Analysis: PA 'balking' at war crimes probe - Middle East - Al Jazeera English - 0 views

  • After a document obtained by Al Jazeera revealed the Palestinian Authority (PA) has stalled the launch of a formal investigation into alleged Israeli war crimes in Gaza, Palestinian legal and human rights experts remain dubious that the PA ever truly intended to join the International Criminal Court (ICC). In a confidential letter obtained exclusively by Al Jazeera's Investigative Unit, the ICC's top prosecutor, Fatou Bensouda, said she "did not receive a positive confirmation" from PA Foreign Minister Riad al-Malki that the request submitted for an international investigation had the Palestinian government's approval. Palestinian officials have, on numerous occasions, threatened to head to the ICC to hold Israel accountable for possible war crimes and crimes against humanity. But their efforts so far, have proved fruitless. In July, a French lawyer filed a complaint with the court on behalf of the Palestinian minister of justice, accusing Israel of carrying out war crimes in the Gaza Strip. This came after a 2009 call for an ICC investigation into Israel's three-week military offensive in Gaza that was later dropped when the prosecutor said Palestine was not a court member. In August, Malki met with ICC officials to discuss the implications of ratifying the Rome Statute, the treaty that established the criminal court. "Everything that has happened...is clear evidence of war crimes committed by Israel, amounting to crimes against humanity," he told reporters in The Hague, referring to the recent 51-day Israeli military offensive on Gaza, which left more than 2,100 Palestinians dead. Six Israeli civilians were killed, along with 66 Israeli soldiers.
  • Two years ago, Palestine became recognised as a non-member observer state at the UN General Assembly. This made it eligible to join the ICC; however, to date, Palestinian officials have not signed the Rome Statute, even though almost 80 percent of Palestinians support going to the court. Senior Fatah official Mohammad Shtayyeh didn't say when the Palestinians would apply to the ICC, but said it would probably happen in another few months. "The indictment against Israel at the ICC and all the accompanying documents are ready," Shtayyeh told Al Jazeera. One of the remaining hurdles, Shtayyeh said, is getting one remaining Palestinian faction - Islamic Jihad - to sign an accession document before the Palestinians can present it. Hamas signed onto the proposal at the behest of the PA in August. "We're not in a situation of setting a deadline or making an ultimatum," he said. "We're following developments in the region and the world, and therefore, we'll wait for answers from the international community. But I believe that by November-December, the picture should be clearer."
  • In response to Al Jazeera's claims, the Palestinian Justice Minister Salim al-Saqqa said that Palestinian President Mahmoud Abbas was serious about going to the ICC and was "awaiting national dialogue" to pursue it. "This issue is our number-one priority," he said. "It is still on the table awaiting a few legal and technical procedures. We have not missed our opportunity to head to the court." So far, the Palestinians have struggled to use the court to pursue their claims, with some attributing this to the PA's use of an ICC investigation as a political bargaining chip. "The PA can go to the ICC in one day," said Shawan Jabarin, the director of Ramallah-based human rights group al-Haq. "Abbas, who has been turned this into a political issue, is balking." Many factors are working against setting off a war crimes investigation at the ICC, not least the international community's apparent opposition to the move. "It is the PA's trump card because the Israelis and the Americans have said it is a red line," said Diana Buttu, a lawyer and former adviser to the Palestine Liberation Organisation (PLO).

"The Palestinian Authority has been consistently pressured by the USA, Israel, Canada, the UK and other EU Member States not to take steps to grant the ICC jurisdiction," Amnesty International said. "Such pressure has included threats to withdraw financial assistance on which the Palestinian Authority depends."

"The problem is the method being used by Abbas; he has subjected the issue to political bargaining and to the whims of negotiations."   • In the past week, Israel said it would open a criminal investigation into several instances of what it is calling "military misconduct" in the Gaza war. Israel's swift call for a probe appears to be an attempt to pre-empt any independent investigations into allegations that its military committed war crimes in Gaza. "The PA gave the Israelis enough time to come up with a trick to prevent the court from opening any investigation," said Saad Djebbar, a London-based lawyer. Generally, the ICC launches probes in instances where the country involved is unable or unwilling to launch an investigation itself, Djebbar told Al Jazeera. "If the court tries to open an inquiry, the Israelis can claim they have jurisdiction [to do it themselves] because the ICC's jurisdiction is complementary," he explained. "The ICC is legally bound to allow an Israeli [probe] to continue."

Violence in Israel and the Palestinian territories - the Guardian briefing | News | The... - 0 views

  • Israel and the occupied Palestinian territories have been convulsed by a wave of escalating violence in recent days. The lethal tensions ratcheted up sharply last Thursday when a married couple, Jewish settlers from Neria in the northern West Bank, were shot and killed in a car in front of their four children near Beit Furik, allegedly by members of a five-man Hamas cell who were subsequently arrested. Two more Israelis were stabbed and killed in Jerusalem’s Old City on Saturday by a Palestinian youth, who was shot dead at the scene. On Sunday, an 18-year-old Palestinian was shot dead by Israeli forces in clashes near the West Bank town of Tulkarem. The mounting friction has seen attacks by settlers on Palestinians, clashes between Palestinians and Israeli security forces and attempted attacks continue. On Wednesday. there were incidents in Jerusalem, where a Palestinian woman stabbed an Israeli man who then shot and seriously wounded her in the Old City, the southern Israeli city of Kiryat Gat, where a Palestinian was killed after reportedly trying to seize a gun from a soldier and stabbing him, and when a female Israeli settler’s car was stoned near Beit Sahour, which adjoins Bethlehem, in an incident in which it appears other settlers fired on Palestinians, seriously injuring a youth.
  • On the Palestinian side, anger escalated earlier this week after a 13-year-old boy in Bethlehem’s Aida refugee camp was shot and killed by an Israeli sniper in an incident the Israeli military has claimed was “unintentional” as soldiers were aiming at another individual.
  • Jerusalem has remained tense now for almost a year. Most analysts blame the recent heightened tension on several factors. Key among them has been the issue of the religious site in Jerusalem known to Muslims as al-Haram al-Sharif, or the Noble Sanctuary, and Jews as the Temple Mount. A long-running campaign by some fundamentalist Jews and their supporters for expanding their rights to worship in the Al-Aqsa mosque compound on the Temple Mount, supported by rightwing members of Israeli prime minister Binyamin Netanyahu’s own cabinet, has raised the suspicion – despite repeated Israeli denials – that Israel intends to change the precarious status quo for the site, which has been governed under the auspices of the Jordanian monarchy since 1967.

