Victory! Federal Court Recognizes Constitutional Rights of Americans on the No-Fly List... - 0 views

  • A federal court took a critically important step late yesterday towards placing a check on the government's secretive No-Fly List. In a 38-page ruling in Latif v. Holder, the ACLU's challenge to the No-Fly List, U.S. District Court Judge Anna Brown recognized that the Constitution applies when the government bans Americans from the skies. She also asked for more information about the current process for getting off the list, to inform her decision on whether that procedure violates the Fifth Amendment guarantee of due process. We represent 13 Americans, including four military veterans, who are blacklisted from flying. At oral argument in June on motions for partial summary judgment, we asked the court to find that the government violated our clients' Fifth Amendment right to due process by barring them from flying over U.S. airspace – and smearing them as suspected terrorists – without giving them any after-the-fact explanation or a hearing at which to clear their names. The court's opinion recognizes – for the first time – that inclusion on the No-Fly List is a draconian sanction that severely impacts peoples' constitutionally-protected liberties. It rejected the government's argument that No-Fly list placement was merely a restriction on the most "convenient" means of international travel.
  • Such an argument ignores the numerous reasons an individual may have for wanting or needing to travel overseas quickly such as for the birth of a child, the death of a loved one, a business opportunity, or a religious obligation. According to the court, placement on the No-Fly List is like the revocation of a passport because both actions severely burden the right to international travel and give rise to a constitutional right to procedural due process: Here it is undisputed that inclusion on the No-Fly List completely bans listed persons from boarding commercial flights to or from the United States or over United States air space.  Thus, Plaintiffs have shown their placement on the No-Fly List has in the past and will in the future severely restrict Plaintiffs' ability to travel internationally. Moreover, the realistic implications of being on the No-Fly List are potentially far-reaching. For example, TSC [the Terrorist Screening Center] shares watchlist information with 22 foreign governments and United States Customs and Boarder [sic] Protection makes recommendations to ship captains as to whether a passenger poses a risk to transportation security, which can result in further interference with an individual's ability to travel as evidenced by some Plaintiffs' experiences as they attempted to travel abroad by boat and land and were either turned away or completed their journey only after an extraordinary amount of time, expense, and difficulty. Accordingly, the Court concludes on this record that Plaintiffs have a constitutionally-protected liberty interest in traveling internationally by air, which is affected by being placed on the list. The court also found that the government's inclusion of our clients on the No-Fly List smeared them as suspected terrorists and altered their ability to lawfully board planes, resulting in injury to another constitutionally-protected right: freedom from reputational harm.
  • The importance of these rulings is clear. Because inclusion on the No-Fly List harms our clients' liberty interests in travel and reputation, due process requires the government to provide them an explanation and a hearing to correct the mistakes that led to their inclusion. But under the government's "Glomar" policy, it refuses to provide any information confirming or denying that our clients are on the list, let alone an after-the-fact explanation and hearing. The court has asked the ACLU and the government for more information about the No-Fly List redress procedure to help it decide the ultimate question of whether that system violates the Fifth Amendment right to due process. We are confident the court will recognize that the government's "Glomar" policy of refusing even to confirm or deny our clients' No-Fly List status (much less actually providing the reasons for their inclusion in the list) is fundamentally unfair and unconstitutional.

