    THE U.S. SUPREME Court overturned a lower court ruling that found Grants Pass, Oregon's ban on outdoor sleeping on public lands violated the constitution's prohibition of cruel and unusual punishment. AAHOA expressed concerns over the ruling in the case that could push the homeless population into hotels. Previously, the U.S. Ninth Circuit Court held that enforcing city ordinances banning outdoor sleeping did violate the Eighth Amendment's Cruel and Unusual Punishments Clause "whenever the number of homeless individuals in a jurisdiction exceeds the number of 'practically available' shelter beds," according to the Supreme Court ruling. This led to several lawsuits against cities filed by homeless advocates, including one against Grants Pass that led a district court to file an injunction prohibiting the city from enforcing the ordinance. The Supreme Court overturned the district court's holding, saying the city's punishments for violations, including fines in first offenses and imprisonment for multiple violations, did not meet the Eighth Amendment's definitions of cruel and unusual. That ruling has an immediate impact on cities and counties in Oregon and other Western states, according to Oregon media.

The rule bans hotels from excluding resort fees, often labeled "junk fees," from advertised rates for short-term lodging. It takes effect 120 days after publication in the Federal Register. The rule mandates businesses to prominently display the total price to prevent "bait-and-switch tactics, such as drip pricing and misleading fees," the FTC said in a statement. Outgoing President Joe Biden said he has always prioritized families and hardworking Americans and urged his administration to focus on lowering costs. "Today, the Federal Trade Commission is doing just that by banning hidden junk fees when you book a hotel or purchase event tickets," Biden said. "We all know the experience of encountering a hidden fee at the very last stage of checkout-these junk fees sneak onto your bill, and companies end up making you pay more because they can. Those fees add up, taking real money out of the pockets of Americans."

The American Hotel & Lodging Association and the Hotel Association of New York City objected to the amendments, warning of potential closures and layoffs in the city's hotel sector. The bill, known as the Hotel Safety Act, originally proposed by Councilwoman Julie Menin on July 18 and revised on Aug. 2, seeks to introduce staffing and operational mandates that AHLA considers unnecessary. "The city council's discussions regarding the Hotel Safety Act continue to exclude those who will be most affected by the legislation-hotel owners, management companies, sub-contractors and tens of thousands of hotel workers," said Kevin Carey, AHLA's interim president and CEO. "It is imperative that all stakeholders have a real seat at the table. If this is a matter of public safety and crime, as has been claimed by Councilwoman Menin and the bill's proponents, let's review the facts and statistics to see what picture they paint."
