  • "Today's vote is good news for European consumers," said Viviane Reding, the EU Telecoms Commissioner. "The European Parliament has today voted in favour of a strong and competitive Single Telecoms Market without borders for cross-border services, competition and investment in Europe. This will level the playing field for telecoms operators in Europe, enhance legal certainty, and broaden consumer choice."
  • the European Parliament today voted in favour of establishing a European telecoms regulator.
  • new body will be financed from the EU budget in order to strengthen its independence and to ensure equality among national regulators.

  • I strongly welcome the European Parliament's support for adding the new remedy of functional separation – which requires an incumbent operator to separate its network infrastructure from its services branch – to the toolbox of national regulators. This last-resort remedy has the capacity to rapidly improve competition in markets while maintaining incentives for investment in new networks, as shown in the UK where it has already been implemented. The Parliament's vote will contribute legal certainty to countries where functional separation is already under discussion, especially Sweden, Poland and Greece."

Fiberevolution: Fiber financing - 0 views

  •
So there you have it. My "optimistic" view. The crisis is shattering the all-private dogma, and that's at least one good aspect of it. Sure, it raises a number of new questions and issues for incumbents, regulators and service providers. But then these issues would have needed tackling anyway, they're just likely to be more visible in the next few years...

Rapid - Press Releases - EUROPA - 0 views

  • The deployment of NGA is indispensable to deliver new broadband services to European consumers. While a number of operators, both incumbents and alternative operators, have launched large-scale rollouts of new broadband infrastructure in a number of Member States, Europe appears to be still lagging behind other economies, notably the United States and Japan.
  • The basic principle of the Commission's draft Recommendation is that national regulatory authorities should provide access to the networks of dominant operators at the lowest possible level. In particular, they should mandate access to the ducts of the dominant operators allowing competitors to roll out their own fibre. However NRAs should also impose further physical access obligations (access to unlit fibre) beyond access to ducts where ducts are not available or the population density is too low for a sustainable business model. Access to active elements such as "bitstream" shall be maintained provided lower level remedies do not sufficiently address distortions of competition.

  • ARCEP's Market 4 decision of 25 July 2008 (page 76) indicates that it will consider extending fibre access obligations if the regulatory measures are insufficient to guarantee competition; the European Commission indicated in its letter dated 18 July 2008 (page 11) (which predates the adoption of the Law) that it encourages ARCEP to consider imposing other remedies in relation to market 4, in case the adopted law would not be sufficient to ensure effective competition in combination with duct access.
