Investigators Said to Seek No Penalty for C.I.A.'s Computer Search - NYTimes.com - 0 views

  • A panel investigating the Central Intelligence Agency’s search of a computer network used by staff members of the Senate Intelligence Committee who were looking into the C.I.A.’s use of torture will recommend against punishing anyone involved in the episode, according to current and former government officials.The panel will make that recommendation after the five C.I.A. officials who were singled out by the agency’s inspector general this year for improperly ordering and carrying out the computer searches staunchly defended their actions, saying that they were lawful and in some cases done at the behest of John O. Brennan, the C.I.A. director.While effectively rejecting the most significant conclusions of the inspector general’s report, the panel, appointed by Mr. Brennan and composed of three C.I.A. officers and two members from outside the agency, is still expected to criticize agency missteps that contributed to the fight with Congress.

    Let's be clear. Feinstein properly raised the Separation of Powers issue but did not raise the even more clear violation of criminal law prohibiting unauthorized hacking into a computer system. The CIA is expressly prohited from engaging in domestic surveillance, so the criminal violation is exceedingly clear.

Bulk Collection Under Section 215 Has Ended… What's Next? | Just Security - 0 views

  • The first (and thus far only) roll-back of post-9/11 surveillance authorities was implemented over the weekend: The National Security Agency shuttered its program for collecting and holding the metadata of Americans’ phone calls under Section 215 of the Patriot Act. While bulk collection under Section 215 has ended, the government can obtain access to this information under the procedures specified in the USA Freedom Act. Indeed, some experts have argued that the Agency likely has access to more metadata because its earlier dragnet didn’t cover cell phones or Internet calling. In addition, the metadata of calls made by an individual in the United States to someone overseas and vice versa can still be collected in bulk — this takes place abroad under Executive Order 12333. No doubt the NSA wishes that this was the end of the surveillance reform story and the Paris attacks initially gave them an opening. John Brennan, the Director of the CIA, implied that the attacks were somehow related to “hand wringing” about spying and Sen. Tom Cotton (R-Ark.) introduced a bill to delay the shut down of the 215 program. Opponents of encryption were quick to say: “I told you so.”
  • But the facts that have emerged thus far tell a different story. It appears that much of the planning took place IRL (that’s “in real life” for those of you who don’t have teenagers). The attackers, several of whom were on law enforcement’s radar, communicated openly over the Internet. If France ever has a 9/11 Commission-type inquiry, it could well conclude that the Paris attacks were a failure of the intelligence agencies rather than a failure of intelligence authorities. Despite the passage of the USA Freedom Act, US surveillance authorities have remained largely intact. Section 702 of the FISA Amendments Act — which is the basis of programs like PRISM and the NSA’s Upstream collection of information from Internet cables — sunsets in the summer of 2017. While it’s difficult to predict the political environment that far out, meaningful reform of Section 702 faces significant obstacles. Unlike the Section 215 program, which was clearly aimed at Americans, Section 702 is supposedly targeted at foreigners and only picks up information about Americans “incidentally.” The NSA has refused to provide an estimate of how many Americans’ information it collects under Section 702, despite repeated requests from lawmakers and most recently a large cohort of advocates. The Section 215 program was held illegal by two federal courts (here and here), but civil attempts to challenge Section 702 have run into standing barriers. Finally, while two review panels concluded that the Section 215 program provided little counterterrorism benefit (here and here), they found that the Section 702 program had been useful.
  • There is, nonetheless, some pressure to narrow the reach of Section 702. The recent decision by the European Court of Justice in the safe harbor case suggests that data flows between Europe and the US may be restricted unless the PRISM program is modified to protect the information of Europeans (see here, here, and here for discussion of the decision and reform options). Pressure from Internet companies whose business is suffering — estimates run to the tune of $35 to 180 billion — as a result of disclosures about NSA spying may also nudge lawmakers towards reform. One of the courts currently considering criminal cases which rely on evidence derived from Section 702 surveillance may hold the program unconstitutional either on the basis of the Fourth Amendment or Article III for the reasons set out in this Brennan Center report. A federal district court in Colorado recently rejected such a challenge, although as explained in Steve’s post, the decision did not seriously explore the issues. Further litigation in the European courts too could have an impact on the debate.