    A case decision in August that I had missed, right here in Oregon. One of our Oregon federal judges gets it right after being reversed the first time by the 9th U.S. Circuit Court of Appeals. I've read the opinion. Looks quite solid. Plaintiffs were carefully chosen for this test case, 13 citizens placed on the no-fly list, all with compelling stories of winding up stranded, some overseas. Several are U.S. military veterans. All were told by government officials that the reason they could not board was because they were on the TSA no-fly list. At issue is whether they have a right to be informed of the information that resulted in them being placed on the no-fly list and a right to a hearing to seek correction of the information. Their constitutional interest in their reputations is also in play, since they have been classified by their government as too dangerous to allow to travel by commercial airline.   The district court case is not done; the judge has ordered further briefing on some issues. But the government is trying to defend a process in which no one is ever formally notified that they are on the no-fly list and is never advised of the reasons they are on the no-fly list. The number of Americans on the no-fly list is now over 700,000. But the judge has recognized that there is a constitutional right to travel and that it extends to international travel. From the opinion: "Plaintiffs contend the government has deprived them of their protected liberty interest in travel. In Kent v. Dulles, 357 U.S. 116 (1958), the Supreme Court held "[t]he right to travel is part of the 'liberty' of which the citizen cannot be deprived without due process of law under the Fifth Amendment."  Id. at 125. As noted by the Ninth Circuit, "the [Supreme] Court has consistently treated the right to international travel as a liberty interest that is protected by the Due Process Clause of the Fifth Amendment." Mr Forsyth and his colleagues struggle along on about 160 thousand pounds a year and the Chief Executive makes do on 234 pounds annually (9.)
  • Children saving seems to be somewhat selective at this agency which operates in “more than 120 countries.” For example, in November 2003, the Guardian reported that: “Senior figures at Save the Children US . . . demanded the withdrawal of the criticism and an effective veto on any future statements blaming the invasion for the plight of Iraqi civilians’ suffering malnourishment and shortages of medical supplies.” Fast forward to the run up to another US extrajudicial assassination of the man purported to be Osama bin Laden in May 2011 in Abbottabad, Pakistan. Save The Children: “had been under suspicion from authorities ever since a doctor accused of assisting the CIA in its search for the al-Qaida leader claimed that Save the Children had introduced him to US intelligence officers.” (11.) Dr Shakil Afridi, currently serving 33 years in jail was: “accused of setting up a bogus hepatitis B vaccination campaign in the Abbottabad area to try to pinpoint Bin Laden’s exact location”, via DNA samples which: “were to be tested by the CIA for genetic matches to Bin Laden.”
  • Whilst: “Afridi never succeeded in persuading (people) to give blood, his collaboration with a foreign intelligence service is regarded as an act of treason by Pakistan’s security establishment.” Save The Children which emphatically denied employing or paying Dr Afridi or indeed having a vaccination programme in Abbottabad were nevertheless expelled from Pakistan in September 2012. In spite of denials, internal mails on the dispute obtained by the Center for Investigative Reporting in Pakistan (12) which can be read in full (13) make interesting reading.
  • A relatively recent Save The Children initiative has been to appoint Samantha Cameron, wife of current UK Prime Minister David Cameron as their “Ambassador” for Syria. Since the organization cannot work in Syria, she has brought stories of “innocent childhoods being smashed to pieces” from neighbouring countries. Of course Britain under Cameron is arming and training the Syrian insurgents. (14.) Cameron is a Blair admirer, on record as taking his advice. “Peace Envoy” Blair is on record as enthusiast for another illegal overthrow in Syria with “no regrets” over Iraq.
  • As the fury mounts over Blair’s Award and Christmas approaches, Denis Halliday, former UN Coordinator in Iraq who resigned over the embargo during Blair’s premiership stating that it was “genocide”, reminded me of Christmas 1998 when Blair stood in front of his Christmas tree outside 10 Downing Street and declared that the UK and US were again (illegally of course) bombing Iraq. During this further blitz, Halliday’s successor, Hans von Sponeck, who was also to resign in disgust, was sleeping on the floor in the UN building in Baghdad, with his staff and families, the building was further out of town and seemed safer for those who took rescue. So as Save The Children lauds Blair and trumpets the Rights of the Child, perhaps they should reflect the horror he has wrought. In Iraq one in four surviving children now has stunted physical or intellectual development due to malnutrition. There are an estimated 35,000 infant deaths annually, over a quarter of Iraqi children, three million, suffer post traumatic stress disorder. (War Child: “Mission Unaccomplished”, 2013.)

UN officials accused of bowing to Israeli pressure over children's rights list | World ... - 0 views

  • Senior UN officials in Jerusalem have been accused of caving in to Israeli pressure to abandon moves to include the state’s armed forces on a UN list of serious violators of children’s rights. UN officials backed away from recommending that the Israel Defence Forces (IDF) be included on the list following telephone calls from senior Israeli officials. The Israelis allegedly warned of serious consequences if a meeting of UN agencies and NGOs based in Jerusalem to ratify the recommendation went ahead. Within hours, the meeting was cancelled. “Top officials have buckled under political pressure,” said a UN source. “As a result, a clear message has been given that Israel will not be listed.”

