THE U.S. GENERAL Services Administration recently announced the per diem rate for lodging for government employees in the continental U.S., and it was good news for hotels. The GSA increased the standard CONUS per diem rate for fiscal year 2023 and set all non-standard area rates at or above the fiscal year 2022 rates. The standard CONUS lodging rate rose from $96 to $98, according to the GSA's statement. The meals and incidental expenses per diem tiers for the fiscal year are unchanged at $59 to $79, with the standard M&IE rate unchanged at $59. There are no new NSA locations this year, and three locations that were NSAs or part of an established NSA in fiscal year 2022 will move into the standard CONUS rate category. They are Cromwell and Old Saybrook, Connecticut, in Middlesex County; El Paso, Texas, in El Paso County; and Rock Springs, Wyoming, in Sweetwater County.

PROPOSED FEDERAL REGULATIONS defining a "joint-employer standard" would have a "chilling effect" on the hospitality industry and franchises in general, according to the American Hotel & Lodging Association. The National Labor Relations Board's latest version of the standard could define two companies as joint employers if they both control certain elements of employees' terms and conditions. The period for comments on the proposed regulations ended Nov. 21 and the would rescind and replace the joint-employer rule that took effect on April 27, 2020. That previous rule established that "a business must possess and exercise substantial direct and immediate control over one or more essential terms and conditions of employment of another employer's employees" to be considered a joint employer. However, a ruling by the U.S. Court of Appeals for the D.C. Circuit in July reversed that rule. Now, under the new rule, "two or more employers would be considered joint employers if they 'share or codetermine those matters governing employees' essential terms and conditions of employment,' such as wages, benefits and other compensation, work and scheduling, hiring and discharge, discipline, workplace health and safety, supervision, assignment, and work rules," according to NLRB.

HYATT HOTELS CORP. is set to launch a lifestyle group following the acquisition of Standard International, the parent company of The Standard and Bunkhouse Hotels. The new group would focus on developing future projects included in the acquisition. Amar Lalvani, former executive chairman of Standard International, will serve as president and creative director of the new group. It will be headquartered in New York City, with additional offices in Austin and Bangkok, Hyatt said in a statement. "The lifestyle segment isn't for the faint of heart; it takes creativity and commitment," said Lalvani. "But if you get it right, you reap the benefits of strong guest loyalty and developer returns. Hyatt respects the creativity needed to deliver our experiences, while we value Hyatt's history, global infrastructure, and commercial services."

A NEW ENVIRONMENTAL, social and governance report released by Choice Hotels International highlights steps that would allow the company to reduce utility costs, save time for franchisees, and increase Choice's ESG commitments. Those steps include new energy- and water-saving technology, diversity goals for hotel ownership and more. The report entitled "Building a Better Tomorrow, Today" lays out the company's plan to being a good corporate citizen, according to a release. "Choice Hotels shares a uniting belief that tomorrow will be even better than today, and we are committed to building that better tomorrow," said Patrick Pacious, Choice's CEO, in the report. "As one of the largest lodging franchisors in the world, we are building on more than 80 years of success in developing a portfolio of diversified brands and creating a lasting, sustainable legacy for the future - one hotel, one family, one community at a time." Key findings The report further details measures being undertaken by Choice to integrate ESG standards and principles into its long-term decision-making and operations, including: Reporting Scope 1 and Scope 2 greenhouse gas emissions for the first time and aligning ESG disclosures with the Sustainability Accounting Standards Board standards and the United Nations Sustainable Development Goals. Appointing an executive with knowledge of the business as vice president, sustainability and creating two new ESG governance forums to strengthen Choice's ESG strategy and execution. Joining the Sustainable Hospitality Alliance, a global network that champions responsible hospitality, and becoming one of its largest members. THE AMERICAN HOTEL & Lodging Association and the Hospitality Financial and Technology Professionals Association announced a 10-year agreement to jointly produce the Uniform System of Accounts for the Lodging Industry, a statement said. The USALI is the global "standard" for hospitality accounting and HFTP purchased rights to its contents in 2018. AHLA and HFTP have reengaged the joint Global Finance Committee that is responsible for creating content for USALI's 12th edition to be released next year, according to AHLA. For many years, AHLA's Financial Management Committee was responsible for creating content for the USALI. HFTP purchased USALI's intellectual property, publishing and distribution rights from the Hotel Association of New York City. "After our decision to publish on our own, many in the industry contacted both HFTP and AHLA to see if we could find a way to work together," said Frank Wolfe, HFTP's CEO. "Both organizations had the willingness to work together, but like any business deal the decision was in the details. Associations are a bit different animal than corporate enterprises. Today we may work together on one project and tomorrow will be dead on competitors so there were lots of details to refine. The good news is that both organizations worked exceptionally hard to put those competitive differences aside and advance the industry."