  • The US intelligence community’s broadest surveillance authorities are enshrined in Executive Order 12333, which primarily covers the interception of electronic communications overseas. The Order authorizes the collection, retention, and dissemination of “foreign intelligence” information, which includes information “relating to the capabilities, intentions or activities of foreign powers, organizations or persons.” In other words, so long as they are operating outside the US, intelligence agencies are authorized to collect information about any foreign person — and, of course, any Americans with whom they communicate. The NSA has conceded that EO 12333 is the basis of most of its surveillance. While public information about these programs is limited, a few highlights give a sense of the breadth of EO 12333 operations: The NSA gathers information about every cell phone call made to, from, and within the Bahamas, Mexico, Kenya, the Philippines, and Afghanistan, and possibly other countries. A joint US-UK program tapped into the cables connecting internal Yahoo and Google networks to gather e-mail address books and contact lists from their customers. Another US-UK collaboration collected images from video chats among Yahoo users and possibly other webcam services. The NSA collects both the content and metadata of hundreds of millions of text messages from around the world. By tapping into the cables that connect global networks, the NSA has created a database of the location of hundreds of millions of mobile phones outside the US.
  • Given its scope, EO 12333 is clearly critical to those seeking serious surveillance reform. The path to reform is, however, less clear. There is no sunset provision that requires action by Congress and creates an opportunity for exposing privacy risks. Even in the unlikely event that Congress was inclined to intervene, it would have to address questions about the extent of its constitutional authority to regulate overseas surveillance. To the best of my knowledge, there is no litigation challenging EO 12333 and the government doesn’t give notice to criminal defendants when it uses evidence derived from surveillance under the order, so the likelihood of a court ruling is slim. The Privacy and Civil Liberties Oversight Board is currently reviewing two programs under EO 12333, but it is anticipated that much of its report will be classified (although it has promised a less detailed unclassified version as well). While the short-term outlook for additional surveillance reform is challenging, from a longer-term perspective, the distinctions that our law makes between Americans and non-Americans and between domestic and foreign collection cannot stand indefinitely. If the Fourth Amendment is to meaningfully protect Americans’ privacy, the courts and Congress must come to grips with this reality.

  • The first significant step of the new administration comes while Trump is not even in offices. Obama, selfishly concerned with his historic legacy, suddenly makes a 180 degree turn and starts to implement Trump polices. Lets consider the initial position: Asked about Aleppo in an October debate with Clinton, Trump said it was a humanitarian disaster but the city had "basically" fallen. Clinton, he said, was talking in favor of rebels without knowing who they were. The rebels fighting Assad in western Syria include nationalists fighting under the Free Syrian Army banner, some of them trained in a CIA-backed program, and jihadists such as the group formerly known as the al Qaeda-linked Nusra Front. The Obama administration, through the CIA led by Saudi asset John Brennan, fed weapons, training and billions of dollars to "moderate rebels". These then turned around (vid) and either gave the CIA gifts to al-Qaeda in Syria (aka Jabhat al Nusra) or joined it themselves. The scheme was no secret at all and Russia as well as Syria pointed this out several times. The Russian foreign Minister Lavrov negotiated with the U.S. Secretary of State Kerry who promised to separate the "moderate rebels" from al-Qaeda. But Kerry never delivered. Instead he falsely accuse Russia of committing atrocities that never happened. The CIA kept the upper hand within the Obama administration and continued its nefarious plans. That changed the day the president-elect Trump set foot into the White House. While Obama met Trump in the oval office, new policies, prepared beforehand, were launched. The policies were held back until after the election and would likely not have been revealed or implemented if Clinton had won.

He is a U.S. weapon industry promoter and the anti-Russia campaign, which helps to sell U.S. weapons to NATO allies in Europe, is largely of his doing. He saw al-Qaeda in Syria as a welcome proxy force against Russia. But Obama has now shut down that policy. We are not yet sure that this is for good but the above Washington Post account is not the only signal: The U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC) took action today to disrupt al-Nusrah Front’s military, recruitment, and financing operations. Specifically, OFAC designated four key al-Nusrah Front leaders – Abdallah Muhammad Bin-Sulayman al-Muhaysini, Jamal Husayn Zayniyah, Abdul Jashari, and Ashraf Ahmad Fari al-Allak – pursuant to Executive Order (E.O.) 13224, which targets terrorists and those providing support to terrorists or acts of terrorism. ... These designations were taken in coordination with the U.S. Department of State, which today named Jabhat Fath al Sham as an alias of al-Nusrah Front – al-Qa’ida’s affiliate in Syria. ... Abdallah Muhammad Bin-Sulayman al-Muhaysini was designated for acting for or on behalf of, and providing support and services to or in support of, al-Nusrah Front. This is a major change in U.S. policy. Nusra will from now on be on the run not only from Russian and Syrian attacks but also from the intelligence and military capabilities of the United States. The newly designated Al-Muhaysini, a Saudi cleric, is Nusra's chief ideologue in Syria. Some considered him the new Osama Bin-Laden.

  • Hadi Abdullah, friend of the designated al-Qaeda terrorist Muhaysini, just received the 2016 Press Freedom Price from the CIA/Soros financed "regime change" influence operation Reporters Without Borders. Might this mean that Hadi Abdullah is himself a CIA assets? He would not be the first such "journalist" in Syria. Obama, obviously as a direct consequence of the Trump election, now ordered the Pentagon to wage war on al-Qaeda in Syria just as the Russians do. This after five years of nearly unlimited U.S. support for al-Qaeda and its "moderate" Syrian affiliates. It is not yet know what new orders, if any, Obama gave to the CIA. Will the CIA follow these policies or will it (again) try to counter the Pentagon policies in Syria? It is unusual that the WaPo report above about this new direction includes no commenting voice from the CIA. Why is such missing? Russia and Syria will welcome the new Obama policies should they come to fruit on the ground. Hillary Clinton had planned and announced to widen the conflict in Syria and with Russia and Iran. Obama would surely not have acted against such policies if she had been elected. But with Trump winning and thereby a new policy on the horizon he now changed course to a direction that will provide "continuity" when Trump takes over. Not only is Trump kicking a black family out of its longtime limewashed home, he also ends U.S. government support for the disenfranchised Jihadis in Syria and elsewhere. This even months before taking office. He really is the menace we have all been warned about.

