  • This is the way the multi-trillion dollar Global War on Terror (GWOT) ends: not with a bang, but with a bigger bang. The GWOT, since its conceptualization 13 years ago, in the aftermath of 9/11, is the gift that keeps on giving. And no gift is bigger than a Transformer Al-Qaeda on steroids – bigger, brasher, and wealthier than anything Osama Bin Laden and Ayman al-Zawahiri had ever dreamt of; the IS (Islamic State, formerly known as ISIS) of Caliph Ibrahim, former Abu Bakr al-Baghdadi. US President Barack Obama, before deploying his golf holidays in Martha’s Vineyard, casually dropped that bombing the Caliph’s goons in Iraq will take months. One may interpret it as another layer of the Obama administration’s self-avowed “Don't Do Stupid Stuff” foreign policy doctrine, not so subtly mocked by prospective presidential candidate Hillary Clinton. Shock and Awe in 2003 destroyed the whole of Baghdad’s infrastructure in only a few hours. Obama also confirmed the US was showering Iraq again with humanitarian bombing “to protect American interests” (first and foremost) and, as an afterthought, “human rights in Iraq.” One could not possibly expect Obama to declare the US would now bomb “our” allies the House of Saud, who have supported/financed/weaponized IS, in Syria and Iraq. The same erstwhile ISIS that thoroughly enjoyed the marvels of US military training in a secret base in Jordan.
  • Obama also could not possibly explain why the US always supported ISIS in Syria and now decides to bomb them in Iraq. Oh, the perils of ‘Don’t Do Stupid Stuff’. So a quick translation applies.
  • Obama’s bombing of the Caliph’s goons has absolutely nothing to do with US ambassador to the UN Samantha Power’s much beloved R2P (‘responsibility to protect’) doctrine – as in the responsibility to protect up to 150,000 Yazidis, not to mention Kurds and remaining Christians, from a ‘potential’ genocide carried out by the Caliph’s goons. The whole fighter jets + drones bombing exercise, lasting ‘months’, has to do with the Benghazi syndrome. The Caliph’s goons were dead set on conquering Irbil - the capital of Iraqi Kurdistan. The Kurdistan Regional Government (KRG) is led by the wily Massoud Barzani – a long-time US client/vassal. The US maintains a consulate in Irbil. Crammed with CIA types. Or, as the New York Times so lovingly puts it, “thousands of Americans.” Enter Benghazi. This is an electoral year. Obama is absolutely terrified of another Benghazi – which Republicans have been trying non-stop to blame on his administration’s incompetence. The last thing Obama needs is the Caliph’s goons killing ‘diplomats’ in Erbil. That would certainly raise a tsunami of questions all over again about the shady CIA weapon-smuggling racket – as in arming Syrian ‘rebels’ with weapons from Libya - at the time Benghazi took place. As secretary of state, Hillary Clinton, of course, also knew about it all. But then, and especially now, no one should know that the CIA was weaponizing the bulk of the future Caliph’s forces.

  • Obama said this humanitarian bombing adventure could last “months,” but in fact it could last only days. The price is cheap: regime change. As in former Iraqi Prime Minister Nouri al-Maliki blocked from having a third term. That explains why all hell broke loose in Baghdad, as Iraqi parliamentarians clearly saw which way the wind is blowing. Haider al-Abadi was chosen by new President Fuad Masoum, a Kurd, as the new prime minister – hours after Maliki positioned Special Forces in strategic sites in and around the Green Zone and may (or may not) have tried to stage a coup. Maliki maintains that Masoum violated the Iraqi constitution by not selecting him to form a new cabinet; after all, his State of Law bloc got the most votes in last April’s parliamentary elections.
  • Obama, predictably, was delighted. But whatever happens next, Maliki won’t go down quietly – to say the least. Even as the predominant narrative among Sunnis, a substantial number of Kurds and even some Shiite political blocs is that Maliki antagonized Sunnis all-out; and that’s what drove them to support the Caliph en masse (although now many are having second thoughts.) As for the KRG and Barzani, in the Obama administration scheme of things, what matters is that they should not declare independence. As long as Barzani promises to Obama that Kurdistan stays inside Iraq, the KRG will get more bombs and drones and the ‘humanitarian’ operation will speed up. US Special Forces are already deployed all over the huge area where the Caliphate borders the KRG, in so-called desert forward operating positions. And the US for all practical purposes is now the Iraqi Air Force against the Caliph. Watch ‘the Hillarator’ This Obama administration warped R2P – protection for Americans first, refugees second – will accomplish nothing for a key reason; no bombing – ‘humanitarian’ or otherwise - exterminates a political/religious movement, even one as demented as IS. The Caliphate prospers, somewhat, and expands, because unlike that pathetic Free Syrian Army (FSA) it’s winning territory, desert and urban, in both Syria and Iraq; an area bigger than Great Britain already, holding at least 6 million people.
  • As for the much-peddled Washington myth of ‘good’ and ‘bad’ jihadists, the Caliphate also exploded it. Virtually every jihadi Washington - and Riyadh – weaponized and trained in Jordan and in the Turkey-Syria border is now among the Caliph’s goons, wallowing in cash raised from oil smuggling, hardcore blackmail and ‘donations’, and weaponized to their teeth after looting four Iraqi divisions and a Syrian brigade. As for the GWOT gift, it will keep on giving in a bigger and bigger bang because of the dream narrative now displayed for every aspiring multinational jihadi; we are now defending our Caliphate from the mighty Crusader Air Force, no less. The US lost the war in Iraq, miserably, only nine days after the fall of Baghdad, in April 2003. No ‘humanitarian’ bombing will turn it into a victory. And no ‘humanitarian’ bombing will finish the Caliphate off. As for prospective presidential candidate Hillary Clinton, she’s taking no prisoners. She insists the US should have bombed Syria in the first place; then there would be no Caliphate. But now she worries the Caliph will attack Europe and even the US (“I’m thinking a lot about containment, deterrence and defeat”). Predictably positioning herself, Clinton could not but totally dismiss Obama’s foreign policy doctrine, a.k.a. ‘Don’t do stupid stuff’: “‘Don’t do stupid stuff’ is not an organizing principle.” So the world will have to wait until 2017, when she’s finally able to implement her own doctrine/organizing principle: “We came, we saw, he died.”

