Freakonomics » What the Google Books Battle Really Means - 0 views

  • Google Books allows users to search a massive database of books — Google has digitized more than 15 million, and its ambition is to eventually reach all the books ever printed.  Google does not allow access to copyrighted books unless it has an agreement with a book’s publisher. Instead, users receive a list of books that include their search term.  Click on a book, and Google shows as much as its publisher has authorized, or, if there is no agreement with the publisher, Google shows only a few lines of text containing the relevant terms.
  • Google Books also provides — for the first time — access to millions of what are called  “orphan works.”  These are books that are out of print, but remain under copyright.  Google Books makes orphan works searchable too.  And that turns out to be extremely important.
  • The orphan problem arises because most books go out of print very quickly. A few copies may be available in used book stores or filed away in library stacks.  But for most purposes, these books might as well not exist.  Copyright, on the other hand, lasts a very long time — currently, the life of the author plus 70 years.  So for millions of books that are out of print and remain under copyright, would-be users — i.e., anyone who wishes to re-print the book, or to use it in a derivative work — must seek permission.

  • The problem is that owners are often hard to find.  This is especially true as the decades pass.  Owners die, and copyright passes to heirs.  But there is no reliable record of copyright ownership.  As a result, it is often impossible to find anyone to ask for permission. By opening up this treasure trove of orphan works, Google Books may make a truly major contribution to nearly every field of writing imaginable.
  • The Authors Guild and the Association of American Publishers sued Google, arguing that by scanning copyrighted books into their database, and by distributing snippets from them, Google violated their copyrights.  Google disagreed, arguing that its copying was fair use.  But before the issues could be determined by a court, the parties settled. The settlement was, characteristically for Google, a masterstroke of creativity.  In return for modest payments to Guild and AAP members, Google obtained copyright immunity for its Google Books project.  But the settlement sought to do more — Google would be free to include orphan works in its database — even though the authors of these works, by definition, were not represented in the settlement negotiations.  Royalties would be directed to the owners of orphan works if they later surfaced.
  • The federal judge overseeing the dispute, however, rejected this settlement, in part because he didn’t like that it required authors to “opt-out” of it rather than “opt-in.”
  • A better option is for Congress to step in.  Legislation has been pending in Congress for several years that would ease the orphan works problem.  If passed, it would allow those who have made a reasonable search to use that work. And if the owner later surfaces, the user need only pay a reasonable license fee.  So under these revised rules, Google Books could include orphan works, and be assured that it would be liable only for the fair value of a license — exactly the type of compensation that they envisioned in the settlement.   And, importantly, firms other than Google –perhaps public libraries — could do so as well.

  • This year will fundamentally change how we think about and buy access to prospects, namely keywords. It is the dawn of paid search without keywords.
  • Google's search results were dominated by the "10 blue links" -- simple headlines, descriptions, and URLs to entice and satisfy searchers. Until it wasn't. Universal search wove in images, video, and real-time updates.
  • For most of its history, too, AdWords been presented in a text format even as the search results morphed into a multimedia experience. The result is that attention was pulled towards organic results at the expense of ads.

