  • The European Union slapped Meta with a record $1.3 billion privacy fine Monday and ordered it to stop transferring user data across the Atlantic, the latest salvo in a decadelong case sparked by U.S. cybersnooping fears. The penalty fine of 1.2 billion euros from Ireland’s Data Protection Commission is the biggest since the EU’s strict data privacy regime took effect five years ago, surpassing Amazon’s 746 million euro penalty in 2021 for data protection violations. The Irish watchdog is Meta’s lead privacy regulator in the 27-nation bloc because the Silicon Valley tech giant’s European headquarters is based in Dublin. Meta, which had previously warned that services for its users in Europe could be cut off, vowed to appeal and ask courts to immediately put the decision on hold.

Google and Facebook fined $240 million for making cookies hard to refuse | Malwarebytes... - 0 views

  • French privacy watchdog, the Commission Nationale de l’Informatique et des Libertés (CNIL), has hit Google with a 150 million euro fine and Facebook with a 60 million euro fine, because their websites—google.fr, youtube.com, and facebook.com—don’t make refusing cookies as easy as accepting them. The CNIL carried out an online investigation after receiving complaints from users about the way cookies were handled on these sites. It found that while the sites offered buttons for allowing immediate acceptance of cookies, the sites didn’t implement an equivalent solution to let users refuse them. Several clicks were required to refuse all cookies, against a single one to accept them. In addition to the fines, the companies have been given three months to provide Internet users in France with a way to refuse cookies that’s as simple as accepting them. If they don’t, the companies will have to pay a penalty of 100,000 euros for each day they delay.
  • EU data protection regulators’ powers have increased significantly since the General Data Protection Regulation (GDPR) took effect in May 2018. This EU law allows watchdogs to levy penalties of as much as 4% of a company’s annual global sales. The restricted committee, the body in charge of sanctions, considered that the process regarding cookies affects the freedom of consent of Internet users and constitutes an infringement of the French Data Protection Act, which demands that it should be as easy to refuse cookies as to accept them. Since March 31, 2021, when the deadline set for websites and mobile applications to comply with the new rules on cookies expired, the CNIL has adopted nearly 100 corrective measures (orders and sanctions) related to non-compliance with the legislation on cookies.

  • The most powerful company on the Internet just got a whole lot creepier: a new service from Google merges offline consumer info with online intelligence, allowing advertisers to target users based on what they do at the keyboard and at the mall. Without much fanfare, Google announced news this week of a new advertising project, Conversions API, that will let businesses build all-encompassing user profiles based off of not just what users search for on the Web, but what they purchase outside of the home. In a blog post this week on Google’s DoubleClick Search site, the Silicon Valley giant says that targeting consumers based off online information only allows advertisers to learn so much. “Conversions,” tech-speak for the digital metric made by every action a user makes online, are incomplete until coupled with real life data, Google says.
  • Of course, there is always the possibility that all of this information can be unencrypted and, in some cases, obtained by third-parties that you might not want prying into your personal business. Edwards notes in his report that Google does not explicitly note that intelligence used in Conversions API will be anonymized, but the blowback from not doing as much would sure be enough to start a colossal uproar. Meanwhile, however, all of the information being collected by Google — estimated to be on millions of servers around the globe — is being handed over to more than just advertising companies. We're Halfway to Encrypting the Entire Web | Electronic Frontier Foundation - 0 views

  • The movement to encrypt the web has reached a milestone. As of earlier this month, approximately half of Internet traffic is now protected by HTTPS. In other words, we are halfway to a web safer from the eavesdropping, content hijacking, cookie stealing, and censorship that HTTPS can protect against. Mozilla recently reported that the average volume of encrypted web traffic on Firefox now surpasses the average unencrypted volume
  • Google Chrome’s figures on HTTPS usage are consistent with that finding, showing that over 50% of of all pages loaded are protected by HTTPS across different operating systems.