    Excellent article other than the fact that the author erred in referring to the AR-15 as an "assault rifle." It is not. It is an "assault weapon," a semi-automatic rifle with only a cosmetic resemblance to the M-16 fully automatic "assault rifle." "Assault rifles" have been outlawed in the U.S. for decades. The U.S. had a complete ban on "assault weapon" rifles from 1994 to 2004. It did not affect gun violence rates at all, because semi-automatic rifles that lacked the cosmetic resemblance to "assault rifles" remained on the market. The distinction between the two terms is critical to understanding the current gun debate. Those who propose a ban on "assault weapons" are offering only a cosmetic sop to the anti-gun crowd, banning a sub-set of semi-automatic rifles whilst leaving equally capable semi-autos on the market. The correct question to ask is "why bother?" One might as well ban toy guns that bear a resemblance to assault weapons; other toy guns remain unaffected. Ron compares the Obama tyranny methods to those used by Hitler to subjugate the German people and take over the German Republic.  His observations are based on the historical work of William L. Shirer, "The Rise and Fall of the Third Reich". excerpt: Over the past year I have been reading a few pages a day of William L. Shirer's history of Nazism, "The Rise and Fall of the Third Reich" - Nearly 1200 pages and I have finally finished. It is a masterpiece of journalism history based on Shirer's own observations beginning in the 1920s. It is centered of course on Adolf Hitler, his cronies, and his generals. As I read this I began mentally comparing it with our current leader and our current administration's edicts  from the EPA and other agencies. I found that there are many similarities between Hitler's rise to power and Obama's, as well as the tyranny of the Nazi administration. So I decided to write up my comparative observations, as given below. It is not that Obama is following a path to Nazism, but that he seems to be following a path to a tyranny that is all his own: racist, anti-rich,  pro-socialist, anti-industry, anti-Semitic, anti-Christian, , anti-Israel,  pro-Islam, anti-Constitution, anti-First Amendment anti-Second Amendment, anti-Fourth Amendment, anti-Tenth Amendment and anti-America, to name a few of the tyrannical tenants of Obamunism. There are many other historical examples of tyrannical leaders besides Hitler, but for now he will do just fine as a model tyrant, and Shirir's tomb provides a ready means of comparison. ...........

On March 9, 2010, the day Tea Party candidate Christine O'Donnell revealed her plan to run for Vice President Joe Biden's former Delaware Senate seat , an IRS tax lien was placed on a house purported to be hers, an action that was quickly publicized by those who did not wish her well.
  • Earlier this year, Dennis Martel, special agent with the Department of Treasury in Baltimore, left a message on O'Donnell's cell phone telling her that an official in Delaware state government had improperly accessed her records on that very same day. The problem was that the house was not hers in the first place and the IRS eventually blamed the lien on a computer glitch and withdrew it.

  • Social Security Administration employees are being instructed to tell people who ask that if the debt ceiling is not raised, their social security benefits could be in danger. In an email sent Friday, obtained by The Daily Caller, employees are instructed: “If a member of the public asks whether their Social Security payment will be affected if the federal debt ceiling is not raised, you may give the following response: ‘Unlike a federal shutdown which has no impact on the payment of Social Security benefits, failure to raise the debt ceiling puts Social Security benefits at risk.’ “Direct all program–related and technical questions to your supervisor.”
  • This was done before in 2011 also and the answer is the same as it was then. Social Security holds $2.6 trillion in special-issue Treasury securities. Those bonds are part of the $14.3 trillion debt amassed by the U.S. government, and benefits are paid out of those securities. So, the theory goes, if Treasury redeemed the needed Social Security bonds, and issued new marketable Treasury bonds to make good on the Social Security bonds, it would be a one for one swap and the debt ceiling would not be increased. There is a technical wrinkle involving the fact that payroll taxes that are collected are supposed to be immediately turned into Treasury securities, but there could be ways around that, such as putting the monies in a noninterest bearing account, as during the 1985 debt crisis.   • This social disruption has motivated the enthusiastic growth and militarization of our local police departments. The law and order crowd thrives on excessive laws and regulations that no US citizen can escape. The out-of-control war on drugs is the worst part, and it generates the greatest danger in poverty-ridden areas via out-of-control police. It is estimated that these conditions have generated up to 80,000 SWAT raids per year in the United States. Most are in poor neighborhoods and involve black homes and businesses being hit disproportionately. This involves a high percentage of no-knock attacks. As can be expected many totally innocent people are killed in the process. Property damage is routine and compensation is rare. The routine use of civil forfeiture of property has become an abomination, totally out of control, which significantly contributes to the chaos. It should not be a surprise to see resentment building up against the police under these conditions. The violent reaction against local merchants in retaliation for police actions further aggravates the situation —hardly a recipe for a safe neighborhood.

