  • Julian Assange is a deeply polarizing figure. Many admire him and many despise him (into which category one falls in any given year typically depends on one’s feelings about the subject of his most recent publication of leaked documents). But one’s views of Assange are completely irrelevant to this article, which is not about Assange. This article, instead, is about a report published this week by The Guardian that recklessly attributed to Assange comments that he did not make. This article is about how those false claims — fabrications, really — were spread all over the internet by journalists, causing hundreds of thousands of people (if not millions) to consume false news. The purpose of this article is to underscore, yet again, that those who most flamboyantly denounce Fake News, and want Facebook and other tech giants to suppress content in the name of combating it, are often the most aggressive and self-serving perpetrators of it.

  • The Turkish government ordered the closing of more than 100 media outlets on Wednesday, including newspapers, publishing companies and television channels, as part of a sweeping crackdown following a failed military coup this month.The Turkish authorities ordered the shutdown of 45 newspapers, three news agencies, 16 television channels, 15 magazines and 29 publishers in a decree that was published in the government’s official gazette on Wednesday.Among those ordered to close are the newspaper Zaman and the Cihan News Agency, which had previously been seized by the government over suspicions that it has links to the network of Fethullah Gulen, a Muslim cleric who lives in self-imposed exile in the United States and has been accused of orchestrating the July 15 coup attempt.

  • New York Post columnist John Crudele obliterates the despicable word-parsing. “Clinton was so careless when using her BlackBerry that the Russians stole her password,” he writes. “All Russian President Vladimir Putin’s gang had to do was log into Clinton’s account and read whatever they wanted.” When it comes to the DNC hack, “The Russians did it” is the theme-du-jour. Clinton campaign manager, Robby Mook stated Sunday that “experts are telling us that Russian state actors broke into the DNC, stole these emails, [and are] releasing these emails for the purpose of helping Donald Trump.” The campaign itself echoed that assertion. “This is further evidence the Russian government is trying to influence the outcome of the election.”
  • The reliably leftist Politico — so far left that reporter Ken Vogel remains employed there despite sending a story to the DNC before he sent it to his own editor — is quite comfortable advancing that agenda, using it as a vehicle to buff up Clinton’s tenure as secretary of state. “Former U.S. officials who worked on Russia policy with Clinton say that Putin was personally stung by Clinton’s December 2011 condemnation of Russia’s parliamentary elections, and had his anger communicated directly to President Barack Obama,” Politico reports. “They say Putin and his advisers are also keenly aware that, even as she executed Obama’s ‘reset’ policy with Russia, Clinton took a harder line toward Moscow than others in the administration. And they say Putin sees Clinton as a forceful proponent of ‘regime change’ policies that the Russian leader considers a grave threat to his own survival.” Yet even Politico is forced to admit the payback angle is “speculation,” and that some experts remain “unconvinced that Putin’s government engineered the DNC email hack or that it was meant to influence the election in Trump’s favor as opposed to embarrassing DNC officials for any number of reasons.”
  • Americans would also be wise to remain highly skeptical of this claim for any number of reasons. WikiLeaks founder Julian Assange asserts there is “there is no proof whatsoever” Russia is behind the hack and that “this is a diversion that’s being pushed by the Hillary Clinton campaign.” To be fair, Assange is a Russian sympathizer, and leftists aren’t the only ones attributing the hack to the Russians. The same FBI that gave Clinton a pass will be investigating the DNC hack, and at some point the bureau will reach a conclusion. In the meantime, it might be worth considering that this smacks of a carefully orchestrated disinformation campaign similar to the one Clinton and several other Obama administration officials engineered with regard to Benghazi. While Clinton was never held personally or legally accountable for the deaths of four Americans, it is beyond dispute that she lied unabashedly about a video causing the attack, while sending her daughter a damning email at 11:12 p.m. on Sept. 11, 2012, admitting the administration knew “the attack had nothing to do with the film. It was a planned attack, not a protest.” The theme of this coordinated narrative? Clinton campaign chair John Podesta referred Monday night to “a kind of bromance going on” between Putin and Trump. Clinton campaign manager Robby Mook echoed that assertion, insisting the email dump comes on the heels of “changes to the Republican platform to make it more pro-Russian.”

  • The Leftmedia were equally obliging. “The theory that Moscow orchestrated the leaks to help Trump … is fast gaining currency within the Obama administration because of the timing of the leaks and Trump’s own connections to the Russian government,” reports the Daily Beast. Other Leftmedia examples abound. “Until Friday, that charge, with its eerie suggestion of a Kremlin conspiracy to aid Donald J. Trump, has been only whispered,” shouted the New York Times. “Because the leaks are widely suspected of being the result of a Russian hacking operation, they can be used to reinforce the narrative that Russian President Vladimir Putin is rooting for Trump and that Trump, in turn, would be too accommodating to Moscow,” adds the Los Angeles Times. “Why would Russian President Vladimir Putin want to help Donald Trump win the White House?” asks NPR. “If you want to indulge in a bit of conspiracy theory, remember that Russian President Vladimir Putin has praised candidate Trump as recently as June,” states the Burlington Free Press.
  • Ultimately, here’s the question: If the Russians could access the DNC server, they could certainly access Clinton’s unsecure server. And if they could access Clinton’s server, including the 33,000 emails she deleted (maybe some were about how the Clintons profited from selling American uranium to Russia), ask yourself who they’d rather have in the Oval Office: Donald Trump, who professed admiration for Putin but remains a highly unpredictable individual — or Hillary Clinton, who could be subjected to blackmail for as long as eight years? Russia’s clear objective would be to have the weakest American leadership they can get. Blackmail aside, what would be weaker than an extension of Obama’s presidency?
  • Moreover, it is just as likely a number of the so-called “experts” as well as Clinton’s useful idiot media apparatchiks have considered the blackmail possibility and are trying to divert attention from it with a phony Trump connection story. Democrats can theorize, complain and blame to their hearts' content, but none of it obscures the reality that the DNC — and by extension Hillary Clinton and the entire Democrat Party — are a conglomeration of morally bereft, utterly incompetent individuals wholly ill-equipped to handle internal security, much less national security. And they are aided and abetted by an equally corrupt media, more than willing to abide that potentially catastrophic reality as long as it gets a Democrat in the Oval Office. WikiLeaks has promised additional dumps with be forthcoming. How much deeper Democrats sink is anyone’s guess.

  • The former National Security Agency contractor Edward Snowden appeared Sunday night in his first extended television interview. Citing published statements by unnamed US intelligence and military operatives calling for his assassination, he warned that he faces “significant threats” to his life and that US “government officials want to kill me.” The interview, broadcast by the German television network ARD, was largely blacked out by the US media. The New York Times carried not a word of what Snowden said, while the cable and broadcast news programs treated the interview with near total silence. The American media’s reaction stood in stark contrast to that of both broadcast and print media in Germany, where the interview conducted with Snowden in Russia was treated as a major political event.
  • Polls conducted in Germany have shown six out of ten surveyed expressing admiration for Snowden, with only 14 percent regarding him as a criminal. The public is evenly divided over whether he should be granted asylum in Germany. Anger over NSA spying on German telephone and Internet communications—including Chancellor Angela Merkel’s personal cell phone—is widespread. In the interview, Snowden eloquently laid out the core questions of basic democratic rights posed by the massive NSA spying programs exposed in the documents he has made public. “Every time you pick up the phone, dial a number, write an email, make a purchase, travel on the bus carrying a cell phone, swipe a card somewhere, you leave a trace and the government has decided that it’s a good idea to collect it all, everything, even if you’ve never been suspected of any crime,” he said.

