are going to not de-escalate the tension, not going to bring down the violence necessarily. That doesn’t mean they’re off the table. It just means that, in consideration of them, we have to factor all of that in. But your question gets well, well ahead of where we are right now, and I couldn’t possibly answer it.
  • QUESTION: If we can go back to Syria – and sorry, this is from a little bit earlier in the week, and so I apologize if it’s already been addressed. But I was wondering if you had a response to the Russian Government blaming – putting blame on the U.S. for the shelling of the Russian embassy in Damascus. MR KIRBY: I don’t know if it’s been addressed or not. There’s no truth to it. Okay?

  • Egypt’s President Abdel Fatah al-Sisi returned from his official visit to China and meetings with Chinese President Xi Jinping. On Tuesday, the two heads of State signed a joint statement on bilateral relations and comprehensive strategic partnership. The agreement sets new trends in international diplomacy and relations. Egypt’s presidential spokesman, Ambassador Alaa Youssef commented on the Chinese – Egyptian agreement, saying that signing the statement elevated bilateral relations to a progressive level. The agreement encompasses politics, economy, trade and investment, military and security, culture and humanitarian issues, space sciences and technologies, as well as a number of regional and international issues.

Int'l Criminal Court's Examination of U.S. Treatment of Detainees Takes Shape | Just Se... - 0 views

  • On Tuesday, the Chief Prosecutor of the International Criminal Court announced, in the most explicit and detailed terms to date, that the U.S. treatment of detainees captured in the Afghanistan conflict is under examination by her office. The statement is included in the Office of the Prosecutor’s (OTP) annual “Report on Preliminary Examination Activities,” released on the eve of the Assembly of States Parties this month.
  • In particular, the OTP is assessing the degree to which national proceedings are underway with respect to the allegations underlying the examination.  Furthermore, an affirmative determination that there is a reasonable basis to proceed with an investigation is far from a finding of strong evidence of criminal wrongdoing. Nevertheless, the appearance of the latter is surely one issue on the minds of administration officials. David Bosco, for instance, reported that “the U.S. delegation urged the court not to publish the allegations, even in preliminary form. They warned that the world would see any ICC mention of possible American war crimes as evidence of guilt, even if the court never brought a formal case.”

These reports describe interrogation techniques approved for use as including food deprivation, deprivation of clothing, environmental manipulation, sleep adjustment, use of individual fears, use of stress positions, sensory deprivation (deprivation of light and sound), and sensory overstimulation.

  • The Prosecutor proceeds in 4 phases within any preliminary examination: (1) an initial assessment to analyze the seriousness of information received; (2) a jurisdictional analysis – the formal commencement of an examination involving “a thorough factual and legal assessment” of whether there is “a reasonable basis to believe that the alleged crimes fall within the subject-matter jurisdiction of the Court;” (3) an admissibility determination – assessing whether the gravity of the crimes or prospect of national investigations and prosecutions preclude the need for the ICC to proceed ; (4) prudential considerations — determining whether an investigation would serve the “interests of justice.” It appears that the examination of U.S. detention operations has reached the third phase and crossed over the important threshold of a finding that there is a reasonable basis to believe U.S. forces committed war crimes within the jurisdiction of the Court. Heller posited that some aspects of the Prosecutor’s Afghanistan examination had already reached this stage in 2013. The 2014 report provides further corroboration specifically with respect to U.S. detention practices. For example, paragraph 96 of the 2014 report states that the Office of the Prosecutor is now “analysing the relevance and genuineness of national proceedings by the competent national authorities for the alleged conduct described above as well as the gravity of the alleged crimes”—clearly a phase three inquiry. That said, paragraph 96 also states that the Office is “continuing to assess the seriousness and reliability of such allegations”—which sounds like phase two and even phase one.

