If you tire in reading, please consider that at trillions of dollars of annual public benefits, you literally have nothing more valuable to do than understand the following facts and ideas. Harvard's Linda Bilmes co-authored a paper with Nobel Prize winner Joseph Stiglitz estimating the long-term costs of current US wars at now $3 to $5 trillion ($30-$50,000 per US household of $50,000/year income), with total debt increase since 2001 of over $10 trillion. Remember, as demonstrated by the evidence disclosed by our own government, all the reasons Americans were told to go to war were known to be lies as they were told and applicable law proves these wars Orwellian unlawful. Just down the Charles River from Harvard, MIT's Simon Johnson (and former Chief Economist of the International Monetary Fund) describes our economy being lead by gambling oligarchs who have captured government as in banana republics (his words), and might plunge the US into an economy worse than the Great Depression. We're falling into a double-dip recession. The Labor Department reports this morning that the private sector added a measly 41,000 net new jobs in May. (The vast bulk of new jobs in May were temporary government Census workers.) But at least 100,000 new jobs are needed every month just to keep up with population growth. In other words, the labor market continues to deteriorate. The average length of unemployment continues to rise - now up to 34.4 weeks (up from 33 weeks in April). That's another record. More Americans are too discouraged to look for a job than last year at this time (1.1 million in May, an increase of 291,000 from a year earlier.)

It is unsurprising that the 9/11 attack fostered a massive expansion of America's already sprawling Surveillance State. But what is surprising, or at least far less understandable, is that this growth shows no signs of abating even as we approach almost a full decade of emotional and temporal distance from that event. The spate of knee-jerk legislative expansions in the immediate aftermath of the 9/11 trauma - the USA-PATRIOT Act - has actually been exceeded by the expansions of the last several years - first secretly and lawlessly by the Bush administration, and then legislatively and out in the open once Democrats took over control of the Congress in 2006. Simply put, there is no surveillance power too intrusive or unaccountable for our political class provided the word "terrorism" is invoked to "justify" those powers.

Stack was upset that §1706 did precisely what it was designed to do: Deprive him of the chance to exploit independent contractor status to avoid paying taxes through non-filing or through the understatement of income, overstatement of deductions, and avoidance of income tax withholding. In spite of the overwhelming advantages attendant to employee status, Joe Stack desperately wanted to be treated as an independent contractor for one simple reason: It would have made his tax protesting easier.4 Footnotes: ¹ We have met many taxpayers who worked as independent contractors for years without so much as a peep of protest until they realized, ex post facto, that it might have better for them to have been treated as employees. In our experience, workers tend to be content with their independent contractor status until one of the following happens: They get fired or quit They get hurt on the job They get sued for something they did while on the job They need a bank loan (and employment verification) ² If Stack had been an independent contractor and was subsequently “fired” by his principal, my hunch is it would have taken him less time to file a claim for unemployment compensation than it takes Apolo Ohno to finish short track. ³ Indeed, §1706 was included in TRA ‘86 because the CBO had estimated that the government was losing up to 30% of taxes because independent contractors were either not reporting all of their income on their tax returns or were claiming fraudulent or questionable deductions against that income. 4 Like all tax protestors, Stack knew that once the IRS had collected his taxes through payroll withholding it would never give it back to him based on previously refuted tax protestor arguments. Consequently, his only chance of avoiding taxes was to control his own tax payments and then use his frivolous arguments to evade or at least defer paying taxes.

Enacted in 1978, §530 is a safe harbor law that lists several conditions which if met allows workers to be treated as independent contractors rather than employees.\n\n Joe Stack was compelled to burn his house down, murder his wife and children and fly his airplane into the side of a federal building because 24 years ago Congress passed and President Reagan signed into law the Tax Reform Act of 1986 that added sub-section (d) to §530 thereby excluding engineers and computer programmers from the safe harbor provisions of §530 .\n\nThe passage of this law (§1706 of the Tax Reform Act of 1986) did not as some have suggested make all engineers and computer programmers employees, it merely made them subject to the 20 factor common law test historically used for determination of a worker's status. In other words, had Joe Stack been truly independent from the company or companies to whom he provided services, he could have, should have and would have been treated as an independent contractor rather than an employee.

