  • President Obama has said the United States’ combat mission in Afghanistan is over, and that the 13-year-long war there has come to an end. Top lawyers in his administration have a different message: Not so fast. Obama stated unconditionally in his State of the Union address in January that “our combat mission in Afghanistan is over.” But in a recent speech to the annual meeting of the American Society of International Law, an often-used venue for Obama administration officials to make extensive remarks on national security policy, the Defense Department’s general counsel seemed to reinterpret the president’s earlier statements. The lawyer appeared to walk back his more emphatic pronouncements about the end of America’s longest war.
  • “Although our presence in [Afghanistan] has been reduced and our mission there is more limited, the fact is that active hostilities continue,” Stephen Preston, the Pentagon’s top lawyer, said in a speech April 10. And, he added, “There is no doubt that we remain in a state of armed conflict against the Taliban, al Qaeda, and associated forces as a matter of international law.” Preston’s observations were supported by facts:
  • Justice Department lawyers are likely being put in the awkward position of having to argue against the president’s own statements. On Friday, U.S. attorneys filed a motion opposing an argument by an accused Taliban member held at Guantanamo Bay, Mukhtar al Warafi, that he should be released because Obama has said the war in Afghanistan is over, erasing any legal grounds to continue holding him. The government's response is classified. But legal experts told The Daily Beast that to counter Warafi’s claims, U.S. lawyers will almost certainly have to argue that despite what Obama has said, there is still a state of armed conflict against the Taliban, meaning the U.S. may continue to hold Warafi.

While not commenting on Warafi’s case, Preston predicted that the conflict may outlast Obama’s time in office. “Active hostilities will continue in Afghanistan (and elsewhere) at least through 2015 and perhaps beyond,” he said. Warafi may have kicked off a trend. Lawyers working with other Guantanamo detainees told The Daily Beast that another man held on the island prison, Faiz Mohammed Ahmed Al Kandari, is also petitioning the government to release him, using the same argument as Warafi. The legal briefs in his case haven’t been made public and the government has yet to file its response.

And it just got much worse.A senior U.S. official has confirmed that foreign hackers compromised the intimate personal details of an untold number of government workers. Likely included in the hackers’ haul: information about workers’ sexual partners, drug and alcohol abuse, debts, gambling compulsions, marital troubles, and any criminal activity.Those details, which are now presumed to be in the hands of Chinese spies, are found in the so-called “adjudication information” that U.S. investigators compile on government employees and contractors who are applying for security clearances. The exposure suggests that the massive computer breach at the Office of Personnel Management is more significant and potentially damaging to national security than officials have previously said.
  • Three former U.S. intelligence officials told The Daily Beast that the adjudication information would effectively provide dossiers on current and former government employees, as well as contractors. It gives foreign intelligence agencies a roadmap for finding people with access to the government’s most highly classified secrets.Obama administration officials had previously acknowledged the breach of information that applicants voluntarily disclose on a routine questionnaire, called Standard Form 86, but the theft of the more detailed and wide-ranging adjudication information appears to have gone overlooked.

You can’t rebuild people.”Adjudicators are in a powerful position because in deciding whether to recommend granting a security clearance, they have access to the entire scope of an applicant’s file and are told to make a subjective analysis.“The adjudication process is the careful weighing of a number of variables known as the whole-person concept,” according to official guidelines. “Available, reliable information about the person, past and present, favorable and unfavorable, should be considered in reaching a determination.”
  • By design, adjudication is an invasive process, meant to unearth risk factors including drug and alcohol abuse, extramarital affairs, a history of violence, and other events that speak to a person’s “trustworthiness” and their susceptibility to blackmail or being recruited to spy for a foreign government.For instance, “compulsive gambling is a concern, as it may lead to financial crimes including espionage,” the guidelines say. Adjudicators are told to note “a pattern of compulsive, self-destructive, or high risk sexual behavior,” “relapse after diagnosis of alcohol abuse,” and “emotionally unstable, irresponsible, dysfunctional, violent, paranoid, or bizarre behavior,” among other warning signs in 13 categories. Some of the embarrassing personal details found in some adjudications have been made public. That’s what happens after an applicant who was denied a security clearance launched an appeal.
  • Armed with such intimate details of a person’s worst moments, foreign spies would have unprecedented advantage against their U.S. adversaries. And the news is especially bad for people who hold the highest levels of clearance, which require more rigorous background checks, noted Adams, the computer security expert. “The higher up you go in your sensitivity levels, the more data that’s in your adjudication file,” he said.

