    The state teacher's union declared a major court victory on Wednesday after a judge ruled that a school district cannot impose a teacher evaluation system where 40 percent is based on student test scores. Student test scores will count for at least 20 percent of an educator's evaluation, and could count for an additional 20 percent only if it is collectively bargained, NYSUT spokesman Carl Korn said.

The governor's beloved 2 percent tax cap was challenged in a lawsuit filed by the New York State United Teachers union in state Supreme Court in Albany. The suit offers multiple arguments why the tax cap is unconstitutional, asserting that it locks in unequal funding between have- and have-not school districts across the state, ''while pushing many school districts to the brink of educational and financial insolvency,'' in the words of NYSUT President Dick Iannuzzi.

    Commissioner King's decision to cut off funding to School Improvement Grant (SIG) districts will disrupt services to our neediest students and deprive their schools of millions in promised federal funding - in what appears to be an arbitrary exercise of brinksmanship. Instead of requesting a waiver for New York's SIG school districts to give them a reasonable extension of time to construct quality evaluations that support teacher development and growth in student learning, SED is using a blunt instrument - taking away funds that provide essential services for students in our neediest schools.

    Teachers can expected unannounced observations to factor into their annual ratings under the terms of the evaluations agreement that Gov. Andrew Cuomo announced today. The unannounced observations are one of several ways that the State Education Department and state teachers union, NYSUT, agreed to flesh out the state's 2010 evaluation law, seen as so open-ended as to stymie implementation. The agreement, which Cuomo is set to turn into law through the state budget amendment process, resolves some major points of contention while continuing to leave many elements of districts' evaluation system subject to local collective bargaining. Districts and their unions have until the end of 2012 to turn the framework into a local evaluation system, or risk losing state aid.

    This past week, I read "the evaluation deal" between NYSUT (the New York teachers union) and the State Education Department. I was surprised, and I was angry. I was particularly struck by the lack of logic and fairness in the rules of the deal. And so to gain some perspective (and to lower my blood pressure) I went to the cafeteria at lunchtime and sat with some kids. I bought some bags of chips and put them on the table and told them I wanted input on grading, a subject near and dear to their hearts. The first scenario I gave them was this…. "Suppose this marking period you had three tests. Each of the tests was on different topics, and you passed all three. Would it be fair for your teacher to fail you?"

    Ultimately, I admitted my mistake in originally registering with the Principals' Letter database.  I wrote to Sean Feeney, requesting removal from the signature roster. What could have been an attempt to cooperatively work with educators of all levels had evolved into a mess that could well hurt our teachers.

    Here's something you won't read too often in RHSU: "UFT president Michael Mulgrew is right." But he is. Just today, a New York state appellate court ruled that New York City must release reports that show value-added data on a teacher-by-teacher basis, with teachers' names attached. I agree with Mulgrew that this is an unfortunate decision.
