Some Americans justify the wars in Iraq and Afghanistan as well-intended interventions for the good of their people, and the security of our nation and the world. They believe that the President MUST have had evidence of national security risk before taking the last and dire step of invasion. This is a crucial point. If there was credible evidence of imminent threat to US national security, then the wars were justified under the UN Charter for self-defense. However, if the evidence was not credible, or fabricated, then these wars are illegal Wars of Aggression. So which is it? Americans and the world no longer need BELIEVE anything; the specific evidence used to justify invading two countries is now public knowledge. All we have to do is match the government's claims to the exact evidence and you can decide for yourself. This article lays it out. First, as you may recall, there were four basic claims of fact presented by political "leadership" to invade Iraq:

Troops are coming home from Iraq despite the best efforts of the Obama administration to keep them there. "We're relieved to know all the troops will be home at the end of the year. This would not have been possible without the courageous actions of Wikileaks and the alleged participation of Bradley Manning" says Executive Director of Iraq Veterans Against the War, Jose Vasquez. Until their abrupt reversal a few weeks ago, the Obama administration had been working hard to maintain between 8000 and 20,000 troops in Iraq after the current Status of Forces agreement was set to expire at the end of this year. Fortunately, the Iraqi government refused to renew the judicial immunity, under which the U.S. Armed Forces had been operating. Establishment news outlets have largely ignored the reason for this sudden change of plans. A few weeks before the negotiations between Washington and Baghdad reached an impasse, WikiLeaks released a cable providing clear evidence that U.S. forces had been engaged in a cover up of the heinous execution of civilian non-combatants following a raid of a suspected insurgent stronghold. "A U.S. diplomatic cable made public by WikiLeaks provides evidence that U.S. troops executed at least 10 Iraqi civilians, including a woman in her 70s and a 5-month-old infant, then called in an airstrike to destroy the evidence, during a controversial 2006 incident in the central Iraqi town of Ishaqi." A definitive review and close reading of medical peer-review journals, and government health statistics shows that American medicine frequently causes more harm than good. The number of people having in-hospital, adverse drug reactions (ADR) to prescribed medicine is 2.2 million. (1) Dr. Richard Besser, of the CDC , in 1995, said the number of unnecessary antibiotics prescribed annually for viral infections was 20 million. Few issues highlight Barack Obama's extreme hypocrisy the way that Bagram does. As everyone knows, one of George Bush's most extreme policies was abducting people from all over the world -- far away from any battlefield -- and then detaining them at Guantanamo with no legal rights of any kind, not even the most minimal right to a habeas review in a federal court. Back in the day, this was called a "Bush's legal black hole." In 2006, Congress codified that policy by enacting the Military Commissions Act, but in 2008, the Supreme Court, in Boumediene v. Bush, ruled that provision unconstitutional, holding that the Constitution grants habeas corpus rights even to foreign nationals held at Guantanamo. Since then, detainees have won 35 out of 48 habeas hearings brought pursuant to Boumediene, on the ground that there was insufficient evidence to justify their detention. Immediately following Boumediene, the Bush administration argued that the decision was inapplicable to detainees at Bagram -- including even those detained outside of Afghanistan but then flown to Afghanistan to be imprisoned. Amazingly, the Bush DOJ -- in a lawsuit brought by Bagram detainees seeking habeas review of their detention -- contended that if they abduct someone and ship them to Guantanamo, then that person (under Boumediene) has the right to a habeas hearing, but if they instead ship them to Bagram, then the detainee has no rights of any kind. In other words, the detainee's Constitutional rights depends on where the Government decides to drop them off to be encaged. One of the first acts undertaken by the Obama DOJ that actually shocked civil libertarians was when, last February, as The New York Times put it, Obama lawyers "told a federal judge that military detainees in Afghanistan have no legal right to challenge their imprisonment there, embracing a key argument of former President Bush's legal team." . . .