  • More than 50 intelligence analysts working out of the U.S. military's Central Command have formally complained that their reports on ISIS and al Qaeda’s branch in Syria were being inappropriately altered by senior officials, The Daily Beast has learned. The complaints spurred the Pentagon’s inspector general to open an investigation into the alleged manipulation of intelligence. The fact that so many people complained suggests there are deep-rooted, systemic problems in how the U.S. military command charged with the war against the self-proclaimed Islamic State assesses intelligence. “The cancer was within the senior level of the intelligence command,” one defense official said.
  • Two senior analysts at CENTCOM signed a written complaint sent to the Defense Department inspector general in July alleging that the reports, some of which were briefed to President Obama, portrayed the terror groups as weaker than the analysts believe they are. The reports were changed by CENTCOM higher-ups to adhere to the administration’s public line that the U.S. is winning the battle against ISIS and al Nusra, al Qaeda’s branch in Syria, the analysts claim.That complaint was supported by 50 other analysts, some of whom have complained about politicizing of intelligence reports for months. That’s according to 11 individuals who are knowledgeable about the details of the report and who spoke to The Daily Beast on condition of anonymity.

  • After months of deliberation, the Obama administration has made a long-awaited decision on the thorny issue of how to deal with encrypted communications: It will not — for now — call for legislation requiring companies to decode messages for law enforcement. Rather, the administration will continue trying to persuade companies that have moved to encrypt their customers’ data to create a way for the government to still peer into people’s data when needed for criminal or terrorism investigations. “The administration has decided not to seek a legislative remedy now, but it makes sense to continue the conversations with industry,” FBI Director James B. Comey said at a Senate hearing Thursday of the Homeland Security and Governmental Affairs Committee.
  • The decision, which essentially maintains the status quo, underscores the bind the administration is in — balancing competing pressures to help law enforcement and protect consumer privacy. The FBI says it is facing an increasing challenge posed by the encryption of communications of criminals, terrorists and spies. A growing number of companies have begun to offer encryption in which the only people who can read a message, for instance, are the person who sent it and the person who received it. Or, in the case of a device, only the device owner has access to the data. In such cases, the companies themselves lack “backdoors” or keys to decrypt the data for government investigators, even when served with search warrants or intercept orders.
  • The decision was made at a Cabinet meeting Oct. 1. “As the president has said, the United States will work to ensure that malicious actors can be held to account — without weakening our commitment to strong encryption,” National Security Council spokesman Mark Stroh said. “As part of those efforts, we are actively engaged with private companies to ensure they understand the public safety and national security risks that result from malicious actors’ use of their encrypted products and services.” But privacy advocates are concerned that the administration’s definition of strong encryption also could include a system in which a company holds a decryption key or can retrieve unencrypted communications from its servers for law enforcement. “The government should not erode the security of our devices or applications, pressure companies to keep and allow government access to our data, mandate implementation of vulnerabilities or backdoors into products, or have disproportionate access to the keys to private data,” said Savecrypto.org, a coalition of industry and privacy groups that has launched a campaign to petition the Obama administration.

The FBI and Justice Department have been talking with tech companies for months. On Thursday, Comey said the conversations have been “increasingly productive.” He added: “People have stripped out a lot of the venom.” He said the tech executives “are all people who care about the safety of America and also care about privacy and civil liberties.” Comey said the issue afflicts not just federal law enforcement but also state and local agencies investigating child kidnappings and car crashes — “cops and sheriffs . . . [who are] increasingly encountering devices they can’t open with a search warrant.”
  • One senior administration official said the administration thinks it’s making enough progress with companies that seeking legislation now is unnecessary. “We feel optimistic,” said the official, who spoke on the condition of anonymity to describe internal discussions. “We don’t think it’s a lost cause at this point.” Legislation, said Rep. Adam Schiff (D-Calif.), is not a realistic option given the current political climate. He said he made a recent trip to Silicon Valley to talk to Twitter, Facebook and Google. “They quite uniformly are opposed to any mandate or pressure — and more than that, they don’t want to be asked to come up with a solution,” Schiff said. Law enforcement officials know that legislation is a tough sell now. But, one senior official stressed, “it’s still going to be in the mix.” On the other side of the debate, technology, diplomatic and commerce agencies were pressing for an outright statement by Obama to disavow a legislative mandate on companies. But their position did not prevail.

