  • The partner of Glenn Greenwald, the journalist for The Guardian who has been publishing information leaked by the former National Security Agency contractor Edward J. Snowden, was detained for nine hours by the British authorities under a counterterrorism law while on a stop in London’s Heathrow Airport during a trip from Germany to Brazil, Mr. Greenwald said Sunday.
  • Mr. Greenwald’s partner, David Michael Miranda, 28, is a citizen of Brazil. He had spent the previous week in Berlin visiting Laura Poitras, a documentary filmmaker who has also been helping to disseminate Mr. Snowden’s leaks, to assist Mr. Greenwald. The Guardian had paid for the trip, Mr. Greenwald said, and Mr. Miranda was on his way home to Rio de Janeiro.
  • The Guardian published a report on Mr. Miranda’s detainment on Sunday afternoon. Mr. Greenwald said someone who identified himself as a security official from Heathrow Airport called him early on Sunday and informed him that Mr. Miranda had been detained, at that point for three hours. The British authorities, he said, told Mr. Miranda that they would obtain permission from a judge to arrest him for 48 hours, but he was released at the end of the nine hours, around 1 p.m. Eastern time. Mr. Miranda was in Berlin to deliver documents related to Mr. Greenwald’s investigation into government surveillance to Ms. Poitras, Mr. Greenwald said. Ms. Poitras, in turn, gave Mr. Miranda different documents to pass to Mr. Greenwald. Those documents, which were stored on encrypted thumb drives, were confiscated by airport security, Mr. Greenwald said. All of the documents came from the trove of materials provided to the two journalists by Mr. Snowden. The British authorities seized all of his electronic media — including video games, DVDs and data storage devices — and did not return them, Mr. Greenwald said.

    Note that when detained, Mr. Miranda was acting in the role of a courier transporting documents on a thumb drive between two of the lead reporters working on the NSA scandal for The Guardian. The police kept the thumb drive and all other electronic devices Mr. Miranda carried, presumably to study their data stores.  Perhaps even more to the point, this was the seizure of leaked NSA documents and reporters' notes about them. I do not know about the UK law on the subject, but the shame of it is that it would be lawful accordng to the U.S. Supreme Court for U.S. Customs officials to do the same thing had Mr. Miranda arrived at an American international airport. Most Americans would be shocked to learn how many of their cherished Constitutional rights disappear at a port or entry or when crossing a border into the U.S. and when traveling within a 100-mile distance from a U.S. border on the U.S. side. But the particular detention of Mr. Miranda and seizure of the reporter's research and NSA document copies was sure from the outset to cause a major media stir. It has also provoked a strong diplomatic protest from Brazil This incident has already provoked not only a strong diplomatic protest from Brazil, but also in the UK, "Labour MP Tom Watson said he was shocked at the news and called for it to be made clear if any ministers were involved in authorising the detention." Also note in The Guardian article that the police were acting under authority of the draconian British Terrorism Act, which does not limit its application to those who are not suspected of being a terrorist. The number of substantiated cases of misconduct has increased steadily since 2008, according to statistics by the Defense Department’s inspector general.The Navy is investigating Vice Adm. Ted Branch, director of naval intelligence, and Rear Adm. Bruce Loveless, director of intelligence operations, on accusations of “illegal and improper relations” with a defense contractor who scammed the Navy of millions of dollars and bribed naval officials with hookers and gifts over several years.Neither admiral has been charged with a crime or violation, but the Navy said the accusations against them involve “inappropriate conduct prior to their current assignments and flag officer rank.”So far, three Navy officials have been arrested and charged with giving classified information to Malaysian defense contractor Leonard Glenn Francis in exchange for concert tickets, prostitutes and other illicit gifts.

  • A sophisticated FBI-produced spyware program has played a crucial behind-the-scenes role in federal investigations into extortion plots, terrorist threats and hacker attacks in cases stretching back at least seven years, newly declassified documents show. As first reported by Wired.com, the software, called a "computer and internet protocol address verifier," or CIPAV, is designed to infiltrate a target’s computer and gather a wide range of information, which it secretly sends to an FBI server in eastern Virginia. The FBI’s use of the spyware surfaced in 2007 when the bureau used it to track e-mailed bomb threats against a Washington state high school to a 15-year-old student. But the documents released Thursday under the Freedom of Information Act show the FBI has quietly obtained court authorization to deploy the CIPAV in a wide variety of cases, ranging from major hacker investigations, to someone posing as an FBI agent online. Shortly after its launch, the program became so popular with federal law enforcement that Justice Department lawyers in Washington warned that overuse of the novel technique could result in its electronic evidence being thrown out of court in some cases. "While the technique is of indisputable value in certain kinds of cases, we are seeing indications that it is being used needlessly by some agencies, unnecessarily raising difficult legal questions (and a risk of suppression) without any countervailing benefit," reads a formerly-classified March 7, 2002 memo from the Justice Department’s Computer Crime and Intellectual Property Section.
  • The documents, which are heavily redacted, do not detail the CIPAV’s capabilities, but an FBI affidavit in the 2007 case indicate it gathers and reports a computer’s IP address; MAC address; open ports; a list of running programs; the operating system type, version and serial number; preferred internet browser and version; the computer’s registered owner and registered company name; the current logged-in user name and the last-visited URL. After sending the information to the FBI, the CIPAV settles into a silent "pen register" mode, in which it lurks on the target computer and monitors its internet use, logging the IP address of every server to which the machine connects. The documents shed some light on how the FBI sneaks the CIPAV onto a target’s machine, hinting that the bureau may be using one or more web browser vulnerabilities. In several of the cases outlined, the FBI hosted the CIPAV on a website, and tricked the target into clicking on a link. That’s what happened in the Washington case, according to a formerly-secret planning document for the 2007 operation. "The CIPAV will be deployed via a Uniform Resource Locator (URL) address posted to the subject’s private chat room on MySpace.com."