On January 26, 2011, Defense Department spokesman Geoff Morrell stood before the Pentagon press corps and made a series of patently false statements about Bradley Manning (the video is here).  Even taking into account the position Morrell occupies -- in which a penchant for telling the truth is not exactly a job requirement (it actually would be disqualifying) -- this Press Conference was an extraordinary display of pure official mendacity.   Morrell was asked several times about the evidence -- first reported here -- that Manning was being held in repressive and inhumane conditions:  specifically, 23-hour/day solitary confinement, a prohibition on exercising in his cell, and being allowed out only 1 hour per day to "exercise" which entails walking around alone in a room, shackled.  Morrell repeatedly insisted that everything being done to Manning was being done to all of the other detainees at the brig; in his words:

The rapid and terrifying acceleration of global warming, which is disfiguring the ecosystem at a swifter pace than even the gloomiest scientific studies predicted a few years ago, has been confronted by the power elite with two kinds of self-delusion. There are those, many of whom hold elected office, who dismiss the science and empirical evidence as false. There are others who accept the science surrounding global warming but insist that the human species can adapt. Our only salvation-the rapid dismantling of the fossil fuel industry-is ignored by both groups. And we will be led, unless we build popular resistance movements and carry out sustained acts of civil disobedience, toward collective self-annihilation by dimwitted pied pipers and fools.

A Senate committee has laid out the evidence. Now the Justice Department should bring criminal charges

On July 25th, for instance, while John Boehner raced around the Capitol desperately pressing Republican House members for votes on a debt-ceiling bill that Harry Reid was calling dead-on-arrival in the Senate, America's new ambassador to Afghanistan, Ryan Crocker, took his oath of office in distant Kabul.  According to the New York Times, he then gave a short speech "warning" that "Western powers needed to 'proceed carefully'" and emphasized that when it came to the war, there would "be no rush for the exits." If, in Washington, people were rushing for those exits, no chance of that in Kabul almost a decade into America's second Afghan War.  There, the air strikes, night raids, assassinations, roadside bombs, and soldier and civilian deaths, we are assured, will continue to 2014 and beyond.  In a war in which every gallon of gas used by a fuel-guzzling US military costs $400 to $800 to import, time is no object and -- despite the panic in Washington over debt payments -- neither evidently is cost.

By executive order on Aug. 4, President Barack Obama refused entry to the United States of war criminals and human-rights violators (jurist.org, Aug. 4). He ignored, as he often does, the deeply documented factual evidence of war crimes committed by the Bush-Cheney administration along with grim proof that the Obama administration also violates our anti-torture laws and the U.N. Convention Against Torture we signed. Take, for example, right now under Obama, "The CIA Secret Sites in Somalia" (the nation.com, July 12).

Government officials and Quantico Marine base have blocked official visits to PFC. Bradley Manning by Rep. Dennis Kucinich, Amnesty International, and the UN Special Rappateur on torture. According to Manning's attorney, Kucinich, Amnesty, and UN have been trying to get clearance for "official visits" to Manning at the Quantico Marine brig. An "official visit" is different from an "authorized visit" in that an "authorized visit" - one made by family or friends and approved by the brig and Manning - is subject to full surveillance by the brig. An official visit would be one conducted by those officials on government business, and would not be subject to monitoring by the brig. So essentially, the government and the brig are saying you can come visit Manning, but we're going to watch and record every thing you say, and those recordings could be used as evidence against Manning at his trial. Manning's attorney stated that Kucinich, Amnesty, and the UN are not allowed to have an official visit "because none of these individuals are conducting 'official government business.'" This is, of course, ludicrous. Rep. Kucinich is a sitting Member of Congress with a seat on the Oversight Committee, and he submitted official notices to the Department of Defense that he wanted to inspect the conditions of Manning's confinement. Additionally, the UN Special Rappateur on Torture has opened an investigation into Manning's detention and would be visiting in his official capacity. What is the government afraid that Manning will say to these officials when the Brig isn't able to record his every move? If Manning's torture is "meeting our basic standards," as President Obama says, what is there to hide?