With cradle-to-grave welfare protecting all citizens from any mistakes and a perpetual global war on terrorism, which a majority of Americans were convinced was absolutely necessary for our survival, our security and prosperity has been sacrificed. It was all based on lies and ignorance. Many came to believe that their best interests were served by giving up a little freedom now and then to gain a better life. The trap was set. At the beginning of a cycle that systematically undermines liberty with delusions of easy prosperity, the change may actually seem to be beneficial to a few. But to me that's like excusing embezzlement as a road to leisure and wealth - eventually payment and punishment always come due. One thing is for sure: The next two decades are going to be tumultuous and tragic. The events that unfold will be far more radical than we dare envision today. Paradigms in banking, politics and philosophy will be overturned. Wrenching lifestyle shifts will be forced upon millions. Something akin to what happened in the Soviet Union after the fall of communism in 1991 will take place in America. Our ruling regime will collapse and bring Russian-style economic hardship to us all. How exactly things unfold will depend upon whether the nation's intelligentsia bring themselves to seriously question the shams of statism, or whether the government-media-academy triad is able to continue bamboozling them. What is extremely unnerving is that whoever wins this battle to control the destiny of our country will determine the fate of freedom on the planet for hundreds, perhaps thousands of years. We are being destroyed because of what historian Clarence Carson called a "collectivist curvature of the mind" that took over our intellectuals back in the early twentieth century. This curvature of the mind functions as the grand fueling mechanism for the goals of government centralization and ending our national sovereignty. It's horrifying, but every year our schools form the "best and the brightest minds" into collectivist apparatchiks to go out in the world and work their way into the power centers of society. The schools do this via false teachings in philosophy, economics, political science and history. This "ideological indoctrination" teaches every new generation that capitalism is an evil, exploitative, racist, warmongering system and must be phased out of modern societies. It teaches that national sovereignty is anachronistic and must be given up. Such indoctrination is being done very subtly and sophisticatedly, but it is a powerful, pervasive theme instilled into all our children from the first grade on.

You can't possibly save those starfish; there's thousands of them. You're wasting your time, you fool. YOU CAN'T MAKE A DIFFERENCE!" The old man looked up at the insolent youth and smiled. He then reached down and picked up one of the struggling starfish and winged it far out into the water, replying to his tormentor, "Made a difference with that one, didn't I?"

When such wards see others fighting valiantly against seemingly insurmountable odds for the freedom they have scorned, they are subconsciously humiliated because they are not deep in the thick of the fight themselves. They have chosen to avoid the fight and sanction the tyrants who are destroying our way of life. Thus, they must find a way to salve their consciences. That way is to caustically mock the Davids who go up against the Goliaths, to smear the Rolands of Roncesvalles that history hands down to us as heroic exemplars.
  • You the reader have a paramount decision to make regarding all this. It is High Noon for the cause of freedom. Will you fight with the heroic exemplars? If you choose to fight, then your first necessity is to become aware of WHAT is happening and WHY it is happening. That awareness can only be found via fervent curiosity and a commitment to the study of libertarian and conservative literature.
  • Your second duty is to emulate Paul Revere and warn all those in your sphere of influence. You do this by making a diplomatic nuisance of yourself, by pleasantly pestering your comrades to wake up to the elite's usurpations growing by leaps and bounds in our lives. You do it by convincing them that there are grander values in life than shiny new SUVs and country club memberships. There is something called the American way of life that requires personal independence.

The anarchists violate logic and ignore history because logic and history show their political system to be unworkable.

  • The Western Press doesn’t have much to say about the military operations in Syria, except to affirm, without the slightest proof, that the Coalition is successfully bombing Daesh jihadists while the Russians continue to kill innocent civilians. It is in fact difficult to form a reasonable idea of the current situation, particularly since each side is readying its weapons in preparation for a wider conflict. Thierry Meyssan describes what is going on. The silence surrounding the military operations in Iraq and Syria does not mean that the war has ground to a halt, but that the different protagonists are preparing for a new round of hostilities.
  • The Coalition forces On the imperial side, there reigns a state of total confusion. With regard to the contradictory declarations by US leaders, it is impossible to understand Washington’s objectives, if indeed there are any. At the very best, it would seem that the United States are allowing France to take certain initiatives at the head of one part of the Coalition, but even there, we do not know their real objectives. Of course, France declares that it wants to destroy Daesh in retaliation for the attacks of the 13th November in Paris, but it was already saying so before these attacks took place. Their earlier declarations were the stuff of public relations, not reality. For example, the Mecid Aslanov, property of Necmettin Bilal Erdoğan’s BMZ Group, left the French port of Fos-sur-Mer on the 9th November 2015, having just delivered, in total impunity, a cargo of oil which it claimed had been extracted in Israël, but which in reality had been stolen by Daesh in Syria. There is nothing to indicate that the situation is any different today, or that we should begin taking the official declarations seriously. French President François Hollande and his Minister of Defence Jean-Yves Le Drian visited the aircraft-carrier Charles-De-Gaulle, off the coast of Syria, on the 4th December. They announced a change of mission, but gave no explanation. As Army Chief of Staff General Pierre de Villiers had previously stated, the ship was diverted to the Persian Gulf.
  • The aeronaval Group constituted around the Charles-De-Gaulle is composed of its on-board aerial Group (eighteenRafale Marine, eight modernised Super Etendard, two Hawkeye, two Dauphin and one Alouette III), the aerial defence frigateChevalier Paul, the anti-submarine frigate La Motte-Picquet, the command flagship Marne, the Belgian frigate Léopold Ier and the German frigate Augsburg, and also, although the Minister of Defence denies it, a nuclear attack submarine. Attached to this group, the stealth light frigate Courbet remained in the western Mediterranean. The European forces have been integrated into Task Force 50 of the USNavCent, in other words the US Central Command fleet. This unit now comprises about sixty ships. The French authorities have announced that rear-admiral René-Jean Crignola has taken command of this international force, without mentioning that he is placed under the authority of the commander of the 5th Fleet, rear-admiral Kevin Donegan, who is himself under the authority of General Lloyd J. Austin III, commander of CentCom. It is in truth an absolute rule of the Empire that the command of operations always falls to US officers, and that the Allies only occupy auxiliary positions. In fact, apart from the relative promotion of the French rear-admiral, we find ourselves in the same position as last February. We have an international Coalition which is supposed to be fighting Daesh, and which – for an entire year – has certainly multiplied its reconnaissance flights and destroyed Chinese oil installations, but without having the slightest effect on its official objective, Daesh. Here too, there is no indication that anything will change.

