Alternate text is not meant to be used as a tool tip, or more specifically, to provide additional information about an image. In 2005, the Authors Guild filed a lawsuit against Google arising from the Google Books project. In October 2008, the parties announced a proposed settlement. Academics and rightsholders have criticized the Settlement terms on grounds ranging from antitrust to privacy. The Settlement sets forth non-privacy terms, including provisions regarding royalties and book advertising, in great detail. However, it does not contain meaningful privacy protections for readers or authors. Various entities and individuals have filed comments, objections, and amicus curiae briefs concerning the proposed settlement.

In preparation for WIPO's initiative on Exceptions & Limitations to Copyright, the US Copyright Office is currently soliciting comments on the topic of "facilitating access to copyrighted works for the blind or persons with other disabilities". Written comments are due next week (April 21st, 2009), and there will be a public meeting in Washington on May 18th. EFF will be sending our own submission, as will many other IP and disability groups. But if you've worked on software or hardware to overcome your own visual or other disabilities, or co-operated informally (perhaps in an open source project) to provide wider access to content for users with disabilities, or have dealt with a publisher regarding the accessibility of texts, we'd like to encourage you to send the copyright office your own stories - and cc: us at accessibility@eff.org.

What's really at stake with Kindle is Amazon's desire to re-invent itself as a company where the buying and selling of retail goods is not an end in itself but also a means by which to obtain valuable client data. In a more abstract sense, Amazon.com is actively producing laboring subjects in and around an everyday practice-the reading of books and periodicals-which to my knowledge has never shared as direct a relationship to economically productive activity as it does with Kindle.

Amazon's new world-beating gadget isn't the savior of the e-book, genre. It's a proprietary, market-protecting anomaly in a world of increasingly open standards and accessible media. Shame on you, Amazon. (...) The thing that e-books need, I'm convinced, is PDF. Secure, reflowable, customizable PDF. The reader devices need to be easy on the eyes, lightweight, and allow users to shunt any PDF to it, whether it's a specially formatted e-book or not. If I am paying $300+ for essentially a document storage device on steroids, I need to be able to put my own junk on it, too. (...)You might be lining your own pockets and making a few sales, Mr. Bezos, but you're also promoting confusion in the marketplace and causing division in the e-book space at a time when everyone else is pushing for convergence and open standards. Listening to the examples demonstrates that nobody non-blind and non-masochistic would use the Kindle 2 text-to-speech feature. And as blind people can't use the Kindle 2, what is the point of that feature - and of the Authors' Guild ruckus about it?

February 25, 2009. Text-to-speech (TTS) programs have been in use for a number of years, and they're improving. As Roy Blount says in an op-ed in today's New York Times, Kindle 2's TTS isn't Jim Dale reading "Harry Potter," but it's listenable. There's no need to take our word for it; have a listen to the sample below.

Copyrights and Accommodations Although there are numerous technical and financial challenges to making course content accessible, the implications of the restrictive copyright that comes along with the use of proprietary content may present challenges that are frequently overlooked. Various forms of accommodation require the creation and distribution of derivative works, which is a restriction that comes along with the default copyright license. On the up side, the materials in question may include intellectual property created and owned by the faculty member and/or educational organization offering the course, in which case you and the learner may be lucky, relatively speaking. If you had the foresight to create accessible versions of all course media, you are home free. If not, your primary questions may be simply how to find the resources and tools to create accessible versions of these items in a timely fashion, which is a technical and financial issue.

It is impossible for the sites to do this. There is no way to independently identify the age and identify of minors. There is no RealID system for minors! My perspective is that the only reasonable option for Facebook, MySpace and any other social networking site would be to terminate the accounts of any minors who live in Illinois because it would be impossible for them to do this. The penalties for non-compliance would be pretty tough. Many co-sponsors. You might want to alert your students. They are the ones who would be impacted.