Certain of the enhanced interrogation techniques apparently approved by US senior commanders in Afghanistan in the period from February 2003 through June 2004, could, depending on the severity and duration of their use, amount to cruel treatment, torture or outrages upon personal dignity as defined under international jurisprudence. In addition, there is information available that interrogators allegedly committed abuses that were outside the scope of any approved techniques, such as severe beating, especially beating on the soles of the feet, suspension by the wrists, and threats to shoot or kill. 96. While continuing to assess the seriousness and reliability of such allegations, the Office is analysing the relevance and genuineness of national proceedings by the competent national authorities for the alleged conduct described above as well as the gravity of the alleged crimes.
  • The OTP is considering whether the war crimes of cruel treatment, torture or outrages upon personal dignity were committed by U.S. forces. Article 8 of the ICC statute places something of a qualification on the jurisdiction of the Court over war crimes. It states that the Court shall have jurisdiction over war crimes “in particular when committed as part of a plan or policy or as part of a large-scale commission of such crimes.” In 2013, the Prosecutor’s annual report stated that the Office “continues to seek information to determine whether there is any reasonable basis to believe any such alleged acts, which could amount to torture or humiliating and degrading treatment, may have been committed as part of a policy.” That reference to the “as a part of policy” qualification does not appear in the 2014 report. And, on the contrary, the 2014 report highlights elements that indicate the existence of a policy such as the Presidential Directive of 7 February 2002 on the determination of POW status and the senior US commanders’ approval of interrogation techniques.
  • Will bilateral agreements between the US and Afghanistan preclude the ICC from investigating or prosecuting “U.S. persons”? One final question that might arise from these proceedings is the legal viability of the bilateral agreement between the United States and Afghanistan regarding the surrender of persons to the International Criminal Court (full text).  Since the case arises out of Afghanistan’s status under the ICC treaty, the United States might try to claim that the bilateral agreement provides US nationals and employees immunity for actions that took place in Afghanistan. I have briefly discussed the legal viability of such article 98 agreements in an  earlier post at Just Security.

Russia Holds "De-Dollarization Meeting": China, Iran Willing To Drop USD From Bilateral... - 0 views

  • That Russia has been pushing for trade arrangements that minimize the participation (and influence) of the US dollar ever since the onset of the Ukraine crisis (and before) is no secret: this has been covered extensively on these pages before (see Gazprom Prepares "Symbolic" Bond Issue In Chinese Yuan; Petrodollar Alert: Putin Prepares To Announce "Holy Grail" Gas Deal With China; Russia And China About To Sign "Holy Grail" Gas Deal; 40 Central Banks Are Betting This Will Be The Next Reserve Currency; From the Petrodollar to the Gas-o-yuan and so on). But until now much of this was in the realm of hearsay and general wishful thinking. After all, surely it is "ridiculous" that a country can seriously contemplate to exist outside the ideological and religious confines of the Petrodollar... because if one can do it, all can do it, and next thing you know the US has hyperinflation, social collapse, civil war and all those other features prominently featured in other socialist banana republics like Venezuela which alas do not have a global reserve currency to kick around. Or so the Keynesian economists, aka tenured priests of said Petrodollar religion, would demand that the world believe. However, as much as it may trouble the statists to read, Russia is actively pushing on with plans to put the US dollar in the rearview mirror and replace it with a dollar-free system. Or, as it is called in Russia, a "de-dollarized" world.
  • Voice of Russia reports citing Russian press sources that the country's Ministry of Finance is ready to greenlight a plan to radically increase the role of the Russian ruble in export operations while reducing the share of dollar-denominated transactions. Governmental sources believe that the Russian banking sector is "ready to handle the increased number of ruble-denominated transactions". According to the Prime news agency, on April 24th the government organized a special meeting dedicated to finding a solution for getting rid of the US dollar in Russian export operations. Top level experts from the energy sector, banks and governmental agencies were summoned and a number of measures were proposed as a response for American sanctions against Russia. Well, if the west wanted Russia's response to ever escalating sanctions against the country, it is about to get it. The "de-dollarization meeting” was chaired by First Deputy Prime Minister of the Russian Federation Igor Shuvalov, proving that Moscow is very serious in its intention to stop using the dollar. A subsequent meeting was chaired by Deputy Finance Minister Alexey Moiseev who later told the Rossia 24 channel that "the amount of ruble-denominated contracts will be increased”, adding that none of the polled experts and bank representatives found any problems with the government's plan to increase the share of ruble payments.
  • Further, if you thought that only Obama can reign supreme by executive order alone, you were wrong - the Russians can do it just as effectively. Enter the "currency switch executive order": It is interesting that in his interview, Moiseev mentioned a legal mechanism that can be described as "currency switch executive order”, telling that the government has the legal power to force Russian companies to trade a percentage of certain goods in rubles. Referring to the case when this level may be set to 100%, the Russian official said that "it's an extreme option and it is hard for me to tell right now how the government will use these powers". Well, as long as the options exists. But more importantly, none of what Russia is contemplating would have any practical chance of implementation if it weren't for other nations who would engage in USD-free bilateral trade relations. Such countries, however, do exist and it should come as a surprise to nobody that the two which have already stepped up are none other than China and Iran.