Susana Malcorra – a high-ranking official in the New York office of the UN secretary general, Ban Ki-moon – raised the issue in a private letter to Israel’s ambassador to the UN, Ron Prosor. The UN in New York said it could not comment on leaked documents. The telephone calls were made to June Kunugi, Unicef’s special representative to Palestine and Israel, on 12 February, the night before a meeting to decide whether to recommend the IDF’s inclusion on the list. One call was from a senior figure in Cogat, the Israeli government body that coordinates between the IDF, the Palestinian Authority and the international community; the other was made by an official in Israel’s foreign ministry.

The UN in Jerusalem was unable to comment on the process, it added, but the submission from Jerusalem to New York was “based on verified facts, not influenced by any member state or other entity”.

The secretary general is required to list armed forces or armed groups responsible for such actions. Following last summer’s seven-week war in Gaza, a number of UN agencies and NGOs met to consider whether to recommend the IDF’s inclusion on the list. According to insiders, participants “agreed there is a strong and credible case to recommend listing”.
  • A 13-page internal Unicef paper seen by the Guardian examined the case for the IDF to be listed on the basis of its actions in last summer’s war in Gaza, including the killing and injuring of children, and “targeted and indiscriminate” attacks on schools and hospitals. Israel has no desire to get into a slanging match with anti-Israel elements nor to submit to their intimidations.”

    "What the hell just happened? That is the question that many Americans should be asking themselves following the news conference where Obama unveiled his plan for destroying the Bill of Rights to the U.S. Constitution. At first glance it appeared to be a case of Obama shamelessly using the deaths of innocents, and some live children as a backdrop, to push for the passage of radical gun control measures by Congress. Most of these have no chance of passing, yet, Obama's signing of Executive orders initiating 23 so called Executive actions on gun control seemed like an afterthought. Unfortunately, that is the real story, but it is generally being overlooked. The fact is that with a few strokes of his pen Obama set up the mechanisms he will personally use to not only destroy the Second Amendment to the Constitution, but also the First, Fourth, and Fifth Amendments. It will not matter what Congress does, Obama can and will act on his own, using these Executive actions, and will be violating both the Constitution and his oath of office when he does it. Here are the sections of the Executive Order that he will use: "1. Issue a Presidential Memorandum to require federal agencies to make relevant data available to the federal background-check system." What exactly is relevant data? Does it include our medical records obtained through Obamacare, our tax returns, our political affiliations, our military background, and our credit history? I suggest that all of the above, even if it violates our fourth Amendment right to privacy will now be relevant data for determining if we are allowed to purchase a firearm. "2. Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background-check system." Cost of Medical Bills for Baby Hit by SWAT Grenade? Over $800,000. County's Refusal to ... - 0 views

  • Remember back in May when a gang of uniformed thugs from the  Habersham County SWAT team threw a flash-bang grenade right on top of a sleeping baby? Well, stellar group that they are, they’ve refused to pay the over $800,000 in medical bills for the child that they permanently disfigured and nearly killed. That’s right. They aren’t paying the bills and are leaving the family to try and cover the costs for the toddler’s care. Our militarized police forces are claiming too many innocent victims, and they aren’t being held accountable.
  • The family’s attorneys, from the Davis Bozeman Law Firm in Decatur, Georgia, released a statement this morning: The family of Bounkham “Baby Bou Bou” Phonesavanh, the child severely injured on May 28, 2014 by a flash bang grenade thrown in his play pen during a botched police raid while his family was staying in Georgia, received a copy of the notice sent to their son’s doctor’s office that Habersham County reneges on their public promise to pay for the medical expenses of this working class family’s child. “Bounkham “Baby Bou Bou” Phonesavanh has to date incurred an estimated $800,000 worth of expenses due to his injuries. Shortly after severely burning “Baby Bou Bou” with a flash bang grenade the Habersham County Sheriff’s Department vowed to pay for the child’s medical expenses.  Last week the family discovered through medical providers that the county will not pay any medical bills.  The county stated that it would be “illegal” to pay. Recently, Alecia Phonesavanh shared her son’s injuries are so severe that doctors predict several more surgeries throughout his life to repair the hole in his chest and major facial injuries.