  • Starting in 2010, EFF members have pushed tech companies to follow crypto best practices. We applauded when Facebook and Twitter implemented HTTPS by default, and when Wikipedia and several other popular sites later followed suit. Google has also put pressure on the tech community by using HTTPS as a signal in search ranking algorithms and, starting this year, showing security warnings in Chrome when users load HTTP sites that request passwords or credit card numbers. EFF’s Encrypt the Web Report also played a big role in tracking and encouraging specific practices. Recently other organizations have followed suit with more sophisticated tracking projects. For example, Secure the News and Pulse track HTTPS progress among news media sites and U.S. government sites, respectively.
  • But securing large, popular websites is only one part of a much bigger battle. Encrypting the entire web requires HTTPS implementation to be accessible to independent, smaller websites. Let’s Encrypt and Certbot have changed the game here, making what was once an expensive, technically demanding process into an easy and affordable task for webmasters across a range of resource and skill levels. Let’s Encrypt is a Certificate Authority (CA) run by the Internet Security Research Group (ISRG) and founded by EFF, Mozilla, and the University of Michigan, with Cisco and Akamai as founding sponsors. As a CA, Let’s Encrypt issues and maintains digital certificates that help web users and their browsers know they’re actually talking to the site they intended to. CAs are crucial to secure, HTTPS-encrypted communication, as these certificates verify the association between an HTTPS site and a cryptographic public key. Through EFF’s Certbot tool, webmasters can get a free certificate from Let’s Encrypt and automatically configure their server to use it. Since we announced that Let’s Encrypt was the web’s largest certificate authority last October, it has exploded from 12 million certs to over 28 million. Most of Let’s Encrypt’s growth has come from giving previously unencrypted sites their first-ever certificates. A large share of these leaps in HTTPS adoption are also thanks to major hosting companies and platforms--like WordPress.com, Squarespace, and dozens of others--integrating Let’s Encrypt and providing HTTPS to their users and customers.
  • Unfortunately, you can only use HTTPS on websites that support it--and about half of all web traffic is still with sites that don’t. However, when sites partially support HTTPS, users can step in with the HTTPS Everywhere browser extension. A collaboration between EFF and the Tor Project, HTTPS Everywhere makes your browser use HTTPS wherever possible. Some websites offer inconsistent support for HTTPS, use unencrypted HTTP as a default, or link from secure HTTPS pages to unencrypted HTTP pages. HTTPS Everywhere fixes these problems by rewriting requests to these sites to HTTPS, automatically activating encryption and HTTPS protection that might otherwise slip through the cracks.

As Belgium threatens fines, Facebook's defence of tracking visitors rings hollow | nsnb... - 0 views

  • Facebook has been ordered by a Belgian court to stop tracking non-Facebook users when they visit the Facebook site. Facebook has been given 48 hours to stop the tracking or face possible fines of up to 250,000 Euro a day.
  • Facebook has said that it will appeal the ruling, claiming that since their european headquarters are situated in Ireland, they should only be bound by the Irish Data Protection Regulator. Facebook’s chief of security Alex Stamos has posted an explanation about why non-Facebook users are tracked when they visit the site. The tracking issue centres around the creation of a “cookie” called “datr” whenever anyone visits a Facebook page. This cookie contains an identification number that identifies the same browser returning each time to different Facebook pages. Once created, the cookie will last 2 years unless the user explicitly deletes it. The cookie is created for all visitors to Facebook, irrespective of whether they are a Facebook user or even whether they are logged into Facebook at the time. According to Stamos, the measure is needed to: Prevent the creation of fake and spammy accounts Reduce the risk of someone’s account being taken over by someone else Protect people’s content from being stolen Stopping denial of service attacks against Facebook
  • The principle behind this is that if you can identify requests that arrive at the site for whatever reason, abnormal patterns may unmask people creating fake accounts, hijacking a real account or just issuing so many requests that it overwhelms the site. Stamos’ defence of tracking users is that they have been using it for the past 5 years and nobody had complained until now, that it was common practice and that there was little harm because the data was not collected for any purpose other than security. The dilemma raised by Facebook’s actions is a common one in the conflicting spheres of maintaining privacy and maintaining security. It is obvious that if you can identify all visitors to a site, then it is possible to determine more information about what they are doing than if they were anonymous. The problem with this from a moral perspective is that everyone is being tagged, irrespective of whether their intent was going to be malicious or not. It is essentially compromising the privacy of the vast majority for the sake of a much smaller likelihood of bad behaviour.