  • Of course, the success of Moscow's campaign to switch its trading to rubles or other regional currencies will depend on the willingness of its trading partners to get rid of the dollar. Sources cited by Politonline.ru mentioned two countries who would be willing to support Russia: Iran and China. Given that Vladimir Putin will visit Beijing on May 20, it can be speculated that the gas and oil contracts that are going to be signed between Russia and China will be denominated in rubles and yuan, not dollars. In other words, in one week's time look for not only the announcement of the Russia-China "holy grail" gas agreement described previously here, but its financial terms, which now appears virtually certain will be settled exclusively in RUB and CNY. Not USD. And as we have explained repeatedly in the past, the further the west antagonizes Russia, and the more economic sanctions it lobs at it, the more Russia will be forced away from a USD-denominated trading system and into one which faces China and India. Which is why next week's announcement, as groundbreaking as it most certainly will be, is just the beginning.

ITAR-TASS: World - WTO approves Bali package of agreements - 0 views

  • World Trade Organization member countries have approved the Bali package of agreements. The decision was traditionally taken by a consensus. The countries officially adopted the agreement on trade procedures, five agrarian documents, including a food security agreement and a declaration on export competition, and four documents to support least developed countries. The Bali package forms a basis to conclude the Doha round of WTO talks, deadlocked since 2008, to liberalize world trade. The talks are aimed at lowering tariffs on trade in agricultural products and industrial goods.

    I haven't been keeping up lately on the Doha Round of trade agreement negotiations. But generally speaking, the WTO series of trade agreements have been of, by, and for moneyed interests. Which is why their get-togethers get picketed a lot. Money talks at the WTO; not mere mortals.  When this round concludes, there will be in the U.S. a very large package of treaties delivered to the Senate for ratification, followed by ratification conditioned on the President certifying that certain Congressional limitations have been achieved, whereupon enabling legislation will automatically kick in. Russia and Egypt to establish 'free trade zone' and build nuclear reactor | Middle East... - 0 views

  • Egyptian President Abdel Fattah al-Sisi has hailed the economic and security relationship between Egypt and Russia, and announced the establishment of a “free trade zone” between Egypt and the Russian-led Eurasian Economic Union (EEU).
  • Sisi also announced a strengthening of trade relations between the two countries, culminating in a preliminary agreement to create a Russian industrial zone in Egypt, near the Suez Canal. The pair also said that they would set up a nuclear power plant designed to “help Egypt reach its energy needs”. Egypt had taken steps in the early 1980s to launch a nuclear plant to produce electricity in Dabaa but it was shut down after the Chernobyl disaster in 1986. The EEU currently consists of Russia, Armenia, Belarus, Kyrgyzstan and Kazakhstan and has generally been seen as an attempt by Russia to provide a counterweight to the European Union (EU).
  • The decision by Egypt to increase its bilateral trade with Russia is likely to further increase tensions with the EU and the US, who have placed sanctions on Russia over its alleged interference in the Ukraine conflict. It is possible the meet might also upset wealthy Gulf donors who have clashed with Moscow over its support of Syrian President Bashar al-Assad.

  • While no statements were made about the possibility of arms sales, following a meet in Russia last summer, Putin announced that the two countries were close to penning a $3bn deal for Moscow to supply missiles and warplanes, including MiG-29 fighters and attack helicopters. However, Washington has since resumed its annual $1.5 bn in aid to Egypt, also delivering Apache helicopter gunships to fight militants in the Sinai.
  • In a further controversial move, the two countries have also suggested they may stop using the dollar in bilateral trade and instead use national currencies. “This measure will open up new prospects for trade and investment cooperation between our countries, reduce its dependence on the current trends in the world markets,” Putin told Egyptian state newspaper al-Ahram. “I should note that we already use national currencies for trade with a number of the Commonwealth of Independent States (CIS) states, and China. This practice proves its worth; we are ready to adopt it in our relations with Egypt as well. This issue is being discussed in substance by relevant agencies of both countries.” Egypt offered to increase agricultural exports to Russia by 30 percent as Russia underwent Western economic sanctions last year for its part in occupying parts of Ukraine. 
  • Daniel Levy, director of the Middle East and North Africa programme and the European Council on Foreign Relations (ECFR), said the strengthening Egypt-Russian ties should come as no surprise. "Incorporating a Russia angle into one’s geostrategic toolbox appealed to many Middle Eastern states even before the current crisis, as Russia had been actively re-asserting itself in the region in recent years," he wrote on the ECFR website. "Which is not to say that the West’s Middle East allies really see in Russia a replacement option – rather that they see greater value in both doing some geo-strategic balancing and in being able to use a flirtation with Russia as part of their respective strategies for managing the West, deflecting any Western criticism and guaranteeing future Western assistance and arms sales." He also pointed out that Russia was now the number one source of tourists to Egypt, which has seen a drop-off in tourism as the security situation has deteriorated in the country.