The program aims to enhance the company's environmental performance, reduce carbon footprint and improve guest comfort and satisfaction, according to a joint statement by the companies. As part of the partnership, BWH Hotels in the U.S. and Canada gain access to Green Key Global's sustainability certification program, the joint statement said. That includes a list of green certified vendors, an "Eco-Rating" program and guidance on hosting sustainable meetings, according to the Green Key website. "We are delighted to partner with Green Key Global to enhance sustainability standards across our properties," said Michael Morton, vice president of brand management at BWH Hotels. "As a trusted organization, Green Key Global aligns with our commitment to sustainability, and this partnership will reinforce our dedication to providing guests with an environmentally responsible hotel experience."

THE U.S. GENERAL Services Administration announced Wednesday a raise in its standard permissible per diem rates for federal travelers, reaching $166 for fiscal year 2024. This adjustment stems from a year-on-year increment of $9 in the lodging allowance, now set at $107. The rate will be applicable from Oct. 1 to Sept. 30, 2024, GSA said. The per diem guidelines regulate the reimbursement of federal employees' lodging and meal expenses for official government travel. These guidelines involve a $9 increase to the continental U.S. lodging rate, as well as significant rate hikes in multiple non-standard areas. "GSA bases the maximum lodging allowances on historical ADR data, less 5 percent. However, the COVID-19 pandemic led to unprecedented declines in ADR, followed by a volatile hotel industry recovery," GSA said in a statement. "The ADR data available to establish fiscal year 2024 rates was from before the COVID-19 Public Health Emergency expired on May 11. Similar to the approach for fiscal year 2023, GSA made upward adjustments to ensure that maximum lodging allowances for federal travelers are sufficient in fiscal year 2024."

The Indian state of Uttar Pradesh eyes investments of more than $3.9 billion (Rs 32,000 crore) in the hospitality and tourism sector, according to a report published in Business Standard. The investment could create an additional 80,000 accommodation units through hotels and resorts, addressing the room availability deficit. Religious tourism surged post the consecration of the Lord Ram temple in Ayodhya on Jan. 22. Uttar Pradesh anticipates an annual tourist footfall of 850 million by 2028, emphasizing the expansion of hospitality units in tourism hubs like Varanasi, Ayodhya, Prayagraj, and Agra, Business Standard daily reported. "To cater to this increasing demand, the state is looking to create a robust supply of accommodation units with the development of hotels, resorts, and homestays," a government official was quoted as saying in the report.

INDIA-BASED ORAVEL STAYS, the parent company of OYO, is reportedly in talks to raise $200 million in a primary funding round, according to Business Standard. The funds are expected to support OYO's potential acquisition of G6 Hospitality, which owns the budget Motel 6 and Studio 6 chains in the U.S. Oravel Stays aims for a valuation between $4.5 billion and $5 billion, up from its previous $2.4 billion valuation, though still below its earlier $10 billion target. The company is in discussions with offshore institutional and private Indian investors to secure the funding, Business Standard reported. Among the private investors involved are InCred Wealth, J&A Partners, the Mankind Pharma family office, and ASK Financial Holdings, all of whom previously valued OYO at $2.4 billion. OYO, backed by SoftBank, has not commented on the matter.

FORMER AAHOA CHAIRWOMAN Jagruti Panwala testified recently before Congress on the Department of Labor's proposal to raise the overtime salary exemption threshold for executive, administrative, and professional employees under the Fair Labor Standards Act. Panwala, now a board member for American Hotel & Lodging Association, argued that the proposed change would actually limit hotel employees' opportunities and does not take into account economic differences between regions of the country. In August, DOL proposed raising the threshold from $35,568 to an estimated $60,209 in 2024 according to AHLA based on the department's projections. That equals a nearly 70 percent increase, and AHLA said that means all employees making under that amount must be paid overtime for any hours worked over 40 in one week. The DOL proposal also would automatically increase the threshold every three years thereafter based on the 35th percentile of earnings for full-time salaried workers in the lowest-wage census region, currently the South.

