    Excellent article other than the fact that the author erred in referring to the AR-15 as an "assault rifle." It is not. It is an "assault weapon," a semi-automatic rifle with only a cosmetic resemblance to the M-16 fully automatic "assault rifle." "Assault rifles" have been outlawed in the U.S. for decades. The U.S. had a complete ban on "assault weapon" rifles from 1994 to 2004. It did not affect gun violence rates at all, because semi-automatic rifles that lacked the cosmetic resemblance to "assault rifles" remained on the market. The distinction between the two terms is critical to understanding the current gun debate. Those who propose a ban on "assault weapons" are offering only a cosmetic sop to the anti-gun crowd, banning a sub-set of semi-automatic rifles whilst leaving equally capable semi-autos on the market. The correct question to ask is "why bother?" One might as well ban toy guns that bear a resemblance to assault weapons; other toy guns remain unaffected.   • Clinton’s State Department was getting pressure from President Obama and his White House inner circle, as well as heads of state internationally, to try and cutoff Assange’s delivery of the cables and if that effort failed, then to forge a strategy to minimize the administration’s public embarrassment over the contents of the cables. Hence, Clinton’s early morning November meeting of State’s top brass who floated various proposals to stop, slow or spin the Wikileaks contamination. That is when a frustrated Clinton, sources said, at some point blurted out a controversial query. “Can’t we just drone this guy?” Clinton openly inquired, offering a simple remedy to silence Assange and smother Wikileaks via a planned military drone strike, according to State Department sources. The statement drew laughter from the room which quickly died off when the Secretary kept talking in a terse manner, sources said. Clinton said Assange, after all, was a relatively soft target, “walking around” freely and thumbing his nose without any fear of reprisals from the United States. Clinton was upset about Assange’s previous 2010 records releases, divulging secret U.S. documents about the war in Afghanistan in July and the war in Iraq just a month earlier in October, sources said. At that time in 2010, Assange was relatively free and not living cloistered in in the embassy of Ecuador in London. Prior to 2010, Assange focused Wikileaks’ efforts on countries outside the United States but now under Clinton and Obama, Assange was hammering America with an unparalleled third sweeping Wikileaks document dump in five months. Clinton was fuming, sources said, as each State Department cable dispatched during the Obama administration was signed by her.
  • Following Clinton’s alleged drone proposal, another controversial remedy was floated in the State Department to place a reward or bounty for Assange’s capture and extradition to the United States, sources said. Numbers were discussed in the realm of a $10 million bounty. A State Department source described that staff meeting as bizarre. One minute staffers were inquiring about the Secretary’s blue and black checkered knit sweater and the next minute, the room was discussing the legalities of a drone strike on Assange and financial bounties, sources said. Immediately following the conclusion of the wild brainstorming session, one of Clinton’s top aides, State Department Director of Policy Planning Ann-Marie Slaughter, penned an email to Clinton, Chief of Staff Cheryl Mills, and aides Huma Abebin and Jacob Sullivan at 10:29 a.m. entitled “an SP memo on possible legal and nonlegal strategies re Wikileaks.” “Nonlegal strategies.” How did that phrasing make it into an official State Department email subject line dealing with solving Wikileaks and Assange? Why would the secretary of state and her inner circle be discussing any “nonlegal strategies” for anything whatsoever? Against anyone? Shouldn’t all the strategies discussed by the country’s top diplomat be strictly legal only? And is the email a smoking gun to confirm Clinton was actually serious about pursuing an obvious “nonlegal strategy” proposal to allegedly assassinate Assange? Numerous attempts were made to try and interview and decipher Slaughter’s choice of email wording, however, she could not be reached for comment.
  • Slaughter’s cryptic email also contained an attached document called “SP Wikileaks doc final11.23.10.docx.” That attachment portion of Slaughter’s “nonlegal strategies” email has yet to be recovered by federal investigators and House committee investigators probing Clinton’s email practices while at State. Even Wikileaks does not have the document. Slaughter, however, shed some light on the attachment: “The result is the attached memo, which has one interesting legal approach and I think some very good suggestions about how to handle our public diplomacy.” But did it also include details on the “nonlegal strategies” teased in the subject line? Sources confirm Clinton took the email and attachment with her to the White House for an afternoon meeting with Secretary of Defense Bob Gates and National Security Advisor Tom Donilon prior to an additional evening meeting at the White House. President Obama, sources said, did not attend the early meeting with Gates as he was traveling with Vice President Joe Biden. President Obama did attend the second meeting, however, and Wikileaks and Assange’s planned release of secret cables were discussed at length, sources said. Attending this meeting were President Obama, Clinton, Gates, Donilon, Director of National Intelligence James Clapper, Deputy Secretary of State James Steinberg, Under Secretary of Defense for Policy Michele Flournoy, Chairman of the Joint Chiefs of Staff Admiral “Mike” Mullen, Vice Chairman of the Joint Chiefs of Staff Gen. James Cartwright as well as a half dozen or more various policy aides, sources confirmed. Did Clinton also share her alleged morning query of droning Assange with the members of the National Security Council and the President? Was it discussed among the top secret subjects in the meeting? Or was Clinton planning to conduct or hatch her own secret foreign policy in defiance of the President, a likely violation of the Logan Act?

Shortly after CableGate, the WikiLeaks founder sought refuge from authorities and threats by hiding at the Ecuadorian Embassy in London. Now 45, Assange is in his fifth year living quarantined inside the embassy. Clinton remains the Democratic nominee for the presidency of the United States.

The information is an analysis of the ongoing battle between Obama and his illegal NSA spying activities and uber patriot, Edward Snowden; and his media connection Glen Greenwald of the UK Guardian. So far the patriots are winning. So often we hear the facts about an issue; the date, time and places stuff. But rarely do we find insightful analysis where the dots are connected. Naked Capitalism provides exactly that kind of insight. Awesome covergage! Covers Congressman Alan Grayson's unsuccessful attempts to hold a hearing on NSA activities. Grayson has scheduled Greenwald to appear and testify before Congress. excerpt: "Shortly after the vote, Alan Grayson invited members to a session scheduled for the morning of Wednesday, July 31, in which Greenwald would testify via video link. Richard Clarke, the chairman of the Counter-terrorism Security Group and a member of the National Security Group, was also scheduled to participate. Within 24 hours of Grayson announcing the meeting, which got the expected considerable interest from members, Clarke withdrew. He initially claimed to have developed a scheduling conflict, but it became clear he'd gotten the Elizabeth Warren treatment from the Administration, of being offered an undisclosed goodie (not of monetary value, but of participation in an insider process) and he was told that participating in this session would preclude his involvement in the other initiative.   • “Deaf ears”? I’m not buying it. I think the intelligence went straight to the top, where Obama and his neocon colleagues came up with the plan that is unfolding as we speak. They figured, if they just look the other way and let these homicidal madhatters seize a few cities and raise a little Hell, they’d be able to kill two birds with one stone, that is,  get rid of al Mailiki and partition the country at the same time. But, it’s not going to work out like Obama expects, mainly because this is just about the dumbest plan ever conjured up. I would give it an 80 percent chance blowing up in Obama’s face in less than a month’s time. This turkey has failure written all over it.