  • The documents appear to settle one of the questions the FBI declined to answer in 2007: whether the bureau obtains search warrants before using the CIPAV, or if it sometimes relies on weaker "pen register" orders that don’t require a showing of probable cause that a crime has been committed. In all the criminal cases described in the documents, the FBI sought search warrants. The records also indicate that the FBI obtained court orders from the Foreign Intelligence Surveillance Court, which covers foreign espionage and terrorism investigations, but the details are redacted. The FBI released 152 heavily-redacted pages in response to Threat Level’s FOIA request, and withheld another 623.

    The article summarizes many cases in which the CIPAV exploit was used by the FBI. But the article's closing observation that the released documents "whether the bureau obtains search warrants before using the CIPAV" stretches the evidence a bit too far, methinks. If they exist, the FBI very likely would not have produced records of incidents in which it used CIPAV without court authorization.

  • IBM announced today that it would throw another billion at Linux, the open-source operating system, to run its Power System servers. The first time it had thrown a billion at Linux was in 2001, when Linux was a crazy, untested, even ludicrous proposition for the corporate world. So the moolah back then didn’t go to Linux itself, which was free, but to related technologies across hardware, software, and service, including things like sales and advertising – and into IBM’s partnership with Red Hat which was developing its enterprise operating system, Red Hat Enterprise Linux. “It helped start a flurry of innovation that has never slowed,” said Jim Zemlin, executive director of the Linux Foundation. IBM claims that the investment would “help clients capitalize on big data and cloud computing with modern systems built to handle the new wave of applications coming to the data center in the post-PC era.” Some of the moolah will be plowed into the Power Systems Linux Center in Montpellier, France, which opened today. IBM’s first Power Systems Linux Center opened in Beijing in May. IBM may be trying to make hay of the ongoing revelations that have shown that the NSA and other intelligence organizations in the US and elsewhere have roped in American tech companies of all stripes with huge contracts to perfect a seamless spy network.   • Then another boon for IBM. Experts at the German Federal Office for Security in Information Technology (BIS) determined that Windows 8 is dangerous for data security. It allows Microsoft to control the computer remotely through a “special surveillance chip,” the wonderfully named Trusted Platform Module (TPM), and a backdoor in the software – with keys likely accessible to the NSA and possibly other third parties, such as the Chinese.   • It would be an enormous competitive advantage for an IBM salesperson to walk into a government or corporate IT department and sell Big Data servers that don’t run on Windows, but on Linux. With the Windows 8 debacle now in public view, IBM salespeople don’t even have to mention it. In the hope of stemming the pernicious revenue decline their employer has been suffering from, they can politely and professionally hype the security benefits of IBM’s systems and mention in passing the comforting fact that some of it would be developed in the Power Systems Linux Centers in Montpellier and Beijing. Alas, Linux too is tarnished. The backdoors are there, though the code can be inspected, unlike Windows code. And then there is Security-Enhanced Linux (SELinux), which was integrated into the Linux kernel in 2003. It provides a mechanism for supporting “access control” (a backdoor) and “security policies.” Who developed SELinux? Um, the NSA – which helpfully discloses some details on its own website (emphasis mine): The results of several previous research projects in this area have yielded a strong, flexible mandatory access control architecture called Flask. A reference implementation of this architecture was first integrated into a security-enhanced Linux® prototype system in order to demonstrate the value of flexible mandatory access controls and how such controls could be added to an operating system. The architecture has been subsequently mainstreamed into Linux and ported to several other systems, including the Solaris™ operating system, the FreeBSD® operating system, and the Darwin kernel, spawning a wide range of related work.

