  • On Wednesday, progressives were surprised to learn they were “split” on President Obama’s trade agenda. Few issues have galvanized the American left like trade promotion authority, legislation that would pave the way for the administration to fast-track trade negotiations and the Trans-Pacific Partnership (TPP) — the trade deal the Obama administration is working tirelessly to make a reality and many Democrats oppose. From senators to the activists that make up the organized left (trade unions, environmentalists, human rights advocates), progressives can’t stand the trade deal. Yet there it was in black and white: “RIFT AMONG PROGRESSIVES EMERGES ON TPP,” read a headline in Politico’s daily labor and employment tipsheet, Morning Shift. The short item detailed the emergence of the “Progressive Coalition for American Jobs ” — a group of “progressives and Democrats committed to leveling the playing field for American workers,” according to the coalition’s barebones website. The website adds that “it’s critical that we give the president trade promotion authority and establish the Trans-Pacific Partnership.”
  • There’s something weird about the group, though: No one in the Washington, D.C., progressive community seems to have ever heard of them before. “Who are they? Are they getting paid? And this group will convince anybody of what?” asked Sen. Sherrod Brown. “There is zero progressive interest in this [trade promotion authority].” The group’s website provides few details about when the coalition was launched or who’s working for the group. But the team behind the Progressive Coalition for American Jobs includes some of the most senior members of Obama’s campaign team. Lefty site Daily Kos reported Mitch Stewart, the former aide the president tapped to run Organizing For America, and Lynda Tran, the former OFA press secretary are involved. A press release earlier in the week announcing the group came from 270 Strategies, the campaign firm started by Stewart and Obama’s former field director, Jeremy Bird. Tran told BuzzFeed News the purpose of the group was to boost liberal voices who support the Obama trade agenda.
  • While there is Democratic support for increasing free trade and the White House has made an effort to placate progressives, arguing any deal will include tough language supporting labor rights and environmental protections, that message hasn’t landed with the left. The Progressive Caucus in the House has released their own set of trade principles arguing that they believe it’s “possible to negotiate a trade agreement that doesn’t replicate the mistakes of the past.” But as it currently stands, House progressives remain diametrically opposed to Obama’s trade agenda. “If you look at the progressives — labor unions, activists, online organizations — who are lined up against the TPP, there are no credible groups left to build a ‘coalition,’” said an aide to a progressive House member, who wasn’t authorized to speak on the record. “The creation of a front group like PCAJ is a sign people pushing for a bad trade deal don’t have the votes to jam the [trade deal] through Congress.”

  • A senior Democratic leadership aide told BuzzFeed News that the emergence of a group like the Progressive Coalition For American Jobs would bring “some modicum of balance” to the public discussion of the trade negotiations. “I do think it’s helpful to have an outside space for this to happen and for progressives to have a more balanced conversation about this,” the aide said. That’s not how everyone feels, however. With the emergence of the Progressive Coalition For American Jobs, some progressives got the feeling Obama’s allies were trying to flip the script. “It’s insulting,” said Candice Johnson, spokesperson for the Communications Workers of America, one of the many unions organized against TPP. “You put progressive in your name and that’s going to convince people?” She called the group “fake,” noting that it includes none of the biggest names in progressive politics in its coalition. Johnson wasn’t alone in that characterization. “As far as I know, the only thing ‘progressive’ about this so called ‘Progressive Coalition for American Jobs’ is the first word of the group’s name,” said Becky Bond, president of CREDO, the San Francisco-based progressive activist known to tangle publicly with the White House.