  • Recent Israeli police actions at the site scandalised the Muslim world and raised tensions. Israel has also banned two volunteer Islamic watch groups – male and female – accusing them of harassing Jews during the hours they are allowed to visit. That has combined with the lack of a peace process and growing resentment and frustration in Palestinian society aimed at both Israel and the Palestinian president, Mahmoud Abbas, and the Palestinian Authority. Israel has complained in recent weeks of an increase in stone throwing and molotov cocktail attacks on West Bank roads and in areas adjoining mainly Palestinian areas of Jerusalem, where an elderly motorist died after crashing his car during an alleged stoning attack. In response, Netanyahu and his cabinet have loosened live-fire regulations over the use of .22 calibre bullets on Palestinian demonstrators. Although described by Israel as “less lethal”, it is this type of ammunition that killed 13-year-old Abdul Rahman Shadi on Monday.
  • Part of the problem is the leadership on both sides. Netanyahu leads a rightwing/far-right coalition with the smallest of majorities. Several cabinet ministers support the settler movement and have publicly criticised him for not cracking down harder on Palestinian protest. Netanyahu’s weakness is reflected on the Palestinian side, where the ageing Abbas is seen as isolated, frustrated and increasingly out of step with other members of the Palestinian leadership, who would like a tougher line against Israel over continued settlement building and the absence of any peace process.
  • In his recent speech to the UN general assembly, Abbas went further than he had ever done before in threatening to end what he claims is Palestine’s unilateral adherence to the Oslo accords, which he said Israel refuses to honour. “We cannot continue to be bound by these signed agreements with Israel and Israel must assume fully its responsibilities of an occupying power,” he said. Abbas, however, stopped short of ending security cooperation between Israel and Palestinian security forces – mainly aimed at Hamas on the West Bank – and asked the UN for international protection. His speech at the United Nations has been seen as a move to placate growing discontents in Palestinian society. Both Abbas and Netanyahu are now both engaged in a delicate balancing act, trying to avoid further escalation that would be detrimental to both while trying not to lose the support of key constituencies. On Abbas’s side, that has meant ordering Palestinian factions and security forces to desist from joining the conflict, while on Netanyahu’s side it has seen numerous warnings of harsh measures – many of which have been repeatedly announced.
  • Nentanyahu does not want to risk a position where Abbas ends security cooperation and in the local jargon “hands back the keys” – in other words revokes the Oslo accords and insists on Israel once again taking full responsibility for administering the occupied territories. For his part, Abbas is said to see a limited popular uprising as useful because of the message it delivers to both Israel and the international community of the mounting risks of a moribund peace process and how serious things could become if security cooperation were to end.
  • At the end of the last round of the peace process last year, US diplomats warned about this potential outcome and Washington has largely withdrawn from a guiding role, exhausted by the lack of progress and frustrated with Netanyahu. Despite the Palestinian desire for a new multilateral international approach, it has failed to materialise as have any US guarantees to Abbas that they intend to advance the peace process. While Syria, migration and Russia are preoccupying western governments, Israel and Palestine have been largely left to their own devices.
  • Flare-ups of violence have a habit of coming and going but hopes that this one is coming to an end appear premature for now. However, the likelihood of the current violence fading away still remains the strongest bet. The biggest risk is a miscalculation by either side, which is out of the hands of either leader, that would alter the dynamics. Individuals on both sides have led some of the worst attacks: Jewish extremists in the summer burning three members of a Palestinian family to death, and “lone wolf attacks” launched by Palestinians angry about al-Aqsa and other issues. With neither side having a clear exit strategy, there is a risk is that Netanyahu and Abbas are being led by events rather than leading.

  • Conflict between Israel and Palestine escalates as youth throughout Palestine vent their frustrations over decades of illegal occupation and an escalation of Israeli oppression and violence. The renewed round of violence takes its toll on both Israelis and Palestinians.  
  • Violent clashes between Israeli occupation forces, settlers and Palestinians have escalated throughout Palestine since the beginning of the intensified Israeli crackdown against Palestinians at the Al-Aqsa mosque in Jerusalem, last month. On Sunday Israeli troops carried out a raid against the International Middle East Media Center (IMEMC). The center disseminates a lot of regional and local news coverage that otherwise only is available in Arab to English-speaking listeners and readers. The raid was carried out Sunday morning at 4.00 o’clock. Over the weekend a rocket was fired into Israeli territory from the Gaza Strip. The rocket landed without causing damage. Sunday at dawn Israel responded by launching air strikes against targets in the Gaza Strip. Israeli military and government sources say that the strikes aimed at targeting militants.
  • One of these air strikes struck a family home in the Zeitoun neighborhood of Gaza City. The air raid killed a five months pregnant Palestinian mother along with her two-year-old child while several other family members were injured. The husband of the deceased 30-year-old Nour Rasmi Hassan told that a “knock on the roof rocket” woke the family from their sleep but that they were confused, shocked and that there was no time to respond and flee their home before the house was struck. Frustrated Palestinian youth are confronting Palestinian police and military in occupied East Jerusalem and other occupied Palestinian territories. Clashes in the interim Palestinian capital Ramallah turned deadly on Sunday evening when a 13-year-old boy succumbed to the his injuries. The 13-year-old Ahmad had been struck in the head by a rubber-coated steel bullet fired by Israeli occupation forces earlier that day. The fatal shooting occurred close to the Beit El settlement northeast of al-Biereh.

  • Last week Israeli undercover agents infiltrated Palestinian protesters near Beit El, grabbing some, beating, kicking and injuring them severely. Meanwhile, some frustrated Palestinian youth have carried out knife attacks against Israeli settlers and citizens, venting their frustrations. Knife attacks began after the willful fatal shooting of an unarmed Palestinian youth by Israeli officers. A video captured the fatal shooting and the cheering words “kill him, kill him” before the fatal shots were fired. Several analysts noted that the latest round of violence has the potential to escalate into a full-scale Palestinian uprising. The Israeli crackdown against Palestinians has further soured Egyptian – Israeli relations. Last week the spokesman for the Egyptian Foreign Ministry, Ahmed Abu Zeid said that Israel as the occupying power must provide Palestinian people the required protection and stop repeating its attacks that lead to more political congestion among the Palestinians and weaken the opportunities of reviving the installed peace talks between Palestinians and Israel,.