  • Among a slew of American companies who contributed to the NSA’s “mainstreaming” efforts: Red Hat. And IBM? Like just about all of our American tech heroes, it looks at the NSA and other agencies in the Intelligence Community as “the Customer” with deep pockets, ever increasing budgets, and a thirst for technology and data. Which brings us back to Windows 8 and TPM. A decade ago, a group was established to develop and promote Trusted Computing that governs how operating systems and the “special surveillance chip” TPM work together. And it too has been cooperating with the NSA. The founding members of this Trusted Computing Group, as it’s called facetiously: AMD, Cisco, Hewlett-Packard, Intel, Microsoft, and Wave Systems. Oh, I almost forgot ... and IBM. And so IBM might not escape, despite its protestations and slick sales presentations, the suspicion by foreign companies and governments alike that its Linux servers too have been compromised – like the cloud products of other American tech companies.   • In 1964, the year Dr Strangelove was made, "the missile gap" was the false flag. To build more and bigger nuclear weapons and pursue an undeclared policy of domination, President John F Kennedy approved the CIA's propaganda that the Soviet Union was well ahead of the US in the production of intercontinental ballistic missiles. This filled front pages as the "Russian threat". In fact, the Americans were so far ahead in production of the missiles, the Russians never approached them. The cold war was based largely on this lie.
  • Since the collapse of the Soviet Union, the US has ringed Russia with military bases, nuclear warplanes and missiles as part of its Nato enlargement project. Reneging on the Reagan administration's promise to the Soviet president Mikhail Gorbachev in 1990 that Nato would not expand "one inch to the east", Nato has all but taken over eastern Europe. In the former Soviet Caucasus, Nato's military build-up is the most extensive since the second world war.In February, the US mounted one of its proxy "colour" coups against the elected government of Ukraine; the shock troops were fascists. For the first time since 1945, a pro-Nazi, openly antisemitic party controls key areas of state power in a European capital. No western European leader has condemned this revival of fascism on the border of Russia. Some 30 million Russians died in the invasion of their country by Hitler's Nazis, who were supported by the infamous Ukrainian Insurgent Army (the UPA) which was responsible for numerous Jewish and Polish massacres. The Organisation of Ukrainian Nationalists, of which the UPA was the military wing, inspires today's Svoboda party.Since Washington's putsch in Kiev – and Moscow's inevitable response in Russian Crimea to protect its Black Sea fleet – the provocation and isolation of Russia have been inverted in the news to the "Russian threat". This is fossilised propaganda. The US air force general who runs Nato forces in Europe – General Philip Breedlove, no less – claimed more than two weeks ago to have pictures showing 40,000 Russian troops "massing" on the border with Ukraine. So did Colin Powell claim to have pictures proving there were weapons of mass destruction in Iraq. What is certain is that Barack Obama's rapacious, reckless coup in Ukraine has ignited a civil war and Vladimir Putin is being lured into a trap.

The aim is to convince his "allies" in the region, principally Japan, to rearm and prepare for the possibility of war with China. By 2020, almost two-thirds of all US naval forces in the world will be transferred to the Asia-Pacific area. This is the greatest military concentration in that vast region since the second world war.

A strategic naval base is being built on the Korean island of Jeju, less than 400 miles from Shanghai and the industrial heartland of the only country whose economic power is likely to surpass that of the US. As for America's massive movement of naval forces and nuclear weapons to Asia, that is "a sign of the humanitarian assistance the US military can provide".Obama is seeking a bigger budget for nuclear weapons than the historical peak during the cold war, the era of Dr Strangelove. The US is pursuing its longstanding ambition to dominate the Eurasian landmass, stretching from China to Europe: a "manifest destiny" made right by might.

    Until the late 1940s, the U.S. had a "War Department." But in 1949, having just completed the largest foreign war in U.S. history, the War Department ironically was renamed as the "Defense Department." Ever since, the U.S. has waged nothing but foreign wars, none that could literally be characterized as necessary to defend the U.S. As John Pilger eloquently encapsulates in this article, perhaps it's past time to return the Department to the "Department of Wars of Aggression."