  • Negotiations held over the past 18 years toward resolving historic issues of land dispossession and conflicts over natural resources with indigenous peoples of the Americas are finally expected to reach consensus by May. “We were told there are some states very interested in getting the declaration done so we can move to another stage in the Organization of American States (OAS) and be able to enforce the rights recognized,” said Leonardo A. Crippa, a senior attorney for the Indian Law Resource Center in Washington. “It’s aiming to be completed by May so the text can be submitted for approval to the General Assembly of the OAS, which is meeting in D.C. in June.”
  • This process began in 1989, when the OAS General Assembly approved a resolution to ask the Inter-American Commission of Human Rights (IACHR) to prepare a declaration on the rights of indigenous people of North America, South America, Central America and the Caribbean. The IACHR submitted the first Draft American Declaration on the Rights of Indigenous Peoples in 1997. Also that year, the Indian Law Resource Center and other indigenous rights groups such as the Native American Rights Fund in Colorado petitioned the OAS to create a working group to discuss issues with member states and work toward reaching consensus on resolutions.
  • “We are doing our best to advise indigenous representatives, have discussions with the OAS, and compose language that is more defined than the U.N. Declaration [on the Rights of Indigenous Peoples] to reflect regional issues,” Crippa said. Yet, as Crippa notes, the United States and Canada, among other OAS states, have not accepted the jurisdiction of the Inter-American Court on Human Rights and continue to refuse to sign onto the draft declaration. A statement released by the U.S. delegation to the negotiations in March states: “The United States remains committed to addressing the urgent issues of indigenous peoples in the hemisphere, including combating societal discrimination against indigenous peoples, increasing indigenous participation in national political processes, addressing lack of infrastructure and poor living conditions in indigenous areas, and collaborating on issues of land rights and self governance.” It also notes that the U.S. “continues to believe the OAS can be mobilized to make a practical difference in the lives of indigenous peoples,” but reiterates that it refuses to sign the declaration.

  • The study also found that Brazil is the country with the greatest diversity of indigenous peoples in isolation, followed by Peru and Bolivia. The current version of the OAS declaration includes Article XXVI, agreed by consensus in 2005, specifically for indigenous peoples in voluntary isolation to have the right to remain in that condition and to live freely and in accordance with their cultures. “In most cases the key recommendation is to prevent contact either by state agencies, officials, non-government organizations or companies wanting to exploit resources of their lands,” Crippa said. Their ancestors lived on the land long before the current states even existed. Vulnerable and at risk of disappearing entirely, they cannot advocate for their own rights. The study cites the National Environment Commission of Peru’s findings that from 1950 to 1957 a total of 11 indigenous groups disappeared completely from the Amazon, and of those remaining, 18 are in grave danger of disappearing, as they each have fewer than 225 members.
  • “There are regional particulates that are unique and not defined in the U.N. Declaration [UNDRIP],” Crippa said. He used the example of people in the Americas living in voluntary isolation, emphasizing, “We need to protect these peoples from internal armed conflicts, such as in Colombia, where they’re caught in the middle of military, paramilitary and guerrilla forces. It’s a situation of a government of a country trying to control land of indigenous peoples without respect to their rights.” Indigenous peoples in voluntary isolation are groups or individuals who remain untouched by non-indigenous populations. They do not maintain contact with non-indigenous populations, may reject any type of contact, or may have chosen to return to their traditional culture and break relations with non-native societies in favor of maintaining their own ways of life. A provision to protect indigenous communities living in isolation has been approved in the OAS draft declaration, which has no corresponding provision in UNDRIP.
  • When efforts to resolve issues have failed to find remedy in their own country, the IACHR can be appealed to. All 35 member states of the OAS are under the jurisdiction of the IACHR, headquartered in Washington. No country can be a part of the OAS process without ratifying the OAS Charter. “All 35 member countries have signed the Declaration on the Rights and Duties of Man of 1948,” said Maria Isabel Rivera, director of Press and Publications for the IACHR. “This means the Commission analyzes all cases and petitions and monitors human rights situations in those countries under the light of the rights recognized in the Declaration.” Countries that have not ratified the convention include the Bahamas, Belize, Canada, Cuba, Guyana, St Kitts and Nevis, St. Lucia, St. Vincent and the Grenadines, and the U.S. Thus, cases originating in these countries cannot be brought to the Inter-American Court of Human Rights, but they can be brought to IACHR in a petition of injustice.
  • The OAS draft declaration recommends protections including legislation that specifically addresses indigenous rights to land, culture and self-determination, and training programs for state employees, who may encounter issues that affect communities living in voluntary isolation. It further recommends studies for projects which take into account people living in isolation nearby, and sanctions for those violating natural resources protections. It also calls for limiting commercial tourism in the territories of people living in voluntary isolation and urges companies, organizations and governments to work in coordination with indigenous groups which aim to protect indigenous rights toward free and prior consent. “Indigenous peoples have the right to maintain, express, and freely develop their cultural identity in all respects, free from any external attempt at assimilation,” the draft also states. “The States shall not carry out, adopt, support, or favor any policy to assimilate the indigenous peoples or to destroy their cultures.”