Chinese delegation offers $250M investment in Egypt | Cairo Post - 0 views

  • CAIRO:  A Chinese delegation from Star Oil & Gas (SOG) holdings along with partners from the International Drilling Material Manufacturing (IDM) company met Sunday with Minister of Petroleum and Mineral Resources Sherif Ismail, offering new projects of $250M to be completely funded by the Chinese government and Chinese banks. A statement released from the ministry added that the delegation discussed a feasibility study of a new steel rolling factory to produce seamless pipes to supply the entire African market, that will be considered as a “development step” in the whole IDM system. SOG’s representative in Egypt Mohamed Al-Gohary stated that this project is going to be “a first” in the Middle East on the field of drilling and oil exploration. The U.S. delivered 10 Apache Helicopters to Egypt in November, but other than that, strategic cooperation has pretty much stopped in the past two years, said Mostafa Elwi, a Cairo University professor of political science. China and Russia supported the change after June 30, 2013, when millions marched to topple Morsi, and exchanged visits between Egyptian officials and their counterparts from these two countries have been “very fruitful,” unlike U.S. Secretary of State John Kerry’s visits to Egypt, Elwi added. Amr explained that Egypt’s foreign policy has been successful in moving forward in coalitions, rather than its own, in the face of major powers, such as the Non-Aligned Movement, the Arab League and as part of coordination with regional forces.

The cables in question were published in August in “The WikiLeaks Files: The World According to US Empire,” a book in which multiple journalists along with Julian Assange analyze the contents of the treasure trove of cables Manning provided to WikiLeaks in 2010. The book devotes a section to what “The WikiLeaks Files” contributors Alexander Main and Dan Beeton call “the day-to-day mechanics of Washington’s political intervention in Latin America.” According to the cables, the plot to orchestrate a coup or carry out an assassination against Morales came after years of resistance by the Morales government to the United States’ Latin American agenda. TeleSUR, a Latin American TV network, reported last week that the Bolivian government is continuing a formal investigation into the allegations, despite denials by U.S. government officials:
  • “In a strongly worded statement the U.S. Embassy in Bolivia said, ‘The government of the United States was not involved in any conspiracy, attempt to overthrow the government of Bolivia or assassinate President Morales. This kind of unfounded allegations does not contribute to improving bilateral relations.’” These allegations of a U.S. plot mirror recent revelations that the DEA is targeting the Morales government with secret drug indictments after his administration kicked the U.S. agency out of Bolivia to pursue their own, locally-oriented and highly successful cocaine-reduction strategies. Contrary to the official denials, the WikiLeaks cables show how the U.S. escalated attempts to put pressure on Morales and his government over several years. According to Main and Beeton’s analysis of the cables, pressure on Morales began soon after his 2005 election as part of a wave of left-leaning candidates winning elections in Latin America. But Morales resisted U.S. directives and continued with his plans to nationalize the fossil fuels industry and move away from dependence on foreign aid and international loans. The cables suggest that starting from 2007 the U.S. government began providing aid to the “Media Luna” region of Bolivia, which is controlled by Morales’ opposition:
  • “A USAID report from 2007 stated that its Office of Transition Initiatives (OTI) ‘ha[d] approved 101 grants for $4,066,131 to help departmental governments operate more strategically.’ Funds also went to local indigenous groups that were ‘opposed to Evo Morales’ vision for indigenous communities.’” A year later, the residents of Media Luna were rebelling against the Morales government in clashes that led to 20 deaths. A coup seemed imminent, and the opposition had the support of U.S. officials: “[T]he United States was in regular communication with the leaders of the separatist opposition movement, even as they spoke openly of ‘blow[ing] up gas lines’ and ‘violence as a probability to force the government to . . . take seriously any dialogue.’” While officially supporting the Morales administration in public statements, the cables show the U.S. government preparing “a plan for immediate response in the event of a sudden emergency, i.e. a coup attempt or President Morales’ death.” Tensions only eased as other South American governments declared their support for Bolivia’s democratically-elected government.

  • For more than six months, Edward Snowden’s revelations about the National Security Agency (NSA) have been pouring out from the Washington Post, the New York Times, the Guardian, Germany’s Der Spiegel, and Brazil’s O Globo, among other places.  Yet no one has pointed out the combination of factors that made the NSA’s expanding programs to monitor the world seem like such a slam-dunk development in Washington.  The answer is remarkably simple.  For an imperial power losing its economic grip on the planet and heading into more austere times, the NSA’s latest technological breakthroughs look like a bargain basement deal when it comes to projecting power and keeping subordinate allies in line -- like, in fact, the steal of the century.  Even when disaster turned out to be attached to them, the NSA’s surveillance programs have come with such a discounted price tag that no Washington elite was going to reject them.
  • What exactly was the aim of such an unprecedented program of massive domestic and planetary spying, which clearly carried the risk of controversy at home and abroad? Here, an awareness of the more than century-long history of U.S. surveillance can guide us through the billions of bytes swept up by the NSA to the strategic significance of such a program for the planet’s last superpower. What the past reveals is a long-term relationship between American state surveillance and political scandal that helps illuminate the unacknowledged reason why the NSA monitors America’s closest allies. Not only does such surveillance help gain intelligence advantageous to U.S. diplomacy, trade relations, and war-making, but it also scoops up intimate information that can provide leverage -- akin to blackmail -- in sensitive global dealings and negotiations of every sort. The NSA’s global panopticon thus fulfills an ancient dream of empire. With a few computer key strokes, the agency has solved the problem that has bedeviled world powers since at least the time of Caesar Augustus: how to control unruly local leaders, who are the foundation for imperial rule, by ferreting out crucial, often scurrilous, information to make them more malleable.
  • Once upon a time, such surveillance was both expensive and labor intensive. Today, however, unlike the U.S. Army’s shoe-leather surveillance during World War I or the FBI’s break-ins and phone bugs in the Cold War years, the NSA can monitor the entire world and its leaders with only 100-plus probes into the Internet’s fiber optic cables. And better yet, it fulfills the greatest imperial dream of all: to be omniscient not just for a few islands, as in the Philippines a century ago, or a couple of countries, as in the Cold War era, but on a truly global scale. In a time of increasing imperial austerity and exceptional technological capability, everything about the NSA’s surveillance told Washington to just “go for it.”  This cut-rate mechanism for both projecting force and preserving U.S. global power surely looked like a no-brainer, a must-have bargain for any American president in the twenty-first century -- before new NSA documents started hitting front pages weekly, thanks to Snowden, and the whole world began returning the favor.

  • As the gap has grown between Washington’s global reach and its shrinking mailed fist, as it struggles to maintain 40% of world armaments (the 2012 figure) with only 23% of global gross economic output, the U.S. will need to find new ways to exercise its power far more economically. As the Cold War took off, a heavy-metal U.S. military -- with 500 bases worldwide circa 1950 -- was sustainable because the country controlled some 50% of the global gross product. But as its share of world output falls -- to an estimated 17% by 2016 -- and its social welfare costs climb relentlessly from 4% of gross domestic product in 2010 to a projected 18% by 2050, cost-cutting becomes imperative if Washington is to survive as anything like the planet’s “sole superpower.” Compared to the $3 trillion cost of the U.S. invasion and occupation of Iraq, the NSA’s 2012 budget of just $11 billion for worldwide surveillance and cyberwarfare looks like cost saving the Pentagon can ill-afford to forego. Yet this seeming “bargain” comes at what turns out to be an almost incalculable cost. The sheer scale of such surveillance leaves it open to countless points of penetration, whether by a handful of anti-war activists breaking into an FBI field office in Media, Pennsylvania, back in 1971 or Edward Snowden downloading NSA documents at a Hawaiian outpost in 2012.

By the end of Bush’s term in 2008, Congress had enacted laws that not only retrospectively legalized these illegal programs, but also prepared the way for NSA surveillance to grow unchecked. Rather than restrain the agency, President Obama oversaw the expansion of its operations in ways remarkable for both the sheer scale of the billions of messages collected globally and for the selective monitoring of world leaders.

By contrast, the marriage of the NSA’s technology to the Internet’s data hubs now allows the agency’s 37,000 employees a similarly close coverage of the entire globe with just one operative for every 200,000 people on the planet
  • Through the expenditure of $250 million annually under its Sigint Enabling Project, the NSA has stealthily penetrated all encryption designed to protect privacy. “In the future, superpowers will be made or broken based on the strength of their cryptanalytic programs,” reads a 2007 NSA document. “It is the price of admission for the U.S. to maintain unrestricted access to and use of cyberspace.” By collecting knowledge -- routine, intimate, or scandalous -- about foreign leaders, imperial proconsuls from ancient Rome to modern America have gained both the intelligence and aura of authority necessary for dominion over alien societies. The importance, and challenge, of controlling these local elites cannot be overstated. During its pacification of the Philippines after 1898, for instance, the U.S. colonial regime subdued contentious Filipino leaders via pervasive policing that swept up both political intelligence and personal scandal. And that, of course, was just what J. Edgar Hoover was doing in Washington during the 1950s and 1960s.
  • Indeed, the mighty British Empire, like all empires, was a global tapestry woven out of political ties to local leaders or “subordinate elites” -- from Malay sultans and Indian maharajas to Gulf sheiks and West African tribal chiefs. As historian Ronald Robinson once observed, the British Empire spread around the globe for two centuries through the collaboration of these local leaders and then unraveled, in just two decades, when that collaboration turned to “non-cooperation.” After rapid decolonization during the 1960s transformed half-a-dozen European empires into 100 new nations, their national leaders soon found themselves the subordinate elites of a spreading American global imperium. Washington suddenly needed the sort of private information that could keep such figures in line. Surveillance of foreign leaders provides world powers -- Britain then, America now -- with critical information for the exercise of global hegemony. Such spying gave special penetrating power to the imperial gaze, to that sense of superiority necessary for dominion over others.  It also provided operational information on dissidents who might need to be countered with covert action or military force; political and economic intelligence so useful for getting the jump on allies in negotiations of all sorts; and, perhaps most important of all, scurrilous information about the derelictions of leaders useful in coercing their compliance.
  • In late 2013, the New York Times reported that, when it came to spying on global elites, there were “more than 1,000 targets of American and British surveillance in recent years,” reaching down to mid-level political actors in the international arena. Revelations from Edward Snowden’s cache of leaked documents indicate that the NSA has monitored leaders in some 35 nations worldwide -- including Brazilian president Dilma Rousseff, Mexican presidents Felipe Calderón and Enrique Peña Nieto, German Chancellor Angela Merkel, and Indonesia’s president Susilo Bambang Yudhoyono.  Count in as well, among so many other operations, the monitoring of “French diplomatic interests” during the June 2010 U.N. vote on Iran sanctions and “widespread surveillance” of world leaders during the Group 20 summit meeting at Ottawa in June 2010. Apparently, only members of the historic “Five Eyes” signals-intelligence alliance (Australia, Canada, New Zealand, and Great Britain) remain exempt -- at least theoretically -- from NSA surveillance. Such secret intelligence about allies can obviously give Washington a significant diplomatic advantage. During U.N. wrangling over the U.S. invasion of Iraq in 2002-2003, for example, the NSA intercepted Secretary-General Kofi Anan’s conversations and monitored the “Middle Six” -- Third World nations on the Security Council -- offering what were, in essence, well-timed bribes to win votes. The NSA’s deputy chief for regional targets sent a memo to the agency’s Five Eyes allies asking “for insights as to how membership is reacting to on-going debate regarding Iraq, plans to vote on any related resolutions [..., and] the whole gamut of information that could give U.S. policymakers an edge in obtaining results favorable to U.S. goals.”
  • Indicating Washington’s need for incriminating information in bilateral negotiations, the State Department pressed its Bahrain embassy in 2009 for details, damaging in an Islamic society, on the crown princes, asking: “Is there any derogatory information on either prince? Does either prince drink alcohol? Does either one use drugs?” Indeed, in October 2012, an NSA official identified as “DIRNSA,” or Director General Keith Alexander, proposed the following for countering Muslim radicals: “[Their] vulnerabilities, if exposed, would likely call into question a radicalizer’s devotion to the jihadist cause, leading to the degradation or loss of his authority.” The agency suggested that such vulnerabilities could include “viewing sexually explicit material online” or “using a portion of the donations they are receiving… to defray personal expenses.” The NSA document identified one potential target as a “respected academic” whose “vulnerabilities” are “online promiscuity.”
  • Just as the Internet has centralized communications, so it has moved most commercial sex into cyberspace. With an estimated 25 million salacious sites worldwide and a combined 10.6 billion page views per month in 2013 at the five top sex sites, online pornography has become a global business; by 2006, in fact, it generated $97 billion in revenue. With countless Internet viewers visiting porn sites and almost nobody admitting it, the NSA has easy access to the embarrassing habits of targets worldwide, whether Muslim militants or European leaders. According to James Bamford, author of two authoritative books on the agency, “The NSA's operation is eerily similar to the FBI's operations under J. Edgar Hoover in the 1960s where the bureau used wiretapping to discover vulnerabilities, such as sexual activity, to ‘neutralize’ their targets.”
  • Indeed, whistleblower Edward Snowden has accused the NSA of actually conducting such surveillance.  In a December 2013 letter to the Brazilian people, he wrote, “They even keep track of who is having an affair or looking at pornography, in case they need to damage their target's reputation.” If Snowden is right, then one key goal of NSA surveillance of world leaders is not U.S. national security but political blackmail -- as it has been since 1898. Such digital surveillance has tremendous potential for scandal, as anyone who remembers New York Governor Eliot Spitzer’s forced resignation in 2008 after routine phone taps revealed his use of escort services; or, to take another obvious example, the ouster of France’s budget minister Jérôme Cahuzac in 2013 following wire taps that exposed his secret Swiss bank account. As always, the source of political scandal remains sex or money, both of which the NSA can track with remarkable ease.
  • By starting a swelling river of NSA documents flowing into public view, Edward Snowden has given us a glimpse of the changing architecture of U.S. global power. At the broadest level, Obama’s digital “pivot” complements his overall defense strategy, announced in 2012, of reducing conventional forces while expanding into the new, cost-effective domains of space and cyberspace. While cutting back modestly on costly armaments and the size of the military, President Obama has invested billions in the building of a new architecture for global information control. If we add the $791 billion expended to build the Department of Homeland Security bureaucracy to the $500 billion spent on an increasingly para-militarized version of global intelligence in the dozen years since 9/11, then Washington has made a $1.2 trillion investment in a new apparatus of world power.
  • So formidable is this security bureaucracy that Obama’s recent executive review recommended the regularization, not reform, of current NSA practices, allowing the agency to continue collecting American phone calls and monitoring foreign leaders into the foreseeable future. Cyberspace offers Washington an austerity-linked arena for the exercise of global power, albeit at the cost of trust by its closest allies -- a contradiction that will bedevil America’s global leadership for years to come. To update Henry Stimson: in the age of the Internet, gentlemen don't just read each other’s mail, they watch each other’s porn. Even if we think we have nothing to hide, all of us, whether world leaders or ordinary citizens, have good reason to be concerned.