Mahmoud Abbas stressed that Palestine could not continue to adhere to the accords as Israel continues to violate them. Several of the progressive PLO member factions, including the PFLP and DFLP have called for a renewed uprising. Both factions have repeatedly demanded that the Al-Fatah led Palestinian Authority immediately ends its so-called security cooperation with Israeli police, military, intelligence services and government. The Israeli Cabinet of Prime Minister Benjamin Netanyahu, for its part, has promised a strict response to any “insurrection”. Over 150 Palestinians have been seriously injured over the course of the last week.

  • When the Palestinians sought statehood at the United Nations in 2011, it was widely dismissed as a symbolic gambit to skirt negotiations with Israel and Washington’s influence over the long-running conflict. But the Palestinians have begun to translate a series of such symbolic steps, culminating in last week’s move to join the International Criminal Court, into a strategy that has begun to create pressure on Israel.While many prominent Israelis have called for unilateral action to set the country’s borders, it is Palestinians who have gained political momentum with moves made outside of negotiations. The Palestinians are, in effect, establishing a legal state. International recognition, by 135 countries and counting, is what Palestinians are betting could eventually force changes on the ground — without their leaders having to make the concessions or assurances they have long avoided.
  • President Abbas, having joined the International Criminal Court after months of rebuffing internal pressure to do so, now faces calls from a frustrated public to go further, by halting security coordination with Israel or dissolving the Palestinian Authority. While both steps would be problematic for the Palestinians as well as the Israelis, Palestinian leaders see it as a way to further squeeze Israel.   • e commend Secretary of State John Kerry’s extraordinary efforts to renew Israeli-Palestinian talks and negotiations for a framework for a peace accord, and the strong support his initiative has received from President Barack Obama. We believe these efforts, and the priority Kerry has assigned to them, have been fully justified. However, we also believe that the necessary confidentiality that Secretary Kerry imposed on the resumed negotiations should not preclude a far more forceful and public expression of certain fundamental U.S. positions: Settlements: U.S. disapproval of continued settlement enlargement in the Occupied Territories by Israel’s government as “illegitimate” and “unhelpful” does not begin to define the destructiveness of this activity. Nor does it dispel the impression that we have come to accept it despite our rhetorical objections. Halting the diplomatic process on a date certain until Israel complies with international law and previous agreements would help to stop this activity and clearly place the onus for the interruption where it belongs.
  • Palestinian incitement: Prime Minister Benjamin Netanyahu’s charge that various Palestinian claims to all of historic Palestine constitute incitement that stands in the way of Israel’s acceptance of Palestinian statehood reflects a double standard. The Likud and many of Israel’s other political parties and their leaders make similar declarations about the legitimacy of Israel’s claims to all of Palestine, designating the West Bank “disputed” rather than occupied territory. Moreover, Israeli governments have acted on those claims by establishing Jewish settlements in East Jerusalem and throughout the West Bank. Surely the “incitement” of Palestinian rhetoric hardly compares to the incitement of Israel’s actual confiscations of Palestinian territory. If the United States is not prepared to say so openly, there is little hope for the success of these talks, which depends far more on the strength of America’s political leverage and its determination to use it than on the good will of the parties.

  • The Jewishness of the state of Israel: Israel is a Jewish state because its population is overwhelmingly Jewish, Jewish religious and historical holidays are its national holidays, and Hebrew is its national language. But Israeli demands that Palestinians recognize that Israel has been and remains the national homeland of the Jewish people is intended to require the Palestinians to affirm the legitimacy of Israel’s replacement of Palestine’s Arab population with its own. It also raises Arab fears of continuing differential treatment of Israel’s Arab citizens. Israelis are right to demand that Palestinians recognize the fact of the state of Israel and its legitimacy, which Palestinians in fact did in 1988 and again in 1993. They do not have the right to demand that Palestinians abandon their own national narrative, and the United States should not be party to such a demand. That said, Palestinian recognition of Israel as a Jewish state, provided it grants full and equal rights to its non-Jewish citizens, would not negate the Palestinian national narrative.
  • Israeli security: The United States has allowed the impression that it supports a version of Israel’s security that entails Israeli control of all of Palestine’s borders and part of its territory, including the Jordan Valley. Many former heads of Israel’s top intelligence agencies, surely among the best informed in the country about the country’s security needs, have rejected this version of Israel’s security. Meir Dagan, a former head of the Mossad, dismissed it as “nothing more than manipulation.” Israel’s confiscation of what international law has clearly established as others’ territory diminishes its security. Illegal West Bank land grabs only add to the Palestinian and the larger Arab sense of injustice that Israel’s half-century-long occupation has already generated, and fuels a revanchismthat sooner or later will trigger renewed violence. No Palestinian leader could or would ever agree to a peace accord that entails turning over the Jordan Valley to Israeli control, either permanently or for an extended period of time, thus precluding a peace accord that would end Israel’s occupation. The marginal improvement in Israel’s security provided by these expansive Israeli demands can hardly justify the permanent subjugation and disenfranchisement of a people to which Israel refuses to grant citizenship in the Jewish state.
  • The terms for a peace accord advanced by Netanyahu’s government, whether regarding territory, borders, security, resources, refugees or the location of the Palestinian state’s capital, require compromises of Palestinian territory and sovereignty on the Palestinian side of the June 6, 1967, line. They do not reflect any Israeli compromises, much less the “painful compromises” Netanyahu promised in his May 2011 speech before a joint meeting of Congress. Every one of them is on the Palestinian side of that line. Although Palestinians have conceded fully half of the territory assigned to them in the U.N.’s Partition Plan of 1947, a move Israel’s president, Shimon Peres, has hailed as unprecedented, they are not demanding a single square foot of Israeli territory beyond the June 6, 1967, line. Netanyahu’s unrelenting efforts to establish equivalence between Israeli and Palestinian demands, insisting that the parties split the difference and that Israel be granted much of its expansive territorial agenda beyond the 78 percent of Palestine it already possesses, are politically and morally unacceptable. The United States should not be party to such efforts, not in Crimea nor in the Palestinian territories. We do not know what progress the parties made in the current talks prior to their latest interruption, this time over the issue of the release of Palestinian prisoners. We are nevertheless convinced that no matter how far apart the parties may still be, clarity on America’s part regarding the critical moral and political issues in dispute will have a far better chance of bringing the peace talks to a successful conclusion than continued ambiguity or silence.