  • I BELIEVE that killing an American citizen without a trial is an extraordinary concept and deserves serious debate. I can’t imagine appointing someone to the federal bench, one level below the Supreme Court, without fully understanding that person’s views concerning the extrajudicial killing of American citizens.But President Obama is seeking to do just that. He has nominated David J. Barron, a Harvard law professor and a former acting assistant attorney general, to a seat on the United States Court of Appeals for the First Circuit.
  • I believe that all senators should have access to all of these opinions. Furthermore, the American people deserve to see redacted versions of these memos so that they can understand the Obama administration’s legal justification for this extraordinary exercise of executive power. The White House may invoke national security against disclosure, but legal arguments that affect the rights of every American should not have the privilege of secrecy.I agree with the A.C.L.U. that “no senator can meaningfully carry out his or her constitutional obligation to provide ‘advice and consent’ on this nomination to a lifetime position as a federal appellate judge without being able to read Mr. Barron’s most important and consequential legal writing.” The A.C.L.U. cites the fact that in modern history, a presidential order to kill an American citizen away from a battlefield is unprecedented.The Bill of Rights is clear. The Fifth Amendment provides that no one can be “deprived of life, liberty, or property, without due process of law.” The Sixth Amendment provides that “the accused shall enjoy the right to a speedy and public trial, by an impartial jury,” as well as the right to be informed of all charges and have access to legal counsel. These are fundamental rights that cannot be waived with a presidential pen.

The American Civil Liberties Union sent a letter to all senators on May 6, noting that in the view of the Senate Intelligence Committee chairwoman, Dianne Feinstein, “there are at least eleven OLC opinions on the targeted killing or drone program.” It has not been established whether Mr. Barron wrote all those memos, but we do know that his controversial classified opinions provided the president with a legal argument and justification to target an American citizen for execution without a trial by jury or due process.

In his important book Confidence Men: Wall Street, Washington, and the Education of a President (2011), the Pulitzer Prize-winning author Ron Suskind tells a remarkable story from March of 2009. Three months into Barack Obama’s supposedly progressive, left-leaning presidency, popular anger at Wall Street was intense and the nation’s leading financial institutions were weak and on the defensive in the wake of the financial collapse and recession they had created. The new president called a meeting of the nation’s top 13 financial executives at the White House. The banking titans came into the meeting full of dread. As Suskind noted: “They were the CEOs of the thirteen largest banking institutions in the United States… And they were nervous in ways that these men are never nervous. Many would have had to reach back to their college days, or even grade school, to remember a moment when they felt this sort of lump-in-the-throat tension…As some of the most successful men in the country, they weren’t used to being pariahs… [and] they were indeed pariahs. The populist backlash against the financial sector—building steadily since September—was finally beginning to cause grave discomfort on Wall Street. As unemployment ballooned and credit tightened, the country began to look inward, toward the origins of the panic and its disastrous consequences.”
  • In the end, however, the anxious captains of high finance left the meeting pleased to learn that Obama was totally in their camp. For instead of standing up for those who had been harmed most by the crisis—workers, minorities, and the poor – Obama sided unequivocally with those who had caused the meltdown. “My administration is the only thing between you and the pitchforks,” Obama said. “You guys have an acute public relations problem that’s turning into a political problem. And I want to help…I’m not here to go after you. I’m protecting you…. I’m going to shield you from congressional and public anger.” For the banking elite who destroyed millions of jobs in their lust for profit, there was, as Suskind puts it, “Nothing to worry about. Whereas [President Franklin Delano] Roosevelt had [during the Great Depression] pushed for tough, viciously opposed reforms of Wall Street and famously said ‘I welcome their hate,’ Obama was saying ‘How can I help?’” As one leading banker told Suskind, “The sense of everyone after the meeting was relief. The president had us at a moment of real vulnerability. At that point, he could have ordered us to do just about anything and we would have rolled over. But he didn’t – he mostly wanted to help us out, to quell the mob.” When “the bankers arrived in the State Dining Room,” Suskind notes, “Obama had them scared and ready to do almost anything he said…. An hour later, they were upbeat, ready to fly home and commence business as usual” (Confidence Men).
  • This remarkable episode happened in the White House in a time when, to repeat, the Democrats held the majority in both houses of Congress along with an angry populace ready with good reason for Wall Street and 1% blood. And what did the populace get from this seemingly progressive alignment of the stars? The venerable left liberal journalist William Grieder put it very well in a March 2009 Washington Post Op-Ed: “a blunt lesson about power, who has it and who doesn’t.” Americans “watched Washington rush to rescue the very financial interests that caused the catastrophe. They learned that government has plenty of money to spend when the right people want it. ‘Where’s my bailout,’ became the rueful punch line at lunch counters and construction sites nationwide. Then to deepen the insult, people watched as establishment forces re-launched their campaign for ‘entitlement reform’ – a euphemism for whacking Social Security benefits, Medicare and Medicaid.”

Yet AG Holder with all the majesty of office declares China engaged in criminal economic espionage against America, even DOJ issuing “wanted” posters, pictures and names, of five army officers to stand trial in Pennsylvania for cyberattacks on US corporations and the Steelworkers’ Union. More like it would be, the International Criminal Court issuing an Obama “wanted” poster for war crimes that include intervention, regime change, and assassination, and the World Trade Organization (if it were not dominated already by the US) for the exact kind of espionage Holder charges against China. If we are to be symmetrical, how about a Beijing court issuing subpoenas, accompanied by “wanted” posters for five members of OTNS (Obama Team National Security), say, Clapper, Rice, Comey, Brennan, and Dempsey? The chance of US honoring the request for the extradition of its five, is about as slim as China honoring the request for extraditing, though at a lower functional level in policy making and execution, its five—perhaps selected at random, unless the US has hacked into the computers of, or placed informants in (or both)–the People’s Liberation Army (PLA Unit61398).

FBI Flouts Obama Directive to Limit Gag Orders on National Security Letters - The Inter... - 0 views

  • Despite the post-Snowden spotlight on mass surveillance, the intelligence community’s easiest end-run around the Fourth Amendment since 2001 has been something called a National Security Letter. FBI agents can demand that an Internet service provider, telephone company or financial institution turn over its records on any number of people — without any judicial review whatsoever — simply by writing a letter that says the information is needed for national security purposes. The FBI at one point was cranking out over 50,000 such letters a year; by the latest count, it still issues about 60 a day. The letters look like this:
  • Recipients are legally required to comply — but it doesn’t stop there. They also aren’t allowed to mention the order to anyone, least of all the person whose data is being searched. Ever. That’s because National Security Letters almost always come with eternal gag orders. Here’s that part:
  • That means the NSL process utterly disregards the First Amendment as well. More than a year ago, President Obama announced that he was ordering the Justice Department to terminate gag orders “within a fixed time unless the government demonstrates a real need for further secrecy.” And on Feb. 3, when the Office of the Director of National Intelligence announced a handful of baby steps resulting from its “comprehensive effort to examine and enhance [its] privacy and civil liberty protections” one of the most concrete was — finally — to cap the gag orders: In response to the President’s new direction, the FBI will now presumptively terminate National Security Letter nondisclosure orders at the earlier of three years after the opening of a fully predicated investigation or the investigation’s close. Continued nondisclosures orders beyond this period are permitted only if a Special Agent in Charge or a Deputy Assistant Director determines that the statutory standards for nondisclosure continue to be satisfied and that the case agent has justified, in writing, why continued nondisclosure is appropriate.

