U.S. nuke regulators weaken safety rules [20Jun11] - 0 views

  • Federal regulators have been working closely with the nuclear power industry to keep the nation's aging reactors operating within safety standards by repeatedly weakening standards or simply failing to enforce them, an investigation by The Associated Press has found.Officials at the U.S. Nuclear Regulatory Commission regularly have decided original regulations were too strict, arguing that safety margins could be eased without peril, according to records and interviews.The result? Rising fears that these accommodations are undermining safety -- and inching the reactors closer to an accident that could harm the public and jeopardize nuclear power's future.
  • Examples abound. When valves leaked, more leakage was allowed -- up to 20 times the original limit. When cracking caused radioactive leaks in steam generator tubing, an easier test was devised so plants could meet standards.Failed cables. Busted seals. Broken nozzles, clogged screens, cracked concrete, dented containers, corroded metals and rusty underground pipes and thousands of other problems linked to aging were uncovered in AP's yearlong investigation. And many of them could escalate dangers during an accident.

When the first were built in the 1960s and 1970s, it was expected that they would be replaced with improved models long before their licenses expired.That never happened. The standard is based on a reactor vessel's "reference temperature," which predicts when it will become dangerously brittle and vulnerable to failure. Through the years, many plants have violated or come close to violating the standard.As a result, the minimum standard was relaxed first by raising the reference temperature 50 percent, and then 78 percent above the original -- even though a broken vessel could spill radioactive contents."We've seen the pattern," said nuclear safety scientist Dana Powers, who works for Sandia National Laboratories and also sits on an NRC advisory committee. "They're ... trying to get more and more out of these plants."
  • Sharpening the pencilThe AP study collected and analyzed government and industry documents -- some never-before released -- of both reactor types: pressurized water units that keep radioactivity confined to the reactor building and the less common boiling water types like those at Fukushima, which send radioactive water away from the reactor to drive electricity-generating turbines.The Energy Northwest Columbia Generating Station north of Richland is a boiling water design that's a newer generation than the Fukushima plants.Tens of thousands of pages of studies, test results, inspection reports and policy statements filed during four decades were reviewed. Interviews were conducted with scores of managers, regulators, engineers, scientists, whistleblowers, activists and residents living near the reactors at 65 sites, mostly in the East and Midwest.
  • AP reporters toured some of the oldest reactors -- Oyster Creek, N.J., near the Atlantic coast 50 miles east of Philadelphia and two at Indian Point, 25 miles north of New York City on the Hudson River.Called "Oyster Creak" by some critics, this boiling water reactor began running in 1969 and is the country's oldest operating commercial nuclear power plant. Its license was extended in 2009 until 2029, though utility officials announced in December they will shut the reactor 10 years earlier rather than build state-ordered cooling towers. Applications to extend the lives of pressurized water units 2 and 3 at Indian Point, each more than 36 years old, are under NRC review.Unprompted, several nuclear engineers and former regulators used nearly identical terminology to describe how industry and government research has frequently justified loosening safety standards. They call it "sharpening the pencil" or "pencil engineering" -- fudging calculations and assumptions to keep aging plants in compliance.
  • Cracked tubing: The industry has long known of cracking in steel alloy tubing used in the steam generators of pressurized water reactors. Ruptures have been common in these tubes containing radioactive coolant; in 1993 alone, there were seven. As many as 18 reactors still run on old generators.Problems can arise even in a newer metal alloy, according to a report of a 2008 industry-government workshop.