  • It’s important to remember a few things regarding this case. 1.) There is no question or denial that the SWAT team threw a grenade right on top of a sleeping baby. 2.) No drugs were found on the premises. 3.) The person they were looking for was not present at the time of the no-knock raid. It’s bad enough that it happened.  But to cripple the family financially with nearly a million dollars in medical expenses on top of that? This isn’t even about the shoddy police work, the bad intel, or the poor decision to throw a grenade (that was designed to be rolled) into a room full of children. Nor is it about the slimy sheriff of Habersham County, who, if you recall, defended the actions of his SWAT team.
  • This is about a complete lack of accountability. A refusal to take responsibility for a horrible mistake that crosses into criminal negligence, at the very least. What an absolutely repulsive group of individuals. They blew a hole through the face and chest cavity of a 19 month old child, permanently disfigured him,  put him through an unfathomable amount of agony with treatments and repeated surgeries, and now, the family, which was already struggling financially after losing their home in a fire, is stuck with the bill, which will continue to climb, since Bou Bou is looking at several more operations.

FBI Admits It Controlled Tor Servers Behind Mass Malware Attack | Threat Level | Wired.com - 0 views

  • It wasn’t ever seriously in doubt, but the FBI yesterday acknowledged that it secretly took control of Freedom Hosting last July, days before the servers of the largest provider of ultra-anonymous hosting were found to be serving custom malware designed to identify visitors. Freedom Hosting’s operator, Eric Eoin Marques, had rented the servers from an unnamed commercial hosting provider in France, and paid for them from a bank account in Las Vegas. It’s not clear how the FBI took over the servers in late July, but the bureau was temporarily thwarted when Marques somehow regained access and changed the passwords, briefly locking out the FBI until it gained back control. The new details emerged in local press reports from a Thursday bail hearing in Dublin, Ireland, where Marques, 28, is fighting extradition to America on charges that Freedom Hosting facilitated child pornography on a massive scale. He was denied bail today for the second time since his arrest in July. Freedom Hosting was a provider of turnkey “Tor hidden service” sites — special sites, with addresses ending in .onion, that hide their geographic location behind layers of routing, and can be reached only over the Tor anonymity network. Tor hidden services are used by sites that need to evade surveillance or protect users’ privacy to an extraordinary degree – including human rights groups and journalists. But they also appeal to serious criminal elements, child-pornography traders among them.
  • On August 4, all the sites hosted by Freedom Hosting — some with no connection to child porn — began serving an error message with hidden code embedded in the page. Security researchers dissected the code and found it exploited a security hole in Firefox to identify users of the Tor Browser Bundle, reporting back to a mysterious server in Northern Virginia. The FBI was the obvious suspect, but declined to comment on the incident. The FBI also didn’t respond to inquiries from WIRED today. But FBI Supervisory Special Agent J. Brooke Donahue was more forthcoming when he appeared in the Irish court yesterday to bolster the case for keeping Marques behind bars, according to local press reports. Among the many arguments Donahue and an Irish police inspector offered was that Marques might reestablish contact with co-conspirators, and further complicate the FBI probe. In addition to the wrestling match over Freedom Hosting’s servers, Marques allegedly dove for his laptop when the police raided him, in an effort to shut it down.
  • The apparent FBI-malware attack was first noticed on August 4, when all of the hidden service sites hosted by Freedom Hosting began displaying a “Down for Maintenance” message. That included at least some lawful websites, such as the secure email provider TorMail. Some visitors looking at the source code of the maintenance page realized that it included a hidden iframe tag that loaded a mysterious clump of Javascript code from a Verizon Business internet address. By midday, the code was being circulated and dissected all over the net. Mozilla confirmed the code exploited a critical memory management vulnerability in Firefox that was publicly reported on June 25, and is fixed in the latest version of the browser. Though many older revisions of Firefox were vulnerable to that bug, the malware only targeted Firefox 17 ESR, the version of Firefox that forms the basis of the Tor Browser Bundle – the easiest, most user-friendly package for using the Tor anonymity network. That made it clear early on that the attack was focused specifically on de-anonymizing Tor users. Tor Browser Bundle users who installed or manually updated after June 26 were safe from the exploit, according to the Tor Project’s security advisory on the hack.