  • Despite the use of the word “now” in that first sentence, however, the FBI has yet to do any such thing. It has not announced any such change, nor explained how it will implement it, or when. Media inquiries were greeted with stalling and, finally, a no comment — ostensibly on advice of legal counsel. “There is pending litigation that deals with a lot of the same questions you’re asking, out of the Ninth Circuit,” FBI spokesman Chris Allen told me. “So for now, we’ll just have to decline to comment.” FBI lawyers are working on a court filing for that case, and “it will address” the new policy, he said. He would not say when to expect it.
  • There is indeed a significant case currently before the federal appeals court in San Francisco. Oral arguments were in October. A decision could come any time. But in that case, the Electronic Frontier Foundation (EFF), which is representing two unnamed communications companies that received NSLs, is calling for the entire NSL statute to be thrown out as unconstitutional — not for a tweak to the gag. And it has a March 2013 district court ruling in its favor. “The gag is a prior restraint under the First Amendment, and prior restraints have to meet an extremely high burden,” said Andrew Crocker, a legal fellow at EFF. That means going to court and meeting the burden of proof — not just signing a letter. Or as the Cato Institute’s Julian Sanchez put it, “To have such a low bar for denying persons or companies the right to speak about government orders they have been served with is anathema. And it is not very good for accountability.”
  • In a separate case, a wide range of media companies (including First Look Media, the non-profit digital media venture that produces The Intercept) are supporting a lawsuit filed by Twitter, demanding the right to say specifically how many NSLs it has received. But simply releasing companies from a gag doesn’t assure the kind of accountability that privacy advocates are saying is required by the Constitution. “What the public has to remember is a NSL is asking for your information, but it’s not asking it from you,” said Michael German, a former FBI agent who is now a fellow with the Brennan Center for Justice. “The vast majority of these things go to the very large telecommunications and financial companies who have a large stake in maintaining a good relationship with the government because they’re heavily regulated entities.”
  • So, German said, “the number of NSLs that would be exposed as a result of the release of the gag order is probably very few. The person whose records are being obtained is the one who should receive some notification.” A time limit on gags going forward also raises the question of whether past gag orders will now be withdrawn. “Obviously there are at this point literally hundreds of thousands of National Security Letters that are more than three years old,” said Sanchez. Individual review is therefore unlikely, but there ought to be some recourse, he said. And the further back you go, “it becomes increasingly implausible that a significant percentage of those are going to entail some dire national security risk.” The NSL program has a troubled history. The absolute secrecy of the program and resulting lack of accountability led to systemic abuse as documented by repeated inspector-general investigations, including improperly authorized NSLs, factual misstatements in the NSLs, improper requests under NSL statutes, requests for information based on First Amendment protected activity, “after-the-fact” blanket NSLs to “cover” illegal requests, and hundreds of NSLs for “community of interest” or “calling circle” information without any determination that the telephone numbers were relevant to authorized national security investigations.
  • Obama’s own hand-selected “Review Group on Intelligence and Communications Technologies” recommended in December 2013 that NSLs should only be issued after judicial review — just like warrants — and that any gag should end within 180 days barring judicial re-approval. But FBI director James Comey objected to the idea, calling NSLs “a very important tool that is essential to the work we do.” His argument evidently prevailed with Obama.
  • NSLs have managed to stay largely under the American public’s radar. But, Crocker says, “pretty much every time I bring it up and give the thumbnail, people are shocked.   • The Russian-led military coalition is badly beating Washington’s proxies in Syria which is why John Kerry is calling for a “Time Out”. On Monday, U.S. Secretary of State John Kerry called for an emergency summit later in the week so that leaders from Russia, Turkey, Saudi Arabia and Jordan could discuss ways to avoid the “total destruction” of Syria. According to Kerry, “Everybody, including the Russians and the Iranians, have said there is no military solution, so we need to make an effort to find a political solution. This is a human catastrophe that now threatens the integrity of a whole group of countries around the region,” Kerry added. Of course, it was never a “catastrophe” when the terrorists were destroying cities and villages across the country, uprooting half the population and transforming the once-unified and secure nation into an anarchic failed state. It only became a catastrophe when Vladimir Putin synchronized the Russian bombing campaign with allied forces on the ground who started wiping out hundreds of US-backed militants and recapturing critical cities across Western corridor. Now that the Russian airforce is pounding the living daylights out of jihadi ammo dumps, weapons depots and rebel strongholds, and the Syrian Arab Army (SAA) is tightening their grip on Aleppo, and Hezbollah is inflicting heavy casualties on Jabhat al Nusra militants and other Al Qaida-linked vermin; Kerry’s decided it’s a catastrophe. Now that the momentum of the war has shifted in favor of Syrian president Bashar al Assad, Kerry wants a “Time out”.
  • Keep in mind, that Putin worked tirelessly throughout the summer months to try to bring the warring parties together (including Assad’s political opposition) to see if deal could be worked out to stabilize Syria and fight ISIS. But Washington wanted no part of any Russian-led coalition. Having exhausted all the possibilities for resolving the conflict through a broader consensus, Putin decided to get directly involved by committing the Russian airforce to lead the fight against the Sunni extremists and other anti-government forces that have been tearing the country apart and paving the way for Al Qaida-linked forces to take control of the Capital. Putin’s intervention stopped the emergence of a terrorist Caliphate in Damascus. He turned the tide in the four year-long war, and delivered a body-blow to Washington’s malign strategy Now he’s going to finish the job. Putin is not gullible enough to fall for Kerry’s stalling tactic. He’s going to kill or capture as many of the terrorists as possible and he’s not going to let Uncle Sam get in the way. These terrorists–over 2,000 of who are from Chechnya–pose an existential threat to Russia, as does the US plan to use Islamic extremists to advance their foreign policy objectives. Putin takes the threat seriously. He knows that if Washington’s strategy succeeds in Syria, it will be used in Iran and then again in Russia. That’s why he’s decided to dump tons of money and resources into the project. That’s why his Generals have worked out all the details and come up with a rock-solid strategy for annihilating this clatter of juvenile delinquents and for restoring Syria’s sovereign borders. And that’s why he’s not going to be waved-away by the likes of mealy-mouth John Kerry. Putin is going to see this thing through to the bitter end. He’s not going to stop for anyone or anything. Winning in Syria is a matter of national security, Russia’s national security.
  • “Syrian President Bashar Assad “does not have to leave tomorrow or the next day,” the US State Department (spokesman Mark Toner) has stated. Washington allows that Assad may take part in transitional process, but can’t be part of Syria’s next government… “… this isn’t the US dictating this. This is the feeling of many governments around the world, and frankly, the majority of the Syrian people,” Toner said.