  • In February, 1990, US Secretary of State James Baker (1989-1992), representing President George HW Bush, traveled to Moscow to meet with Russian President Mikhail Gorbachev regarding the possible reunification of Germany and the removal of 300,000 Soviet troops. There is little serious dispute that as the Berlin Wall teetered, Baker promised Gorbachev “there would be no extension of NATO’s jurisdiction for forces of NATO one inch to the east.” Gorbachev is reported to have taken the US at its word and responded “any extension of the zone of NATO is unacceptable.” “I agree,” replied Baker.” Unfortunately, Gorbachev never got it in writing and most historians, at the time, agreed that NATO expansion was “ill conceived, ill-timed, and above all ill-suited to the realities of the post-Cold War world.”
  • President Bush’s National Security Advisor Brent Scowcroft and Bill Clinton’s Defense Secretary were also in agreement. But by 1994, that verbal contract had not deterred the concerted efforts of a handful of State Department policy professionals to subdue the overwhelming bureaucratic opposition according to James Goldgeier in his classic “Not Whether but When: The US Decision to Enlarge NATO.” By 1997, the Gorbachev-Baker-Bush agreement was a forgotten policy trinket as Hungary, Poland and the Czech Republic were accepted into NATO. In 2004, former Soviet satellite countries Lithuania, Latvia and Estonia were admitted and in 2009, Croatia and Albania joined NATO. Currently, the former Soviet republics of Ukraine, Georgia, Moldova, Kazakhstan, Armenia, and Azerbaijan are pending membership and all five former Soviet republics in Central Asia (Kyrgyzstan, Tajikistan, Turkmenistan, Kazakhstan, and Uzbekistan) provide NATO with logistical support for the US war in Afghanistan. As the US-led NATO alliance tightens its grip on the Caucasus countries, the American public has not been informed about the Ukrainian Parliament’s approval for a series of NATO military exercises that would put US troops on Russia’s border, even though the Ukraine is not yet a member of NATO. Rapid Trident is a 12-nation military ‘interoperability’ exercise led by the US who will commit the majority of participating troops and Sea Breeze is a naval exercise that will take place on the Black Sea adjacent to Russian ports. The NATO buildup includes joint ground operations with Moldova and Romania.
  • Most recently, NATO Secretary General Anders Fogh Rasmussen announced that the military alliance has cut Russia off from civilian and military cooperation and that there would be the deployment and reinforcement of military assets including increased air patrols over the Baltic Sea and AWACS surveillance flights over Poland and Romania. It goes without saying that the NATO build up is in addition to the deployment of US troops and F-16 warplanes to Poland, F-15C warplanes to Lithuania and aircraft carriers to the Black and Mediterranean Seas. All this raises the question about whether a promise and handshake in the world of international diplomacy is a real commitment and what is a 1991 international promise made by a Republican Administration worth in 1994 to a Democratic Administration?   • What all this means is that, behind the diplomatic landscape of verbal jujitsu and summit meetings, there had been a concerted effort at the US State Department with the creation of a NATO Enlargement Office to establish what has become a Russian Wall – an impenetrable US – defined barrier of estrangement along the Russian border meant to cut the country off from land and sea access – as NATO, itching for war, continues to bait Russia with isolation and threats.

  • The organization charged with overseeing the destruction of Syria’s chemical weapons program says the last of the country’s acknowledged stockpile has been handed over.Organization for the Prohibition of Chemical Weapons director general Ahmet Uzumcu said Monday the final 8 percent of the 1,300-ton stockpile has been loaded onto ships in the Syrian port of Latakia.   • The ship Marianne of Gothenburg set sail Monday night on its journey to break the Israeli blockade of the Gaza Strip. It's journey will mark five years since the Israeli navy forcibly boarded the first Freedom Flotilla's ship Mavi Marmara, killing nine Turkish activists. Israel has announced it will not permit unauthorised ships to enter its territorial waters. Marianne will join additional ships to form the Freedom Flotilla III to perform a peaceful, nonviolent action to break the illegal and inhumane blockade of the Gaza Strip. In passing, Marianne will call at European ports for demonstrations and actions against Israel's blockade of Gaza. The ship is bringing a limited cargo of solar panels and medical equipment for the people of Gaza. The group Ship to Gaza stated that “In the blockaded Gaza Strip, where the infrastructure has been demolished, solar cells will thus provide an opportunity to independent local production of clean energy. The sun can not be blockaded.”
  • In addition to a crew of five people, Marianne will have up to eight delegates as passengers in each section of the route. The Freedom Flotilla’s first attempt to break the blockade ended in the deaths of nine Turkish activists after Israeli Navy commandos on May 31, 2010 boarded the Mavi Marmara. The United Nations declared that Israel used excessive force in stopping the ship, and a diplomatic crisis opened between Turkey and Israel which has yet to fully subside. A second attempt was turned back in October 2012. Without relating specifically to the Marianne of Gothenburg, Foreign Ministry spokesman Emmanuel Nachshon told the Jerusalem Post that “if the so-called helpful Gaza flotillas were really interested in the welfare of the population in Gaza, they would send their aid via Israel. The fact that they insist on a flotilla demonstrates this is an unnecessary provocation.” Israel is clearly concerned about the possible ramifications of Freedom Flotilla III, however; the Foreign Ministry has appointed a point-person to coordinate policy on the matter between the foreign ministry, the prime minister’s office, and the defense ministry.

