At issue is whether the IRS exceeded its authority under the Patient Protection and Affordable Care Act by issuing a final IRS rule that expanded the application of the Act's subsidies and mandates beyond the limits imposed by the statute. King v. Burwell is not a constitutional challenge. It challenges an IRS rule as being inconsistent with the Act it purports to implement. The case is a straightforward question of statutory interpretation. Here are seven things everyone needs to know about how the IRS developed the rule at issue in King v. Burwell. But first, a little background. If you're familiar with the case, you can skip to number one. Background Section 1311 of the Act directs states to establish health-insurance "Exchanges." Section 1321 directs the Secretary of Health and Human Services to establish Exchanges in states that "fail[]" to establish Exchanges. Confounding expectations, 38 states failed to establish Exchanges, in almost every case due to opposition to the Act. Section 1401 (creating I.R.C. § 36B) authorizes health-insurance subsidies (nominally, tax credits) "through an Exchange established by the State." The availability of those subsidies triggers tax penalties under the law's individual and employer mandates. In January 2014, the IRS began issuing those subsidies and imposing the resulting penalties through not only state-established Exchanges but also Exchanges established by the federal government as well (i.e., HealthCare.gov). In King v. Burwell, the plaintiffs allege that the IRS exceeded its powers under the Act by issuing a so-called final rule that purports to authorize subsidies in states with Exchanges established by the federal government. As if Obamacare weren't problematic enough, two federal courts have found that the IRS unlawfully expanded the health care law's individual and employer mandates, by imposing them on tens of millions of Americans whom Congress exempted. On Wednesday, the Supreme Court will hear King v. Burwell, a case challenging that illegal and ongoing attempt to expand Obamacare outside the legislative process. The victims of this illegal Obamacare expansion include Kevin Pace, a jazz musician and adjunct professor of music in Northern Virginia. Anticipating the Obamacare mandate that employers cover all workers who put in at least 30 hours a week, Pace's employer was forced to cut hours for part-time professors like him in order to avoid massive penalties. In 2013, The Washington Post reported that Pace was left with "an $8,000 pay cut." "Thousands of other workers in Virginia" also had their hours cut. Even though the Obama administration has delayed the employer mandate, many employers have left the cuts in place for when the rules are enforced. " King v. Burwell is about more than IRS rules; it could kill the employer mandate, too." This unlawful expansion of Obamacare's employer mandate is causing workers across the country to lose more income with every passing day. It forced Utah's Granite School District to cut hours for 1,200 part-timers. According to the state of Indiana, which filed a similar legal challenge, this IRS power grab pushed "many Indiana public school corporations (to) reduc(e) the working hours of instructional aides, substitute teachers, non-certified employees, cafeteria staff, bus drivers, coaches and leaders of extracurricular activities." Excellent piece of research by the godfather of politics.  He lists the Obama Executive Orders that effectively overturn the Constitution and suspend fully the Bill of Rights.  The framework is now in place, waiting for an incident to happen that will trigger the occasion for Obama to declare a national emergency.  At that point, the full force and reach of the executive orders kicks in, and this great experiment of individual liberty and freedom based on Constitutional rule of law and self governance comes to a sudden end.  It's wake up time America!!!!!!! excerpt: If one man is allowed to singlehandedly change the law for 800,000 people in a way that he never could have achieved through the constitutional legal process, and he remains unchallenged, we are no longer living in a constitutional republic. Ode to the NSA!  Hat tip to Marbux for this awesome digg.  Kipling wrote this at the outbreak of the Boer War.  Like the War on Terror, the circumstance and patriotic fervor of citizens demanding safety and security becomes occasion for the government to seize and stomp liberty. I give a lot of credibility to this article's author when it comes to matters involving the oil market. Remember when reading that the only thing propping up the U.S. dollar is the Saudi (later extended to all OPEC nations) insistence that they be paid for their oil and natural gas in U.S. dollars, which creates artificial demand for the dollar globally. If the Gulf Coast States begin accepting payment in rubles or yuan, it is curtains for the U.S. dollar in global markets.  