  • Neil Wilmshurst, director of plant technology for the industry's Electric Power Research Institute, acknowledged the industry and NRC often collaborate on research that supports rule changes. But he maintained there's "no kind of misplaced alliance ... to get the right answer."Yet agency staff, plant operators and consultants paint a different picture:* The AP reviewed 226 preliminary notifications -- alerts on emerging safety problems -- NRC has issued since 2005. Wear and tear in the form of clogged lines, cracked parts, leaky seals, rust and other deterioration contributed to at least 26 of the alerts. Other notifications lack detail, but aging was a probable factor in 113 more, or 62 percent in all. For example, the 39-year-old Palisades reactor in Michigan shut Jan. 22 when an electrical cable failed, a fuse blew and a valve stuck shut, expelling steam with low levels of radioactive tritium into the outside air. And a 1-inch crack in a valve weld aborted a restart in February at the LaSalle site west of Chicago.
  • * A 2008 NRC report blamed 70 percent of potentially serious safety problems on "degraded conditions" such as cracked nozzles, loose paint, electrical problems or offline cooling components.* Confronted with worn parts, the industry has repeatedly requested -- and regulators often have allowed -- inspections and repairs to be delayed for months until scheduled refueling outages. Again and again, problems worsened before being fixed. Postponed inspections inside a steam generator at Indian Point allowed tubing to burst, leading to a radioactive release in 2000. Two years later, cracking grew so bad in nozzles on the reactor vessel at the Davis-Besse plant near Toledo, Ohio, that it came within two months of a possible breach, an NRC report said, which could release radiation. Yet inspections failed to catch the same problem on the replacement vessel head until more nozzles were found to be cracked last year.
  • Time crumbles thingsNuclear plants are fundamentally no more immune to aging than our cars or homes: Metals grow weak and rusty, concrete crumbles, paint peels, crud accumulates. Big components like 17-story-tall concrete containment buildings or 800-ton reactor vessels are all but impossible to replace. Smaller parts and systems can be swapped but still pose risks as a result of weak maintenance and lax regulation or hard-to-predict failures.Even mundane deterioration can carry harsh consequences.For example, peeling paint and debris can be swept toward pumps that circulate cooling water in a reactor accident. A properly functioning containment building is needed to create air pressure that helps clear those pumps. But a containment building could fail in a severe accident. Yet the NRC has allowed safety calculations that assume the buildings will hold.
  • In a 2009 letter, Mario V. Bonaca, then-chairman of the NRC's Advisory Committee on Reactor Safeguards, warned that this approach represents "a decrease in the safety margin" and makes a fuel-melting accident more likely.Many photos in NRC archives -- some released in response to AP requests under the federal Freedom of Information Act -- show rust accumulated in a thick crust or paint peeling in long sheets on untended equipment.Four areas stand out:
  • Brittle vessels: For years, operators have rearranged fuel rods to limit gradual radiation damage to the steel vessels protecting the core and keep them strong enough to meet safety standards.But even with last year's weakening of the safety margins, engineers and metal scientists say some plants may be forced to close over these concerns before their licenses run out -- unless, of course, new regulatory compromises are made.
  • Leaky valves: Operators have repeatedly violated leakage standards for valves designed to bottle up radioactive steam in an earthquake or other accident at boiling water reactors.Many plants have found they could not adhere to the general standard allowing main steam isolation valves to leak at a rate of no more than 11.5 cubic feet per hour. In 1999, the NRC decided to allow individual plants to seek amendments of up to 200 cubic feet per hour for all four steam valves combined.But plants have violated even those higher limits. For example, in 2007, Hatch Unit 2, in Baxley, Ga., reported combined leakage of 574 cubic feet per hour.
  • "Many utilities are doing that sort of thing," said engineer Richard T. Lahey Jr., who used to design nuclear safety systems for General Electric Co., which makes boiling water reactors. "I think we need nuclear power, but we can't compromise on safety. I think the vulnerability is on these older plants."Added Paul Blanch, an engineer who left the industry over safety issues, but later returned to work on solving them: "It's a philosophical position that (federal regulators) take that's driven by the industry and by the economics: What do we need to do to let those plants continue to operate?"Publicly, industry and government say that aging is well under control. "I see an effort on the part of this agency to always make sure that we're doing the right things for safety. I'm not sure that I see a pattern of staff simply doing things because there's an interest to reduce requirements -- that's certainly not the case," NRC chairman Gregory Jaczko said in an interview.

