"Steve Green reports that one of the website operators accused of copyright infringement by Righthaven has retaliated, hitting the Las Vegas company with a class-action counterclaim, charging that defendants in all 57 Righthaven cases in Colorado 'are victims of extortion litigation by Righthaven, which has made such extortion litigation a part of its, if not its entire, business model.' The counterclaim says Righthaven has victimized defendants by failing to send takedown notices prior to suing, by threatening to take their website domain names when that's not provided for under the federal Copyright Act, by falsely claiming it owns the copyrights at issue and by failing to investigate jurisdictional and fair use issues before suing, among other things. The claim seeks an adjudication that Righthaven's copyright infringement lawsuits amount to unfair and deceptive trade practices under Colorado law, an injunction permanently enjoining Righthaven from continuing the alleged unfair and deceptive trade practices, an unspecified financial award to the class-action plaintiffs for damages as well as their costs and attorney's fees."

Gartner has just released its Worldwide Mobile Terminal Sales to End Users report for 1Q11, and results confirm the expectations: Android keeps growing and is with no doubt the number one platform, while Nokia is still the strongest manufacturer even though at its minimum level since 1997. The other great winner is the Taiwanese HTC, which sells almost triple amount of handsets thanks especially to its Android smartphones.

Nokia keeps loosing share but keeps first position, with Samsung holding number two with a slight loss in percentage but growth in sales. LG loses ground too and is now pushed by Apple and RIM. ZTE keeps growing, and just behind it HTC passes two of the bigger names from the past that are today relegated to bottom positions: Motorola and Sony Ericsson. Huawei closes the top ten thanks to its low-price devices. Can we expect HTC to pass ZTE and maybe even RIM before the next report? With amazing superphones such as the Sensation and the Thunderbolt that’s very possible! “Smartphones accounted for 23.6 percent of overall sales in the first quarter of 2011, an increase of 85 percent year-on-year”, said Roberta Cozza, principal research analyst at Gartner. “This share could have been even higher, but manufacturers announced a number of high-profile devices during the first quarter of 2011 that would not ship until the second quarter of 2011. We believe some consumers delayed their purchases to wait for these models”.

The smartphones report shows a huge growth by the Android OS, which is now firmly the platform to sell the most, with Symbian dropped to number two, and iOS third after surpassing BlackBerry OS. Microsoft OSs (both Windows Phone 7 and the older Windows Mobile, combined) mantains the same sales level of last year but halving its percentage; experts say Microsoft’s alliance with Nokia will bring Windows Phones back to the top replacing Symbian,

Fysx writes with recent comments from Valve co-founder Gabe Newell about how he thinks the traditional video game business model is flawed: "The industry has this broken model, which is one price for everyone. That’s actually a bug, and it’s something that we want to solve through our philosophy of how we create entertainment products. What you really want to do is create the optimal pricing service for each customer and see what’s best for them. We need to give customers, all of them, a robust set of options regarding how they pay for their content. An example is – and this is something as an industry we should be doing better – is charging customers based on how much fun they are to play with. Some people, when they join a server, a ton of people will run with them. Other people, when they join a server, will cause others to leave. We should have a way of capturing that. We should have a way of rewarding the people who are good for our community."

"The ongoing debate over the supposed dangers posed by mobile phone usage and wireless signals has exploded once again. An influential European committee has called for a ban on mobile phones and Wi-Fi networks in schools – the GSM Association has denounced the report as an 'unbalanced political assessment, not a scientific report.' The report made its recommendation to reduce mobile and wireless use in schools, despite admitting that there is a lack of clear scientific and clinical proof. However, it said the lack of proof was reason enough to restrict use, just in case, comparing mobile phone radiation to other things whose dangers were once unknown, such as asbestos, leaded petrol and tobacco."

With a veritable “Cambrian explosion” of low- and high-end Android devices in Asia, venture firm DCM recently made a big bet that there will be some winning startups in the next few years by launching a $100 million early-stage Android fund with Japan’s GREE and mobile operator KDDI.

“We all recognize that Android is going to really take off in China and Japan over the next 12 months and we wanted to make sure we intersected with the best and brightest whether it’s apps guys or people working with chips,” he said. Chao says he sees Android as the fourth wave in a series of shifts affecting the gaming industry in Asia over the last several years. While there aren’t any truly reliable statistics, Chao says there might be about 15 million Android devices shipped in China by the end of this year. Higher-end Android devices like Sony Ericsson’s Xperia line of phones are starting to find a foothold in Japan.

“All of the majors are jumping on the bandwagon and the Android smartphones tend to do really well in Japan,” he said. “They’ll have traditional Japanese phone functions like FeliCA, which is a local payment method, and the ability to play GREE games.”

When choosing from over one million mobile apps across multiple platforms, which ones are really worth it? What about Web-based applications that aren’t apps but are highly effective when used on your mobile device? Well, there isn’t an app that can figure out which apps are right for you but there is a non-app alternative—humans—that can do that.

re creating smartphone loyalty, determining which OS and device a consumer may buy. At least that’s what a recent Gartner report will have you believe. The sales report ranks Android, Symbian, iPhone, BlackBerry and Windows Phone sales in the first quarter of 2011, noting the impact of mobile apps on the market share of new sales. It seems the mobile device market is only gaining in strength, Google (GOOG) taking 36 percent market share, leading with 36.3 million unites sold. Symbian comes in second, with 27.4 percent market share at 27.6 million units, leaving Apple (AAPL) at 16.8 percent market share with 16.9 in sales. RIM’s (RIMM) BlackBerry comes in fourth, with 13 million and a 12.9 percent take of the market.