  • Perhaps the strongest evidence that the attack was a law enforcement or intelligence operation was the limited functionality of the malware. The heart of the malicious Javascript was a tiny Windows executable hidden in a variable named “Magneto.” A traditional virus would use that executable to download and install a full-featured backdoor, so the hacker could come in later and steal passwords, enlist the computer in a DDoS botnet, and generally do all the other nasty things that happen to a hacked Windows box. But the Magneto code didn’t download anything. It looked up the victim’s MAC address — a unique hardware identifier for the computer’s network or Wi-Fi card — and the victim’s Windows hostname. Then it sent it to a server in Northern Virginia server, bypassing Tor, to expose the user’s real IP address, coding the transmission as a standard HTTP web request.
  • The official IP allocation records maintained by the American Registry for Internet Numbers show the two Magneto-related IP addresses were part of a ghost block of eight addresses that have no organization listed. Those addresses trace no further than the Verizon Business data center in Ashburn, Virginia, 20 miles northwest of the Capital Beltway. The code’s behavior, and the command-and-control server’s Virginia placement, is also consistent with what’s known about the FBI’s “computer and internet protocol address verifier,” or CIPAV, the law enforcement spyware first reported by WIRED in 2007. Court documents and FBI files released under the FOIA have described the CIPAV as software the FBI can deliver through a browser exploit to gather information from the target’s machine and send it to an FBI server in Virginia. The FBI has been using the CIPAV since 2002 against hackers, online sexual predators, extortionists, and others, primarily to identify suspects who are disguising their location using proxy servers or anonymity services, like Tor. Prior to the Freedom Hosting attack, the code had been used sparingly, which kept it from leaking out and being analyzed.

    Taking down the entire Freedom Hosting service because some content was kiddie porn is reminiscent of the U.S. government's proxy take-down of Mega-Upload in New Zealand. Such actions that disable legitimate users or deny access to their data are in my opinion violative of the 1st and 4th Amendments.  It suppresses the Freedom of Speech and seizes more than the 4th Amendment allows.  That our own government would use malware for surveillance purposes under any circumstance is just plain chilling.

  • If there is one word missing from the United States government’s post-9/11 lexicon it is “accountability.” While perfectly legal though illicit sexual encounters apparently continue to rise to the level of high crimes and misdemeanors, leading to resignations, no one has been punished for malfeasance, torture, secret prisons, or extraordinary renditions. Indeed, the Obama administration stated in 2009 that it would not punish CIA torturers because it prefers to “look forward and not back,” a decision not to prosecute that was recently confirmed by Attorney General Eric Holder in two cases involving the deaths of detainees after particularly brutal Agency interrogations. What the White House decision almost certainly means is that the president would prefer to avoid a tussle with the Republicans in congress over national security that would inevitably reveal a great deal of dirty laundry belonging to both parties.
  • The bipartisan willingness to avoid confrontation over possible war crimes makes the recently completed 6,000 page long Senate Intelligence Committee report on CIA torture an extraordinary document. Though it is still classified and might well never see the light of day even in any sanitized or bowdlerized form, its principal conclusions have been leaking out in the media over the past two weeks. It directly addresses the principal argument that has been made by Bush administration devotees and continues to be advanced regarding the CIA torture agenda:  that vital information obtained by “enhanced interrogation techniques” led to the killing of Osama bin Laden. According to the report, no information obtained by torture was critical to the eventual assassination of the al-Qaeda leader, nor has it been found to be an indispensable element in any of the other terrorism cases that were examined by the Senate committee.
  • What exactly does that mean? It means that torture, far from being an essential tool in the counter-terrorism effort, has not provided information that could not be obtained elsewhere and using less coercive methods. Senator Diane Feinstein, who sits on the Senate Intelligence Committee and has had access to the entire classified document, elaborated, explaining that the investigation carried out by the Senate included every detainee held by CIA, examining “the conditions under which they were detained, how they were interrogated, the intelligence they actually provided and the accuracy or inaccuracy of CIA descriptions about the program to the White House, Department of Justice, Congress and others.” It “uncovers startling details about the CIA detention and interrogation program…” The report has 35,000 footnotes and investigators perused 6 million pages of official records, which is why it has taken more than two years to produce. The Senate inquiry’s conclusions inevitably lead to the assumption that there has been a whole lot of lying and obfuscation going on in connection with the so-called war on terror.

