    This report lists hundreds of instances in which the United States has used its Armed Forces abroad in situations of military conflict or potential conflict or for other than normal peacetime purposes. It was compiled in part from various older lists and is intended primarily to provide a rough survey of past U.S. military ventures abroad, without reference to the magnitude of the given instance noted. The listing often contains references, especially from 1980 forward, to continuing military deployments, especially U.S. military participation in multinational operations associated with NATO or the United Nations. Most of these post-1980 instances are summaries based on presidential reports to Congress related to the War Powers Resolution. A comprehensive commentary regarding any of the instances listed is not undertaken here. The instances differ greatly in number of forces, purpose, extent of hostilities, and legal authorization. Eleven times in its history the United States has formally declared war against foreign nations. These 11 U.S. war declarations encompassed 5 separate wars: the war with Great Britain declared in 1812; the war with Mexico declared in 1846; the war with Spain declared in 1898; the First World War, during which the United States declared war with Germany and with Austria-Hungary during 1917; and World War II, during which the United States declared war against Japan, Germany, and Italy in 1941, and against Bulgaria, Hungary, and Rumania in 1942.  Some of the instances were extended military engagements that might be considered undeclared wars. These include the Undeclared Naval War with France from 1798 to 1800; the First Barbary War from 1801 to 1805; the Second Barbary War of 1815; the Korean War of 1950-1953; the Vietnam War from 1964 to 1973; the Persian Gulf War of 1991; global actions against foreign terrorists after the September 11, 2001, attacks on the United States; and the war with Iraq in 2003. Declaration For The Americas Moves Toward Signing Without US And Canada - 0 views

  • Negotiations held over the past 18 years toward resolving historic issues of land dispossession and conflicts over natural resources with indigenous peoples of the Americas are finally expected to reach consensus by May. “We were told there are some states very interested in getting the declaration done so we can move to another stage in the Organization of American States (OAS) and be able to enforce the rights recognized,” said Leonardo A. Crippa, a senior attorney for the Indian Law Resource Center in Washington. “It’s aiming to be completed by May so the text can be submitted for approval to the General Assembly of the OAS, which is meeting in D.C. in June.”
  • This process began in 1989, when the OAS General Assembly approved a resolution to ask the Inter-American Commission of Human Rights (IACHR) to prepare a declaration on the rights of indigenous people of North America, South America, Central America and the Caribbean. The IACHR submitted the first Draft American Declaration on the Rights of Indigenous Peoples in 1997. Also that year, the Indian Law Resource Center and other indigenous rights groups such as the Native American Rights Fund in Colorado petitioned the OAS to create a working group to discuss issues with member states and work toward reaching consensus on resolutions.
  • “We are doing our best to advise indigenous representatives, have discussions with the OAS, and compose language that is more defined than the U.N. Declaration [on the Rights of Indigenous Peoples] to reflect regional issues,” Crippa said. Yet, as Crippa notes, the United States and Canada, among other OAS states, have not accepted the jurisdiction of the Inter-American Court on Human Rights and continue to refuse to sign onto the draft declaration. A statement released by the U.S. delegation to the negotiations in March states: “The United States remains committed to addressing the urgent issues of indigenous peoples in the hemisphere, including combating societal discrimination against indigenous peoples, increasing indigenous participation in national political processes, addressing lack of infrastructure and poor living conditions in indigenous areas, and collaborating on issues of land rights and self governance.” It also notes that the U.S. “continues to believe the OAS can be mobilized to make a practical difference in the lives of indigenous peoples,” but reiterates that it refuses to sign the declaration.