Although he wasn’t specific, Mr. Trump suggested a shift away from what he said was the current Obama administration policy of attempting to find moderate Syrian opposition groups to support in the civil war there. “I’ve had an opposite view of many people regarding Syria,” he said. He suggested a sharper focus on fighting Islamic State, or ISIS, in Syria, rather than on ousting Syrian President Bashar al-Assad. “My attitude was you’re fighting Syria, Syria is fighting ISIS, and you have to get rid of ISIS. Russia is now totally aligned with Syria, and now you have Iran, which is becoming powerful, because of us, is aligned with Syria. … Now we’re backing rebels against Syria, and we have no idea who these people are.” If the U.S. attacks Mr. Assad, Mr. Trump said, “we end up fighting Russia, fighting Syria.”

  • MEMORANDUM FOR: The President FROM: Veteran Intelligence Professionals for Sanity (VIPS) SUBJECT: Is Syria a Trap? Precedence: IMMEDIATE We regret to inform you that some of our former co-workers are telling us, categorically, that contrary to the claims of your administration, the most reliable intelligence shows that Bashar al-Assad was NOT responsible for the chemical incident that killed and injured Syrian civilians on August 21, and that British intelligence officials also know this. In writing this brief report, we choose to assume that you have not been fully informed because your advisers decided to afford you the opportunity for what is commonly known as “plausible denial.” We have been down this road before – with President George W. Bush, to whom we addressed our first VIPS memorandumimmediately after Colin Powell’s Feb. 5, 2003 U.N. speech, in which he peddled fraudulent “intelligence” to support attacking Iraq. Then, also, we chose to give President Bush the benefit of the doubt, thinking he was being misled – or, at the least, very poorly advised.
  • The fraudulent nature of Powell’s speech was a no-brainer. And so, that very afternoon we strongly urged your predecessor to “widen the discussion beyond …  the circle of those advisers clearly bent on a war for which we see no compelling reason and from which we believe the unintended consequences are likely to be catastrophic.” We offer you the same advice today. Our sources confirm that a chemical incident of some sort did cause fatalities and injuries on August 21 in a suburb of Damascus. They insist, however, that the incident was not the result of an attack by the Syrian Army using military-grade chemical weapons from its arsenal. That is the most salient fact, according to CIA officers working on the Syria issue. They tell us that CIA Director John Brennan is perpetrating a pre-Iraq-War-type fraud on members of Congress, the media, the public – and perhaps even you. We have observed John Brennan closely over recent years and, sadly, we find what our former colleagues are now telling us easy to believe. Sadder still, this goes in spades for those of us who have worked with him personally; we give him zero credence. And that goes, as well, for his titular boss, Director of National Intelligence James Clapper, who has admitted he gave “clearly erroneous” sworn testimony to Congress denying NSA eavesdropping on Americans.
  • That Secretary of State John Kerry would invoke Clapper’s name this week in Congressional testimony, in an apparent attempt to enhance the credibility of the four-page “Government Assessment” strikes us as odd. The more so, since it was, for some unexplained reason, not Clapper but the White House that released the “assessment.” This is not a fine point. We know how these things are done. Although the “Government Assessment” is being sold to the media as an “intelligence summary,” it is a political, not an intelligence document. The drafters, massagers, and fixers avoided presenting essential detail. Moreover, they conceded upfront that, though they pinned “high confidence” on the assessment, it still fell “short of confirmation.”

  • There is a growing body of evidence from numerous sources in the Middle East — mostly affiliated with the Syrian opposition and its supporters — providing a strong circumstantial case that the August 21 chemical incident was a pre-planned provocation by the Syrian opposition and its Saudi and Turkish supporters. The aim is reported to have been to create the kind of incident that would bring the United States into the war. According to some reports, canisters containing chemical agent were brought into a suburb of Damascus, where they were then opened. Some people in the immediate vicinity died; others were injured. We are unaware of any reliable evidence that a Syrian military rocket capable of carrying a chemical agent was fired into the area. In fact, we are aware of no reliable physical evidence to support the claim that this was a result of a strike by a Syrian military unit with expertise in chemical weapons. In addition, we have learned that on August 13-14, 2013, Western-sponsored opposition forces in Turkey started advance preparations for a major, irregular military surge. Initial meetings between senior opposition military commanders and Qatari, Turkish and U.S. intelligence officials took place at the converted Turkish military garrison in Antakya, Hatay Province, now used as the command center and headquarters of the Free Syrian Army (FSA) and their foreign sponsors.
  • Senior opposition commanders who came from Istanbul pre-briefed the regional commanders on an imminent escalation in the fighting due to “a war-changing development,” which, in turn, would lead to a U.S.-led bombing of Syria. At operations coordinating meetings at Antakya, attended by senior Turkish, Qatari and U.S. intelligence officials as well as senior commanders of the Syrian opposition, the Syrians were told that the bombing would start in a few days. Opposition leaders were ordered to prepare their forces quickly to exploit the U.S. bombing, march into Damascus, and remove the Bashar al-Assad government The Qatari and Turkish intelligence officials assured the Syrian regional commanders that they would be provided with plenty of weapons for the coming offensive. And they were. A weapons distribution operation unprecedented in scope began in all opposition camps on August 21-23. The weapons were distributed from storehouses controlled by Qatari and Turkish intelligence under the tight supervision of U.S. intelligence officers.
  • We hope your advisers have warned you that retaliation for attacks on Syrian are not a matter of IF, but rather WHERE and WHEN. Retaliation is inevitable. For example, terrorist strikes on U.S. embassies and other installations are likely to make what happened to the U.S. “Mission” in Benghazi on Sept. 11, 2012, look like a minor dust-up by comparison. One of us addressed this key consideration directly a week ago in an article titled “Possible Consequences of a U.S. Military Attack on Syria – Remembering the U.S. Marine Barracks Destruction in Beirut, 1983.”