Wiretap Numbers Don't Add Up | Just Security - 0 views

  • Last week, the Administrative Office (AO) of the US Courts published the 2014 Wiretap Report, an annual report to Congress concerning intercepted wire, oral, or electronic communications as required by Title III of the Omnibus Crime Control and Safe Streets Act of 1968. News headlines touted that the number of federal and state wiretaps for 2014 was down 1% for a total of 3,554. Of these, there were few involving encrypted communications; and for those, law enforcement agencies were in most cases able to overcome the encryption. But there is a bigger story that calls into question the accuracy of the all of the prior reports submitted to the AO and the overall data provided to Congress and the public in the Wiretap Reports. Since the Snowden revelations, more and more companies have started publishing “transparency reports” about the number and nature of government demands to access their users’ data. AT&amp;T, Verizon, and Sprint published data for 2014 earlier this year and T-Mobile published its first transparency report on the same day the AO released the Wiretap Report. In aggregate, the four companies state that they implemented 10,712 wiretaps, a threefold difference over the total number reported by the AO. Note that the 10,712 number is only for the four companies listed above and does not reflect wiretap orders received by other telephone carriers or online providers, so the discrepancy actually is larger.
  • So what accounts for the huge gap in reporting? That is a question Congress and the AO should be asking prosecutors and judges who are required by law to make complete and accurate reports of the number of wiretaps conducted each year. Are wiretaps being consistently under­reported to Congress and the public? Based on the data reported by the four major carriers for 2013 and 2014, it certainly would appear to be the case.

  • The Berkeley City Council is poised to vote March 13 on the Surveillance Technology Use and Community Safety Ordinance, which will significantly protect people's right to privacy and safeguard the civil liberties of Berkeley residents in this age of surveillance and Big Data. The ordinance is based on an ACLU model that was first enacted by Santa Clara County in 2016. The Los Angeles Times has editorialized that the ACLU's model ordinance approach "is so pragmatic that cities, counties, and law enforcement agencies throughout California would be foolish not to embrace it." Berkeley's Peace and Justice and Police Review commissions agreed and unanimously approved a draft that will be presented to the council on Tuesday. The ordinance requires public notice and public debate prior to seeking funding, acquiring equipment, or otherwise moving forward with surveillance technology proposals. In neighboring Oakland, we saw the negative outcome that can occur from lack of such a discussion, when the city's administration pursued funding for, and began building, the citywide surveillance network known as the Domain Awareness Center ("DAC") without community input.   • Theresa May is planning to introduce huge regulations on the way the internet works, allowing the government to decide what is said online. Particular focus has been drawn to the end of the manifesto, which makes clear that the Tories want to introduce huge changes to the way the internet works. "Some people say that it is not for government to regulate when it comes to technology and the internet," it states. "We disagree." Senior Tories confirmed to BuzzFeed News that the phrasing indicates that the government intends to introduce huge restrictions on what people can post, share and publish online. The plans will allow Britain to become "the global leader in the regulation of the use of personal data and the internet", the manifesto claims. It comes just soon&nbsp;after the Investigatory Powers Act came into law. That legislation allowed the government to force internet companies to keep&nbsp;records on their customers' browsing histories, as well as giving ministers the power to break apps like WhatsApp so that messages can be read. The manifesto makes reference to those increased powers, saying that the government will work even harder to ensure there is no "safe space for terrorists to be able to communicate online". That is apparently a reference in part to its work to encourage technology companies to build backdoors into their encrypted messaging services – which gives the government the ability to read terrorists' messages, but also weakens the security of everyone else's messages, technology companies have warned.
  • The government now appears to be launching a similarly radical change in the way that social networks and internet companies work. While much of the internet is currently controlled by private businesses like Google and Facebook, Theresa May intends to allow government to decide what is and isn't published, the manifesto suggests. The new rules would include laws that make it harder than ever to access pornographic and other websites. The government will be able to place restrictions on seeing adult content and any exceptions would have to be justified to ministers, the manifesto suggests. The manifesto even suggests that the government might stop search engines like Google from directing people to pornographic websites. "We will put a responsibility on industry not to direct users – even unintentionally – to hate speech, pornography, or other sources of harm," the Conservatives write.
  • The laws would also force technology companies to delete anything that a person posted when they were under 18. But perhaps most unusually they would be forced to help controversial government schemes like its Prevent strategy, by promoting counter-extremist narratives. "In harnessing the digital revolution, we must take steps to protect the vulnerable and give people confidence to use the internet without fear of abuse, criminality or exposure to horrific content", the manifesto claims in a section called 'the safest place to be online'. The plans are in keeping with the Tories' commitment that the online world must be regulated as strongly as the offline one, and that the same rules should apply in both. "Our starting point is that online rules should reflect those that govern our lives offline," the Conservatives' manifesto says, explaining this justification for a new level of regulation. "It should be as unacceptable to bully online as it is in the playground, as difficult to groom a young child on the internet as it is in a community, as hard for children to access violent and degrading pornography online as it is in the high street, and as difficult to commit a crime digitally as it is physically."

