Section 17 of the Bill of Rights provides for rights to conduct peaceful and unarmed activities such as assembly, demonstrations, pickets and petitions. Political protest also involves imparting related information, and this right is guaranteed by the section regarding freedom of expression (Section 16 of the Bill of Rights). Although the right to political protest is protected by the Constitution, this right may be limited by principle. Activists must remember that none of the fundamental rights and freedoms guaranteed by the Bill of Rights are absolute. The Constitution gives government the power to limit these rights. Section 36 of the Bill, however, says the limitation of fundamental rights or freedoms must be reasonable and justifiable in an open and democratic society based on human dignity, equality and freedom. The Following Abstracts from the Bill of Rights Might Apply To Any On-Line Protest Section 15: Freedom of religion, belief and opinion Everyone has the right to believe or think what they want, even if their opinion is different to the government. Everyone has the right to practise the religion they choose. Government institutions, like schools, can follow religious practices (like having prayers in the morning) but this must be done fairly and people cannot be forced to attend them. A person can also get married under the laws of their religion. But these cannot go against the Bill of Rights. For example, a woman who marries according to customary law does not lose her rights of equality when she gets married. Section 16: Freedom of speech and expression Everyone has the right to say what they want, including the press and other media. More and more, we hear that nothing can be done to tax major corporations because of the threat of how they would respond. Likewise, we cannot stop their price gouging or even the government subsidies and tax loopholes they enjoy. For example, as the oil majors reap stunning profits from high oil and gas prices, we are told it is impossible to tax their windfall profits or stop the billions they get in government subsidies and tax loopholes. There appears to be no way for the government to secure lower energy prices or seriously impose and enforce environmental protection laws. Likewise, despite high and fast rising drug and medicine prices, we are told that it is impossible to raise taxes on pharmaceutical companies or have the government secure lower pharmaceutical prices. And so on.

If there were any doubt that the 90s are back in style, witness the Obama administration's attempt to reignite the Crypto Wars by seeking legislation that would force Internet services to redesign their networks and products to provide a centralized mechanism for decrypting user communications. It cannot be stressed enough what a radical-and terrible-idea this is.

Peak Oil is the point at which petroleum production reaches its greatest rate just before going into perpetual decline. In "Peak Oil and a Changing Climate," a new video series from The Nation and On The Earth productions, radio host Thom Hartmann explains that the world will reach peak oil within the next year if it hasn't already. As a nation, the United States reached peak oil in 1974, after which it became a net oil importer. Bill McKibben, Noam Chomsky, Nicole Foss, Richard Heinberg and the other scientists, researchers and writers interviewed throughout "Peak Oil and a Changing Climate" describe the diminishing returns our world can expect as it deals with the consequences of peak oil even as it continues to pretend it doesn't exist. These experts predict substantially increased transportation costs, decreased industrial production, unemployment, hunger and social chaos as the supplies of the  fuels on which we rely dwindle and eventually disappear. Chomsky urges us to anticipate the official response to peak oil based on how corporations, news organizations and other institutions have responded to global warming: obfuscation, spin and denial. James Howard Kunstler says that we cannot survive peak oil unless we "come up with a consensus about reality that is consistent with the way things really are." Drought could parch close to 70 percent of the planet's soil by 2025 unless countries implement policies to slow desertification, a senior United Nations official has warned. "If we cannot find a solution to this problem... in 2025, close to 70 percent could be affected," Luc Gnacadja, executive secretary of the United Nations Convention to Combat Desertification, said Friday. Drought currently affects at least 41 percent of the planet and environmental degradation has caused it to spike by 15 to 25 percent since 1990, according to a global climate report. "There will not be global security without food security" in dry regions, Gnacadja said at the start of the ninth UN conference on the convention in the Argentine capital. "A green deal is necessary" for developing countries working to combat drought, he stressed. The next meeting on the convention is scheduled to take place in South Korea in 2010.

I've written before about the crisis of inequality in the United States and about the quasi-religious abhorrence of "wealth redistribution" that causes many Americans to oppose tax increases, even on the ultra rich. The conviction that taxation is intrinsically evil has achieved a sadomasochistic fervor in conservative circles-producing the Tea Party, their Republican zombies, and increasingly terrifying failures of governance. Happily, not all billionaires are content to hoard their money in silence. Earlier this week, Warren Buffett published an op-ed in the New York Times in which he criticized our current approach to raising revenue. As he has lamented many times before, he is taxed at a lower rate than his secretary is. Many conservatives pretend not to find this embarrassing. Conservatives view taxation as a species of theft-and to raise taxes, on anyone for any reason, is simply to steal more. Conservatives also believe that people become rich by creating value for others. Once rich, they cannot help but create more value by investing their wealth and spawning new jobs in the process. We should not punish our best and brightest for their success, and stealing their money is a form of punishment. Of course, this is just an economic cartoon. We don't have perfectly efficient markets, and many wealthy people don't create much in the way of value for others. In fact, as our recent financial crisis has shown, it is possible for a few people to become extraordinarily rich by wrecking the global economy. Nevertheless, the basic argument often holds: Many people have amassed fortunes because they (or their parent's, parent's, parents) created value. Steve Jobs resurrected Apple Computer and has since produced one gorgeous product after another. It isn't an accident that millions of us are happy to give him our money. But even in the ideal case, where obvious value has been created, how much wealth can one person be allowed to keep? A trillion doll

Occupy Portland is a nonviolent movement for accountability in the United States government. At 12PM on October 6th, 2011 we will assemble at Tom McCall Waterfront Park, 1020 Southwest Naito Parkway in Portland, OR. We will gather in solidarity with the ongoing protest in New York City, Occupy Wall Street, and the growing number of cities whose people will no longer sit back watching corporate and special interests run their government. We are citizens of the United States, and this country is ours. We will take it back. It is no longer enough to vote and to participate in the political system because our political system has been altered drastically from its intended and proper function. Currently, we are allowed to pick from a few candidates whose campaigns are funded more and more by large organizations, corporations, and special interests. The success of their campaigns depends entirely on how the corporate mass media presents them. When our elected officials enter office they then pander to the small groups responsible for their election. Even good men and women cannot make real improvements that benefit the American people. We are one city in a growing national movement of people who no longer feel that their government works in their best interest. We will assemble on October 6th to demonstrate peaceful, substantive democracy and work for real change. Our government is divided. We, the people, are united.

The most important moral and intellectual voices within a disintegrating society are slowly discredited when their nonviolent protests and calls for justice cannot alter intransigent and corrupt systems of power. The repeated acts of peaceful civil disobedience, efforts at electoral and political reform and the fight to protect the rule of law are dismissed as useless by an embittered, dispossessed and betrayed public. The demagogues and hatemongers, the purveyors of violence, easily seduce enraged and bewildered masses in the final stages of collapse with false promises of vengeance, new glory and moral renewal. And in the spiral downward the good among us are reviled as naive and ineffectual fools.
