Trump's Immigration Order Expands the Definition of 'Criminal' - The New York Times - 1 views

  • After President Trump signed two sweeping executive orders on immigration on Wednesday, most of the attention was on his plans to build a wall along the border with Mexico and to hold back money from “sanctuary cities.” But the most immediate effect may come from language about deportation priorities that is tucked into the border wall order. It offers an expansive definition of who is considered a criminal — a category of people Mr. Trump has said he would target for deportation. Immigration agents will now have wider latitude to enforce federal laws and are being encouraged to deport broad swaths of unauthorized immigrants.
  • Each presidential administration must decide who it considers a priority for deportation. Mr. Trump’s order focuses on anyone who has been charged with a criminal offense, even if it has not led to a conviction. He also includes, according to language in the order, anyone who has “committed acts that constitute a chargeable criminal offense,” meaning anyone the authorities believe has broken any type of law — regardless of whether that person has been charged with a crime.Mr. Trump’s order also includes anyone who has engaged in “fraud or willful misrepresentation in connection with any official matter or application before a governmental agency,” a category that includes anyone who has used a false Social Security number to obtain a job, as many unauthorized immigrants do. Anyone who has received a final order to leave the country, but has not left, is also considered a priority.Finally, he allows the targeting of anyone who “in the judgment of an immigration officer” poses a risk to either public safety or national security. That gives immigration officers the broad authority they have been pressing for, and no longer requires them to receive a review from a supervisor before targeting individuals.

  • More than six months after the US government finally dropped all charges against Dr. Sami Al-Arian, the stateless Palestinian academic and activist was deported yesterday to Turkey. During his appearance on Democracy Now! today, Dr. Al-Arian expressed relief that his twelve-year-long persecution in the US, where he lived for forty years, had finally come to an end. “It feels like I’m free, finally really feeling freedom for the first time in twelve years,” Dr. Al-Arian said.
  • During the half-hour segment, Dr. Al-Arian revealed how he campaigned for George W. Bush, helping him win crucial votes from the Muslim community that would clinch his 2000 presidential election victory in the decisive state of Florida. Dr. Al-Arian was very active politically, and had visited the White House several times during both the Bush and Clinton administrations. Regarding his role in Bush’s election, Dr. Al-Arian said that he received a call “from someone who was very close to [Bush advisor] Karl Rove” asking how the campaign could win the endorsement of the Muslim American community. Dr. Al-Arian told this contact that Bush needed to declare his support for proposed legislation against secret evidence being used against Arab and Muslim Americans. During the second presidential candidate debate, Dr. Al-Arian told Democracy Now!, Bush did just that, securing the support of Muslim and Arab American leaders.

  • After he was fired from the University of South Florida following two years of administrative leave and a lengthy smear campaign that began with “vicious” attacks on him by right-wing Fox News pundit Bill O’Reilly, Dr. Al-Arian found himself a target of the newly passed Patriot Act. In February 2003, as Democracy Now! host Amy Goodman explained today, “The Justice Department handed down a sweeping fifty count indictment against him and seven other men, charging them with conspiracy to commit murder, giving material support to terrorists, extortion, perjury and other offenses. He was held in solitary confinement leading up to the trial.” That trial ended in 2005 with the jury failing to return a single guilty verdict, acquitting Dr. Al-Arian of eight of the seventeen counts he was tried on. But the government’s efforts did not end there, as the prosecution threatened a retrial of the nine charges on which the jury had deadlocked. Dr. Al-Arian chose to spare himself a second trial.
  • “In the hopes of escaping an indefinite legal battle that would keep him in jail, Al-Arian opted to plead guilty for one of the less serious charges, which accused him of sending money to a Palestinian charity before the US government made it illegal to do so,” Khadijah Qamar and Hamdan Azhar recounted for The Electronic Intifada last year. “The judge gave him a 57-month sentence, most of which he had already served, with the promise of deportation by April 2007,” Qamar and Azhar added.