Here are the key highlights: Israel has become a deeply partisan issue for ordinary Americans as well as for politicians in Washington, a shift that may represent a watershed moment in foreign policy and carry implications for domestic politics after decades of general bipartisan consensus. Republicans by a ratio of more than 2-to-1 say the US should support Israel even when its stances diverge with American interests, a new Bloomberg Politics poll finds. Democrats, by roughly the same ratio, say the opposite is true and that the US must pursue its own interests over Israel’s.
  • Further illustrating how sharply partisan the debate has become, Republicans say they feel more sympathetic to Israeli Prime Minister Benjamin Netanyahu than to their own president, 67 percent to 16 percent, while Democrats are more sympathetic to President Barack Obama than to Israel’s prime minister, 76 percent to 9 percent. The survey also highlights how differently the nuclear negotiations with Iran are seen between Republicans and Democrats. Democrats, by a nearly 3-to-1 ratio, said they were more optimistic than pessimistic that a tentative deal with Iran announced this month will contain Iran’s ability to get nuclear weapons and thus make the world safer.

  • The poll also shows, as Glenn Greenwald puts it at The Intercept, that “religious fanaticism is a huge factor in Americans’ support for Israel.” Bloomberg Politics finds that “Born-again Christians are more likely than overall poll respondents, 58 percent to 35 percent, to back Israel regardless of US interests. Americans with no religious affiliation were the least likely to feel this way, at 26 percent.” “The US media loves to mock adversary nations, especially Muslim ones, for being driven by religious extremism, but that is undeniably a major factor, arguably the most significant one, in explaining fervent support for Israel among the American populace,” Greenwald observes.
  • The poll also confirms that Israel is increasingly becoming a niche issue of the right: “62 percent of self-identified conservatives say supporting Israel is key, while that drops to 35 percent among moderates,” the poll states.
  • This is all in line with broader trends in recent years: an increasingly multicultural and younger America is moving to the left, while an older, whiter, more Christian America that is in demographic decline has been moving to the right. What’s striking is that Hillary Clinton’s campaign launch video – featuring multiracial families, single moms and a gay couple about to get married – was calculated to appeal to the America that is increasingly alienated from Israel and the conservatives who love it. The America Hillary Clinton is trying to woo is moving away from Israel. Will the presidential hopeful and the Democratic Party leadership follow? I wouldn’t bet on it any time soon, but the trends are hard to ignore.

  • Americans are dying at a shockingly high rate from preventable causes, found a first-of-its-kind global health study published late Thursday. The new research demonstrates that despite the fact that the U.S. has the largest economy in the world, healthcare for many of its residents is woefully inadequate. The U.S. was tied with Estonia and Montenegro, far below other wealthy nations such as Norway, Canada, and Australia, in the study’s ranking of 195 countries. “America’s ranking is an embarrassment, especially considering the U.S. spends more than $9,000 per person on health care annually, more than any other country,” said Dr. Christopher Murray, senior author of the study and director of the Institute for Health Metrics and Evaluation (IHME) at the University of Washington. “Anyone with a stake in the current healthcare debate, including elected officials at the federal, state, and local levels, should take a look at where the U.S. is falling short.”
  • Progressives have long pointed out that the U.S. is one of the only wealthy nations not to provide some form of government-mandated healthcare, exacerbating inequality in healthcare outcomes. The study published in the Lancet created a Healthcare Access and Quality (HAQ) Index, “a summary measure based on 32 causes, that in the presence of high-quality healthcare, should not result in death,” the researchers wrote. “Using deaths that could be avoided as a measure of the quality of a health system is not new but what makes this study so important is its scope, drawing on the vast data resources assembled by the Global Burden of Disease team to go beyond earlier work in rich countries to cover the entire world in great detail, as well as the development of a means to assess what a country should be able to achieve,” said Professor Martin McKee of the London School of Hygiene & Tropical Medicine, who participated in the study. Causes examined by the study include tuberculosis, diarrhea-related diseases, lower and upper respiratory infections, leukemia, breast cancer, Hodgkin’s lymphoma, measles, tetanus, appendicitis, epilepsy, diabetes, and others. “The United States measures well for diseases preventable by vaccines, such as diphtheria and measles, but it gets almost failing grades for nine other conditions that can lead to death,” reported the Washington Post. “These are lower respiratory infections, neonatal disorders, non-melanoma skin cancer, Hodgkin’s lymphoma, ischemic heart disease, hypertensive heart disease, diabetes, chronic kidney disease, and the adverse effects of medical treatment itself.” “What we have found about healthcare access and quality is disturbing,” said Dr. Murray. “Having a strong economy does not guarantee good healthcare. Having great medical technology doesn’t either. We know this because people are not getting the care that should be expected for diseases with established treatments.”

