  • The law requires lobbyists for foreign interests to plainly and conspicuously identify themselves as such in any materials distributed in the course of their lobbying—for example, emails, other correspondence, or publications. We found that many documents filed with the Justice Department lack this identification statement; furthermore, many lobbyists admitted that they did not comply with this requirement. More than half (51 percent) of the registrants we examined in a sample from 2010 checked a box on a the semi-annual Justice Department questionnaire saying they had filed informational materials, and checked another box saying they had not met the legal requirement that they identify themselves in those materials as working on behalf of foreign interests. Toby Moffett, a former Member of Congress from Connecticut who is now Chairman of the Moffett Group and one of its registered lobbyists, told POGO that “Around the edges there’s a lot of loosey-goosey stuff going on. People representing foreign interests and not reporting.”[4] But even when lobbyists do report to the Justice Department, the information they provide is not easily accessible to the public. Astonishingly, informational materials are not available online, despite the fact that the Justice Department has an electronic filing system. Instead, these documents are kept in an office at the Justice Department that is only open for four hours each weekday. Hard copies of the documents are kept in folders that are often disorganized and susceptible to misfiling. This archaic system undermines the intended transparency of the law.
  • The Project On Government Oversight examined thousands of these materials spanning four years, as well as additional public records related to the Justice Department’s oversight of lobbyists for foreign interests. We found that lobbyists for foreign interests have routinely failed to comply with the law—a failure that prevents journalists and watchdogs from scrutinizing the lobbying activities while foreign interests are trying to influence U.S. policy. We found a pattern of lax enforcement of FARA requirements by the Justice Department. We found that the Justice Department office responsible for administering the law is a record-keeping mess. And we found loopholes in the law that often makes it difficult if not impossible for the government to police compliance or to discipline lobbyists who fail to comply. Here are some highlights of our investigation:
  • Though federal law bars foreign money from U.S. political campaigns, there appears to be a gray area in the law that can let in such money indirectly. POGO found many instances in which members of lobbying firms made political contributions to Members of Congress on the same day that those firms were lobbying the Members of Congress or their legislative staffs on behalf of foreign clients.[1] Lobbyists who fail to comply with certain FARA requirements may have little to fear from the Justice Department. “The cornerstone of the Registration Unit’s enforcement efforts is encouraging voluntary compliance,” a Justice Department website says.[2] When lobbyists do not voluntarily comply, the Justice Department rarely uses one of the key tools at its disposal to enforce the law—seeking a court injunction. A representative of the Department’s FARA unit told POGO: “While the FARA statute and regulations authorize the pursuit of formal legal proceedings, such as injunctive remedy options, the FARA Unit [has] not pursued injunctive remedy options recently and has instead utilized other mechanisms to achieve compliance.”[3] It appears that some registered foreign agents have been distributing materials but not filing them with the Justice Department. It’s unclear the extent to which that illustrates a lack of compliance with the law or loopholes in the law. In the process of researching this report, POGO noticed that many more lobbyists were registering as foreign agents than had filed informational materials that we could locate at the FARA office. To determine what was happening, we looked at a sampling of questionnaires that the Justice Department requires registered agents to complete every six months. Some checked one box indicating they had distributed materials and another box stating they did not file them with the FARA office.
  • We set out to determine the extent to which lobbyists for foreign interests were filing lobbying materials at the Justice Department within the required time frame. Based on a review of filings made in 2012, in those instances where it was possible to answer the question, POGO estimates that almost half—46 percent—were filed late. Fifteen percent were filed more than 30 business days after they were distributed, and 12 percent were filed more than 100 business days after they were distributed. In many instances, the Justice Department would be hard pressed to enforce the filing deadline. Based on the records the Department maintains to enforce the law, we found that in more than a quarter (26 percent) of the 2012 filings, it was impossible to determine whether the lobbyists complied. For example, in many cases, the records did not show when the lobbyists disseminated the materials to the targets of their lobbying. In a glaring omission, the law does not require lobbyists to provide that information. Without it, there may be no way for the government or the public to know whether lobbying materials were filed on time.
  • When lobbyists for foreign interests do not follow the law, when the U.S. government fails to enforce it, and when the Justice Department makes it difficult for the American people to access records to which they are legally entitled, the public is left in the dark. To bring more transparency to this opaque realm, POGO has made four years of informational materials available for the first time online with our Foreign Influence Database, allowing the public to see how lobbyists attempt to influence American policies on behalf of their foreign clients.