  • Support it or oppose it, a coup d’état took place in Kiev after an EU-brokered agreement was signed by the Ukrainian government and the mainstream opposition on Feb. 21. The agreement called for power sharing between both sides through the formation of a national unity government and for an end to the opposition-led street protests in Kiev. President Viktor Yanukovych ordered the Ukrainian police and security forces to withdraw from their positions, and even earlier, he had made multiple concessions to the opposition leadership. Instead of keeping its end of the bargain, the Ukrainian mainstream opposition executed a coup through the use of violence by organized ultra-nationalist gangs, which some analysts have compared to stay-behinds or secretive militias that were created by NATO during the Cold War. These armed ultra-nationalist groups took over administrative bodies in Ukraine and fought until they managed to oust the Ukrainian government and opened the path for opposition leaders to take power on Feb. 25. The Ukrainian mainstream opposition used the EU-brokered agreement, which the Brussels-based European Commission deliberately refused to enforce, as a means of justifying the formation of a coup-imposed government.
  • In the absence of almost half the Ukrainian Verkhovna Rada, or Ukrainian Parliament, the opposition parties began to arbitrarily pass unconstitutional laws. They also unconstitutionally selected Oleksandr/Aleksandr Valentynovych Turchynov as the acting president of Ukraine before President Viktor Yanukovych was even impeached. Intimidation and violence were additionally used to secure the cooperation of any disagreeing parliamentarians or state officials in Kiev. Saying that the ultra-nationalists and fascists are marginal elements, the mainstream media networks in North America and the European Union have simply dismissed the armed ultra-nationalist groups involved in the coup that are presently integrated into the putsch regime running Kiev. The militant ultra-nationalists, however, are very influential and amassing power under the illegal premiership of Arseniy Yatsenyuk.  Yatsenyuk, himself, is from Yulia Tymoshenko’s notoriously corrupt All-Ukrainian Union Fatherland Party (Batkivshchyna) and essentially a U.S. and EU appointee. There is even a pre-coup leaked telephone interception, likely either recorded by the intelligence services of Russia or Ukraine, in which U.S. Assistant Secretary of State Victory Nuland says that Yatsenyuk will be appointed as the prime minister of the Ukrainian government that the U.S. is putting together.
  • It is unlikely that Yatsenyuk and the loosely-knit alliance of the governing parties that ran Ukraine under the Yushchenko-Tymoshenko governments, foreign-based Ukrainians, and the forces behind the Orange Revolution that form the Orangist camp which he belongs to could have gotten back into power in Ukraine without pressure, the use of force and foreign backing. Yatsenyuk was even threatened and booed by the Ukrainians gathered at Independence Square when it was announced that he would be appointed as the prime minister of the post-coup government. A vast segment of the protesters made it clear that Tymoshenko, Yatsenyuk’s party leader, was no alternative to the ousted President Viktor Yanukovych in their eyes, either, when it was announced that she wanted to run for prime minister. The Orangists do not have the support of a majority of the population, nor did they form the parliamentary majority in the Verkhovna Rada. Their Orangist president, Viktor Yushchenko, only got 5 percent of the vote in January 2010, in a show of no-confidence, whereas Viktor Yanukovych won the first and second rounds of the presidential elections in 2010. According to Victoria Nuland, the U.S. has also poured $5 billion into “democracy promotion” inside Ukraine. This is U.S. State Department doublespeak for politicized funding that Washington has sent to Ukraine to organize the Orange Revolution and its Euromaidan sequel or what can frankly be described as regime change.