How did a man who was never convicted by a jury of his peers end up serving five years in prison and four and a half years under house arrest? Several lawyers we consulted point to the unique nature of the case, perhaps unprecedented even in the annals of bizarre government judicial practices since 11 September 2001.

Humanitarians were sentenced to decades in prison in the Holy Land Five case as material support for terror convictions became the domestic front of the endless US wars and occupations abroad. The era of political repression is not over, as shown by the recent moves to criminalize Palestine solidarity work, including at US campuses, and the recent conviction of Palestinian American community leader Rasmea Odeh. “I’ve heard a lot from Obama, but it’s all rhetoric … after six years, I haven’t really seen much change,” Dr. Al-Arian said from Turkey today. But he expressed happiness towards protests and whistleblowing regarding “the excesses of the surveillance and police state.”

Salvadoran General Deemed Deportable In the Absence of Criminal Charges | Just Security - 0 views

  • The Board of Immigration Appeals (BIA) ruled last week that General Carlos Eugenio Vides-Casanova could be removed to El Salvador on account of his participation in human rights abuses in the 1980s when he was head of the National Guard (1979–1983) and then Minister of Defense (1983–1989). (The judgment is here.) In so ruling, the BIA affirmed a February 2012 opinion by an Immigration Judge, which — apparently for privacy reasons — was not released by the Justice Department until April 2013 after The New York Times filed a request under the Freedom of Information Act. Vides-Casanova has been found deportable under the Intelligence Reform and Terrorism Prevention Act, 8 U.S.C. § 1127(a)(4)(D) (passed in 2004 but rendered retroactive), which is intended to bar individuals who participated in genocide, Nazi persecution, torture, or summary execution from enjoying safe haven in the United States.
  • The Vides-Casanova decision reiterated D-R-’s determination that: inadmissibility under … the Act is established where it is shown that an alien with command responsibility knew or should have known that his subordinates committed unlawful acts covered by the statute and failed to prove that he took reasonable measures to prevent or stop such acts or investigate in a genuine effort to punish the perpetrators. The BIA’s opinion constitutes precedent and is binding upon all Immigration Judges. In reaching these results, both sets of adjudicators rejected Vides-Casanova’s claims that:  the human rights violations were the result of “rogue units” acting autonomously and his conduct was “consistent with the ‘official policy’ of the United States” such that it would be unfair under principles of equitable estoppel to remove him.

    Consistent with the "offficial policy" of the U.S. isn't a defense, but the troubling part is that it's true. Vides-Casnova was a participant in a U.S. program that coodinated the intelligence gathering and distribution in a secure U.S. government communications network housed in Panama under cover of the notorious School of Americas. It was a regional coordinated effort based on ideology to identify, torture, terrorize, round up, and disappear anyone suspected of leaning to the political left. Welcome to the world of Operation Condor. Tens of thousands of Latin Americans were tortured and killed. CIA also coordinated the overthrow of many Latin American nations and their replacement by military juntas.  A lot of information about Operation Condor was released in the late 90s by CIA and the State Dept.     "However, now we - at least those of us who pay attention - know, thanks to Glenn Beck, the Saudi person of interest is not just some innocent bystander after all. Just hours after the April 15 bombing, Abdul Rahman Ali Alharbi was put on a terror watch list and had an event file created that indicated he was armed and dangerous; and actions began that would lead to his deportation. Alharbi, who is related to a number of terrorists now residing in Gitmo and/or listed as part of al-Qaida, was admitted to the United States under a "special advisory opinion," indicating someone pulled some strings for him. His strings go a long way - all the way to the White House, where Alharbi was a frequent visitor (seven times since 2009). His file contained one prior event, indicating he was already in the terrorism watch list system. Yet even though he's marked as a terrorist, he was allowed in. Perhaps that explains Michelle Obama's hospital visit. Alharbi and the Obamas are friends. After news of his possible deportation leaked, government officials backtracked. Homeland Security Secretary Janet Napolitano refused to answer questions from a Congressman about Alharbi. An Immigration and Customs Enforcement official told Beck a different Saudi was in custody but not connected to the bombing. Someone altered Alharbi's file on April 17 in a way that disassociated him from the bombing, according to Beck, but an original had been printed out and saved. The change happened around the time that first Secretary of State John Kerry and then President Barack Obama met with the Saudi foreign minister - a meeting that wasn't on Obama's schedule. There are photographs on the Internet that purport to show Alharbi with two other Saudis near the bomb site. If the government will lie about who Alharbi is and whether his is a suspect, what else about the official narrative is a lie? ICE has struck a deal to track license plates across the US - The Verge - 0 views