Just like with gambling, that money will be used to pay for advertising schemes to tell people about the dangers of the internet, in particular being used to "support awareness and preventative activity to counter internet harms", according to the manifesto. The Conservatives will also seek to regulate the kind of news that is posted online and how companies are paid for it. If elected, Theresa May will "take steps to protect the reliability and objectivity of information that is essential to our democracy" – and crack down on Facebook and Google to ensure that news companies get enough advertising money. If internet companies refuse to comply with the rulings – a suggestion that some have already made about the powers in the Investigatory Powers Act – then there will be a strict and strong set of ways to punish them. "We will introduce a sanctions regime to ensure compliance, giving regulators the ability to fine or prosecute those companies that fail in their legal duties, and to order the removal of content where it clearly breaches UK law," the manifesto reads. In laying out its plan for increased regulation, the Tories anticipate and reject potential criticism that such rules could put people at risk.

    Normally, I'd be suspicious of anything published by Infowars because its editors are willing to publish really over the top stuff, but: [i] this is subject matter I've maintained an interest in over the years and I was aware that working quantum computers were imminent; and [ii] the pedigree on this particular information does not trace to Scientific American, as stated in the article. I've known Scientific American to publish at least one soothing and lengthy article on the subject of chlorinated dioxin hazard -- my specialty as a lawyer was litigating against chemical companies that generated dioxin pollution -- that was generated by known closet chemical industry advocates long since discredited and was totally lacking in scientific validity and contrary to established scientific knowledge. So publication in Scientific American doesn't pack a lot of weight with me. But checking the Scientific American linked article, notes that it was reprinted by permission from Nature, a peer-reviewed scientific journal and news organization that I trust much more. That said, the InfoWars version is a rewrite that contains lots of information not in the Nature/Scientific American version of a sensationalist nature, so heightened caution is still in order.   • Vitaly Milnov, generally known for being ultra-conservative, introduced the controversial bill on Monday. Touting the bill under the banner of wanting to protect children and limit their access to social media the bill has far deeper implications. Parents could very well self-regulate their children’s access to social media. The bill, however, implies that it would become mandatory for social media users to submit their passport data. Moreover, the bill also proposes that the use of pseudonyms will be banned. The proposed legislation also aims to introducing strict rules, requiring two-party consent before the publication of screenshots of online correspondence. The bill reads, among others: “Social networks create a special virtual world where a person spends significant part of their life, contacting other people and essentially doing everything that they would do in real world. This&nbsp;world can’t be left unregulated by law. Especially now, when growing number of users are falling victim to different types of fraud.” Even though Milonov is generally viewed as ultra-conservative, there are about 62 percent of Russians who according to polls support the ban of social networks for children while 39 percent supported using passport data to create an online account, a poll by the state-funded pollster&nbsp;VTsIOM revealed Monday.

Disturbingly, there are very few Russians who have received independent information about the not so overtly advertised implications of this scrutiny, of the proposed bill, and of plans to create a “Russian internet” to filter “unwanted foreign content. Russia also cracks down on independent bloggers and journalists. On January 1, 2016 the Russian Federation implemented amendments to laws&nbsp;that further censor the internet and potentially independent media. These laws are being sold under the guise of empowering internet users and the right to protect personal information. The amendments follow legislation from 2014 that infringed on the rights of bloggers.

The&nbsp;Associated Press&nbsp;sought the help of Princeton researchers to prove that while Google is clear and upfront about giving App users the ability to turn off or "pause" Location History on their devices, there are other hidden means through which it retains the data.