  • Turkey and the ex-governor of Mosul, Atheel al-Nujaifi, would like to be present when the city is taken from Daesh, hoping to be able to prevent it from being occupied by the Popular Mobilisation Forces (al-Hashd al-Shaabi), the great majority of whom are Shia. It’s clear that everyone is dreaming – illegitimate President Massoud Barzani believes that no-one will question his annexation of the oil fields of Kirkuk and the Sinjar mountains – the leader of the Syrian Kurds, Saleh Muslim, imagines that he will soon be President of an internationally-recognised pseudo-Kurdistan – and President Recep Tayyip Erdoğan presumes that the Arabs of Mosul long to be liberated and governed by the Turks, as they were under the Ottoman Empire. Furthermore, in Ukraine, Turkey has deployed the International Islamist Brigade that it officially created last August. These jihadists, who were extracted from the Syrian theatre, were divided into two groups as soon as they arrived in Kherson. Most of them went to fight in Donbass with the Cheikh Manour and Djokhar Doudaïev Brigades, while the best elements were infiltrated into Russia in order to sabotage the Crimean economy, where they managed to cut all electricity to the Republic for 48 hours.
  • The terrorist forces We could deal here with the terrorist organisations, but that would involve pretending, like NATO, that these groups are independent formations which have suddenly materialised from the void, with all their salaries, armement and spare parts. More seriously, the jihadists are in fact mercenaries in the service of Turkey, Saudi Arabia and Qatar – it seems that the United Arab Emirates have almost completely withdrawn from this group – to which we must add certain multinationals like Academi, KKR and Exxon-Mobil. Turkey continues its military deployement in Bachiqa (Irak), in support of the Kurdish forces of illegitimate President Massoud Barzani who, although his mandate is terminated, refuses to leave power and organise new elections. When the Iraqi government demanded that Turkey remove its troops and tanks, Ankara responded that it had sent its soldiers to protect the training forces deployed in Iraq according to an earlier international agreement, and that it had no intention of withdrawing them. It then added even more, bringing the number of troops involved to at least 1,000 soldiers and 25 tanks. Iraq referred its case to the United Nations Security Council and the Arab League, without provoking the slightest reaction anywhere.
  • The Coalition has announced that it has carried out new bombing missions and destroyed a number of Daesh installations, but these allegations are unverifiable and even more doubtful insofar as the terrorist organisation has not made the slightest protest. From this disposition, we may conclude that France may elaborate its own strategy, but that the United States can re-assert control at any time.
  • Saudi Arabia united its mercenaries in Riyadh in order to constitute a delegation in readiness for the next round of negotiations organised by the NATO Director of Political Affairs, US neo-Conservative Jeffrey Feltman. The Saudis did not invite the representatives of Al-Qaïda, nor those of Daesh, but only the Wahhabist groups who are working with them, like Jaysh al-Islam or Ahrar al-Sham. Therefore, in theory, there were no « terrorist groups », as listed by the UNO Security Council, present at the conference. However, in practice, all the participants were fighting with, in the name of, or alongside Al-Qaïda or Daesh without using their label, since most of these groups are directed by personalities who once belonged to Al-Qaïda or Daesh. Thus, Ahrar al-Sham was created just before the beginning of the events in Syria by the Muslim Brotherhood and the principal leaders of Al-Qaïda, drawn from personalities close to Osama bin Laden. Continuing to act as they had before the Russisan intervention, the participants agreed to a « political solution » which would start with the abdication of the democratically-elected President Bachar el-Assad, and continue with a sharing of power between themselves and the Republican institutions. Thus, although they have lost all hope of a military victory, they persist in counting on the surrender of the Syrian Arab Republic.
  • Since the representative of the Syrian Kurds was not invited to the conference, we may conclude that Saudi Arabia considers the project for a pseudo-Kurdistan as distinct from the future of the rest of Syria. Let us note in passing that the YPG has just created a Syrian Democratic Council in order to reinforce the illusion of an alliance between Selah Muslim’s Kurds and the Sunni and Christian Arabs, when in reality, they are fighting each other on the ground. In any case, there is no doubt that Riyadh is supporting Turkey’s efforts to create this pseudo-Kurdistan as a place of banishment for « its » Kurds. Indeed, it is now confirmed that Saudi Arabia supplied the logistical aid necessary for Turkey to guide the air-air missile which shot down the Russian Soukhoï 24. Finally, Qatar is still pretending that it has not been involved in the war since the abdication of Emir Hamad, two years ago. Nonetheless, proof is accumulating of its secret operations, all of which are directed not against Damascus, but against Moscow – thus, the Qatari Minister of Defence, in Ukraine at the end of September, bought a number of sophisticated Pechora-2D anti-air weapons which the jihadists could use to threaten Russian forces. More recently, he organised a false-flag operation against Russia. Still in Ukraine, at the end of October, he bought 2,000 OFAB 250-270 Russian fragmentation bombs and dispersed them on the 6th December over a camp of the Syrian Arab Army, in order to accuse the Russian Army of blundering. In this case too, despite the proof, there was no reaction from the UNO.
  • The patriotic forces The Russian forces have been bombing the jihadists since the 30th September. They plan to continue at least until the 6th January. Their action is aimed principally at destroying the bunkers built by these armed groups and the totality of their logistical networks. During this phase, there will be little evolution on the ground other than a withdrawal of jihadists towards Iraq and Turkey. The Syrian Arab Army and its allies are preparing a vast operation for the beginning of 2016. The objective is to provoke an uprising of the populations dominated by the jihadists, and to take almost all the cities in the country simultaneously – with the possible exception of Palmyra – so that the foreign mercenaries will fall back to the desert. Unlike Iraq, where 120,00 Sunnis and Ba’athists joined Daesh only to exact revenge for having been excluded from power by the United States in favour of the Chiites, rare are the Syrians who ever acclaimed the « Caliphate ». On the 21st and 22nd November, in the Mediterranean, the Russian army took part in excercises with its Syrian ally. As a result, the airports of Beirut (Lebanon) and Larnaca (Cyprus) were partially closed. On the 23rd and 24th November, the firing of Russian missiles on Daesh positions within Syria provoked the closing of the airports at Erbil and Sulaymaniyah (Iraq). It seems that in reality, the Russian army may have been testing the possible extension of its weapon that inhibits NATO communications and commands. In any case, on the 8th December, the submarine Rostov-on-Don fired on Daesh installations from the Mediterranean.
  • Russia, which disposes of the air base at Hmeymim (near Lattakia), also uses the air base of the Syrian Arab Army in Damascus, and is said to be building a new base at al-Shayrat (near Homs). Besides this, some high-ranking Russian officers have been carrying out scouting missions with a view to creating a fourth base in the North-East of Syria, in other words, close to both Turkey and Iraq. Finally, an Iranian submarine has arrived off the coast of Tartus. Hezbollah, who demonstrated their capacity to carry out commando operations during their liberation of the Sukhoï pilot held prisoner by militias organised by the Turkish army, are preparing the uprising of Shia populations, while the Syrian Arab Army – which is more than 70% Sunni – is concentrating on the Sunni populations. The Syrian government has concluded an agreement with the jihadists of Homs, who have finally accepted to either join up or leave. The area has been evacuated under the control of the United Nations, so that today, Damascus, Homs, Hama, Lattakia and Der ez-Zor are completely secure. Aleppo, Idlib and Al-Raqqah still need to be liberated. Contrary to peremptory affirmations by the western Press, Russia has no intention of leaving the north of the country to France, Israël and the United Kingdom so that they can create their pseudo-Kurdistan. The patriot plan forsees the liberation of all the inhabited areas of the country, including Rakka, which is the current « capital of the Caliphate ». This is the calm before the storm.