  • Abstract Numerous polls demonstrate that U.S. public approval of President Harry Truman's decision to drop the atomic bombs on Hiroshima and Nagasaki has declined significantly since 1945. Many scholars and political figures argue that this decline constitutes compelling evidence of the emergence of a “nuclear taboo” or that the principle of noncombatant immunity has become a deeply held norm. An original survey experiment, recreating the situation that the United States faced in 1945 using a hypothetical U.S. war with Iran today, provides little support for the nuclear taboo thesis. In addition, it suggests that the U.S. public's support for the principle of noncombatant immunity is shallow and easily overcome by the pressures of war. When considering the use of nuclear weapons, the majority of Americans prioritize protecting U.S. troops and achieving American war aims, even when doing so would result in the deliberate killing of millions of foreign noncombatants. A number of individual-level traits—Republican Party identification, older age, and approval of the death penalty for convicted murderers—significantly increase support for using nuclear weapons against Iran. Women are no less willing (and, in some scenarios, more willing) than men to support nuclear weapons use. These findings highlight the limited extent to which the U.S. public has accepted the principles of just war doctrine and suggest that public opinion is unlikely to be a serious constraint on any president contemplating the use of nuclear weapons in the crucible of war. © 2017 by the President and Fellows of Harvard College and the Massachusetts Institute of Technology.

The absolute worst scandal that's emerged lately, and the worst administration scandal in American history is the IRS scandal. Why? Because you, the People, became the targets of a comprehensive federal government effort to stifle dissent, one made using the government's overwhelming and disproportionate policing and taxing powers. All of the other scandals, going back to Andrew Johnson's post-Civil War scandals, Warren G. Harding's 1920s Teapot Dome scandal, Nixon's Watergate, Reagan's Iran-Contra, and Clinton's Oval Office sexcapades have actually been narrowly focused acts of cronyism, garden-variety political chicanery, or personal failings. It's been insider stuff. The IRS scandal, by contrast, is a direct attack on the American people.   • In my view, the idea of a "soft landing" is an illusion based on the idea held by central bankers, themselves, that they have the wisdom and ability to know how to "micro-manage" the all the changes and adjustments resulting from their own manipulations of the monetary aggregates. They do not have this wisdom and ability. So hold on for what is most likely to be another rocky road.

Like a night prowler with a bag of stolen goods suddenly caught in a powerful Klieg light, it now finds itself under the glare of nonstop press coverage, accused of robbing the public of its right to privacy. Despite the standard denials from the agency’s public relations office, the documents outline a massive operation to secretly keep track of everyone’s phone calls on a daily basis – billions upon billions of private records; and another to reroute the pipes going in and out of Google, Apple, Yahoo, and the other Internet giants through Fort Meade – figuratively if not literally. 
  • But long before Edward Snowden walked out of the NSA with his trove of documents, whistleblowers there had been trying for years to bring attention to the massive turn toward domestic spying that the agency was making.
  • Without documents to prove their claims, the agency simply dismissed them as falsehoods and much of the mainstream press simply accepted that. “We don’t hold data on U.S. citizens,” Alexander said in a talk at the American Enterprise Institute last summer, by which time he had been serving as the head of the NSA for six years. In response to a Fox News question, Alexander lied at length and in detail along the theme of "We don't hold data on U.S. citizens." With both Alexander and National Intelligence DIrector James Clapper both now caught flat-out lying about keeping records on Americans, why should any Executive Branch statements about the scope of their domestic spying be trusted in the least, given that any official statement on the topic would have to rely on information provided by these two men. We know that they are perfectly willing to lie to the public on that topic.