Numerous media outlets -- The New York Times, The Washington Post, The Guardian, The Telegraph, and NPR, among others - last night published classified files on more than 700 past and present Guantanamo detainees. The leak was originally provided to WikiLeaks, which then gave them to the Post, NPR and others; the NYT and The Guardian claim to have received them from "another source" (WikiLeaks suggested the "other source" was Daniel Domscheit-Berg, a former WikiLeaks associate who WikiLeaks claims took, without authorization, many WikiLeaks files when he left). The documents reveal vast new information about these detainees and, in particular, the shoddy and unreliable nature of the "evidence" used (both before and now) to justify their due-process-free detentions. There are several points worth noting about all this:

t's increasingly clear that the operation was a planned assassination, multiply violating elementary norms of international law. There appears to have been no attempt to apprehend the unarmed victim, as presumably could have been done by 80 commandos facing virtually no opposition - except, they claim, from his wife, who lunged towards them. In societies that profess some respect for law, suspects are apprehended and brought to fair trial. I stress "suspects." In April 2002, the head of the FBI, Robert Mueller, informed the press that after the most intensive investigation in history, the FBI could say no more than that it "believed" that the plot was hatched in Afghanistan, though implemented in the UAE and Germany. What they only believed in April 2002, they obviously didn't know 8 months earlier, when Washington dismissed tentative offers by the Taliban (how serious, we do not know, because they were instantly dismissed) to extradite bin Laden if they were presented with evidence - which, as we soon learned, Washington didn't have. Thus Obama was simply lying when he said, in his White House statement, that "we quickly learned that the 9/11 attacks were carried out by al Qaeda." Nothing serious has been provided since. There is much talk of bin Laden's "confession," but that is rather like my confession that I won the Boston Marathon. He boasted of what he regarded as a great achievement.

What Really Happened? Stella Liebeck, 79-years-old, was sitting in the passenger seat of her grandson's car having purchased a cup of McDonald's coffee. After the car stopped, she tried to hold the cup securely between her knees while removing the lid. However, the cup tipped over, pouring scalding hot coffee onto her lap. She received third-degree burns over 16 percent of her body, necessitating hospitalization for eight days, whirlpool treatment for debridement of her wounds, skin grafting, scarring, and disability for more than two years. Despite these extensive injuries, she offered to settle with McDonald's for $20,000. However, McDonald's refused to settle for this small amount and, in fact, never offered more than $800. The jury awarded Liebeck $200,000 in compensatory damages - reduced to $160,000 because the jury found her 20 percent at fault - and $2.7 million in punitive damages for McDonald's callous conduct. (To put this in perspective, McDonald's revenue from coffee sales alone was in excess of $1.3 million a day.) The trial judge reduced the punitive damages to $480,000, but did state that McDonald's had engaged in "willful, wanton, and reckless" behavior. Mrs. Liebeck and McDonald's eventually settled for a confidential amount. The jury heard the following evidence in the case: McDonald's Operations Manual required the franchisee to hold its coffee at 180 to 190 degrees Fahrenheit; Coffee at that temperature, if spilled, causes third-degree burns (the worst kind of burn) in three to seven seconds; Third-degree burns do not heal without skin grafting, debridement and whirlpool treatments that cost tens of thousands of dollars and result in permanent disfigurement, extreme pain and disability of the victim for many months, and in some cases, years; The chairman of the department of mechanical engineering and bio-mechanical engineering at the University of Texas testified that this risk of harm is unacceptable, as did a wid

Two weeks after the U.S. killed American citizen Anwar Awlaki with a drone strike in Yemen - far from any battlefield and with no due process - it did the same to his 16-year-old son, Abdulrahman al-Awlaki, ending the teenager's life on Friday along with his 17-year-old cousin and seven other people. News reports, based on government sources, originally claimed that Awlaki's son was 21 years old and an Al Qaeda fighter (needless to say, as Terrorist often means: "anyone killed by the U.S."), but a birth certificate published by The Washington Post proved that he was born only 16 years ago in Denver. As The New Yorker's Amy Davidson wrote: "Looking at his birth certificate, one wonders what those assertions say either about the the quality of the government's evidence - or the honesty of its claims - and about our own capacity for self-deception." The boy's grandfather said that he and his cousin were at a barbecue and preparing to eat when the U.S. attacked them by air and ended their lives. There are two points worth making about this:
