    PEACHTREE GROUP, THE newly formed affiliate of Peachtree Hotel Group created last week to handle its real estate investments, is launching its first initiative, the 1031 Exchange Delaware Statutory Trust program. The company also selected Tim Witt as president over the new program. A DST is a single-purpose entity qualified for Section 1031 real estate exchanges, according to Peachtree. It allows investors to exchange replacement properties without incurring taxable gain on the sale of previously owned assets. Peachtree's 1031 Exchange DST program will invest in institutional-grade hotels in the U.S. through Peachtree Hospitality Management, another division of Peachtree, is expected to operate any properties acquired as part of the exchange. "As we expand our array of high-quality, diversified investment strategies, we wanted to create 1031 Exchange DSTs to provide tax deferral strategies in the hospitality sector," said Greg Friedman, Peachtree's CEO and managing principal. "We anticipate significant growth and appreciation in the hospitality sector, driving values above pre-pandemic levels. Also, real estate offers an excellent alternative investment channel for those seeking an inflation hedge. We strongly believe hospitality is the most investable asset in the market today, and we anticipate being able to achieve outsized returns."

Heather Carnes to executive vice president for communications and chief strategy officer and hired Phelps Hope as its new executive vice president for operations and chief development officer. Carnes has been with AAHOA for three years, most recently as the association's vice president of marketing and communications, and has worked nearly her entire career in the association space, according to AAHOA. In her new role, she will focus on organizational strategy, marketing and communications, organizational culture and HR, education/program development and strategic partnerships.     THE RECENTLY PASSED federal $1.7 trillion omnibus spending bill contains important gains for the travel and hospitality industries, according to several advocacy groups. That includes the Omnibus Travel and Tourism Act and the creation of a position in the Department of Commerce to coordinate travel and tourism industry strategy. AAHOA, the American Hotel & Lodging Association and the U.S. Travel Association all welcomed the passage of the spending bill that was signed into law by President Biden on Dec. 23. All cited the OTTA legislation created by U.S. Sens. Jacky Rosen, Democrat of Nevada, and Republic Roger Wicker of Mississippi through the Senate Committee on Commerce, Science, and Transportation. What is the OTTA? The elements of the OTTA include the Visit America Act, which authorizes the creation of the new position in the DOC. The new assistant secretary would coordinate a strategy across multiple federal agencies to increase travel and tourism nationwide through annual goals and recommendations. "This means the industry will finally have a seat at the policy table after decades of advocating for this to occur," said Laura Lee Blake, AAHOA president and CEO, in LinkedIn.com post.

Both companies released statements saying they will now focus on their standalone strategies. Choice also announced that it would withdraw its nominees for Wyndham's board of directors. Last week it made a last effort to encourage Wyndham shareholders to tender shares for the acquisition but still failed to gather sufficient support for the deal. "Since beginning this process in April 2023, Choice has attempted to engage in good-faith negotiations with Wyndham through numerous different avenues, including increasing the proposed offer multiple times and expressing an openness to further enhancing the offer with due diligence, offering a one-way NDA to share its confidential information with Wyndham, and offering above-market regulatory protections," the company said. "Given Wyndham's refusal to constructively and substantively engage on terms, Choice took the extraordinary step of launching the exchange offer to initiate the regulatory review process and engage with Wyndham stockholders. While the support from Wyndham stockholders tendering into the exchange offer was significant considering the number of investors structurally prevented from participating at this stage, it was not sufficient for Choice to conclude - particularly when taking into account the Wyndham board's obvious continuing disinterest in a combination - that a path towards a transaction is available at this time."