The materials were previously only available in hard copy at the FARA Registration Unit in Washington, DC, which is only open to the public from 11am to 3pm on weekdays.[12] In this digital age it is surprising that these materials could not be read online and are instead stored in file folders, where they are disorganized and susceptible to misfiling. Even those that were electronically filed by the registrants are not available to the public in an electronic format. POGO’s database includes informational materials filed in 2009, 2010, 2011, and 2012.[13]

    POGO does thorough work and doesn't let up until it gets results. Forcing DoJ to puts its foreign agents registration materials online should be a fairly trivial battle. The real war, though, will be forcing better enforcement. The new database is at http://www.pogo.org/tools-and-data/foreign-influence-database/ I punched up the word "Israel" and came up with 113 documents in the search results. Each search hit lists the name of the nation involved that the lobbying was done for. Of those 113 document hits, only two were for the nation of Israel, both for its Ministry of Tourism. The rest were by other nations who had mentioned Israel in their lobbying materials.  Now that is fairly incredible, given that Israel outright controls Congress when it comes to Middle East policy.  The last administration to attempt to do something about Israeli lobbyists not registering was the the Kennedy Administration. The result was that the major Israeli lobbying group disbanded and was promptly reformed under a new corporate charter and name. That was the very last attempt at enforcing the Foreign Agents Registration Act against Israel's lobbyists in the U.S., despite the fact that the reformed group, AIPAC, has even been caught more than once being passed highly classified U.S. documents by double agents working inside the U.S. military establishment. This may not come as such a great surprise, however, as Google's Executive Chairman, Eric Schmidt, helped organize and run Obama's re-election e-team. Schmidt "helped recruit talent, choose technology, and coach the campaign manager, Jim Messina, on the finer points of leading a large organization," Bloomberg reports. Since he came onto the national political scene, Barack Obama has campaigned like a veritable David vs Goliath with evil corporations standing in for Goliath while Obama presents himself as David loading his sling shot to do battle. But the reality is not quite that cut and dried and Google has been a big recipient of Obama's largesse. The Washington Examiner's Tim Carney points out that the administration is filled with Googleites and that President Obama and Google have a long standing love affair. Remember Obama's No. 2 tech staffer at the White House was Google's former top lobbyist-who improperly worked with active Google lobbyists on pushing polic.... Obama appointed non-registered Google lobbyist and max-Obama donor Vint Cerf to a science advisory board. Then there was the time when Google chief Schmidt is reported to have told a Google staffer to make sure that the search engine did not connect his entries to his own political donations so that it was a bit harder to find out to whom he donated campaign cash."

Military Industry Lobbyists Manufacture Fake Tea Party Outrage Against Cutting Defense ... - 0 views

  • Military industry lobbyists are using the Tea Party as props to fight back against defense cuts. Companies that benefit from tens of billions of taxpayer dollars, many of which are for unnecessary and wasteful programs, are attempting to co-opt political support as they desperately try to maintain their pork barrel contracts. Take, for example, the “Coalition for the Common Defense,” an ad hoc project launched last fall to develop “grass-roots lobbying” to prevent “automatic budget cuts known as sequestration that will slash defense spending by as much as $600 billion over 10 years,” according to Roll Call.
  • Republic Report took a look at who’s behind the campaign, and unsurprisingly, K Street lobbyists with weapons-maker clients and military industry companies are playing a pivotal role: – Cord Sterling is the vice president for legislative affairs at the Aerospace Industry Association, a lobbying group that represents Boeing, Northrop Grumman, Honeywell, L-3 Communications, and other defense industry corporations. He has participated in events for the Coalition for the Common Defense, thanking the group for helping stave off the looming defense cuts. The Aerospace Industry Association spent $2,181,383 lobbying the federal government last year. – The campaign is managed by the Center for Security Policy, a think tank that is governed by a board of directors with deep ties to the defense industry. Board member Lt. Col. Marlin L. Hefti (Ret.) is a vice president at Van Scoyoc Associates, a lobbying firm that represents over two dozen defense company clients, including Lockheed Martin and Humvee manufacturer, the Renco Group. Board members J.P. London and Bruce J. Brotman are executives with other defense companies.