  • German Foreign Minister Frank-Walter Steinmeier, on Monday, called on Israel to lift the blockade of Gaza in return for Palestinian security reassurances during a visit to the beleaguered coastal enclave. Frank-Walter Steinmeier, heading a delegation of 60 German officials, arrived in the region on Saturday to hold talks with top Palestinian and Israeli officials.
  • During Monday’s visit to Gaza he said the enclave was a “powder keg” at risk of exploding, and called for efforts to quicken reconstruction. “I came out of all my discussions yesterday in Jerusalem and in Ramallah with the hope that all parties are mindful that here we are sitting on a powder keg here and that we must ensure that the fuse does not catch light,” Steinmeier said at a press conference in Gaza City’s fishing port.

  • On Aug. 1, 2008, a small team of Israeli commandos entered the waters near Tartus, Syria, and shot and killed a Syrian general as he was holding a dinner party at his seaside weekend home. Muhammad Suleiman, a top aide to the Syrian president, was shot in the head and neck, and the Israeli military team escaped by sea. While Israel has never spoken about its involvement, secret U.S. intelligence files confirm that Israeli special operations forces assassinated the general while he vacationed at his luxury villa on the Syrian coast. The internal National Security Agency document, provided by former NSA contractor Edward Snowden, is the first official confirmation that the assassination of Suleiman was an Israeli military operation, and ends speculation that an internal dispute within the Syrian government led to his death. A top-secret entry in the NSA’s internal version of Wikipedia, called Intellipedia, described the assassination by “Israeli naval commandos” near the port town of Tartus as the “first known instance of Israel targeting a legitimate government official.” The details of the assassination were included in a “Manhunting Timeline” within the NSA’s intelligence repository.

  • Two Russian navy ships are completing preparations to sail to Syria with a unit of marines on a mission to protect Russian citizens and the nation's base there, a news report said Monday. The deployment appears to reflect Moscow's growing concern about Syrian President Bashar Assad's future.
  • The Interfax news agency quoted an unidentified Russian navy official as saying that the two amphibious landing vessels, Nikolai Filchenkov and Caesar Kunikov, will be heading shortly to the Syrian port of Tartus, but didn't give a precise date.

Also on the agenda are plans to expand joint oil projects as well as initiatives to kickstart Venezuela’s domestic production, particularly in the areas of cement, iron, aluminum, and paper.

Dozens of US trucks transported pieces of batteries and other systems to the port of İskenderun for shipment to the US on Friday. While the US made the decision to withdraw its Patriot systems for mere technical reasons and due to the decreasing threats from Syria, imminent threats in northern Syria precipitated by Russian air strikes against rebel-held areas and the Russian violation of Turkish airspace twice over the weekend expose a troubling reality for Turkey. Having lacked a genuine air defense system, Turkey solely relies on NATO's cover against any missile threat in its vicinity and several times over the course of the past two decades, Ankara has appealed to the alliance to deploy Patriots on its soil, first against Saddam Hussein's Iraq and then Bashar al-Assad's Syria.