  • Putin has offered solutions from the very onset, it was Washington that rejected those remedies. Putin supported the so called Geneva communique dating back to 2012. In fact, it was then-Secretary of State Hillary Clinton who threw a wrench in the proceedings by demanding that Assad not be part of any transitional governing body. (Note: Now Obama has caved on this demand.) Russia saw her demand as tantamount to regime change, which it was since Assad is the internationally-recognized head of state and fully entitled to be a part of any transitional government. US rejectionism sabotaged efforts for internationally-monitored “free and fair multi-party elections” and ended any chance for a speedy end to the war. Washington was more determined to get its own way (“Assad must go”) then to save the lives of tens of thousands of civilians who have died since Clinton walked away from Geneva. And now Kerry is extending the olive branch? Now Washington pretends to care about the “total destruction” of Syria? I’m not buying it. What Kerry cares about is his hoodlum “head-chopper” buddies that are being turned into shredded wheat by Russian Daisy Cutters. That’s what he cares about. Take a look at this from RT:
  • Toner is backpeddling so fast he’s not even sure what he’s saying. Clearly, the administration is so flustered by developments on the ground in Syria, and so eager to stop the killing of US-backed jihadis, that they sent poor Toner out to talk to the media before he’d even gotten his talking points figured out. What a joke. The administration has gone from refusing to meet with a high-level Russian delegation just last week (to talk about coordinating airstrikes in Syria), to completely capitulating on their ridiculous “Assad must go” position today. That’s quite a reversal, don’t you think? I’m surprised they didn’t just run a big white Flag up over 1600 Pennsylvania Ave. while the Marine Band played Taps. But don’t think that this latest humiliation will derail Washington’s plan for destroying Syria as a functioning, sovereign state and carving it into a million powerless statelets that pose no threat to Big Oil’s pipeline corridors, or US military bases, or Israel’s sprawling Zionist Valhalla. Because it won’t. That plan is still right on track despite Putin’s efforts to crush the militants and defend the borders.
  • Topple Assad and partition the country. Destroy Syria once and for all. That is Washington’s operating strategy. It’s a plan that was first proposed by Brooking’s analyst Michael O’Hanlon who recently said: “…a future Syria could be a confederation of several sectors: one largely Alawite (Assad’s own sect), spread along the Mediterranean coast; another Kurdish, along the north and northeast corridors near the Turkish border; a third primarily Druse, in the southwest; a fourth largely made up of Sunni Muslims; and then a central zone of intermixed groups in the country’s main population belt from Damascus to Aleppo… Under such an arrangement, Assad would ultimately have to step down from power in Damascus… A weak central government would replace him. But most of the power, as well as most of the armed forces. would reside within the individual autonomous sectors — and belong to the various regional governments… American and other foreign trainers would need to deploy inside Syria, where the would-be recruits actually live — and must stay, if they are to protect their families. (Syria’s one hope may be as dim as Bosnia’s once was, Michael O’ Hanlon, Reuters)
  • Once again, the same theme repeated: Topple Assad and partition the country. Of course, the US will have to train “would-be recruits” to police the natives and prevent the buildup of any coalition or militia that might threaten US imperial ambitions in the region. But that goes without saying. (By the way, Hillary Clinton has already thrown her support behind the O’Hanlon plan emphasizing the importance of “safe zones” that could be used to harbor Sunni militants and other enemies of the state.)
  • (Note: As this article was going to press, the Turkish Daily Zaman reported that: “….the US and several European and Gulf states…have agreed to a plan under which Syria’s embattled President Bashar al-Assad will remain in power for the next six months during a transition period….Turkey has abandoned its determination [to get rid of Assad] and has agreed on an interim period with Assad in place,” former Foreign Minister Yaşar Yakış told Today’s Zaman on Tuesday….If the Syrian people decide to continue with Assad, then there is not much Turkey can object to.” (Report: Turkey agrees to Syria political transition involving Assad, Today’s Zaman) This story has not yet appeared in any western media. Obama’s Syrian policy has completely collapsed.

  • Over the last year the U.S. bombed Jabhat al-Nusra personal and facilities in Syria some five or six times. The al-Qaeda subgroup also has a history of attacking U.S. paid "relative moderate" proxy forces in Syria. The Pentagon recently inserted another U.S. mercenary group into north Syria. This was accompanied by a media campaign in which the administration lauded itself for the operation. The newly inserted group is especially trained and equipped to direct U.S. air attacks like those that earlier hit al-Nusra fighters. Now that freshly inserted group was attacked by Jabhat al-Nusra. Some of its members were killed and others were abducted. The Obama administration is shocked, SHOCKED, ABSOLUTELY SHOCKED that Jabhat al-Nusra would do such a ghastly deed. "Why would they do that?" "Who could have known that they would attack U.S. proxy forces???"
  • There is no longer an Jihadist ISIS or ISIL in Syria and Iraq. The people leading that entity declared (pdf) today, at the highly symbolic beginning of Ramadan, themselves to be a new caliphate:

  • On more thought from me on why the dimwits did not foresee that Nusra would attack. The White House insisted on calling a part of Nusra the "Khorasan group" and explained that it was only bombing this groups of alQaeda veterans now part of Nusra because the "Khorasan group" planning to hit in "western" countries. No expert nor anyone on the ground in Syria thought that this differentiation was meaningful. Nusra is alQaeda and so are all of its members. But the White House and Pentagon probably thought that Nusra would accept the artificial separation they themselves had made up. That Nusra would understand that it is seen as an "ally" and only the "Khorasan group" is seen as an enemy. If that was the line of thinking, and the situation seems to point to that, then these people have fallen for their own propaganda stunt. They probably believed that the "Khorasan group" was an accepted narrative because they were telling that tale to themselves. Poor idiots.
  • UPDATE: The one sane guy at the Council of Foreign relations, Micah Zenko, foresaw this debacle and wrote on March 2: [The U.S. trained mercenaries] will immediately be an attractive target for attacks by the Islamic State, Assad’s ground and air forces, and perhaps Nusra and other forces. Killing or taking prisoner fighters (or the families of those fighters) who were trained by the U.S. military will offer propaganda value, as well as leverage, to bargain for those prisoners’ release. He compared the whole operation to the 1961 CIA invasion of Cuba: Last September, the White House and Congress agreed to authorize and fund a train-and-equip project similar to the Bay of Pigs, but this time in the Middle East, without any discussion about phase two. The Syrian project resembles 1961 in two ways: What happens when the fighting starts is undecided, and the intended strategic objective is wholly implausible.
  • The attack on Friday was mounted by the Nusra Front, which is affiliated with Al Qaeda. It came a day after the Nusra Front captured two leaders and at least six fighters of Division 30, which supplied the first trainees to graduate from the Pentagon’s anti-Islamic State training program. In Washington, several current and former senior administration officials acknowledged that the attack and the abductions by the Nusra Front took American officials by surprise and amounted to a significant intelligence failure. While American military trainers had gone to great lengths to protect the initial group of trainees from attacks by Islamic State or Syrian Army forces, they did not anticipate an assault from the Nusra Front. In fact, officials said on Friday, they expected the Nusra Front to welcome Division 30 as an ally in its fight against the Islamic State....A senior Defense Department official acknowledged that the threat to the trainees and their Syrian recruiters had been misjudged, and said that officials were trying to understand why the Nusra Front had turned on the trainees. Like other Obama administration operations this one did not fail because of "intelligence failure" but because an utter lack of common sense.
  • U.S. media can no agree with itself if Russia is giving ISIS an airforce or if Russia pounds ISIS with the biggest bomber raid in decades. Such confusion occurs when propaganda fantasies collide with the observable reality. To bridge such divide requires some fudging. So when the U.S. claims to act against the finances of the Islamic State while not doing much, the U.S Public Broadcasting Service has to use footage of Russian airstrikes against the Islamic State while reporting claimed U.S. airstrike successes. The U.S. military recently claimed to have hit Islamic State oil tankers in Syria. This only after Putin embarrassed Obama at the G-20 meeting in Turkey. Putin showed satellite pictures of ridiculous long tanker lines waiting for days and weeks to load oil from the Islamic State without any U.S. interference.
  • The U.S. then claimed to have hit 116 oil tankers while the Russian air force claims to have hit 500. But there is an important difference between these claims. The Russians provided videos showing how their airstrikes hit at least two different very large oil tanker assemblies with hundreds of tankers in each. They also provided video of several hits on oil storage sites and refinery infrastructure. I have found no video of U.S. hits on Islamic State oil tanker assemblies. The U.S. PBS NewsHour did not find any either. In their TV report yesterday about Islamic State financing and the claimed U.S. hits on oil trucks they used the videos Russia provided without revealing the source. You can see the Russian videos played within an interview with a U.S. military spokesperson at 2:22 min.
  • The U.S. military spokesperson speaks on camera about U.S. airforce hits against the Islamic State. The video cuts to footage taken by Russian airplanes hitting oil tanks and then trucks. The voice-over while showing the Russian video with the Russians blowing up trucks says: "For the first time the U.S. is attacking oil delivery trucks." The video then cuts back to the U.S. military spokesperson. At no point is the Russian campaign mentioned or the source of the footage revealed. Any average viewer of the PBS report will assume that the black and white explosions of oil trucks and tanks are from of U.S. airstrikes filmed by U.S. air force planes. The U.S. military itself admitted that its strikes on IS oil infrastructure over the last year were "minimally effective". One wonders then how effective the claimed strike against 116 trucks really was. But unless we have U.S. video of such strikes and not copies of Russian strike video fraudulently passed off as U.S. strikes we will not know if those strikes happened at all.
  • The wannabe Sultan Erdogan did not get his will in Syria where he had planned to capture and annex Aleppo. The Russians prevented that. He now goes for his secondary target, Mosul in Iraq, which many Turks see as historic part of their country
  • Mosul, Iraq's second biggest city with about a million inhabitants, is currently occupied by the Islamic State. On Friday a column of some 1,200 Turkish soldiers with some 20 tanks and heavy artillery moved into a camp near Mosul. The camp was one of four small training areas where Turkey was training Kurds and some Sunni-Arab Iraqis to fight the Islamic State. The small camps in the northern Kurdish area have been there since the 1990s. They were first established to fight the PKK. Later their Turkish presence was justified as ceasefire monitors after an agreement ended the inner Kurdish war between the KDP forces loyal to the Barzani clan and the PUK forces of the Talabani clan. The bases were actually used to monitor movement of the PKK forces which fight for Kurdish independence in Turkey. The base near Mosul is new and it was claimed to be just a small weapons training base. But tanks and artillery have a very different quality than some basic AK-47 training. Turkey says it will increase the numbers in these camps to over 2000 soldiers.
  • Should Mosul be cleared of the Islamic State the Turkish heavy weapons will make it possible for Turkey to claim the city unless the Iraqi government will use all its power to fight that claim. Should the city stay in the hands of the Islamic State Turkey will make a deal with it and act as its protector. It will benefit from the oil around Mosul which will be transferred through north Iraq to Turkey and from there sold on the world markets. In short: This is an effort to seize Iraq's northern oil fields. That is the plan but it is a risky one. Turkey did not ask for permission to invade Iraq and did not inform the Iraqi government. The Turks claim that they were invited by the Kurds: Turkey will have a permanent military base in the Bashiqa region of Mosul as the Turkish forces in the region training the Peshmerga forces have been reinforced, Hürriyet reported. The deal regarding the base was signed between Kurdistan Regional Government (KRG) President Massoud Barzani and Turkish Foreign Minister Feridun Sinirlioğlu, during the latter’s visit to northern Iraq on Nov. 4. There are two problems with this. First: Massoud Barzani is no longer president of the KRG. His mandate ran out and the parliament refused to prolong it. Second: Mosul and its Bashiqa area are not part of the KRG. Barzani making a deal about it is like him making a deal about Paris.
  • The Iraqi government and all major Iraqi parties see the Turkish invasion as a hostile act against their country. Abadi demanded the immediate withdrawal of the Turkish forces but it is unlikely that Turkey will act on that. Some Iraqi politicians have called for the immediate dispatch of the Iraqi air force to bomb the Turks near Mosul. That would probably the best solution right now but the U.S. installed Premier Abadi is too timid to go for such strikes. The thinking in Baghdad is that Turkey can be kicked out after the Islamic State is defeated. But this thinking gives Turkey only more reason to keep the Islamic State alive and use it for its own purpose. The cancer should be routed now as it is still small. Barzani's Kurdistan is so broke that is has even confiscated foreign bank accounts to pay some bills. That may be the reason why Barzani agreed to the deal now. But the roots run deeper. Barzani is illegally selling oil that belongs to the Iraqi government to Turkey. The Barzani family occupies  not only the presidential office in the KRG but also the prime minister position and the local secret services. It is running the oil business and gets a big share of everything else. On the Turkish side the oil deal is handled within the family of President Erdogan. His son in law, now energy minister, had the exclusive right to transport the Kurdish oil through Turkey. Erdogan's son controls the shipping company that transports the oil over sea to the customer, most often Israel. The oil under the control of the Islamic State in Iraq passes the exactly same route. These are businesses that generate hundreds of millions per year.
  • It is unlikely that U.S., if it is not behinds Turkey new escapade, will do anything about it. The best Iraq could do now is to ask the Russians for their active military support. The Turks insisted on their sovereignty when they ambushed a Russian jet that brushed its border but had no intend of harming Turkey. Iraq should likewise insist on its sovereignty, ask Russia for help and immediately kick the Turks out. The longer it waits the bigger the risk that Turkey will eventually own Mosul.