      Huh?  Matt is one really hardcore Democrat.  The truth is that the first vote on TARP failed in the House 205-228, with one member not voting. House Democrats voted 140-95 in favor of the legislation, while Republicans voted 133-65 against it.  It's the 95 Democrats plus 133 Repubicans that defeated TARP I. The revised HR1424 was received from the Senate by the House, and on October 3, it voted 263-171 to enact the bill into law. Democrats voted 172 to 63 in favor of the legislation, while Republicans voted 108 to 91 against it; overall, 33 Democrats and 24 Republicans who had previously voted against the bill supported it on the second vote.[6][12]

  • Newly released documents confirm what critics have long suspected—that the National Security Agency, a component of the Defense Department, is engaged in unconstitutional surveillance of Americans' communications, including their telephone calls and emails. The documents show that the NSA is conducting sweeping surveillance of Americans' international communications, that it is acquiring many purely domestic communications as well, and that the rules that supposedly protect Americans' privacy are weak and riddled with exceptions.
  • 3. The Procedures permit the government to conduct surveillance that has no real connection to the government's foreign intelligence interests. One of the fundamental problems with the Act is that it permits the government to conduct surveillance without probable cause or individualized suspicion. It permits the government to monitor people who aren't even thought to be doing anything wrong, and to do so without particularized warrants or meaningful review by impartial judges. Government officials have placed heavy emphasis on the fact that the Act allows the government to conduct surveillance only if one of its purposes is to gather "foreign intelligence information." That term, though, is defined very broadly to include not only information about terrorism but also information about intelligence activities, the national defense, and even "the foreign affairs of the United States." The Procedures weaken the limitation further. Among the things the NSA examines to determine whether a particular email address or phone number will be used to exchange foreign intelligence information is whether it has been used in the past to communicate with foreigners. Another is whether it is listed in a foreigner's address book. In other words, the NSA seems to equate a propensity to communicate with foreigners with a propensity to communicate foreign intelligence information. The effect is to bring virtually every international communication within the reach of the NSA's surveillance.

Have you ever communicated with a foreigner? Have any of your communications ever been routed through servers in a foreign country? (The way the Internet works, it is an everyday event for just about anyone.) Does that constitute communication with a foreigner?  One of the many giant loopholes in the NSA's leaked procedures document for "minimizing" the collection of data on U.S. citizens.

    Wow.  I remember Paul Craig Roberts writing on the backpage of NewsWeek Magazine, back in the late 1960's.  Wow, we've come a long way since the days of protesting the Vietnam War, the socialism behind LBJ's Great Society, and the outrageous coup d'état that took place with the in-your-face-America assassination of JFK.  The circle is almost complete. The government, they said, wants to avoid a constitutional challenge to the law, which governs a National Security Agency surveillance program that has once again become the focus of national debate over its reach into Americans’ private communications.“Whenever it is good for the government to brag about its success, it speaks loudly and publicly,” lawyers Thomas Durkin and Joshua Herman wrote in their motion. “When a criminal defendant’s constitutional rights are at stake, however, it quickly and unequivocally clams up under the guise of State Secrets.”

The law permits the interception of foreign targets’ ­e-mails and phone calls without an individual warrant, including when the foreigners are in communication with Americans or legal residents.The U.S. Supreme Court in February rejected a constitutional challenge to Section 702 by a group of journalists, lawyers and human rights advocates, saying they had no standing to sue because they had not proved that their communications had been intercepted.But the court also said that if the government intends to use information derived from the Section 702 surveillance in a prosecution “it must provide advance notice of its intent,” and a defendant may challenge the lawfulness of the surveillance. The government assured the court that it would give such notice to criminal defendants.In a filing this month in Chicago, U.S. Attorney Gary S. Shapiro refused to say whether the evidence was obtained under Section 702. Instead, he said, the government told Daoud the evidence was acquired pursuant to a traditional FISA court order, rather than under the expanded surveillance program authorized in 2008. A traditional order requires the government to go to a FISA judge and show probable cause that the target is an agent of a foreign power.Daoud’s attorneys say in their pleading that the government is being disingenuous. “We believe it is clear that the evidence . . . came from Section 702,” Durkin said in an interview. “Either Senator Feinstein’s information was correct in December 2012, or she was given wrong information. The government has never disputed what she said.”

Vladeck, a law professor at American University, said, “Everyone knows the role that Section 702 is playing in a case like this.” But, he said, “thanks in part to the Supreme Court, the government can use Section 702 and then never have to defend its constitutionality.”

    Another "sting" type prosecution where the FBI enticed a defendant to perform a terrorist act. But now a direct challenge to government refusal to disclose whether the email that triggered the government's interest in the defendant was unconstitutionally obtained. If so, long established criminal procedure would require that the email and all evidence discovered because of it would have to be excluded from trial unless the government could meet once of the narrow exceptions.