  • There are also other good reasons to oppose torture and torture by proxy through CIA rendition. Most people and governments worldwide believe that torture is immoral, a view that is generally shared by most Americans. Legally there is also a long tradition condemning torture. German and Japanese officers were executed after the Second World War for torturing prisoners and the principle was firmly established that torture, specifically including waterboarding, is a war crime. The US is signatory to the UN’s anti-torture convention and both the United States Code and specific acts of congress require prosecution of any government employee engaging in such activity. In practical terms, torture also opens up a door that should never be opened by anyone who genuinely cares about US soldiers, diplomats, and intelligence officers stationed at their peril around the world. To put it succinctly, if we do it to them, they will do it to us.
  • Torture advocates have assiduously cultivated a number of myths, most prominent of which is the “ticking time bomb.” This is a particular favorite of the redoubtable Alan Dershowitz and a number of prominent neocons. It goes like this – a terrorist is captured who has knowledge of an impending attack on a major civilian target, but he won’t cooperate. How to get the information?  Simple. Get an accommodating judge to issue a legal finding that enables you to torture him until he talks, thereby saving lives of innocent civilians. The only problem with the Dershowitz narrative is that there has never been an actual ticking time bomb. No terrorist has ever been captured, subjected to torture, and provided information that foiled an attack, not even in Israel where routine torture of suspected terrorists captured in flagrante used to be the case (but is now illegal). Advocating a policy of torture, with all that entails, based on a “what if” is fighting evil with more evil, not a solution.

Consider the situation of a person suspected of kidnapping a child who may still be alive; might government lawfully discard the suspect's right to remain silent, the presumption of innocence, and the right to trial by jury in order to torture the suspect for information about the child's whereabouts? Our Constitution commands otherwise.

  • Despite this, however, both under Clinton and Kerry, the State Department’s response to the violence and military and police impunity has largely been silence, along with continued U.S. aid to Honduran security forces. In “Hard Choices,” Clinton describes her role in the aftermath of the coup that brought about this dire situation. Her firsthand account is significant both for the confession of an important truth and for a crucial false testimony. First, the confession: Clinton admits that she used the power of her office to make sure that Zelaya would not return to office. “In the subsequent days [after the coup] I spoke with my counterparts around the hemisphere, including Secretary [Patricia] Espinosa in Mexico,” Clinton writes. “We strategized on a plan to restore order in Honduras and ensure that free and fair elections could be held quickly and legitimately, which would render the question of Zelaya moot.” This may not come as a surprise to those who followed the post-coup drama closely. (See my commentary from 2009 on Washington’s role in helping the coup succeed here, here and here.) But the official storyline, which was dutifully accepted by most in the media, was that the Obama administration actually opposed the coup and wanted Zelaya to return to office.
  • The question of Zelaya was anything but moot. Latin American leaders, the United Nations General Assembly and other international bodies vehemently demanded his immediate return to office. Clinton’s defiant and anti-democratic stance spurred a downward slide in U.S. relations with several Latin American countries, which has continued. It eroded the warm welcome and benefit of the doubt that even the leftist governments in region offered to the newly installed Obama administration a few months earlier. Clinton’s false testimony is even more revealing. She reports that Zelaya was arrested amid “fears that he was preparing to circumvent the constitution and extend his term in office.” This is simply not true. As Clinton must know, when Zelaya was kidnapped by the military and flown out of the country in his pajamas on June 28, 2009, he was trying to put a consultative, nonbinding poll on the ballot to ask voters whether they wanted to have a real referendum on reforming the constitution during the scheduled election in November. It is important to note that Zelaya was not eligible to run in that election. Even if he had gotten everything he wanted, it was impossible for Zelaya to extend his term in office. But this did not stop the extreme right in Honduras and the United States from using false charges of tampering with the constitution to justify the coup.