The reality is still far from it: [H]is administration crafted a draft order that would direct the Pentagon and the State Department to submit plans for the safe zones within 90 days. The order hasn't yet been issued. The draft of the order, which will be endlessly revised, says that safe zones could be in Syria or in neighboring countries. The Pentagon has always argued against such zones in Syria and the plans it will submit, should such an order be issued at all, will reflect that. The safe zones in Syria ain't gonna happen

It reflects political incompetence on a scale so great as to make Mitt Romney's gaffes a little bitty thing.   • It was 12 years ago today. Historians will register that, according to the official narrative, 19 Arabs armed with box cutters and minimal flying skills pledged to a transnational Terror Inc turned jets into missiles to attack the US homeland, fooling the most elaborate defense system on Earth.  Fast forward to 2013. Here's a 15-second version of the President of the United States (POTUS) address on Syria, one day before the 12th anniversary of 9/11: "Our ideals and principles, as well as our national security, are at stake. The United States is 'the anchor of global security.' Although the United States military 'doesn't do pin pricks,' we still carry the burden to punish regimes that would flout long-held conventions banning the use of biological, chemical and nuclear weapons.  "That's why I have decided to pursue an unlimited, targeted military strike against Washington DC." For countless global citizens, this alternative version predictably sounds as far-fetched as the official version of what happened 12 years ago. The fog of war obscures in mysterious ways. But the fact remains that the current, "reluctant" (farcical) Emperor continues to stake his -- and his nation's -- "credibility" on a "limited," "kinetic" operation to reinforce his self-defined red line against chemical weapons. 
  • In theory, the Russian plan of having Damascus surrender its chemical weapons arsenal works because of its inbuilt Chinese wisdom; nobody loses face -- from Obama and the US Congress to the European Union, the UN and the even more farcical "Arab" League, which is essentially a Saudi Arabian colony.  Although Obama is on a media blitzkrieg stealing the credit for it, Asia Times Online has confirmed that the plan was elaborated by Damascus, Tehran and Moscow last week -- after a visit to Damascus by the head of the national security committee of the Iranian Majlis (parliament), Alaeddin Boroujerdi. A brand new propaganda/manufactured hysteria campaign must be unfurled to justify war. And that's exactly what the Anglo-French-American axis is working on.  No wonder the French proposal for a new UN Security Council resolution falls under the UN's Chapter 7 -- which would explicitly allow the use of force against Damascus in case of non-compliance. As it is, this resolution will inevitably be vetoed by Russia and China. And that will be the new pretext for war. The (farcical) emperor may easily invoke plausible deniability, stress he made "every effort" to avoid a military conflict, and then convince skeptics in the US Congress this is the only way to go.

For just as the establishment right and center got Iraq and the economy wrong, the establishment left was indulging in its own fantasy world, and it was one which is now coming to bite us on the proverbial ass, namely the fantasy of Barack Obama. Plenty of ink has been spilled in recent weeks about “misjudgments” which caused the left to swoon over a candidate who rejected virtually the entirety of what the left (by any reasonable definition) believes.  And even more anguish is caused by the grim reality that Obama is now acting on his deepest beliefs: expanding the war on terror, torpedoing banking reform, extending Bush tax cuts, while demanding fiscal austerity in the midst of what appears to be a second great depression.

  • Combat operations in Afghanistan may be coming to an end, but a look at secret NATO documents reveals that the US and the UK were far less scrupulous in choosing targets for killing than previously believed. Drug dealers were also on the lists.
  • The child and his father are two of the many victims of the dirty secret operations that NATO conducted for years in Afghanistan. Their fate is described in secret documents to which SPIEGEL was given access. Some of the documents concerning the International Security Assistance Force (ISAF) and the NSA and GCHQ intelligence services are from the archive of whistleblower Edward Snowden. Included is the first known complete list of the Western alliance's "targeted killings" in Afghanistan. The documents show that the deadly missions were not just viewed as a last resort to prevent attacks, but were in fact part of everyday life in the guerilla war in Afghanistan. The list, which included up to 750 people at times, proves for the first time that NATO didn't just target the Taliban leadership, but also eliminated mid- and lower-level members of the group on a large scale. Some Afghans were only on the list because, as drug dealers, they were allegedly supporting the insurgents.
  • Different rules apply in war than in fighting crime in times of peace. But for years the West tied its campaign in Afghanistan to the promise that it was fighting for different values there. A democracy that kills its enemies on the basis of nothing but suspicion squanders its claim to moral superiority, making itself complicit instead. This lesson from Afghanistan also applies to the conflicts in Syria, Iraq, Pakistan and Yemen. The material SPIEGEL was able to review is from 2009 to 2011, and falls within the term of US President Barack Obama, who was inaugurated in January 2009.   • After Obama assumed office, the US government opted for a new strategy. In June 2009, then Defense Secretary Robert Gates installed Stanley McChrystal, a four-star general who had served in Iraq, as commander of US forces in Afghanistan. McChrystal promoted the aggressive pursuit of the Taliban. Obama sent 33,000 additional troops to Afghanistan, but their deployment was tied to a demand that military officials provide a binding date for the withdrawal of US forces. At the same time, the president distanced himself from the grand objectives the West had proclaimed when it first marched into Kabul. The United States would not try to make Afghanistan "a perfect place," said Obama. Its new main objective was to fight the insurgency.
  • This marked the beginning of one of the bloodiest phases of the war. Some 2,412 civilians died in Afghanistan in 2009. Two-thirds of them were killed by insurgents and 25 percent by NATO troops and Afghan security forces. The number of operations against the Taliban rose sharply, to between 10 and 15 a night. The operations were based on the lists maintained by the CIA and NATO -- Obama's lists. The White House dubbed the strategy "escalate and exit." McChrystal's successor, General David Petraeus, documented the strategy in "Field Manual 3-24" on fighting insurgencies, which remains a standard work today. Petraeus outlined three stages in fighting guerilla organizations like the Taliban. The first was a cleansing phase, in which the enemy leadership is weakened. After that, local forces were to regain control of the captured areas. The third phase was focused on reconstruction. Behind closed doors, Petraeus and his staff explained exactly what was meant by "cleansing." German politicians recall something that Michael T. Flynn, the head of ISAF intelligence in Afghanistan, once said during a briefing: "The only good Talib is a dead Talib."
  • Under Petraeus, a merciless campaign began to hunt down the so-called shadow governors and local supporters aligned with the Islamists. For the Americans, the fact that the operations often ended in killings was seen as a success. In August 2010, Petraeus proudly told diplomats in Kabul that he had noticed a shifting trend. The figures he presented as evidence made some of the ambassadors feel uneasy. At least 365 insurgent commanders, Petraeus explained, had been neutralized in the last three months, for an average of about four killings a day. The existence of documents relating to the so-called Joint Prioritized Effects List (JPEL) has only been described in vague terms until now. The missions by US special units are mentioned but not discussed in detail in the US Army Afghanistan war logs published by WikiLeaks in 2010, together with the New York Times, the Guardian and SPIEGEL. The documents that have now become accessible provide, for the first time, a systematic view of the targeted killings. They outline the criteria used to determine who was placed on the list and why.
  • According to the NSA document, in October 2008 the NATO defense ministers made the momentous decision that drug networks would now be "legitimate targets" for ISAF troops. "Narcotics traffickers were added to the Joint Prioritized Effects List (JPEL) list for the first time," the report reads. In the opinion of American commanders like Bantz John Craddock, there was no need to prove that drug money was being funneled to the Taliban to declare farmers, couriers and dealers as legitimate targets of NATO strikes.
  • The document also reveals how vague the basis for deadly operations apparently was. In the voice recognition procedure, it was sufficient if a suspect identified himself by name once during the monitored conversation. Within the next 24 hours, this voice recognition was treated as "positive target identification" and, therefore, as legitimate grounds for an airstrike. This greatly increased the risk of civilian casualties. Probably one of the most controversial decisions by NATO in Afghanistan is the expansion of these operations to include drug dealers. According to an NSA document, the United Nations estimated that the Taliban was earning $300 million a year through the drug trade. The insurgents, the document continues, "could not be defeated without disrupting the drug trade."
  • When an operation could potentially result in civilian casualties, ISAF headquarters in Kabul had to be involved. "The rule of thumb was that when there was estimated collateral damage of up to 10 civilians, the ISAF commander in Kabul was to decide whether the risk was justifiable," says an ISAF officer who worked with the lists for years. If more potential civilian casualties were anticipated, the decision was left up to the relevant NATO headquarters office. Bodyguards, drivers and male attendants were viewed as enemy combatants, whether or not they actually were. Only women, children and the elderly were treated as civilians. Even officers who were involved in the program admit that these guidelines were cynical. If a Taliban fighter was repeatedly involved in deadly attacks, a "weighing of interests" was performed. The military officials would then calculate how many human lives could be saved by the "kill," and how many civilians would potentially be killed in an airstrike.
  • In early 2009, Craddock, NATO's Supreme Allied Commander for Europe at the time, issued an order to expand the targeted killings of Taliban officials to drug producers. This led to heated discussions within NATO. German NATO General Egon Ramms declared the order "illegal" and a violation of international law. The power struggle within NATO finally led to a modification of Craddock's directive: Targets related to the drug production at least had to be investigated as individual cases. The top-secret dossier could be highly damaging to the German government. For years, German authorities have turned over the mobile phone numbers of German extremists in Afghanistan to the United States. At the same time, the German officials claimed that homing in on mobile phone signals was far too imprecise for targeted killings. This is apparently an untenable argument. According to the 2010 document, both Eurofighters and drones had "the ability to geolocate a known GSM handset." In other words, active mobile phones could serve as tracking devices for the special units.
  • The classified documents could now have legal repercussions. The human rights organization Reprieve is weighing legal action against the British government. Reprieve believes it is especially relevant that the lists include Pakistanis who were located in Pakistan. "The British government has repeatedly stated that it is not pursuing targets in Pakistan and not doing air strikes on Pakistani territory," says Reprieve attorney Jennifer Gibson. The documents, she notes, also show that the "war on terror" was virtually conflated with the "war on drugs." "This is both new and extremely legally troubling," says Gibson.
  • A 2009 CIA study that addresses targeted killings of senior enemy officials worldwide reaches a bitter conclusion. Because of the Taliban's centralized but flexible leadership, as well as its egalitarian tribal structures, the targeted killings were only moderately successful in Afghanistan. "Morover, the Taliban has a high overall ability to replace lost leaders," the study finds.