  • To rule Ukraine once more, the Orangists and their foreign backers have used and manipulated the ultra-nationalist elements of the population — some of which are openly anti-European Union — as their foot soldiers in an application of force against their democratically-elected opponents. Despite their views, the ultra-nationalists are actually more honest than the Orangist liberal figures like Arseniy Yatsenyuk. Unlike the misleading and utterly corrupt Orangist leaders, the ultra-nationalists do not hide their agendas and platforms.
  • The ultra-nationalists have inconsolably anti-Russian attitudes. Many of them also dislike a vast spectrum of other groups, including Jews, Armenians, Roma, Poles, Tatars, supporters of the Party of Regions and communists. In this context, it should come as no surprise that one of the first decisions that the post-coup regime in Kiev made was to remove the legal status of the Russian language as the regional language of half of Ukraine. Right Sector is, itself, a coalition of militant ultra-nationalists. These militants were instrumental in fighting government forces and taking over both government buildings in Kiev and regional governments in the western portion of Ukraine. Despite the protests of First Deputy Defense Minister Oleynik, Deputy Defense Minister Mozharovskiy and Defense Minister Babenk, Arseniy Yatsenyuk’s post-coup government has even given the ultra-nationalist opposition militias official status within the Ukrainian military and security forces. Yatsenyuk and the Orangists also dismissed all the officials that protested that the move would fracture the country and make the political divide in Ukraine irreversible.
  • Several members of Svoboda have been given key cabinet and government posts. One of the two junior deputy prime ministers, or assistant deputy prime ministers, is Oleksandr Sych. The ministry of agriculture and food has been given for management to Ihor Shvaika. The environment and natural resources ministry has been assigned to Andry/Andriy Mokhnyk. The defense minister is Ihor Tenyukh, a former admiral in the Ukrainian Navy who obstructed Russian naval movements in Sevastopol during the Russo-Georgian War over South Ossetia and who was later dismissed by the Ukrainian government for insubordination. Oleh Makhnitsky, another member of Svoboda, has been assigned as the new prosecutor-general of Ukraine by the coup government. Andry Parubiy, one of the founders of Svoboda, is now the post-coup secretary of the National Security and Defense Council of Ukraine (RNBO). He was the man controlling the so-called “Euromaidan security forces” that fought government forces in Kiev. His job as secretary is to represent the president and act on his behalf in coordinating and implementing the RNBO’s decisions. As a figure, Parubiy clearly illustrates how the mainstream opposition in Ukraine is integrated with the ultra-nationalists. Parubiy is an Orangist and was a leader in the Orange Revolution. He has changed parties several times. After founding Svoboda, he joined Viktor Yushchenko’s Our Ukraine before joining Yulia Tymoshenko’s Fatherland Party and being elected as one of the Fatherland Party’s deputies, or members of parliament.
  • While the mainstream media in North America and the EU look the other way about the ultra-nationalists in the coup government in Kiev, the facts speak for themselves. Both the EU and the U.S. governments have rubbed their elbows with the ultra-nationalists. Oleh Tyahnybok, the leader of Svoboda (formerly the Social Nationalist Party of Ukraine), was even part of the opposition triumvirate that all the U.S. and EU officials visiting Kiev met with while performing their political pilgrimages to Ukraine to encourage the protesters to continue with their demonstrations and riots demanding Euro-Atlantic integration. Svoboda has popularly been described as a neo-Nazi grouping. The World Jewish Congress has demanded that Svoboda be banned. The ultra-nationalist party was even condemned by the EU’s own European Parliament, which passed a motion on Dec. 13, 2012 categorically condemning Svoboda.
  • The ultra-nationalists are such an integral part of the mainstream opposition that the U.S.-supported Orangist president of Ukraine, Viktor Yushchenko, posthumously awarded the infamous Nazi collaborator Stepan Bandera the title and decoration of the “Hero of Ukraine” in 2010. Foreign audiences, however, would not know that if they relied on reportage from the likes of the U.S. state-run Radio Free Europe, which tried to protect Yushchenko because he wanted to reorient Ukraine toward the U.S. and EU. Parubiy also lobbied the European Parliament not to oppose Yushchenko’s decision. Other smaller ultra-nationalists parties were also given government posts, and several of the independent cabinet members are also aligned to these parties. Dmytro Yarosh from Right Sector (Pravyi Sektor) is the deputy secretary of the RNBO, and the Trizub Party was given the education ministry. Trizub had Sergey Kvit appointed to the post of education minister.
  • The role of the ultra-nationalists in executing the coup has been essentially ignored by the mainstream media in North America and the EU. The roots of the bloodshed in Kiev have been ignored, too. The shootings of protesters by snipers have simply been presented as the vile actions of the Ukrainian government, never taking into consideration the agitation of the armed ultra-nationalist gangs and the mainstream opposition leaders for a conflict. According to a leaked telephone conversation on Feb. 26 between Estonian Foreign Minister Urmas Paet and European Union Commissionaire Catherine Ashton, which was leaked by the Security Service of Ukraine (SBU) , the snipers who shot at protesters and police in Kiev were allegedly hired by Ukrainian opposition leaders. Estonian Foreign Minister Paet made the statements on the basis of details he was given by one of the head doctors of the medical team of the anti-government protests, Olga Bogomolets, an opponent of Viktor Yanukovych’s government who wanted it removed from power. Paet tells Ashton the following first: “There is now stronger and stronger understanding that behind the snipers, it was not Yanukovych, but it was somebody from the new coalition.” This is also corroborated by the fact that Yanukovych actually had ordered the Ukrainian riot police and security forces not to use lethal force.
  • The Estonian official then mentions that it was verified to him that the same snipers were killing people on both sides. He tells Ashton the following: “And second, what was quite disturbing, this same Olga [Bogomolets] told as well that all the evidence shows that the people who were killed by snipers from both sides, among policemen and then people from the streets, that they were the same snipers killing people from both sides.” Another important point that Paet makes to Ashton is the following: “[Dr. Olga Bogomolets] then also showed me some photos she said that as a medical doctor she can say that it is the same handwriting, the same type of bullets, and it’s really disturbing that now the new coalition, that they don’t want to investigate what exactly happened.” Past reports that the mainstream media were hostile to the ousted Ukrainian government also raise serious questions that corroborate what has been said about the snipers intentionally killing protesters to instigate regime change.
  • The Telegraph reported on Feb. 20 that “[a]t least three of the bodies displayed single bullet wounds to the heads,” and “were shot in the head, the neck or the heart. None were shot anywhere else like in the legs.” This means that the snipers were making kill shots by design, which seems like the last thing that the Ukrainian government would want to do when it was trying to appease the protesters and bring calm to Kiev. The Ukrainian journalist Alexey Yaroshevsky’s account of the sniper shootings is also worth noting, and it is backed up by footage taken by his Russian crew in Kiev.  Their footage shows armed opposition members running away from the scene of the shooting of anti-government protesters. What comes across as unusual is that the armed members of the opposition were constantly agitating to start firefights at every opportunity that they could get.
  • The commandant of the SSU, Major-General Oleksandr Yakimenko, has testified that his counter-intelligence forces were monitoring the CIA in Ukraine during the protests. According to the SSU, the CIA was active on the ground in Kiev and collaborating with a small circle of opposition figures. Yakimenko has also said that it was not the police or government forces that fired on the protesters, but snipers from the Philharmonic Building that was controlled by the opposition leader Andriy Parubiy, which he asserts was interacting with the CIA. Speaking to the Russian media, Yakimenko said that 20 men wearing “special combat clothes” and carrying “sniper rifle cases, as well as AKMs with scopes” ran out of the opposition-controlled Philharmonic Building and split into two groups of 10 people, with one taking position at the Ukraine Hotel. The anti-government protesters even saw this and asked Ukrainian police to pursue them, and even figures from Right Sector and Svoboda asked Yakimenko’s SSU to investigate and apprehend them, but Parubiy prevented it. Major-General Yakimenko has categorically stated that opposition leaders were behind the shootings. Following the release of the conversation between Paet and Ashton, the Estonian Foreign Ministry confirmed that the leak was authentic, whereas the European Commission kept silent. The mainstream media in North America and the EU either ignored it or said very little. The Telegraph even claimed that Dr. Bogomolets told it that she had not treated any government forces even though she contradicts this directly in an interview with CNN where says she treated military personnel.
  • CNN, on the other hand, quickly glossed over the story, giving it only enough attention to create the impression that the network is fairly covering the news. Opting not to give the story the airtime that it deserved, CNN instead posted it on its webpage. The conversation is immediately discredited, undermined and dismissed in the first sentence of the article, which is attributed to Foreign Minister Paet: “Don’t read too much into the conversation.” The article was deliberately structured by CNN to undermine the important information that would challenge the narrative that the U.S. mainstream media have been painting. The title, sub-titles and opening sentences of most texts act as microcosms or summaries of the articles, and in many cases, readers evaluate or decide to read the articles on the basis of what these texts communicate. Moreover, the first sentence of the article sets the tempo for readers and and influences their opinion, too. Although anyone who listens to the conversation between Paet and Ashton and considers the evidence that is being discussed would realize just how important the news was, the message being set forth by CNN was a dismissive one.

  • As George Watson put it in The Lost Literature of Socialism:It is now clear beyond all reasonable doubt that Hitler and his associates believed they were socialists, and that others, including democratic socialists, thought so too. The clue is in the name. Subsequent generations of Leftists have tried to explain away the awkward nomenclature of the National Socialist German Workers' Party as either a cynical PR stunt or an embarrassing coincidence. In fact, the name meant what it said. Hitler told Hermann Rauschning, a Prussian who briefly worked for the Nazis before rejecting them and fleeing the country, that he had admired much of the thinking of the revolutionaries he had known as a young man; but he felt that they had been talkers, not doers. "I have put into practice what these peddlers and pen pushers have timidly begun," he boasted, adding that "the whole of National Socialism" was "based on Marx".