Eric Cantor's Opponent Beat Him By Calling Out GOP Corruption | - 0 views

  • “All of the investment banks, up in New York and D.C., they should have gone to jail.” That isn’t a quote from an Occupy Wall Street protester or Senator Elizabeth Warren. That’s a common campaign slogan repeated by Dave Brat, the Virginia college professor who scored one of the biggest political upsets in over a century by defeating Majority Leader Eric Cantor in the Republican primary last night. The national media is buzzing about Brat’s victory, but for all of the wrong reasons.
  • Did the Tea Party swoop in and help Brat, as many in the Democratic Party are suggesting? Actually, the Wall Street Journal reports no major Tea Party or anti-establishment GOP group spent funds to defeat Cantor. Did Cantor, the only Jewish Republican in Congress, lose because of his religion, as some have suggested? There’s no evidence so far of anti-Semitism during the campaign. Was Cantor caught flatfooted? Nope; Cantor’s campaign spent close to $1 million on the race and several outside advocacy groups, including the National Rifle Association, the National Realtors Association and the American Chemistry Council (a chemical industry lobbying association) came in and poured money into the district to defeat Brat. The New York Times claims that Brat focused his campaign primarily on immigration reform. Brat certainly made immigration a visible topic in his race, but Republic Report listened to several hours of Brat stump speeches and radio appearances, and that issue came up far less than what Brat called the main problem in government: corruption and cronyism. Brat told Internet radio host Flint Engelman that the “number one plank” in his campaign is “free markets.” Brat went on to explain, “Eric Cantor and the Republican leadership do not know what a free market is at all, and the clearest evidence of that is the financial crisis … When I say free markets, I mean no favoritism to K Street lobbyists.” Banks like Goldman Sachs were not fined for their role in the financial crisis — rather, they were rewarded with bailouts, Brat has said.

The STOCK Act, a bill to crack down on insider trading, was significantly watered down by Cantor in early 2012. The lawmaker took out provisions that would have forced Wall Street “political intelligence” firms to register as traditional lobbyists would, and removed a section of the bill to empower prosecutors to go after public officials who illegally trade on insider knowledge. And Brat may be right to charge that Cantor’s moves on the STOCK Act were motivated by self interest. Cantor played a leading role in blocking legislation to fix the foreclosure crisis while his wife and his stock portfolio were deeply invested in mortgage banks.

  • Most self-described Tea Party Republicans, including Rand Paul and Ted Cruz, have railed against Washington in a general sense without calling out the powerful – often Republican-leaning — groups that wield the most power. Not Brat. “Eric is running on Chamber of Commerce and Business Roundtable principles,” Brat told a town hall audience, later clarifying that he meant the U.S. Chamber of Commerce, the largest lobbying trade group in the country. He also called out the American Chemistry Council for funding ads in his race with Cantor, telling a radio host that his opponent had asked his “crony capitalist friends to run more ads.” Brat repeats his mantra: “I’m not against business. I’m against big business in bed with big government.” Indeed, Cantor has been a close ally to top lobbyists and the financial industry. “Many lobbyists on K Street whose clients include major financial institutions consider Cantor a go to member in leadership on policy debates, including overhauling the mortgage finance market, extending the government backstop for terrorism insurance, how Wall Street should be taxed and flood insurance,” noted Politico following Cantor’s loss last night. In 2011, Cantor was caught on video promising a group of commodity speculators that he would roll back regulations on their industry. 
  • There are many lessons to be learned from the Cantor-Brat race. For one, it’s worth reflecting on the fact that not only did Cantor easily out raise and outspend Brat by over $5 million to around $200,000 in campaign funds, but burned through a significant amount on lavish travel and entertainment instead of election advocacy. Federal Election Commission records show Cantor’s PAC spent at least $168,637 on steakhouses, $116,668 on luxury hotels (including a $17,903 charge to the Beverly Hills Hotel & Bungalows) and nearly a quarter million on airfare (with about $140,000 in chartered flights) — just in the last year and a half! But on the policy issues and political ramifications of this race, it’s not easy to box Brat into a neat caricature of an anti-immigration zealot or Tea Party demagogue, or, in TIME’s hasty reporting, a “shopworn conservative boilerplate.” If Brat ascends to Congress, which is quite likely given the Republican-leaning district that he’ll run in as the GOP nominee, he may actually continue taking on powerful elites in Washington.

