CMA fines Pfizer and Flynn £70 million for inflating price - 0 views

    Britain's competition watchdog has fined pharmaceutical companies Pfizer and Flynn £63 million and £6.7 million respectively for allegedly breaking competition law and illegally profiting from the sale of an anti-epilepsy drug. The Competition and Markets Authority (CMA) found that the two companies colluded to sell phenytoin sodium capsules, previously known as Epanutin, at "unfairly high prices" for over four over years between 2012 and 2016. The annual costs of the capsules for the NHS increased from £2 million in 2012 to approximately £50 million the following year. CMA has accused Pfizer of charging, over four years, prices between 780 per cent and 1,600 per cent higher than what was fixed previously for the medicine used to prevent life-threatening epileptic seizures. Pfizer supplied the drug to Flynn, which then sold the capsules on to wholesalers and pharmacies at a price between 2,300 per cent and 2,600 per cent higher than the prices previously charged by Pfizer.

    Pharmacist supervision has been the subject of debate for as long as I can remember. Strikingly, no one is sure what supervision requires. The Human Medicines Regulations 2012 say it is a criminal offence to sell or supply Pharmacy medicines or Prescription Only Medicines unless a pharmacist makes the sale or supply or, if the transaction is carried out by a non-pharmacist, that person acts under the supervision of a pharmacist. Over the years, some people have argued that supervision requires a clinical check. Others say it requires an accuracy assessment. Yet others have asserted that it requires a final check before a medicine leaves the pharmacy. Things are made more uncertain by the NHS terms of service which require prescription medicines to be supplied under the direct supervision of a pharmacist. No one knows what the word "direct" adds. The wording of the Human Medicines Regulations is not identical to the wording of earlier legislation. In particular, on the only occasions when the courts have been called upon to interpret the requirement for supervision, the Pharmacy and Poisons Act 1933 was in force. In cases decided in 1943 and 1953, the courts decided that a pharmacist who was upstairs when a supply was made could not have been supervising; and that a sale was supervised by pharmacist standing at the cash desk because the pharmacist could intervene if a sale would not be appropriate.

    The Department of Health and Social Care aims to amend the Human Medicines Regulations 2012, thereby enabling pharmacy technicians to provide and administer specific medicines through a patient group direction. In line with this initiative, the Department introduced a six-week consultation to assess whether registered pharmacy technicians should be authorised to dispense medicines using a PGD. The proposals, backed by all four Home Nations, apply exclusively to registered pharmacy technicians. Meanwhile, this coverage will extend to include pharmacy technicians in Northern Ireland upon their achievement of registered professional status. "The proposed statutory instrument, presently applicable in England, Scotland, and Wales would offer 'clear benefits,' especially in areas such as vaccination and the provision of oral contraception and EHC," the DHSC said. According to the Department, facilitating registered pharmacy technicians to execute PGDs might amplify their workload, yet it could simultaneously enhance overall efficiency and cost-effectiveness for pharmacy teams by optimising the utilisation of skill diversity.

    Skelmersdale-based online pharmacy Chemist4U has secured a £12 million investment from Pitalia Capital, an equity investment company led by Anil Pitalia. Chemist4U is part of JCCO Healthcare, which also houses the weight management platform myBMI. Anil Pitalia is a health enthusiast, who heads SpaMedica, a company providing cataract surgery to the NHS. This investment will propel the group's expansion, with John Davies, Managing Partner of Pitalia Capital, joining the board, the company said. "Our goal is for Chemist4U to emerge as one of the largest NHS dispensing facilities in the country, while also providing vital support to our partners through our rapidly expanding outsourced dispensing services division," said said James O'Loan, Chief Executive Officer of both Chemist4U and myBMI, who joined Chemist4U as a superintendent pharmacist in 2012 before becoming CEO in 2018.     A couple in Maidenhead, Berkshire has been handed suspended sentence for illegal possession and supply of £1.6m of unlicensed medicines. Following investigations initiated by the MHRA, Karina Filimonova and Andrejs Stolarovs were caught with the unlicensed medicines which included prescription-only medications. Southwark Crown Court sentenced each "to eight months imprisonment suspended for 18 months and 150 hours unpaid work" for possessing and intending to supply medicinal products contrary to the Human Medicines Regulations 2012. "This was a sophisticated operation illegally bringing unlicensed medicines into the UK from Singapore and India, and then distributing them across the country and abroad," said Andy Morling, MHRA Deputy Director of Criminal Enforcement. "Criminals trading in medicines illegally like this are not only breaking the law, but they also have no regard for your safety. These are powerful medicines that can lead to serious adverse health consequences if taken without appropriate medical supervision." In 2020, the Royal Mail Group (RMG) informed the MHRA about parcels containing unlicensed medicines discovered during their investigation into suspicious parcel activity. Following this, the MHRA's Criminal Enforcement Unit, in cooperation with local police, launched an investigation and apprehended the couple at their residence in Kidwells Close, Maidenhead.

    A pharmacy assistant has been jailed for three years and seven months for stealing £330,000 worth of diabetes-testing kits from his workplace. Abdul Nargoliya stole the products while working as a pharmacy assistant at a Lloydspharmacy counter inside a Sainsbury's supermarket in Fosse Park, Leicester where we was employed since 2012. The 30-year-old from Woodboy Street in Leicester was sentenced on Friday (May 26) after pleading guilty at Leicester Crown Court "to theft by an employee and concealing, transferring, converting criminal property". According to police an internal investigation launched at the pharmacy branch in July 2018 revealed that more than 22,000 test kits had been ordered since January 2017. Leicester Police said they identified Nargoliya as a suspect due to the time of the orders being placed matching up to his shift patterns. They arrested him in July 2018. Orders for the products were placed by telephone and CCTV footage showed Nargoliya handling them. It was noticed that during his shifts, the defendant would move the deliveries into a private consultation room and later leave with full carrier bags.

They also seized thousands of illegal medicines from two business addresses in Bury and Miles Platting, including powerful opioid painkillers and antidepressants, as well as unlicensed versions of erectile dysfunction drugs.

    The Department of Health and Social Care (DSHC) has launched a consultation to seek views on changes to pharmacy supervision, which is being considered as part of the Primary Care Recovery Plan. Plans set out in the consultation include making better use of pharmacies, improving access to primary care and maximising the contribution of pharmacy professionals across healthcare. In the consultation, the DSHC has set out proposals to amend the Medicines Act 1968 and The Human Medicines Regulations 2012. PSNC: Enable Original Pack Dispensing By Pharmacists - 0 views

    Pharmaceutical Services Negotiating Committee (PSNC) has expressed its support for alterations in the Human Medicines Regulations 2012 to enable original pack dispensing (OPD) and supply of medicines containing sodium valproate by pharmacists. PSNC's support for changes was in response to the consultation on OPD, initiated by the Department of Health and Social Care (DHSC). The consultation had proposed regulatory changes to allow pharmacists to dispense (up to 10 per cent) more or less than the prescribed quantity of a given medicine in the manufacturer's original packs. Key aims of the proposal are to "support increased patient safety by ensuring patients receive the necessary information that is included in the original manufacturer's packaging about the safe and effective use of a product," DHSC said.