Al Jazeera once again removes Joseph Massad article on Palestine | The Electronic Intifada - 0 views

  • Al Jazeera English has once again removed an article by Columbia University professor Joseph Massad hours after publishing it. The article, “The Dahlan Factor,” appeared for several hours on the Qatar-based broadcaster’s website this morning at this link, but was later removed without explanation (the full article is republished below). The article had been extremely popular, appearing in the fifth spot on the website’s “What’s Hot” section.

  • The recent resurrection of Mohammad Dahlanby several Arab governments, Israel and the US is a most important development for the future of the Palestinian cause, Palestinian Authority (PA)-Israel negotiations, and Hamas-ruled Gaza. Dahlan is viewed, by many Palestinians, as the most corrupt official in the history of the Palestinian national movement (and there are many contenders for that title). Dahlan, it would be recalled, was the PA man in charge of Gaza after the Oslo Accords were signed, where he commanded 20,000 Palestinian security personnel who were answerable to the CIA and to Israeli intelligence. His forces would torture Hamas members in PA dungeons throughout the 1990s. His corruption, at the time, was such that he allegedly diverted over 40 percent of taxes levied against the Palestinians to his personal account in what became known as the Karni Crossing Scandal in 1997. Dahlan, who has been accused repeatedly by both Hamas and Fatah of being an agent of US, Israeli, Egyptian, and Jordanian intelligence, would attempt to stage a US-organised coup against the democratically elected Hamas government in 2007 in Gaza, an attempt that backfired on him and ended with his eviction from the Strip (I had forewarned about the coup several months before it occurred).

  • A simultaneous coup led by Abbas and his Israeli- and US-backed security forces in the West Bank was successful in dislodging the elected Hamas from power. Dahlan retreated to that mainstay of US and Israeli power, namely the PA-controlled West Bank, where he began to hatch new plots with his multiple patrons to undermine not only Hamas but also Abbas, whose position he begrudged and coveted. Indeed the Americans and the European Union (the latter on US orders) began to pressure Abbas to appoint Dahlan as his deputy, making it clear that they would like to see Dahlan succeed Abbas. Abbas resisted the pressure and refused. In the meantime, Dahlan, has been accused by Hamas and the PA of allegedly plotting several assassination attempts that targeted several Palestinian officials, including Hamas Prime Minister Ismail Haniyyah and Fatah ministers in the PA. Accusations that he persistently denied. His involvement in the 2010 Mossad assassination of a Hamas official in Dubai included having two of his Palestinian death squad hit men (later arrested by Dubai authorities) assist in the operation, a charge he also denied. His personal wealth was conservatively estimated in 2005 by an Israeli think tank at $120m.
  • Just as George Bush Jr and Bill Clinton terminated the services of Arafat after the latter proved unable to sign off on the final Palestinian surrender demanded of him at Camp David in the summer of 2000 (an inability that would arguably cost him his life at the hands of Abbas or Dahlan - depending on which of the two you talk to - acting at the behest of the Israelis, and very likely the Americans), Obama will terminate the services of Abbas should he fail to sign the US-sponsored surrender. Indeed, even if Abbas does sign such a deal, as he is approaching his 80th birthday, Dahlan will be needed and ready to take over after his death. It is in this context that Egyptian army top brass recently visited Israel for a whole week while the Egyptian private TV station Dream (owned by a Mubarak businessman ally, Ahmad Bahgat) aired an interview with Dahlan in which he attacked Abbas, in yet another effort to delegitimise the latter. Dahlan was offered the support of the rightwing Egyptian businessman Naguib Sawiris (infamous for his cutting off cellular phone lines in Cairo during the Egyptian uprising in January 2011 on the orders of Mubarak’s security apparatus), who sang Dahlan’s praises (as well as those of Mohammad Rashid, aka Khaled Salam, a former Arafat aide and another allegedly corrupt embezzling fugitive) as one of the most honest businessmen he ever worked with and then proceeded to denounce Abbas as a “liar”.
  • Dahlan’s power lies in his ability to serve the agenda of multiple patrons. For the Israelis, he is a ruthless, corrupt power-grubbing man who would do their bidding obediently were he to come to power in Gaza or the West Bank. Both the Americans and the Israelis see him as especially willing to sign on an American-sponsored Netanyahu deal without equivocation. For the Egyptians and the Gulf monarchies (and he is said to be a business partner with a Gulf ruler), he would look after their interests and obey their orders by eliminating any resistance to a US-imposed Palestinian final surrender to Israel and by eliminating Hamas once and for all. For the Egyptian coup leaders, whose coup replicated Dahlan’s 2007 Gaza coup, except successfully, he could rid them of Hamas, which they see as an extension of the power of the Muslim Brotherhood (MB), and render their relations with Israel even closer than they already are. Dahlan’s most important role, however, is the one that the Americans need him for, namely, to replace Abbas should the latter fail to sign on to the final surrender that Barack Obama and John Kerry have been cooking at the behest of Netanyahu in the past few months.
  • Once Dahlan’s schemes became too obvious to ignore, Abbas stripped him of power and chased him out of the Ramallah Green Zone in 2010. He moved to Mubarak’s Egypt and later, following the ouster of Mubarak, to Dubai (and on occasion Europe) where he remained until his more recent resurrection by the heirs of Mubarak who now sit on Egypt’s throne.
  • As an Egyptian court has recently joined Israel and the US in banning Hamas from the country and considering it a terrorist organisation and as the Israelis have threatened openly this week that an invasion of Gaza will be necessary, the plan for a Dahlan take-over is hatching slowly but surely. This is viewed as such a threat that Abbas dispatched his supporters and cronies to the streets of Ramallah to prove to the Americans and the Israelis that he still commands much support in the West Bank. The competition between Abbas and Dahlan is essentially one where each of them wants to prove that he can be more servile to Israeli, US, Egyptian, and Gulf interests while maintaining legitimacy and full control of the Palestinian population. The details of the plot are not clear. They could involve an invasion of Gaza from the Egyptian and the Israeli sides (and Egyptian officials have already threatened to carry out such an invasion a few weeks ago), a coup of sorts in the West Bank, and even assassinations of Haniyyah and/or Abbas. All bets are off at the moment, as Abbas, like Arafat before him, is offering complete obedience to US and Israeli diktat and will go much farther than Arafat did, but he understands too well that he would lose all legitimacy and control were he to sign the final humiliating surrender that the US and Israel are insisting on. Dahlan of course will have no such worries.
  • As for Hamas, which, unlike the MB, is a resistance movement and not a political party, it cannot be rounded up or crushed so easily, and the entry of Dahlan into Gaza, let alone the West Bank, will usher in a civil war that could likely end in his defeat yet again, short of a full Israeli invasion of Gaza to return him to power (Dahlan has also been accused by the PA of collaborating with the Israelis in their 2008 invasion of Gaza and has recently been accused in aiding the ongoing counter-revolution in Egypt). The same scenario would be repeated in the West Bank. The future of the Palestinian people is in danger and the enemies of the Palestinians surround them inside and outside Palestine. The Obama-Israeli-Egyptian-Gulf plans for liquidating their cause and their rights continue afoot. However, just like past corrupt Palestinian leaders were unsuccessful in liquidating the rights of the Palestinians and their cause, the Israeli and US betting on the Dahlan horse will only increase the resolve of the Palestinian people and their supporters that Palestinian resistance will only cease after the final liquidation of Israeli state racism and colonialism in all its manifestations throughout historic Palestine.