  • Google countered that trend with their big push for universal paid search in 2010. It was, perhaps, the most radical evolution to the paid search results since the introduction of Quality Score. Consider the changes:
  • New ad formats: Text is no longer the exclusive medium for advertising on Google. No format exemplifies that more than Product List Ads (and their cousin, Product Extensions). There is no headline, copy or display URL. Instead, it's just a product image, name, price and vendor slotted in the highest positions on the right side. What's more, you don't choose keywords. We also saw display creep into image search results with Image Search Ads and traditional display ads.
  • New calls-to-action: The way you satisfy your search with advertising on Google has evolved as well. Most notably, through the introduction of click-to-call as an option for mobile search ads (as well as the limited release AdWords call metrics). Similarly, more of the site experience is being pulled into the search results. The beta Comparison Ads creates a marketplace for loan and credit card comparison all on Google. The call to action is comparison and filtering, not just clicking on an ad.
  • New buying/monetization models: Cost-per-click (CPC) and cost-per-thousand-impressions (CPM) are no longer the only ways you can buy. Comparison Ads are sold on a cost-per-lead basis. Product listing ads are sold on a cost-per-acquisition (CPA) basis for some advertisers (CPC for most).
  • New display targeting options: Remarketing (a.k.a. retargeting) brought highly focused display buys to the AdWords interface. Specifically, the ability to only show display ads to segments of people who visit your site, in many cases after clicking on a text ad.
  • New advertising automation: In a move that radically simplifies advertising for small businesses, Google began testing Google Boost. It involves no keyword research and no bidding. If you have a Google Places page, you can even do it without a website. It's virtually hands-off advertising for SMBs.
  • Of those changes, Google Product Listing Ads and Google Boost offer the best glimpse into the future of paid search without keywords. They're notable for dramatic departures in every step of how you advertise on Google: Targeting: Automated targeting toward certain audiences as determined by Google vs. keywords chosen by the advertiser. Ads: Product listing ads bring a product search like result in the top position in the right column and Boost promotes a map-like result in a preferred position above organic results. Pricing: CPA and monthly budget caps replace daily budgets and CPC bids.
  • For Google to continue their pace of growth, they need two things: Another line of business to complement AdWords, and display advertising is it. They've pushed even more aggressively into the channel, most notably with the acquisition of Invite Media, a demand side platform. To remove obstacles to profit and incremental growth within AdWords.   • The inquiry will examine the heart of Google's search-advertising business, and the source of most of Google's revenue. Google accounts for around two-thirds of internet searches in the US (and close to 90% in the UK) and according to critics unfairly uses that dominance to favour its own growing network of services.Last November, the European commission opened its own formal investigation into allegations that Google discriminated against competing services in its search results and prevented some websites from using ads by Google competitors.
  • Legal experts said the investigation could be similar in scale to the massive antitrust probe of Microsoft, which started in 1991 and ended in a settlement a decade later. Professor Joshua Wright of George Mason Law School said: "The investigation will be of a comparable scale to that of Microsoft."But he said the chances of Google being found guilty of antitrust behaviour, as Microsoft was, were far smaller. Wright said for the US to bring a successful case against Google, it would have to prove the company was harming consumers. "As an outsider I would say that obstacle is far higher for them today with Google than it was back then with Microsoft," he said.

The Federal Trade Commission (FTC) is days away from serving subpoenas on the internet giant in what could be the biggest investigation yet of the search company's business, according to The Wall Street Journal. Both Google and the FTC declined to comment. A wide-ranging investigation into Google has been discussed for months. Google has faced several antitrust probes in recent years, and is already the subject of a similar investigation in Europe. In the US inquiries have so far largely been limited to reviews of the company's mergers and acquisitions.

  • When you read the enormous list of sites with Penney links, the landscape of the Internet acquires a whole new topography. It starts to seem like a city with a few familiar, well-kept buildings, surrounded by millions of hovels kept upright for no purpose other than the ads that are painted on their walls.
  • Exploiting those hovels for links is a Google no-no. The company’s guidelines warn against using tricks to improve search engine rankings, including what it refers to as “link schemes.” The penalty for getting caught is a pair of virtual concrete shoes: the company sinks in Google’s results.

  • The insultingly vacuous and frankly bizarre prose of the content farms — it seems ripped from Wikipedia and translated from the Romanian — cheapens all online information.
  • These prose-widgets are not hammered out by robots, surprisingly. But they are written by writers who work like robots. As recent accounts of life in these words-are-money mills make clear, some content-farm writers have deadlines as frequently as every 25 minutes. Others are expected to turn around reported pieces, containing interviews with several experts, in an hour. Some compose, edit, format and publish 10 articles in a single shift. Many with decades of experience in journalism work 70-hour weeks for salaries of $40,000 with no vacation time. The content farms have taken journalism hackwork to a whole new level.

  • So who produces all this bulk jive? Business Insider, the business-news site, has provided a forum to a half dozen low-paid content farmers, especially several who work at AOL’s enormous Seed and Patch ventures. They describe exhausting and sometimes exploitative writing conditions. Oliver Miller, a journalist with an MFA in fiction from Sarah Lawrence who once believed he’d write the Great American Novel, told me AOL paid him about $28,000 for writing 300,000 words about television, all based on fragments of shows he’d never seen, filed in half-hour intervals, on a graveyard shift that ran from 11 p.m. to 7 or 8 in the morning.

IPhone and Android Apps Breach Privacy - WSJ.com - 0 views

  • Few devices know more personal details about people than the smartphones in their pockets: phone numbers, current location, often the owner's real name—even a unique ID number that can never be changed or turned off.