  • The Immigration and Customs Enforcement (ICE) agency has officially gained agency-wide access to a nationwide license plate recognition database, according to a contract finalized earlier this month. The system gives the agency access to billions of license plate records and new powers of real-time location tracking, raising significant concerns from civil libertarians. The source of the data is not named in the contract, but an ICE representative said the data came from Vigilant Solutions, the leading network for license plate recognition data. “Like most other law enforcement agencies, ICE uses information obtained from license plate readers as one tool in support of its investigations,” spokesperson Dani Bennett said in a statement. “ICE is not seeking to build a license plate reader database, and will not collect nor contribute any data to a national public or private database through this contract.”
  • While it collects few photos itself, Vigilant Solutions has amassed a database of more than 2 billion license plate photos by ingesting data from partners like vehicle repossession agencies and other private groups. Vigilant also partners with local law enforcement agencies, often collecting even more data from camera-equipped police cars. The result is a massive vehicle-tracking network generating as many as 100 million sightings per month, each tagged with a date, time, and GPS coordinates of the sighting.
  • ICE agents would be able to query that database in two ways. A historical search would turn up every place a given license plate has been spotted in the last five years, a detailed record of the target’s movements. That data could be used to find a given subject’s residence or even identify associates if a given car is regularly spotted in a specific parking lot. “Knowing the previous locations of a vehicle can help determine the whereabouts of subjects of criminal investigations or priority aliens to facilitate their interdiction and removal,” an official privacy assessment explains. “In some cases, when other leads have gone cold, the availability of commercial LPR data may be the only viable way to find a subject.” ICE agents can also receive instantaneous email alerts whenever a new record of a particular plate is found — a system known internally as a “hot list.” (The same alerts can also be funneled to the Vigilant’s iOS app.) According to the privacy assessment, as many as 2,500 license plates could be uploaded to the hot list in a single batch, although the assessment does not detail how often new batches can be added. With sightings flooding in from police dashcams and stationary readers on bridges and toll booths, it would be hard for anyone on the list to stay unnoticed for long. Those powers are particularly troubling given ICE’s recent move to expand deportations beyond criminal offenders, fueling concerns of politically motivated enforcement. In California, state officials have braced for rumored deportation sweeps targeted at sanctuary cities. In New York, community leaders say they’ve been specifically targeted for deportation as a result of their activism. With automated license plate recognition, that targeting would only grow more powerful. For civil liberties groups, the implications go far beyond immigration.

  • The new license plate reader contract comes after years of internal lobbying by the agency. ICE first tested Vigilant’s system in 2012, gauging how effective it was at locating undocumented immigrants. Two years later, the agency issued an open solicitation for the technology, sparking an outcry from civil liberties group. Homeland Security secretary Jeh Johnson canceled the solicitation shortly afterward, citing privacy concerns, although two field offices subsequently formed rogue contracts with Vigilant in apparent violation of Johnson’s policy. In 2015, Homeland Security issued another call for bids, although an ICE representative said no contract resulted from that solicitation. As a result, this new contract is the first agency-wide contract ICE has completed with the company, a fact that is reflected in accompanying documents. On December 27th, 2017, Homeland Security issued an updated privacy assessment of license plate reader technology, a move it explained was necessary because “ICE has now entered into a contract with a vendor.” The new system places some limits on ICE surveillance, but not enough to quiet privacy concerns. Unlike many agencies, ICE won’t upload new data to Vigilant’s system but simply scan through the data that’s already there. In practical terms, that means driving past a Vigilant-linked camera might flag a car to ICE, but driving past an ICE camera won’t flag a car to everyone else using the system. License plates on the hot list will also expire after one year, and the system retains extensive audit logs to help supervisors trace back any abuse of the system. Still, the biggest concern for critics is the sheer scale of Vigilant’s network, assembled almost entirely outside of public accountability. “If ICE were to propose a system that would do what Vigilant does, there would be a huge privacy uproar and I don’t think Congress would approve it,” Stanley says. “But because it’s a private contract, they can sidestep that process.”