Netanyahu Has Never Actually Supported a Palestinian State, Despite What He Told Obama - 0 views

  • IN A MEETING with President Obama today, Benjamin Netanyahu went through the familiar motions of expressing rhetorical support for a two-state solution to the Israel-Palestine conflict. Stating, “I remain committed to a vision of peace of two states for two peoples,” Netanyahu said that he wanted “make it clear that we have not given up our hope,” for achieving a two-state solution to the conflict. Just a day before this statement, however, the Israeli government took steps to ensure such a vision could never become reality, moving to authorize the construction of an additional 2,200 housing units in the occupied territories in the face of Palestinian opposition. The reason behind this apparent discrepancy between word and deed is that Netanyahu does not, and has essentially never, supported the creation of an actual Palestinian state. Last year, during the Israeli election, Netanyahu briefly acknowledged this fact himself, explicitly stating to voters that there would not be a Palestinian state during his tenure as prime minister if he was reelected. Despite this, the convenient fiction that the Israeli prime minister supports a “two-state solution” continues to linger in the United States. Why?
  • In 2009, however, that began to change. In June of that year, newly elected President Barack Obama, who had made rebuilding ties with the Muslim world a part of his foreign policy platform, gave a landmark speech in Cairo in which he said the United States “does not accept the legitimacy of continued Israeli settlements,” going on to describe them as contrary to previous agreements and an impediment to peace in the region. Israeli media would report at the time that Obama’s words “resonated through Jerusalem’s corridors.” In seeming recognition of shifting American sentiments on this issue, 10 days later Netanyahu gave what was billed as a landmark speech at Bar-Ilan University near Tel-Aviv, dealing in part with the subject of Palestinian statehood. In his address, hailed by the White House as an “important step forward,” Netanyahu endorsed for the first time the creation of what he called “a demilitarized Palestinian state” in the occupied territories. But the same speech added stipulations that, in sum, turned this so-called state into a rebranded version of Netanyahu’s 2000 “Palestinian entity,” with only limited autonomy. In private, just three months before the speech, Netanyahu was even more blunt about the limits he required for a more independent Palestinian territory, stipulating he could only support one “without an army or control over air space and borders,” according to diplomatic cables later released by WikiLeaks.
  • In a speech two years later to Congress, Netanyahu would go into more detail about the ridiculous conception of Palestinian “statehood” he was imagining, one in which the West Bank would be essentially bifurcated by massive Israeli settlement blocs, the prospective Palestinian capital of East Jerusalem would be surrounded by settlements, and the Israeli Defense Forces would continue to have “a long-term military presence” inside the newly independent “state.” Needless to say, such a proposal was unlikely ever to be accepted by the Palestinians, nor did it bear much resemblance to the independent statehood they had actually been seeking. Netanyahu let the mask drop even further in July 2014, when he stated in a press conference that “there cannot be a situation, under any agreement, in which we relinquish security control of the territory west of the River Jordan,” essentially outlining a position of permanent military occupation of Palestinian territories. In the run-up to the 2015 election, when he publicly disowned the idea of Palestinian statehood, Netanyahu would specifically repudiate his 2009 Bar-Ilan speech, stating that “there will be no withdrawals and no concessions,” and that the speech was “not relevant.” As recently as last week, Netanyahu told the Knesset Foreign Affairs and Defense Committee that “we need to control all of the territory for the foreseeable future,” before adding darkly that Israel “will forever live by the sword.”

  • In light of all this, it’s difficult to take seriously Netanyahu’s most recent claim that he supports the creation of a Palestinian state. At best, he has in the past expressed support for a Palestinian “entity” with some features of self-governance (an idea that has well-known historical precedents), but certainly not one that affords genuine independence, freedom or statehood to its inhabitants. At his most brazen, he has denied the possibility of even that limited form of self-determination, stating bluntly that Israel will control the entire West Bank and keep its inhabitants under indefinite military subjugation. Netanyahu has nonetheless been allowed to maintain a convenient fiction that he supports the negotiated goal of Palestinian self-determination. In reality, he has never really supported it. Thanks in large part to Netanyahu’s leadership, a Palestinian state will likely never emerge. Due to his own obstinance, as well as American indulgence, a binational state or a formalized Apartheid regime have now become the most probable remaining outcomes to this disastrous, decades-long conflict.

    Negotiation of a "2-state solution" for Israel and Palestine has never been anything more than an excuse for continuing the status quo, with Israel dominating both territories in an apartheid state. The 2-state solution, moreover, denies all residents of the former British Mandate Territory of Palestine (including present day Israel) of their fundamental right to self-determination of their form of government established by the U.N. Charter. And the notion of a 2-state solution with territorial swaps ignores the right of Arab residents of the Mandate Territory to return to their homes at the close of hostilities, a right specifically forbidden from being negotiable by Israel and the Palestinian authority; it is an individual right that governments cannot lawfully barter away.   I'm glad to see The Intercept taking a no holds barred, speak-truth-to-power  approach to the Israel-Palestine question.