  • The study also found that Brazil is the country with the greatest diversity of indigenous peoples in isolation, followed by Peru and Bolivia. The current version of the OAS declaration includes Article XXVI, agreed by consensus in 2005, specifically for indigenous peoples in voluntary isolation to have the right to remain in that condition and to live freely and in accordance with their cultures. “In most cases the key recommendation is to prevent contact either by state agencies, officials, non-government organizations or companies wanting to exploit resources of their lands,” Crippa said. Their ancestors lived on the land long before the current states even existed. Vulnerable and at risk of disappearing entirely, they cannot advocate for their own rights. The study cites the National Environment Commission of Peru’s findings that from 1950 to 1957 a total of 11 indigenous groups disappeared completely from the Amazon, and of those remaining, 18 are in grave danger of disappearing, as they each have fewer than 225 members.
  • “There are regional particulates that are unique and not defined in the U.N. Declaration [UNDRIP],” Crippa said. He used the example of people in the Americas living in voluntary isolation, emphasizing, “We need to protect these peoples from internal armed conflicts, such as in Colombia, where they’re caught in the middle of military, paramilitary and guerrilla forces. It’s a situation of a government of a country trying to control land of indigenous peoples without respect to their rights.” Indigenous peoples in voluntary isolation are groups or individuals who remain untouched by non-indigenous populations. They do not maintain contact with non-indigenous populations, may reject any type of contact, or may have chosen to return to their traditional culture and break relations with non-native societies in favor of maintaining their own ways of life. A provision to protect indigenous communities living in isolation has been approved in the OAS draft declaration, which has no corresponding provision in UNDRIP.
  • When efforts to resolve issues have failed to find remedy in their own country, the IACHR can be appealed to. All 35 member states of the OAS are under the jurisdiction of the IACHR, headquartered in Washington. No country can be a part of the OAS process without ratifying the OAS Charter. “All 35 member countries have signed the Declaration on the Rights and Duties of Man of 1948,” said Maria Isabel Rivera, director of Press and Publications for the IACHR. “This means the Commission analyzes all cases and petitions and monitors human rights situations in those countries under the light of the rights recognized in the Declaration.” Countries that have not ratified the convention include the Bahamas, Belize, Canada, Cuba, Guyana, St Kitts and Nevis, St. Lucia, St. Vincent and the Grenadines, and the U.S. Thus, cases originating in these countries cannot be brought to the Inter-American Court of Human Rights, but they can be brought to IACHR in a petition of injustice.
  • The OAS draft declaration recommends protections including legislation that specifically addresses indigenous rights to land, culture and self-determination, and training programs for state employees, who may encounter issues that affect communities living in voluntary isolation. It further recommends studies for projects which take into account people living in isolation nearby, and sanctions for those violating natural resources protections. It also calls for limiting commercial tourism in the territories of people living in voluntary isolation and urges companies, organizations and governments to work in coordination with indigenous groups which aim to protect indigenous rights toward free and prior consent. “Indigenous peoples have the right to maintain, express, and freely develop their cultural identity in all respects, free from any external attempt at assimilation,” the draft also states. “The States shall not carry out, adopt, support, or favor any policy to assimilate the indigenous peoples or to destroy their cultures.”

The Declaration of Independence Affirms Unalienable Property Rights - 1 views

    I needed some background regarding the founding documents and their position on individual property rights.  Google came back with this gem!   The basic argument i'm pursuing is that socialism is unconstitutional because it's based on the selective seizure and redistribution of wealth.  Meaning, not all citizens are equal before the law.  The complaints lodged against King George in the Declaration of Independence are very much about the colonist not having the same rights of Englishmen as those whom the King favors. excerpt: the purpose of the Declaration of Independence. "Not to find out new principles, or new arguments, never before thought of, not merely to say things which had never been said before; but to place before mankind the common sense of the subject . . . ."1 The "common sense of the subject" expressed in the Declaration of Independence was that a national civil government must be based upon the "Laws of Nature and of Nature's God." The laws of nature and of nature's God dictate that all men are equally endowed by their Creator with unalienable rights to "Life, Liberty and the pursuit of Happiness." In Jefferson's day, the common sense of the subject was that the pursuit of happiness included the unalienable right of the individual to acquire, possess, protect and dispose of property. Because the purpose of civil governments was to secure unalienable rights, violations of one's unalienable right of property were subject to civil sanction. Today, however, the common sense of the subject is quite the opposite. The modern idea is that civil government properly possesses all power over all subjects of property. Any rights that may exist are derived from the civil government. Any rights to property that a person has may be regulated, limited or revoked by the civil government in order to satisfy the "public interest." Al-Qaeda might attack Guantanamo, claims US - Human Rights - Al Jazeera English - 0 views