“Every time a user downloads a native app to their smartphone or puts their data into a platform’s cloud service, they are committing to a particular ecosystem and reducing the chances of switching to a new platform,” notes principle research analyst Roberta Cozza. “This is a clear advantage for the current stronger ecosystem owners Apple and Google. As well as putting their devices in the context of a broader ecosystem, manufacturers must start to see their smartphones as part of a computing continuum.”

Apps have certainly created an expansive ecosystem for mobile industry, but just like the mighty dinosaur, this era may one day become extinct. The death of mobile apps has been predicted by MIT writer Christopher Mims, pegging web apps as the future. It’s their potential ubiquity across platforms that extends access to web users, instead of drawing lines in the sand around mobile browsing versus the web you access on a PC laptop. Mims calls for a browser-based utopia where offline access and standards like HTML5 harmonize our desperate web experiences, but notes that offline access is far from perfect. Things still boil down to business, where Google’s marketplace has lower operating costs than Apple’s, with a broadening reach.

A significant security hole has been discovered in Google’s Android operating system for smartphones, which can allow attackers to gain access to users’ personal information without their permission. The flaw, which was discovered by three research assistants at Ulm University in the southern part of Germany, affects approximately 97% of Android users. In a recent blog post, the researchers found that users of Android devices running versions 2.3.3 and below could be susceptible to attack when they are connected to unencrypted Wi-Fi networks. Anyone else on that network could gain access to, modify or delete Android users’ calendars, photos and contacts.

Third-party apps are the weakest link in user privacy on smart phones. They often get access to large quantities of user data, and there are few rules covering how they must handle that data once they have it. Worse yet, few third-party apps have a privacy policy telling users what they intend to do. That was the message delivered at a hearing of the U.S. Senate committee on Commerce, Science, and Transportation held yesterday. Companies and regulators are struggling to find ways to ensure that user data is handled properly by apps installed on smart phones, but the way apps are designed makes this difficult.

This week, Facebook joined Google and Apple on the hot seat. But all three companies run platforms that support thousands of third-party developers, and how to make sure those apps respect users' privacy, and explain their rules, is a major question. Sen. Mark Pryor (D-Arkansas) said at the hearing, "It's not clear that Americans understand how their information may be shared or transferred."

Twitter is updating its authentication system to give users more control over how third-party applications can access their accounts. Applications will now have to explicitly request additional permission from the user during the authentication process in order to send and receive direct messages on behalf of the user. At first glance, the change seems like a welcome improvement to the Twitter APIs. Support for granular permission tiers is one of the technical advantages of authority delegation systems like OAuth

Twitter's approach to implementing the feature comes with some serious problems for third-party client implementors

The OAuth standard was originally intended to enable server-to-server authentication for limited third-party access to non-public APIs. It is poorly suited for open APIs with an arbitrary number of independent third-party applications. More significantly, it doesn't address the needs of desktop and mobile authentication at all. Despite the significant limitations of the standard, it is being adopted and mandated by a number of social networking services, including Twitter.

"After years of dominance in computer chips, Intel now is chasing the mobile chip market and trying to redefine its future. During Intel's financial analyst meeting Monday, CEO Paul Otellini announced that he is refocusing the company, moving its 'center' from PC processors to processors for the burgeoning mobile market. 'I think Intel recognizes that they absolutely have to get a win here,' said analyst Rob Enderle. 'All the activity is in mobile. A post-PC era would be a post-Intel era if they don't get a beachhead established.' Earlier this month, Intel made a move in this new direction when it unveiled its new 3D transistor technology that is expected to position the chip maker to grab a piece of the mushrooming tablet market."

"We all know about the growing popularity of collision avoidance systems. As recently as this week, we've even heard about developments on the autonomous car front. Problem is, most of those systems depend on vehicles going it alone, using radar and other technology to avoid hazards in their way. But what if cars could talk to one another and the surrounding infrastructure? Wouldn't that be even better — and safer? The US Department of Transportation thinks so, and it's hoping to prove it in a new series of 'talking car' experiments taking place in six locales across the US. But for those of us who are doubtful, the Proceedings of the National Academy of Science has published a study showing how masses can become dumber: social influence. While previous studies show how groups of people can come up with remarkably accurate results, it seems 'even mild social influence can undermine the wisdom of crowd effect in simple estimation tasks.' Social influence 'diminishes the diversity of the crowd without improvements of its collective error.' In short, crowd intelligence only works in cases where the opinion of others is hidden."

"With cybercrime now the second largest criminal activity in the world, measures such as the creation of an 'Internet Interpol' and better cooperation between international law enforcement agencies are needed if criminals are to be curtailed in the future, Kaspersky Labs founder and security expert Eugene Kaspersky has argued. He said, 'We were talking about that 10 years ago and almost nothing has happened. Sooner or later we will have one. I am also talking about Internet passports and having an online ID. Some countries are introducing this idea, so maybe in 15 years we will all have it.'"

"The National Endowment for the Arts recently published their criteria for next year's Arts in Media grants. One of the key changes is the inclusion of video games as works of art. 'Projects may include high profile multi-part or single television and radio programs (documentaries and dramatic narratives); media created for theatrical release; performance programs; artistic segments for use within an existing series; multi-part webisodes; installations; and interactive games. Short films, five minutes and under, will be considered in packages of three or more.'