Apartheid Forever: Israel's Netanyahu rules out Palestinian Citizenship Rights | Inform... - 0 views

  • Israeli Prime Minister Binyamin Netanyahu, under extreme pressure over the real possibility that he will lose the March 17 elections, has made a powerful appeal to his far right wing constituency by openly admitting that he will never allow a Palestinian state and that he intends to flood Israeli squatters into East Jerusalem and its environs to make sure this Occupied territory never returns to the Palestinians.Millions of Palestinians whose families were violently expelled from their homes by Jewish settlers in Mandate Palestine in 1947-48 remain stateless. These include the people of Gaza, the West Bank (four million) and a million or more in diasporas in Lebanon, Syria, and other countries. A million Palestinians are now citizens in Israel, and others have rights of citizenship in far-flung places like Chile and Honduras, as well as the United States. But I figure five million at least remain stateless.
  • Statelessness is rare in today’s world, a result of reforms initiated by the international community after the horrors of World War II and its preceding decades. Franco rendered many on the Spanish Left stateless after his victory in the Civil War in 1939 (not to mention massacring tens of thousands of them). The White Russians lost citizenship after their revolt against the Communists failed. The Nazis took citizenship rights away from Jews, Gypsies and others in Europe. In fact, the Holocaust was made practically possible in part by the denial of citizenship to Jews, which left them with no access to courts or other levers of social power that might have combated the monstrous Nazi plans for genocide. Millions were stateless in the 1930s and 1940s, and their lack of citizenship rights often exposed them to ethnic cleansing or loss of property and displacement.
  • The Palestinians are the last major stateless population. Stateless people do not have rights as most people understand the term. Their situation in some ways resembles slavery, since slaves also were denied the rights of citizenship. Stateless people’s property is insecure, since people with citizenship rights have better access to courts and to ruling authorities. Palestinians never really know what they own, and Israeli squatters routinely steal their property with impunity. Squatters dig tube wells deeper than those of the Palestinian villagers, lowering aquifers and causing Palestinian wells to dry up. Squatters go on wilding attacks, chopping down entire olive orchards (a prime source of Palestinian income) or beating up Palestinians. If Palestinians assemble peacefully to protest the loss of their farms to ever-expanding squatter settlements, the Israel army arrests them, including, often, children, who are taken away from their families and put in jail. Palestinians can be held for long periods without being charged. The prisoners are sometimes tortured.

Netanyahu said Sunday that if Israel relinquished the West Bank it would become a bastion of Muslim radicalism (but West Bankers are substantially more secular than the Jewish population of West Jerusalem).But in fact, Netanyahu and the right are dedicated to Greater Israel, to annexing the West Bank territory and finding a way to expel the Palestinians from it. The Palestinians are not a security challenge– they are like the guard at a bank getting in the way of bank robbers. The bank robbers feel a need to knock him out or kill him, remove him from the scene.

The news of this major success against a company famed for its role in illegal Israeli settlements broke amidst intensifying demonstrations against Israel’s policies of colonisation in Jerusalem. Grassroots boycott activism saw SodaStream dropped by major retailers across North America and Europe including Macy’s in the US and John Lewis in the UK.

SodaStream has also come under fire for its treatment of Palestinian workers in its West Bank factory, as Ziadah explains: “Any suggestion that SodaStream is employing Palestinians in an illegal Israeli settlement on stolen Palestinian land out of the kindness of its heart is ludicrous.” “Palestinian workers are paid far less than their Israeli counterparts and SodaStream recently fired 60 Palestinians following a dispute over food for the breaking of the Ramadan fast. Workers have previously said they are treated ‘like slaves’”. “Palestinians are forced to work inside settlements in sub-standard conditions because of Israel’s deliberate destruction of the Palestinian economy. There’s an urgent need for the creation of decent and dignified jobs within the Palestinian economy.”

Soros Fund Management, the family office of the billionaire investor George Soros, sold its stake in SodaStream following BDS pressure. SodaStream’s share price fell dramatically in recent months as sales dried up, particularly in North America. After reaching a high of $64 per share in October 2013, the stock fell to around $20 per share this month. SodaStream has estimated its third quarter revenue will be $125 million, down almost 14 percent from the same period last year. But Ziadah warned that SodaStream will still remain actively complicit in the displacement of Palestinians in the Naqab and will remain a focus of boycott campaigning. “Even if this announced closure goes ahead, SodaStream will remain implicated in the displacement of Palestinians. Its new Lehavim factory is close to Rahat, a planned township in the Naqab (Negev) desert, where Palestinian Bedouins are being forcefully transferred against their will. Sodastream, as a beneficiary of this plan, is complicit with this violation of human rights,” she said.

Modeled on the successful South African BSD movement that ended the South African apartheid state, the Palestinian movement has had a long string of victories, with only a few of the most recent discussed in this article. The BSD movement, in my studied opinion, represents the best hope of finally resolving the Palestinian Question, resulting in a single non-sectarian state spanning both Israel and Palestine. Until that day, Israel's war crimes against Palestinians, extending from the forced expulsion of 750,000 Palestinians when Israel was first formed via terrorist paramilitary actions, will likely continue.

    What's remarkable here is that Obama has apparently ratcheted down his fear of the Israel Lobby. But it's not as though Mr. Netanyahu was not warned that the world would see Israel as responsible if it blew up the Kerry-brokered negotiation between Israel and Palestine. Israel did blow it up by not delivering the last shipment of Palestinian prisoners required by the pre-negotiation agreement, attempting to gain further concessions using their release as leverage.  Palestine responded by joining a large number of U.N. treaty organizations and was thus recognized by most nations on the planet as a nation: a critically important move, because it is recognition by other nations as a nation that qualifies Palestine as a full-fledged U.N. member rather than an observer state, an application Palestine can now make at the time of its choosing. That is also important because Palestine is now positioned to join the Rome Convention that created the International Criminal Court, providing Palestine with legal standing to file war crime charges against high Israeli officials that would then obligate the Court to investigate. Palestine is holding back on that move, using it as bargaining leverage on the world stage.   Palestine also responded by forming a coalition "unity" government with Hamas, the political party that nominally rules the Gaza strip, the world's largest open-air concentration camp. At Israel's request, the U.S. had several years ago designated Hamas as a terrorist organization. But that was a purely political move. It seems that the political situation has changed.     Not a decision to go to the ICC, but the latest in a consistent dribble of information indicating that the Palestinian state is working toward doing so.  The slow pace of the public indications hint that they are intended to increase Palestinian leverage in negotiations. To me the questions of whether Abbas would actually make such a complaint and if he did so whether ICC would proceed with a prosecution are far from settled.  Almost certainly, such a complaint would end negotiations and U.S. subsidy of the Palestinian government's expenses. Abbas has previously shown no sign of being more than a U.S.-Israeli puppet. And the U.S. and Israel are applying stiff pressure on the ICC not to take the case if it arrives there, including a U.S. threat to cease its funding contributions to the ICC. On the other hand, if Abbas wishes to preserve his unity government with Hamas and thus have standing to speak for the entirety of the Palestinian population, he *must* be perceived  in Gaza as either delivering or fighting hard for very substantial easing of Israel's blockade of Gaza. A complaint to the ICC would be perceived as fighting hard, as having abandoned his commitment to resolution purely via negotiation.   So there is a lot of pressure on Abbas to do something more than negotiate unsuccessfully. And the U.S. and Israel leadership surely realize that.