    This report by Veteran Intelligence Professionals for Sanity is almost certainly the most credible report contradicting the White House's "intelligence summary" that included zero evidence supporting the claim that Syrian government forces had unleashed the August 21, 2013 chemical attack in Ghoutu, near Damascus and less than five miles away from the just-arrived UN investigative team.  Spread it far and wide.

  • The CIA Inspector General’s Office has asked the Justice Department to investigate allegations of malfeasance at the spy agency in connection with a yet-to-be released Senate Intelligence Committee report into the CIA’s secret detention and interrogation program, McClatchy has learned.The criminal referral may be related to what several knowledgeable people said was CIA monitoring of computers used by Senate aides to prepare the study. The monitoring may have violated an agreement between the committee and the agency. The development marks an unprecedented breakdown in relations between the CIA and its congressional overseers amid an extraordinary closed-door battle over the 6,300-page report on the agency’s use of waterboarding and harsh interrogation techniques on suspected terrorists held in secret overseas prisons. The report is said to be a searing indictment of the program. The CIA has disputed some of the reports findings.

Seems to me that’s a yes or no answer.”Brennan replied that he’d have to get back to Wyden after looking into “what the act actually calls for and it’s applicability to CIA’s authorities.”

Caroline Krass, a top justice department lawyer, sparked the ire of several Senate intelligence committee members by claiming that crucial legal opinions about intelligence matters were beyond the scope of the committee. Asked directly and repeatedly if the Senate panel was entitled to the memos, which several senators claimed were crucial for performing their oversight functions, Krass replied: "I do not think so, as a general matter." The exception is the committee's prolonged fight with the CIA over a 6,300-page report on the agency's torture of terrorism detainees in its custody since 9/11. The committee has prepared its report for years; the former chairman, Jay Rockefeller of West Virginia, said the classified version contains 50,000 footnotes. For a year, the panel has sought to release a public version that multiple members of the panel say documents both the brutality of CIA torture and what they have called "lies" told by the CIA to the oversight committees in Congress and the rest of the executive branch concerning its torture practices. CIA director John Brennan, who was a senior CIA official during the years scrutinised by the committee, is resisting release of the report. The CIA has told reporters that the report contains numerous factual errors, which Senator Mark Udall, a Colorado Democrat on the panel, said on Tuesday was a "misleading" and self-serving description of differences of "interpretation" between the agency and the committee. "I'm more confident than ever in the factual accuracy" of the torture report, Udall said.
  • The panel said at the hearing that the CIA is stalling on the provision of documents to the committee that will help it complete its work. Krass, a former White House official who worked alongside Brennan there, did not assure the committee she would help provide them. Krass said the general counsel of the CIA had a "duty and obligation to make sure the committee understands the legal basis" for CIA activities. She worried that disclosure of the legal memos themselves would inhibit the executive branch from candidly discussing policy proposals for fear of embarrassing public disclosure. Several senators found Krass's statement insufficient. Carl Levin, a Michigan Democrat who has investigated torture while serving on the Armed Services Committee as well, asked if the committee was "entitled" to the opinions as a matter of oversight. Krass said her "caveated answer" was, "I do not think so, as a general matter." It is unclear if the committee will reject Krass's nomination. But the two-hour exchange highlighted the difficulties the intelligence committees can face in getting basic factual information from the intelligence agencies they are tasked with overseeing.