  • Yossi Sarid, the former head of Israel’s Meretz Party and leader of the opposition in the Knesset from 2001 to 2003, has just written a very blunt—far too blunt for “acceptable” political discourse in Washington, DC—op-ed published Sunday by Haaretz. Unfortunately, it’s behind a pay wall, so the most I can do is extract a few excerpts. The title is straightforward: “Beware: Republican Jews on the Warpath,” and Sarid, who also served as minister of education under Ehud Barak, doesn’t pull any punches about what Boehner’s fraudulent invitation to Israeli Prime Minister Benjamin Netanyahu is really all about. Now it’s no longer a “crisis in the relationship” that they try to paper over; now it’s no longer just “tensions with the White House” that they’re making every effort to reduce in between meetings; now, it’s an open war with the United States. It’s Sheldon Adelson versus Barack Obama, and Israel is caught in the cross-fire. After Vice President Joe Biden, our greatest friend over there, announced an unspecified trip abroad that will prevent him from being in Congress at the fateful hour, Republican Jewish organizations launched a campaign of intimidation against those lawmakers who had already announced their intent to skip the joint session: Their political fate will be bitter.

  • You’ll remember that Obama, during an off-the-record meeting with Democratic senators three weeks ago, reportedly appealed to them to resist “donors and others” who opposed a deal with Iran and were pushing for new sanctions legislation that risked sabotaging the nuclear-focused talks with Iran and an eventual deal. Sen. Robert Menendez, who has been pushing for such legislation for more than a year, reportedly replied that he took “personal offense” at Obama’s remarks about donors, apparently interpreting Obama’s comments as suggesting that Menendez’s position was motivated by his desire and need for campaign cash. The New York Times helpfully noted in a profile of Menendez that the New Jersey senator had received $341,170 from hard-line pro-Israel groups over the past seven years, “more than any other Democrat in the Senate.” (In fact, he received more money than any other Senate candidate—Democratic or Republican—in the 2012 elections, while his Republican comrade-in-arms and co-sponsor for sanctions legislation, Illinois Sen. Mark Kirk, has received more campaign cash from pro-Israel political actions committees (PACs) associated with the American Israel Public Affairs Committee (AIPAC) than any other member of Congress over the past decade. And that doesn’t necessarily include all the much-harder-to-track money provided by donors like Adelson, who chairs Brooks’s RJC, through super PACS and other vehicles.)  Indeed, there’s no doubt that Obama’s reference to “donors” touched a very sensitive nerve with Menendez. Sarid, whose op-ed is most unlikely to appear in any mainstream U.S. publication, has now pounded it with a sledgehammer.

  • Last week charges of Desertion and Misbehavior Before the Enemy were recommended against Sergeant Bowe Bergdahl. Tragically, Sergeant Bergdahl was once again crucified, without evidence or trial, throughout mainstream, alternative and social media. That same day Sergeant Bergdahl was offered as a sacrifice to primarily Republican politicians, bloggers, pundits, chicken hawks and jingoists, while Democrats mostly kept silent as Sergeant Bergdahl was paraded electronically and digitally in the latest Triumph of the Global War on Terror, President Ashraf Ghani was applauded, in person, by the American Congress. Such coincidences, whether they are arranged or accidental, often appear in literary or cinematic tales, but they do, occasionally, manifest themselves in real life, often appearing to juxtapose the virtues and vices of a society for the sake and advancement of political narratives. The problem with this specific coincidence for those on the Right, indulging in the fantasy of American military success abroad, as well as for those on the Left, desperate to prove that Democrats can be as tough as Republicans, is that reality may intrude. To the chagrin and consternation of many in DC, Sergeant Bergdahl may prove to be the selfless hero, while President Ghani may play the thief, and Sergeant Bergdahl's departure from his unit in Afghanistan may come to be understood as just and his time as a prisoner of war principled, while President Obama's continued propping up and bankrolling of the government in Kabul, at the expense of American servicemembers and taxpayers, comes to be fully acknowledged as immoral and profligate.
  • Buried in much of the media coverage this past week on the charges presented against Sergeant Bergdahl, with the exception of CNN, are details of the Army's investigation into Sergeant Bergdahl's disappearance, capture and captivity. As revealed by Sergeant Bergdahl's legal team, twenty-two Army investigators have constructed a report that details aspects of Sergeant Bergdahl's departure from his unit, his capture and his five years as a prisoner of war that disprove many of the malicious rumors and depictions of him and his conduct.
  • As documented in his lawyers' statement submitted to the Army on March 25, 2015, in response to Sergeant Bergdahl's referral to the Article 32 preliminary hearing (which is roughly the military equivalent of a civilian grand jury), the following facts are now known about Sergeant Bergdahl and his time prior to and during his captivity as a prisoner of war:• Sergeant Bergdahl is a "truthful person" who "did not act out of a bad motive"; • he did not have the intention to desert permanently nor did he have an intention to leave the Army when he left his unit's outpost in eastern Afghanistan in 2009; • he did not have the intention of joining the Taliban or assisting the enemy; • he left his post to report "disturbing circumstances to the attention of the nearest general officer". • while he was a prisoner of war for five years, he was tortured, but he did not cooperate with his captors. Rather, Sergeant Bergdahl attempted to escape twelve times, each time with the knowledge he would be tortured or killed if caught; • there is no evidence American soldiers died looking for Sergeant Bergdahl.