  • But I am required to evaluate honestly how we manage Israeli-Palestinian relations over the next several years.  Because up until this point, the premise has been, both under Republican and Democratic administrations, that as different as it was, as challenging as it was, the possibility of two states living side by side in peace and security could marginalize more extreme elements, bring together folks at the center and with some common sense, and we could resolve what has been a vexing issue and one that is ultimately a threat to Israel as well. And that possibility seems very dim.  That may trigger, then, reactions by the Palestinians that, in turn, elicit counter-reactions by the Israelis.  And that could end up leading to a downward spiral of relations that will be dangerous for everybody and bad for everybody. So, bottom line, just to summarize here -- number one, our military and intelligence cooperation with Israel will continue unabated, unaffected, and we are absolutely committed to making sure that the Israeli people are safe, particularly from rocket attacks and terrorist attacks aimed on civilians.
  • I don't think anybody ever envisioned in any peace agreement, certainly not one that Prime Minister Netanyahu would agree to, or that the Israeli people would agree to, that overnight you suddenly have a Palestinian state right next to Jerusalem and that Israel would not have a whole range of security conditions that had to be met, and that it would be phased in over a long period of time. So the issue has never been, do you create a Palestinian state overnight.  The question is, do you create a process and a framework that gives the Palestinians hope, the possibility, that down the road they have a secure state of their own, standing side-by-side with a secure, fully recognized Jewish state of Israel.  And I think -- it's not just my estimation -- I think it’s hard to envision how that happens based on the Prime Minister’s statements.  And so, when I said that we have to now do an evaluation of where we are, it's not in reference to our commitment to Israel’s military edge in the region, Israel’s security, our intelligence cooperation, our military cooperation.  That continues unabated.  And I will continue to do whatever I need to do to make sure that our friends in Israel are safe.  That's what I've done since I've been President, and that's not going to stop.  And so the Israeli people need to know that.

  • With respect to Israel’s relations with the Palestinians, I think it's important to understand that the issue here is not what I believe, but it’s what the Palestinians and the parties in the negotiations and the Israeli people believe is possible.  That's the most important issue.  I've said before and I'll simply repeat:  Prime Minister Netanyahu, in the election run-up, stated that a Palestinian state would not occur while he was Prime Minister.  And I took him at his word that that's what he meant, and I think that a lot of voters inside of Israel understood him to be saying that fairly unequivocally. Afterwards, he pointed out that he didn’t say “never,” but that there would be a series of conditions in which a Palestinian state could potentially be created.  But, of course, the conditions were such that they would be impossible to meet anytime soon.  So even if you accepted, I think, the corrective of Prime Minister Netanyahu in subsequent days, there still does not appear to be a prospect of a meaningful framework established that would lead to a Palestinian state even if there were a whole range of conditions and security requirements that might be phased in over a long period of time -- which was always the presumption. 
  • Number two, that the evaluation that’s taking place is specific to what happens between the Israelis and Palestinians going forward.  We’ll continue to engage the Israeli government as well as the Palestinians, and ask them where they are interested in going and how do they see this issue being resolved.  But what we can’t do is pretend that there’s a possibility of something that’s not there.  And we can’t continue to premise our public diplomacy based on something that everybody knows is not going to happen at least in the next several years.  That is something that we have to, for the sake of our own credibility, I think we have to be able to be honest about that. And I guess one last point about this, because obviously I’ve heard a lot of the commentary -- there’s a tendency I think in the reporting here to frame this somehow as a personal issue between myself and Prime Minister Netanyahu.  And I understand why that’s done, because when you frame it in those terms, the notion is, well, if we all just get along and everybody cools down, then somehow the problem goes away.  I have a very business-like relationship with the Prime Minister.  I’ve met with him more than any other world leader.  I talk to him all the time.  He is representing his country’s interests the way he thinks he needs to, and I’m doing the same.
  • So the issue is not a matter of relations between leaders; the issue is a very clear, substantive challenge.  We believe that two states is the best path forward for Israel’s security, for Palestinian aspirations, and for regional stability.  That’s our view, and that continues to be our view.  And Prime Minister Netanyahu has a different approach.  And so this can’t be reduced to a matter of somehow let’s all hold hands and sing “Kumbaya.”  This is a matter of figuring out how do we get through a real knotty policy difference that has great consequences for both countries and for the region. These were the words of Nickolay Mladenov, United Nations' Coordinator for the Middle East Peace Process, in response to the passing of a bill at the Israeli Knesset on February 7 that retroactively legalises thousands of illegal settler homes, built on stolen Palestinian land. Mladenov's job title has grown so irrelevant in recent years that it merely delineates a reference to a bygone era: a "peace process" that has ensured the further destruction of whatever remained of the Palestinian homeland. Israeli politicians' approval of the bill is indeed an end of an era. We have reached the point where we can openly declare that the so-called peace process was an illusion from the start, for Israel had no intentions of ever conceding the occupied West Bank and East Jerusalem to the Palestinians. In response to the passing of the bill, many news reports alluded to the fact that the arrival of Donald Trump in the White House, riding a wave of right-wing populism, was the inspiration needed by equally right-wing Israeli politicians to cross that "very, very thick red line". There is truth to that, of course. But it is hardly the whole story.