  • Schrems first asked the Irish Data Commissioner to investigate the legality of Facebook Ireland sending his info over to the States, where it could be seen by the security services, but when the commissioner refused to investigate, he sought a judicial review at the High Court.The Commissioner had ruled that Schrems didn’t have a case because he couldn’t prove that anyone had slurped his data in particular and anyway, the EU has an agreement with the US under the “Safe Harbour” principle decided way back in 2000. This principle governs data flow from Europe to United States and allows US firms to self-certify themselves as respectful of European data protection rules.High Court Justice Gerard Hogan said Schrems did not need to prove that his own data had been spied upon to make a complaint.“Quite obviously, Mr Schrems cannot say whether his own personal data has ever been accessed or whether it would ever be accessed by the US authorities,” he wrote in his ruling.
  • “But even if this were considered to be unlikely, he is nonetheless certainly entitled to object to a state of affairs where his data are transferred to a jurisdiction which, to all intents and purposes, appears to provide only a limited protection against any interference with that private data by the US security authorities.”However, he said that only the European Court of Justice could decide that individual member states were allowed to look past the Safe Harbour principle or reinterpret its meaning. Hogan said that Schrems, who had filed on behalf of the Europe-v-Facebook group, really had a problem with this principle and acknowledged that there may be an argument for the idea that the rule was outdated.“The Safe Harbour Regime… may reflect a somewhat more innocent age in terms of data protection,” he said. “This Regime came into force prior to the advent of social media and, of course, before the massive terrorist attacks on American soil which took place on September 11th, 2001.”