  • Again, these are the findings of the Army's investigation into Sergeant Bergdahl's disappearance; they are not the apologies or fantasies of his legal team, Marines turned anti-war peaceniks like myself, or Obama fawning conspirators. The details behind these facts are contained in the Army's report, authored by Major General Kenneth Dahl, which has not been publically released, but hopefully will be made available to the public after Sergeant Bergdahl's preliminary hearing next month or, if the desertion and misbehavior charges are pursued, during his court martial. Just what events Sergeant Bergdahl witnessed that would compel him to risk his life, traveling unarmed through enemy controlled territory, to provide information to an American general, are not presently known. We do know that the unit Sergeant Bergdahl belonged to underwent serious disciplinary actions both before and after Sergeant Bergdahl's capture, that several of his unit's leaders were fired and replaced both prior to and subsequent to his capture, and, from communications between Sergeant Bergdahl and his family prior to his capture, Sergeant Bergdahl was sickened and distraught over the actions of his unit, including its possible complicity in the death of an Afghan child. It is quite possible Sergeant Bergdahl left his unit to report a war crime(s) or other serious crime(s) committed by American forces. He may have been trying to report a failure of his immediate leadership or it may have been something, in hindsight, that we would now consider trivial. Such an action on Sergeant Bergdahl's part would help to explain why his former platoon mates, quite possibly the very men whom Sergeant Bergdahl left to report on, have been so forceful in their condemnation of him, so determined not to forgive him for his disappearance, and so adamant in their denial to show compassion for his suffering while a prisoner of war.
  • This knowledge may explain why the Taliban believed Sergeant Bergdahl had fallen behind on a patrol rather than deserted. If he truly was deserting, than Sergeant Bergdahl most likely would have told the Taliban disparaging information about US forces in an attempt to harvest friendship and avoid torture, but if he was on a personal mission to report wrongdoing, than he certainly would not relate such information to the enemy. This may explain why Sergeant Bergdahl told his captors a lie rather than disclose his voluntary departure from the platoon outpost. This would also justify why Sergeant Bergdahl left his base without his weapon or equipment. Before his departure from his outpost, Sergeant Bergdahl asked his team leader what would happen if a soldier left the base, without permission, with his weapon and other issued gear. Sergeant Bergdahl's team leader replied that the soldier would get in trouble. Understanding Sergeant Bergdahl as not deserting, but trying to serve the Army by reporting wrongdoing to another base would explain why he chose not to carry his weapon and issued gear off of the outpost. Sergeant Bergdahl was not planning on deserting, i.e. quitting the army and the war, and he did not want to get in trouble for taking his weapon and issued gear with him on his unauthorized mission.
  • This possible exposure to senior leaders, and ultimately the media and American public, of civilian deaths or other offenses would also account for the non-disclosure agreement Sergeant Bergdahl's unit was forced to sign after his disappearance. Non-disclosure agreements may be common in the civilian world and do exist in military fields such as special operations and intelligence, but for regular infantry units they are rare. Sergeant Bergdahl's capture by the enemy, possibly while en-route to reveal war crimes or other wrongdoings, would certainly be the type of event an embarrassed chain of command would attempt to hide. Such a cover up would certainly not be unprecedented in American military history.Similar to the assertions made by many politicians, pundits and former soldiers that Sergeant Bergdahl deserted because, to paraphrase, he hated America and wanted to join the Taliban, the notion that he cooperated and assisted the Taliban while a prisoner of war has also been debunked by the Army's investigation. We know that Sergeant Bergdahl resisted his captors throughout his five years as a prisoner of war. His dozen escape attempts, with full knowledge of the risks involved in recapture, are in keeping with the Code of Conduct all American service members are required to abide by during captivity by the enemy.
  • In his own words, Sergeant Bergdahl's description of his treatment reveals a ghastly and barbaric five years of non-stop isolation, exposure, malnutrition, dehydration, and physical and psychological torture. Among other reasons, his survival must be attested to an unshakeable moral fortitude and inner strength. The same inherent qualities that led him to seek out an American general to report "disturbing circumstances" could well be the same mental, emotional and spiritual strengths that kept him alive through half a decade of brutal shackling, caging, and torture. It is my understanding the US military's prisoner of war and survival training instructors are studying Sergeant Bergdahl's experience in order to better train American service members to endure future experiences as prisoners of war. Susan Rice, President Obama's National Security Advisor, was roundly lampooned and criticized last year for stating that Sergeant Bergdahl "served with honor and distinction". It is only the most callous and politically craven among us who, now understanding the torture Sergeant Bergdahl endured, his resistance to the enemy that held him prisoner, and his adherence to the US military's Code of Conduct for five years in horrific conditions, would argue that he did not serve with honor and distinction.

    There's more article than I highlighted and it's worth reading. Obama should step in here and issue a full pardon to end this young man's torment by Army generals playing to the press. Let's recall here that Obama, when asked to prosecute Bush II officials for war crimes, said he would rather look forward rather than backward. Sgt. Bergdahl, who committed no war crime, deserves no less. Five years of torture and malnutrition as a POW is more punishment than anyone deserves.

The fact that going after the wealthiest for even more isn't going to generate significant additional revenues - certainly not enough to make a dent in the debt - isn't mentioned by the President in his letter. And if Obama is so determined to be "fair", why doesn't he simply offer to write a check to the IRS for the part of his income that he feels he doesn't deserve? He doesn't say. The President did get one thing right: The middle class is the target of any deficit-reduction plans likely to come out of Washington in the next few days: "It's just not right to ask them to pay the whole tab - especially when they're not the ones who caused this mess in the first place." He's right: The middle class didn't create the financial crisis; the Ruling Class did. Instead, the middle class, by and large, just want to be left alone to work out their own lives. Whenever possible, they resist further government intrusions into their lives - witness the growth of the Tea Party - and are waiting to see if Washington will, for the first time in memory, not listen to the siren song of entitlement protection and class warfare being sung by the President, and instead ignore him and start some serious cutting back of Leviathan. Perhaps what the President should be saying to the American people is what he said as Senator in railing against raising the debt ceiling back in March, 2006: The fact that we are here today to debate raising America 's debt limit is a sign of leadership failure. It is a sign that the US Government cannot pay its own bills. It is a sign that we now depend on ongoing financial assistance from foreign countries to finance our Government's reckless fiscal policies. In