  • The greatest mistake that the Palestinian leadership has committed (aside from its disgraceful disunity) was entrusting the US, Israel's main enabler, with managing a "peace process" that has allowed Israel time and resources to finish its colonial projects, while devastating Palestinian rights and political aspirations. Returning to the same old channels, using the same language, seeking salvation at the altar of the same old "two-state solution" will achieve nothing, but to waste further time and energy. It is Israel's obstinacy that is now leaving Palestinians (and Israelis) with one option, and only one option: equal citizenship in one single state or a horrific apartheid. No other "solution" suffices. In fact, the Regulation Bill is further proof that the Israeli government has already made its decision: consolidating apartheid in Palestine. If Trump and May find the logic of Netanyahu's apartheid acceptable, the rest of the world shouldn't. In the words of former President Jimmy Carter, "Israel will never find peace until it ... permit(s) the Palestinians to exercise their basic human and political rights." That Israeli "permission" is yet to arrive, leaving the international community with the moral responsibility to exact it.

    Not mentioned in the article: the Knesset's Regulation Bill formally annexed territory inside the West Bank and holds that Israeli law, rather than military law, will now govern the annexed portions. That is the fact that establishes a clean break with the 2-state solution and flies in the face of international law including the Fourth Geneva Convention, which strictly prohibits annexation and requires the immediate withdrawal of invading military forces from occupied territories immediately upon cessation of hostilities, which occurred in 1967. The two-state solution is dead, although the Regulation Bill will likely be overturned by the Israeli Supreme Court. Trump gave Israel's ultra-right wing leaders way too much encouragement.

  • A slip of the tongue from Prime Minister Benjamin Netanyahu last month is worthy of attention. In an unprepared response to a Likud Knesset member, Netanyahu said: “What I’m willing to give to the Palestinians is not exactly a state with full authority, but rather a state-minus, which is why the Palestinians don’t agree [to it].”
  • This almost never happens to Netanyahu. He is calculated, in contrast to Defense Minister Avigdor Liberman who once threatened to execute Hamas leader Ismail Haniyeh and destroy his movement. In his public appearances, Netanyahu’s statements are carefully worded. His mind operates mechanically, and it is for this reason that a slip of the tongue warrants attention. He has given away more than he intended to. Netanyahu’s words need to be tied back his stance during the negotiations with Palestinian President Mahmoud Abbas, as part of the 2013-4 peace talks initiated by then-Secretary of State John Kerry. Netanyahu’s position was that even following an agreement, Israel would retain security control over the entire area between the Jordan River and the Mediterranean Sea over the coming decades. The best case scenario for the Palestinians would have been a severely handicapped state. What would a less ideal scenario have looked like? In order to answer that question, we must also look at Netanyahu’s support for the Formalization Law and for settlement expansion, two processes he has pushed forward with since Donald Trump entered the White House. The significance of these processes, territorially-speaking, is the end of the “temporary” occupation and the effective annexation of around 60 percent of the West Bank.

  • This would be followed by a self-evident de jure annexation, which would seem almost natural. Palestinians would be left with what they currently have: enclaves that are barely connected to one another. Israel would govern them externally and enter them at will. As far as Netanyahu is concerned, if the Palestinians want to call this kind of autonomy a state, that’s their affair. This would also mark the definite end of the Oslo Accords; the Palestinian Authority would not be upgraded to a sovereign state on the entirety of the 1967 territories. Netanyahu is exploiting Abbas’ adaptability and passivity. Abbas pays no attention to the voices calling on him to shutter the Palestinian Authority and hand over the keys to Israel, who would then have to bear full responsibility for its policies. He persists in security cooperation with Israel on the grounds that they share the same enemies: Hamas and the Islamic State. Abbas and the PA also have an interest in keeping the benefits that they receive as part of a ruling class sponsored by Israel. The continued existence of a hobbled PA is also in Europe’s interests. European countries donate heavily in order to keep the PA in its current incarnation, on the premise that it is a stable factor in fighting radical Islam and prevents the Israeli-Palestinian conflict from engulfing the continent’s cities.
  • Yet Netanyahu is using Trump even more than he is using Abbas, hence the importance of their upcoming meeting in D.C. Trump’s position on Israel-Palestine remains unclear, and his limited attention prevents him from getting into the details. He is a man of simplistic principles that can be summarized in a formula — the opposite of Barack Obama and Kerry. Trump rejected UN Security Council Resolution 2334, which reaffirmed the international understanding of the borders of June 4, 1967 as the future border between Israel and a sovereign Palestinian state. Trump also condemned Obama’s decision not to use the U.S.’s veto. Trump also denounced Kerry’s final speech on the Middle East, in which he portrayed the Netanyahu government’s annexationist policy as racist. Israel believes that continuing to rule over the Palestinians when there are equal numbers in both demographic groups will allow it to remain a Jewish and democratic state. Kerry called this an illusion, saying that the result would be “separate but unequal.” He deliberately used the term for the racist regime of separation that formerly prevailed in the U.S. According to Kerry, such a regime is in opposition to America’s democratic principles, and as such, the U.S. could not support it. Trump’s executive orders and senior appointments, however, have shown that he has a different understanding of American democracy and the rights of minorities.

Netanyahu can try to nail down Trump’s agreement to a “state-minus” policy, and present it as a security necessity that will prevent the West Bank from falling into the hands of radical Islamists. In play are two sets of Israeli building plans aimed at completely sealing off the area that separates Palestinian Jerusalem and the rest of the West Bank: Givat HaMatos, which sits between Jerusalem and Bethlehem, and the larger expanse between Jerusalem and the settlement of Ma’ale Adumim, also known as the E1 area. The surprising hush that has fallen over the campaign for a law that would annex Ma’ale Adumim indicates that it will be on the agenda when Netanyahu and Trump sit down together. An agreement with Trump would allow Netanyahu to tackle the expected opposition from Western European countries to the plan for a state-minus. These countries’ guiding values will be far more similar to those of the Obama administration than the Trump administration. Meanwhile, Netanyahu was encouraged by the U.K.’s decision to activate Article 50 in order to leave the European Union, and its overtures to Trump as a replacement; he hurried to meet Prime Minister Theresa May, who had herself just returned from D.C. The Israeli government has also drawn encouragement from the various messages coming out of Europe that continued settlement-building endangers the two-state solution. That is, indeed, the aim. Up until Kerry’s speech, that had also been the automatic response of the Obama administration. From the moment Kerry declared that the settlements were creating a racist regime, Netanyahu perceived the danger of a new international agenda. Instead of the question of a Palestinian state, attention is now on the question of whether Israel is an apartheid state