  • As the basis for this request, the petitioner states that following an 8.9 magnitude earthquake on March 11, 2011, in Fukushima, Japan, one or more nuclear power reactors there sustained significant damage which resulted in the release of radioactive particles into the environment, and that the Japanese authorities ordered a ``General Emergency Evacuation,'' but many Japanese citizens were not able to timely leave the affected area and were subject to radioactive contamination at this time. The petitioner further stated that many of NRC's licensees operate nuclear power reactors on or near earthquake fault lines and could, therefore, be subject to significant earthquake damage and loss- of-coolant accidents similar to that experienced by those in Japan for which an on-going state of emergency continued to unfold.

The request has been referred to the Director of the Office of Nuclear Reactor Regulation (NRR). The NRR Petition Review Board (PRB) held two recorded teleconferences on April 14 and May 25, 2011, with the petitioner, during which the petitioner supplemented and clarified the petition.   • The Nuclear Regulatory Commission’s (NRC) “Near-Term Task Force Review of Insights from the Fukushima Dai-ichi Accident” publicly released its 92-page well intentioned near-term review on the implications of the Fukushima Daiichi nuclear disaster for US reactors on July 13, 2011.  The federal agency proposes to improve its “patchwork of regulatory requirements” developed “piece by piece over the decades.” Beyond Nuclear remains concerned that many critical reactor safety areas are still dominated by industry “voluntary initiatives” where non-compliance continues to elude federal enforcement and  Capitol Hill pro-nuclear champions announced their resistance to any costly safety improvements
  • Of most concern, the NRC is still ignoring warnings as did its predecessor, the Atomic Energy Commission,  in 1972 from their senior safety officer, Dr. Steven Hanuaer to “discourage all further use” in the US of the Fukushima-style General Electric Mark I boiling water reactor. The federal regulators instead issued three more construction permits and eventually 16 more operating licenses in the 1970s for this same dangerous design. There are now 23 Fukushima-style reactors operating in the United States as part of a total of 32 Mark I’s worldwide---counting the smoldering radioactive rubble at Fukushima.   The NRC task force report does not fundamentally address the most critical issue coming out of the Fukushima catastrophe, namely, the design vulnerability of all Mark I containment structures to catastrophic failure during a severe accident
  • The NRC report further ignores that these same Mark I reactors, like Vermont Yankee and Oyster Creek, are not currently in compliance with their operating licenses that were originally required to have a reliable "leak tight" containment structure. If the NRC were looking for the most significant and meaningful safety upgrade to the US reactors directly impacted by the Fukushima disaster they would require that all Mark I reactor operators restore containment integrity to the original licensed leak tight condition. Or order that they be shut them down, permanently.  All of the Mark I reactors voluntarily installed retrofits to vent all a substandard and undersized containment to save it from rupturing during a severe accident. The same experimental vent was installed at Fukushima in 1991. The same experimental fix failed on three containments buildings to prevent the uncontrolled releases of radioactivity to the air and water that are still occurring now four months after the accident.

  • Instead, in order to keep these dangerous reactors operational, many now with twenty year license extensions, the NRC task force is recommending that rather than the industry volunteering a dubious containment vent system, the NRC should order the nuclear industry to take another try at an experimental venting fix which fundamentally compromises their own defense in depth philosophy.

It's Chairman Jaczko (Democratic appointee) vs Commissioner Svinicki (Republican appointee), with a former chairman fanning the infighting.

U.S. Industry Taking Steps to Learn Lessons from Japan, Enhance Safety at America's Nuc... - 0 views

  • The nuclear energy industry will continue to work with the Nuclear Regulatory Commission as it considers forthcoming recommendations of an agency task force on new procedures and regulations in light of the accident at Fukushima Daiichi.  We have undertaken significant work in the past 90 days to examine our facilities and take the steps necessary to enhance safety.  We will continue to work with the Nuclear Regulatory Commission to understand any potential gaps in safety and fill those gaps. Prompted by the Fukushima accident, the NRC staff has been developing recommendations to enhance safety at America’s reactors. The task force is expected to release its report to the NRC commissioners within the next week. In their interim reports, NRC officials have emphasized that issues identified during the recent inspections will not impede the facilities’ ability to maintain safety even in the face of extreme events.
  • These NRC’s inspections complement industry efforts begun within days of the Fukushima Daiichi accident. Each of the nation’s 104 nuclear energy facilities has been subjected to a comprehensive verification of preparedness to maintain safety during a severe event, regardless of the cause. As a result of these self-inspections, facility operators have made immediate enhancements or developed plans to enhance safety. The vast majority of the items identified by the industry are enhancements to safety measures already in place.
  • The NRC has also made clear that issues identified during its post-Fukushima inspections at each plant do not undermine any facility’s ability to respond to extreme events. This conclusion is based upon exemplary levels of safe operation and the multiple layers of protection that exist at each nuclear energy facility in the country.   Moreover, in its annual reports to Congress, the NRC has listed only one “abnormal occurrence” over the past decade—an incident nine years ago that did not result in the release of radiation. Over the last 10 years, the NRC has not identified any negative trends in safety at America’s nuclear facilities. In the wake of the tragedy in Japan, Americans are concerned about whether U.S. reactors face the same risks.  The fact is, American nuclear facilities are subject to more regulatory scrutiny and requirements than in any other country.  American nuclear energy facilities are equipped and employees are trained to manage severe events. Since the terrorist attacks of Sept. 11, 2001, the industry has made significant improvements in physical structures and emergency response capabilities.