    The Cantor defeat was not a Tea Party upset victory as claimed by MSM, according to this article. Instead, Brat's stump speeches were about crony capitalism, bankster corruption of Congress, and libertarian principles. So if this article is correct, then MSM would rather claim that Cantor was a victim of the Tea Party than acknowledge the issues that Brat actually raised, Congressional corruption and big government/big corporation cronyism.  Very interesting food for thought.

Members of the establishment don’t like rocking the boat, because they have worked so hard to ensure that they are always the ones riding high and dry. “The establishment” is neither Democratic nor Republican, nor is it “liberal” or “conservative.” It’s not even “the rich” versus “the poor.” It is simply the cancer that can consume great nations when government gets too big, too involved, and too powerful.

  • The real alternative to the tyranny of the D.C. establishment has always been more liberty, not a better, more benevolent despot. America’s genius comes from each of us, working together in voluntary cooperation to solve problems, from the bottom, up. We need a leader who gets it. Community banks are rapidly disappearing — except in North Dakota, where they are thriving.  At over 2,300 pages, the Dodd Frank Act is the longest and most complicated bill ever passed by the US legislature. It was supposed to end “too big to fail” and “bailouts,” and to “promote financial stability.” But Dodd-Frank’s “orderly liquidation authority” has replaced bailouts with bail-ins, meaning that in the event of insolvency, big banks are to recapitalize themselves with the savings of their creditors and depositors. The banks deemed too big are more than 30% bigger than before the Act was passed in 2010, and 80% bigger than before the banking crisis of 2008. The six largest US financial institutions now have assets of some $10 trillion, amounting to almost 60% of GDP; and they control nearly 50% of all bank deposits.
  • Meanwhile, their smaller competitors are struggling to survive. Community banks and credit unions are disappearing at the rate of one a day. Access to local banking services is disappearing along with them. Small and medium-size businesses – the ones that hire two-thirds of new employees – are having trouble getting loans; students are struggling with sky-high interest rates; homeowners have been replaced by hedge funds acting as absentee landlords; and bank fees are up, increasing the rolls of the unbanked and underbanked, and driving them into the predatory arms of payday lenders. Even some well-heeled clients are being rejected. In an October 19, 2015 article titled  “Big Banks to America’s Firms: We Don’t Want Your Cash,” the Wall Street Journal reported that some Wall Street banks are now telling big depositors to take their money elsewhere or be charged a deposit fee. Municipal governments are also being rejected as customers. Bank of America just announced that it no longer wants the business of some smaller cities, which have been given 90 days to find somewhere else to put their money. Hundreds of local BofA branches are also disappearing.

