    A man who got behind the wheel only minutes after being ordered off the road by a magistrate was handcuffed and arrested in a nearby carpark by a police prosecutor who had followed him out of the building, southport magistrates court was told.

    Nikos kiofetzis, 40, of gaven, appeared in court last month on traffic charges relating to a road rage incident.

    Prosecutor sergeant douglas bettany suspected kiofetzis may have been about drive despite the disqualification and decided to follow him across the road to the carpark.

    The court was told sgt bettany saw kiofetzis get into his car and begin to reverse it when he stopped him and ordered him out of the car.

    Sgt bettany handcuffed kiofetzis and marched him back across to the courthouse and into the watchhouse where he was charged with driving while disqualified.

    Yesterday, the court was told kiofetzis had one previous charge of driving while disqualified.

    Barrister chris rosser said his client had misunderstood the beats by dre solo magistrate on the last occasion.

    "He was stunned that he got that punishment and he does not recall being told that he could not drive,"He said.

    Mr rosser said it was not an act of blatant contempt of court.

    "I don doubt it would have been explained to him but he just didn take any of it in,"He said.

    Mr rosser said kiofetzis licence was not taken from him that day and as a result he believed he could drive.

    "He did not intend to thumb his nose at the court, it was more an act of stupidity or recklessness than of contempt of court,"He said.

    Magistrate ron kilner said he was willing to give kiofetzis the benefit of the doubt and fined him $900.

    He disqualified him from driving for a further 12 months, taking the beats headphones total to two years.

    "Let me make this perfectly clear, when a court says you are disqualified from holding or obtaining a driver licence, that means from today, the moment that sentence is pronounced in court, so there is no misunderstanding in future,"He said.

    "I prepared to give you the benefit of the doubt but if you come back in the next two years on a disqualified driving charge you will most certainly spend time behind bars. "