  • The U.S. industry—through its commitment to continuous learning and relentless pursuit of excellence in safe operations—has taken significant action to ensure that American reactors are operated safety and securely. This includes actions in the following areas: Command and control: key operational and response decisions remain with shift supervisor—Decision-making remains on site with licensed operators. Reactor operators drill on accident scenarios several times each year and are prepared to respond to a wide range of potential severe events.
  • Operator licensing and training—U.S. reactor operators are licensed by the NRC and must re-qualify for their license every two years. U.S. reactor operators spend one week out of six in simulator training, which is more continuous training than pilots and doctors. Safety culture—The industry’s safety culture is transparent and encourages and facilitates the reporting of problems or concerns by employees through several channels. A commitment to safety culture is evidenced by employees who embrace continuous learning and maintain a questioning attitude regarding safety. This attitude gives rise to tools like corrective actions programs.

Some of the people who are most likely to be victims of groupthink are those who adamantly oppose the continued safe operation of emission-free nuclear power plants.   • NOTHING happend to the fuel in the pools at Fukushima. I would like to see some evidence other than the word of an activist who frightens kids for a living to support Gunter’s rant about peices of fuel being ejected miles away. From the looks of that video, the fuel didn’t move an inch. There is also a poll associated with the article. The poll discloses that it is completely unscientific, since it allows anyone to vote and is not based on randomly selected participants. However, I think that the results as of 0315 this morning are pretty amusing since the antinuclear opinion piece has been posted for nearly a week.
  • Perhaps this October 12, 2011 post titled Oyster Creek Response that was published on Clean Energy Insight has something to do with the way the results are shaping up with 1029 out of 1080 respondents (95.3%) saying that Oyster Creek should not stop operating. Here is one more example of how inbred the group of antinuclear activists has become. I am talking here about the people who are so adamantly opposed to using nuclear energy that they do not even want existing nuclear plants to keep on producing clean, emission free, low cost electricity. Michael Mariotte of NIRS makes the following extraordinary claim: Ninety-five percent of the people in the world know about Fukushima, Michael Mariotte of the Nuclear Information and Resource Service said.
  • “It took a really extraordinary event for 95 percent of the people in the world to know about it,” he said. “If they know about Fukushima, they know about Mark 1 reactors exploding in the air and releasing toxic radiation across the world and they know that’s not a good thing. Something has to be done to make sure that never happens again.” I could not let that one pass without a comment; I am quite sure that Mariotte has once again fallen victim to the fact that he surrounds himself with people who echo his own prejudices. Here is my response.
  • Marriotte makes an interesting statement by he claiming that “95% of the people in the world” know about Fukushima. That statement might be true about the people in the United States, where advertiser-supported television news programs covered the events with breathless hype for several months. I am pretty sure that you would have a difficult time finding anyone in China, central Africa, the Asian subcontinent, South America or the Middle East who can even pronounce Fukushima, much less know anything about GE Mark 1 containments. Most of them would not even know that they should be worried about radiation because they have never been taught to be afraid of something that they cannot smell, feel, taste, or hear especially when it occurs at levels that have no chance of making them sick within their expected lifetime. Mariotte, Gunter, Kamps, Katz and Bridenbaugh are all members of a vocal, but tiny group of people who have been carrying the water of the fossil fuel industry for decades by opposing nuclear energy, the only real competitor it has. They are victims of groupthink who believe that their neighbors in Takoma Park are representative of the whole world.
  • Just before making this comment, I voted in the unscientific poll associated with the article. 95% say that Oyster Creek should keep on powering New Jersey homes and businesses. They are not impressed by the Beyond Nuclear FUD; they like clean electricity.

US Radiation Monitoring May Have Been Handed Off To Nuclear Industry [04Nov11] Lobbyist... - 0 views