Google’s&nbsp;support page on the subject&nbsp;states: “You can turn off Location History at any time. With Location History off, the places you go are no longer stored.” That isn’t true. Even with Location History paused, some Google apps automatically&nbsp;store time-stamped location data&nbsp;without asking. For example, Google stores a snapshot of where you are when you merely open its Maps app. Automatic daily weather updates on Android phones pinpoint roughly where you are. And some searches that have nothing to do with location, like “chocolate chip cookies,” or “kids science kits,” pinpoint your precise latitude and longitude — accurate to the square foot — and save it to your Google account. The issue directly affects around two billion people using Google's Android operating software and iPhone users relying on Google maps or a simple search. Among the computer science researchers at Princeton conducting the tests is&nbsp;Jonathan Mayer, who told the AP,&nbsp;“If you’re going to allow users to turn off something called ‘Location History,’ then all the places where you maintain location history should be turned off,” and added,&nbsp;“That seems like a pretty straightforward position to have.”

  • Ever wonder why most e-mail clients hide images by default? The reason for the "display images" button is because images in an e-mail must be loaded from a third-party server. For promotional e-mails and spam, usually this server is operated by the entity that sent the e-mail. So when you load these images, you aren't just receiving an image—you're also sending a ton of data about yourself to the e-mail marketer. Loading images from these promotional e-mails reveals a lot about you. Marketers get a rough idea of your location via your IP address. They can see the&nbsp;HTTP referrer, meaning the URL of the page that requested the image. With the referral data, marketers can see not only what client you are using (desktop app, Web, mobile, etc.) but also what folder you were viewing the e-mail in. For instance, if you had a Gmail folder named "Ars Technica" and loaded e-mail images, the referral URL would be "https://mail.google.com/mail/u/0/#label/Ars+Technica"—the folder is right there in the URL. The same goes for the inbox, spam, and any other location. It's even possible to uniquely identify each e-mail, so marketers can tell which e-mail address requested the images—they know that you've read the e-mail. And if it was spam, this will often earn you more spam since the spammers can tell you've read their last e-mail.
  • But Google&nbsp;has just announced&nbsp;a move that will shut most of these tactics down: it will cache all images for Gmail users.&nbsp;Embedded images will now be saved by Google, and the e-mail content will be modified to display those images from Google's cache, instead of from a third-party server. E-mail marketers will no longer be able to get any information from images—they will see a single request from Google, which will then be used to send the image out to all Gmail users. Unless you click on a link, marketers will have no idea the e-mail has been seen.&nbsp;While this means improved privacy from e-mail marketers, Google will now be digging deeper than ever into your e-mails and literally modifying the contents. If you were worried about e-mail scanning,&nbsp;this may take things a step further. However, if you don't like the idea of cached images, you can turn it off in the settings. This move will allow Google to automatically display images, killing the "display all images" button in Gmail. Google servers should also be faster than the usual third-party image host. Hosting all images sent to all Gmail users sounds like a huge bandwidth and storage undertaking, but if anyone can do it, it's Google. The new image handling will rollout to desktop users today, and it should hit mobile apps sometime in early 2014. There's also a bonus side effect for Google: e-mail marketing is advertising. Google exists because of advertising dollars, but they don't do e-mail marketing. They've just made a competitive form of advertising much less appealing and informative to advertisers. No doubt Google hopes this move pushes marketers to spend less on e-mail and more on Adsense.

  • A judge has approved a settlement valued at $650 million from Facebook to end a privacy lawsuit, one which alleged the social network used facial recognition technology on user photos stored on its iPhone app without permission. The lawsuit, which started in April 2015, alleged Facebook did not gain consent from users to use its facial tagging features on their photographs. Originally filed by Chicago attorney Jay Edelson on behalf of plaintiff Carlo Licata, the complaint claimed the consent-less tagging was not allowed under privacy laws in Illinois. The case originated in Cook County Circuit Court before moving to Chicago federal court then California, reports the Chicago Tribune. On reaching California, the lawsuit attained class-action status. The class in question constitutes approximately 6.9 million Facebook users in Illinois that Facebook created and stored a face template for after June 7, 2011. Close to 1.6 million claim forms were filed ahead of the November 23 deadline for joining, making up roughly 22% of potential class members. Facebook went against the Illinois Biometric Information Privacy Act, the complaint alleged, which is among the toughest privacy laws in the United States. Part of the act requires companies to gain permission from users before being able to start using biometric systems with their data, which includes facial recognition systems.