The fight between the CIA and the Senate Intelligence Committee over the Committee’s Torture Report – which Dan Froomkin covered here – has now zeroed in on the White House. Did the White House order the CIA to withdraw 920 documents from a server made available to Committee staffers, as Senator Dianne Feinstein says the agency claimed in 2010? Were those documents – perhaps thousands of them – pulled in deference to a White House claim of executive privilege, as Senator Mark Udall and then CIA General Counsel Stephen Preston suggested last fall? And is the White House continuing to withhold 9,000 pages of documents without invoking privilege, as McClatchy reported yesterday? We can be sure about one thing: The Obama White House has covered up the Bush presidency’s role in the torture program for years. Specifically, from 2009 to 2012, the administration went to extraordinary lengths to keep a single short phrase, describing President Bush’s authorization of the torture program, secret.
  • As Steven Aftergood, director of the Federation of American Scientists Project on Government Secrecy, noted  in 2009 – shortly after Hayden revealed that torture started as a covert operation – this means there should be a paper trail implicating President Bush in the torture program. “[T]here should be a Presidential ‘finding’ authorizing the program,” he said, “and [] such a finding should have been provided to Congressional overseers.” The National Security Act dictates that every covert operation must be supported by a written declaration finding that the action is necessary and important to the national security. The Congressional Intelligence committees – or at least the Chair and Ranking Member – should receive notice of the finding. But there is evidence that those Congressional overseers were never told that the finding the president signed on September 17, 2001 authorized torture. For example, a letter from then ranking member of the House Intelligence Committee, Jane Harman, to the CIA’s General Counsel following her first briefing on torture asked: “Have enhanced techniques been authorized and approved by the President?” The CIA’s response at the time was simply that “policy as well as legal matters have been addressed within the Executive Branch.”
  • Nevertheless, the finding does exist. The CIA even disclosed its existence in response to the ACLU FOIA, describing it as “a 14-page memorandum dated 17 September 2001 from President Bush to the Director of the CIA pertaining to the CIA’s authorization to detain terrorists.” In an order in the ACLU suit, Judge Alvin K. Hellerstein confirmed that the declaration was “intertwined with” the administration’s effort to keep the language in the Tenet document hidden. When the administration succeeded in keeping that short phrase secret, all effort to release the declaration also ended.

  • The White House’s fight to keep the short phrase describing Bush’s authorization of the torture program hidden speaks to its apparent ambivalence over the torture program. Even after President Obama released the DOJ memos authorizing torture – along with a damning CIA Inspector General Report and a wide range of documents revealing bureaucratic discussions within the CIA about torture – the White House still fought the release of the phrase that would have made it clear that the CIA conducted this torture at the order of the president. And it did so with a classified declaration from Jones that would have remained secret had Judge Hellerstein not insisted it be made public. As Aftergood noted, such White House intervention in a FOIA suit is rare. “The number of times that a national security advisor has filed a declaration in a FOIA lawsuit is vanishingly small,” he said. “It almost never happens.” But as ACLU Deputy Legal Director Jameel Jaffer noted of the finding, “It was the original authority for the CIA’s secret prisons and for the agency’s rendition and torture program, and apparently it was the authority for the targeted killing program as well.  It was the urtext.  It’s remarkable that after all this time it’s still secret.”
  • Enduring confusion about this particular finding surely exists because of its flexible nature. As Bob Woodward described in Bush at War, CIA Director Tenet asked President Bush to sign “a broad intelligence order permitting the CIA to conduct covert operations without having to come back for formal approval for each specific operation.” As Jane Mayer described in The Dark Side, such an order not only gave the CIA flexibility, it also protected the President. “To give the President deniability, and to keep him from getting his hands dirty, the finding called for the President to delegate blanket authority to Tenet to decide on a case-by-case basis whom to kill, whom to kidnap, whom to detain and interrogate, and how.” When George Tenet signed written guidelines for the CIA’s torture program in 2003, however, he appeared to have deliberately deprived the President of that deniability by including the source of CIA’s authorization – presumably naming the President – in a document interrogators would see. You can’t blame the CIA Director, after all; Tenet signed the Guidelines just as CIA’s Inspector General and DOJ started to review the legality of the torture tactics used against detainees like Abd al-Rahim al-Nashiri, who was threatened with a drill and a gun in violation of DOJ’s ban on mock executions.
  • President Obama’s willingness to go to such lengths to hide this short phrase may explain the White House’s curious treatment of potentially privileged documents with the Senate now – describing President Bush’s authorization of the torture program and its seemingly contradictory stance supporting publishing the Torture Report while thwarting its completion by withholding privileged documents. After all, the documents in question, like the reference to the presidential finding, may deprive the President of plausible deniability. Furthermore, those documents may undermine one of the conclusions of the Torture Report. According to Senator Ron Wyden, the Senate Torture Report found that “the CIA repeatedly provided inaccurate information about its interrogation program to the White House.” Perhaps the documents reportedly withheld by the White House undermine this conclusion, and instead show that the CIA operated with the full consent and knowledge of at least some people within the White House. Finally, the White House’s sensitivity about documents involved in the torture program may stem from the structure of the finding. As John Rizzo made clear, the finding authorizes not just torturing, but killing, senior al Qaeda figures. Bob Woodward even reported that that CIA would carry out that killing using Predator drones, a program CIA still conducts. And in fact, when the Second Circuit ultimately ruled to let the White House to keep the authorization phrase secret, it did so because the phrase also relates to “a highly classified, active intelligence activity” and “pertains to intelligence activities unrelated to the discontinued [torture] program.” Given what we know about the September 17, 2001 finding, that may well refer to President Obama’s still active drone program.