  • Neither Apple nor Google requires apps to ask permission to access some forms of the device ID, or to send it to outsiders. When smartphone users let an app see their location, apps generally don't disclose if they will pass the location to ad companies.
  • Lack of standard practices means different companies treat the same information differently. For example, Apple says that, internally, it treats the iPhone's UDID as "personally identifiable information." That's because, Apple says, it can be combined with other personal details about people—such as names or email addresses—that Apple has via the App Store or its iTunes music services. By contrast, Google and most app makers don't consider device IDs to be identifying information.
  • A growing industry is assembling this data into profiles of cellphone users. Mobclix, the ad exchange, matches more than 25 ad networks with some 15,000 apps seeking advertisers. The Palo Alto, Calif., company collects phone IDs, encodes them (to obscure the number), and assigns them to interest categories based on what apps people download and how much time they spend using an app, among other factors. By tracking a phone's location, Mobclix also makes a "best guess" of where a person lives, says Mr. Gurbuxani, the Mobclix executive. Mobclix then matches that location with spending and demographic data from Nielsen Co.
  • Mobclix can place a user in one of 150 "segments" it offers to advertisers, from "green enthusiasts" to "soccer moms." For example, "die hard gamers" are 15-to-25-year-old males with more than 20 apps on their phones who use an app for more than 20 minutes at a time. Mobclix says its system is powerful, but that its categories are broad enough to not identify individuals. "It's about how you track people better," Mr. Gurbuxani says.
  • four app makers posted privacy policies after being contacted by the Journal, including Rovio Mobile Ltd., the Finnish company behind the popular game Angry Birds (in which birds battle egg-snatching pigs). A spokesman says Rovio had been working on the policy, and the Journal inquiry made it a good time to unveil it.
  • Free and paid versions of Angry Birds were tested on an iPhone. The apps sent the phone's UDID and location to the Chillingo unit of Electronic Arts Inc., which markets the games. Chillingo says it doesn't use the information for advertising and doesn't share it with outsiders.
  • Some developers feel pressure to release more data about people. Max Binshtok, creator of the DailyHoroscope Android app, says ad-network executives encouraged him to transmit users' locations. Mr. Binshtok says he declined because of privacy concerns. But ads targeted by location bring in two to five times as much money as untargeted ads, Mr. Binshtok says. "We are losing a lot of revenue."
  • Apple targets ads to phone users based largely on what it knows about them through its App Store and iTunes music service. The targeting criteria can include the types of songs, videos and apps a person downloads, according to an Apple ad presentation reviewed by the Journal. The presentation named 103 targeting categories, including: karaoke, Christian/gospel music, anime, business news, health apps, games and horror movies. People familiar with iAd say Apple doesn't track what users do inside apps and offers advertisers broad categories of people, not specific individuals. Apple has signaled that it has ideas for targeting people more closely. In a patent application filed this past May, Apple outlined a system for placing and pricing ads based on a person's "web history or search history" and "the contents of a media library." For example, home-improvement advertisers might pay more to reach a person who downloaded do-it-yourself TV shows, the document says.
  • The patent application also lists another possible way to target people with ads: the contents of a friend's media library. How would Apple learn who a cellphone user's friends are, and what kinds of media they prefer? The patent says Apple could tap "known connections on one or more social-networking websites" or "publicly available information or private databases describing purchasing decisions, brand preferences," and other data. In September, Apple introduced a social-networking service within iTunes, called Ping, that lets users share music preferences with friends. Apple declined to comment.

  • Here’s another hypothesis, this one for the conspiracy-minded. Last year, Advertising Age obtained a Google document that listed some of its largest advertisers, including AT&T, eBay and yes, J. C. Penney. The company, this document said, spent $2.46 million a month on paid Google search ads — the kind you see next to organic results.

  • We gave 20 of our engineers laptops with a fresh install of Microsoft Windows running Internet Explorer 8 with Bing Toolbar installed. As part of the install process, we opted in to the “Suggested Sites” feature of IE8, and we accepted the default options for the Bing Toolbar.We asked these engineers to enter the synthetic queries into the search box on the Google home page, and click on the results, i.e., the results we inserted. Marissa Mayer, "keeper" of the Google homepage since 1998, walked into a room filled with over 1,200 mostly graphic designers to talk about how well design worked at the design-dismissive Google. Maybe he couldn't, but someone won a recent battle to widen the search box by a few pixels, the most major change for the homepage in quite some time.

    I don't really know where this fits but I find this really amusing. The article is about how Google uses data, very specific data to determine their designs, almost to the point of being anal (to me). I wonder if this is what it means by challenging forth the nature (human mind) to reveal.