    "The American Left's desire to crush Liberty and dissent in order to "fundamentally transform the United States of America" has reached metastatic levels. In the last three weeks alone, the following stories have surfaced. All of which indicate we are well on our way toward relinquishing our birthright. Even worse, millions of Americans are apparently more than willing to do so. First, this week the Supreme Court heard arguments in the United States v. Texas case that will determine whether a president can unilaterally rewrite immigration law. If SCOTUS rules in Barack Obama's favor, the separation of powers outlined in the first three articles of the Constitution will be rendered moot and, as political analyst Charles Krauthammer wryly observed, "you can send Congress home." And the Left is not content to stop there. A coalition of 118 cities and counties have filed a legal brief asserting they will lose up to $800 million in economic benefits if large numbers of illegal aliens remain subject to deportation. Second, the IRS has admitted it abides the use of fraudulent Social Security numbers used by illegal aliens to process tax payments - and refunds. Third, in New York and California, Democratic attorneys general Eric Schneiderman and Kamala Harris are pursuing fraud investigations against Exxon, based on the premise they can "prosecute persons and institutions with nonconforming views on global warming," writes National Review's Kevin Williams. "Prosecuting political institutions and businesses for political activism is brown-shirt business." Fourth, the Obama administration, already under fire for its determination to flood America with Syrian "refugees," announced it will reduce its vetting process to three months, instead of 18-24 months.     I'll leave well enough alone on Mr. Ahert's positions regarding the U.S. v. Texas case and IRS reliance on fraudulent Social Security numbers; I have not studied those issues. But Mr. Ahert has not done his homework on the Exxon investigations and on the law governing the Syrian refugee situation. Re Exxon, the criminal investigations are to determine whether Exxon committed fraud against *investors* by concealing its knowledge of climate change the company was contributing to --- and knew of decades ago. We don't yet know the outcome of those investigations, but this is a far cry from prosecuting "persons and institutions with nonconforming views on global warming." If pursued, it will be a prosecution of a company -- and conceivably its managers -- who damned well knew through in-house scientific studies it sponsored that global warming was man-made and that their own company was a major causative agent. On the Syrian refugee situation, the right of war refugees to refuge in the U.S. and all other nations is, under the U.S. Constitution's Treaty Clause, "the law of this land." There is nothing in that body of international law created by treaty that permits the U.S. or any other nation to delay providing refuge for purposes of vetting refugees for possible terrorists among them. Vetting can, however, proceed lawfully after refugees are admitted while being held in refugee camps. One need only ask how one would feel were the tables turned and it was yourself fleeing from U.S. violence? Turkish-Uyghur Terror Inc. - America's Other Al Qaeda | nsnbc international - 0 views

  • Because it relatively poorly understood and under-reported in comparison to other more notorious terrorist groups, the Turkish-Uyghur terror network is perhaps more dangerous and of greater utility to the United States and its allies presently versus their increasingly exposed Al Qaeda legions. The genesis of modern Turkish-sponsored terrorism, like Al Qaeda, also originates from the Cold War. Part of the wider stay-behind networks known as “Gladios” created by NATO to allegedly fight Soviet forces in the event of a Soviet invasion and occupation of Western Europe, these terrorist groups were instead turned against the population of NATO member states and engaged in violence, terrorism, mass murder, and assassinations. A group of ultra-nationalists known as the “Grey Wolves” would be cultivated for this task within Turkey. In a 1998 LA Times article titled, “Turkish Dirty War Revealed, but Papal Shooting Still Obscured,” it would be reported that (emphasis added):