This appears to be a political calculation. There is little risk of losing votes for admitting her role in making most of the hemisphere’s governments disgusted with the United States. On the other side of the equation, there are influential interest groups and significant campaign money to be raised from the right-wing Latin American lobby, including Floridian Cuban-Americans and their political fundraisers.

  • What beats me is why more Democrats aren’t deeply troubled by the legacy of Clinton’s foreign policy blunder in Honduras. Maybe you’ve forgotten what happened in that small country in the first year of the Obama administration — more on that in a moment. But surely you’ve noticed the ugly wave of xenophobia greeting a growing number of Central American child refugees arriving on our southern border. Some of President Barack Obama’s supporters are trying to blame this immigration crisis on the Bush administration because of an anti-trafficking law George W. signed in 2008 specifically written to protect Central American children that preceded an uptick in their arrivals. But which country is the top source of kids crossing the border? Honduras, home to the world’s highest murder rate, Latin America’s worst economic inequality, and a repressive U.S.-backed government. When Honduran military forces allied with rightist lawmakers ousted democratically elected President Manuel Zelaya in 2009, then-Secretary of State Clinton sided with the armed forces and fought global pressure to reinstate him.
  • Washington wields great influence over Honduras, thanks to the numerous military bases built with U.S. funds where training and joint military and anti-drug operations take place. Since the coup, nearly $350 million in U.S. assistance, including more than $50 million in military aid has poured into the country. That’s a lot of investment in a nation where the police, the military, and private security forces are killing people with alarming frequency and impunity, according to Human Rights Watch. In short, desperate Honduran children are seeking refuge from a human rights nightmare that would cast a dark cloud over Clinton’s presidential bid right now if the media were paying any attention. That wouldn’t give Republicans a big advantage, of course. Until they stop alienating a majority of female voters and communities of color, I find it hard to see the party of Mitt Romney and John McCain winning the White House.
  • Given the Democratic Party’s demographic edge, progressives have nothing to lose by seizing on the GOP field’s weakness and pressing for a viable alternative to another Clinton administration. Senator Elizabeth Warren could prove a contender. Unfortunately, the consumer-rights firebrand and Massachusetts Democrat lacks any foreign policy experience. And foreign policy is no afterthought these days. Israel — the recipient of $3.1 billion a year in U.S. military aid — is waging a ground war in Gaza, and the stakes in the Russia-Ukraine conflict just grew following the downing of that Malaysia Airlines jet. Plus, Iraq is growing more violent and unstable once more. On all these issues, Clinton is more hawkish than most of the Democratic base. But other Democrats with a wide range of liberal credentials and foreign policy expertise are signaling some interest in running, especially if Clinton ultimately sits out the race. Even if Clinton does win in 2016, a serious progressive primary challenge could help shape her presidency. As more and more Honduran kids cross our border in search of a safe haven, voters should take a good look at her track record at the State Department and reconsider the inevitability of another Clinton administration.

A request has been put into the EU Secretary General to provide all correspondence relating to the funding and training of the White Helmets. By law this information must be made transparent and available to the public. There has been a concerted campaign by a range of investigative journalists to expose the true roots of these Syria Civil Defence operatives, known as the White Helmets.  The most damning statement, however, did not come from us, but from their funders and backers in the US State Department who attempted to explain the US deportation of the prominent White Helmet leader, Raed Saleh, from Dulles airport on the 18th April 2016.

They’d said in June that Russian hackers had access to DNC servers for about a year.A company representative, identifying herself as Hannah Hammond, emailed Assange’s Swedish and British legal agents offering $1 million for him to appear in a five-minute tongue-in-cheek television advertisement. In a subsequent exchange Sept. 19, the representative wrote that “the source of the $1,000,000 is the Russian government.”In a curious twist, she offered what she said were three facts about Assange’s London attorney that are “unknown to the public,” including details inside her home and an event in her son’s life, suggesting a capability to conduct surveillance.Taylor, the Assange lawyer, said the details appeared “to create the impression that the members of his team were under close surveillance and/or to bolster the bona fides of the claim that the offer was linked to a State. Its inclusion does appear quite menacing.”