  • Lucas W Hixson may have uncovered a major abuse of the public trust by the NRC. In late March 2011 the NRC issued a directive that allowed the nuclear industry lobbyist group NEI to supply radiation monitoring data to the NRC who would then forward it to the EPA. March 24th the NRC discussed handing over radiation monitoring to nuclear industry lobbyists, April 14th RadNet was shut down and went back to routine monitoring schedules. This meant no ongoing food,water and air filter testing. Only the radiation level monitors were left operating. The EPA claimed that levels were going down as the reason for shutting down the expanded monitoring, but places like Idaho did not have the decreases seen at other sites.
  • The NRC directive put commercial nuclear power plant owners in charge of voluntarily providing the public with radiation monitoring data but it would be run through their nuclear industry lobbyists before it would then be provided to the NRC. Raw data was not provided directly to the NRC. Considering the massive US nuclear industry offensive to flood the media with propaganda downplaying the Fukushima nuclear disaster, they are hardly a reliable source to tell the public what the radiation levels are.
  • RadNet itself had many problems, stations didn’t work, some were not calibrated before the disaster. Even more disturbing is that the EPA does not even handle their own radiation monitoring network. The important function falls to a former Bush administration appointee running a business out of a rundown storefront in New Mexico. Under a $238,000 no bid contract Environmental Dimensions supposedly manages, maintains and operates RadNet, the only tool the public has to see if we are being subjected to nuclear fallout. The blogger that broke this story states that Environmental Dimensions has tripled their revenue in recent years. The company cites a different address as their mailing address. This shows up as a tiny house in Albuquerque. EDI was also part of a 12 million dollar contract in 2010 along with a couple of other contractors. The contract provides environmental & remediation services to the US Corps of Engineers. EDI claims to have been in business since 1990 but owner, Ms. Bradshaw worked for the DoD in 2006.

  • What little system the public has for radiation notification through the EPA has been shuffled off to a no bid contract with spurious origins and the system experienced widespread problems when it was needed most. That system was mostly turned off just over a month after the disaster. Spent Nuclear Fuel Reprocessing Facilities, Reulations [10Jun11] - 0 views

  • The NRC has the authority under the Atomic Energy Act to license commercial spent fuel reprocessing facilities. Currently, Title 10 of the Code of Federal Regulations (10 CFR) Part 50, ``Domestic Licensing of Production and Utilization Facilities,'' provides the licensing framework for production and utilization facilities. Although a reprocessing facility is one type of production facility, its industrial processes are more akin to fuel cycle processes. This framework was established in the 1970's to license the first U.S. reprocessing facilities. The policy decision by the Carter Administration to cease reprocessing initiatives was based, in part, on the proliferation risks posed by the early reprocessing technology. While that policy was reversed during the Reagan Administration, until recently there was no commercial interest in reprocessing and, hence, no need to update the existing reprocessing regulatory framework in 10 CFR part 50.
  • Although commercial reprocessing interest waned, the Department of Energy (DOE) continued to pursue reprocessing technology development through the National Laboratories. The DOE has sought to decrease proliferation risk and spent fuel high-level waste through developing more sophisticated reprocessing technologies. During the Bush Administration, the Global Nuclear Energy Partnership (GNEP) renewed interest in commercial reprocessing. The GNEP sought to expand the use of civilian nuclear power globally and close the nuclear fuel cycle through reprocessing spent fuel and deploying fast reactors to burn long-lived actinides. In response to these initiatives, the Commission directed the staff to complete an analysis of 10 CFR part 50 to identify regulatory gaps for licensing an advanced reprocessing facility.
  • In mid-2008, two nuclear industry companies informed the NRC of their intent to seek a license for a reprocessing facility in the U.S. An additional company expressed its support for updating the regulatory framework for reprocessing, but stopped short of stating its intent to seek a license for such a facility. NUCLEAR POWER - Resisting "Rust Belt" reactors' radioactive risks! [04Aug12] - 0 views

  • As if the closing steel mills and automobile manufacturing plants weren't bad enough, some of the oldest, most risky atomic reactors in the U.S. are located in the Midwest. Worse still, they are on the shores of the Great Lakes, putting at risk the drinking water supply for 40 million people downstream in the U.S., Canada, and a large number of Native American First Nations. Altogether, 33 atomic reactors are located on the shorelines of the Great Lakes. Two of the most infamous of these radiologically risky "Rust Belt reactors" are Entergy Nuclear's Palisades in southwest Michigan, and FirstEnergy's Davis-Besse in northwest Ohio.
  • Last month, U.S. Rep. Ed Markey (D-MA), a long-time watchdog on the nuclear industry, wrote the U.S. Nuclear Regulatory Commission (NRC) about an acidic, radioactive leak representing a "crisis in the control room at the Palisades nuclear power plant." The leakage had been ongoing for a year, and was being "contained" in glorified buckets referred to by Entergy PR spokesman Mark Savage as "catch basins." Although the leak came to light when Palisades was forced to shutdown after its rate reached more than 30 gallons per day, it had been ongoing for months at a rate of 15 gallons per day. The tritiated and borated water is leaking from a 300,000 gallon Safety Injection Refueling Water storage tank, which is safety critical for both reactor core and radiological containment cooling. Whistleblowers contacted Washington, D.C. attorney Billie Pirner Garde, who alerted Rep. Markey, who wrote NRC. The NRC Office of Investigations has launched a probe into potential Entergy wrongdoing. On July 17th, NRC issued a "Confirmatory Action Letter" which enables Palisades to keep operating into 2013, even if the leak increases to nearly 38 gallons per day!
  • Markey demanded a copy of an internal Entergy report surveying its own workers on "safety culture" at Palisades. Michigan Radio obtained a copy, which reveals "a lack of accountability at all levels," and a workforce deeply distrustful of management, fearful that they will be harassed and punished if they dare to raise safety concerns.

