    HOSPITALITY INDUSTRY ASSOCIATIONS are welcoming two laws, one proposed on a federal level and another passed by the state of Tennessee. The federal law is long-awaited clarification of the definition joint employers and the Tennessee law limits regulations by local governments in the state that would affect small businesses, including hotels. A clear definition Versions of the Save Local Business Act recently was introduced in the U.S. House of Representatives and the Senate. Sponsors of the bill say it will provide clarity on Department of Labor's proposed new joint employer rules that have undergone multiple changes lately, leading to legal confusion. "You can't focus on running a business if the federal government keeps changing the rules. The Save Local Business Act provides long-overdue clarity and consistency that will protect our nation's small businesses," said one of the bill's sponsors, U.S. Sen. Roger Marshall. "The Biden Administration's Labor Department has relied on complicated court rulings to handle joint employers instead of providing clear guidance to the business community. In a time of economic hardship, we should be doing all that we can to help our nation's small businesses, not let the heavy hand of government regulations run amok."

    MORE ASSOCIATIONS ARE joining the American Hotel & Lodging Association in protesting the National Labor Relations Board's recently issued final ruling on the definition of joint-employer status. The ruling essentially broadens the definition to any "entity that has an employment relationship with the employees," and AAHOA, AHLA and the other associations say it could damage the current franchise business model. NLRB's new standard, issued last week, defines a joint employer to be any company that shares or codetermines one or more essential terms and conditions of employment. Those include: Wages, benefits, and other compensation. Hours of work and scheduling. The assignment of duties to be performed. The supervision of the performance of duties. Work rules and directions governing the manner, means, and methods of the performance of duties and the grounds for discipline. The tenure of employment, including hiring and discharge. Working conditions related to the safety and health of employees.

AHLA opposes the pro-union PRO Act - 0 views

    SPONSORS AND SUPPORTERS of the proposed Richard L. Trumka Protecting the Right to Organize Act of 2023 say it is needed to protect the rights of workers to organize under labor unions. However, the American Hotel & Lodging Association and others claim the PRO Act puts an undue burden on small businesses, including hotels. The PRO Act would authorize penalties against employers that interfere with employees' efforts to organize, according to Democratic Rep. Robert "Bobby" Scott of Virginia, one of the co-sponsors of the bill. Also, the bill would facilitate collective bargaining agreements, close loopholes that allow employers to misclassify employees as supervisors and independent contractors. Other aspects of the PRO Act include protection for employees that experience retaliation for trying to organize a union, ensures that workers can collect "fair share" fees and authorizes a private right of action for violation of workers' rights. It also prevents employers from interfering in union elections or holding captive audience meetings. "Regrettably, for too long, workers have suffered from anti-union attacks and toothless labor laws that undermined their right to form a union," Scott said. "As a historic number of Americans put their support behind labor unions, Congress has an urgent responsibility to ensure that workers can join a union and negotiate for higher pay, better benefits, and safer workplaces."

AHLA's Rogers joins cast of TV series 'Hotels ByDesign' - 0 views

New Jersey franchise reform bill takes a step forward - 0 views

    ONE VERSION OF a proposed New Jersey bill that would reshape hotel franchising in the state has passed out of committee in the Assembly but efforts reportedly are under way to amend it to address opponents' concerns. The Senate version of the bill remains in committee. The American Hotel & Lodging Association, a long-time critic of the proposed legislation, called the Assembly Committee on Commerce, Economic Development and Agriculture's passage of the bill a "dangerous step forward." Supporters of the bill, including AAHOA as well as sponsors of the bill, did not respond to requests for comment in time for this article. What's at stake The bills, A3495 in the Assembly and S2336 in the Senate, were introduced at the beginning of the year to replace the original legislation that stalled in the state's legislature last year. It is essentially the same as its prior incarnation. Specifically, the provisions include restricting non-competes that are longer than six months; prohibiting requiring a relocation or capital investment greater than $25,000 more than once every five years unless hotel franchisers can establish a return on the investment; requiring a franchiser that receives "any rebate, commission, kickback, services, other consideration or anything of value" to fully disclose them to the franchisee and turn them over to the franchisee; putting restrictions on mandatory sourcing of goods or resources; and prohibiting suspending, restricting or preventing access to franchise services.

DHS to issue more than 60,000 additional H-2B visas - 0 views

    THE U.S. DEPARTMENT of Homeland Security will make available more than 64,000 additional H-2B temporary nonagricultural worker visas for fiscal year 2023. The extra visas will help the hotel and travel industries meet continuing labor shortages, according to the U.S. Travel Association. DHS also will issue its normal allotment of 66,000 H-2B visas as well as the 64,716 extra visas. The visas, which permit employers to temporarily hire noncitizens to perform certain labor in the U.S., became available at the beginning of October. Also, the agency created the new Worker Protection Taskforce to make sure the H-2B visa workers are not exploited. "The Department of Homeland Security is moving with unprecedented speed to meet the needs of American businesses," said Alejandro Mayorkas, secretary of Homeland Security. "At a time of record job growth, this full year allocation at the very outset of the fiscal year will ensure that businesses can plan for their peak season labor needs. We also will bolster worker protections to safeguard the integrity of the program from unscrupulous employers who would seek to exploit the workers by paying substandard wages and maintaining unsafe work conditions."