Three other officials confirmed that the inquiry—which is not a formal investigation—is underway and that lawmakers have been talking to intelligence officials about whether their reports to Congress accurately predicted when the Russian air strikes would begin and that they would target rebel groups fighting the regime of Bashar al-Assad.
  • U.S. intelligence officials fired back that they had provided lawmakers with warnings about Russia’s intentions to begin military operations in Syria, including in the weeks before airstrikes began in late September. “Any suggestion that the intelligence community was surprised by Russia’s military support to the Assad regime is misleading,” a senior intelligence official told The Daily Beast. Members of Congress had access to intelligence reports on the movements of Russian aircraft into Syria as well as the buildup of ground troops and could read them anytime they chose, another official said.

The Defense Department is also investigating allegations that senior intelligence officials at the military’s Central Command manipulated intelligence reports to paint a rosy picture about the U.S.-led air campaign against the so-called Islamic State, widely known as ISIS, in Iraq and Syria.

Headed for the trash heap of history. We're not in the habit of giving advice here in The Daily Reckoning. Sure, we warned readers about the biggest threats to their finances in 30 years - the bubbles in tech stocks and then in housing. And sure, we urged them to buy what turned out to be the best investment they could have made - gold. And yes, we criticized governments for doing all the wrong things. But urging them to do the right things would be both futile and earnest. Futility doesn't bother us. But we can't stand earnestness. Left unchecked it leads right to world improvement…and thence to Hell. Still, in the spirit of civic betterment, today exceptionally, we offer a bit of advice to financial authorities all over the world. In a word: Default! When you have more debt than you can pay, it is always best to own up…default…hang your head…say you're sorry…promise not to do it again… …and go about your business. And do it as soon as possible. Whence cometh this august advice? From the pages of history - recent…and not so recent.

  • Nickolaus says repeatedly that she imported the data into Access, but through a process of "human error", she "forgot to save".  Then come the tears, repeatedly, throughout her presser. Here's the problem.  Microsoft Access (any version) doesn't ask you to save. When you enter data into a table, it automatically updates the underlying database.  If you close the database accidentally, the data you entered (or imported, in the case of Nickolaus) remains.  If you stop to take a phone call from your buddy the governor (for example), your data will still automatically save.
  • Bottom line: Nickolaus is clearly lying.  Not only did she insist on having her own private system based on some of the most unsecure, pedestrian computing technology available (Seriously?  Access and Excel controlling such an important part of our democracy?), but she apparently assumes that nobody else has ever used Microsoft Access.
  • On an almost daily basis, I recommend to my business users to avoid Microsoft Access, due to the almost complete lack of security and auditing within the tool.  It's good for keeping track of your grocery list, perhaps.  But not an election. It's difficult to imagine being any worse at stealing an election and lying about it.  Honestly.