Mozilla Wants Heads-Up From FBI on Tor Browser Hack - 0 views

  • The maker of the Firefox browser is wading into an increasingly contentious court battle over an undisclosed security vulnerability the FBI used to track down anonymous users of a child-porn site. The FBI took over a dark web child-pornography site called Playpen last year and, rather than shut it down, used a secret, still-undisclosed vulnerability in the Tor Browser to install malware on the computers of more than 1,000 users that allowed the FBI to determine their locations. But in Tacoma, Washington, lawyers for a school administrator caught in the dragnet have successfully demanded the right to review the malware in order to pursue their argument that it, rather than he, was responsible for the illicit material ending up on his computer. The Tor Browser is a free browser that shields a user’s identity. It is also based on code from the Firefox browser. Mozilla, the organization behind Firefox, has long worried that the Tor Browser vulnerability might still be out there, could be exploited by bad actors, and could exist in Firefox, which is much more widely used than the Tor Browser.
  • So while it seems likely that the FBI will go to great lengths not to turn over the code – possibly dropping the case altogether – Mozilla’s top lawyer, Denelle Dixon-Thayer, is now arguing “that the government must disclose the vulnerability to us before it is disclosed to any other party.” She explained: “Court ordered disclosure of vulnerabilities should follow the best practice of advance disclosure that is standard in the security research community. In this instance, the judge should require the government to disclose the vulnerability to the affected technology companies first, so it can be patched quickly.” Dixon-Thayer noted that Mozilla isn’t taking sides, pro- or anti-disclosure. The issue of when the government should disclose security vulnerabilities is a hotly contested issue outside the courtroom as well.

The Debt To GDP Ratio For The Entire World: 286 Percent Washington's Blog - 0 views

  • Did you know that there is more than $28,000 of debt for every man, woman and child on the entire planet?  And since close to 3 billion of those people survive on less than 2 dollars a day, your share of that debt is going to be much larger than that.  If we took everything that the global economy produced this year and everything that the global economy produced next year and used it to pay all of this debt, it still would not be enough.  According to a recent report put out by the McKinsey Global Institute entitled “Debt and (not much) deleveraging“, the total amount of debt on our planet has grown from 142 trillion dollars at the end of 2007 to 199 trillion dollars today.  This is the largest mountain of debt in the history of the world, and those numbers mean that we are in substantially worse condition than we were just prior to the last financial crisis.
  • When it comes to debt, a lot of fingers get pointed at the United States, and rightly so.  Just prior to the last recession, the U.S. national debt was sitting at about 9 trillion dollars.  Today, it has crossed the 18 trillion dollar mark.  But of course the U.S. is not the only one that is guilty.  In fact, the McKinsey Global Institute says that debt levels have grown in all major economies since 2007.  The following is an excerpt from the report… Seven years after the bursting of a global credit bubble resulted in the worst financial crisis since the Great Depression, debt continues to grow. In fact, rather than reducing indebtedness, or deleveraging, all major economies today have higher levels of borrowing relative to GDP than they did in 2007. Global debt in these years has grown by $57 trillion, raising the ratio of debt to GDP by 17 percentage points (Exhibit 1). That poses new risks to financial stability and may undermine global economic growth. What is surprising is that debt has actually grown the most in China.  If you can believe it, total Chinese debt has grown from 7 trillion dollars in 2007 to 28 trillion dollars today.  Needless to say, that is absolutely insane…
  • What all of this means is that our long-term global economic problems have gotten much, much worse.  This short-lived period of relative stability that we have been enjoying has been fueled by unprecedented amounts of debt and voracious money printing.  Anyone with half a brain should be able to see that this is a giant financial bubble, and in the end it is going to unwind very, very painfully.  The following comes from a Canadian news source… At the beginning of 2008, government accounted for a smaller portion of the debt pie than corporate, household or financial debt. It now exceeds each of those other categories. “The current situation is much worse than in 2000 or 2007, and with interest rates near or at zero, the central banks have already used up their ammunition. Plus, the total indebtedness, especially the indebtedness of governments, is much higher than ever before,” said Claus Vogt, a Berlin-based analyst and co-author of a 2011 book titled The Global Debt Trap.
