  • The fair use doctrine permits the unauthorized digitization of copyrighted works in order to create a full-text searchable database, the U.S. Court of Appeals for the Second Circuit ruled June 10.Affirming summary judgment in favor of a consortium of university libraries, the court also ruled that the fair use doctrine permits the unauthorized conversion of those works into accessible formats for use by persons with disabilities, such as the blind.
  • The dispute is connected to the long-running conflict between Google Inc. and various authors of books that Google included in a mass digitization program. In 2004, Google began soliciting the participation of publishers in its Google Print for Publishers service, part of what was then called the Google Print project, aimed at making information available for free over the Internet.Subsequently, Google announced a new project, Google Print for Libraries. In 2005, Google Print was renamed Google Book Search and it is now known simply as Google Books. Under this program, Google made arrangements with several of the world's largest libraries to digitize the entire contents of their collections to create an online full-text searchable database.The announcement of this program triggered a copyright infringement action by the Authors Guild that continues to this day.
  • Part of the deal between Google and the libraries included an offer by Google to hand over to the libraries their own copies of the digitized versions of their collections.In 2011, a group of those libraries announced the establishment of a new service, called the HathiTrust digital library, to which the libraries would contribute their digitized collections. This database of copies is to be made available for full-text searching and preservation activities. Additionally, it is intended to offer free access to works to individuals who have “print disabilities.” For works under copyright protection, the search function would return only a list of page numbers that a search term appeared on and the frequency of such appearance.

  • Turning to the fair use question, the court first concluded that the full-text search function of the Hathitrust Digital Library was a “quintessentially transformative use,” and thus constituted fair use. The court said:the result of a word search is different in purpose, character, expression, meaning, and message from the page (and the book) from which it is drawn. Indeed, we can discern little or no resemblance between the original text and the results of the HDL full-text search.There is no evidence that the Authors write with the purpose of enabling text searches of their books. Consequently, the full-text search function does not “supersede[ ] the objects [or purposes] of the original creation.”Turning to the fourth fair use factor—whether the use functions as a substitute for the original work—the court rejected the argument that such use represents lost sales to the extent that it prevents the future development of a market for licensing copies of works to be used in full-text searches.However, the court emphasized that the search function “does not serve as a substitute for the books that are being searched.”
  • The court also rejected the argument that the database represented a threat of a security breach that could result in the full text of all the books becoming available for anyone to access. The court concluded that Hathitrust's assertions of its security measures were unrebutted.Thus, the full-text search function was found to be protected as fair use.
  • The court also concluded that allowing those with print disabilities access to the full texts of the works collected in the Hathitrust database was protected as fair use. Support for this conclusion came from the legislative history of the Copyright Act's fair use provision, 17 U.S.C. §107.

  • Journalist Glenn Greenwald just dropped a pile of new secret National Security Agency documents onto the Internet. But this isn’t just some haphazard WikiLeaks-style dump. These documents, leaked to Greenwald last year by former NSA contractor Edward Snowden, are key supplemental reading material for his new book, No Place to Hide, which went on sale Tuesday. Now, you could just go buy the book in hardcover and read it like you would any other nonfiction tome. Thanks to all the additional source material, however, if any work should be read on an e-reader or computer, this is it. Here are all the links and instructions for getting the most out of No Place to Hide.
  • Greenwald has released two versions of the accompanying NSA docs: a compressed version and an uncompressed version. The only difference between these two is the quality of the PDFs. The uncompressed version clocks in at over 91MB, while the compressed version is just under 13MB. For simple reading purposes, just go with the compressed version and save yourself some storage space. Greenwald also released additional “notes” for the book, which are just citations. Unless you’re doing some scholarly research, you can skip this download.

