Excellent read!  Peter Ferrara walks us through the latest Obama assault on the Constitution, this time his refusal to enforce laws he disagrees with.  Surprisingly, this now includes the employer mandate portion of ObamaCare!!!  Why he has to do this however is a stunning story. Bottom line:  The latest jobs report has the economy producing 195,000 new jobs in the past quarter.  The problem is, 100% of these new jobs are part-time.  Thanks to ObamaCare.   "The duties of the President of the United States are spelled out in Article II, Section 3 of the Constitution, which states, inter alia, that the President "shall take Care that the laws be faithfully executed." As Stanford Law Professor and former federal judge Michael McConnell explained in yesterday's Wall Street Journal, "This is a duty, not a discretionary power. While the president does have substantial discretion about how to enforce a law, he has no discretion about whether to do so." Section 1513(d) of the Unaffordable Care Act (aka "Obamacare") states unequivocally, "The amendments made by this section shall apply to months beginning after December 31, 2013." In other words, the provisions of Obamacare become fully effective in 2014, as a matter of duly enacted federal law. But over the long Fourth of July weekend, in a "Never Mind" moment, the Obama Administration announced, through a Deputy Assistant Secretary of the Treasury, that contrary to federal law, the employer mandate of Obamacare shall not become fully effective in months beginning after December 31, 2013, but only in months beginning after December 31, 2014. Making the announcement through such a low level Administration official to me says that Obama has contempt for the American people, and for the rule of law. Napolitano Published August 01, 2013 FoxNews.com Last week, Justin Amash, the two-term libertarian Republican congressman from Michigan, joined with John Conyers, the 25-term liberal Democratic congressman from the same state, to offer an amendment to legislation funding the National Security Agency (NSA). If enacted, the Amash-Conyers amendment would have forced the government's domestic spies when seeking search warrants to capture Americans' phone calls, texts and emails first to identify their targets and produce evidence of their terror-related activities before a judge may issue a warrant. The support they garnered had a surprising result that stunned the Washington establishment. It almost passed. The final vote, in which the Amash-Conyers amendment was defeated by 205 to 217, was delayed for a few hours by the House Republican leadership, which opposed the measure. The Republican leadership team, in conjunction with President Obama and House Minority Leader Nancy Pelosi, needed more time for arm-twisting so as to avoid a humiliating loss. But the House rank-and-file did succeed in sending a message to the big-government types in both parties: Nearly half of the House of Representatives has had enough of government spying and then lying about it, and understands that spying on every American simply cannot withstand minimal legal scrutiny or basic constitutional analysis. The president is deeply into this and no doubt wishes he wasn't. He now says he welcomed the debate in the House on whether his spies can have all they want from us or whether they are subject to constitutional requirements for their warrants. I've said for more than 40 years that "inflation is the cruelest tax of all." In a fiat currency economy, it is robbery, pure and simple; and the poor are hardest hit because they lack the capital to make investments that can outpace inflation. The net effect is to transfer wealth from the lower economic classes to the wealthy, most of all the investment banksters and "old wealth".

The author, Ken White, is a former U.S. Dept. of Justice criminal prosecutor, a Libertarian, but he plays no favorites; he's also a civil libertarian and a leader in protection of First Amendment rights. He's one of my favorite bloggers. He has a real gift for sarcasm, which shines all over this gem. Well worth the read; this is a shining example of exemplary writing.

Solid libertarian thinking applied to a problem that continues to confound democrat socialists and republican statists. One thing missing from this excellent analysis; "follow the money". There are reasons for the madness of the left and the right. Follow the money and follow the power of government. excerpt: "Gang violence is afflicting some of our major cities, Chicago chief amongst them. As I write, there are reports coming in regarding a shooting of 13 people at a basketball court in the Second City. Fortunately, no one was killed in this episode. But a three year old boy is now in critical condition as a result of being shot, and the not unreasonable expectation is that retaliation from the aggrieved gang toward the perpetrators of this particular act will soon follow. According to USA Today, this bout of gunfire was due to a dispute between the Gangster Disciples and the Black P Stone Nation gang.  Neither is likely to sue the other in a court of law to settle their grievances with each other. A true complication for the Obama Administration and Israeli government, if the Palestinian unity deal sticks. At Israel's urging, the U.S. formally designated Hamas as a Terrorist Organization™ shortly after it won a valid election to lead government in the Gaza Strip, imposing sanctions and criminal penalties on any person or legal entity that aids Hamas. With Gaza and the West Bank organized under a single government that includes Hamas, Obama may have to decide whether to end the Hamas terrorist designation or abandon attempts to broker a settlement of the Israel-Palestine question.  

The Aleppo region is well to the north of Tartus, where the Russians have there only  naval base in the Mediterranean, but Russia has a vested interest in Syria surviving intact. Look for a Russian move soon to blunt the planned attack on Aleppo. You can bet that the Russian, Iranian, and Syrian governments are working together on a strategy.  

So now it's anti-semitic to even discuss the Israel lobby, according to the Israel-firsters. 

Can Obama Supreme Court nominee Elena Kagan take the oath of office required to serve on the Supreme Court?  Not if it means upholding the Constitution!  Come to think of it; no one in the Obama-Democratic regime can take that oath.  Including Professor Obama himself! One thing we can all agree on is that the Constitution is the foundation for our country, the main unifying element, what distinguishes us as America. It provides defined roles for the government, based on the profound recognition of the sinful tendency of mankind to abuse power. So why do liberal politicians have a problem when people bring it up? When Obama submitted his nominee to the Supreme Court, he didn't state the main qualification for any person who serves in government, the absence of which has lit a brushfire of discontent, fidelity to the Constitution. The bottom line of America's discontent and anger at Obama and the Democrats is their utter disregard for the Constitution. The concept of a limited government, restrained in what it can and should do, is foreign to them, while for most Americans it's in our DNA. This is what puts Obama at odds with so many Americans.