  • But when it comes to how a 29-year old IT wizard with little formal education has been able to access a batch of ultra-sensitive secrets of the US intelligence-national security complex, that's a no-brainer; it's all about the gung-ho privatization of spying - referred to by a mountain of euphemisms of the "contractor reliance" kind. In fact the bulk of the hardware and software used by the dizzying network of 16 US intelligence agencies is privatized. A Washington Post investigation found out that US homeland security, counter-terror and spy agencies do business with over 1,900 companies. [2] An obvious consequence of this contractor tsunami - hordes of "knowledge" high-tech proletarians in taupe cubicles - is their indiscriminate access to ultra-sensitive security. A systems administrator like Snowden can have access to practically everything.

It's important to remember that the Hong Kong judicial system is independent from China's - according to the Deng Xiaoping-conceptualized "one country, two systems". As much as Washington may go for extraditing Snowden, he may also apply for political asylum. In both cases he may stay in Hong Kong for months, in fact years. The Hong Kong government cannot extradite anyone claiming he will be persecuted in his country of origin. And crucially, article 6 of the treaty stipulates, "a fugitive offender shall not be surrendered if the offence of which that person is accused or was convicted is an offence of a political character." Another clause stipulates that a fugitive shall not be surrendered if that implicates "the defense, foreign affairs or essential public interest or policy" of - guess who - the People's Republic of China.
  • So then we may have a case of Hong Kong and Beijing having to reach an agreement. Yet even if they decided to extradite Snowden, he could argue in court this was "an offence of a political character". The bottom line - this could drag on for years. And it's too early to tell how Beijing would play it for maximum leverage. A "win-win" situation from a Chinese point of view would be to balance its commitment to absolute non-interference in foreign domestic affairs, its desire not to rock the fragile bilateral relation boat, but also what non-pivoting move the US government would offer in return.

Oh, but those were rudimentary proto-capitalist days. Welcome to the (savagely privatized) future, where the NSA black hole, "Digital Blackwater", lords over all as the ultimate Panopticon.