Pick your e-poison: Amazon, Nook, Kobo, iBooks. Flipping back and forth Each page of the documents includes a corresponding page number for the book, to allow readers to easily flip between the book text and the supporting documents. If you use the Amazon Kindle version, you also have the option of reading Greenwald’s book directly on your computer using the Kindle for PC app or directly in your browser. Yes, that may be the worst way to read a book. In this case, however, it may be the easiest way to flip back and forth between the book text and the notes and supporting documents. Of course, you can do the same on your e-reader—though it can be a bit of a pain. Those of you who own a tablet are in luck, as they provide the best way to read both ebooks and PDF files. Simply download the book using the e-reader app of your choice, download the PDFs from Greenwald’s website, and dig in. If you own a Kindle, Nook, or other ereader, you may have to convert the PDFs into a format that works well with your device. The Internet is full of tools and how-to guides for how to do this.   • As part of an effort to make encryption a standard component of every application, the Linux Foundation has launched the Let's Encrypt project (announcement) and stated its intention to provide access to a free certificate management service. Jim Zemlin, executive director for the Linux Foundation, says the goal for the project is nothing less than universal adoption of encryption to disrupt a multi-billion dollar hacker economy. While there may never be such a thing as perfect security, Zemlin says it's just too easy to steal data that is not encrypted. In its current form, encryption is difficult to implement and a lot of cost and overhead is associated with managing encryption keys. Zemlin claims the Let's Encrypt project will reduce the effort it takes to encrypt data in an application down to two simple commands. The project is being hosted by the Linux Foundation, but the actual project is being managed by the Internet Security Research Group.     The blurb is a bit misleading. This is a project that's been under way since last year; what's new is that they're moving under the Linux Foundation umbrella for various non-technical suoport purposes. By sometime this summer, encrypting web site data and broadcasting it over https is  slated to become a two-click process. Or on the linux command line: $ sudo apt-get install lets-encrypt $ lets-encrypt example.com This is a project that grew out of public disgust with NSA surveillance, designed to flood the NSA (and other bad actors) with so much encrypted data that they will be able to decrypt only a tiny fraction (decryption without the decryption key takes gobs of computer cycles).  The other half of the solution is already available, the HTTPS Everywhere extension for the Chrome, FIrefox, and Opera web browsers by the Electronic Frontier Foundation and the TOR Project that translates your every request for a http address into an effort to connect to an https address preferentially before establishing an http connection if https is not available. The Kablink project is Novell's effort to grow the market for open source collaboration solutions, and chip away at the hold that Microsoft's Sharepoint commands among small business users.
  • "We have a system inside of Kablink that allows developers to create business objects and these business objects model data," McConnell explained. "Then with the model of the data you can pass it views for forms and displaying the business model. So you can model a business object and then add collaboration items for that object." With the Kablink release, workflow capability is being added to the ICEcore collaboration features. A business user can now create a business workflow for a process -- be it approval, development or otherwise and attach that workflow to the business objects.
  • "We think our offering is unique; there are point solutions that have workflow embedded in them but the kind of social networking collaboration that we do, I don't know anyone that has a workflow component that can do the things that we can," McConnell claimed. "There are customers that have designed ISO 9000 processes with this, so it's a nifty thing to have, especially in an open source project."

Intra-corporate politics afoot? Seems like an X/K/Ubuntu package would be a natural for the Kablink product itself and drive uptake. OTOH, this is a new acquisition for Novell, so packaging may reflect what was done before Novell acquired. A lot of signs on the web site that the rebranding from ICEcore to Kablink was rushed, conceivably for OSCON, where it was announced.

    As many know, i've moved all my attention to WebKit and thw webkit "fixed/flow" document model as an alternative to Microsoft's proprietary XAML "fixed/flow". Webkit is the default layout for iPhone, Safari and the Adobe RIA runtime (Flex/Flash/AiR/Acrobat). It's just a short hop from WebKit to VisualForce Pages, the default document model for SalesForce.com developers. The Meta announcement further demonstrates how powerful the WebKit design is. It's will be worthwhile keepign an eye on the Meta JavaScript SDK-Runtime as a nice addition to WebKit. Good stuff!

    Although there are many ways to slice this discussion, it might be useful to compare Adobe RIA and Microsoft Silverlight RIA in terms of web ready, highly interactive documents. The Adobe RIA story is quite different from that of Silverlight. Both however exploit the shortcomings of browsers; shortcomings that are in large part, i think, due to the disconnect the browser community has had with the W3C. The W3C forked off the HTML-CSS path, putting the bulk of their attention into XML, RDF and the Semantic Web. The web developer community stayed the course, pushing the HTML-CSS envelope with JavaScript and some rather stunning CSS magic. Adobe seems to have picked up the HTML-CSS-Javascript trail with a Microsoft innovation to take advantage of browser cache, DHTML (Dynamic HTML). DHTML morphs into AJAX, (which so wild as to have difficulty scaling). And AJAX gets tamed by an Adobe-Apple sponsored WebKit. Most people see WebKit as a browser specific layout engine, and compare it to the IE and Gecko on those terms. I would argue however that WebKit is both a document model and, a document format. For sure it's a framework for very advanced HTML-CSS-DOM-Javascript work. Because the Adobe AIR run-time is based on WebKit layout, WebKit documents can hit on all cylinders across any browser able to implement the AIR plug-in. Meaning, web developers and web content providers need only target the WebKit document model to attain the interactive access ubiquity all seek. Very cool. Let me also add that the WebKit HTML-CSS-DOM-Javascript model is capable of "fixed/flow" representation. I'll explain the importance of "fixed/flow" un momento, but think about how iPhone renders a web page and you'll understand the "flow" side of this equation.

    The four rules of the web and compound documents A real quirk that truly interests me is the difference in aims between the way documents are typically published and the way that the information within them is reused. A published document is normally in a single 'format' - a paginated layout, and this may comprise text, numerical charts, diagrams, tables of data and so on. My assumption is that, to support a given view or argument, a reference to the entirety of an article is not necessary; The full paper gives the context to the information, but it is much more likely that a small part of this paper contains the novel insight being referenced. In the paper-based method, it is difficult to uniquely identify parts of an article as items in their own right. You could reference a page number, give line numbers, or quote a table number, but this doesn't solve this issue that the author hadn't put time to considering that a chart, a table or a section of text would be reused.