By releasing the DOJ memos and other materials, the White House provided what seemed to be unprecedented transparency about what the CIA had done.   • The release of the White House “Government Assessment” on August 30, providing the purported evidence to support a bombing attack on Syria, defused a conflict with the intelligence community that had threatened to become public through the mass resignation of a significant number of analysts. The intelligence community’s consensus view on the status of the Syrian chemical-weapons program was derived from a National Intelligence Estimate (NIE) completed late last year and hurriedly updated this past summer to reflect the suspected use of chemical weapons against rebels and civilians. The report maintained that there were some indications that the regime was using chemicals, while conceding that there was no conclusive proof. There was considerable dissent from even that equivocation, including by many analysts who felt that the evidence for a Syrian government role was subject to interpretation and possibly even fabricated. Some believed the complete absence of U.S. satellite intelligence on the extensive preparations that the government would have needed to make in order to mix its binary chemical system and deliver it on target was particularly disturbing. These concerns were reinforced by subsequent UN reports suggesting that the rebels might have access to their own chemical weapons. The White House, meanwhile, considered the somewhat ambiguous conclusion of the NIE to be unsatisfactory, resulting in considerable pushback against the senior analysts who had authored the report.
  • In a scenario unfortunately reminiscent of the lead up to Iraq, the National Security Council tasked the various intelligence agencies to beat the bushes and come up with more corroborative information. Israel obligingly provided what was reported to be interceptions of telephone conversations implicating the Syrian army in the attack, but it was widely believed that the information might have been fabricated by Tel Aviv, meaning that bad intelligence was being used to confirm other suspect information, a phenomenon known to analysts as “circular reporting.” Other intelligence cited in passing by the White House on the trajectories and telemetry of rockets that may have been used in the attack was also somewhat conjectural and involved weapons that were not, in fact, in the Syrian arsenal, suggesting that they were actually fired by the rebels. Also, traces of Sarin were not found in most of the areas being investigated, nor on one of the two rockets identified. Whether the victims of the attack suffered symptoms of Sarin was also disputed, and no autopsies were performed to confirm the presence of the chemical. 
  • With all evidence considered, the intelligence community found itself with numerous skeptics in the ranks, leading to sharp exchanges with the Director of Central Intelligence John Brennan and Director of National Intelligence James Clapper. A number of analysts threatened to resign as a group if their strong dissent was not noted in any report released to the public, forcing both Brennan and Clapper to back down. On Syria, he added: “I can see a time in the future where Syria is fractured into two or three parts.” That is not the U.S. goal, he said, but it’s looking increasingly likely.

  • No, the most interesting part of the latest Torture Report details almost falls off the end of the page over at The Huffington Post. It's more hints of CIA spying, ones that go a bit further than previously covered. According to sources familiar with the CIA inspector general report that details the alleged abuses by agency officials, CIA agents impersonated Senate staffers in order to gain access to Senate communications and drafts of the Intelligence Committee investigation. These sources requested anonymity because the details of the agency's inspector general report remain classified. "If people knew the details of what they actually did to hack into the Senate computers to go search for the torture document, jaws would drop. It's straight out of a movie," said one Senate source familiar with the document. Impersonating staff to gain access to Senate Torture Report work material would be straight-up espionage. Before we get to the response that mitigates the severity of this allegation, let's look at what we do know.
  • The CIA accessed the Senate's private network to (presumably) gain access to works-in-progress. This was denied (badly) by CIA director John Brennan. The CIA also claimed Senate staffers had improperly accessed classified documents and reported them to the DOJ, even though they knew the charges were false. Then, after Brennan told his agency to stop spying on the Senate, agents took it upon themselves to improperly access Senate email accounts. This is all gleaned from a few public statements and a one-page summary of an Inspector General's report -- the same unreleased report EPIC is currently suing the agency over. Now, there's this: accusations that the CIA impersonated Senate staffers in hopes of accessing Torture Report documents. Certainly a believable accusation, considering the tactics it's deployed in the very recent past. This is being denied -- or, at least, talked around.
  • A person familiar with the events surrounding the dispute between the CIA and Intelligence Committee said the suggestion that the agency posed as staff to access drafts of the study is untrue. “CIA simply attempted to determine if its side of the firewall could have been accessed through the Google search tool. CIA did not use administrator access to examine [Intelligence Committee] work product,” the source said. So, it was a just an innocuous firewall test. And according to this explanation, it wasn't done to examine the Senate's in-progress Torture Report. But this narrative meshes with previous accusations, including those detailed in the Inspector General's report. Logging on to the shared drives with Senate credentials would allow agents to check the firewall for holes. But it also would allow them to see other Senate documents, presumably only accessible from that "side" of the firewall. While there's been no mention of "impersonation" up to this point, the first violation highlighted by the IG's report seems to be the most likely explanation of what happened here.

A supposed firewall test would be the perfect cover for sniffing around previously off-limits areas. Much of what has come to light about the agency's actions hints at low-level espionage. There's still more buried in the IG report that the agency is actively trying to keep from being made public. Just because these activities didn't specifically "target" Senate work material, it was all there and able to accessed. It doesn't really matter what the CIA says it was looking for. The fact that it was done at all, and done with such carefree audacity, is the problem. There are presumably ways to perform these checks that don't involve Inspector Generals, damning reports and multiple hacking accusations.