  • Army illegally supplied  intelligence on nonviolent antiwar protesters to FBI and police in multiple states Tacoma, WA – Recently obtained public records confirm an Army-led, multi-agency spy network that targeted “leftists/anarchists” as domestic terrorists. The Army used illegal infiltration to gather information on nonviolent antiwar protesters, disseminate it to the FBI and police departments in multiple states, and in some cases used it to disrupt planned protests by preemptively and falsely arresting activists. Public records obtained last month by Olympia activist Paul French reveal new evidence in the widely-watched Army spying case Panagacos v. Towery. An email from November 2007, in particular, shows that intelligence analyst John J. Towery was paid by the Army to infiltrate political groups and share unlawfully obtained intelligence with a growing network of law enforcement agencies, including the FBI, and police departments in Los Angeles, Portland, Eugene, Everett, and Spokane. The Towery email not only represents a broader spying program than previously thought, it also confirms the program was led by the Army, a fact contradicted by Towery’s 2009 sworn statements.
  • “The latest revelations show how the Army not only engaged in illegal spying on political dissidents, it led the charge and tried to expand the counterintelligence network targeting leftists and anarchists,” said Larry Hildes, a National Lawyers Guild attorney who filed the Panagacos lawsuit in 2010. “By targeting activists without probable cause, based on their ideology and the perceived political threat they represent, the Army clearly broke the law and must be held accountable.” Previously obtained public records indicate that absent such accountability, the Army will continue to spy on and target protesters, which it did until at least 2010, long after Towery’s identity was exposed. Public records previously obtained in 2009 already established that over a two-year period beginning in 2006, Towery (under the alias “John Jacob”) spied on the Olympia antiwar group Port Militarization Resistance (PMR) as well as several other organizations, including Students for a Democratic Society, the Industrial Workers of the World, and Iraq Veterans Against the War. It has also already been established that Towery’s intelligence was passed on to the Washington State Fusion Center, a communications hub of  local, state and federal law enforcement, and then used by local police to target activists for repeated harassment, preemptive and false arrest, excessive use of force, and malicious prosecution
  • The recently disclosed Towery email was a follow-up to a 2007 Domestic Terrorism Conference he attended in Spokane, during which “domestic terrorist” dossiers on some of the Panagacos plaintiffs were distributed. The Towery email shows the development of a multi-agency spying apparatus in intimate detail. “I thought it would be a good idea to develop a leftist/anarchist mini-group for intel sharing and distro,” wrote the Army analyst to several law enforcement officials. Towery references books, “zines and pamphlets,” and a “comprehensive web list” as source material, but cautions the officials on file sharing “because it might tip off groups that we are studying their techniques, tactics and procedures.” Towery, who worked at Joint Base Lewis-McChord, not only coordinated his actions with local, state and federal law enforcement agencies, many of whom are named defendants in the Panagacos case, he also admitted to eavesdropping on a confidential, privileged attorney-client email listserv of criminal defendants and their legal counsel. Such conduct is considered a constitutional violation, but Towery also took sensitive information from the listserv vital to a pending criminal trial in 2007 and passed it on to fusion center officials who then transmitted it to prosecutors, forcing a mistrial in a case the defense was winning handily.   • The public records disclosure comes as government spying and criticism of the National Security Agency’s surveillance program has reached a fever pitch. However, a little-known and rarely, if ever, enforced law from 1878 distinguishes the spying under Panagacos from that of the NSA. The Posse Comitatus Act prohibits the military from enforcing domestic laws on U.S. soil by making such actions a Gross Misdemeanor, yet to-date no official has been prosecuted under the Act. Instead of conceding to the violations, the Army is currently using the Panagacos case to try to seal nearly 10,000 pages of documents, many of which are incriminating and embarrassing to the government. The legal effort to unseal those documents will play out over the next few weeks. The Obama Administration tried to dismiss the Panagacos lawsuit, but in a Ninth Circuit decision from December 2012 the court rejected the government’s arguments, ruling that allegations of First and Fourth Amendment violations were “plausible,” and ordered the case to proceed to trial. The lawsuit was filed on behalf of seven PMR members who sought to oppose the wars in Iraq and Afghanistan through nonviolent civil disobedience and is being heard by U.S. District Court Judge Ronald B. Leighton. In addition to Towery, named defendants in Panagacos include Thomas Rudd, one of Towery’s superiors at Joint Base Lewis-McChord, the U.S. Army, Navy, and Coast Guard, as well as certain officials within its ranks, the City of Olympia and its police department, the City of Tacoma and its police department, Pierce County, and various personnel from those jurisdictions.

    One I had missed from February, 2014. I believe I had bookmarked something about this before the lawsuit was filed. Now not only has the case been filed but the alleged grounds for the lawsuit have been greenlighted by the 9th U.S. Circuit Court of Appeals. If you click through the link to the court's opinion, you'll find one of the Ninth Circuit's shorter opinions, less than five pages, which does not even mention that the defendants were employed by the U.S. Army or any branch of government, while still rejecting their claim of government officials' qualified immunity from suit for the alleged First and Fourth Amendment violations. The third amended complaint sufficiently alleged facts to support claims that had been clearly established as violative of the First and Fourth Amendments.   It's clear that the plaintiffs have smoking gun evidence and that the National Lawyers' Guild is all over this one. Trial is scheduled next month, according to the article. It's just under 300 miles from here to Seattle, but I just might make the trip to watch a few days of this trial. Strong First Amendment cases for damages that survive appellate review of the qualified immunity nearly always settle before trial. But this one smells like it is going to trial for publicity purposes even if not for the vindication of rights, considering the nature of the organizations involved both as targets of the surveillance and their lawyers. It's great entertainment watching government guys and gals squirm on the witness stand when they've been caught violating civil rights. In criminal cases, invoking the Fifth Amendment right against self-incrimination cannot be taken as evidence of guilt. But in a federal civil rights case, that entitles the plaintiffs to have the jury instructed that it can infer liability from the resort to the Fifth Amendment to refuse answering questions.  Better back in the day when I was the lawyer asking the questions. But it's still great fun just to watch

