In May 2008, Josh Fox received a letter from a natural gas company offering to lease his family's land in Milanville, Pennsylvania for $100,000 to drill for gas.[1]Following the lease offer, he looked for information about natural gas drilling in the Marcellus Shale under large parts of Pennsylvania, New York, Ohio and West Virginia. He visited Dimock, Pennsylvania where natural gas drilling was already taking place. In Dimock, he met families able to light their tap water on fire as well as suffering from numerous health issues and fearing their well water had been contaminated.Fox then set out to see how communities are being affected in the west where a natural gas drilling boom has been underway for the last decade. He spent time with citizens in their homes and on their land as they relayed their stories of natural gas drilling in Colorado, Wyoming, Utah and Texas, among others. He spoke with residents who have experienced a variety of chronic health problems as well as contamination of their air, water wells or surface water. Section 17 of the Bill of Rights provides for rights to conduct peaceful and unarmed activities such as assembly, demonstrations, pickets and petitions. Political protest also involves imparting related information, and this right is guaranteed by the section regarding freedom of expression (Section 16 of the Bill of Rights). Although the right to political protest is protected by the Constitution, this right may be limited by principle. September 13, 2011 - Many regulations that were originally scorned by politicians and industry as signaling the death of product lines, companies, and jobs - including those requiring more efficient light bulbs and banning chemicals that damage the ozone layer - in fact stimulated healthy innovations that have protected American lives and saved billions of dollars without harming industry, according to a report by Public Citizen. "Regulation: An Unsung Hero in American Innovation," describes five regulations that were originally excoriated but have resulted in innovations that improved public safety, helped the environment and led to better products. The report comes as public protections are under attack from the U.S. Chamber of Commerce and big business allies in Congress, who focus on the cost of rules while ignoring their public safety benefits and their potential to spur innovations.

Social Security didn't create the deficit, but America's seniors are being presented with a fake Social Security crisis to try to trick them into accepting reduced benefits. Social Security will be able to pay 100% of its benefits through 2037 without any changes whatsoever. So, why the panic today? If seniors accept cuts to Social Security benefits today, a surplus cash flow will build in the Social Security trust fund. According to the Congressional Research Service, "Social Security's cash surpluses are borrowed by the U.S. Treasury and can be used for tax cuts, spending or repaying debt." Social Security benefit cuts are increasing taxes paid to Social Security or extending retirement age will give more money for tax cuts spending or repaying the debt. Except for one thing: Social Security money belongs to those who have paid into the fund, it's not the government's money to use it; it shouldn't be the government's money to play with. Senior citizens should not have to accept a reduced standard of living to finance tax cuts for the rich. We must take a stand for senior citizens and protect Social Security and protect future generations from this raid on Social Security's funds.

I'm genuinely excited today to announce the release of my new book, With Liberty and Justice for Some: How the Law is Used to Destroy Equality and Protect the Powerful. The book focuses on what I began realizing several years ago is the crucial theme tying together most of the topics I write about: America's two-tiered justice system - specifically, the way political and financial elites are now vested with virtually absolute immunity from the rule of law even when they are caught committing egregious crimes, while ordinary Americans are subjected to the world's largest and one of its harshest and most merciless penal states even for trivial offenses. As a result, law has been completely perverted from what it was intended to be - the guarantor of an equal playing field which would legitimize outcome inequalities - into its precise antithesis: a weapon used by the most powerful to protect their ill-gotten gains, strengthen their unearned prerogatives, and ensure ever-expanding opportunity inequality. The original text of the talk is below: Imagine for a moment that somewhere in the middle of Texas there was a large foreign military base, say Chinese or Russian. Imagine that thousands of armed foreign troops were constantly patrolling American streets in military vehicles. Imagine they were here under the auspices of "keeping us safe" or "promoting democracy" or "protecting their strategic interests." Imagine that they operated outside of US law, and that the Constitution did not apply to them. Imagine that every now and then they made mistakes or acted on bad information and accidentally killed or terrorized innocent Americans, including women and children, most of the time with little to no repercussions or consequences. The candidate supported by progressives - President Obama - himself holds heinous views on a slew of critical issues and himself has done heinous things with the power he has been vested. He has slaughtered civilians - Muslim children by the dozens - not once or twice, but continuously in numerous nations with drones, cluster bombs and other forms of attack. He has sought to overturn a global ban on cluster bombs. He has institutionalized the power of Presidents - in secret and with no checks - to target American citizens for assassination-by-CIA, far from any battlefield. He has waged an unprecedented war against whistleblowers, the protection of which was once a liberal shibboleth. He rendered permanently irrelevant the War Powers Resolution, a crown jewel in the list of post-Vietnam liberal accomplishments, and thus enshrined the power of Presidents to wage war even in the face of a Congressional vote against it. His obsession with secrecy is so extreme that it has become darkly laughable in its manifestations, and he even worked to amend the Freedom of Information Act (another crown jewel of liberal legislative successes) when compliance became inconvenient.

President Obama, he says, "seems to be playing a sly double game-protecting banks from sharing the pain while proclaiming sympathy for embattled homeowners." Greider adds, "The government, in effect, has been sheltering banks from facing the hard truth about their condition." Banks may be valuing mortgages or mortgage bonds at 85 cents on the dollar when their true market value is closer to 30 cents. "That strengthens the case for a general and orderly write-down now: if many of these loans aren't ever going to be rapid, then the assets now claimed by the banks are imaginary."