The party’s coffers swelled with secret contributions from the government.  By the late 1970s, the Gray Wolves had spun out of state control. Their paramilitary wing fought a campaign against leftist rivals that killed nearly 6,000 people. Ali Agca, who shot Pope John Paul II in a 1981 assassination attempt, is alleged to have been affiliated with the party.
  • The article would also reveal that despite this horrific past, the Grey Wolves and their political allies were still a very potent political force in Turkey. Today, the Grey Wolves function as a paramilitary wing of the Nationalist Movement Party (MHP), which holds the third largest number of seats in Turkey’s parliament. As troubling as this should be to Turks who may find themselves on the receiving end of a politically powerful terrorist organization apparently tolerated, even sponsored by NATO for decades and in particular, supported by the United States, the Grey Wolves’ terrorism has branched out far beyond Turkey’s borders.   • Looking at a map of China it is clear that this campaign of separatism directly serves the long-standing plans of the United States to encircle and contain China’s rise – a campaign that has been openly and repeated outlined in US policy papers for decades – the most recent of which was published by the Council on Foreign Relations (CFR) and was titled, “Revising U.S. Grand Strategy Toward China.” It states in no uncertain terms: Because the American effort to ‘integrate’ China into the liberal international order has now generated new threats to U.S. primacy in Asia—and could result in a consequential challenge to American power globally—Washington needs a new grand strategy toward China that centers on balancing the rise of Chinese power rather than continuing to assist its ascendancy. Encouraging separatism in China’s western Xinjiang region, if successful, would carve off a substantial amount of territory. In conjunction with US-backed separatism in China’s Tibet region, an immense buffer region stands to be created that would virtually isolate China from Central Asia. And while the Grey Wolves and their Uyghur proxies are working hard to create this barrier to China’s west, with their involvement in a recent bombing in Bangkok, it appears the US is now using them to augment efforts to create a similar encirclement across Southeast Asia.

A month later, a devastating bomb would detonate in the heart of Bangkok, killing 20 mostly Chinese tourists and injuring over 100 more. In addition to the BBC already being on site before the blast, the British network would conclude even before bodies were cleared from the site that Uyghurs were likely behind the blast. This was done specifically to deflect blame from another US proxy, Thaksin Shinawatra, who has been attempting for years to regain power in Thailand. In reality, Shinawatra and the Uyghur terrorists are both functions of the same Westesrn agenda to encircle and contain China by building up a “wall” of proxy states around Beijing, and if nothing else, to create chaos in which Beijing finds it nearly impossible to prosper.