I needed some background regarding the founding documents and their position on individual property rights.  Google came back with this gem!   The basic argument i'm pursuing is that socialism is unconstitutional because it's based on the selective seizure and redistribution of wealth.  Meaning, not all citizens are equal before the law.  The complaints lodged against King George in the Declaration of Independence are very much about the colonist not having the same rights of Englishmen as those whom the King favors. excerpt: the purpose of the Declaration of Independence. "Not to find out new principles, or new arguments, never before thought of, not merely to say things which had never been said before; but to place before mankind the common sense of the subject . . . ."1 The "common sense of the subject" expressed in the Declaration of Independence was that a national civil government must be based upon the "Laws of Nature and of Nature's God." The laws of nature and of nature's God dictate that all men are equally endowed by their Creator with unalienable rights to "Life, Liberty and the pursuit of Happiness." In Jefferson's day, the common sense of the subject was that the pursuit of happiness included the unalienable right of the individual to acquire, possess, protect and dispose of property. Because the purpose of civil governments was to secure unalienable rights, violations of one's unalienable right of property were subject to civil sanction. Today, however, the common sense of the subject is quite the opposite. The modern idea is that civil government properly possesses all power over all subjects of property. Any rights that may exist are derived from the civil government. Any rights to property that a person has may be regulated, limited or revoked by the civil government in order to satisfy the "public interest." This lengthy article from Reuters deserves attention. The peace initiatives by Russia/Syria and by Iran are forcing realignment of foreign policies throughout the Mideast. The U.S. is no longer perceived as being on the side of only Sunni Muslim states. One of the most visible changes (after cancellation of the U.S. military strike on Syria) is a go-it-alone declaration by the House of Saud that parallels the stance taken by Israel's ruling right-wing coalition. Both Israel and the Saudis had very successfully isolated the U.S. from the non-Sunni Arab nations, fueling and deepening a religious divide within the Arab nations. It remains to be seen whether the declarations by the House of Saud and Bibi Netanyahu will translate into effective military action against Iran and Syria, although Saudi money and weapons will continue to flow into Syria for the foreseeable future. Both nations will continue attempts to undo the looming Iran-U.S. thaw in relations. Predictably, the Zionist/Neocon hawks in Congress are pushing legislation to put a big freeze back on the Iran-U.S. thaw in relations, including a bill to stiffen economic sanctions on Iran and authorize military strikes against Syria. But that legislation seems to be going nowhere; the mood of the U.S. population (and thus of those up for election next year) has shifted to profoundly anti-war, at least as applied to Syria and Iran. It would be ironic if Russia/Syria and Iran's peace initiatives actually resulted in a lasting U.S. shift away from the Zionist/Neocon strategy to destabilize all of Israel's neighboring states except Egypt, Lebanon, and Jordan (those three have already been destabilized and swept into Israel's influence). If so, Obama might yet leave a positive legacy.

Gold, Peace, and Prosperity is the title of Ron Paul's essay for a "modern" gold standard.  According to Paul, such a standard would end the relentless boom-bust cycle, and maintain the value of King Dollar.  However, King Dollar would have to be founded on a monetary standard that eschews government tampering. Paul begins his treatise by pointing out that "Congress alone is responsible for inflation, and Congress alone can stop it."  Which means that the old scapegoats - OPEC, greedy CEOs, labor unions - are not the real cause of inflation.  To support his contention, Paul relates a story told by Marco Polo in his travels through China.  As Paul states, "Abuse of paper money led to the expulsion of the Mongol dynasty from China." Bretton Woods - in 1944 - supposedly established a new gold exchange standard.  In Paul's opinion, Bretton Woods was "nothing more than an international Federal Reserve System."  And of course, it didn't do anything but cause more inflation.  Then on August 15, 1971, President Nixon "closed the 'gold window.'"  This was the beginning of "managed fiat currency." Paul states that since 1971, the price of gold has increased "more than twentyfold."  The trade deficit has increased by 1146%, and the Consumer Price Index has increased 79%.  Due to these imbalances, he concludes that the dollar is dead.    Rather than pronouncing the Last Rites over the dollar, followed by a mournful funeral and weeping and wailing, Paul views the death of the dollar as an opportunity.  "The time is ripe for the institution of a trustworthy monetary system."  And it's not all that difficult.  The way to stop inflation is to "stop inflating the money supply."  Paul then cites the three main reasons politicians, bankers, etc., desire inflation:  greed, power, and a way to pay the government's bills without raising taxes sky-high.  The answer - the only alternative - to inflation is