  • Obviously, making the big banks bigger also serves the interests of the megabanks, whose lobbyists are well known to have their fingerprints all over the legislation. How they have been able to manipulate the rules was seen last December, when legislation drafted by Citigroup and slipped into the Omnibus Spending Bill loosened the Dodd-Frank regulations on derivatives. As noted in a Mother Jones article before the legislation was passed: The Citi-drafted legislation will benefit five of the largest banks in the country—Citigroup, JPMorgan Chase, Goldman Sachs, Bank of America, and Wells Fargo. These financial institutions control more than 90 percent of the $700 trillion derivatives market. If this measure becomes law, these banks will be able to use FDIC-insured money to bet on nearly anything they want. And if there’s another economic downturn, they can count on a taxpayer bailout of their derivatives trading business.
  • Regulation is clearly inadequate to keep these banks honest and ensure that they serve the public interest. The world’s largest private banks have been caught in criminal acts that former bank fraud investigator Prof. William K. Black calls the greatest frauds in history. The litany of frauds involves more than a dozen felonies, including bid-rigging on municipal bond debt; colluding to rig interest rates on hundreds of trillions of dollars in mortgages, derivatives and other contracts; exposing investors to excessive risk; and engaging in multiple forms of mortgage fraud. According to US Attorney General Eric Holder, the guilty have gone unpunished because they are “too big to prosecute.” If they are too big to prosecute, they are too big to regulate.

The GOP's source — a former FBI informant and lobbyist for the U.S.-based unit of Rosatom, a Russian-owned nuclear power company — will appear before the upper chamber as part of the probe into the so-called Uranium One deal. Although the Senate committee did not reveal the witness' name, former lobbyist William D. Campbell identified himself to Reuters. "I have worked with the Justice Department undercover for several years, and documentation relating to Uranium One and political influence does exist and I have it," Campbell said. Campbell was once a "star witness" in an FBI case against a Rosatom, until his credibility and motivations as an informant were called into question by defense attorneys. President Trump has repeatedly claimed that Uranium One's sale was approved by Clinton's State Department in exchange for donations to the Clinton Foundation, and deal skeptics point to the fact that the Clinton Foundation received $145 million in donations from owners of Uranium One. In a statement to Reuters, Rosatom noted that the State Department is only one of nine government agencies that had to approve the sale.

Why not apply the same standard to Congress?  * Members of Congress should not be allowed to trade stock in companies that are overseen by their committees. * Apply whistleblower laws to Congress. If it's good enough for federal workers and corporate employees, it should be good enough for Congress.  * Disallow "sweetheart" IPOs. Unless the initial public offering goes through a public auction, in which people can openly compete for shares in a bidding contest, members of Congress should not be allowed to participate. * Family members of legislators should not be allowed to become lobbyists. * The federal government needs to get out of the business of offering grants and taxpayer-backed loans.  Americans who have suspected that Washington does not have their interests at heart and wonder on their trips to the nation's capital how it is such a gilded boomtown will get answers in this book.  The country is at the beginning stages of a citizen revolt against the permanent political class whose interests are tied to the crony capitalistic system that benefits their own self-interest.

As our Michael Rubin noted at the time, Baker’s long record of hostility to Israel and consistent backing for engagement with rogue regimes ought to make him radioactive for a candidate seeking to brand himself as a supporter of the Jewish state and a critic of the Obama administration’s foreign policy. But Baker’s status as a faithful family retainer for the Bush family might have given Jeb a pass, especially since, as Michael wrote, another far wiser former secretary of state — George P. Schultz — is considered to be Jeb’s top foreign policy advisor. But the news that Baker will serve as a keynote speaker at the upcoming annual conference of the left-wing J Street lobby ought to change the conversation about this topic. Coming as it does hard on the heels of the president’s open threats to isolate Israel, having someone so closely associated with his campaign serve in that role at an event dedicated to support for Obama’s hostile attitude toward Israel obligates Jeb to not let this happen without saying or doing something to disassociate himself from Baker.

But while screaming that only AIPAC represents Israel's real interests and acknowledging that Baker is closely tied to the Bush family, they're not addressing the political reality that Baker is the global oil industry's top lobbyist nor the fact that it was Baker who put the kibosh on the neocons' goal of privatizing all the oil in Iraq and flooding the market with cheap oil to break the OPEC Cartel. The western oil companies are profoundly against privately owned oil in the Mideast and even less enthused about breaking the OPEC Cartel, which normally keep crude oil prices high, enabling higher oil company profits. Apparently the oil industry also wants the 2-state solution to actually happen in order to obtain a more stable Middle East. And that is anathema to Netanyahu, AIPAC, and the neocons..