  • Every year on 15 September, thousands of Salvadorans celebrate the date when much of Central America gained independence from Spain. Fireworks are set off and marching bands parade through villages across the country. But, last year, in the town of San Isidro, in Cabañas, the festivities had a markedly different tone. Hundreds had gathered to protest against the mine. Gold mines often use cyanide to separate gold from ore, and widespread concern over already severe water contamination in El Salvador has helped fuel a powerful movement determined to keep the country’s minerals in the ground. In the central square, colourful banners were strung up, calling on OceanaGold to drop its case against the country and leave the area. Many were adorned with the slogan, “No a la mineria, Si a la vida” (No to mining, Yes to life). On the same day, in Washington DC, Parada gathered his notes and shuffled into a suite of nondescript meeting rooms in the World Bank’s J building, across the street from its main headquarters on Pennsylvania Avenue. This is the International Centre for the Settlement of Investment Disputes (ICSID): the primary institution for handling the cases that companies file against sovereign states. (The ICSID is not the sole venue for such cases; there are similar forums in London, Paris, Hong Kong and the Hague, among others.) The date of the hearing was not a coincidence, Parada said. The case has been framed in El Salvador as a test of the country’s sovereignty in the 21st century, and he suggested that it should be heard on Independence Day. “The ultimate question in this case,” he said, “is whether a foreign investor can force a government to change its laws to please the investor as opposed to the investor complying with the laws they find in the country.”
  • Most international investment treaties and free-trade deals grant foreign investors the right to activate this system, known as investor-state dispute settlement (ISDS), if they want to challenge government decisions affecting their investments. In Europe, this system has become a sticking point in negotiations over the controversial Transatlantic Trade and Investment Partnership (TTIP) deal proposed between the European Union and the US, which would massively extend its scope and power and make it harder to challenge in the future. Both France and Germany have said that they want access to investor-state dispute settlement removed from the TTIP treaty currently under discussion. Investors have used this system not only to sue for compensation for alleged expropriation of land and factories, but also over a huge range of government measures, including environmental and social regulations, which they say infringe on their rights. Multinationals have sued to recover money they have already invested, but also for alleged lost profits and “expected future profits”. The number of suits filed against countries at the ICSID is now around 500 – and that figure is growing at an average rate of one case a week. The sums awarded in damages are so vast that investment funds have taken notice: corporations’ claims against states are now seen as assets that can be invested in or used as leverage to secure multimillion-dollar loans. Increasingly, companies are using the threat of a lawsuit at the ICSID to exert pressure on governments not to challenge investors’ actions.

  • The quiet village of Moorburg in Germany lies just across the river from Hamburg. Past the 16th-century church and meadows rich with wildflowers, two huge chimneys spew a steady stream of thick, grey smoke into the sky. This is Kraftwerk Moorburg, a new coal-fired power plant – the village’s controversial next-door neighbour. In 2009, it was the subject of a €1.4bn investor-state case filed by Vattenfall, the Swedish energy giant, against the Federal Republic of Germany. It is a prime example of how this powerful international legal system, built to protect foreign investors in developing countries, is now being used to challenge the actions of European governments as well. Since the 1980s, German investors have sued dozens of countries, including Ghana, Ukraine and the Philippines, at the World Bank’s Centre in Washington DC. But with the Vattenfall case, Germany found itself in the dock for the first time. The irony was not lost on those who considered Germany to be the grandfather of investor-state arbitration: it was a group of German businessmen, in the late 1950s, who first conceived of a way to protect their overseas investments as a wave of developing countries gained independence from European colonial powers. Led by Deutsche Bank chairman Hermann Abs, they called their proposal an “international magna carta” for private investors.
  • In the 1960s, the idea was taken up by the World Bank, which said that such a system could help the world’s poorer countries attract foreign capital. “I am convinced,” the World Bank president George Woods said at the time, “that those … who adopt as their national policy a welcome [environment] for international investment – and that means, to mince no words about it, giving foreign investors a fair opportunity to make attractive profits – will achieve their development objectives more rapidly than those who do not.” At the World Bank’s 1964 annual meeting in Tokyo, it approved a resolution to set up a mechanism for handling investor-state cases. The first line of the ICSID Convention’s preamble sets out its goal as “international cooperation for economic development”. There was sharp opposition to this system from its inception, with a bloc of developing countries warning that it would undermine their sovereignty. A group of 21 countries – almost every Latin American country, plus Iraq and the Philippines – voted against the proposal in Tokyo. But the World Bank moved ahead regardless. Andreas Lowenfeld, an American legal academic who was involved in some of these early discussions, later remarked: “I believe this was the first time that a major resolution of the World Bank had been pressed forward with so much opposition.”
  • now governments are discovering, too late, the true price of that confidence. The Kraftwerk Moorburg plant was controversial long before the case was filed. For years, local residents and environmental groups objected to its construction, amid growing concern over climate change and the impact the project would have on the Elbe river. In 2008, Vattenfall was granted a water permit for its Moorburg project, but, in response to local pressure, local authorities imposed strict environmental conditions to limit the utility’s water usage and its impact on fish. Vattenfall sued Hamburg in the local courts. But, as a foreign investor, it was also able to file a case at the ICSID. These environmental measures, it said, were so strict that they constituted a violation of its rights as guaranteed by the Energy Charter Treaty, a multilateral investment agreement signed by more than 50 countries, including Sweden and Germany. It claimed that the environmental conditions placed on its permit were so severe that they made the plant uneconomical and constituted acts of indirect expropriation.
  • With the rapid growth in these treaties – today there are more than 3,000 in force – a specialist industry has developed in advising companies how best to exploit treaties that give investors access to the dispute resolution system, and how to structure their businesses to benefit from the different protections on offer. It is a lucrative sector: legal fees alone average $8m per case, but they have exceeded $30m in some disputes; arbitrators’ fees at start at $3,000 per day, plus expenses.
  • Vattenfall v Germany ended in a settlement in 2011, after the company won its case in the local court and received a new water permit for its Moorburg plant – which significantly lowered the environmental standards that had originally been imposed, according to legal experts, allowing the plant to use more water from the river and weakening measures to protect fish. The European Commission has now stepped in, taking Germany to the EU Court of Justice, saying its authorisation of the Moorburg coal plant violated EU environmental law by not doing more to reduce the risk to protected fish species, including salmon, which pass near the plant while migrating from the North Sea. A year after the Moorburg case closed, Vattenfall filed another claim against Germany, this time over the federal government’s decision to phase out nuclear power. This second suit – for which very little information is available in the public domain, despite reports that the company is seeking €4.7bn from German taxpayers – is still ongoing. Roughly one third of all concluded cases filed at the ICSID are recorded as ending in “settlements”, which – as the Moorburg dispute shows – can be very profitable for investors, though their terms are rarely fully disclosed.
  • “It was a total surprise for us,” the local Green party leader Jens Kerstan laughed, in a meeting at his sunny office in Hamburg last year. “As far as I knew, there were some [treaties] to protect German companies in the [developing] world or in dictatorships, but that a European company can sue Germany, that was totally a surprise to me.”
  • While a tribunal cannot force a country to change its laws, or give a company a permit, the risk of massive damages may in some cases be enough to persuade a government to reconsider its actions. The possibility of arbitration proceedings can be used to encourage states to enter into meaningful settlement negotiations.
  • A small number of countries are now attempting to extricate themselves from the bonds of the investor-state dispute system. One of these is Bolivia, where thousands of people took to the streets of the country’s third-largest city, Cochabamba, in 2000, to protest against a dramatic hike in water rates by a private company owned by Bechtel, the US civil engineering firm. During the demonstrations, the Bolivian government stepped in and terminated the company’s concession. The company then filed a $50m suit against Bolivia at the ICSID. In 2006, following a campaign calling for the case to be thrown out, the company agreed to accept a token payment of less than $1. After this expensive case, Bolivia cancelled the international agreements it had signed with other states giving their investors access to these tribunals. But getting out of this system is not easily done. Most of these international agreements have sunset clauses, under which their provisions remain in force for a further 10 or even 20 years, even if the treaties themselves are cancelled.
  • There are now thousands of international investment agreements and free-trade acts, signed by states, which give foreign companies access to the investor-state dispute system, if they decide to challenge government decisions. Disputes are typically heard by panels of three arbitrators; one selected by each side, and the third agreed upon by both parties. Rulings are made by majority vote, and decisions are final and binding. There is no appeals process – only an annulment option that can be used on very limited grounds. If states do not pay up after the decision, their assets are subject to seizure in almost every country in the world (the company can apply to local courts for an enforcement order).
  • While there is no equivalent of legal aid for states trying to defend themselves against these suits, corporations have access to a growing group of third-party financiers who are willing to fund their cases against states, usually in exchange for a cut of any eventual award.
  • Increasingly, these suits are becoming valuable even before claims are settled. After Rurelec filed suit against Bolivia, it took its case to the market and secured a multimillion-dollar corporate loan, using its dispute with Bolivia as collateral, so that it could expand its business. Over the last 10 years, and particularly since the global financial crisis, a growing number of specialised investment funds have moved to raise money through these cases, treating companies’ multimillion-dollar claims against states as a new “asset class”.
  • El Salvador has already spent more than $12m defending itself against Pacific Rim, but even if it succeeds in beating the company’s $284m claim, it may never recover these costs. For years Salvadoran protest groups have been calling on the World Bank to initiate an open and public review of ICSID. To date, no such study has been carried out. In recent years, a number of ideas have been mooted to reform the international investor-state dispute system – to adopt a “loser pays” approach to costs, for example, or to increase transparency. The solution may lie in creating an appeals system, so that controversial judgments can be revisited.