It involves oil and gas control of the entire region and the weakening of Russia and Iran by Saudi Arabian flooding the world market with cheap oil. Details were concluded in the September meeting by US Secretary of State John Kerry and the Saudi King. The unintended consequence will be to push Russia even faster to turn east to China and Eurasia. One of the weirdest anomalies of the recent NATO bombing campaign, allegedly against the ISIS or IS or ISIL or Daash, depending on your preference, is the fact that with major war raging in the world’s richest oil region, the price of crude oil has been dropping, dramatically so. Since June when ISIS suddenly captured the oil-rich region of Iraq around Mosul and Kirkuk, the benchmark Brent price of crude oil dropped some 20% from $112 to about $88. World daily demand for oil has not dropped by 20% however. China oil demand has not fallen 20% nor has US domestic shale oil stock risen by 21%.
  • What has happened is that the long-time US ally inside OPEC, the kingdom of Saudi Arabia, has been flooding the market with deep discounted oil, triggering a price war within OPEC, with Iran following suit and panic selling short in oil futures markets. The Saudis are targeting sales to Asia for the discounts and in particular, its major Asian customer, China where it is reportedly offering its crude for a mere $50 to $60 a barrel rather than the earlier price of around $100. [1] That Saudi financial discounting operation in turn is by all appearance being coordinated with a US Treasury financial warfare operation, via its Office of Terrorism and Financial Intelligence, in cooperation with a handful of inside players on Wall Street who control oil derivatives trading. The result is a market panic that is gaining momentum daily. China is quite happy to buy the cheap oil, but her close allies, Russia and Iran, are being hit severely.
  • The US-Saudi oil price manipulation is aimed at destabilizing several strong opponents of US globalist policies. Targets include Iran and Syria, both allies of Russia in opposing a US sole Superpower. The principal target, however, is Putin’s Russia, the single greatest threat today to that Superpower hegemony. The strategy is similar to what the US did with Saudi Arabia in 1986 when they flooded the world with Saudi oil, collapsing the price to below $10 a barrel and destroying the economy of then-Soviet ally, Saddam Hussein in Iraq and, ultimately, of the Soviet economy, paving the way for the fall of the Soviet Union. Today, the hope is that a collapse of Russian oil revenues, combined with select pin-prick sanctions designed by the US Treasury’s Office of Terrorism and Financial Intelligence will dramatically weaken Putin’s enormous domestic support and create conditions for his ultimate overthrow. It is doomed to fail for many reasons, not the least, because Putin’s Russia has taken major strategic steps together with China and other nations to lessen its dependence on the West. In fact the oil weapon is accelerating recent Russian moves to focus its economic power on national interests and lessen dependence on the Dollar system. If the dollar ceases being the currency of world trade, especially oil trade, the US Treasury faces financial catastrophe. For this reason, I call the Kerry-Abdullah oil war a very stupid tactic.

As momentum against ISIS picks up, they may be emerging from the shadows. In a pitched battle on Monday, Kurdish Peshmerga, backed by American airpower and what appeared to be U.S. troops, struck at ISIS positions in the strategic crossroads of Zumar. Scenes from Monday’s battle provide a tentative but valuable glimpse into the evolving role of special operations troops and how that might be playing out on the ground in Iraq.
  • Stuck out in the open with no clear sense of what was occurring in the battle that required us to be stopped, we made contact with high-level Peshmerga ministries, both in Erbil and on the ground in Zumar. “Yes, we want to let you in, but we can’t,” said one high-level Kurdish government official. “We have visitors, you’ll see them,” he stated. As we tried to decipher his cryptic response our answer came: multiple armored Toyotas swept down the mountain, passing within feet of us. They didn’t wear any identifying insignia but they were visibly Western and appeared to match all the visual characteristics of American special operations soldiers.

Ranking members of the Kurdish military and intelligence service said that one team of U.S. Special Operations was on the ground in Zumar along with several German counterparts, working in conjunction with Peshmerga units. According to the Kurdish sources, U.S. and German special operations teams had taken up positions in Zumar that allowed them to coordinate with U.S. aircraft. If American troops were active in the fighting in Zumar, as they appeared to be on Monday, and as Kurdish officials stated, it would mark a significant break with U.S. official policy. Even as President Obama has avoided getting the military more involved in Iraq, the mission has gradually expanded. U.S. airstrikes began as a policy to break the siege on Yazidis and prevent ISIS from attacking Americans in Erbil but have grown to “support Iraqi security forces and Kurdish defense forces” in their fight against ISIS.

On Wednesday, Los Angeles City Councilman Mitchell Englander called on the Southern California Gas Co. to extend residential relocation assistance to residents in Granada Hills, Chatsworth and Northridge who live near the Aliso Canyon gas leak above Porter Ranch. These residents reported symptoms related to the exposure of natural gas such as nausea, vomiting, headaches and respiratory problems.
  • This latest development compounds with a new analysis from Home Energy Efficiency Team (HEET). The Cambridge-based nonprofit sent Boston University Professor Nathan Phillips and Bob Ackley of Gas Safety to take methane measurements around the San Fernando Valley for several days and their findings were disturbing. As the Los Angeles Daily News wrote, “the researchers recorded elevated levels of the main ingredient in natural gas—10 miles away from the nation’s largest gas leak.” “It’s not just in Porter Ranch, it’s going all the way across the [San Fernando] Valley,” Ackley told Inside Climate News. According to HEET, the researchers drove a high precision GIS-enabled natural gas analyzer down the roads around the gas leak to create a comprehensive map of the leak around San Fernando Valley. The red on the map indicates where they drove and the levels of methane they found is shown by the height of the peaks. Their monitors showed methane levels at 3.4 parts per billion, about twice the level of natural clean air, the Los Angeles Daily News reported. Another measurement showed 127 ppm, or an astounding 67 times above normal. “Whatever else may be in the gas—benzene, toluene, xylene—that is what people may be breathing,” Phillips told Inside Climate News. “Even though we’re not measuring things other than methane, there is a legitimate concern that there is that other nasty stuff in there.”