    While I'd be the first to agree that the degree of fiscal mismanagement of this nation's economy is beyond insane and have to admit that I see very little to admire in Barack Obama's presidency, the meme about Executive Order 13603 authorizing confiscation of any property and enslavement of the American public needs to be put to rest. See http://www.archives.gov/federal-register/executive-orders/2012.html#13603 E.O. 13603 is not much more than an updating of similar executive orders issued by prior presidents beginning with Dwight Eisenhower. In fact, in skimming it a few minutes ago, I didn't see anything drastically different from some of the prior related orders. E.g., it reflects that a bunch of agencies that were formerly either independent or under other departments are now under the newish Department of Homeland Security, whose Secretary now gets the authority formerly delegated to other department and agency heads. If blame must be cast, it belongs on the Congress that enacted the Defense Production Act of 1950, 50 U.S.C. 2061, et seq. The executive order does no more than obey that Act's instructions. For example there is a section authorizing pre-emption of manufacturing capacity of critical industries over any existing civilian contracts in the event of a national emergency, but that language is in the statute as well. But that power hasn't had much traction since Harry Truman tried to nationalize the steel industry to break a nationwide strike. The Supreme Court swatted down that effort as an abuse of a power that would be lawful in a true emergency, like another major. But even that semi-radical "survival" power is ameliorated by other provisions of the statute and the order that authorize loan guarantees for companies' construction and maintenance of critical productive capacity. This served the interests of the neoconservatives, the private armaments companies, the US military, the private security companies, government security agencies such as the CIA, the left-wing, the right-wing, the Israel Lobby, and the print and TV media. The official explanation gave the neoconservatives the “new Pearl Harbor” that they needed for their program of invasions of Middle Eastern countries. The private armaments companies could look forward to decades of high profits. Wars always bring the military rapid promotions and higher retirement benefits. Private manufacturers of security equipment and spyware enjoy a rising demand for their products and have grown fat from the products sold to the TSA and NSA. Homeland Security has vastly expanded the federal workforce and administrative positions. The left-wing has proof of “blowback” caused by US interference in the internal affairs of other countries. The right-wing has proof that America has enemies against whom defense at all costs is necessary. The Israel Lobby has the US to overthrow the regimes in the way of Israel’s territorial expansion. The media has the story of the century with which to boost ratings and curry the favor of government.

All the trillions of dollars spent were worth it. We got revenge on the guy who did 9/11. No one remembered that the US government, unable to find bin Laden for 10 years, had settled on a different “9/11 mastermind,” Khalid Sheikh Mohammed, and had him water-boarded 183 times until he confessed to being responsible for 9/11. If Khalid Sheikh Mohammed “was responsible for the 9/11 operation from A to Z,” why were SEALS sent, illegally, into Pakistan to murder bin Laden? As the FBI says, there is no evidence that bin Laden is responsible for 9/11. That is why bin Laden was not wanted on that charge by the FBI, as the FBI publicly stated.
  • Judicial Watch has been trying to pry the (nonexistent) photos of a dead bin Laden from the government’s hands. For “national security reasons” the US government does not want anyone to see evidence that supports its far-fetched tale of bin Laden’s murder. The photographic evidence of a successful raid are off limits. They are like the alleged videos of the airliner hitting the Pentagon that we are not permitted to see for “national security reasons.” In other words, the photos and videos do not exist and never did. No government, not even the American one, would be so totally stupid as to withhold the evidence for its claims. The government, seeing its unbelievable stories lose believability at home and abroad used Judicial Watch’s lawsuit to boost the credibility of its story. Judicial Watch filed a Freedom of Information Act lawsuit for the photos that the Obama regime alleged to have of the murdered bin Laden but refused to release. Obviously, the government has no such photos and never had any such photos. But the government does not need evidence when it can rely on the gullibility of the American people.

No other helicopters landed. So there was no dead bin Laden to be buried at sea (there are no known witnesses to the alleged burial) and no photographs of a dead bin Laden.

  • DEEP in a remote, fog-layered hollow near Sugar Grove, W.Va., hidden by fortress-like mountains, sits the country's largest eavesdropping bug. Located in a "radio quiet" zone, the station's large parabolic dishes secretly and silently sweep in millions of private telephone calls and e-mail messages an hour. Run by the ultrasecret National Security Agency, the listening post intercepts all international communications entering the eastern United States. Another N.S.A. listening post, in Yakima,Wash., eavesdrops on the western half of the country. A hundred miles or so north of Sugar Grove, in Washington, the N.S.A. has suddenly taken center stage in a political firestorm. The controversy over whether the president broke the law when he secretly ordered the N.S.A. to bypass a special court and conduct warrantless eavesdropping on American citizens has even provoked some Democrats to call for his impeachment. According to John E. McLaughlin, who as the deputy director of the Central Intelligence Agency in the fall of 2001 was among the first briefed on the program, this eavesdropping was the most secret operation in the entire intelligence network, complete with its own code word - which itself is secret.
  • But the agency is still struggling to adjust to the war on terror, in which its job is not to monitor states, but individuals or small cells hidden all over the world. To accomplish this, the N.S.A. has developed ever more sophisticated technology that mines vast amounts of data. But this technology may be of limited use abroad. There would be no place to hide." He added that if a dictator ever took over, the N.S.A. "could enable it to impose total tyranny, and there would be no way to fight back."

Those deemed innocent would quickly be eliminated from the watch list, while those thought suspicious would be submitted to the FISA court for a warrant. In essence, N.S.A. seemed to be on a classic fishing expedition, precisely the type of abuse the FISA court was put in place to stop.At a news conference, President Bush himself seemed to acknowledge this new tactic. "FISA is for long-term monitoring," he said. "There's a difference between detecting so we can prevent, and monitoring.
  • In 2002, it was revealed that the Pentagon had launched Total Information Awareness, a data mining program led by John Poindexter, a retired rear admiral who had served as national security adviser under Ronald Reagan and helped devise the plan to sell arms to Iran and illegally divert the proceeds to rebels in Nicaragua. Total Information Awareness, known as T.I.A., was intended to search through vast data bases, promising to "increase the information coverage by an order-of-magnitude." According to a 2002 article in The New York Times, the program "would permit intelligence analysts and law enforcement officials to mount a vast dragnet through electronic transaction data ranging from credit card information to veterinary records, in the United States and internationally, to hunt for terrorists." After press reports, the Pentagon shut it down, and Mr. Poindexter eventually left the government. But according to a 2004 General Accounting Office report, the Bush administration and the Pentagon continued to rely heavily on data-mining techniques. "Our survey of 128 federal departments and agencies on their use of data mining," the report said, "shows that 52 agencies are using or are planning to use data mining. These departments and agencies reported 199 data-mining efforts, of which 68 are planned and 131 are operational." Of these uses, the report continued, "the Department of Defense reported the largest number of efforts."

  • The United States and "partner nation forces" have expanded airstrikes against the Islamic State into Syria, broadening the war with the jihadist group beyond Iraq. Additionally, the US targeted the Khorasan Group, a coordinating council made up of al Qaeda leaders in Syria. US military officials involved in the operation told The Long War Journal that the strike package includes US B-1 bombers, carrier-based F/A-18 fighters and ground-based F-15s and F-16s, remotely piloted drones, and Tomahawk cruise missiles launched from warships. Airstrikes targeted Islamic State command and control centers in Raqqah, the jihadist group's de facto capital in Raqqah province in eastern Syria, as well as arms caches, supply depots, and ground units near the Iraqi border. Rear Admiral James Kirby, the Pentagon's spokesman, confirmed that airstrikes have begun. "I can confirm that US military and partner nation forces are undertaking military action against ISIL [Islamic State] terrorists in Syria using a mix of fighter, bomber and Tomahawk Land Attack Missiles," Kirby said in a statement obtained by The Long War Journal. In the early morning of Sept. 23, US Central Command, or CENTCOM, which is directing the operations in Iraq and Syria, provided further details of the attack.

