    Here are bits of it that I found infomitive, hope this helps. In November 1993 it was becoming evident that the Norwegian Government and the Sami Parliament had different interpretations on several significant sections of the ILO Convention. The premises for these court decisions were obviously not simply a matter of legal history or current law. What the judges in the Calder- and the Mabo-case did was, in fact, to define or construct «Native title», i.e. the inherent right of indigenous peoples to their homelands based on use and occupancy from time immemorial. The basis for this recognition was that the judges came to admit that the state powers relation to indigenous peoples constituted a most real legal-political problem and a present dilemma in inter-ethnic relations. The source of this problem and dilemma stemmed from the obvious fact that the nation state had colonised and were governing territories where indigenous populations still lived and depended on. In other words, the courts admitted to the unpleasant fact that in spite of the nations states sovereignty over these territories, indigenous peoples still constitute a social and cultural reality in their own homelands and in relation to the state. Thus, courts in Australia and Canada solved the current legal and political dilemmas by abolishing legal conventions like terra nullius as legal fictions, by transcending legal precedents and norms of current law, and by inventing legal principles like Native Title.

    This answers 'Determine their economic, social, and cultural development' somewhat: The external aspect is connected to indigenous peoples' traditional land and water areas and natural resources. A part of the right to self-determination is to give indigenous people the right to decide on and/or exercise influence over their land and water areas, natural resources and traditional forms of living. Several UN agencies have emphasized that indigenous people have the right to control their traditional land and water areas, natural resources and traditional forms of livelihoods. In 2007, the United Nations adopted a declaration on the rights of indigenous peoples that, among other things, recognizes indigenous peoples' rights to self-determination and the right to own, use and control land and natural resources. According to the declaration, land areas traditionally used by Sami can no longer be regarded as property of the State. According to the declaration, the Sami shall have the right to restoration of, or compensation for, land and natural resources that have been used without Sami consent.