The ultimate Stranger in a Strange Land is, of course, Obama. It's no wonder; given his bizarro family, there was no one with whom to bond. Pitifully, the focal point in Obama's life story -- the brave, oppressed Obama Sr. -- is a chimera, all smoke-and-mirrors.  Obama has surrounded himself with other Strangers. His friends are society's misfits: Van Jones, the self-proclaimed Communist; John Holdren, enthralled with devolution and eugenics. Chicago pals Bill Ayers and Bernadine Dohrn tried to destroy their own nation with terrorism.  Obama has been called a Citizen of the World.  While liberals find this appealing, what it actually means is that Obama has come from nowhere and belongs nowhere.   Someone with no country or roots has nothing. Bob Dylan described the predicament and the danger: "When you have nothing, you have nothing to lose."  

The best evidence that Obama's new mortgage scheme won't end well: look at the people who are the most excited about it. It's the same, smarmy mortgage guys that profited handsomely from the subprime crisis. In a great bit of deep dive reporting over at Salon -- hardly an outfit you'd expect to be critical of Obama -- Alyssa Katz, with help from The Nation Institute (also very liberal), shows how modifications are hardly the paragon of progressive idealism:

So where is the new Obama administration likely to take us? Seven things seem certain: The U.S. military will withdraw from Iraq quickly and substantially, regardless of conditions on the ground or the obvious consequence of emboldening terrorists there and around the globe. Protectionism will become our national trade policy; free trade agreements with other nations will be reduced and limited. Income taxes will rise on middle- and upper-income people and businesses, and individuals will pay much higher Social Security taxes, all to carry out the new president's goals of "spreading the wealth around." Federal government spending will substantially increase. The new Obama proposals come to more than $300 billion annually, for education, health care, energy, environmental and many other programs, in addition to whatever is needed to meet our economic challenges. Mr. Obama proposes more than a 10% annual spending growth increase, considerably higher than under the first President Bush (6.7%), Bill Clinton (3.3%) or George W. Bush (6.4%). Federal regulation of the economy will expand, on everything from financial management companies to electricity generation and personal energy use. The power of labor unions will substantially increase, beginning with repeal of secret ballot voting to decide on union representation. Free speech will be curtailed through the reimposition of the Fairness Doctrine to limit the conservative talk radio that so irritates the liberal establishment. These policy changes will be the beginning of the Europeanization of America.

A "conservative" judge is not one who always votes to uphold conservative laws and to strike down liberal ones. Rather, when observers call a judge "conservative," they typically mean that he is to some degree an originalist. That is, he believes that laws have reasonably definite meanings, set by the words within them, and that these meanings do not change over time. Originalists do not believe that the Constitution is "living," and most originalists agree that judges should avoid looking beyond the text of enacted laws, except to learn the context and meaning of the laws themselves. Originalism has come a long way in a very short time. During a speech at an American Spectator dinner in late 2008, Justice Samuel Alito noted that there has been an explosion of judges' citing dictionary definitions from the eras when laws passed. This reflects a desire to understand what laws meant when the people, through their representatives, consented to them. Alito also noted that in Heller, both the majority opinion and the main dissent used originalist arguments. That is, the justices disagreed only on what the words of the Second Amendment meant to the generation of Americans that enacted it, and used a good deal of historical evidence in making their points. To understand originalism's rise, it helps to understand originalism's history. In the 18th century and most of the 19th, originalism was the only game in town. The Supreme Court almost never struck down the actions of the other branches of government. When the justices made decisions, the reasoning was typically grounded in the text of the Constitution, sometimes with extra evidence of the Founders' intentions from contemporary documents like the Federalist Papers.

Nails it.  This is exactly what is happening in my neighborhood.  And i'm at the epicenter of Silicon Valley;  about as liberal, far-left, marxist-statist-socialist as it gets.  Yet here we are.  As Lady Thatcher famously once said, " 'The trouble with socialism is that eventually you run out of other people's money".  "Eventually" has arrived.   excerpt:  America is on the verge of something unprecedented in history: the peaceful, constitutional replacement of our country's entire political establishment. The second was the 2008 financial crash, which revealed that our economy is a house of cards built on a pile of debt so high we cannot possibly repay it.

Good video news story from local station KTVU in San Francisco.  My neighbor sent me this link, and i think this local gun rights story is representative of what is happening across America.  People are arming up.  And while there is perhaps no more liberal area in this country than San Francisco, concern over second amendment rights and the constitution affects every aspect of American life.  Our constitution is designed to seriously limit the power and growth of government.  Yet, in the past year alone, our government debt (public debt) has risen from 43% of GDP to 58%!!!  Tha tis unsustainable, unconstitutional growth and empowerment.  No wonder the second amendment is a concern.  For government to be on such a growth binge, the entire constitution would have to be breached.  Which is what i fear we are facing. Oh, and then there is the NY Times story on how the Feds are now tracking eMail and social network sights like Facebook and twitter, looking for dissident comments.  What's going on here?

Schweizer blows the lid off the 30-year leftist war on banking standards in the name of "equality" that created the housing bubble and caused the foreclosure crisis. (Somebody get this book to Glenn Beck as he recovers from his appendectomy- it'll give him at least a week's worth of blackboard material when he returns.)