UPDATE 1-NRC not ready to allow restart of Virginia reactors [07Oct11] - 0 views

Progress Energy announces leadership change at Robinson plant [21Oct10] - 0 views

  • The Robinson plant remains offline. The 719-megawatt plant was the first commercial nuclear reactor in the Southeast and has been producing electricity since 1971. The plant shut down early Oct. 8 because of an electrical problem in one of the reactor coolant pump motors. Inspectors from the Nuclear Regulatory Commission returned to the plant Oct. 12. NRC spokesman Roger Hannah said in an earlier report that a team of inspectors is examining the operation of the pumps that supply water to the steam generators. Robinson shut down in September after a control problem with one of the plant’s turbines, about three months after the plant re-opened. Two electrical system fires led to a nearly four-month shutdown of the plant, which re-opened in July. Those fires and a reactor shutdown March 28 did not adversely affect public health or safety, the Nuclear Regulatory Commission said in June. Conditions did not rise to a level that threatened plant safety during the fires, and no measurable radiation was released from the plant’s reactor.
  • NRC inspectors did find some shortcomings in equipment, training, operator response and performance and some other areas agency officials said would require additional NRC review. The plant’s reactor remained shut down until the NRC completed most of its additional reviews, officials said. The initial fire resulted from a malfunction in a cable and circuit breaker, NRC’s Region II Branch Chief Robert Haag said. The NRC originally dispatched a three-person special inspection team to the Robinson plant in response to the fires, but further review pointed to the need for additional inspection, the agency said. An Augmented Inspection Team (AIT) is formed by the NRC to review particularly significant events or issues at NRC-licensed facilities, and the Robinson AIT included members of the original inspection team as well as five additional inspectors.

US LLC Rules Allow Nuclear Power Companies To Take Profits, Dump Risk On Taxpayers [09N... - 0 views

  • US nuclear power plants mostly exist in a legal “get out of jail free” land of LLC (Legal Liability Corporation) ownership. While big energy conglomerates like Entergy own the bulk of the commercial nuclear power plants in the US, these plants are owned by individual LLC companies that have one asset, the power plant. Through a network of LLC companies and holding companies these energy giants are able to suck all the profits out of these nuclear power plants but shoulder none of the risk if something goes bad.
  • The US has a nuclear accident liability law, Price-Anderson. This law sets up a limited fund that all licensed nuclear plant owners would pay into in the event of an accident. They only pay premiums into this fund after an accident happens. Under this law each plant is required to have $300 million in liability insurance that would pay before Price-Anderson would kick in. Proving any other sort of cash reserves, ability to pay for an extended outage or an accident (including Price-Anderson premiums) has been largely voluntary by the power companies. Even when proof of financial assets is asked for by the NRC it is calculated based on projected income estimates done by the power company. The NRC admits they are out of their expertise when it comes to finance and also does no investigation to assure these estimates have any basis in fact. The NRC has also complained repeatedly that deregulation of the energy industry is causing a lack of safety and maintenance to become a large problem as companies try to extract as much profit as possible up and out of these LLC companies to the parent company, leaving insufficient money to safely operate these nuclear plants. Many of these plants in LLC situations are among the aging reactor fleet from the 1960′s & 1970′s. As these plants ask for operating license extensions from the NRC, financial soundness is not part of the review.
  • If a nuclear power plant has a major accident, is found to have an expensive damage situation or is facing decommissioning the LLC that owns it can file for bankruptcy and walk away. The parent company has no financial risk or liability. The NRC has expressed doubt about being able to “pierce the corporate veil” in court and has diverted into settlements every time it has run into this issue with an aging plant facing a financial crisis. The NRC also has no special standing in a bankruptcy case where they can compel Price-Anderson premium payments or for the nuclear power company to pay funds towards decommissioning. It is not totally clear where the decommissioning trust fund lies as these funds are “sold” along with the plant when a new company takes over a nuclear power plant.