US President Barack Obama, before deploying his golf holidays in Martha’s Vineyard, casually dropped that bombing the Caliph’s goons in Iraq will take months. One may interpret it as another layer of the Obama administration’s self-avowed “Don't Do Stupid Stuff” foreign policy doctrine, not so subtly mocked by prospective presidential candidate Hillary Clinton. Shock and Awe in 2003 destroyed the whole of Baghdad’s infrastructure in only a few hours. Obama also confirmed the US was showering Iraq again with humanitarian bombing “to protect American interests” (first and foremost) and, as an afterthought, “human rights in Iraq.” One could not possibly expect Obama to declare the US would now bomb “our” allies the House of Saud, who have supported/financed/weaponized IS, in Syria and Iraq. The same erstwhile ISIS that thoroughly enjoyed the marvels of US military training in a secret base in Jordan.

Obama is absolutely terrified of another Benghazi – which Republicans have been trying non-stop to blame on his administration’s incompetence. The last thing Obama needs is the Caliph’s goons killing ‘diplomats’ in Erbil. That would certainly raise a tsunami of questions all over again about the shady CIA weapon-smuggling racket – as in arming Syrian ‘rebels’ with weapons from Libya - at the time Benghazi took place. As secretary of state, Hillary Clinton, of course, also knew about it all. But then, and especially now, no one should know that the CIA was weaponizing the bulk of the future Caliph’s forces.

Haider al-Abadi was chosen by new President Fuad Masoum, a Kurd, as the new prime minister – hours after Maliki positioned Special Forces in strategic sites in and around the Green Zone and may (or may not) have tried to stage a coup. Maliki maintains that Masoum violated the Iraqi constitution by not selecting him to form a new cabinet; after all, his State of Law bloc got the most votes in last April’s parliamentary elections.
  • Obama, predictably, was delighted. But whatever happens next, Maliki won’t go down quietly – to say the least. Even as the predominant narrative among Sunnis, a substantial number of Kurds and even some Shiite political blocs is that Maliki antagonized Sunnis all-out; and that’s what drove them to support the Caliph en masse (although now many are having second thoughts.) As for the KRG and Barzani, in the Obama administration scheme of things, what matters is that they should not declare independence. As long as Barzani promises to Obama that Kurdistan stays inside Iraq, the KRG will get more bombs and drones and the ‘humanitarian’ operation will speed up. US Special Forces are already deployed all over the huge area where the Caliphate borders the KRG, in so-called desert forward operating positions. And the US for all practical purposes is now the Iraqi Air Force against the Caliph. Watch ‘the Hillarator’ This Obama administration warped R2P – protection for Americans first, refugees second – will accomplish nothing for a key reason; no bombing – ‘humanitarian’ or otherwise - exterminates a political/religious movement, even one as demented as IS. The Caliphate prospers, somewhat, and expands, because unlike that pathetic Free Syrian Army (FSA) it’s winning territory, desert and urban, in both Syria and Iraq; an area bigger than Great Britain already, holding at least 6 million people.
  • As for the much-peddled Washington myth of ‘good’ and ‘bad’ jihadists, the Caliphate also exploded it. The US lost the war in Iraq, miserably, only nine days after the fall of Baghdad, in April 2003. No ‘humanitarian’ bombing will turn it into a victory. And no ‘humanitarian’ bombing will finish the Caliphate off. As for prospective presidential candidate Hillary Clinton, she’s taking no prisoners. She insists the US should have bombed Syria in the first place; then there would be no Caliphate. But now she worries the Caliph will attack Europe and even the US (“I’m thinking a lot about containment, deterrence and defeat”). Predictably positioning herself, Clinton could not but totally dismiss Obama’s foreign policy doctrine, a.k.a. ‘Don’t do stupid stuff’: “‘Don’t do stupid stuff’ is not an organizing principle.” So the world will have to wait until 2017, when she’s finally able to implement her own doctrine/organizing principle: “We came, we saw, he died.”

Obama also confirmed the US was showering Iraq again with humanitarian bombing “to protect American interests” (first and foremost) and, as an afterthought, “human rights in Iraq.”

Many of us were in the Oval Office that day, proud to stand behind you as you signaled an end to the misguided policies of the post-9/11 period. As retired generals and admirals, we have worked since that day to build a stronger, more durable consensus against torture in our country so that, at a future moment when our nation is tested, the American people will reject calls to resort to such abuses. We welcomed your public support for declassification of the Senate Select Intelligence Committee’s study on the CIA’s rendition, detention, and interrogation program. We believe that the American people must understand fully what the program entailed, how it came to be, and what was gained—and lost— because of it. We write to you today because we believe your strong record against torture is being undermined by members of your own administration. In part because there has been so little transparency about the torture program, some former government officials continue to claim that so-called “enhanced” interrogation techniques were necessary to disrupt terrorist plots and save lives. Now one of the key proponents of this false narrative that “torture works,” the former CIA director George Tenet, is reportedly coordinating with the current leadership of the CIA to discredit the Senate intelligence committee’s report. CIA Director John Brennan recently told the Wall Street Journal that he plans to "take issue” with parts of the report that he “believe[s] are inaccurate or misleading."
  • It is understandable that current and former employees of the CIA feel protective of the agency’s reputation and embarrassed by what the Senate study contains. The U.S. military’s examination of torture in its ranks after the Abu Ghraib scandal was painful; it was also necessary to the health of the institution. The stakes are too high to allow the intelligence community to circle the wagons and launch a concerted campaign to undermine the report’s credibility. Ultimately, an American public that understands the high costs of torture is the best guarantee against a future president rescinding your executive order and treating torture as a viable policy option. There is no substitute for leadership from the top on an issue like this. You have set the direction for your administration that torture is unacceptable. But for that leadership to have a lasting impact on the direction of our country, beyond your administration, you must act to ensure that Americans learn the right lessons from our past. We urge you to make clear in no uncertain terms that you expect CIA Director John Brennan to support an expansive declassification of the report and an honest reckoning with its findings.