    "Luis Parada's office is just four blocks from the White House, in the heart of K Street, Washington's lobbying row - a stretch of steel and glass buildings once dubbed the "road to riches", when influence-peddling became an American growth industry. Parada, a soft-spoken 55-year-old from El Salvador, is one of a handful of lawyers in the world who specialise in defending sovereign states against lawsuits lodged by multinational corporations. He is the lawyer for the defence in an obscure but increasingly powerful field of international law - where foreign investors can sue governments in a network of tribunals for billions of dollars. Fifteen years ago, Parada's work was a minor niche even within the legal business. But since 2000, hundreds of foreign investors have sued more than half of the world's countries, claiming damages for a wide range of government actions that they say have threatened their profits. In 2006, Ecuador cancelled an oil-exploration contract with Houston-based Occidental Petroleum; in 2012, after Occidental filed a suit before an international investment tribunal, Ecuador was ordered to pay a record $1.8bn - roughly equal to the country's health budget for a year. (Ecuador has logged a request for the decision to be annulled.) Parada's first case was defending Argentina in the late 1990s against the French conglomerate Vivendi, which sued after the Argentine province of Tucuman stepped in to limit the price it charged people for water and wastewater services. Argentina eventually lost, and was ordered to pay the company more than $100m. Now, in his most high-profile case yet, Parada is part of the team defending El Salvador as it tries to fend off a multimillion-dollar suit lodged by a multinational mining company after the tiny Central American country refused to allow it to dig for gold."

There is no visible occupation army oppressing the mass of the people in their everyday life. The ‘enemy’ does not disrupt everyday normal life – as forced conscription would and does. Under normal peaceful time, who would be willing to sacrifice their constitutional rights and their participation in civil society to subject themselves to martial rule that precludes the exercise of all their civil freedoms?

Since all US imperial wars are fought ‘overseas’ – far from any immediate threats, attacks or invasions – -US imperial rulers have the special task of making the ‘causus bellicus’ immediate, ‘dramatic’ and self-righteously ‘defensive’. To this end US Presidents have created circumstances, fabricated incidents and acted in complicity with their enemies, to incite the bellicose temperament of the masses in favor of war.
  • The pretext for wars are acts of provocation which set in motion a series of counter-moves by the enemy, which are then used to justify an imperial mass military mobilization leading to and legitimizing war. State ‘provocations’ require uniform mass media complicity in the lead-up to open warfare: Namely the portrayal of the imperial country as a victim of its own over-trusting innocence and good intentions. All four major US imperial wars over the past 67 years resorted to a provocation, a pretext, and systematic, high intensity mass media propaganda to mobilize the masses for war. An army of academics, journalists, mass media pundits and experts ‘soften up’ the public in preparation for war through demonological writing and commentary: Each and every aspect of the forthcoming military target is described as totally evil – hence ‘totalitarian’ – in which even the most benign policy is linked to demonic ends of the regime. Since the ‘enemy to be’ lacks any saving graces and worst, since the ‘totalitarian state’ controls everything and everybody, no process of internal reform or change is possible. Hence the defeat of ‘total evil’ can only take place through ‘total war’. The targeted state and people must be destroyed in order to be redeemed. In a word, the imperial democracy must regiment and convert itself into a military juggernaut based on mass complicity with imperial war crimes. The war against ‘totalitarianism’ becomes the vehicle for total state control for an imperial war.