Other countries that participated in the operation include Bahrain, Jordan, Saudi Arabia, Qatar and the United Arab Emirates. Additionally, the US launched eight airstrikes against "a network of seasoned al Qaeda veterans - sometimes referred to as the Khorasan Group - who have established a safe haven in Syria to develop external attacks, construct and test improvised explosive devices and recruit Westerners to conduct operations." The strikes targeted "training camps, an explosives and munitions production facility, a communication building and command and control facilities" as part of an effort "to disrupt the imminent attack plotting against the United States and Western interests."

President Barrack Obama stated 13 days ago that the US air campaign against the Islamic State, which began in northern Iraq on Aug. 7, would be expanded into Syria. US and French warplanes are now operating over Irbil, Sinjar, Kirkuk, the Mosul and Haditha dams, southwest of Baghdad (likely in Jurf al Sakhar in northern Babil), and somewhere on the Euphrates River. According to CENTCOM, the US has launched 194 airstrikes in Iraq since Aug. 7. The Islamic State has threatened to retaliate against the US and other Western countries that participate in military action against the jihadist group. Just yesterday, Abu Muhammad al Adnani, the spokesman for the Islamic State, called for Muslims in Western countries to wage jihad.   • The National Security Archive today posted key documents on Operation Condor, presented by its Southern Cone analyst, Carlos Osorio, at a historic trial in Buenos Aires of former military officers. During 10 hours on the witness stand recently, Osorio introduced one hundred documents into evidence for the court proceedings. His testimony was profiled on May 3 in a major feature article published in the Buenos Aires daily, Pagina 12. Operation Condor was an infamous secret alliance between South American dictatorships in the mid and late 1970s - a Southern Cone rendition and repression program - formed to track down and eliminate enemies of their military regimes. The Condor trial charges 25 high-ranking officers, originally including former Argentine presidents Jorge Videla (deceased) and Reynaldo Bignone (aged 87), with conspiracy to "kidnap, disappear, torture and kill" 171 opponents of the regimes that dominated the Southern Cone in the 1970s and 1980s. Among the victims were approximately 80 Uruguayans, 50 Argentines, 20 Chileans and a dozen others from Paraguay, Bolivia, Peru and Ecuador who were targeted by Condor operatives.
  • The tribunal requested Osorio’s testimony, which took place over two days on March 6 and 7, 2015, and included presentation of an Excel data base of 900 documents drawn mostly from U.S. government sources and from the Archive of Terror in Paraguay. Of these, Osorio focused on 100 declassified records selected for the tribunal, which was presided over by Judge Oscar Amirante, president of Federal Tribunal N° 1. The National Security Archive obtained the U.S. documents through the Freedom of Information Act (FOIA), primarily from the Central Intelligence Agency, Defense Intelligence Agency and the State Department. Other notable records originated from the Chilean former secret police, DINA. "We have been working on Operation Condor for years," Osorio said, "sifting through archives in many continents and building a body of knowledge and a trove of documents." The Pagina 12 feature entitled "The Evolution of Condor," described Osorio’s presentation of "dozens" of documents to the tribunal, and the contribution the documents made in educating the judges on the genesis and evolution of coordinated repression in the Southern Cone. Osorio’s testimony covered a range of topics including the breadth of Condor operations, U.S. knowledge of those operations and the authenticity of the records being introduced into evidence.

  • The article highlighted one document Osorio presented that revealed the bilateral precedent for what would become a multilateral system of regional repression: a secret accord between the Argentine and Paraguayan military intelligence services to "Collaborate in the struggle against subversion…" and the "… internment [of dissenters]…" " The agreement was dated September 12,1972, and signed by Paraguayan intelligence officer Col. Benito Guanes Serrano. Three years later, Guanes would also be one of the five original signatories of the secret Condor accords. Osorio discovered the document in the Archive of Terror in Paraguay. In September 1975, an assessment by a State Department intelligence analyst concluded that "The national security forces of the southern cone surpass the terrorists in cooperation at the international level…" Six weeks later, in Santiago, Chile, intelligence chiefs from Argentina, Bolivia, Chile, Paraguay and Uruguay signed an "Acta" officially establishing Operation Condor. Osorio introduced that pivotal document - provided to the Archive by a source in Chile - into evidence as well.
  • Two declassified U.S. documents presented to the tribunal underscored the contradictory response of high U.S. officials as they became aware of Condor operations in the summer of 1976. One well-known 13-page memorandum of conversation between Secretary of State Henry Kissinger and Argentine Foreign Minister Admiral Cesar Guzzetti dated June 10, 1976, revealed Kissinger’s endorsement of the regional collaboration to repress the left. After Guzzetti informed Kissinger that the Southern Cone regimes were engaged in "joint efforts" to fight "the terrorist problem," Kissinger essentially supported this approach: "If there are things that have to be done, you should do them quickly. But you should get back quickly to normal procedures," according to the declassified transcript Osorio provided to the court. "We want you to succeed. We do not want to harrass [sic] you," Kissinger concluded. "I will do what I can … "
  • After a CIA briefing to Kissinger’s top aides in late July 1976 on the Condor countries’ plans to send assassination teams around the world to eliminate opponents, the Secretary of State authorized a démarche to General Augusto Pinochet in Chile, General Jorge Videla in Argentina, and other military leaders in the region calling on them to cease and desist. "Government planned and directed assassinations within and outside the territory of Condor members has most serious implication which we must face squarely and rapidly," stated the secret August 13, 1976, cable to U.S. ambassadors in those nations. But the démarche was never delivered to any of the Condor regimes. After the U.S. ambassadors raised objections about presenting the démarche to the generals, on September 16, 1976, Kissinger rescinded it, and ordered "that no further action be taken on this matter." In addition to Osorio, the National Security Archive’s Chile Documentation Project director, Peter Kornbluh, testified in the Operation Condor trial for five hours in December 2014. The Times accused Moscow of “saber-rattling,” challenging Obama’s Syria agenda, ignoring its lawlessness, saying “(a) Russian ground force could fundamentally alter the conflict.” Putin categorically ruled out using ground troops in Syria. Russian upper house Federation Council foreign affairs committee chairman Konstantin Kosachev said “(w)e would not risk getting stuck in a long conflict and threaten the lives of our troops. The operation is aerial only. Certainly, in coordination with the ground operation of the Syrian army.” Putin called for an international anti-terrorist coalition to fight its scourge, cooperatively with Syrian armed forces, boots on the ground directly engaging ISIS and other takfiri terrorists. The Times accused Russia of using troops disguised as volunteers – the same “little green men” Big Lie claim about Ukraine – “stealth tactics…using (Russian) soldiers to seize Crimea…and aid pro-Moscow rebels in eastern Ukraine,” said The Times – polar opposite clear, hard truths. It cited unnamed US military officials, claiming hundreds of “Russian military personnel” are in Syria, preparing for many more to come.

Its bombing campaign strikes Syrian targets, supporting these groups, not fighting them.