Hacker claims to have breached CIA director's personal email - 0 views

  • An anonymous hacker claims to have breached CIA Director John Brennan's personal email account and has posted documents online, including a list of email addresses purportedly from Brennan's contact file. The CIA said it referred the matter to the proper authorities, but would not comment further. The hacker spoke to the New York Post, which described him in an article published Sunday as "a stoner high school student," motivated by his opposition to U.S. foreign policy and support for Palestinians. His Twitter account, @phphax, includes links to files that he says are Brennan's contact list, a log of phone calls by then-CIA deputy director Avril Haines, and other documents.
  • The hacker also claimed to have breached a Comcast account belonging to Homeland Security Secretary Jeh Johnson, and released what appeared to be personal information. One document purporting to come from Brennan's AOL email account contains a spreadsheet of people, including senior intelligence officials, along with their Social Security numbers, although the hacker redacted the numbers in the version he posted on Twitter. It's unclear why Brennan would have stored such a document in his private email account. Based on the titles, the document appears to date from 2009 or before. When people visit the White House and other secure facilities, they are required to supply their Social Security numbers. Brennan could have been forwarding a list of invitees to the White House when he was President Barack Obama's counter terrorism adviser, the job he held before he became CIA director in 2013.
  • The hacker told the Post he had obtained a 47-page version of Brennan's application for a security clearance, known as an SF86. That document — millions of which were stolen from the federal personnel office last year by hackers linked to China — contains detailed information about past jobs, foreign contacts, finances and other sensitive personal details. No such document appears to be posted on the hacker's Twitter account, but it's not clear whether the hacker posted it elsewhere.

  • Wednesday’s criminal referral by 11 House Republicans of former Secretary of State Hillary Clinton as well as several former and serving top FBI and Department of Justice (DOJ) officials is a giant step toward a Constitutional crisis. Named in the referral to the DOJ for possible violations of federal law are: Clinton, former FBI Director James Comey; former Attorney General Loretta Lynch; former Acting FBI Director Andrew McCabe; FBI Agent Peter Strzok; FBI Counsel Lisa Page; and those DOJ and FBI personnel “connected to” work on the “Steele Dossier,” including former Acting Attorney General Sally Yates and former Acting Deputy Attorney General Dana Boente. With no attention from corporate media, the referral was sent to Attorney General Jeff Sessions, FBI Director Christopher Wray, and U.S. Attorney for the District of Utah John Huber.  Sessions appointed Huber months ago to assist DOJ Inspector General (IG) Michael Horowitz.

The 11 House members chose to include the following egalitarian observation in the first paragraph of the letter conveying the criminal referral: “Because we believe that those in positions of high authority should be treated the same as every other American, we want to be sure that the potential violations of law outlined below are vetted appropriately.” If this uncommon attitude is allowed to prevail at DOJ, it would, in effect, revoke the de facto “David Petraeus exemption” for the be-riboned, be-medaled, and well-heeled.

  • The dangerous brinkmanship pitting Israel against the alliance of Iran, Syria and Hezbollah has brought the region closer to war than at any time since the end of the July-August 2006 conflict. A combination of bellicose rhetoric, aggressive acts, warnings and threats set against the backdrop of Syria’s grueling civil war and its critical implications for the Middle East has revived the era of miscalculation after nearly seven years of calm and restraint, with potentially disastrous consequences, diplomats and observers say. In the past two weeks, Israel has confirmed its unprecedented policy of airstrikes against suspected Hezbollah arms caches in Syria with two more attacks in swift succession after the inaugural bombing in January. Syria has warned of an “automatic response” should Israel stage a fourth strike.
  • Israel upped the stakes by using Thursday’s edition of the New York Times to deliver a clear warning to Syrian President Bashar Assad that he would “risk forfeiting his regime” if he fulfilled the vow of retaliation to any further airstrikes. Another option is to attempt to shoot down an Israeli jet in Lebanese airspace. All three Israeli airstrikes against sites west of Damascus were conducted from the Lebanese side of the border using long-range standoff missiles. The Israeli Air Force used a similar technique in October 2003 when it attacked the Ain es-Saheb training camp for the Popular Front for the Liberation of Palestine-General Command which was located 20 kilometers east of the Lebanese border and in the same general area as the more recent strikes.