  • n her review of Risen’s book in the New York Times, Louise Richardson lauds his criticism of “the profligacy of government agencies and the ‘over-sight free zone’ they operated” as well as of “self-appointed terrorism experts” who promote fear “while drawing lucrative consulting contracts for themselves.
  • She is troubled, however, that Risen “makes no mention of the press,” which she considers a key member of the terrorism industry and “at least as guilty as others in his book of stirring up public anxiety for public gain.”             
  • Fear-mongering by officials and by the media is politically (and economically) understandable, but it is also decidedly irresponsible. Especially when public safety is the concern, it is vital to get the threats right and to evaluate counterterrorism measures in a systematic and coherent manner.     ""Fear sells," points out journalist James Risen in his recent book, Pay Any Price.             There was a great deal of selling on ABC's "Good Morning America" on Friday. Segueing neatly from a report on raids against terrorists in Belgium, host George Stephanopoulos noted that "fears in Europe are matched by growing anxiety here about homegrown terror." He then stoked those anxieties as he introduced a segment on an apparently current "sting operation to stop a radicalized young man planning a deadly attack on our nation's Capitol."            Only at the end of the "exclusive" report, and in passing, was it noted that the plot actually took place three years ago. And nowhere was it pointed out that the man had overstayed his visitor's visa by 12 years (and therefore could have been deported at any time), that he had been evicted from his apartment in Virginia, or that FBI operatives had paid him $5,700 for living expenses and provided him with every scrap of weaponry he possessed. Also unmentioned: FBI informants had promised to pay the man's destitute parents in Morocco up to $1,000 a month after he killed himself in the process of detonating a small (FBI-provided) bomb in a ludicrous mission to bring down the Capitol dome. The average monthly household income in Morocco is less than $600.              It is often assumed that, even without the FBI's aid, a determined homegrown terrorist would eventually find someone else to supply him with his required weaponry. However, as Trevor Aaronson observes in his book, The Terror Factory, there has never "been a single would-be terrorist in the United States who has become operational through a chance meeting with someone able to provide the means for a terrorist attack." Then the narrative of the brothers robbing a convenience store was revealed to be false. Police scanners referred to a "black top" person. Still, the official narrative is that the Tsarnaev brothers were at the same place and the same time of the robbery.

These measures have sparked outrage among many immigrant rights organizations and caused city mayors to speak out against them. Opponents likely have the law on their side. Politico reported that the White House failed to consult the proper federal agencies and lawmakers before signing the executive orders. This means the orders are likely fraught with contradictions to current laws that can be easily exploited by opponents to dismantle them. The legal fight has already begun. Mayors of targeted cities are teaming up with immigration advocacy groups and attorneys to gear up for a legal battle against the presidential orders. Opponents of Trump’s order say that federal money allocated to cities can only be cut if the funding is directly linked to behavior that opposes the federal government’s plan for immigration.

  • The House of Saud may be up to something in Crimea. Let’s pivot back to the desert to see how that could possibly be accomplished. A week ago, Minister of Information and Culture Abdelaziz Khoja proclaimed that the House of Saud “renews its firm position condemning terrorism in all its forms.” That was the preamble to ask all Saudi nationals, jihadists or otherwise, to abandon Syria. They were committing a crime, Saudi King Abdullah, ever closer to meeting his maker, decreed. Then, Saudi Arabia, the United Arab Emirates (UAE) and Bahrain all called their ambassadors from Qatar, under the pretext that Doha continues to support “hostile media,” as in Al Jazeera. Finally Saudi Arabia officially declared the Muslim Brotherhood, Al-Nusra Front (Al-Qaeda’s official Syrian branch) and the Islamic State of Iraq and the Levant (ISIL) - the rogue jihadists fighting both the Assad government in Syria and the Maliki government in Iraq - as terrorist organizations. Any Saudi member of any of these outfits not back to the Kingdom in 15 days would be thrown in jail for up to 30 years. By decree, the Saudi Interior Ministry (just in case) also branded as terrorists the Shiite Huthi rebels in northern Yemen, as well as an obscure, Saudi-based outfit called ‘Hezbollah Inside the Kingdom’. None of the above can so much as have a Facebook account.

They are terrified of jihad freelancers. They are terrified of Muslim Brothers supported by their cousins in Qatar – which the West, laughably, praises as practicing a ‘more moderate’ brand of medieval Wahhabism. The old Emir Hamad al Thani – who recently deposed himself to the benefit of his son Tamim – had skillfully manipulated the Brotherhood as the key lever of Doha’s wide Middle-Eastern ambitions.