The Great Recession could have spawned another era of fundamental reform, just as the Great Depression did. But the financial rescue reduced immediate demands for broader reform. Obama might still have succeeded had he framed the challenge accurately. Yet in reassuring the public that the economy would return to normal, he missed a key opportunity to expose the longer-term scourge of widening inequality and its dangers. Containing the immediate financial crisis and then claiming the economy was on the mend left the public with a diffuse set of economic problems that seemed unrelated and inexplicable, as if a town's fire chief dealt with a conflagration by protecting the biggest office buildings but leaving smaller fires simmering all over town: housing foreclosures, job losses, lower earnings, less economic security, soaring pay on Wall Street and in executive suites.

Power does not rest with the electorate. It does not reside with either of the two major political parties. It is not represented by the press. It is not arbitrated by a judiciary that protects us from predators. Power rests with corporations. And corporations gain very lucrative profits from war, even wars we have no chance of winning. All polite appeals to the formal systems of power will not end the wars in Iraq and Afghanistan. We must physically obstruct the war machine or accept a role as its accomplice.

More and more, we hear that nothing can be done to tax major corporations because of the threat of how they would respond. Likewise, we cannot stop their price gouging or even the government subsidies and tax loopholes they enjoy. For example, as the oil majors reap stunning profits from high oil and gas prices, we are told it is impossible to tax their windfall profits or stop the billions they get in government subsidies and tax loopholes. There appears to be no way for the government to secure lower energy prices or seriously impose and enforce environmental protection laws. Likewise, despite high and fast rising drug and medicine prices, we are told that it is impossible to raise taxes on pharmaceutical companies or have the government secure lower pharmaceutical prices. And so on.

Even if areas dedicated to conserving plants, animals, and other species that provide Earth's life support system increased tenfold, it would not be enough without dealing with the big issues of the 21st century: population, overconsumption and inefficient resource use.

It's tax time. It's also a time when right-wing Republicans are setting the agenda for massive spending cuts that will hurt most Americans. Here's the truth: The only way America can reduce the long-term budget deficit, maintain vital services, protect Social Security and Medicare, invest more in education and infrastructure, and not raise taxes on the working middle class is by raising taxes on the super rich.

The most important moral and intellectual voices within a disintegrating society are slowly discredited when their nonviolent protests and calls for justice cannot alter intransigent and corrupt systems of power. The repeated acts of peaceful civil disobedience, efforts at electoral and political reform and the fight to protect the rule of law are dismissed as useless by an embittered, dispossessed and betrayed public. The demagogues and hatemongers, the purveyors of violence, easily seduce enraged and bewildered masses in the final stages of collapse with false promises of vengeance, new glory and moral renewal. And in the spiral downward the good among us are reviled as naive and ineffectual fools.

United States v. Dougherty was a 1972 decision by the United States Court of Appeals for the District of Columbia in which the court ruled that members of the D.C. Nine, who had broken into Dow Chemical Company, vandalized office furniture and equipment, and spilled about a bloodlike substance, were not entitled to a new trial on the basis of the judge's failing to allow a jury nullification jury instruction. The Appeals Court ruled, by a 2-1 vote: " The fact that there is widespread existence of the jury's prerogative, and approval of its existence as a "necessary counter to casehardened judges and arbitrary prosecutors," does not establish as an imperative that the jury must be informed by the judge of that power. On the contrary, it is pragmatically useful to structure instructions in such wise that the jury must feel strongly about the values involved in the case, so strongly that it must itself identify the case as establishing a call of high conscience, and must independently initiate and undertake an act in contravention of the established instructions. This requirement of independent jury conception confines the happening of the lawless jury to the occasional instance that does not violate, and viewed as an exception may even enhance, the over-all normative effect of the rule of law. An explicit instruction to a jury conveys an implied approval that runs the risk of degrading the legal structure requisite for true freedom, for an ordered liberty that protects against anarchy as well as tyranny. We are at a pivotal moment in American history, and many Americans watching the deficit talks in Washington are confused, perplexed, angry and frustrated. This country, which has paid its debts from Day 1, must pay its debts. Anyone who says it is not a big deal for this country to default clearly does not understand what he or she is talking about. This is a nation whose faith and credit has been the gold standard of countries throughout the world. Some people simply say we're not going to pay our debt, that there's nothing to really worry about. Those are people who are wishing our economy harm for political reasons, and those are people whose attitudes will have terrible consequences for virtually every working family in this country in terms of higher interest rates, in terms of significant job loss, in terms of making a very unstable global economy even more unstable. Our right-wing friends in the House of Representatives have given us an option. What they have said is end Medicare as we know it and force elderly people, many of whom don't have the money, to pay substantially more for their health care. So when you're 70 under their plan and you get sick and you don't have a whole lot of income, we don't know what happens to you. They forget to tell us that if their plan was passed you're going to have to pay a heck of a lot more for the prescription drugs you're getting today. They we're going to throw millions of kids off health insurance. If your mom or dad is in a nursing home and that nursing home bill is paid significantly by Medicaid and Medicaid isn't paying anymore, they forgot to tell us what happens to your mom or dad in that nursing home. What happens? And what happens today if you are unemployed and you're not able to get unemployment extension? What happens if you are a middle-class family desperately trying to send their kids to college and you make savage cuts to Pell grants and you can't go to college? The laws of war are essential for citizens and legislators to master if humanity is to evolve beyond our violent history of war to enjoy civil communities. To bring these basic laws to life, we'll touch on war's history, explain the letter of US war laws, explain the philosophy/spirit of US war laws, and make the obvious conclusion once the laws are clearly understood that current US wars in Afghanistan and Iraq are unlawful orders that our military must refuse and stop as demanded in their oath to the protect and defend the US Constitution.