  • In a 13-page brief filed on Friday in federal court in Washington, DC, government lawyers assert that a June 3 declaration signed by Guantanamo prison warden Colonel John Bogdan, which sought to justify the rationale behind the genital search policy , contains details about "operational-security and force-protection procedures" that, if made public, "would better enable our enemies to attack the detention facilities at Guantanamo or undermine security at the facility".
  • The government made these claims in response to a motion to intervene  filed by this reporter in federal court last month which sought to unseal Bogdan's six-page declaration. Journalists can intervene in court cases and argue for the release of certain materials on the grounds that the public has a right of access to judicial records. The warden's declaration was submitted by the government - under seal - in response to a lawsuit filed by Guantanamo attorneys, who argued the genital search policy Bogdan enacted at the height of a mass hunger strike in April interfered with prisoners' access to their lawyers. The new procedures required prisoners to agree to have their genitals searched whenever they left their cells to meet with attorneys, and upon return, to ensure they were not transporting "contraband". Rather than submit to the searches, numerous prisoners declined to meet with their lawyers.
  • Last month, US District Court Judge Royce Lamberth banned the searches, calling them "religiously and culturally abhorrent". Lamberth said the protocol Bogdan implemented under the guise of security was actually intended to deter prisoners from meeting with their lawyers. The judge noted the "government is a recidivist when it comes to denying counsel access" to the prisoners. Three days after Lamberth issued his opinion, this reporter's Washington, DC-based attorney, Jeffrey Light, filed a motion to intervene to unseal Bogdan's declaration. The following week a federal appeals court reversed Lamberth's decision while the government prepared a formal appeal.

  • Secret, or not secret? In response to the court filing, the government on Friday released a partially redacted version of Bogdan's declaration, and argued that the blacked-out passages in the document should remain secret - because they contained sensitive "operational-security information" about Guantanamo. But it appears government lawyers were unaware that another version of Bogdan's declaration - one that contained a different set of redactions - was publicly released last month, in documents filed with the federal appeals court when the government asked Lamberth's decision to be put on hold. Redacted passages that the government says needs to remain secret are unredacted in the earlier version filed on the public record as part of the government's appeal. At the same time, some unredacted passages in the declaration submitted on Friday are redacted in the public version of Bogdan's declaration filed with the appeals court last month.

U.S. Blocked Declaration of "Right to Health Care", Says Bolivia's President at OAS Sum... - 0 views

  • Bolivia’s President Evo Morales has blamed U.S. President Barack Obama for the failure of the recent OAS (Organization of American States) Summit of the Americas to issue a final declaration, and he says that a major sticking point for Mr. Obama was Obama’s opposition to a provision in the proposed declaration that would have said that health care is “a human right.” Mr. Obama insisted that it’s instead a privilege, access to which must be based primarily upon an individual’s ability-to-pay, as is the case in the United States.  Said Mr. Morales: “One point (in the drafted declaration) was important: health as a human right, and the U.S. government did not accept that health should be considered a human right … President Obama did not accept” that concept. The 8-point draft had resulted from four months of negotiations between the participating countries prior to the Summit in Panama, which was held on April 10-11. There was such strong sentiment for declaring health care to be a right, so that this provision was included in the draft despite Obama’s opposition to it.

  • The United States government has already declared that in regards to what it alleges to be a Russian cyberattack against the U.S. Democratic Party, the U.S. reserves the right to go to war against Russia. NATO has accordingly changed its policy so as to assert that a cyberattack (in this case actually cyber-espionage, such as the U.S. government itself perpetrates against even its own allies such as Angela Merkel by tapping her phone) constitutes an act of war by the alleged cyberattacker, and so requires all NATO member nations to join any cyberattacked NATO nation in war against its alleged (cyber)attacker, if the cyberattacked member declares war against its alleged cyberattacker. Excuses are being sought for a war against Russia; and expanding the definition of “invasion,” to include mere espionage, is one such excuse. But it’s not the only one that the Obama Administration has cooked up. U.S. Senator Mike Lee has asserted that President Barack Obama must obtain a declaration of war against Syria — which is allied with and defended by Russia — before invading Syria. Syria has, for the past few years, already been invaded by tens of thousands of foreign jihadists (financed mainly by the royal Sauds and Qataris, and armed mainly with U.S. weaponry) who are trying to overthrow and replace the Syrian government so that pipelines can be built through Syria into Europe to transport Saudi oil and Qatari gas into the EU, the world’s biggest energy-market, which now is dominated by Russia’s oil and gas. Since Syria is already being defended by Russia (those royals’ major competitor in the oil and gas markets), America’s invasion of Syria would necessarily place U.S. and Russia into an air-war against each other (for the benefit of those royal Arabs — who finance jihadist groups, as even Hillary Clinton acknowledges): Syria would thus become a battleground in a broader war against Russia. So: declaring war against Syria would be a second excuse for World War III, and one which would especially serve the desires not only of U.S. ‘defense’ firms but of the U.S. aristocracy’s royal Arabic allies, who buy much of those ‘defense’ firms’ exports (weaponry), and also U.S. oilfield services firms such as pipelines by Halliburton. (It’s good business for them, no one else. Taxpayers and war-victims pay, but those corporations — and royal families — would profit.)