Refat Chubarov, the president of the Majlis, the National Assembly of Crimean Tatars, considers the Crimean referendum on March 16 a “threat” to the Ukraine. He is not promoting a jihad, but as many Tatar representatives, already forecasts “serious consequences” if Crimea’s statute is changed. There is certified Tatar backing to the neo-Nazis/fascists of the Svoboda and Right Sector kind in Kiev. From this ‘alliance’ to jihad, it’s just a suicide bombing away. Whatever happens in Crimea, the House of Saud is up to something. Bandar Bush had boasted to President Putin that he controlled Caucasus jihadists and could turn them on and off at will. His successor might as well be tempted to turn them on not in the Caucasus, but in establishing a shuttle from the Syrian desert to Simferopol. What a spectacular favor to his American masters.   • The Israeli Knesset (Parliament) announced that on Sunday July 12th, they will bring back a bill to forcibly remove 40,000 Palestinian Bedouins from their homes in the Negev desert in southern Israel.
  • The bill had been tabled in 2013 after widespread international condemnation of the forced transfer plan. According to Article 49 of the Fourth Geneva Convention, “Individual or mass forcible transfers, as well as deportations of protected persons from occupied territory to the territory of the Occupying Power or to that of any other country, occupied or not, are prohibited, regardless of their motive.” Israeli authorities had initially approved the plan, known as the ‘Prawer Plan’, in 2011, but delayed it indefinitely after the UN and other international bodies condemned the plan. The Palestinian Bedouin communities of southern Israel have lived in their homes for hundreds of years, but when Israel was created in 1948, the Israeli government refused to recognize their villages. As such, their homes have been destroyed dozens of times by the Israeli government, each time rebuilt by the Bedouin community.

  • A court in Istanbul has issued arrest warrants against four Israeli military officials for their role in authorizing and carrying out the attacks on the Mavi Marmara, the Turkish humanitarian aid boat bound for Gaza on 31 May 2010. Israeli forces attacked and raided the boat, which was part of a flotilla in international waters and was attempting to break the siege on Gaza. Israeli commandos killed nine civilians and wounded dozens of others. Speaking to The Electronic Intifada, Rabia Yurt, a Turkish attorney for the families of the victims, says the ruling is unprecedented. Yurt says it is “the first [time] in history” that arrest warrants have been issued against Israeli officials, who have never been held responsible in an international court for the army’s “uncountable crimes.”
  • The judges presiding at the Istanbul Çağlayan Courthouse on 26 May ordered arrest warrants against former Israeli army Chief General Gabi Ashkenazi, Naval Forces commander Vice Admiral Eliezer Marom, Israeli military intelligence chief Major General Amos Yadlin and Air Forces Intelligence head Brigadier General Avishai Levi. Last year, as The Electronic Intifada reported, the prosecutor of Spain’s national court formally requested a judge to begin steps to refer a case against Israeli leaders for the attack to the International Criminal Court (ICC). Three Spanish citizens, Manuel Tapial, Laura Arau and David Segarra, were aboard the Mavi Marmara when it was attacked and commandeered. Tapial, Arau and Segarra filed the case against Israeli Prime Minister Benjamin Netanyahu, six ministers and Vice Admiral Eliezer Marom of the Israeli navy who led the attack.

It is part of and is a signatory to the European extradition convention and signed to Interpol, and therefore all other countries who are also signatories to these conventions and institution have an obligation to indeed arrest these Israeli officials for whom the arrest warrants were issued. And we also know that — remember that this trial started way back in 2012 — the Israeli soldiers wouldn’t travel around too much, especially not go to Turkey. We know that Israeli soldiers were complaining about this. For instance, there was a case of an Israeli soldier who filed a claim against the State of Israel because he wanted to study in the United States, but because he took part in this operation he could not set foot out of Israel. So because we know this, we are quite optimistic about the arrest warrants, that they will be in fact implemented by other countries.

RY: In December, there is going to be another hearing, and we’re just going to make sure that the entire world will know about this arrest warrant, that we will follow whether any of these four defendants steps foot outside of Israel. We have lawyers in different countries also working together, and in South Africa, in the UK, many, many countries more — they will also closely follow whether these four defendants will travel in these countries. And then if this is the case, we will immediately take action and make sure that if the country in which one of the four defendants steps foot refuses, or neglects to fulfill its obligation to arrest [the defendant], then we will make sure that that country will not get away with it. And we will push for it, and publicize this as much as we can.