  • Government production regulations, controls, restrictions and prohibitions prevent entrepreneurs from using their knowledge, ability and capital in ways that most effectively produce the goods consumers actually want and at the most cost-competitive prices possible.
  • This is why countries around the world periodically experience booms and busts, inflations and recessions − not because of some inherent instabilities or "irrationalities" in financial markets, but because of monetary central planning through central banking that does not allow market-based financial intermediation to develop and work as it could and would in a real free-market setting.
  • But in the United States and especially in Europe, government "austerity" means merely temporarily reducing the rate of increase in government spending, slowing down the rate at which new debt is accumulating and significantly raising taxes in an attempt to close the deficit gap.
  • The fundamental problem is that over the decades, the size and scope of governments in the Western world have been growing far more than the rates at which their economies have been expanding, so that the "slice" of the national economic "pie" eaten by government has been growing larger and larger, even when the "pie" in absolute terms is bigger than it was, say, 30 or 40 years ago.
  • European governments, in general, take the view that "austerity" means squeezing the private sector more through taxes and other revenue sources to avoid any noticeable and significant cuts in what government does and spends.
  • So there is "austerity" for the private sector and a mad rush for financial "safety nets" for the government and those who live off the State.
  • In reality, of course, it is the burdens of government regulation, taxation and impediments to more flexible labor and related markets that have generated the high unemployment rates and the retarded recovery from the recession.
  • Instead, the "common market" ideal has been transformed into the goal of a European Union "Super-State" to which the individual countries and their citizens would be subservient and obedient.
  • Keynesian policies offer people and politicians what they want to hear. Claiming that any sluggish business or lost jobs are due to a lack of "aggregate demand," Keynes argued that full employment and profitable business could only be reestablished and maintained through "activist" government monetary and fiscal policy – print money and run budget deficits.
  • What Britain and Europe should have as its goal is the ideal of the classical liberal free traders of the 19th century – non-intervention by governments in people's lives, at home and abroad. That is, a de-politicization of society, so people may freely work, trade and travel as they peacefully wish, with government merely the protector of people's individual rights.
  • Take the benefits away and tell people they are free to come and work to support themselves and their families. Restore more flexibility and competitiveness to labor markets and reduce taxes and business regulations.
  • Then those who come to Britain's shores will be those wanting freedom and opportunity without being a burden upon others.
  • What was needed was a change in ideas from the statist mentality to one of individual freedom and unhampered free markets.
  • In an epoch of collectivist ideas, don't be surprised if governments regulate, control, intervene and redistribute wealth.
  • The tentacle of regulations, restrictions and politically-correct social controls are spreading out in every direction from Brussels and its European-wide manipulating and mismanaging bureaucracy.
  • In the name of assuring "national prosperity," politicians could spend money to buy the votes that get them elected and reelected to government offices.
  • And every special interest group could make the case that government-spending programs that benefitted them were all reasonable and necessary to assure a fully employed and growing economy.
  • Furthermore, the Keynesian rationale for government deficit spending enabled politicians to seem to be able to offer something for nothing.   • In my view, the idea of a "soft landing" is an illusion based on the idea held by central bankers, themselves, that they have the wisdom and ability to know how to "micro-manage" the all the changes and adjustments resulting from their own manipulations of the monetary aggregates. They do not have this wisdom and ability. So hold on for what is most likely to be another rocky road.
  • It was Mises's clear vision that once society has broken the relationship between value and payment, sooner or later people would not know the price of anything.
  • At this point, investment ceases and business becomes furtive and transactional.
  • People cannot plan for the future because they do not understand the reality of the present.

    Incredible.  A simple explanation that explains everything.  Rchard Ebeling's "Unified Theory of Everything" is something every American can understand.  If only they would take a break from "Dancing with the Stars" and pay attention to the future of their country and the world.  It's a future where either "individual freedom", as defined by our Constitution and Declaration of Independence, will win out; or, the forces of fascist socialism / marxism will continue to roll and rule.  Incredible read!!!!