MORE ASSOCIATIONS ARE joining the American Hotel & Lodging Association in protesting the National Labor Relations Board's recently issued final ruling on the definition of joint-employer status. The ruling essentially broadens the definition to any "entity that has an employment relationship with the employees," and AAHOA, AHLA and the other associations say it could damage the current franchise business model. NLRB's new standard, issued last week, defines a joint employer to be any company that shares or codetermines one or more essential terms and conditions of employment. Those include: Wages, benefits, and other compensation. Hours of work and scheduling. The assignment of duties to be performed. The supervision of the performance of duties. Work rules and directions governing the manner, means, and methods of the performance of duties and the grounds for discipline. The tenure of employment, including hiring and discharge. Working conditions related to the safety and health of employees.

THE U.S. DEPARTMENT of Labor's definition of who qualifies as independent contractors, due to take effect in March, is meant to ensure that workers are treated fairly, according to the department. However, the American Hotel & Lodging Association says the new rule limits independent contractors to work and impact hotels' ability to find workers. The new rule under the Fair Labor Standards Act aims to prevent misclassification of workers that can affect workers' rights to minimum wage and overtime pay, "facilitates wage theft, allows some employers to undercut their law-abiding competition and hurts the economy at-large," the Labor Department said in a statement. It uses a multifactor analysis of six factors defining a worker's relationship with an employer, such as the worker's opportunities for profit or loss; the financial stake and nature of any resources a worker has invested in the work; the degree of permanence of the work relationship; the degree of control an employer has over the individual's work; how essential the work is to the employer's business; and the worker's skill and initiative.

THE AMERICAN HOTEL & Lodging Association is weighing all options, including litigation, to contest the U.S. Department of Labor's final rule revising overtime regulations under the Fair Labor Standards Act. The association is concerned that many hoteliers may be forced to eliminate longstanding managerial positions, which serve as crucial paths to career advancement. The updated rule features two-tiered increases in the minimum salary threshold and the threshold for highly compensated employees, along with automatic updates to both thresholds, DOL said in a statement. The minimum salary threshold will rise to $43,888 on July 1, followed by an increase to $58,656 on Jan. 1, 2025. This represent more than a 60 percent increase from the current $35,568 threshold, DOL said. The HCE threshold will jump to $132,964 on July 1, then to $151,164 on Jan. 1, 2025-an over 70 percent increase from the current $107,432 threshold, DOL added. The updated rule includes automatic updates to both the minimum salary threshold and the HCE threshold, which will be raised every three years.

ELECTRIC VEHICLE CHARGING points are becoming a standard amenity at hotels, akin to the rise of Wi-Fi in the early 2000s. Benefits for the hotel owners and franchisers can include additional revenue, carbon credits as well as attracting guests from the growing number of electric vehicle drivers. A 2022 Green Lodging survey by the American Hotel and Lodging Association revealed a surge in the deployment of EV chargers within the hospitality sector, with 26.6 percent of all U.S. hotels equipped with charging stations. The EV charging facilities are more commonly found at luxury hotels (nearly 90 percent offer them), while only about one in five limited-service hotels provides charging, representing significant growth opportunities. Hotel brands such as Hilton Hotels & Resorts, Marriott International, BWH Hotel Group, IHG Hotels & Resorts, Choice Hotels International, Hyatt Hotel Corp. and G6 Hospitality have prioritized deploying EV charging based on customer preferences. Their franchisees have begun incorporating EV charging infrastructures into their properties. "We've heard from our owners that offering EV charging solutions is increasingly influential for guests when choosing hotels," said Brian McGuiness, IHG's senior vice president of global guest experience. "This is backed by our observation of guests using EVC filters on the IHG One Rewards mobile app and website. Our integrated EV-charger search filter within the IHG One Rewards mobile app allows travelers to easily find properties with EV charging capabilities, empowering them to plan their journeys conveniently and confidently."

Hospitality Financial and Technology Professionals published the revised edition, overseen by the Global Finance Committee and jointly sponsored by the American Hotel & Lodging Association and HFTP. The publication added financial and operating changes, a sustainability section, and a section specific to all-inclusive hotels, with an adoption date of Jan. 1, 2026. The GFC comprises global financial leaders from AHLA's financial management committee and HFTP members representing the most prominent global hotel brands, operators, owners, and other industry authorities, AHLA said in a statement. "The USALI has long been the compass guiding financial and operational reporting in hospitality," said Gina Tallarico, GFC co-chair and Hyatt's global head of acquisition integration. "This update signifies GFC's commitment to globalization, sustainability, and informed decision-making. With this 12th Revised Edition, we're excited to introduce a new all-inclusive reporting section - an initial step toward standardization and benchmarking capability in this rapidly -growing segment."