Furthermore, as regards whether Crimea’s rejoining Russia was ‘illegal’ as she says: does she also deny the right of self-determination of peoples regarding the residents of Catalonia though the Spanish government accepts it there, and also by the residents of Scotland though the British government accepts it there? Or is she simply determined to have as many excuses to invade Russia as she can have? She has never condemned the independence movements in Scotland or Catalonia. The United States is clearly on a path toward war with Russia. Donald Trump opposes all aspects of that policy.

Hillary Clinton argues that she, with her neoconservative backing (consisting of the same people who cheer-led the invasion of Russia-friendly Iraq, and who shared her joy in doing the same to Russia-friendly Libya — “We came, we saw, he died, ha ha!”), is the better person to have her finger on the nuclear button with Russia. This U.S. Presidential election will be decided upon the WW3-issue, unless the American electorate are incredibly stupid (or else terribly deceived): Is she correct to allege that she and not Trump should have control over the nuclear button against Russia? She’s even more of a neoconservative than Obama is, and this is why she has the endorsement of neoconservatives in this election. And that is the issue.

And that’s the source of neoconservatism — the top U.S.-based international corporations, mainly in ‘defense’ and oil and Wall Street. (Clinton’s career is based upon precisely those three segments, whereas Trump’s is based instead upon real estate and entertainment, neither of which segments is neoconservative.) It doesn’t come from nowhere; it comes from the people who buy and sell politicians.

So is declaring a national emergency without congressional approval. While Congress has passed many an unConstitutional Law regarding "National Emergency Powers", there is nothing in the Constitution granting any branch of the Federal government to tear up the Constitution and Bill of Rights.  Atrocities like FiSA, The Military Commissions Act, NSP51, HSPD20, the John Warner Defense Authorization Act, the National Emergencies Act, and the Patriot Act are un Constitutional to the core.   Only the American people, through their representatives in Congress, can declare a national emergency.  With the exception of the habeas corpus clause, the Constitution makes no allowance for the suspension of any of its provisions during a national emergency.  Many statist seeking to breach the Constitution and Bill of Rights argue that the granting of emergency powers by Congress is implicit in its Article I, section 8 authority to "provide for the common Defense and general Welfare," the commerce clause, its war, armed forces, and militia powers, and the "necessary and proper" clause empowering it to make such laws as are required to fulfill the executions of "the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof." Hayek argues that, in politics, "the worst rise to the top", and he outlines three reasons why: .... Choosing is the problem. Informed people are more "nuanced" - they have many divergent opinions and views. Uniformity however drives the group dynamics behind a democratic process. Uniformity of opinion rules, and the less informed a person is, the more uniform and drawn to larger groups they will be. The "lowest common denominator" rule rules the democratic process. Mobocracy at work. .... Those on top, pursuing the political leadership positions, must appeal to the masses and weave together the groups driven by the "lowest common denominator" rule. The docile and gullible "are ready to accept whatever values and ideology drummed into them". Advantage to big media, the socialist assemblage ruling public education, and public workers unions. ..... Third, political leaders "don't promote a positive agenda, but a negative one of hating an enemy and envy of the wealthy. To appeal to the masses, leaders preach an "us" against "them" program."