  • A court in Istanbul has issued arrest warrants against four Israeli military officials for their role in authorizing and carrying out the attacks on the Mavi Marmara, the Turkish humanitarian aid boat bound for Gaza on 31 May 2010. Israeli forces attacked and raided the boat, which was part of a flotilla in international waters and was attempting to break the siege on Gaza. Israeli commandos killed nine civilians and wounded dozens of others. Speaking to The Electronic Intifada, Rabia Yurt, a Turkish attorney for the families of the victims, says the ruling is unprecedented. Yurt says it is “the first [time] in history” that arrest warrants have been issued against Israeli officials, who have never been held responsible in an international court for the army’s “uncountable crimes.”
  • The judges presiding at the Istanbul Çağlayan Courthouse on 26 May ordered arrest warrants against former Israeli army Chief General Gabi Ashkenazi, Naval Forces commander Vice Admiral Eliezer Marom, Israeli military intelligence chief Major General Amos Yadlin and Air Forces Intelligence head Brigadier General Avishai Levi. It is now up to Interpol, the international police agency, to follow the Turkish court’s directives and arrest the four commanders, who were tried in absentia. This was the sixth trial so far in the case against the Israeli leaders for their role in the deadly attacks on the flotilla.
  • After the deadly raid on the Mavi Marmara, Israeli forces kidnapped the crew and hundreds of the flotilla’s passengers, bringing the boats and all aboard to an Israeli port, where the human rights activists were arrested, detained and deported. One of the civilians killed was Furkan Doğan, a 19-year-old dual citizen of Turkey and the US. The Center for Constitutional Rights stated that “Israeli commandos shot Furkan five times, including one shot to the head at point-blank range. At the time of the attack, it is believed Furkan was filming with a small video camera on the top deck of the Mavi Marmara.” A tenth activist, 51-year-old Turkish citizen Uğur Süleyman Söylemez, died on 23 May — days before the court’s decision, and nearly four years after Israeli forces shot him in the head. Söylemez was in a coma ever since his injury.

  • “The court argued that an arrest warrant had become necessary for the legal procedure as the defendants had neither attended the trial nor responded to an invitation sent to them through the related department of the Turkish justice ministry,” reported Turkish daily Hurriyet on 30 May. The Turkish humanitarian group IHH (Humanitarian Relief Foundation), which sponsored and helped organize the aid flotilla in 2010 and has been helping to represent the families of those killed, stated in a press release last week that the ruling was a “positive outcome” for the relatives and loved ones of the ten Turkish citizens who were killed by Israeli attacks. Last year, as The Electronic Intifada reported, the prosecutor of Spain’s national court formally requested a judge to begin steps to refer a case against Israeli leaders for the attack to the International Criminal Court (ICC). Three Spanish citizens, Manuel Tapial, Laura Arau and David Segarra, were aboard the Mavi Marmara when it was attacked and commandeered. Tapial, Arau and Segarra filed the case against Israeli Prime Minister Benjamin Netanyahu, six ministers and Vice Admiral Eliezer Marom of the Israeli navy who led the attack.
  • However, we are optimistic, because Turkey is a democratic country. It is part of and is a signatory to the European extradition convention and signed to Interpol, and therefore all other countries who are also signatories to these conventions and institution have an obligation to indeed arrest these Israeli officials for whom the arrest warrants were issued. So we have to trust [this] and we have to keep our faith in this. And we also know that — remember that this trial started way back in 2012 — the Israeli soldiers wouldn’t travel around too much, especially not go to Turkey. We know that Israeli soldiers were complaining about this. For instance, there was a case of an Israeli soldier who filed a claim against the State of Israel because he wanted to study in the United States, but because he took part in this operation he could not set foot out of Israel. So because we know this, we are quite optimistic about the arrest warrants, that they will be in fact implemented by other countries.
  • NBF: Finally, what’s next in this case on behalf of now ten victims of Israel’s raid, how are you pushing forward in this case? RY: In December, there is going to be another hearing, and we’re just going to make sure that the entire world will know about this arrest warrant, that we will follow whether any of these four defendants steps foot outside of Israel. We have lawyers in different countries also working together, and in South Africa, in the UK, many, many countries more — they will also closely follow whether these four defendants will travel in these countries. And then if this is the case, we will immediately take action and make sure that if the country in which one of the four defendants steps foot refuses, or neglects to fulfill its obligation to arrest [the defendant], then we will make sure that that country will not get away with it. And we will push for it, and publicize this as much as we can.

    A historic day indeed. Turkey is a member of both NATO and INTERPOL. Four high-ranking Israeli military officers will be on the INTERPOL arrest list soon, with a network of human rights lawyers around the world on the watch and ready to enforce INTERPOL arrest obligations. In other words, these officers' travel outside Israel will be very unlikely to include INTERPOL treaty nations and European extradition convention nations as either destinations or waypoints. The deterrent effect on Israeli government officials is considerable, particularly with another criminal prosecution pending in Spain. Fittingly, the Turkish court has aimed its message at high military officials who directed the assassinations rather than at the low-ranking soldiers who committed them. Message to high Israeli officials: be nice to Turkish citizens if you want to ever travel outside Israel.  One can only wish that the same message had been delivered about American citizens. The victim shot five times including a point blank shot to the head was an American citizen. Many of the kidnaped human rights people on the Navi Marmara and accompanying boats were Americans. One of the boats was American-flagged. Under international law, these actions were casus belli, a sufficient cause for military retaliation against the government of Israel. But the cowardly Obama and Secretary of State Hillary Clinton did not so much as lodge a diplomatic protest, so fearful they are of the powerful Israel Lobby.