'Smart hotel' company EV Hotel going public - 0 views

    EV HOTEL CORP., the Atlanta-based tech centric "smart hotel" company, is in a "change of control" stock purchase agreement with Plandai Biotechnology, Inc. Plandai will become the parent company to EV Hotel, founded by Ken Patel, for the purposes of going public. Before closing the agreement, both parties must complete independent financial audits, a third-party valuation of EV Hotel Corp. and the company completing corporate actions with the Secretary of State of Nevada, according to EV Hotel. Trading regulatory organization FINRA will change Plandai's name and trading symbol, along with implementing a reverse split of the company's common stock, with management plans at 100:1. Upon closing, Plandai will acquire all of the authorized stock and assets in EV Hotel in exchange for common stock and Patel will acquire all of the company's Series "A" Preferred stock, resulting in a change of control.

Surveys: Most Americans likely to stay in hotels in 2023 - 0 views

    AS MANY AS 60 percent of Americans are likely to stay in hotels this year, more than last year, according to two surveys commissioned by the American Hotel & Lodging Association. The survey findings apply to business and leisure travelers, with most saying they are travelling as much as or more than they did pre-pandemic. Hotels are the top lodging choice among travelers for business and leisure in the next three months, the new national Hotel Booking Index survey research commissioned by AHLA and conducted by Morning Consult has revealed. According to the surveys, conducted on Dec. 16 to 19 and Dec. 28 to Jan. 2, 52 percent of adults would choose to stay in hotels in the next three months, while 76 percent of potential business travelers would be most likely to stay in a hotel during the same period. Besides, business travelers indicate that nearly 70 percent of their employers have either returned to the pre-pandemic normal or increased amounts of business travel. The survey said that 51 percent of business travelers said that share of employees expected or encouraged to travel for work is now the same as before the pandemic, while another 20 percent said it's more than before. About 53 percent of business travelers said that the average length of business trips is now the same as before the pandemic, while another 20 percent said it's more than before.

AAHOA survey finds only 5 percent of franchisees are happy - 0 views

    THE AMERICAN FRANCHISE business model is in trouble, according to a recent survey commissioned by AAHOA. The survey was inspired by a webinar AAHOA co-sponsored to gather public comment on the state of franchising for the Federal Trade Commission. The survey found that only 5 percent of the franchisee respondents are satisfied that their current franchise agreements provide fair terms representing a balanced relationship between themselves and their franchiser. Also, 72.6 percent of respondents would "possibly" or "probably" terminate their current franchised business within the next year if they could do so without penalty. "Franchising is in dire straits unless changes are made," said Laura Lee Blake, AAHOA president and CEO. "Franchising is still a powerful tool for economic mobility for America's small-business owners, including AAHOA Members. But franchising only works when both franchisors and franchisees are committed to its success, which requires transparency, fairness, and sustainable business practices. As this survey shows, there is much room for improvement when it comes to relationships that allow our small-business owners to thrive." Blake recently wrote an editorial supporting AAHOA's 12 Points of Fair Franchising and its promotion of a proposed New Jersey law that would reform that state's franchising regulations in ways similar to the 12 points. Several large hotel companies, including Choice Hotels International and Marriott International, protested AAHOA's recent annual convention in protest to its position on franchise reform The survey was conducted among owners of hotels, restaurants, retail stores and other small businesses that had participated in the FTC webinar.     Matthew Hostetler, chief development officer at Red Roof, has been operating outside his wheelhouse for about 18 years now. In this installment of Asian Hospitality's Leadership Series, he explains how he does it all with a smile on his face. Hostetler was at the Hunter Hotel Conference in March in Atlanta when he took time to talk about his history in the hotel business along with the current status of Red Roof. Topics also included AAHOA's 12 Points of Fair Franchising, the company's preparations for possible economic headwinds this year and the success of Red Roof's newest brand. Same job, different industry In 2002, Hostetler was recruited by Cendant Hotel Group, which is now Wyndham Hotel Group, to conduct franchise sales under Phil Hugh, who was at that time senior vice president for franchise sales. That was when he stepped out of his comfort zone. "I said yes to an opportunity that was way, in sales was not outside of my wheelhouse, but outside of my industry," Hostetler said. "I was in transportation for 15 years before that. So yeah, that definitely outside the wheelhouse." In 2014, he joined Red Roof as the senior vice president of development, again working under Hugh. In 2020, when Hugh left the company, Hostetler became chief development officer. Now he's settled into the job. "I love the hotel business. I love hospitality. I love the people in this business, how they are so entrepreneurial," Hostetler said. But there's also so people oriented as well. That's what attracts talent so much right? Hospitality. Everyone has a smile on their face most of the time."

Subjects included the labor crisis, attracting new franchisees and the state of the economy. Below are excerpts from the interview along with additional information on the subjects discussed, including franchise relations, the labor crisis and changes the company has seen since his appointment to the top role. Franchise relations One of the biggest issues Cuculic discusses in the interview is maintaining positive relations with Best Western franchisees. He emphasized the need for openness and transparency. "We disclose all of our contract terms throughout the negotiation. I tell our people, I believe in karma," Cuculic said in the Leadership Series interview. "Karma doesn't forget a name or an address. If you treat someone who's thinking about coming into your brand reasonably fairly, and then when they sign a contract, you drive revenue to them, that's a win-win relationship. That's what we want. If you don't have that win-win relationship, they're going to leave and your reputation is that you don't support your hoteliers or believe in that relationship, which then hinders development." Cuculic said his training at West Point Military Academy and law school at Notre Dame University instilled in him an innate sense of fairness. Also, due to its structure, the company has to involve its members in every decision. "I'm the president, CEO of Best Western, I cannot design a governance change," Cuculic said. "The members vote on all those changes. Our board of directors approves our contracts."