    A historic day indeed. Turkey is a member of both NATO and INTERPOL. Four high-ranking Israeli military officers will be on the INTERPOL arrest list soon, with a network of human rights lawyers around the world on the watch and ready to enforce INTERPOL arrest obligations. In other words, these officers' travel outside Israel will be very unlikely to include INTERPOL treaty nations and European extradition convention nations as either destinations or waypoints. The deterrent effect on Israeli government officials is considerable, particularly with another criminal prosecution pending in Spain. Fittingly, the Turkish court has aimed its message at high military officials who directed the assassinations rather than at the low-ranking soldiers who committed them. Message to high Israeli officials: be nice to Turkish citizens if you want to ever travel outside Israel.  One can only wish that the same message had been delivered about American citizens. The victim shot five times including a point blank shot to the head was an American citizen. Many of the kidnaped human rights people on the Navi Marmara and accompanying boats were Americans. One of the boats was American-flagged. Under international law, these actions were casus belli, a sufficient cause for military retaliation against the government of Israel. But the cowardly Obama and Secretary of State Hillary Clinton did not so much as lodge a diplomatic protest, so fearful they are of the powerful Israel Lobby.

Hillary Clinton's Real Scandal Is Honduras, Not Benghazi - 0 views

  • What beats me is why more Democrats aren’t deeply troubled by the legacy of Clinton’s foreign policy blunder in Honduras. Maybe you’ve forgotten what happened in that small country in the first year of the Obama administration — more on that in a moment. But surely you’ve noticed the ugly wave of xenophobia greeting a growing number of Central American child refugees arriving on our southern border. Some of President Barack Obama’s supporters are trying to blame this immigration crisis on the Bush administration because of an anti-trafficking law George W. signed in 2008 specifically written to protect Central American children that preceded an uptick in their arrivals. But which country is the top source of kids crossing the border? Honduras, home to the world’s highest murder rate, Latin America’s worst economic inequality, and a repressive U.S.-backed government. When Honduran military forces allied with rightist lawmakers ousted democratically elected President Manuel Zelaya in 2009, then-Secretary of State Clinton sided with the armed forces and fought global pressure to reinstate him.
  • Washington wields great influence over Honduras, thanks to the numerous military bases built with U.S. funds where training and joint military and anti-drug operations take place. Since the coup, nearly $350 million in U.S. assistance, including more than $50 million in military aid has poured into the country. That’s a lot of investment in a nation where the police, the military, and private security forces are killing people with alarming frequency and impunity, according to Human Rights Watch. In short, desperate Honduran children are seeking refuge from a human rights nightmare that would cast a dark cloud over Clinton’s presidential bid right now if the media were paying any attention. That wouldn’t give Republicans a big advantage, of course. Until they stop alienating a majority of female voters and communities of color, I find it hard to see the party of Mitt Romney and John McCain winning the White House.
  • Given the Democratic Party’s demographic edge, progressives have nothing to lose by seizing on the GOP field’s weakness and pressing for a viable alternative to another Clinton administration. Senator Elizabeth Warren could prove a contender. Unfortunately, the consumer-rights firebrand and Massachusetts Democrat lacks any foreign policy experience. And foreign policy is no afterthought these days. Israel — the recipient of $3.1 billion a year in U.S. military aid — is waging a ground war in Gaza, and the stakes in the Russia-Ukraine conflict just grew following the downing of that Malaysia Airlines jet. Plus, Iraq is growing more violent and unstable once more. On all these issues, Clinton is more hawkish than most of the Democratic base. But other Democrats with a wide range of liberal credentials and foreign policy expertise are signaling some interest in running, especially if Clinton ultimately sits out the race. Even if Clinton does win in 2016, a serious progressive primary challenge could help shape her presidency. As more and more Honduran kids cross our border in search of a safe haven, voters should take a good look at her track record at the State Department and reconsider the inevitability of another Clinton administration.