  • What is more troubling is the greater geopolitical agenda driving both of these seemingly “internal” conflicts – and that they both lead back to a single source beyond China’s borders. With the so-called “Islamic State” (ISIS) now implicated in receiving, training, and employing terrorists from China’s Xinjiang province, and considering the fact that ISIS is the result of an intentional, engineered proxy war the US and its allies are waging in the Middle East, along with the fact that the unrest in Hong Kong is also traced back to Washington and London, presents a narrative of an ongoing confrontation between East and West being fought on the battlefield of fourth generation warfare.
  • If one was asked to name a global-spanning military and intelligence operation opposed to Syria, Iran, Russia, and China, they might say the US Central Intelligence Agency (CIA) and the US Government – and they would be right. But they could also easily answer by saying the “Islamic State” or ISIS/ISIL as it is also known. This is especially true after revelations surfaced that US-backed Uyghur separatists in China’s western-most province of Xinjiang have joined ISIS for training with intentions of leading an armed rebellion against Beijing upon their return. Reuters in their article, “China militants getting IS ‘training’,” would claim: Chinese militants from the western region of Xinjiang have fled from the country to get “terrorist training” from Islamic State group fighters for attacks at home, state media reported on Monday. The report was the first time state-run media had linked militants from Xinjiang, home to ethnic minority Uighur Muslims, to militants of the Islamic State group of radical Sunni Muslims.
  • However, it isn’t just China’s government that claims militants in Xinjiang seek to carve out an independent state in western China – the militants themselves have stated as much, and the United States government fully backs their agenda to do so. Indeed, first and foremost in backing the Xinjiang Uyghur separatists is the United States through the US State Department’s National Endowment for Democracy (NED). For China, the Western region referred to as “Xinjiang/East Turkistan” has its own webpage on NED’s site covering the various fronts funded by the US which include:

  • The next step Washington appears to be taking in China is an attempts to enhance the menace of terrorists in Xinjiang. In addition to assisting US attempts to destabilize territory in China, ISIS has also threatened to launch a campaign against another US enemy – Russia – this in addition to already directly fighting Hezbollah in Lebanon, the governments of Syria and Iraq, and with ISIS claiming to be behind attacks in Egypt against the military-led government that ousted the West’s Muslim Brotherhood proxies. With both Russia and China now in ISIS’ sights, the global public must begin asking questions as to how and why ISIS just so happens to be arraying itself against all of Washington’s enemies, by-passing all of its allies including Israel, Saudi Arabia, and Qatar, and where exactly they are getting the weapons, cash, intelligence, logistical, and administrative capabilities to do so. So suspicious is ISIS’ appearance, agenda, and actions, many across the world have long-ago concluded they are simply the latest creation of the US and other Western-aligned intelligence agencies, just as Al Qaeda and the Muslim Brotherhood was before them, So loud has this narrative become, establishment newspapers like the New York Times have begun writing columns to tamp down what they are calling “conspiracy theories.”
  • This containment strategy would be updated and detailed in the 2006 Strategic Studies Institute report “String of Pearls: Meeting the Challenge of China’s Rising Power across the Asian Littoral” where it outlines China’s efforts to secure its oil lifeline from the Middle East to its shores in the South China Sea as well as means by which the US can maintain American hegemony throughout the Indian and Pacific Ocean. The premise is that, should Western foreign policy fail to entice China into participating in the “international system” as responsible stakeholders, an increasingly confrontational posture must be taken to contain the rising nation. This includes funding, arming, and backing terrorists and proxy regimes from Africa, across the Middle East, Central Asia, Southeast Asia, and even within China’s territory itself. Documented support of these movements not only include Xinjiang separatists and the leaders of “Occupy Central” in Hong Kong, but also militants and separatists in Baluchistan, Pakistan where the West seeks to disrupt a newly christened Chinese port and pipeline, as well as the machete wielding supporters of Aung San Suu Kyi in Myanmar’s Rakhine state – yet another site the Chinese hope to establish a logistical hub.
  • It is not a coincidence that ISIS is standing in for and fulfilling America’s deepest imperial aspirations from North Africa, across the Middle East, and now inching toward the borders of the West’s two largest competitors, Russia and China. Nor is it a coincidence that “Occupy Central” protesters are parroting verbatim talking points scripted in Washington earlier this year. It is no coincidence that the US State Department’s NED is found involved in every hotspot of instability and conflict both within China’s borders and beyond them. It is a documented conspiracy that is now increasingly seeing the light truth cast upon it. Whether or not that is enough to end the unnecessary barbarism and bloodshed that has resulted from the West’s hegemonic aspirations remains to be seen.