  • While Europe is furiously scrambling to find alternative sources of energy should Gazprom pull the plug on natgas exports to Germany and Europe (the imminent surge in Ukraine gas prices by 40% is probably the best indication of what the outcome would be), Russia is preparing the announcement of the "Holy Grail" energy deal with none other than China, a move which would send geopolitical shockwaves around the world and bind the two nations in a commodity-backed axis. One which, as some especially on these pages, have suggested would lay the groundwork for a new joint, commodity-backed reserve currency that bypasses the dollar, something which Russia implied moments ago when its finance minister Siluanov said that Russia may refrain from foreign borrowing this year. Translated: bypass western purchases of Russian debt, funded by Chinese purchases of US Treasurys, and go straight to the source. Here is what will likely happen next, as explained by Reuters:
  • Igor Sechin gathered media in Tokyo the next day to warn Western governments that more sanctions over Moscow's seizure of the Black Sea peninsula from Ukraine would be counter-productive.   The underlying message from the head of Russia's biggest oil company, Rosneft, was clear: If Europe and the United States isolate Russia, Moscow will look East for new business, energy deals, military contracts and political alliances.    The Holy Grail for Moscow is a natural gas supply deal with China that is apparently now close after years of negotiations. If it can be signed when Putin visits China in May, he will be able to hold it up to show that global power has shifted eastwards and he does not need the West. More details on the revelation of said "Holy Grail": State-owned Russian gas firm Gazprom hopes to pump 38 billion cubic meters (bcm) of natural gas per year to China from 2018 via the first pipeline between the world's largest producer of conventional gas to the largest consumer.   "May is in our plans," a Gazprom spokesman said, when asked about the timing of an agreement. A company source said: "It would be logical to expect the deal during Putin's visit to China."

White House: Al Qaeda in Iraq now 'transnational threat' | TheHill - 0 views

  • Al Qaeda's violent resurgence in Iraq and expansion into Syria now represents a "transnational threat network" that could possibly reach from the Mideast to the United States, according to the White House. The teaming of al Qaeda's Iraqi cell and affiliated Islamic militant groups in Syria into the new Islamic State of Iraq and al-Sham (ISIS) has developed into "a major emerging threat to Iraqi stability . . . and to us," a senior administration official told reporters on Wednesday. "It is a fact now that al Qaeda has a presence in Western Iraq" extending into Syria, "that Iraqi forces are unable to target," the official said. That growing presence "that has accelerated in the past six to eight months" has been accompanied by waves of bombings and attacks that threaten to throw Iraq into a full-blown civil war. 
  • Keeping ISIS from destabilizing the Iraqi government and expanding into other areas in the region is a "major focus" of this week's visit by Iraqi Prime Minister Nouri al Maliki to Washington. The Iraqi delegation met with Vice President Joe Biden Wednesday morning, and will meet with congressional leaders later in the day. Top defense lawmakers are already sounding the alarm on ISIS growth in the region and the threat posed by the al Qaeda faction to Iraq, Syria and ultimately the United States. "As the situation in both countries grows worse . . . we are deeply concerned that Al-Qaeda could use its new safe haven in Iraq and Syria to launch attacks against U.S. interests and those of our friends and allies," Sen. John McCain (R-Ariz.) along with Senate Armed Services Committee chief Carl Levin (D-Mich.), ranking member Jim Inhofe (R-Okla.) wrote in a letter to President Obama. Senate Foreign Relations heads Sens. Robert Menendez (D-NJ) and Bob Corker (R-Tenn.) also co-signed the letter, sent to the White House on Tuesday.

  • Iraqi officials reportedly reached out to U.S. intelligence officials to see if American drones could begin conducting airstrikes against ISIS targets in Western Iraq. When asked whether the White House was considering expediting those weapon sales to Iraq, the official replied: "I will leave it up to the Iraqis to make that case." That said, the administration "is working closely with Congress" to facilitate the kind of military and intelligence aid being sought by al-Maliki from the United States. Counterterrorism support is evaluated "country by country and in Iraq that is [especially] complicated," the official said, noting the long-standing tribal and sectarian ties woven into the country's makeup. 
  • That said, the White House official ruled out the possibility of putting U.S. boots back on the ground in Iraq, in the form of military trainers, as part of any counterterrorism strategy. The White House and Pentagon failed to reach a bilateral security deal with Baghdad that would allow a handful of American troops to remain in the country after the U.S. pullout in 2011. That lack of a deal prevented Washington from fielding a postwar force in Iraq after the final withdrawal in December of that year. White House critics claim Obama's inability to lock in a postwar deal with Iraq opened the door for al Qaeda's return to power in the country.

    Let's see if I've got this straight. Our previous wars in Iraq and Afghanistan resulted in massive recruitment by "terrorists" who now threat our shores once again. Therefore, we should launch a third war in Iraq or at least raining Hellfire missiles on Iraq from drones. This logic seems to ignore the immutable fact that it is U.S. violence in the region that converts peaceful Arab citizens into "terrorists." The message is clear: end our military involvement in the Mideast and northern Africa. But that message seems to fall on deaf ears in Washington, D.C. That is because this is not about terrorists at all. It is about control of Pipelinestan and profits in the military-industrial complex.