Bowe Bergdahl as a “deserter” who wasn’t worth ransoming from the Taliban, but the real villains are the architects of the disastrous Iraq and Afghan wars who frivolously put the many Bergdahls in harm’s way, writes ex-CIA analyst Ray McGovern. By Ray McGovern For me, the Sgt. Bowe Bergdahl affair brings back angry memories of how, in 2009, President Barack Obama caved in to be-medaled and be-ribboned generals like David Petraeus and ordered a modified-limited-hangout-type “surge” of 33,000 troops into Afghanistan. Consequential cowardice at work – trading lives for political advantage – as bad as it gets. Bergdahl was quick to discern that he and his comrades were pawns of a policy doing far more harm than good in terms of helping the Afghans. Emailing from Afghanistan in late June 2009, Bergdahl pointed out the main problem in these words: “In the US army you are cut down for being honest… but if you are a conceited brown nosing shit-bag you will be allowed to do what ever you want.”
  • But how far up the line did this behavior go? Did it include Petraeus, described by CENTCOM commander Admiral William “Fox” Fallon as “an ass-kissing little chickenshit” after a meeting at which Petraeus fawned over Fallon, then his superior? (Why is it that the Fox Fallons are the ones who get sacked? Although Petraeus’s charmed government career was finally done in by a sex scandal in December 2012.) Do Fallon’s epithets toward Petraeus apply equally to commander-in-chief Obama who ordered the “surge” into Afghanistan, which – like its first still-born twin “surge” in Iraq two years earlier – predictably did little more than get a lot of folks killed and buy some time for the architects of the two misguided adventures to get some distance between their original decisions and the ultimate failures.

    Former CIA analyst Ray McGovern has some very harsh words for Barack Obama and some good advice as well. I was a little slowed-down by McGovern's use of the term "right wing" to describe television networks; dumping on Sgt. Bergdahl certainly wasn't confined to Fox News; it's happening throughout mainstream media.  Then I realized that he was using the term in the sense employed nearly everywhere but in U.S. mainstream media land; "right-wing" denotes a position that supports maximal government power and minimizes the citizenry's rights. "Left-wing" takes the opposite tack. And within those senses, McGovern is absolutely correct to brand all of mainstream media as right-wing. They're virtually all pro-oligarchists peddling American exceptionalism fascism under an imperial presidency as being good for all Americans.

  • On Friday, James Clapper finally provided Ron Wyden an unclassified response to a question he posed on January 29, admitting that the NSA conducts back door searches. (via Charlie Savage) As reflected in the August 2013 Semiannual Assessment of Compliance with Procedures and Guidelines Issued Pursuant to Section 702, which we declassified and released on August 21, 2013, there have been queries, using U.S. person identifiers, of communications lawfully acquired to obtain foreign intelligence by targeting non U.S. persons reasonably believed to be located outside the U.S. pursuant to Section 702 of FISA. It has taken just 9 months for Clapper to admit that, contrary to months of denials, the NSA (and FBI, which he doesn’t confirm but which the Report makes clear, as well as the CIA) can get the content of Americans’ communications without a warrant. But Clapper’s admission that this fact was declassified in August should disqualify Vice Admiral Mike Rogers from confirmation as CyberComm head (I believe he started serving as DIRNSA head, which doesn’t require confirmation, yesterday). Because it means Rogers refused to answer a question the response to which was already declassified.
  • Udall: If I might, in looking ahead, I want to turn to the 702 program and ask a policy question about the authorities under Section 702 that’s written into the FISA Amendments Act. The Committee asked your understanding of the legal rationale for NASA [sic] to search through data acquired under Section 702 using US person identifiers without probable cause. You replied the NASA–the NSA’s court approved procedures only permit searches of this lawfully acquired data using US person identifiers for valid foreign intelligence purposes and under the oversight of the Justice Department and the DNI. The statute’s written to anticipate the incidental collection of Americans’ communications in the course of collecting the communications of foreigners reasonably believed to be located overseas. But the focus of that collection is clearly intended to be foreigners’ communications, not Americans. But declassified court documents show that in 2011 the NSA sought and obtained the authority to go through communications collected under Section 702 and conduct warrantless searches for the communications of specific Americans. Now, my question is simple. Have any of those searches been conducted?

Rogers: But if you would like me to come back to you in the future if confirmed to be able to specifically address that question I will be glad to do so, Sir. Udall: Let me follow up on that. You may recall that Director Clapper was asked this question in a hearing earlier this year and he didn’t believe that an open forum was the appropriate setting in which to discuss these issues. The problem that I have, Senator Wyden’s had, and others is that we’ve tried in various ways to get an unclassified answer — simple answer, yes or no — to the question. We want to have an answer because it relates — the answer does — to Americans’ privacy. Can you commit to answering the question before the Committee votes on your nomination?

  • I assume that now that Clapper has given him the okay to discuss unclassified topics with Congress, Rogers will now provide a forthright answer, all the while claiming he was ignorant about the answer at the time (fine! then make me DIRNSA because I know more about it!). But Rogers’ response went far beyond such an answer. He refused — not just in the hearing but even after it — to commit to answering a question with a completely unclassified answer. And as I pointed out in this post, his written answers were even more obfuscatory. I don’t get a vote. But I think this should disqualify him as a nominee.

Save The Children: “had been under suspicion from authorities ever since a doctor accused of assisting the CIA in its search for the al-Qaida leader claimed that Save the Children had introduced him to US intelligence officers.” (11.) Dr Shakil Afridi, currently serving 33 years in jail was: “accused of setting up a bogus hepatitis B vaccination campaign in the Abbottabad area to try to pinpoint Bin Laden’s exact location”, via DNA samples which: “were to be tested by the CIA for genetic matches to Bin Laden.”
  • Whilst: “Afridi never succeeded in persuading (people) to give blood, his collaboration with a foreign intelligence service is regarded as an act of treason by Pakistan’s security establishment.” Save The Children which emphatically denied employing or paying Dr Afridi or indeed having a vaccination programme in Abbottabad were nevertheless expelled from Pakistan in September 2012. In spite of denials, internal mails on the dispute obtained by the Center for Investigative Reporting in Pakistan (12) which can be read in full (13) make interesting reading.

Since the organization cannot work in Syria, she has brought stories of “innocent childhoods being smashed to pieces” from neighbouring countries. Of course Britain under Cameron is arming and training the Syrian insurgents. (14.) Cameron is a Blair admirer, on record as taking his advice. “Peace Envoy” Blair is on record as enthusiast for another illegal overthrow in Syria with “no regrets” over Iraq.

