    THE AMERICAN FRANCHISE business model is in trouble, according to a recent survey commissioned by AAHOA. The survey was inspired by a webinar AAHOA co-sponsored to gather public comment on the state of franchising for the Federal Trade Commission. The survey found that only 5 percent of the franchisee respondents are satisfied that their current franchise agreements provide fair terms representing a balanced relationship between themselves and their franchiser. Also, 72.6 percent of respondents would "possibly" or "probably" terminate their current franchised business within the next year if they could do so without penalty. "Franchising is in dire straits unless changes are made," said Laura Lee Blake, AAHOA president and CEO. "Franchising is still a powerful tool for economic mobility for America's small-business owners, including AAHOA Members. But franchising only works when both franchisors and franchisees are committed to its success, which requires transparency, fairness, and sustainable business practices. As this survey shows, there is much room for improvement when it comes to relationships that allow our small-business owners to thrive." Blake recently wrote an editorial supporting AAHOA's 12 Points of Fair Franchising and its promotion of a proposed New Jersey law that would reform that state's franchising regulations in ways similar to the 12 points. Several large hotel companies, including Choice Hotels International and Marriott International, protested AAHOA's recent annual convention in protest to its position on franchise reform The survey was conducted among owners of hotels, restaurants, retail stores and other small businesses that had participated in the FTC webinar. Also, it mentions AAHOA's support for New Jersey's proposed Assembly Bill 1958 that would make changes to the New Jersey Franchise Practices Act similar to the guidelines laid out in the 12 Points. "Ultimately, Marriott cannot support, either by endorsement and/or financially, any organization that is in direct opposition to our business model and interests," Marriott said in the letter. "We believe quite strongly that the longstanding relationship between Marriott and AAHOA has proven to be mutually beneficial, and we are deeply saddened that AAHOA has chosen to pivot its stance on these key issues in a way that is decidedly anti-franchising and anti-Marriott (especially since, as the AAHOA leadership shared with us in a recent meeting, neither AAHOA's leaders nor its members have any material issues with Marriott's approach to franchising or to our franchisees)."

Also, the bill would facilitate collective bargaining agreements, close loopholes that allow employers to misclassify employees as supervisors and independent contractors. Other aspects of the PRO Act include protection for employees that experience retaliation for trying to organize a union, ensures that workers can collect "fair share" fees and authorizes a private right of action for violation of workers' rights. It also prevents employers from interfering in union elections or holding captive audience meetings. "Regrettably, for too long, workers have suffered from anti-union attacks and toothless labor laws that undermined their right to form a union," Scott said. "As a historic number of Americans put their support behind labor unions, Congress has an urgent responsibility to ensure that workers can join a union and negotiate for higher pay, better benefits, and safer workplaces."

In response, AAHOA is urging its members to lend a hand to relief efforts. In Kentucky, at least 70 people were killed as the storms churned through Friday night and into Saturday, according to local media reports. About 110 people were trapped in a Mayfield, Kentucky, candle factory when the tornado hit. At least two died at an Amazon facility in Edwardsville, Illinois. Deaths were reported in Arkansas, Tennessee and other states as well. "This will be, I believe, the deadliest tornado system to ever run through Kentucky. Earlier this morning at about 5 a.m., we were pretty sure that we would lose over 50 Kentuckians. I'm now certain that number is north of 70. It may in fact end up exceeding 100 before the day is done," Kentucky Gov. Andy Beshear said in a statement. "The damage is even worse now that we have first light. A couple places have been hit incredibly hard, certainly Mayfield here in Graves County, but everywhere along the line of this tornado that touched down and stayed down for 227 miles."

While the government had planned to keep the mandates in place until at least May, critics, including the U.S. Travel Association, said it had outlived its usefulness and a recent survey found most travelers agree. On Monday, U.S. District Judge Kathryn Kimball Mizelle in Tampa said in her ruling that the Centers for Disease Control and Prevention had overstepped its authority in issuing the mask mandate, according to CNBC.com. The Transportation Security Administration later announced it would no longer enforce the mandate, although the CDC continues to recommend that people wear masks on public transit. Several major airlines announced that masks would not longer be required for passengers. Delta Airlines said in a statement that employees and customers could continue wearing masks if they chose. Also, the company said some enforcement of the mandate may continue in the short term as news of the TSA decision is spread, but communications to customers and in-airport signage and announcements would be updated to say that masking is now optional.

New Jersey Assembly Bill A1958 would make changes to the New Jersey Franchise Practices Act. AAHOA has been supporting the bill, saying it mirrors several concerns included in its 12 Points of Fair Franchising. Specifically, it would reform rules for mandated vendors, rebates, loyalty programs and new fees, AAHOA said in a statement. "New Jersey has long been a state with a strong entrepreneurial culture that has been welcoming to immigrants, including many AAHOA members," said AAHOA Chairman Bharat Patel. "The state Assembly recognized that and took a step toward making New Jersey a better place for small businesses with today's vote to advance fair franchising principles. New Jersey can be an example to the nation for supporting franchising practices that allow hotel owners to achieve the American dream." AAHOA supports the preference of certified women-owned, minority-owned and veteran-owned businesses to serve as the mandated and preferred vendors for the franchise business model.

    Matthew Hostetler, chief development officer at Red Roof, has been operating outside his wheelhouse for about 18 years now. In this installment of Asian Hospitality's Leadership Series, he explains how he does it all with a smile on his face. Hostetler was at the Hunter Hotel Conference in March in Atlanta when he took time to talk about his history in the hotel business along with the current status of Red Roof. Topics also included AAHOA's 12 Points of Fair Franchising, the company's preparations for possible economic headwinds this year and the success of Red Roof's newest brand. Same job, different industry In 2002, Hostetler was recruited by Cendant Hotel Group, which is now Wyndham Hotel Group, to conduct franchise sales under Phil Hugh, who was at that time senior vice president for franchise sales. That was when he stepped out of his comfort zone. "I said yes to an opportunity that was way, in sales was not outside of my wheelhouse, but outside of my industry," Hostetler said. "I was in transportation for 15 years before that. So yeah, that definitely outside the wheelhouse." In 2014, he joined Red Roof as the senior vice president of development, again working under Hugh. In 2020, when Hugh left the company, Hostetler became chief development officer. Now he's settled into the job. "I love the hotel business. I love hospitality. I love the people in this business, how they are so entrepreneurial," Hostetler said. But there's also so people oriented as well. That's what attracts talent so much right? Hospitality. Everyone has a smile on their face most of the time."