  • What we saw them do was create a single screen application with rich interactivity on the client, but still all of the benefits of being a web based application (nothing to install, back end connectivity for inventory and other data using XML, use of client side media/animation to guide the user, reachable through any browser, etc.) We really looked at this as the best of web applications and the best of desktop applications: rich connectivity, platform independence, no install, lightweight as well as rich client side logic and interactivity, ability to integrate rich media and communications. But we dropped the baggage of the page based metaphor that basically required a page refresh for everything and got beyond the layout/graphics/media constraints of HTML.

    Blog from James Governor covers an exchange with Adobe's David Mendels concerning the transition from the static document centric Web 1.0, to the dynamic application platform we know today as the Web 2.0. David discusses the transition from DHTML to AJAX to RIA. David and his group at Adobe witnessed the transition and coined the phrase RIA - Rich Internet Application, to describe this incredible transition. No mention of WebKit as an important aspect enabling the interactive - dynamic document model behind Adobe RIA.

  • The commission's investigation into Microsoft's Web-surfing software began a year ago, after the Norwegian browser-maker Opera Software filed a complaint. Opera argued that Microsoft hurt competitors not only by bundling the software, in effect giving away the browser, but also by not following accepted Web standards. That meant programmers who built Web pages would have to tweak their codes for different browsers. In many cases, they simply designed pages that worked with market-leading Internet Explorer but showed up garbled on competing browsers.
  • At the time of the complaint, Opera said it was asking E.U. regulators to either force Microsoft to market a version of Windows without the browser, or to include other browsers with Windows.

    The Post too says that DG Competition ordered the unbundling of MSIE from Windows. But again no attribution for the statement. They also leave the impression that Opera's complaint regarding the undermining of open web standards was upheld, something not stated in either the Microsoft or DG Competition announcements. So the questions of the day are: [i] did the Commission order the unbundling of MSIE from Windows; and [ii] did the Commission also rule on the undermining of open web standards. The latter question could be of critical importance in the still ongoing proceeding regarding the ECIS complaint in regard to the undermining of ODF by Microsoft pushing OOXML.

    Coursey challenges the assertions put forward by Stephen Vaughn-Nichols that Google's Android will appear as a netbook OS before the year is out. Stephen also contends that soon enough, an Android Desktop will appear, and this will truly challenge Microsoft's monopolist grip. Coursey disputes that also, pointing out the need for file format compatibility and cloud synchronization before this can happen. Obviously, he does not see Microsoft easing their iron grip over the MSOffice productivity environment anytime soon. Stephen counters with the SAMBA story, claiming that the EU will continue to force integration and interop concessions from Microsoft. My take is that both commentators are missign the revolution that is taking place at the edge of the Web ::: the WebKit dancing document/application revolution that includes both iPhone and Android. The WebKit document/app model is washing back over the greater Web, with Web designers and masters upgrading their Web pages to reach the revolution at the edge. This is the big change Coursey is so unaware of.

    MHTML (MIME HTML) which allows all of webpages referenced resources to be downloaded and saved in a single file. This way you can avoid having the manageability problem of many loose files which many browsers produce when you save a web page. This is very useful for archiving webpages to file servers and local disk as well as emailing webpages to people....... An alternative to MHTML would be ZIP containers similar to ODF, OOXML, and XPS. Moving to standardized, containerized files will provide the same benefit of MIME HTML, allowing entire webpages and associated resources to be treated as a single file for better usability.

    Apple has posted an interesting page describing Safari technologies. Innovations and support for existing standards as well as the ACID3 test are covered.

    Many people think that the Apple WebKit-Safari-iPhone innovations are pushing Open Web Standards beyond beyond the limits of "Open", and deep into the verboten realm of vendor specific extensions. Others, myself included, believe that the WebKit community has to do this if Open Web technologies are to be anyway competitive with Microsoft's RiA (XAML-Silverlight-WPF).

    Adobe RiA (AiR-Flex-Flash) is also an alternative to WebKit and Microsoft RiA; kind of half Open Web, half proprietary though. Adobe Flash is of course proprietary. While Adobe AiR implements the WebKit layout engine and visual document model. I suspect that as Adobe RiA loses ground to Microsoft Silverlight, they will open up Flash. But that's not something the Open Web can afford to wait for.

    In many ways, WebKit is at the cutting edge of Ajax Open Web technologies. The problems of Ajax not scaling well are being solved as shared JavaScript libraries continue to amaze, and the JavaScript engines roar with horsepower. Innovations in WebKit, even the vendor-device specific ones, are being picked up by the JS Libraries, Firefox, and the other Open Web browsers.

    At the end of the day though, it is the balance between the ACiD3 test on one side and the incredible market surge of WebKit smartphones, countertops, and netbook devices at the edge of the Web that seem to hold things together.

    The surge at the edge is washing back over the greater Web, as cross-browser frustrated Web designers and developers roll out the iPhone welcome. Let's hope the ACiD3 test holds. So far it's proving to be a far more important consideration for maintaining Open Web interop, without sacrificing innovation, than anything going on at the stalled W3C.