So as Save The Children lauds Blair and trumpets the Rights of the Child, perhaps they should reflect the horror he has wrought. In Iraq one in four surviving children now has stunted physical or intellectual development due to malnutrition.   • Oceanfront views, 24-hour doorman, heated pool, and perhaps best of all, a “private tunnel to the beach.” This $3 million Palm Beach, Florida penthouse could be yours, but unfortunately it isn’t because this prize has already been claimed by a former high-level U.S. official who helped pave the way for the over decade-long “war on terror,” which has been a near complete catastrophe. Iraq is aflame, the Islamic State is on the rampage, the situation in Afghanistan worsens by the day, and thousands of Americans—and many more Iraqis and Afghans—have died during the post-9/11 conflicts. Meanwhile, the combined cost of the “war on terror” comes to an estimated $1.6 trillion. But if the American people got screwed on the deal, a lot of former senior government officials who played important roles in this debacle have done quite well for themselves. It’s New Year’s Eve and I need to write a final sendoff to 2014, so I thought I’d take a look at the fortunes (literally) of some of these figures: Former CIA director George Tenet and former FBI director Louis Freeh (I’ll cover former Department of Homeland Security chief Tom Ridge in a New Year’s post).
  • Freeh resigned from the FBI two months before 9/11. When he worked there he was making an annual salary of $145,000 and lived “in a heavily mortgaged house in Great Falls, a Virginia suburb,” according to an old and admiring New Yorker profile. He and his wife now own at least four lavish estates worth many millions of dollars, including a residence in Wilmington, Delaware, a six-bedroom summerhouse worth more than $3 million in Vermont, and a beachfront penthouse at 100 Worth Avenue in Palm Beach, Florida, which was bought for $1.4 million and now has an estimated value of $3 million. How’d that happen? Well, Freeh is one of many former U.S. officials who got paid big speaking fees (reportedly up to $50,000 a pop) by a creepy Iranian group called the People’s Mujahedin, also known as Mojahedin-e-Khalq, or MEK, to successfully advocate for its removal from the State Department’s list of Foreign Terrorist Organizations. He also opened up a consulting firm whose clients have included Saudi Arabia’s Prince Bandar, who the U.S. Department of Justice accused of taking massive bribes from a British defense contractor. That’s right, Freeh represented a prince from America’s old pal Saudi Arabia, home to fifteen of the nineteen 9/11 hijackers, and whose export of Wahhabism is credited with giving rising to the Islamic State.
  • Freeh is also hired to conduct investigations, like the controversial report he produced about Penn State’s football program. Nasser Kazeminy, a Minnesota businessman who in 2008 was accused of bribing former Senator Norm Coleman, also hired Freeh to conduct a “thorough investigation” of the allegations against him in the hopes of clearing his name.

  • In 2011, Freeh issued a public statement saying that his investigation had “completely vindicated” both Kazeminy and Coleman. Sure, Kazeminy had bought Coleman $100,000 worth of presents, but, Freeh said at a press conference, “There was no quid pro quo in the gifts. There was no wrongdoing.” Freeh also met with the Justice Department – which was investigating the bribery charges but declined to bring a case—on Kazeminy’s behalf. Oh yeah, about Freeh’s Palm Beach penthouse. As I discovered through Florida property records, Freeh’s wife co-owns it with Kazeminy, which kind of makes you wonder about just how thorough and impartial his investigation was. The quit claim deed giving Freeh’s wife one-half ownership of the penthouse was signed nine days after Freeh’s vindication of Kazeminy.

  • Fogh of War is all over the place, talking "pre-positioning of supplies, equipment" - euphemism for weapons; boosting bases and headquarters in host countries; and touting a 10,000-strong, rapid reaction "spearhead" force to respond to Russian "aggression" and deployable in a maximum of five days. Meanwhile, in a bad cop-bad cop routine, outgoing president of the European Commission, outstanding mediocrity Jose Manuel Barroso, leaked that Russian President Vladimir Putin told him over the phone later last week he could take Kiev in a fortnight if he wanted. Well, Putin could. If he wanted. But he doesn't want it. What matters is what he told Rossiya state TV; that Kiev should promote inclusive talks about the future statute of Eastern Ukraine. Once again, the Western spin was that he was advocating the birth of a Novorossiya state. Here, The Saker analyzes in detail the implications of what Russia really wants, and what the Novorossiya forces really want.
  • NATO somehow is already in Ukraine. A NATO cyber center group has been in Kiev since March, operating in the building of the Council of National Security and Defense. So it is a bunch of NATO bureaucrats who actually determine the news agenda in Ukraine - and the non-stop demonization of all things Russia. Ukraine is all about Germany now. Berlin wants a political solution. Fast. Berlin wants Russian gas flowing via Ukraine again. Fast. Berlin does not want US missile defense in Eastern Europe - no matter what the Baltic states scream. That's why Poroshenko's latest "Invasion! Invasion! Invasion!" craze is nothing but pure desperation by a lowly, bankrupt vassal of the Empire of Chaos. Of course that does not prevent Fogh of War - who got the NATO job because he was an enthusiastic cheerleader of the rape of Iraq - to keep crying "Invasion!" till all Danish retrievers come home.

  • And then there's NATO's recent record. An ignominious defeat in Afghanistan. A "humanitarian" bombing that reduced once-stable Libya to a miserable failed state immersed in total anarchy and ravaged by rabid militias. Not exactly fabulous PR for NATO's future as a coalition assembly line with global "vocation", capable of pulling off expeditionary wars all around the world by creating the appearance of a military and political consensus unified by - what else - an Empire of Chaos doctrine: NATO's "strategic concept" approved at the 2010 Lisbon summit. (See US a kid in a NATO candy store, Asia Times Online, November 25, 2010.) Since those go-go "Bubba" Clinton years; through the "pre-emptive" Dubya era; and now under the R2P dementia of Obama's warring Medusas (Rice, Power, Hillary), the Pentagon dreams of NATO as global Robocop, dominating all the roles embodied by the UN and the EU in terms of security. This has absolutely nothing to do with the original collective defense of NATO signatories against possible territorial attacks. Oh, sorry; we forgot the attacks by those (non-existent) nuclear missiles deployed by evil Iran.
  • The Ukraine battleground at least has the merit of showing the alliance is naked. For the Full Spectrum Dominance Pentagon, what really matters above all is something that's been actually happening since the fall of the Soviet Union; unlimited NATO expansion to the westernmost borders of Russia. The real deal this September is not NATO. It's the SCO's summit. Expect the proverbial tectonic shifts of geopolitical plaques in the upcoming meeting of the Shanghai Cooperation Organization - a shift as far-reaching as when the Ottoman empire failed at the gates of Vienna in 1683.   • The Federal Chief Information Officers (CIO) Council has won the infamous Rosemary Award for worst open government performance of 2014, according to the citation published today by the National Security Archive at www.nsarchive.org. The National Security Archive had hoped that awarding the 2010 Rosemary Award to the Federal Chief Information Officers Council for never addressing the government's "lifetime failure" of saving its e-mail electronically would serve as a government-wide wakeup call that saving e-mails was a priority. Fallout from the Hillary Clinton e-mail debacle shows, however, that rather than "waking up," the top officials have opted to hit the "snooze" button. The Archive established the not-so-coveted Rosemary Award in 2005, named after President Nixon's secretary, Rose Mary Woods, who testified she had erased 18-and-a-half minutes of a crucial Watergate tape — stretching, as she showed photographers, to answer the phone with her foot still on the transcription pedal. Bestowed annually to highlight the lowlights of government secrecy, the Rosemary Award has recognized a rogue's gallery of open government scofflaws, including the CIA, the Treasury Department, the Air Force, the FBI, the Justice Department, and Director of National Intelligence James Clapper.
  • Chief Information Officer of the United States Tony Scott was appointed to lead the Federal CIO Council on February 5, 2015, and his brief tenure has already seen more references in the news media to the importance of maintaining electronic government records, including e-mail, and the requirements of the Federal Records Act, than the past five years. Hopefully Mr. Scott, along with Office of Management & Budget Deputy Director for Management Ms. Beth Cobert will embrace the challenge of their Council being named a repeat Rosemary Award winner and use it as a baton to spur change rather than a cross to bear.