Go read this Glenn Greenwald post and this followup from Nick Baumann about Gulet Mohamed, an American citizen who was recently arrested in Kuwait, brutally tortured (I think it's OK to use the word since it's someone else's police we're talking about), and then put on a no-fly list so he can't return to America. This is not the first time this has happened, and if you're really worried about an increasingly tyrannical government, this is the kind of thing to worry about. If a crime has been committed, then let him come home and charge him. If not, then he's an American citizen, and no American government should be allowed to unilaterally strand its own citizens overseas. This whole affair is revolting.

On January 26, 2011, Defense Department spokesman Geoff Morrell stood before the Pentagon press corps and made a series of patently false statements about Bradley Manning (the video is here). Even taking into account the position Morrell occupies -- in which a penchant for telling the truth is not exactly a job requirement (it actually would be disqualifying) -- this Press Conference was an extraordinary display of pure official mendacity. Morrell was asked several times about the evidence -- first reported here -- that Manning was being held in repressive and inhumane conditions: specifically, 23-hour/day solitary confinement, a prohibition on exercising in his cell, and being allowed out only 1 hour per day to "exercise" which entails walking around alone in a room, shackled. Morrell repeatedly insisted that everything being done to Manning was being done to all of the other detainees at the brig; in his words:

While this regulatory capture continued, how many of us filled up our homes with these toxic products? Via Think Progress: Large manufacturers and chemical producers have lobbied ferociously to stop the National Institutes of Health from classifying formaldehyde as a carcinogen. A wide body of research has linked the chemical to cancer, but industrial polluters have stymied regulators from action. Last year, the New Yorker's Jane Mayer reported that billionaire David Koch, whose company Georgia Pacific (a subsidiary of Koch Industries) is one of the country's top producers of formaldehyde, was appointed to the NIH cancer board at a time when the NIH delayed action on the chemical. The news was met with protests from environmental groups. Faced with mounting pressure from Greenpeace and the scientific community, Koch offered an early resignation from the board in October. Yesterday, the NIH finally handed down a report officially classifying formaldehyde as a carcinogen: Government scientists listed formaldehyde as a carcinogen, and said it is found in worrisome quantities in plywood, particle board, mortuaries and hair salons. They also said that styrene, which is used in boats, bathtubs and in disposable foam plastic cups and plates, may cause cancer but is generally found in such low levels in consumer products that risks are low. Frequent and intense exposures in manufacturing plants are far more worrisome than the intermittent contact that most consumers have, but government scientists said that consumers should still avoid contact with formaldehyde and styrene along with six other chemicals that were added Friday to the government's official Report on Carcinogens. That Terrorism means nothing more than violence committed by Muslims whom the West dislikes has been proven repeatedly. When an airplane was flown into an IRS building in Austin, Texas, it was immediately proclaimed to be Terrorism, until it was revealed that the attacker was a white, non-Muslim, American anti-tax advocate with a series of domestic political grievances. The U.S. and its allies can, by definition, never commit Terrorism even when it is beyond question that the purpose of their violence is to terrorize civilian populations into submission. Conversely, Muslims who attack purely military targets -- even if the target is an invading army in their own countries -- are, by definition, Terrorists. That is why, as NYU's Remi Brulin has extensively documented, Terrorism is the most meaningless, and therefore the most manipulated, word in the English language. Washington is in the grip of a fever. It's hard to find a word other than lunacy to describe what's going on. We are veering toward potential economic catastrophe. And Congress is hung up on a debate that shouldn't be occurring. It is debating an imaginary problem that conjures scary future scenarios but ignores dire existing circumstances. The consensus proffered solution to the imaginary problem would damage our country and further weaken our economy. Democrats and Republicans are at loggerheads, but they are disagreeing primarily about how much harm they want to impose. That's a very consequential disagreement, but it ignores the fact that we don't need to impose any harm at all.