  • The U.S. government must get a grip on the massive opening that the CIA, through its misfeasance, nonfeasance and malfeasance, has created. If Tuesday’s WikiLeaks document dump is authentic, as it appears to be, then the agency left open electronic gateways that make all Americans vulnerable to spying, eavesdropping and technological manipulation that could bring genuine harm. That the CIA has reached into the lives of all Americans through its wholesale gathering of the nation’s “haystack” of information has already been reported. It is bad enough that the government spies on its own people. It is equally bad that the CIA, through its incompetence, has opened the cyberdoor to anyone with the technological skills and connections to spy on anyone else. The constant erosion of privacy at the hands of the government and corporations has annihilated the concept of a “right to privacy,” which is embedded in the rationale of the First, Third, Fourth, Ninth and Fourteenth Amendments to the U.S. Constitution. It is becoming increasingly clear that we are sliding down the slippery slope toward totalitarianism, where private lives do not exist.

I have repeatedly warned about the dangers of the Patriot Act and its successive iterations, the execrable national security letters that turn every FBI agent into a star chamberlain, the dangers of fear-based security policies eroding our republic.     Wow.  Great collection of links detailing the incredible theft of the 2012 elections by the Obammunists.   There are a couple things we can do. web site provider suggests that all Tea Party, Libertarian and Conservative groups contact the Secretary of State in each of the involved battleground States and request a recount and verification of actual voters casting ballots. Another suggestion is to send official organization letters to Republican Secretaries of State asking them NOT TO Certify the election until all questions about voter fraud are vetted and abated. This is awful stuff, and may signal the end of our blessed Republic unless good citizens act immediately.

Billy Carter (1931-1988) was a charming ne’er-do-well who had an intense sibling rivalry with his older and more successful brother. Billy got mixed up in Middle East politics. PBS: In September 1978 Billy made a highly publicized trip to Libya with a group of Georgia legislators and businessmen eager to make deals. Several months later, he hosted a delegation of Libyans in Atlanta, as they looked for a place to locate a permanent trade mission. When asked why he was involved, Billy said, “The only thing I can say is there is a hell of a lot more Arabians than there is Jews.” He also argued that the “Jewish media [tore] up the Arab countries full-time,” and defended Libya against charges of state-sponsored terrorism by saying that a “heap of governments support terrorists and [Libya] at least admitted it.” President Carter tried to disassociate himself from the controversy that ensued, telling NBC News that he hoped people would “realize that I don’t have any control over what my brother says [and] he has no control over me.” Billy also apologized and explained he wasn’t anti-Semitic, but the damage was done.   • Iran took defiant steps on Monday in response to the intensified Western sanctions aimed at stifling its oil exports, announcing legislation intended to disrupt traffic in the Strait of Hormuz, a vital Persian Gulf shipping lane, and testing missiles in a desert drill clearly intended as a warning to Israel and the United States.
  • The legislation calls for Iran's military to block any oil tanker heading through the strait en route to countries no longer buying Iranian crude because of the European Union embargo, which took effect on Sunday. It was unclear whether the legislation would pass or precisely how Iran would enforce it, given that the United States Navy's Fifth Fleet patrols the strait. Pentagon officials have said Iran's military is capable of closing the strait temporarily, and the Obama administration has warned that any such move would constitute a "red line" that would provoke an American response. The strait, connecting the Gulf of Oman to the Persian Gulf, is the conduit for one fifth of the world's oil supply and has been called the world's most important "oil chokepoint" by the United States Department of Energy.

But at the same time, the Iranian Parliament has no power to declare war. That power resides with Ayatolla Khomeni and the Supreme Council of the Revolutionary Guards.  So the legislation is more symbolic than a similar bill in the U.S. would be. But still, it's a strong message that Parliament has Khomeni's back if he decides to retaliate against U.S. and E.U. economic warfare.

  • Over 100,000 Venezuelans mobilized throughout the country for a series of national military exercises in defense of their national sovereignty on Saturday.
  • The exercise featured the participation of 20,000 civilian volunteers who joined an additional 80,000 soldiers of the Bolivarian National Armed Forces in nationwide preparations for a potential U.S. aggression against the Bolivarian Republic.  Alongside active duty soldiers participated members of the Bolivarian Militia, which was expanded by over 35,000 members by President Chávez in 2010. The Bolivarian Militia represents the foundation of a popular “civic-military alliance” that has kept the Bolivarian Revolution in power amid repeated efforts to overthrow the government, including the reversed 2002 coup backed by the United States. 
  • Bolivarian soldiers and civilians additionally welcomed the participation of a contingent of Russian soldiers and naval craft, who assisted in exercises testing Venezuela’s air defense system, which included the launching of Russian-made BM-30 Smerch ground to air missiles.  The defensive preparations inaugurated on Saturday will continue over the course of ten days, encompassing approximately 30 exercises.

Waving banners that read “peace” and “Yankees go home,” the seemingly endless columns of demonstrators reached Miraflores Palace, where they were addressed by President of the Republic Nicolas Maduro.