  • Many on the Federal CIO Council could use some motivation, including the beleaguered State Department CIO, Steven Taylor. In office since April 3, 2013, Mr. Taylor is in charge of the Department's information resources and IT initiatives and services. He "is directly responsible for the Information Resource Management (IRM) Bureau's budget of $750 million, and oversees State's total IT/ knowledge management budget of approximately one billion dollars." Prior to his current position, Taylor served as Acting CIO from August 1, 2012, as the Department's Deputy Chief Information Officer (DCIO) and Chief Technology Officer of Operations from June 2011, and was the Program Director for the State Messaging and Archival Retrieval Toolset (SMART). While Hillary Clinton repeatedly claimed that because she sent her official e-mail to "government officials on their State or other .gov accounts ... the emails were immediately captured and preserved," a recent State Department Office of Inspector General report contradicts claims that DOS' e-mail archiving system, ironically named SMART, did so.
  • The report found that State Department "employees have not received adequate training or guidance on their responsibilities for using those systems to preserve 'record emails.'" In 2011, while Taylor was State's Chief Technology Officer of Operations, State Department employees only created 61,156 record e-mails out of more than a billion e-mails sent. In other words, roughly .006% of DOS e-mails were captured electronically. And in 2013, while Taylor was State's CIO, a paltry seven e-mails were preserved from the Office of the Secretary, compared to the 4,922 preserved by the Lagos Consulate in Nigeria. Even though the report notes that its assessments "do not apply to the system used by the Department's high-level principals, the Secretary, the Deputy Secretaries, the Under Secretaries, and their immediate staffs, which maintain separate systems," the State Department has not provided any estimation of the number of Clinton's e-mails that were preserved by recipients through the Department's anachronistic "print and file" system, or any other procedure.
  • The unfortunate silver lining of Hillary Clinton inappropriately appropriating public records as her own is that she likely preserved her records much more comprehensively than her State Department colleagues, most of whose e-mails have probably been lost under Taylor's IT leadership. 2008 reports by CREW, right, and the GAO, left, highlighted problems preserving e-mails. Click to enlarge. The bigger issue is that Federal IT gurus have known about this problem for years, and the State Department is not alone in not having done anything to fix it. A 2008 survey by Citizens for Responsibility and Ethics in Washington (CREW) and OpenTheGovernment.org did not find a single federal agency policy that mandates an electronic record keeping system agency-wide. Congressional testimony in 2008 by the Government Accountability Office indicted the standard "print and file" approach by pointing out:
  • 2011- the Justice Department (for doing more than any other agency to eviscerate President Obama's Day One transparency pledge through pit-bull whistleblower prosecutions, recycled secrecy arguments in court cases, retrograde FOIA regulations, and mixed FOIA responsiveness) 2010 - the Federal Chief Information Officers' Council (for "lifetime failure" to address the crisis in government e-mail preservation) 2009 - the FBI (for having a record-setting rate of "no records" responses to FOIA requests) 2008 - the Treasury Department (for shredding FOIA requests and delaying responses for decades) 2007 - the Air Force (for disappearing its FOIA requests and having "failed miserably" to meet its FOIA obligations, according to a federal court ruling) 2006 - the Central Intelligence Agency (for the biggest one-year drop-off in responsiveness to FOIA requests yet recorded).
  • Troublingly, current Office of Management and Budget guidance does not require federal agencies to manage "all email records in an electronic format" until December 31, 2016. The only part of the federal government that seems to be facing up to the e-mail preservation challenge with any kind of "best practice" is the White House, where the Obama administration installed on day one an e-mail archiving system that preserves and manages even the President's own Blackberry messages. The National Security Archive brought the original White House e-mail lawsuit against President Reagan in early 1989, and continued the litigation against Presidents George H.W. Bush and Bill Clinton, until court orders compelled the White House to install the "ARMS" system to archive e-mail. The Archive sued the George W. Bush administration in 2007 after discovering that the Bush White House had junked the Clinton system without replacing its systematic archiving functions. CREW subsequently joined this suit and with the Archive negotiated a settlement with the Obama administration that included the recovery of as many as 22 million e-mails that were previously missing or misfiled.
  • s a result of two decades of the Archive's White House e-mail litigation, several hundred thousand e-mails survive from the Reagan White House, nearly a half million from the George H.W. Bush White House, 32 million from the Clinton White House, and an estimated 220 million from the George W. Bush White House. Previous recipients of the Rosemary Award include: 2013 - Director of National Intelligence James Clapper (for his "No, sir" lie to Senator Ron Wyden's question: "Does the NSA collect any type of data at all on millions or hundreds of millions of Americans?") 2012 - the Justice Department (in a repeat performance, for failing to update FOIA regulations to comply with the law, undermining congressional intent, and hyping its open government statistics)
  • Rogue Band of Federal E-mail Users and Abusers Compounds Systemic Problems Former Secretary of State Hillary Clinton and other federal officials who skirt or even violate federal laws designed to preserve electronic federal records compound e-mail management problems. Top government officials who use personal e-mail for official business include: Clinton; former U.S. Ambassador to Kenya Scott Gration; chairman of the U.S. Chemical Safety Board Rafael Moure-Eraso; and former Secretary of State Colin Powell, who told ABC's This Week "I don't have any to turn over. I did not keep a cache of them. I did not print them off. I do not have thousands of pages somewhere in my personal files." Others who did not properly save electronic federal records include Environmental Protection Agency former administrator Lisa Jackson who used the pseudonym Richard Windsor to receive email; current EPA administrator Gina McCarthy, who improperly deleted thousands of text messages (which also are federal records) from her official agency cell phone; and former Internal Revenue Service official Lois Lerner, whose emails regarding Obama's political opponents "went missing or became destroyed."
  • "agencies recognize that devoting significant resources to creating paper records from electronic sources is not a viable long-term strategy;" yet GAO concluded even the "print and file" system was failing to capture historic records "for about half of the senior officials."
  • The destruction of other federal records was even more blatant. Jose Rodriguez, the former CIA official in charge of the agency's defunct torture program ordered the destruction of key videos documenting it in 2005, claiming that "the heat from destroying [the torture videos] is nothing compared to what it would be if the tapes ever got into the public domain;" Admiral William McRaven, ordered the immediate destruction of any emails about Operation Neptune Spear, including any photos of the death of Osama bin Laden ("destroy them immediately"), telling subordinates that any photos should have already been turned over to the CIA — presumably so they could be placed in operational files out of reach of the FOIA. These rogues make it harder — if not impossible — for agencies to streamline their records management, and for FOIA requesters and others to obtain official records, especially those not exchanged with other government employees. The US National Archives currently trusts agencies to determine and preserve e-mails which agencies have "deemed appropriate for preservation" on their own, often by employing a "print and file" physical archiving process for digital records. Any future reforms to e-mail management must address the problems of outdated preservation technology, Federal Records Act violators, and the scary fact that only one per cent of government e-mail addresses are saved digitally by the National Archive's recently-initiated "Capstone" program.
